RESOLUTION 91290-1 EXPRESSING THE APPRECIATION OF THE
BOARD OF SUPERVISORS OF ROANORE COUNTY TO G. ROY NESTER
FOR TWENTY-FIVE YEARS OF SERVICE TO ROANORE COUNTY
WHEREAS, G. Roy Nester was first employed on September
1, 1965, as aide to the Engineer and County Executive; and
WHEREAS, G. Roy Nester worked his way up to the highest
supervisory grades in the County by becoming Superintendent of
Public Works, Director of Facilities, Director of Buildings and
Grounds, and Assistant Director of General Services; and
WHEREAS, G. Roy Nester was instrumental in the early
development and County execution of residential trash collection,
municipal utilities support, street sign installation, landfill
operations, and buildings and grounds maintenance of County
facilities; and
WHEREAS, during his long tenure of service, G. Roy Nester
monitored, managed, and coordinated the expenditure of millions of
dollars year after year, and he continually produced operational
savings which were to the benefit of the County taxpayers; and
WHEREAS, G. Roy Nester has proven through his actions his
personal loyalty and dedications to Roanoke County and its welfare.
NOW, THEREFORE, BE IT RESOLVED, that the Board of
Supervisors of Roanoke County expresses its deepest appreciation
and the appreciation of the citizens of Roanoke County to G. Roy
Nester for twenty-five years of capable, loyal and dedicated
service to Roanoke County.
FURTHER, the Board of Supervisors does express its best
wishes for a happy, restful, and productive retirement.

WHEREAS, the members of emergency medical services teams
devote their lives to saving the lives of others; and emergency
medical services teams consist of emergency physicians, nurses,
emergency medical technicians, paramedics, educators, and
administrators; and
WHEREAS, the people of Roanoke County, Virginia, benefit
daily from the knowledge and skill of these trained individuals;
and advances in emergency medical care increase the number of lives
saved every year; and
WHEREAS, the professional organizations of providers of
emergency medical services promote research to improve and adapt
their skills as new methods of emergency treatment are developed;

encourage national standardization of training and testing of
emergency medical personnel and reciprocal recognition of training

The I-81 Corridor Council has submitted an application to the U.
S. Economic Development Administration for technical assistance
funds to begin work on the I-81 corridor project. Attached is a
letter from Wayne Strickland, chairman of the I-81 Corridor Council
outlining the research that they will undertake. The Council has
also requested support from the governing bodies of Western
Virginia for the concept of a strategic development plan for the
I-81 corridor.

FISCAL IMPACT
There is no financial impact for Roanoke County. This project will

Dear Elmer:
Following my last correspondence with you concerning the
desire of the I-81 Corridor Council. to expand its membership, I
would like to update you on the Council`s current efforts. We
will be submitting an application to the U.S. Economic
Development Administration for techc~ical assistance funds to
begin our initial work on the I-81 corridor project. This
research will entail: (1) an assessment of the current economic
condition of the Corridor region; (2) an assessment of recent
development trends; (3) identification of innovative development
trends and techniques for managing development of highway
interchanges; (4) development of an I-81 interchange
classification system; (5) a detailed examination of one
interchange in each planning district; and (6) a community
participation element to include local community leaders and
public meetings. We will be requesting $25,000 from EDA to be
matched with $8,000 from the Planning District Commissions in
western Virginia to pursue this initial work effort.
Over the last few weeks, we have received several letters of
support and interest from state and local officials, as well as
private sector organizations. If the development of a long-range
plan for western Virginia is to come to fruition, it is
imperative that local governments in the I-81 cororudo IIoa dlor
support this planning effort. An endorsement by y
Council of the concept of a strategic development plan for
western Virginia would be invaluable. To this end, I would like
to offer to address your governing body and provide them an
overview of the purpose and focus of this proposal. I would be

SUMMARY OF INFORMATION:
At its meeting of August 28, 1990, the Board directed the
County Attorney to prepare an appropriate resolution establishing
a future policy for the Board of Supervisors of Roanoke County,
Virginia, concerning the appointment of persons to serve upon
citizen boards and commissions. Specifically, the Board requested
that all future appointments of persons to citizen boards and
commissions be based upon the county residency status of that
person.
Attached is a draft resolution which accomplishes the purpose
of this directive.

BACKGROUND: The Roanoke County School Board has received a
$50,000.00 grant ($25,000 for 1990-91 and $25,000 for 1991-92)
which is 100 percent federally funded for a 2 + 2 program in
early childhood development. The school board is requesting an
appropriation of $25,000 to the Federal Programs Fund for 1990-
91; the remaining $25,000 will be budgeted for 1991-92. As with
the existing 2 + 2 program, Roanoke County Schools will be
cooperating with the school systems of Roanoke City, Salem City,
Botetourt County, Craig County, Franklin County, and Virginia
Western Community College. Funding will be used to articulate,
develop, and modify existing course offerings at the secondary
and post-secondary levels into a 2 + 2 concept in early childhood
development. The program will seek to open the communication and
articulation link between the area secondary schools, the
community college, and the child development .business community
and to develop partnerships with area secondary schools,
business, industry, community college and government. Inservice
training needs of teachers will be identified and training
resources provided. Mr. Garland Kidd, director of vocational and
adult education for Roanoke County Schools, will be present to
answer any questions related to the appropriation request.

been a successful technique in past County projects in which both
private and commercial interests are affected. This committee
would enable citizens and businesses to participate in the

THE ROANORE COIINTY RECYCLE ADVISORY COMMITTEE
The staff proposes the following scope, purpose and membership for
the committee:
SCOPE
The Recycle Advisory Committee will have primary concern with
issues pertaining to refuse recycling within the total Roanoke
County staff and school board administrative operations,
residential recycle collection and commercialjrecycle collection.
PURPOSE
To increase citizen awareness and participation in recycling.
To provide citizen input on the County recycle plan.
To review the recycle portion of the solid waste plan.
To monitor the County progress toward the recycle goals.
To aid in the implementation of County recycle policies.
To provide the board periodic reports on County recycling.
MEMBERSHIP
There will be eight (8) members on the committee. The committee
membership will be as follows:
1. One member from the Board of Supervisors - board
selected.
2. Four citizens (two from County businesses and two lay
citizens) - board appointees.

BACKGROUND'
SUMMARY OF INFORMATION:
On January 3, 1990, at the organizational meeting of the Board
of Supervisors of Roanoke County, Resolution No. 1390-1 was
adopted. This resolution established a schedule of meeting dates
for the calendar year 1990 for the Board of Supervisors.
At that time, staff anticipated that the scheduling of the
Annual Meeting of the Virginia Association of Counties might
conflict with scheduling a meeting of the Board of Supervisors for
the second Tuesday in November. Accordingly, staff suggested that
the Board schedule this meeting for Wednesday, November 14.
Subsequently, staff learned that the Annual Meeting of the
Virginia Association of Counties was scheduled for the following
weekend, November 18-20, 1990. Accordingly, it is recommended that
the Board amend its resolution establishing meeting dates for
calendar year 1990 by rescheduling its November 14, 1990 meeting
to Tuesday, November 13, 1990.
The attached resolution accomplishes this action as well as
specifying public notice of this change in meeting date.

Last year, Roanoke Rebos, Inc. approached this Board regranted
the adoption of a resolution in support of their being g

expressed by the Commissioner of the Revenue, the Board declined
to take action in support of any tax-exempt. status at that time.
SUMMARY OF INFORMATION:
Officials of Roanoke Rebos, Inc. have continued to meet with
Mr. Compton and the County Attorney's office in an effort to
provide more information about the functioning and operations of
this organization. The Commissioner's Office now feels that it has
a clearer understanding of the operations of R alif ed tax-exempt
and would not oppose their designation as a qu

WHEREAS, on August 14, 1990 the Board of Supervisors of
Roanoke County, Virginia, adopted Ordinance 81490-6 which
authorized the imposition of user fees for the Parks and Recreation
Department; and,
WHEREAS, on August 28, 1990, the Board voted to reconsider
this action and to repeal said ordinance; and,
WHEREAS, the Board hereby adopts an ordinance to authorize the
establishment of certain fees for certain recreational activities,
and to appropriate from the general fund sufficient resources to
defray the costs and expenses of these activities; and,
WHEREAS, the first reading of this ordinance was held on
September 12, 1990, and the second reading of this ordinance was
held on September 25, 1990.
BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That Ordinance No. 81490-6 is hereby repealed in its
entirety.
2. That the Director of the Roanoke County Department of
Parks and Recreation is hereby authorized to establish fees for
parks and recreation services and activities, subject to the
approval of the County Administrator, and subject to the following
standards:

a. Definitions:
Indirect costs include the general fund appropriation for
each of the cost centers associated with the recreation area based
on the previous fiscal year budget, plus the allocation of the
central administrative costs for the Department of Parks and
Recreation, and in the case of athletics, the share of the
ballfield maintenance, which is provided by the Parks Division of
the Department.
Direct costs relate to the specific costs of instructors
and associated supplies. The registration fee is proposed to be
established at $5 per participant, per activity and the membership
fee is proposed to be $10 annually for senior citizens, in lieu of
a registration fee.
b. Standards•
The standards are as follows:
i. For youth athletics the general fund of the
County shall subsidize all direct and indirect costs of these
activities. For fiscal year 1990-91 the amount of this subsidy
shall be $32,075.
ii. For community education and leisure arts the
fee shall be based upon a $5 registration fee, per participant,
plus 25$ of the indirect cost, plus 100 of the direct cost. In
any of the programs offered by these divisions primarily for youth
under 18 years of age, there shall be no $5 per participant
registration fee.
iii. For special events the fee shall be based upon

EXECUTIVE SUMMARY'
The purpose of these amendments of the Meals Tax Ordinance is
to increase the potential penalties for failure to file or pay
meals tax collections in order to improve collection of certain
delinquent accounts.
BACKGROUND•
When the Meals Tax Ordinance was originally adopted in 1988,
it was hoped that the threat of a Class 3 ent of meals otax cola
sufficient deterrent to insure prompt paym
lections by sellers of taxable food and beverages. Since that time

revenues in excess of $1,000.00.
SUMMARY OF INFORMATION:
These amendments have been drafted at the request of the
Commonwealth's Attorneys Office in order to provide more teeth in
the Meals Tax Ordinance for collection of delinquent tax proceeds.
In cases where the taxes owed to the Treasurer exceed $1,000.00,
the potential threat of a maximum $500.00 fine allowed for a Class
3 Misdemeanor has not been sufficient to insure prompt remittance
by the seller of these tax proceeds being held.
FISCAL IMPACTS:
There exists at least two different fiscal impacts . The first
impact is the potential for increased fines from successful
criminal prosecution of these offenses. The second impact is the
potential for prompt compliance with the payment provisions of the
ordinance arising from the deterrent effect of increased criminal
penalties.

WHEREAS, the Board of Supervisors of Roanoke County, Virginia,
by ordinance 51088-8 adopted a tax on prepared food and beverages
as authorized by § 58.1-3833 of the Code of Virginia, 1950, as
amended; and
WHEREAS, § 58.1-3916.1 authorizes a local governing body to
impose criminal penalties for refusal or willful failure to file
a tax return or for making false statements with the intent to
defraud in such returns; and
WHEREAS, since the effective date of this ordinance there have
been numerous prosecutions of businesses for failure to collect or
pay to the Treasurer of Roanoke County the tax levied upon prepared
food and beverages under Article VIII of Chapter 21 of the Roanoke
County Code; and
WHEREAS, the lack of stronger criminal penalties has caused
difficulty for the Office of the Commonwealth's Attorney of Roanoke
County and the Office of the Treasurer of Roanoke County in
collecting these taxes where the amount of such defalcation is
substantial; and
WHEREAS, the first reading of this ordinance was held on
September 11, 1990, and the second reading was held on September

BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That Article VIII, TAX ON PREPARED FOOD AND BEVERAGES, of
Chapter 21, TAXATION, of the Roanoke County Code, is hereby amended
and reenacted by amending Section 21-153, Section 21-157, Section
21-159, Section 21-160, Section 21-162, and Section 21-163 to read
and provide as follows:
Section 21-153. Returns ~-and remittances generally.
Every seller of food with respect to which a tax is
levied under this article shall make out a return ~, upon
such forms and setting forth such information as the
Commissioner of the Revenue may prescribe and require, showing
the amount of food charges collected and the tax required to
be collected, and shall sign and deliver such return t
to the Eeu Treasurer of Roanoke County with a remittance
of such tax. Such return ~~ and remittance shall be made
on or before the twentieth day of each month, covering the
amount of tax collected during the preceding month.
Section 21-157. Duty of seller when going out of business.
Whenever any seller required to collect and ~y pay to
the County a tax under this Article ~'~~~ shall cease to
operate or otherwise dispose of his business, any tax payable
under this article shall become immediately due and payable
and such person shall immediately make a return ~e}9e~ and pay
the tax due.

Section 21-159. Enforcement; duty of Commissioner of the
Revenue.
The Commissioner of the Revenue shall promulgate rules
and regulations for the interpretation, administration and
enforcement of this article. It shall also be the duty of the
Commissioner of the Revenue to ascertain the name of every
seller liable for the collection of the tax imposed by this
article, who fails, refuses or neglects to collect such tax
or to make the returns ~9- and remittances required by
this Article ~-~~. The Commissioner of the Revenue shall
have all of the enforcement powers as authorized by Article
1, Chapter 31 of Title 58.1 of the Code of Virginia, 1950, as
amended, for purposes of this Article.
Section 21-160. Procedure upon failure to collect, report,
etc.
If any seller, whose duty it is to do so shall fail or
refuse to collect the tax imposed under this Article ~~e
and to make within the time provided in this Article "'tee,
the returns ~g and remittances mentioned in this Article
..tee, the Commissioner of the Revenue shall proceed in such
manner as he may deem best to obtain facts and information on
which to base his estimate of the tax due. As soon as the
Commissioner of the Revenue shall procure such facts and
information as he is able to obtain upon which to base the
assessment of any tax. payable by any seller who has failed or
refused to collect such tax and to make such return ~ and
remittance, he shall proceed to determine and assess against
such seller the tax and penalties provided for by this Article
,tee and shall notify such seller, by registered mail sent
.~
to his last known place of address, of the total amount of
such tax and penalties and the total amount thereof shall be
payable within ten (10) days from the date such notice is
sent.
Section 21-162. Penalt of late remittance or false return.
(a) If any seller whose duty it is to do so shall fail
or refuse to file any return ~ required by this Article
~~e or to remit to the ~ Treasurer of Roanoke County
the tax require to be collected and paid under this Article
~-~~ within the time and in the amount specified in this
Article ..~~~, there shall be added to such tax by the
y Treasurer of Roanoke County a penalty in the amount of
ten (10) percent if the failure is not for more than thirty
(30) days, with an additional ten (10) percent of the total
amount of tax owed for each additional thirty (30) days or
fraction thereof during which the failure continues, not to
exceed twenty-five (25) percent in the aggregate, with a
minimum penalty of two dollars ($2.00).
(b) In the case of a false or fraudulent return with
intent to defraud the County of any tax due under this Article
""urziis2, a penalty of fifty (50) percent of the tax shall be
assessed against the person required to collect such tax.
Section 21-163. Violations of article.
ja) It shall be unlawful and a violation of this Chapter
for anv person to fail refuse or neglect to comply with anv
provision of this Article Such violation shall constitute (i)
a Class 3 misdemeanor if the amount of tax levied or assessed

in connection with any return required by this Article but
unpaid as of the date of conviction is $1 000.00 or less, or
iii) a Class 1 misdemeanor if the amount of tax levied.. or
assessed in connection with any return required by this
Article but unpaid as of the date of conviction is more than
$1,000.00.
~L Conviction of such violation shall not relieve any
person from the payment, collection or remittance of the taxes
provided for in this Article ~~~~. Any agreement by any
person to pay the taxes provided for in this Article _~2
by a series of installment payments shall not relieve any
person of criminal liability for violation of this Article
~~~~~until the full amount of taxes agreed to be paid by
such person is received by the Treasurer of Roanoke County.
Each failure, refusal, neglect or violation, and each day's
continuance thereof, shall constitute a separate offense.

EXECUTIVE SUMMARY:
The petitioners, Jerry and Martha Garrett, have requested that
the Board of Supervisors vacate the existing 15 foot Drainage
Easement, by Ordinance, because it serves no purpose.
BACKGROUND
In 1963, Franklin Investors, Inc., constructed and put to
record the first section of Penn Forest Subdivision. During the
construction of Verona Trail, the outlet of the storm sewer system
was located outside of the Drainage Easement.
The Department of Engineering, as a part of Roanoke County's
drainage maintenance program, corrected the Garrett's problem and
in return, was granted a Drainage Easement to cover the natural
drainage course.
Therefore, there being no further need for the existing
Drainage Easement, Jerry and Martha Garrett are requesting that
the Easement, described above, and shown on the attached map, be
vacated.

SUMMARY OF INFORMATION
Roanoke County is requesting that the described Easement be
vacated in accordance with Chapter 11, Title 15.1-482 (b), Code of
Virginia, 1950, as amended, by the adoption of the attached
Ordinance.
The Departments of Utility and Engineering, and the Virginia
Department of Transportation, have commented that they have no
objection to the proposed vacation.
The Public Hearing and the First Reading of the Ordinance was
held on August 28, 1990.

WHEREAS, in 1986 and 1987, in honor of her many
accomplishments and dedicated service, Mrs. Patsel was twice
named the Departmental Employee of the Year from the Commissioner
of the Revenue's Office, and
WHEREAS, in 1987, she was chosen as the Roanoke County
Employee of the Year, recognizing her excellence in performance
of job duties and display of service•to the public and to fellow
employees, and
WHEREAS, through her employment with Roanoke County,
Hope P. Patsel has been instrumental in improving the quality of
life for its citizens.
NOW, THEREFORE BE IT RESOLVED that the Board of
Supervisors of Roanoke County expresses its deepest appreciation
and the appreciation of the citizens of Roanoke County to HOPE P.
PATSEL for thirty years of capable, loyal, and dedicated service
to Roanoke County.
FURTHER, the Board of Supervisors does express its best
wishes for a happy, restful and productive retirement.

Mr. Hodge advised he recommended continuing on the
present course and updating the board throughout the year.
Supervisor Eddy advised he still supported a county recycling
advisory committee, explaining that many citizens are interested
in the subject and this would be an opportunity for them to
become involved.
Supervisor Eddy moved to create a Roanoke County
Recycling Advisory Committee and that the County Administrator
bring back recommendations on the makeup of the committee. In
response to a question from Supervisor Robers regarding the
makeup of the committee, Superviosr Eddy advised he has described
his recommendations in a previously written memorandum. Mr.
Hodge responded that he still felt this was a regional issue and
should be addressed regionally. •
Supervisor Johnson offered a substitute motion to refer
the matter to staff to bring back a recommendation at the next
meeting. The substitute motion was defeated by the following
recorded vote:

4. Approval of amendments to Employee Handbook
concerninc Police Department employees

Assistant Director of Human Resources Kathy Claytor
reported that one of the amendments provides procedural
guarantees to employees of the Police Department who serve in a
law enforcement capacity and are required by Title 2.1 of the
Code of Virginia. They apply to an officer who is subject to an
interrogation which could lead to dismissal, demotion, suspension
or transfer for punitive reasons. The second amendment increases
the number of days an employee may be suspended for disciplinary
action from five to twenty-one work days.
Supervisor Eddy moved to approve the amendments to the
Employee Handbook. The motion carried by the following recorded

1. Ordinance imposing or increasing user fees for the
Parks and Recreation Department. (CONTINUED FROM JULY 24, 1990).

Mr. Hodge reviewed what action has taken place
regarding this proposed ordinance. He advised that a compromise
had been reached with those organizations who had expressed
concern with the ordinance. He recommended approval of the
compromise and emphasized that no resident will be eliminated
from a program because of inability to pay the fee.
Supervisor Nickens moved to approve the ordinance as
modified by Supervisor Eddy's written suggestions. He withdrew
his motion to allow for citizen comments.
The following citizens spoke in opposition to the
proposed ordinance: •
1. Fred Corbett, 5522 Stearnes Avenue, questioned
facts sent to him in a letter from County Administrator Elmer
Hodge. He advised he was still in opposition to the fee.
2. Judy Moore, 7647 Apple Grove Lane, a Girl Scout
leader in the outdoor program, advised that costs to the Girl
Scouts would increase 30~ with the user fees. Assistant County
Administrator John Chambliss responded that they are looking at
ways to address this program and the new ordinance will eliminate

IMPOSING OR INCREASING OF CERTAIN
FEES FOR SERVICES FOR PARRS AND
RECREATION ACTIVITIES
WHEREAS, on September 20, 1989, the Board of
Supervisors of Roanoke County, Virginia, selected David M.
Griffith and Associates, Ltd. to conduct a detailed cost/revenue
study focusing upon an analysis of user fee services; and
WHEREAS, the purpose of said user fee study was to
calculate the full costs of providing specific services, compare
costs with the revenues received for these services, and
recommend fee levels to recover the full costs of services when
such fees are practical; and
WHEREAS, the Board has found that it is both equitable
and efficient to ensure that those individuals who benefit from
certain governmental services bear an appropriate portion of the
cost thereof while reducing general service cost subsidies; and
WHEREAS, as a result of said study the Board determined
that it was in the public interest to increase certain user fees,
as modified by staff recommendations, budget work sessions, and
citizen comments in order to recover a portion of the direct and
indirect costs of providing certain services as provided herein;
and
WHEREAS, the first reading on this ordinance was held
August 14, 1990

community education: leisure arts, outdoor adventure and adult
athletics, the fee shall be based upon a $5 registration fee, per
participant, plus 25$ of the indirect cost, plus 100$ of the
direct cost. In any of the programs offered by these divisions
primarily for youth under 18 years of age, there shall be no $5
per participant fee.
2) For youth athletics, in lieu of a
$5 registration fee per participant, the participating recreation
clubs and Department of Parks and Recreation may implement cost
savings and cost sharing alternatives to offset the revenue which
would have been generated through the suggested user fees.
3) For special events, the budget
shall recover 40$ of the indirect cost and 100$ of the direct
cost.
4) For therapeutics, there shall be a
recovery of 20~ of the direct cost.
5) For senior citizens, there shall be
a $10 membership fee, plus 100$ of direct cost associated with
the program.
2. That the Director shall develop guidelines for the
waiver or reduction of fees based upon demonstrable hardship and
inability to pay and shall implement related policies.
3. That the effective date of this ordinance and for
the imposition of the fees and charges authorized herein shall be
August 14, 1990.

Supervisor Johnson: advised that the Board of Zoning
Appeals had denied a request from a resident for a zoning
variance to park her trailer in front of the building line. He
pointed out this could be a hardship on some families and asked
the County Attorney to research the issue and bring back a
recommendation on a possible ordinance revision. Supervisor Eddy
suggested including the Planning Commission in these discussions.
Supervisor McGraw: (1) Announced that the VACo
Executive Director Search Committee had met in Charlottesville
and plan to have someone hired and in place by November. (2)
Announced he felt that the SDN Research Report on consolidation
was slanted and the facts were misconstrued. Supervisors Johnson
and Nickens concurred and board members expressed concern about
the local newspaper editorial. He asked the County Administrator
to review the final report and bring back to the Board a full
report on the research, and further requested that the
information be published in Roanoke County Todav (3) Expressed
concern about a letter from Donna Wood and the Landfill Citizens
Advisory Committee stating that Montgomery County should not be
allowed to join the landfill. He asked that everyone keep an
open mind because the savings could reach $6 million if other
adjacent localities joined the landfill.

WHEREAS, the General Assembly of Virginia enacted legislation
to provide for a state lottery, providing that all monies received
from the sale of lottery tickets, less payments for prizes and
compensation of agents, shall be placed in a special fund known as
the "State Lottery Fund", and
WHEREAS, the Counties and Cities of the Commonwealth of
Virginia have become unduly dependent upon local taxation because
of underfunded and unfunded State mandates and the loss of Federal
Revenue Sharing monies, and
WHEREAS, it would be fair and equitable that a share of the
revenue generated by the sale of lottery tickets be returned to the
respective localities of sale.
NOW, THEREFORE BE IT RESOLVED that the Board of Supervisors
of Roanoke County, Virginia supports legislation to amend Section
58.1-4022 of the Code of Virginia, effective July 1, 1992, to
require the Treasurer of Virginia to transfer to the local
governing bodies of the Commonwealth of Virginia a sum equal to ten
percent of the gross receipts from the sale of lottery tickets in
each jurisdiction to be used as the local governing bodies deem
appropriate for the best interests of their citizens.
BE IT FURTHER RESOLVED, that a copy of this resolution be sent
to the appropriate state officials, the Virginia Association of
Counties, and the Virginia Municipal League.

COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF' INFORMATION
When the General Assembly approved a lottery for the State of
Virginia, the legislation provided that money received from the
sale of lottery tickets, less payment for prizes and compensation,
would be placed in a special fund known as the State Lottery Fund.
The Prince Edward County Board of Supervisors has adopted a
resolution requesting that a share of the lottery funds be returned
to localities with the local share based on a percentage of the
gross receipts from the sale of tickets in each jurisdiction.
Prince Edward County has requested that other localities adopt
similar resolutions and that they be forwarded to the appropriate
state officials the Virginia Association of Counties and the
Virginia Municipal League.
Several Board members have expressed support for this resolution
and requested that it be placed on the agenda for adoption.

and raffles are strictly regulated by Title 18.2-340.1 et. seg.
of the criminal statutes of the Virginia Code, and by Section
4-86 et, seg, of the Roanoke County Code. These laws authorize
the County Board of Supervisors to conduct a reasonable~investiga-
tion prior to granting a bingo or raffle permit. The Board has
sixty days from the filing of an application to grant or deny the
permit. The Board may deny, suspend, or revoke the permit of any
organization found not to be in strict compliance with county and
state law.
Any person violating county or state regulations concerning these
permits shall be guilty of a Class 1 misdemeanor. Any person who
uses any part of the gross receipts from bingo or raffles for any
purpose other than the lawful religious, charitable, community,
or educational purposes for which the organization is specifi-
cally organized, except for reasonable operating expenses, shall
be guilty of a Class 6 felony.

BACKGROUND•
In January 1990, the Board of Supervisors identified customer
service as one of their priorities. Several steps were taken to
respond to this priority. A Customer Service Resource Committee
was formed to promote sound customer service practices among all
Roanoke County employees and to provide advice and guidance for the
development, implementation and evaluation of a Customer Service
Training Program. A training coordinator was employed on a part-
time basis to develop and teach the program.
The committee reviewed and considered alternate approaches to
provide training for the County staff and chose, as a first step,
to develop and conduct an in-house customer service training
program.
SUMMARY OF INFORMATION
The training sessions were held during August. Approximately 70~
or 450 employees have attended the sessions. The overall
evaluation of the training by those attending was 3.7 out of a
possible 5.0.
Training Session
The sessions included the following
o A training manual
o two videotapes: "Ripples" which emphasizes how your
attitude affects others, and "Listen to Hear" which featured
County employees discussing listening skills and dealing with
citizen complaints.
o An opportunity for each employee to describe the operation
of his or her department and how the department provides
services to the public.

o Role playing of specific situations that county employees
face in dealing with citizens.
Results
Progress on this program has been excellent and comments on the
training have been very favorable. However, the training sessions
were just the first step. One the major problems identified by
those attending the sessions was the lack of knowledge by employees
about what other departments do and what services they provide.
Because county staff is located in various buildings throughout
Roanoke County, citizens become frustrated trying to locate the
proper building and staff to conduct business and employees don't
have enough information to assist them.
The Customer Service Resource Committee will continue to meet in
the future. They have held one meeting since the sessions were
completed and reviewed suggestions from employees for future
improved customer service.
These include:
o A better awareness by the employees of the responsibilities
of different departments throughout Roanoke County.
o A telephone directory cross referenced by subject so that
employees may assist citizens in finding the appropriate
department to solve their problems. (This will be included in
the next County Internal Telephone Directory scheduled for
publication this fall)
o A handbook for newcomers and other citizens outlining
available services and who to contact.

on citizen inquiries, requests and complaints.

SUMMARY OF INFORMATION
At the August 28th Board of Supervisors meeting, staff was directed
to analyze the results of the SDN Market Research Report and report
back at the September 12, 1990 meeting.
Since that time County staff has been reviewing the report and
analyzing the statistics. Several significant errors have been
found and these errors change perce~itages, per capita costs, and
conclusions noted in the text. It is anticipated that staff will
not complete the analysis until the middle of next week.
Following completion of the review, I will schedule a press
conference to provide the media with the results of the analysis.
Each board member will receive a copy of the results prior to the
press conference.

Dear Dr. Wilson:
As you are aware, the Roanoke County Education Association continues
to have grave concerns about the memorandum distributed by Paul Mahoney to
all Roanoke County employees on the topic of consolidation . Though the
Roanoke County Board or Supervisors nor the Roanoke County School Board
has taken official action regarding the memorandum, the distribution of and
wording of the memorandum has led employees to draw the conclusion that
it is indeed arr official policy statement; as a result, the memorandum and
subsequent discussions have had a chilling affect on the rights of employees
to exercise their First Amendment Right to voice opinion on matters of public
concern (i.e. consolidation).
Though the RCEA agrees with the premise that employees' opinion--either
for or against consolidation--should not be a disruption to the workplace or
an hindrance to the working relationships within the building, we believe that a
clarification is in order. We concede that the classroom and hallways of the
public buildings should remain "neutral ground , " but we maintain that employees
have the right afforded to them by the Constitution to speak to fellow staff
members and the public on matters of public concern before and after work hours
and during meals and breaks provided that such discussions are not disruptive.
The Roanoke County Education Association at this point remains neutral
on the topic of consolidation; however, we cannot remain neutral on your
employees rights to an opinion in the workplace and we believe that the
restriction presented by the County Attorney is not appropriate to your
employees .
We, therefore, seek from you an affirmative statement regarding the
right of school employees and confirmation that the bulletin boards in faculty
areas may be used to post materials relevant to matters of public concerns and
that information may be distributed at public functions, such as football games,
by employees and students .

I would like to relate to all of you a very positive experience
that I had this past weekend beginning at 8:00 p.m. Friday night
and continuing through to 7:00 a.m. Saturday morning when I rode
and worked with various members of the Roanoke County Police
Department.
Those that I came in contact with included Sgt. Chuck Mason who
formerly worked in "vice". He prefers the "power shift", which is
an overlap by a fifth platoon, "E" Platoon, to help in times of the
greatest need during the week. I also worked with Miguel Villarini
who has four years experience on the force and is one of the nine-
member "swat" team. He has three teenage children. Officer
Villarini is a Viet Nam veteran who saw action in Southeast Asia
during three different tours of duty in the early 70's. At that
time, he was in the Air Force and is now a Marine Reservist
anticipating being called to go to Saudia Arabia in the, near
future. The third officer with whom I rode was Wayne Haynes, a
seven-year veteran of the County force and a graduate of Radford
University in Crimi Ya ~ of to daughtercwho i sn now ten f monthsrolding

Other officers with whom I came in contact included Lt. L. B. Wade,
Sgt. Lee Linkous, and Officers Mike Warner, Carl Johnson, Tom
Kincaid, and Ed Shotwell. At the jail facility, I also talked with
Sgt. Lee who is employed within the County Sheriff's Department.

The types of situations and encounters that occurred during this
eleven hour period of time included two road checks at Route 419
in front of Promenade Park and on Williamson Raad at the
Lamplighter Mall entrance. At both of these road check locations,
several violations of invalid ~.nspectionrst kersato a more serious

DUI arrest were dealt with.
Officer Haynes and I spent a total of s severals d fferent dhotel
which time he was able to cruise by
locations in North County that were suspected of having drug
dealings on their premises. He ticketed two different drivers for
speeding, one a 62 MPH violation in a 45 MPH zone, and a 58 MPH in
a 35 MPH zone. Officer Haynes also was called upon ite obviously
lady who was lying in the middle of Woodhaven Road, qu
intoxicated, and to bring her to the Roanoke City jail for booking
and then return her to the Roanoke County jail. This occurred at
4 a.m. Officer Haynes was unable to take the lady directly to the
Roanoke County jail facility because currently there is no
magistrate working in that location after 3 a• lifiedl personnelto

Other types of observations included Officer Villarini's alert
recognition of youths in a County park after hours, the observation
by him of the need to P vent fema le cemployeesffromgbeingdharasseda
other such areas to p
illegal U-turns on Route 419, and other such encounters.
The one fact which was most educational to me was that the officers
are constantly on the alert and doing a great deal more than one
might readily assume when seeing an officer driving down the road
or sitting in a police cruiser in a parking lot. It is quite often
the case that at these times the officer is handling six or eight
different situations by listening to the various radios or by
observing all activities around him or her. The officers also all
seem to have a very good sense of humor. This probably takes the
edge off the intensity of their required duties. Each has a very
different style, even down to how the interior of the cars are
arranged or which types of radios, beyond the required minimum,
they choose to use.
I was extremely impressed with the conduct, professionalism and
alertness of all those above mentioned individuals and I am sure
that their abilities reflect the great majority of Roanoke County's
Police Department. This type of intensive survey of tour earliest
is one that I would recommend to all of you at y
convenience.

ROANOKE COUNTY POLICY STATEMENT ON CONSOLIDATION
During the months leading up to the consolidation referendum,
County staff will likely be questioned by citizens on that topic.
While every employee is entitled to his or her own personal opinion
on this subject, the County Board of Supervisors hasL adopted'the

which staff personnel may use as guidance in response to questions.
The consolidation plan itself is a result of hundreds of hours
of work by County and City staff members, including all department
heads. The actual details of daily operation have not been
included in the plan, because they will be the responsibility of
the governing body and administration of the merged government.
The consolidation referendum is scheduled for November 6,
1990. The scheduled date for consolidated government to begin
operation is July 1, 1993.
Roanoke County and Roanoke City are both viable, fiscally
sound jurisdictions that provide appropriate services to their
citizens. If the merger passes, the st-a€~Count will work
diligently to make sure that the transition occurs smoothly for
citizens and employees alike. If consolidation does not pass,
Roanoke County will continue to serve its residents promptly,
courteously and efficiently.
A copy of the consolidation plan and pro-forma budget is
available in every County library and at the Administration Center.
The members of the Board of Supervisors are always willing to
discuss this topic with the public. However, it is suggested that
County staff, as employees of all the County's citizens, remain
officially neutral on this matter.
This policy does not prevent staff members from responding to
citizen questions with statements of fact. Furthermore. this
policy does not prevent an employee from speaking or working for
or a ainst consolidation outside the work lace on his or her own
time.

In August, the Roanoke Valley Business Council held a press conference to
release the results of a study conducted by SDN Market Research on the economic
impact of the proposed consolidation of Roanoke County and Roanoke City. The Board
requested that staff review the study for accuracy and completeness because the reported
savings appeared to be excessive. Staff has completed the review and found that there
are numerous errors, incorrect conclusions, and projected savings that are unsupported.
Staff did not analyze the report from a position for or against consolidation. They
concentrated entirely on the accuracy and completeness of the data. They did not use
supplemental reports or information generated for the County to review the findings.
They simply verified the accuracy of the information drawn from the sources referred to
by SDN by comparing this data to the original documents and checking the computations.
Staff found many data extraction errors in the historical information which lead
to calculation errors and inaccurately drawn conclusions. These types of errors total
more than 140 through page 30. There may be additional errors that we were unable
to discern because of the unavailability of source materials. The errors appear to be
randomly distributed between the City and County. These mistakes are in addition to
the error admitted to by Mr. Marshall that will significantly change the projected savings
reported previously.
One example of an extraction error, can be found on Attachment A. SDN
reported that per capita expenditures for all local government functions except education
in the City of Roanoke expanded by a multiple of 4.2 between 1981 and 1988. When
the correct information was substituted for the incorrect information for 1981, the result
was an expansion of expenditures by a multiple of 1.375. Therefore, the increase in all
expenditure categories for Roanoke City between 1981 and 1988 is not 153.3% but rather
51.2%. The total increase for Roanoke County during this time period was 35%.

Another example, can be found on Attachment B. Revenues from other property
taxes for 1981 were improperly recorded as $11,991,000 for Roanoke County, producing
a net increase of only 1% between 1981 and 1988. When in fact, the correct amount
of revenue generated from other property taxes in 1981 was $7,991,000 producing instead
a net increase of 51.6%.
Other examples of errors can be found on the remaining attachments included
with this letter.
The historical data from 1981 to 1988 presumably was used by SDN to develop
the revenue and expenditure projections for 1993 through 2002. Therefore, any errors
recorded in the historical information must be corrected in the projection analysis to
make any conclusions valid.
In addition to the factual errors, the SDN report ignores the start-up costs
projected for RMG. Both the City and County staffs reviewed service delivery, service
enhancements, citizen needs and system capabilities to develop the pro-forma budget for
RMG. These conclusions were not used by SDN consultants. Neither were the $5
million in annual revenue enhancements included.
The SDN report compared Roanoke City and County to other localities that have
merged, including Lexington, Kentucky; Nashville, Tennessee; and Jacksonville, Florida.
As you will note these are major metropolitan areas outside of Virginia where taxing
authorities and other laws are different from those in our Commonwealth. Staff would
recommend that comparisons be made instead with Virginia localities that have merged
such as Virginia Beach and Chesapeake.
The staffs greatest concern is that SDN used assumptions in projecting future
growth and savings under a consolidated government that do not appear to be supported
in the report. For example, the report does not provide the basis for the use of a 50%
lower rate of growth for expenditures under RMG. Neither is there support for the
assumed growth rate in population used in SDN's per capita calculations. SDN assumed
an 11% rate of growth in a combined City/County population over ten years instead of
the rate of growth of 1.4% from 1981 to 1988.
In summary, the connections or relationships between the historical data provided
in the SDN report and the underlying assumptions in the revenue and expenditure
projections are not clearly stated, or at least appear incomplete.
Staff is willing to meet with SDN at a mutually agreeable time to discuss any or
all of their findings.

Every politician who is in Richmond, or
tried to get there-from the governor down
to members of General Assembly-seems to
have said at one time or another, "Gee, we j
sure think the localities should get a share
of the lottery money." That sounds great
during elections. It gets these politicians
votes. But when push comes to shove, we
get pushed and shoved.
It's time for that to stop. It's time for
Virginia localities to get what is rightfully
theirs. It's time for legislators to do what
they say they want to do. Who's stopping
them? Give some of the money back, ladies
and gentleman.
Is 10 percent too much to ask? We'll
let you-the servant keep the lionshare of
lottery profits. We'll settle for 10 percent of
what we spend on lottery tickets. Not a bad
deal, eh? Take us up on it then.
During the lottery's first year of opera-
tion $2 million was spent in Prince Edward
on tickets. Two million dollars is more than
the real estate tax revenue of every
Farmville area county combined. Rural
counties, in particular, cannot tolerate this
financial drain. "I he state government-
having learned from Big Brother in Wash-
ington-is good at telling us what to do.
Now we've got to go bankrupt upgrading
landfills. How can we pay for these
mandates. with the state keeping lottery
money from us?
Oh sure, lottery .funds have been sent
here or there for capital projects. but what
Virginia localities need is an annual return
on lottery proceeds. Not anevery-now-and-
then dispersal for state building projects or
money to correct a humidity problem in a
building at Longwood College. Get serious.
How can we pay for new landfill re-
quirements and state mandates in
education without more money? You keep
taking more of our cash to run things in
Richmond and seem to forget weWe got local
bills to pay. too.
Look, we know the state's constitution
doesn't mean youWe got to jump whenever
you're told to. But. under any reasonable
interpretation, it does mean that when the
citizens of Virginia make a reasonable re-
quest for necessary action'to benefit the
common good, you are to listen and you are
to pass such legislation.
Some elected and appointed state
officials may try to pooh-pooh Prince
Edward's plan by saying it won't return very
much money to the localities and so isn't
worth the fight. Good. if the plan won't i
return very much money then legislators
won't mind voting for the bill and the state ,
won't miss the .paltry sum. The plan will ,
return a significant amount of money to
localities irr dire need of additional revenue.
If the money doesn't mean much in Rich-
mond. send it back here where it obviously
means more.
By our reckoning. the PE plan would
mean a great deal to our friends and
neighbors across the state. Prince Edward
would have received nearly $200.000 last
year under its proposed bill. That'll buy
more than a cup of coffee in these parts.

We look forward to leadership from
Senator Howard P. Anderson and Delegates
Watkins M. Abbitt Jr. and Ted Bennett. who
will no doubt point the way for state elected
or appointed officials who can't see beyond
their plush offices and daily. stipends. With
the House of Delegates elections coming up
in the fall of 1991. support of Prince Ed-
ward's plan-or lack of it will be a major
issue in arty campaigns.
Look, all we're asking for is servant's
vvagesr-lO little pennies out of every dollar.
We're being agreeable about the whole ',
thing. We are. after all. the master in this
people-legislator relationship. But are we
asking for master's wages? No, we are not.
We aren't even asking for partner's 50-50
split. After expenses such as prizes and
adminstrative costs. the state will still keep
more than twice our share.
We, the masters. are humbling our-
selves and asking for a little bit of what's
ours.

As a member of Family
Living classes, Nicole
joined Future -Homemakers
of America and became
involved in STAR events
(Students Taking Action for
Recognition). Her member-
ship in Future Homemakers
of America enabled her to
enter the job interview
event.
The event requires prepara-
tion of a folder prior to the
live competition. The fold-
er included a resume', job
specification, application,
letter, and two letters of
reference. At the
competition site, Nicole
submitted her folder,
completed a job application,
had alive uzterview with
judges present, and wrote a
follow-up letter.
All entrants are judged
against a standazd rating

At the state event, Nicole

Nicole is the daughter of

Jones III. In addition to
her FHA activities, which
includes the position of
treasurer, she was

SADD, Science Club, and
Spanish Club. recently she
was picked as a Seventeen
Cover Model semi-finalist.
She has also worked part-
time as the front desk
manager of a local athletic
club. Next fall, she will be
attending James Madison
University.
