That for calendar year 1992, the regular meetings of the Board of Supervisors of Roanoke County, Virginia, shall be at the Roanoke County Administration Center on Brambleton Avenue, S.W., Roanoke County, Virginia. This provision applies to Main Motions and shall not apply to Privileged Motions, Subsidiary Motions, Incidental Motions, or Motions That Bring a Question Again Before the Board. Allen, Clerk Roanoke County Board of Supervisors cc: File Paul Mahoney, County Attorney John Chambliss, Assistant County Administrator John Hubbard, Assistant County Administrator Don Myers, Assistant County Administrator 3 ROANOKE COUNTY BOARD OF SUPERVISORS 1992 LEGISLATIVE REQUESTS MEETING WITH LEGISLATORS JANUARY 3, 1992 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, OCTOBER 22, 1991 ADOPTION 102291-4 OF A LEGISLATIVE PROGRAM FOR ROANORE COUNTY FOR THE 1992 SESSION OF THE VIRGINIA GENERAL ASSEMBLY WHEREAS, the Board of Supervisors of Roanoke County, Virginia, from time to time adopts a legislative program for submission to the General Assembly of the Commonwealth of Virginia in order to address issues of particular significance for and affecting the citizens of Roanoke County; and WHEREAS, Roanoke County generally supports the legislative initiatives of the Virginia Association of Counties and the Virginia Municipal League, organizations of which it is a member; and WHEREAS, the Board of Supervisors deems it to be in the interests of its citizens to adopt a legislative program for submission to the 1992 session of the Virginia General Assembly; and WHEREAS, this legislative program serves the public interest of the citizens of Roanoke County by addressing unique and particular needs of the County and its citizens. NOW, THEREFORE BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That legislation be adopted by the 1992 session of the Virginia General Assembly amending the Roanoke County Charter as follows: a. Amend § 2.02 to increase the authority of the County 1 to levy and collect taxes on hotel and motel rooms from 2% to 4%. b. Amend § 2.02 to authorize the County to impose a tax upon the sale or use of cigarettes or other tobacco products. c. Amend § 12.04 to authorize the Roanoke County School Board to set the school calendar and establish an earlier date for the opening of the school year and relieve the County from the post-Labor Day opening day requirement. d. Amend Chapter 5, Administrative Departments, by the addition of § 5.02 to provide for law enforcement funding by establishing a distribution of funds for law enforcement expenditures in an amount not less than the amount of expenditures to the county by the State Compensation Board for law enforcement purposes. 2. That the general laws of the Commonwealth of Virginia be amended as follows: a. Amend Article 10 of Title 14.1 to establish a distribution of funds for law enforcement expenditures for counties establishing a police force pursuant to referendum in an amount not less than the amount of expenditures to that county by the State Compensation Board for law enforcement purposes. b. Amend general law to provide for a beverage container deposit. c. Repeal the Dillon Rule. d. Amend § 59.1-274 to increase the number of enterprise zones. The General Assembly is requested to authorize the creation of additional enterprise zones so that Roanoke County 2 may seek such a designation either individually or jointly with adjacent jurisdictions. 3. That other legislative proposals for consideration by the 1992 session of the Virginia General Assembly are as follows: a. To amend state law as it relates to the Virginia Retirement System to allow pre-1981 employees to withdraw contributions. d. That the Clerk to the Board of Supervisors of Roanoke County, Virginia, is hereby directed to send a copy of this resolution to the members of the local legislative delegation. And further, that the County staff is hereby authorized to take such actions as may be necessary to support and implement these legislative initiatives. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia, hereby requests the General Assembly for the Commonwealth of Virginia to amend the Charter of the County of Roanoke as follows: 1• § 2.02. Taxing powers.--In addition to the powers granted by other sections of this charter and general laws, the county shall have the power to raise annually by taxes and assess- ments, as permitted and limited by genera law, in the county such sums of money as the board of supervisors shall deem necessary to pay the debts and defray the expenses of the county in such manner as the board of supervisors shall deem expedient. In addition to, but not as a limitation upon, this general grant of power the county shall have power to levy and collect ad valorum taxes for admission to or other charge for any public amusement, entertain- went, performance, exhibition, sport or athletic event in the county, which taxes may be added to and collected with the price of such admission or other charge; to levy and collect taxes on 1 hotel and motel rooms not to exceed t--- ---°---~ fat~r"~`~~~ of the amount charged for the occupancy thereof; to levy and collect taxes on the sale of meals, including nonalcoholic beverages, only as provided for by general law and such tax shall apply also to food prepared on premises and sold to take out, such tax is subject to limitations as may be imposed by general law; to levy and collect privilege taxes, local general retail sales and use taxes as provided by law; unless prohibited by law, to require licenses, prohibit the conduct of any business, profession, vocation or calling without such license, require taxes to be paid on such licenses in respect of all businesses, professions, vocations and callings not exempted by prohibition of general law; to franchise any business or calling so as to protect the public interest; and to require licenses of all owners of vehicles of all kinds or the privilege of using the streets and other public places in the county, require taxes to be paid on such licenses and prohibit the use of streets, alleys and other public places in the county without such license; €'>`e~ a~ tax t~.8 ~~~ ~~ uee. +?~. ~~~are~t~a~::::cs~ on tobacco roducts ear== y'- -~ a~~t those taxes specially authorized in Title 58.1 of the Code. ITEM NO. --~ AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: January 3, 1992 AGENDA ITEM: RESOLUTION ESTABLISHING A MEETING SCHEDULE FOR THE BOARD OF SUPERVISORS OF ROANOKE COUNTY FOR CALENDAR YEAR 1992 AND ADOPTING RULES OF PROCEDURE FOR SUCH MEETING COUNTY ADMINISTRATOR'S COMMENTS: O/~~~tt~ SUMMARY OF INFORMATION: In January of every year the Board of Supervisors reorganizes itself by electing a chairman and vice-chairman, by establishing a meeting schedule for the upcoming year, and by adopting rules of procedure. The attached resolution suggests a meeting schedule for the calendar year 1992 and certain rules of procedure to govern your meetings. In reviewing the proposed meeting schedule you should note the following: Regular meetings twice a month on the second and fourth Tuesdays (the evening public hearing meeting being scheduled for the fourth Tuesday of each month). Three meetings being scheduled for April to accommodate the review and adoption of the budget. Only one meeting scheduled for August (August 25, 1992) (often the need for formal board action decreases in the summer months, an abbreviated meeting schedule is followed by many localities). Only one meeting scheduled for November (November 17, 1992). December meetings scheduled for the first and third Tuesdays (the November and December meeting schedule changes are suggested to accommodate the holiday season). The 1993 organizational meeting is scheduled for Monday, January 4, 1993. Next, the Board will note that the rules of procedure are the same as previously adopted by the Board. It has been suggested 1 `~ that the rules of procedure be amended so that formal action at a Board meeting not be allowed unless that matter is shown on the printed Board meeting agenda, or is requested by the County Administrator or County Attorney as an item requiring immediate attention, or is approved by unanimous consent of the Board members present. The intent of this amendment is to provide the Board with the benefit of a staff report outlining the relevant facts and analyzing the alternatives. In anticipation of this proposal, it is suggested that the Board may want to consider the following as an amendment to the rules of procedure: 3. c. That no amendment or addition to the printed agenda be permitted unless approved by unanimous vote of all Board members present, unless requested by the County Administrator or the County Attorney as a matter requiring immediate attention. Nickens ;~7~~ December 16, 1991 RULES OF PROCEDURE FOR 1992 Lee, I have no problem with most of those matters identified in your memo of 12/9/91. I do raise objection though to an item contained in your last substantive paragraph and I find that to be in conflict with your first paragraph. Specifically, and I am quoting: ., I believe that any issue requested by a board member prior to the time the meeting agenda is printed should always be included on that agenda. This appears to me to be in conflict with your first paragraph statement that says: I believe that better results can always be achieved if the staff first prepares background information and alternatives, and .the Board members act after reflection and a reasonably complete understanding of the issue. Just because a Board member wants an item placed on the agenda, this should not necessarily cause that item to be placed there if it is going to require any background information to be sought out by our staff. For example, I can see calling in on Friday morning asking that something be added. Since the agenda is also printed and distributed Friday, staff would have absolutely no time to do any background checks, etc. I would be pleased to discuss this with you and other board members at the appropriate time.
