The Board of Supervisors of Roanoke County, Virginia met this day at the
Roanoke County Administration Center, this being a special meeting scheduled for
recognitions and held on the third Tuesday of the month of May 2009.
IN RE: CALL TO ORDER
Chairman Altizer called the meeting to order at 6:00 p.m. The roll call was
taken.

IN RE: OPENING CEREMONIES
The invocation was given by John M. Chambliss, Assistant County
Administrator. The Pledge of Allegiance was recited by all present.
IN RE: REQUESTS TO POSTPONE, ADD TO, OR CHANGE THE ORDER OF
AGENDA ITEMS
Supervisor Church requested that a new business item be added to
request moving the Edward Rose Properties public hearing scheduled for May 26,

2009, to June 23, 2009, at 7:00 p.m. He advised that the postponement would allow
sufficient time for the community to consider information to be presented at a
community meeting on May 21, 2009. He stated that he and Mr. Goodman concur with
the request and that they have been in discussions with the Virginia Department of
Transportation (VDOT).
Chairman Altizer advised that this request would require discussion by the
Board and recommended that the new business item be added after all of the
recognitions have been completed. There were no objections to adding the new
business item.
IN RE: NEW BUSINESS
1. Request to approve and appropriate u1~ to 20 000 for
construction of the veterans' monument at the Vinton War
Memorial for fiscal year 2008-2009 ~ Clayton Goodman III,
County Administrator)

Mr. Goodman informed the Board that he was familiar with the Vinton War
Memorial and the plans for construction of the veterans' monument. Roanoke County
previously approved a commitment of $30,000 and has received a request to provide
additional funding in the amount of $20,000. He stated that there are sufficient funds for
this appropriation in the Board Contingency Fund in the current budget. Mr. Goodman
recommended that the Board approve an appropriation not to exceed $20,000 for

construction of the veterans' monument to recognize the veterans who served from the
Town of Vinton and Roanoke County.
There was no discussion.
Supervisor Altizer moved to approve the staff recommendation
(appropriate up to $20,000 from the fiscal year 2008-2009 Board Contingency Fund to
the Town of Vinton as the County's additional contribution toward the construction of the
new veterans' monument at the Vinton War Memorial). The motion carried by the
following recorded vote:

IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS AND AWARDS
1. Proclamation declaring the week of May 17 through 23, 2009 as
Ruritan Week in Roanoke County
Chairman Altizer presented the proclamation to Marshall Minter,
President, and Bob Kilpatrick, Bonsack/Blue Ridge Ruritan Club, and Millie Rhodes,
Catawba Valley Club.
Mr. Minter expressed appreciation for the proclamation and remarked that
it is an honor for these three clubs to serve Roanoke County. They are having a special
drive this year to increase membership and look forward to serving the County in the
future.

The Board members thanked Mr. Minter and members of the clubs for
their efforts on behalf of the County citizens.
2. Certificate of recognition to Roanoke County Schools for being
selected one of the Best 100 Communities for Music Education in
America in 2009
Chairman Altizer presented the certificate of recognition to Barry Tucker,
Coordinator of Music and Performing Arts.
Mr. Tucker expressed appreciation for the recognition. He advised that
members of the School Board and Dr. Lorraine Lange, School Superintendent, could
not attend because they were attending a dinner for the school retirees. He advised that
the schools have won this award for six of the last seven years and they are the only
school in Southwest Virginia to win it. He introduced the teachers who were present for
the recognition: John Myers, Choir Director, Hidden Valley Middle and High Schools;
Katie Saunders, Choir Director, William Byrd Middle and High Schools; Dan Plybon,
Band Director, William Byrd High School; Glen Gray and Dustin McCollum, Band
Directors, Hidden Valley High School.
The Board members thanked Mr. Tucker and the teachers for their efforts
on behalf of the County students.
3. Certificates of recognition to the following All-State Band and
Choir winners:

Chairman Altizer presented certificates of recognition to Alexandria Smith,
Nigel Huckle and Eric Taylor. He advised that Emily Seibert was unable to attend.
Mr. Tucker noted that All-State awards are difficult to receive and are
tributes to the students' talents and abilities, as well as the quality of education provided
by the County. He expressed appreciation for the recognitions on behalf of the students
and the school system.
The Board members commented that they were proud of the students and
congratulated them on receiving the awards.
Supervisor Moore wished a happy 18t" birthday to Nigel Huckle and
congratulated him on receiving academic and talent scholarships. She remarked that all
three students present would be attending the Shenandoah Conservatory next year.
4. Recognition of students at Hidden Vallev High School:
(a) Resolution of congratulations to the Girls Swim Team for
winning a State Group AA Championship

Chairman Altizer and Supervisor McNamara presented the resolution to
Coach Sheri Vaughn and members of the team who were present. Certificates of
recognition were presented to the team members.

Coach Vaughn reported that the team set their sights on winning state
championships in February 2008. She noted that they dominated the state meet, which
was an amazing and phenomenal accomplishment.
The Board members thanked the coaches, parents and students for their
hard work and congratulated them.

RESOLUTION 051909-2 OF CONGRATULATIONS TO HIDDEN
VALLEY HIGH SCHOOL GIRLS SWIM TEAM FOR WINNING A STATE
GROUP AA CHAMPIONSHIP
WHEREAS, team sports are an important part of the curriculum at schools in
Roanoke County teaching cooperation, sportsmanship, and athletic skill; and
WHEREAS, the Hidden Valley High School girls swim team won their first Group
AA swimming championship at the University of Virginia Aquatic and Fitness Center on
February 28, 2009; and
WHEREAS, the team won with outstanding performances and outscored second-
place Lafayette by 308 to 182; and
WHEREAS, in addition to winning the team championship, the Titans also won
individual state titles while setting new state records for the following events: 100
freestyle, 100 backstroke, 500 freestyle, 200 medley relay, and 400 freestyle relay; and
WHEREAS, the members of the team include the following: Jill Bair, Caroline
Caldwell, Katie Campbell, Danielle Dillon, Drew Dillon, Lauren Gray, Devin Henry,
Lauren Hines, Ellen Hurley, Katherine Moles, Sami Norman, Lindsay Skolrood, and
Katie Young; and
WHEREAS, the team is coached by Sheri Vaughn.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of
Roanoke County, Virginia does hereby extend its sincere congratulations to the
HIDDEN VALLEY HIGH SCHOOL GIRLS SWIM TEAM for winning a State Group AA

Coach Lisa Sink-Morris and the team members who were present. Certificates of
recognition were presented to the team members.
Coach Sink-Morris expressed appreciation for the recognition. She
reported that 24 students competed at the state and national levels and the team
finished 47t" out of 84 teams at the national level. She advised that this is a voluntary
club at the school and that the students did a super job this year.
The Board members thanked the coaches, parents and students for their
hard work and congratulated them.

RESOLUTION 051909-3 OF CONGRATULATIONS TO THE HIDDEN
VALLEY HIGH SCHOOL ARCHERY TEAM FOR WINNING THE
VIRGINIA NATIONAL ARCHERY IN THE SCHOOLS PROGRAM
(NASP) STATE TOURNAMENT
WHEREAS, the Hidden Valley High School Archery team won the Virginia
National Archery in the Schools Program (NASP) State Tournament on February 28,
2009, in Fishersville, Virginia; and
WHEREAS, the State Tournament is the culminating event for Virginia schools
participating in the NASP; and
WHEREAS, the Titans finished first in the High School Division, scoring 2,972
points; and
WHEREAS, by winning the state championship, the Titans qualified to participate
in the National Tournament in Louisville, Kentucky; and
WHEREAS, the members of the team include the following: Molly Christopher,

5. Resolution of congratulations to the Northside Middle School

Coach Bob Shelton and the team members who were present. Certificates of
recognition were presented to the team members.
Coach Shelton expressed appreciation to the parents, organizations and
individuals for their support. He thanked the Virginia Department of Game and Inland
Fisheries for their efforts to get the program into the schools and the Virginia Chapter of
the Wild Turkey Federation for their financial support. He noted that, without everyone's
support, this program would not have been possible.
The Board members thanked the coaches, parents and students for their
hard work and congratulated them.

NORTHSIDE MIDDLE SCHOOL ARCHERY TEAM FOR WINNING THE
VIRGINIA NATIONAL ARCHERY IN THE SCHOOLS PROGRAM
(NASP) STATE TOURNAMENT
WHEREAS, the Northside Middle School Archery team won the Virginia National
Archery in the Schools Program (NASP) State Tournament on February 28, 2009, in
Fishersville, Virginia; and
WHEREAS, the State Tournament is the culminating event for Virginia schools
participating in the NASP; and
WHEREAS, the Northside team finished first in the Middle School Division,
scoring 2,714 points to win its second consecutive state championship; and
WHEREAS, by winning the state championship, the Northside Middle School
Team qualified to participate in the National Tournament in Louisville, Kentucky; and
WHEREAS, the members of the team include the following: Giovanni Allen-
Masu, Corey Besase, Jeremy Brown, Jordan Calloway, Amanda Cosgrove, Will Echols,

6. Recognition of students at William Byrd High School:
Chairman Altizer advised that Patrick Patterson, Guidance Coordinator,
was present for the recognition of the William Byrd High School students.
(a) Certificate of recognition to Jordan Gulli for winning 1st Place
in the Vir inia Science Fair Competition
Chairman Altizer and Supervisor Flora presented the certificate of
recognition to Ms. Gulli.
Mr. Patterson congratulated Ms. Gulli for receiving this award. He advised
that she is a student at the Governors School and this summer she was involved in the
Duke talent program. She will be going to Georgetown for a new leadership program.
She is a member of the Beta Club, an honorary society for the top academic students at
William Byrd High School.
Certificate of recognition to Melissa Wheeler for winning a
State Group AA Championship in divin
Chairman Altizer and Supervisor Flora presented the certificate of
recognition to Ms. Wheeler.
Mr. Patterson congratulated Ms. Wheeler for winning this championship.
He advised that she has a 3.8 grade point average and takes advanced placement
courses in many subjects. She has been active in Friendship Manor Health and
Rehabilitative Services in the Alzheimer's Unit. He advised that Ms. Wheeler is a
phenomenal athlete, wonderful student and a true competitor.

Group AA Championship in track
Chairman Altizer and Supervisor Flora presented the certificate of
recognition to Mr. Hall.
Mr. Patterson reported that Mr. Hall's major at Radford University will be
Parks and Recreation and Outdoor Management and he hopes that Mr. Hall will come
back and work for Roanoke County. He stated that Mr. Hall's interests include sports
climbing, kayaking and camping. He has been active in the Youth Conservation Corps.
Coach Eric Royal advised that a couple of years ago he asked Mr. Hall to
be the anchor for the track team and he responded by working extremely hard to set an
example for William Byrd High School, the Roanoke Valley and the State. He advised
that he was proud of Mr. Hall's accomplishments and that Mr. Hall was setting his sights
high for the future.
7. Resolution of congratulations to the William Byrd High School Air
Force Junior ROTC Program for being selected to receive the
2008-2009 Distinguished Unit Award

Chairman Altizer and Supervisor Flora presented the resolution to Major
Jeff Pruitt and Cadet Jacob Pruitt.
Major Pruitt advised that the ROTC is in its third year of existence and it is
their second year of winning this award, which is due to the cadets and the quality of the

students in the program. He introduced Cadet Jacob Pruitt, his son, and advised that he
was present to represent the Corps of Cadets. Major Pruitt advised that they
appreciated the support of the Board, the community and the school.
Each of the Board members expressed appreciation for the efforts of
Major Pruitt and congratulated the cadets.

RESOLUTION 051909-5 OF CONGRATULATIONS TO WILLIAM BYRD
HIGH SCHOOL AIR FORCE JUNIOR ROTC PROGRAM FOR BEING
SELECTED TO RECEIVE THE 2008-2009 DISTINGUISHED UNIT
AWARD
WHEREAS, the Air Force Junior Reserve Officer Training Corps (ROTC) was
established in 1966 with twenty units and has grown to 393 units throughout the world,
with more than 102,000 cadets; and
WHEREAS, the objectives of the Air Force Junior ROTC program are to educate
and train high school cadets in citizenship and life skills; promote community service;
instill responsibility, character, and self-discipline through character education; and to
provide instruction in air and space fundamentals; and
WHEREAS, the Air Force Junior ROTC Distinguished Unit Award is given in
recognition of units that have performed above and beyond normal expectations,
distinguished themselves through outstanding service to their school and community,
and meet the Air Force Junior ROTC mission of producing better citizens for America;
and
WHEREAS, the William Byrd High School Air Force Junior ROTC is comprised of
81 cadets who continually achieve the requirements for the Distinguished Unit Award,
and are to be commended for their dedication to the success of the unit.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of
Roanoke County, Virginia, does hereby extend its sincere congratulations to the
WILLIAM BYRD HIGH SCHOOL AIR FORCE JUNIOR ROTC PROGRAM for being
selected to receive the 2008-2009 Distinguished Unit Award; and

IN RE: NEW BUSINESS
1. Request to continue the Edward Rose Properties ublic hearing
scheduled for May 26' 2009, until June 23' 2009

Mr. Goodman explained that Supervisor Church requested by email that
the Board consider granting a continuance of the public hearing scheduled for the
Edward Rose Properties rezoning for thirty days from May 26, 2009, to June 23, 2009.
He stated that Supervisor Church informed him that a community meeting had been
scheduled for May 21, 2009, at 7:00 p.m. at the County Administration Center to
present information regarding the proposed development plans and land use issues. It
was Supervisor Church's thought that a continuance was justified to give the citizens an
opportunity to review the information from the May 21 meeting and the developer
sufficient time to respond to inquiries from citizens at that meeting.
Mr. Goodman stated that the continuance would have to be granted by the
Board and, if the continuance is granted, the developer of the Rose property, who is
from another state, needs to be informed as soon as possible to schedule accordingly.
Mr. Goodman advised that he and Supervisor Church had discussed the continuance at

length. He apologized regarding his failure to send a timely notice to Supervisor Church
and will make sure that it does not happen again.
Supervisor Church advised that he has been in touch with many citizens
directly affected by this rezoning and they are looking for a way to make this project a
workable and viable situation for the entire community. He and Mr. Goodman met with
VDOT officials four or five weeks ago and were informed that VDOT was willing to
reduce the speed limit from 40 mph to 35 mph for the extension from the Public Safety
Center back to Green Ridge Road.
Supervisor Church advised that there are still questions regarding VDOT's
involvement or, lack of involvement, pertaining to the safety and the traffic volume
generated from the new development, the commercial piece and the new
multigenerational center on Wood Haven Road. He advised that he thought it was right
to attempt to reach a compromise and give the citizens thirty days to receive more
information and suggest modifications if necessary. He stated that he and the citizens
are trying to do what is right for the community while bringing new business to the area.
Supervisor Moore advised that the petitioners have worked approximately
two years on this project and have been very accommodating to the citizens by having
several community meetings. She advised that she would agree to postponing the
public hearing for thirty days if that would help make it a safer project for the community.
Supervisor Flora stated that this item had already been advertised for
public hearing on May 26, 2009. He asked who would be responsible for the re-

advertisement of the public hearing if it was continued. Mr. Mahoney recommended that
the Board pay for the re-advertisement.
Supervisor Flora inquired if the petitioner had been advised of the possible
postponement and if they have responded to the request. Mr. Mahoney advised that he
has spoken with Mr. Layman, who is a partner with Woods Rogers and represents Rose
Properties. Mr. Mahoney responded that Mr. Layman had indicated to him that he would
attempt to attend the meeting; however, he was not present at today's meeting for
confirmation. Mr. Mahoney stated that when he spoke with Mr. Layman earlier this
afternoon, Mr. Layman advised that the postponement would pose a financial hardship
to the applicant because several of their real estate contracts for closings expire before
the Board's June 23 meeting and they would have some difficulty extending those
contracts.
Supervisor Flora asked if at the public hearing on May 26t" they found out
that the contracts do not expire until after the June 9t" meeting, could the Board make a
decision at the June 9t" meeting to delay action until the June 23rd meeting to have an
opportunity for further negotiations. Mr. Mahoney replied that he had no independent
knowledge with respect to the expiration dates of the contracts and it would be possible
for the Board to hold the public hearing on May 26t" and act at the meeting on June 9t";
however, Mr. Mahoney stated they might have a problem with delaying the decision if
there are any changes in the proffered conditions. He explained that State Code
requires that a new advertised public hearing be held if there are any changes to the

proffered conditions. There has been a recent amendment to the State Code that would
allow amendments to proffered conditions without having a new advertised public
hearing; however, the State Code says that those amendments shall not materially
change or affect the application and there is some flexibility as to what would trigger an
obligation to have a new advertised public hearing.
Supervisor Flora voiced that his point was that going forward with the
public hearing on May 26t" gives the Board an opportunity to find out the expiration
dates of the contracts and if they delay the public hearing until the June 23rd meeting,
this date may be after the contracts expire, which would effectively kill the project. Mr.
Mahoney responded that Mr. Layman is counsel for the petitioner and he would be
better able to advise the Board with respect to the expiration of the contracts.
Supervisor Flora stated that he was concerned that a delay would be a "back door" way
to kill the project and he would rather give the project a fair hearing.
Supervisor Church advised that it was not his intention whatsoever to do
anything "back door" with this project. Supervisor Flora re-stated his opinion that if the
Board continues the public hearing beyond the contract expiration dates, the petitioners
may not be able to get renewals or extensions and be unable to move forward with the
project.
Supervisor McNamara affirmed that the Board had been informed of the
developer's plans since the first reading of the ordinance was held and the public
hearing was scheduled for March 24t". He stated that the request was heard by the

Planning Commission and brought back to the Board on April 28, 2009, thirty-five days
later. He pointed out that at the April 28t" meeting, the Board continued the public
hearing until May 26t" because of questions and concerns that were not addressed
between March 24t" and April 28t". He reported that he received a call within days of the
April 28t" meeting from the developer asking how to make the project better and he and
Supervisor Moore met with the developer several weeks ago.
Supervisor McNamara asserted that the Board needs to make a decision
and they should not make a habit of postponing actions on rezonings. He stated that he
would prefer not to delay the matter to the June 9t" meeting because that is Election
Day and he may not be present at the meeting. He believes this is an excellent project
and the developer has been very responsive to the concerns of the citizens and County
and is holding another community meeting in addition to the two already held. He stated
that the County and citizens had sixty days to review the project and the Board should
hold the public hearing as scheduled and make a decision.
Supervisor Church advised that his intention for requesting a continuance
was to find ways to make the project better so it could be approved. He takes exception
to the statement by Supervisor McNamara that they had sixty days to work on the
project because he gave five specific dates to Ms. Laurie Corley (Project Manager for
Rose Properties) to discuss the project with him and none of the dates were acceptable.
He wanted the citizens to have the information from the May 21St meeting prior to the
public hearing so they could review it and discuss it fully with the developer. He

commented that the Board should be giving its best effort to work with VDOT, the
developer and the citizens to reach an amiable decision. He recounted that the only
reason he was requesting a continuance was to make the project successful and not in
any way to deny it.
Supervisor Altizer announced that he also met with the developer and he
questioned if they plan to have another community meeting because he felt the citizens
deserved to be fully informed. He stated that he would hold the public hearing on May
26t" as scheduled, request that VDOT staff be present and the Board would hear from
all citizens who wish to speak. At the May 26t" meeting, the Board would have the
option to approve or deny the rezoning or continue it to another meeting if other
concerns or issues are brought forward.
Supervisor Church moved to continue the Edward Rose Properties public
hearing until June 23, 2009. The motion was defeated by the following recorded vote:
AYES: Supervisors Moore, Church
NAYS: Supervisors Flora, McNamara, Altizer
Chairman Altizer advised that the Edward Rose Properties public hearing
will be held as scheduled on May 26, 2009.
IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor Flora: He congratulated the Roanoke County school
employees who were enjoying their retirement banquet this evening and advised that
Dr. Lange and other school officials were attending the banquet and were unable to

attend the Board meeting. He noted that there are a record number of retirees this year
and the banquet is being attended by 400 to 500 people. He understands there will also
be a large number of retirees next year.
Supervisor McNamara: He congratulated all the students who appeared
before the Board today. He stated that they have all done a great job and he wanted to
recognize them for their hard work. He voiced that, with all the news of things that are
going wrong in the world, it is nice to recognize the good things that happen.
Supervisor Moore: She congratulated all the students and their parents.
Supervisor Altizer: (1) He stated that it is a great evening when athletics
and arts can be recognized and he felt it was a great thing to have this special meeting
for recognitions. (2) He advised that the veterans' monument at the Vinton War
Memorial has broken ground. It will be a great testament to veterans who have given
the ultimate sacrifice so all citizens can enjoy freedom.
IN RE: ADJOURNMENT
Chairman Altizer adjourned the meeting at 1:31 p.m. to the regularly
scheduled Board meeting on Tuesday, May 26, 2009, at 3:00 p.m., and the evening
session at 1:00 p.m.
