SUBJECT: Proclamation Declaring Thomas E. (Gene) Wagner as Honorary
Life Chief for Mt. Pleasant Volunteer Fire Department
Included on the agenda for the organizational meeting is recognition of Mt. Pleasant
Fire Chief Gene Wagner's 39 years of service to Roanoke County.
This recognition is a surprise to him, so only the Board members and Elmer Hodge
will receive copies of the proclamation in their agenda packet. The only listing on
the agenda is "SPECIAL RECOGNITION".

ON TIIESDAY, JANIIARY 3, 1994
PROCLAMATION DECLARING THOMAS E. (GENE) WAGNER AS HONORARY
LIFE CHIEF FOR MT. PLEASANT VOLIINTEER FIRE DEPARTMENT
WHEREAS, Thomas E. Wagner was a charter member of the
Mt. Pleasant Fire Department in 1955, serving under Chief George C.
Foley; and
WHEREAS, Chief Wagner was appointed by the County of
Roanoke in August, 1958, as Chief of the Mt. Pleasant Fire
Department; and
WHEREAS, Chief Wagner retired from the County of Roanoke
in October, 1986, and was elected Chief of the Mt. Pleasant
Volunteer Fire Department on the same date; and
WHEREAS, Chief Wagner has served as a career or
volunteer member of the Mt. Pleasant Fire Department for a total of
39 years, 36 of those years as Chief; and
WHEREAS, Chief Wagner has been active in the Length of
Service Board; the Roanoke Valley Fire Chiefs Association; is a
Life Member of the State Fire Chiefs Association of Virginia; and
served as Chairman of the Roanoke County Fire Chiefs Board for many
years; and
WHEREAS, the Mt. Pleasant Volunteer Fire Department
wishes to honor Chief Wagner's service to the community by
bestowing upon him the title of "Honorary Life Chief" from this day
forward; and
NOW, THEREFORE, WE, the Board of Supervisors of Roanoke
County, Virginia, in recognition of the many contributions made by
Chief Wagner, do hereby proclaim and bestow upon THOMAS E. (GENE)

COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
In January of every year the Board of Supervisors reorganizes
itself by electing a chairman and vice-chairman, by establishing a
meeting schedule for the upcoming year, and by adopting rules of
procedure. The attached resolution suggests a meeting schedule for
the calendar year 1995 and certain rules of procedure to govern
your meetings.
In reviewing the proposed meeting schedule you should note the
following:
Regular meetings twice a month on the second and fourth
Tuesdays (the evening public hearing meeting being scheduled
for the fourth Tuesday of each month).
Three meetings being scheduled for April to accommodate the
review and adoption of the budget. Staff recommends meeting
on April 4, 11, and 25; however, this recommendation may
conflict with Easter (which is April 16, 1995) and Spring
Break for the schools.
Only one meeting scheduled for August (August 22, 1995) (often
the need for formal board action decreases in the summer
months, an abbreviated meeting schedule is followed by many
localities).
Only one meeting scheduled for November (November 21, 1995.)
Thanksgiving is November 23, 1995.
Only one meeting in December (December 12, 1995) (the November
and December meeting schedule change is suggested to
accommodate the holiday season and is similar to the 1994
schedule).

The 1995 organizational meeting is scheduled for Tuesday,
January 2, 1995.
Next, the Board will note that the rules of procedure are the
same as previously adopted by the Board.
STAFF RECOMMENDATION:
It is recommended that the Board consider the adoption of the
attached resolution.

EXECUTIVE SUMMARY'
Roanoke Moose Lodge #284 is requesting approval of its bingo
permit request. This item was continued from your meeting on
December 13, 1994, in order to verify compliance with Roanoke
County Code Section 4-101 (which requires use of 12.50 of gross
receipts from all bingo games and raffles for lawful charitable
purposes).
BACKGROUND'
Since the continuance of this request by the Board, counsel
for the Roanoke Moose Lodge #284 has contacted the County seeking
an explanation for this action. A copy of this attorney's
correspondence is attached. The Commissioner of the Revenue has
been requested to provide the Board with information concerning
this organizations compliance with the County Code. The
independent auditors report, correspondence from the Moose Lodge,
and the annual financial report are attached.
SUMMARY OF INFORMATION:
It appears that this organization is in compliance with the
provisions of the County Code. You will note, however, the
following from the attached materials:
1. Roanoke Moose Lodge #284 generated gross receipts of
$449,901 for the period 10/1/93 through 9/30/94.
2. 12.5% of these gross receipts is $56,238.
3. Roanoke Moose Lodge #284 paid itself $22,950 in rent.
4. Initial contributions totaled $35,861 of which $29,000
was for roof repairs.

5. On December 7, 1994, Roanoke Moose Lodge #284 determined
that its charitable contributions were in error, and it
reported additional commitments to achieve the required
total of $56,238. This included additional roof repairs
of $10,000.
6. Apart from $39,000 total in roof repairs, Roanoke Moose
Lodge #284 charitably made the following contributions:

Section 18.2-340.9 A. provides that the organization may
expend a portion of its gross receipts derived from bingo games and
raffles for reasonable and proper operating costs, payment of
prizes; lawful religious, charitable, community, or educational
purposes for which the organization is specifically chartered or
organized, and for expenses relating to the acquisition,
construction, maintenance, or repair of any interest in real
property involving the operation and used for lawful religious,
charitable, community, or educational purposes.
STAFF RECOMMENDATION:
Staff recommends that the Board review the attached materials
and provide an opportunity for a representative of the Roanoke
Moose Lodge #284 to speak in support of the granting of this
permit.

I appreciate the chance to talk with you Wednesday morning
regarding the matters at issue between the Roanoke Moose Lodge
and Roanoke County. I shall be representing the Lodge with
regard to the bingo permit as well as the unresolved public
admissions tax assessment.
Of primary concern to the Lodge is the failure of the
Board of Supervisors to renew the bingo permit for 1995 without
prior notice of a continuing question. In response to the
earlier inquiries from the Board of Supervisors, the Lodge had
provided Wayne Compton with a further list of charitable
contributions for the current year which brought the Lodge into
compliance with the ordinance requirement. Wayne Compton was
satisfied with that report and advised the Board of Supervisors
in his report of the Lodge's compliance and his recommendation
that the permit be issued.
Earlier in the permit application process, there had been
a question about the rent shown on the Annual Report with no
rent being paid in the prior quarter. No rent was paid
subsequent to receipt by the Lodge of your letter ruling on the
rent issue.
Wayne Compton had current information on both of these
issues. Had there been any indication of continuing questions
by one or more supervisors prior to the Board of Supervisors
meeting, Wayne Compton advises that he would have attended the
meeting, and a representative of the Lodge would have attended
as well.
The Roanoke Moose Lodge has operated its bingo game
successfully for several years without any allegations of
misuse or fraud as have circulated around other organizations
conducting bingo games. To put an end to their operation, even

temporarily, on two week's notice is patently unfair and
indicates a lack of sensitivity and consideration on the part
of the Board. A two-week interruption may be of no consequence
to the Board, but it is of considerable concern to the Lodge.
If the Board was unwilling to adopt the recommendation of the
Commissioner of Revenue, a conditional or temporary permit
would have protected the County's interests without working a
hardship on the Lodge.
The applicability of the County admissions tax remains
unresolved. T shall be available to meet with you or your
assistants in attempting to reach an ent to the controversy.

I have audited the accompanyiny financial report of the
Roanoke Lodge No. 284, Loyal Order of Moose, Bingo Account
for the period ended September 30, 1994. These financial
statements are the responsibility of the Roanoke Moose Lodge
No. 284. My responsibility is to express an opinion on
these financial s't°aternents based on my audit.
1 conducted my audit in accordance with yenerally accepted
auditing standards. Those standards require that I plan and
perform the audit to obtain reasonable assurance about
whether the financial statements are free of material
misstatement. An audit includes examining, on a test basis,
evidence supporting the amounts and disclosures in the
financial statements. An audit also includes assessing the
accountiny principles used and siynificant estimates made by
manayement, as well as'evaluatiny the overall financial
statement presentation. 1 believe that my audit provides a
reasonable basis for my opinion.
In my opinion, (i) the statement of receipts and
di sbursernerrts i s true arrd correct; (i i) the proceeds of any
bingo games or raffles operated by this oryanization have
been used for those lawful, reliyeous, charitable, community
or educational purposes for which the organization is
specifically chartered or oryanized and (iii) the gross
receipts have been used in all respects in accordance with
the provisions of the Roanoke County Code.

The Board of Supervisors postponed action on the request for your
current bingo permit and 50/50 raffle for calendar year 1995. They
want to review monies given to charity. Also, they will probably
want to go over the funds that were used to pay rent. Your annual
report includes rent whine the last quarter showed no such payment.
I think I can explain it to the supervisors, since the rent was
paid before a County Attorney's Ruling.
Effective January 1, 1995 please discontinue all bingo and 50/50
until notified. The next Board of Supervisors meeting is scheduled
for January 10, 1995.

not contribute the 12.5% ctzaritable donations required by
Title 18.2, Code of Virginia. Our contributions totaled

R880LIITION 121394-2 ADOPTING A LEGISLATIVE PROGRAM FOR
THE 1995 SEBBION OF THE VIRGINIA GENERAL ABSEMHLY, AND
PETITIONING THE GENERAL ASSEMBLY TO FAVORABLY CONSIDER
THE TOPICS AND I88IIE8 ADDRESSED HEREIN
WHEREAS, on June 14, 1994, the Board of Supervisors of Roanoke
County, Virginia, identified major legislative issues of state-wide
concern to be considered by the 1995 session of the Virginia
General Assembly; and
WHEREAS, the Board has recommended these issues to its state-
wide organization, the Virginia Association of Counties, for
consideration in the adoption of its legislative program; and
WHEREAS, the Board adopts this resolution as the Legislative
Program for Roanoke County for the 1995 session of the Virginia
General Assembly.
NOW, THEREFORE, Be It Resolved by the Board of Supervisors of
Roanoke County, Virginia, that the following legislative initia-
tives are submitted to the 1995 session of the Virginia General
Assembly for its favorable consideration and adoption.
I
A. Law Enforcement. The County urges the General Assembly
to restore funding for the H.B. 599 Program (State aid to
localities with police departments). During the 1994 session of
the Virginia General Assembly, the General Assembly restored only
$2.3 Million of $6.6 Million in HB 599 funding cut in the second
year of the biennium. Failure to restore this funding will result
in a loss of $57,550 for Roanoke County.

B. Frinae Benefits for Constitutional Officers The General
Assembly failed to restore funding for constitutional officers'
salary fringe benefits for FY 1996 (SB 560, which did not pass,
would have increased sheriffs' fees to offset the fringe benefit
costs). Restoring this funding is a top priority for Roanoke
County in the 1995 session of the General Assembly. Failure to
restore this funding will result in a loss of $317.241 for Roanoke
County.
C. Education. Realizing that public education is the
foundation of American democracy and the cornerstone of our future
economic well being, the County urges the General Assembly to
enhance funding for public education, including increasing the
funds available to the Literary Fund for local school capital
construction or renovation projects. Local school divisions should
be authorized to establish opening dates for school. Disparity
funding should be based not only upon the number of students
eligible for free or reduced fee lunches, but also upon the
locality's local tax effort in support of education. Disparity
funding should be based upon the composite index (which measures a
locality's relative fiscal ability to provide its share of the cost
of a local school system that meets the standards of quality) and
the locality's local effort in support of that school system.
D. The County supports continued funding by the General
Assembly of the Transportation Museum located in Roanoke City.
E. The County urges the General Assembly to continue its
financial support for the Virginia Recreational Facilities

Authority.
F. The County supports restoration of $2,898,000 to the
Governor's 1995-96 budget for Virginia Cooperative Extension and
the Virginia Agricultural Experiment Station.
G. Eoual Taxation and Borrowing Powers The County urges
the General Assembly to adopt legislation equalizing the taxing and
borrowing powers of counties with those powers granted to
municipalities.
H. Unfunded Mandates The County supports the reduction of
unfunded regulatory and statutory mandates and opposes any state
mandates on local governments without sufficient funding to cover
the costs of those mandates.
I. Property Rights The County petitions the General
Assembly to oppose legislation that would make environmental
protection and reasonable zoning actions by local governments in
the Commonwealth more difficult than current law allows. The
public interest is best served when enlightened local governments
have the ability to guide development and preserve natural
attractions for the benefit of the citizens and their posterity.
J. The County supports several of the legislative
recommendations of the Roanoke Regional Homebuilders, namely: a
relaxation of State law and State regulation permitting stump dumps
and debris landfills, and State funding incentives to encourage and
promote regionalization activities of local governments.

Assembly representing the Roanoke Valley, to the Clerk's of the
House of Delegates and the Senate of the General Assembly, and to
the Town Council of the Town of Vinton, City Councils of the City
of Salem and the City of Roanoke, and the Boards of Supervisors of
the Counties of Bedford, Botetourt, Craig, Floyd, Franklin, and
Montgomery counties.

WHEREAS, Governor Allen has recently proposed to eliminate the
authority of local governments to adopt a local license tax on
businesses, trades, professions, occupations and callings and upon
persons, firms and corporations engaged therein; and,
WHEREAS, Roanoke County currently levies a business license
tax, which provides approximately $3 Million in annual revenue, or
4.3~ of the total local annual revenue for the County, the fifth
largest source of County tax revenues; and,
WHEREAS, this levy equitably spreads the local tax burden to
the business community, and relieves residential homeowners of the
burden of providing all of the local governmental services; and,
WHEREAS, this proposal would unfairly shift to residential
homeowners the burden of paying for the provision of governmental
services for the businesses, trades, professions, occupations and
callings, and replacing this lost source of local revenue; and,
WHEREAS, if the residential homeowner were required to replace
this lost revenue solely from the local real estate tax levy, then
real estate taxes would increase by 9 cents per $100 of assessed
value in Roanoke County; and,
WHEREAS, if local services were reduced to accommodate this
ill-advised measure, then the delivery of critical local services
including education and public safety would be curtailed; and,

WHEREAS, the adoption of this proposal would further restrict
the already limited taxing powers of counties; and
WHEREAS, this proposal to eliminate this local revenue source
is another unfunded mandate from Richmond on local governments.
NOW THEREFORE, BE IT RESOLVED, By the Board of Supervisors of
Roanoke County, Virginia:
1) That Roanoke County is opposed to the elimination of
local authority to levy and provide for the assessment and
collection of license taxes on businesses, trades, professions,
occupations and callings and upon the persons, firms and
corporations engaged therein without the corresponding dedication
of a permanent replacement source of funding.
2) That the Governor of the Commonwealth of Virginia are
hereby petitioned to reconsider and reject the proposal to
eliminate local authority to levy and provide for the assessment
and collection of license taxes on businesses, trades, professions,
occupations and callings and upon the persons, firms and
corporations engaged therein.
3) That the Clerk to the Board of Supervisors is requested
to mail a certified copy of this Resolution to the Governor, each
of the members of the Roanoke Valley delegation to the General
Assembly, and to the Virginia Municipal League and the Virginia
Association of Counties and the Roanoke Regional Chamber of
Commerce.

HCN called and said that Colin Gee, from Mt. Pleasant Fire
Department would be calling or faxing you information.
HCN wants a proclamation of appreciation for Gene Wagner who is
retiring after over 36 years of service with County, either as paid
or volunteer. HCN said Gene was appointed in 1958 and worked as
paid chief from 1958 to when he retired. Then he was elected
volunteer chief and is no retiring from that post.
Mt. Pleasant is making hi an Honorary Life Captain. Anyway, this
is supposed to be big se ret - do not put on agenda, etc.
HCN said he originally wa ted it on Dec 13th agenda but also wants
it framed, etc. so said t probably wasn't enough time. Now his
preference would be to do his at organizational meeting in January
- again not on agenda, ecret, etc. - when they discuss other
business.

Attorney as a matter requiring immediate attention. This provision
applies to Main Motions and shall not apply to Privileged Motions,
Subsidiary Motions, Incidental Motions, or Motions That Bring a

for calendar 1995 from the Roanoke Moose Lodge #284) until its next meeting, January
10, 1995. The Board requested verification from you of this Moose lodge's compliance
with the provisions of Roanoke County Code § 4-101 which requires this organization to
use 12.5% of its gross receipts from all bingo games and raffles for lawful charitable
purposes of the organization.
Your compliance report to the Board on this organization will assist the Board in its
decision on these permit requests. Please submit your report to Mary Allen, Clerk to the

upcoming General Assembly session and the County's legislative initiatives.
The Board of Supervisors will hold its organizational meeting on Tuesday, January
