No. 32841-030496. A RESOL UTION commending and congratulating Roanoke County on the recent opening of the Spring Hollow Reservoir Project. WHEREAS, the Spring Hollaw Reservoir Project, which consists of the reservoir and dam, the water treatment facility, a pump station, distribution storage, and transmission lines, was approved by County voters in a referendum in 1986; and WHEREAS, construction on the dam began in 1993 and was completed in 1994; and WHEREAS, the dam rises 243 feet high and is 990 feet long and it is the largest example of a roller compacted concrete dam on the east coast; and WHEREAS, the dam was named the Clifford D. CraigMemorial Dam in honor of the late Clifford Craig who was the County Utility Director during the critical stages of the planning and construction of the Project; and WHEREAS, the reservoir holds 3.2 billion gallons of water and is capable, at peak capacity, of providing 23 million gallons per day (MGD) to Roanoke Valley residents, and water to fill the reservoir is pumped from the Roanoke River at a maximum rate of 80 million gallons per day and, in the case of upstream contamination or during periods of low river f Zow, pumping operations can be temporarily suspended; and WHEREAS, the water treatment facility will use a state of the art process to filter and disinfect the water, which facility was designed in-house by the Utility Department staff,• and WHEREAS, the first water transmission lines for the project have been installed in Southwest County following an 18 mile route around the base of Twelve O'Clock Knob and Sugar Loaf Mountain to the Starkey/Tanglewood area, and the northern water transmission lines will extend from the treatment plant north of the I-81 corridor to the Hanging Rock area; and WHEREAS, the Spring Hollow Reservoir Project will benefit all the residents of the Roanoke Valley and will be able to meet the water supply needs of Roanoke Valley residents well into the future. THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke as follows: 1. City Council adopts this resolution as a means of congratulating and commending Roanoke County on the recent opening of the Spring Hollow Reservoir Project. 2. Roanoke Counq Clerk http://eservices.roanokecountyva.gov/weblink/DocView.aspx?id=2540&searchhandle=22279 3/5/2008 r r AT A SPECIAL JOINT MEETING OF THE ROANORE COUNTY BOARD OF SUPERVISORS AND ROANORE CITY COUNCIL HELD AT THE HOTEL ROANORE AND CONFERENCE CENTER ON MONDAY, MARCH 4, 1996 RESOLUTION 030496-1 AUTHORIZING THE BOARD OF SUPERVISORS OF THE COUNTY OF ROANORE, VIRGINIA, TO ENTER INTO AND EBECUTE AN AMENDED EBTRATERRITORIAL ARREST POWERS AGREEMENT WITH THE CITY OF ROANOKE, VIRGINIA WHEREAS, in October, 1985, the County of Roanoke and the City of Roanoke entered into an extraterritorial agreement which granted arrest powers to the County Sheriff's deputies and the City's police officers for certain traffic related offenses; WHEREAS, in April, 1991, an amended extraterritorial agreement was executed by the County and City to reflect the establishment of the Roanoke County Police Department and certain technical amendments to the Virginia Motor Vehicle Code; and WHEREAS, the success of these original agreements in providing enhanced law enforcement coverage for both jurisdictions has prompted negotiations to expand the arrest powers of officers in either jurisdiction to any violation of state law and to extend that authority to off-duty officers, except those engaging in off- duty, secondary police related employment outside their normal jurisdictions, as a concrete example of governmental cooperation. THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Roanoke, Virginia, as follows: 1. The members of the Board of Supervisors of the County of Roanoke, Virginia and the County Administrator are hereby authorized, by and on behalf of the County of Roanoke, to enter into and execute an Extraterritorial Arrest Agreement between the County of Roanoke and the City of Roanoke, Virginia, to be dated March 4, 1996, a copy of which is attached to the report of the County Attorney, dated March 4, 1996, providing that an officer of the Roanoke County Police Department while in the City of Roanoke, or an officer of the Roanoke City Police Department while in the County of Roanoke, excepting the Town of Vinton, shall possess extraterritorial arrest powers for all state law violations committed in the presence of any such officer while on duty or off duty, excluding secondary police related employment, and upon such other terms and conditions as provided for therein. 2. This resolution shall be in effect from and after its enactment. AT A SPECIAL JOINT MEETING OF THE ROANOKE COUNTY BOARD OF SUPERVISORS AND ROANOKE CITY COUNCIL HELD AT THE HOTEL ROANOKE AND CONFERENCE CENTER MEETING DATE: March 4, 1996 AGENDA ITEM: REQUEST FROM ROANOKE COUNTY TO AMEND THE EXTRATERRITORIAL ARREST POWERS AGREEMENT WITH THE CITY OF ROANOKE COUNTY ADMINISTRATOR'S COMMENTS: This is a significant step forward. The existing agreement has work well but was limited to (1) driving under the influence; (2) reckless driving; (3) hit and run; (4) driving without a license; and (S) habitual offender offenses. The amended agreement increases police protection to the citizens of both localities at no additional cost. I am hopeful that this model can be used with other localities and other public safey services. Chief Cease, Chief Hooper, Don Myers and Chip Snead are to be commended for their efforts. Request approval EXECUTIVE SUMMARY' This request provides authority for the execution of an amended Extraterritorial Arrest Powers Agreement. Since October 1985, an agreement has existed between Roanoke City and Roanoke County to provide limited police authority to each jurisdiction's officers to enforce certain traffic law violations in the other's jurisdictions. This agreement was amended in April 1991 to reflect the establishment of the Roanoke County Police Department. SUMMARY OF INFORMATION: Certain amendments to this agreement are proposed which would accomplish the following: 1. Allow officers arrest powers for any violation of state law committed in their presence or when probable cause exists to effect an arrest. 2. Allow officers arrest powers during their off-duty hours. Section 15.1-159.7 of the 1950 Code of Virginia, as amended, provides that the governing bodies of counties, cities, and towns may enter in and become a part to Extraterritorial Arrest Powers Agreements. In order to eliminate any possible legal loophole, it is suggested that the Agreement be executed by the Members of the Roanoke City Council and the Members of the Board of Supervisors of Roanoke County, in addition to the County Administrator and City Manager. The agreement is legally necessary to permit officers to take action upon law violations outside an officer's legal jurisdiction and is designed to benefit the public in both the City and the County. This agreement is the necessary instrument that allows traffic enforcement beyond jurisdictional boundary lines. The agreement does not include the Town of Vinton. FISCAL IMPACTS• None. ALTERNATIVES• Currently, the Code of Virginia provides no legal alternative to such an agreement for the enforcement by police officers of violations of law in adjoining jurisdictions. The impact of this agreement is favorable to both localities and allows on-duty and off-duty officers to take enforcement action for any traffic law violation when traveling through a jurisdiction other than their own. Failure to renew this agreement would preclude City and County officers from having authority to act when confronted with traffic law violations when traveling through their neighboring political jurisdictions. Mahoney County Attorney Action Approved ( ) Denied ( ) Received ( ) Ref erred to Motion by Vote No Yes Eddy Johnson Harrison Minnix Nickens 2 THIS AGREEMENT, made and entered into this 4th day of March, 1996, by and between the CITY OF ROANOKE, VIRGINIA, a municipal corporation of the Commonwealth of Virginia, hereinafter referred to as "City," and ROANOKE COUNTY, VIRGINIA, a political subdivision of the Commonwealth of Virginia, hereinafter referred to as "County." WITNESSETH WHEREAS, officers of the City of Roanoke Police Department have occasion as City police officers to be in Roanoke County, and officers of the Roanoke County Police Department have occasion as officers to be in the City of Roanoke; WHEREAS, it is the intent of the City and the County to bestow extraterritorial arrest powers upon such officers who, outside the corporate boundaries of the political subdivision which employes them, coincidentally observe any violation of state law committed in their presence, or when probable cause exists to effect an arrest without the creation of any additional liability for the political subdivision where the arrest occurs or its officers and employees; and WHEREAS, §15.1-159.7, Code of Virginia (1950), as amended, provides that the governing bodies of counties, cities and towns whose boundaries are contiguous may by proper resolutions of such governing bodies enter in and become a party to agreements for the mutual protection of all parties to such agreements by the use of their joint police forces, their equipment and materials all for their mutual protection, defense and the maintenance of peace and good order; NOW, THEREFORE, for and in consideration of the undertakings of the parties to this Agreement, the City and the County covenant and agree, each with the other as follows: 1. Definitions As used in this Agreement, the following words and phrases shall have the meanings ascribed to them in this section: Cam. The word "City" shall mean the City of Roanoke, Virginia. Coun The word "County" shall mean Roanoke County, Virginia. Extraterritorial arrest power. The term "extraterritorial arrest power" shall mean the right, power and authority of an officer of the City of Roanoke Police Department in Roanoke County or an officer of the Roanoke County Police Department in the City of Roanoke to stop and effect arrests and otherwise enforce the law with respect to any violation of a state law which an officer would be required to act upon if working a regular tour of duty in their jurisdiction of employment. This section does not apply to, or include officers working in any off duty capacity, otherwise referred to as secondary police related employment. Officer. The word "officer" shall mean any sworn officer of the City of Roanoke Police Department or any sworn officer of the Roanoke County Police Department. On du .The term "on duty" shall mean working a regularly scheduled tour of duty with the employing law enforcement agency. Off duty. The term "off duty" shall mean that period of time during which an employee would not normally be scheduled or required to engage actively in the 2 performance of police duties. This section does not apply to, or include officers working in any off duty, secondary police related employment. State Code. The term "State Code" shall mean the Code of Virginia (1950), as amended. 2. Extratemtorial Arrest Power. A City officer in the County, except in the Town of Vinton, or a County officer in the City shall possess extraterritorial arrest power when any violation of state law becomes known to the officer, or probable cause exists to effect an arrest. This section is not inclusive of any individual city or county codes which reciprocal agreements do not cover. Any officer effecting or attempting to effect an extraterritorial arrest under or pursuant to this Agreement shall have the same rights, powers and authorities as he would possess in making or attempting to make an arrest in the political subdivision employing him under similar circumstances. Nothing in this agreement shall be construed as requiring an officer to effect an extraterritorial arrest. 3. Notification. Any officer making an extraterritorial arrest shall forthwith give notice of such fact by filing a written report, enumerating the name of the person arrested, the offense and time, place and particulars of the offense, with the law enforcement agency in the jurisdiction where the arrest occurred. 4. Mutual indemnification. a. The City agrees to indemnify and hold harmless the County and its officers, agents and employees from any and all claims, legal actions and judgments advanced against the County and its officers, agents and employees and for any expenses 3 the County may incur in this regard arising out of the intentional acts and negligent acts or omissions of any officer, as defined by Section 1 of this Agreement, arising under or pursuant to this Agreement. b. The County agrees to indemnify and hold harmless the City and its officers, agents and employees from any and all claims, legal actions and judgments advanced against the City and its officers, agents and employees and for any expenses the City may incur in this regard arising out of intentional acts and negligent acts or omissions of any officer, as defined by Section 1 of this Agreement, arising under or pursuant to this Agreement. 5. Oyerational policies. Any officer effecting an extraterritorial arrest shall comply with the operational policies of his own department. The City and County agree to hold their own officers, respectively, responsible and accountable for compliance with operational policies of the employing department. 6. No effect on existingpowers. This Agreement shall not supersede restrict, limit or otherwise impair or affect extraterritorial arrest powers already existing pursuant to §§15.1-131, 15.1-131.1, 15.1-131.5, 19.2-77, 19.2-249, 19.2-250 and other sections of the State Code or any authority or power existing under the City of Roanoke Charter of 1952. 7. Rights of officers. While acting under or pursuant to this Agreement any City officer in the County or any County officer in the City shall have all the immunities from liabilities and exemptions from laws, ordinances and regulations and shall have all the 4 pension, relief, disability, Workers' Compensation and other benefits enjoyed by him while performing his respective duties within the territorial limits of his political subdivision. 8. No backuy. This agreement shall not be construed as requiring any City officer to act in the county or any County officer to act in the city upon request to supplement or replace routine patrol or enforcement activities. 9. Loss or damage to equipment. The City. shall have no liability for any destruction, loss or damage of any County-owned motor vehicle, equipment or personal property and the County shall have no liability for any destruction, loss or damage of any City-owned motor vehicle, equipment or personal property in the exercise of extraterritorial arrest power under or pursuant to this Agreement. 10. Immunities. This Agreement shall not be construed to impair or affect any sovereign or governmental immunity or official immunity that may otherwise be available to the City or any officer, agent or employee of the City or to the County or any officer, agent or employee of the County. All of the immunities from liability enjoyed by the city and the County when acting through its police officers within its territorial limits shall be enjoyed by it to the same extent when the City or the County is so acting through its police officers beyond its territorial limits. 11. Termination. Either party to this Agreement shall have the right to terminate this Agreement, with or without cause, by giving written notice to the chief administrative officer of the other party by certified mail, return receipt requested. Any termination shall be effective ten (10) days after receipt of notice of termination. 5 12. Completeness of Agreement. This Agreement represents the entire and integrated Agreement between the City and the County and supersedes all prior negotiations, representations or agreements related to extraterritorial arrest jurisdiction, either oral or written. This Agreement maybe amended only by written instrument signed by authorized representative of the City and County. 13. Gender. Any word importing the masculine gender used in this Agreement may extend to and be applied to females as well as males. 14. Effective date. This Agreement shall be effective on and after April 1, 1996. THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Roanoke, Virginia, as follows: 1. The members of the Board of Supervisors of the County of Roanoke, Virginia and the County Administrator are hereby authorized, by and on behalf of the County of Roanoke, to enter into and execute an Extraterritorial Arrest Agreement between the County of Roanoke and the City of Roanoke, Virginia, to be dated March 4, 1996, a copy of which is attached to the report of the County Attorney, dated March 4, 1996, providing that an officer of the Roanoke County Police Department while in the City of Roanoke, or an officer of the Roanoke City Police Department while in the County of Roanoke, excepting the Town of Vinton, shall possess extraterritorial arrest powers for all state law violations committed in the presence of any such officer while on duty or off duty, excluding secondary police related employment, and upon such other terms and conditions as provided for therein. 2.
