L. REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor Harrison: ~) announced there were citizens from
Mountclair Estates present who wished to speak about flooding in their
neighborhood. (2) Announced that the North Transmission water lines are
moving a,~ long according to Gary Robertson
Supervisor Nickens: (1) Advised he was absent at last meeting and
asked if any action had been take to participate in the Chamber of
Commerce publication. BLJ responded that the County would not
participate. (2) Expressed concern about youth who are still students, but
not eligible to participate in youth sports because they turn 18 after October
1, the cutoff date for participation. He was aware of at least 16 students
affected b t~ his policv. Asked for concurrence from the Board for Pete
Haislip to review the policy and take to the Rec Club Presidents Committee
to consider allowing any rising senior to participate in youth sports who
previously participated. LBE suggested that Parks and Recreation provide
a report to the Board on advantages and disadvantages of changing the
policy. HCN responded that soccer practice begins August 1 and waiting
for report would exclude these rising seniors HCN suggested allowing
them to play now and that Presidents Committee review the entire age

Supervisor Eddy: (~ Asked whether citizens to talk about stormwater

were planning to speak at the Work Session. BLJ advised they would
speak under Citizens Comments. (2) Announced that the Dedication
Ceremony for the Garst Mill Greenway would be Saturday, August 2 at 10:00
a.m. Invited everyone to attend.
upervisor Minnix: Announced that his appointee. Guv Bvrd, had
resigned from the Industrial Development Authority because he plans to run
for office in Roanoke Ci,_._y. Economic Development staff has recommended
Neil A. Gallagher. Asked MHA to copv resume for other Board members
and asked for any other recommendations for appointment.
supervisor Johnson: Announced there was a joint meeting with the
Roanoke City Council on Monday, 7/7/97. Received reports on several
projects including the Reaio,., nal Airport. Asked for some publicity on all the
new projects going on at the airport on the government access TV channel.
M. CITIZENS' COMMENTS AND COMMUNICATIONS
The following citizens spoke about flooding in their neighborhood and that
this was the 3rd major flood thev had experienced since living in Mountclair
Estates. Asked the Board for temporary assistance until the Peters Creek
Stormwater Management Project is complete:

AGENDA ITEM: Recognition of the Budget staff for receiving
the Distinguished Budget Presentation Award
from the Government Finance Officers
Association
COUNTY ADMINISTRATOR'S COMMENTS:
Roanoke County has again received the Distinguished Budget
Presentation Award for the current year. This award is presented
by the Government Finance Officers Association to governments that
achieve the highest principles of governmental budgeting.
In order to receive the budget award, the entity has to satisfy
nationally recognized guidelines for effective budget presentation
as a policy document, a financial plan, an operations guide and a
communication device. This is at least the 10th consecutive year
that Roanoke County and its staff has been honored by the GFOA for
our budget presentation.
Accepting the award and Certificate of Recognition will be Budget
Manager Brent Robertson and Steve Kleiber.

MEETING DATE: July 8, 1997
AGENDA ITEM: Authorization to Enter into an Agreement to Provide
a Recycling Program in Roanoke County
COUNTY ADMINISTRATOR'S COMMENTS:
BACKGROUND•
During the past year, several alternatives for providing
recycling services were evaluated including the following:
1) Commingled recycling to the entire County at a cost of
$1.14 million in capital and $330,200 in annual operating
costs.
2) Expansion of source separation to the entire county at a
cost of $.8 million in capital and $181,000 in operating
costs.
3) Privatization of county-wide drop off centers through the
RFP process at an annual estimated cost of $85,000.
Staff recommended Alterative 3.
SUMMARY OF INFORMATION:
At the May 13th meeting, the Board agreed with the staff
recommendation of county-wide recycling using drop-off locations,
and approved funding for that method. Staff was instructed to
finalize a contract and bring it back to the Board for approval.

The following locations have been included in a contract with
Waste Management of Virginia effective August 1, 1997:
Orange Market at Routes 311 and 419 (Catawba)
Waste Management Facility in Salem (Catawba)
Kroger's on Route 460E (Vinton/Hollins)
Wal-Mart on Route 2205 (Cave Spring)
An additional facility for the Hollins area will be
identified, with the concurrence of the Chairman, prior to August
1. Sites under consideration are Burlington Elementary School and
Walrond Park. In addition to the above sites, the Roanoke Valley
Resource Authority currently provides drop off centers at the
Kroger stores in Cave Spring, Vinton and Crossroads Mall. Between
July 8 and August 1, appropriate measures will be taken to
advertise this change in our recycling program.
STAFF RECOMMENDATION:
Staff requests your concurrence with the locations identified
and your authorization to execute the contract with Waste
Management of Virginia.
FISCAL IMPACT:
Funding for this program was approved on May 13, 1997, and the
contract is within the approved amounts.

ORDINANCE 070897-2 AUTHORIZING E%ERCISE OF AN OPTION TO
PURCHASE AGREEMENT WITH ROPPERS INDIISTRIEB, INC. TO
OBTAIN TWO SANITARY SEWER EASEMENTB AND TO PURCHASE
APPRO%IMATELY 0.226 ACRES OF RIGHT OF WAY ON THE WEST
SIDE OF THE PRIVATE PORTION OF GARMAN ROAD (BEING
IDENTIFIED AS A PORTION OF COUNTY TA% MAP PARCEL 55.03-2-
11) FOR ROAD IMPROVEMENTS AS PART OF THE RROGER PROJECT
WHEREAS, by Resolution #012897-12, the Board of Supervisors of
Roanoke County authorized and approved an economic development
project, known as the Kroger Project, authorized execution of a
Performance Agreement with the Industrial Development Authority of
Roanoke County, Virginia, ("IDA"), and the Kroger Co., and
appropriated the sum of $1,780,000 to pay for the County's and the
IDA's performance obligations under the Agreement; and,
WHEREAS, by Resolution #031197-4, the Board of Supervisors of
Roanoke County approved the Option to Purchase Agreement dated
March 3, 1997, with Koppers Industries, Inc., for 0.17 acres of
proposed right of way and 0.15 acres of grading, slope and
construction easements on the west side of the private portion of
Garman Road, being further shown on the Roanoke County land records
as Tax Map Number 55.03-2-11 ("the Property"); and,
WHEREAS, under the terms of said agreement, the purchase price
for the Property is $2,800 and the option must be exercised on or
before July 31, 1997; and,
WHEREAS, the agreement provides for settlement within 30 days
of the notice of exercise of the Option; and,
WHEREAS, the property is necessary for construction of a cul-
de-sac at the terminus of the improved Garman Road, and the funds
are available in the Kroger Project account as appropriated by the
Board on January 28, 1997; and,
WHEREAS, as construction plans have progressed, it has been
determined that revisions to the " the Property" are necessary in
order to comply with the requirements of the Virginia Department of
Transportation for acceptance of the improved Garman Road into the
state secondary road system; and,
WHEREAS, by Amendment to Option to Purchase Agreement dated
June 19, 1997, Koppers Industries, Inc. agreed to the changes in
the proposed right-of-way and easements to be acquired in
connection to the road improvement project at no additional cost to
the County; and,
WHEREAS, Section 18.04 of the Roanoke County Charter directs
that the acquisition of real estate interests be accomplished by
ordinance; the first reading of this ordinance was held on June 24,
1997; the second reading was held on July 8, 1997.
THEREFORE, BE IT ORDAINED by the Board of Supervisors of
Roanoke County, Virginia, as follows:
1. That the Amendment to Option to Purchase Agreement dated
June 19, 1997, between Koppers Industries, Inc., Grantor, and the
Board of Supervisors of Roanoke County, Virginia, Grantee, and the
terms and conditions provided for in said agreement, is hereby
approved and the execution of said agreement by the County
Administrator is hereby authorized and ratified.

2. That the County Administrator is hereby authorized to
exercise the option to purchase from Koppers Industries, Inc. the
following described real estate, to-wit:
All that certain lot or parcel of land, together with any
improvements thereon, rights incident thereto, and
appurtenances thereunto belonging, situate in the Catawba
Magisterial District of the County of Roanoke, Virginia,
containing 0.226 acre, more or less, and being shown and
designated as "FUTURE AREA TO BE DEDICATED FOR GARMAN
ROAD RIGHT-OF-WAY" upon the 'Plat Showing New 20'
Sanitary Sewer Easements Being Dedicated To The County of
Roanoke, Virginia, By Koppers Industries, Inc. and
Showing A Future Portion of Property To Be Dedicated For
The Right-Of-Way Of Garman Road', dated June 5, 1997,
prepared by Lumsden Associates, P.C., Engineers-
Surveyors-Planners, a copy of which is attached hereto
and made a part hereof.
This being a portion of the same real estate conveyed
unto Koppers Industries, Inc., by deed dated December 29,
1988, from Koppers Company, Inc., recorded in the
Clerk's Office of the Circuit Court of Roanoke County,
Virginia, in Deed Book 1298, page 1003.
TOGETHER WITH the perpetual RIGHTS and EASEMENTS, twenty
feet (20') in width, to construct, install, improve,
operate, inspect, use, maintain, remove, monitor, repair
or replace a sanitary sewer line or lines, system, or
facilities, and related improvements, together with the
right of ingress and egress thereto from a public road,
upon, over, under, and across a tract or parcel of land
belonging to the Grantor, acquired by deed dated December
29, 1988, and recorded in the aforesaid Clerk's Office in
Deed Book 1298, page 1003, and designated on the Roanoke
County Land Records as Tax Map No. 55.03-2-9, No. 55.03-
2-6, and No. 55.03-2-11. The location of said easements
are shown and designated as "NEW SANITARY SEWER EASEMENT
"A"" and "NEW 20' SANITARY SEWER EASEMENT "B"" upon the
'Plat Showing New 20' Sanitary Sewer Easements Being
Dedicated To The County of Roanoke, Virginia, By Koppers
Industries, Inc. and Showing A Future Portion of Property
To Be Dedicated For The Right-Of-Way Of Garman Road',
dated June 5, 1997, prepared by Lumsden Associates, P.C.,
Engineers-Surveyors-Planners, a copy of which is attached
hereto and incorporated herein; and,
TOGETHER WITH temporary construction easements of an
additional ten feet (10') on each side of the permanent
easements hereinabove described for use as a temporary
work space and to allow for necessary grading during any
phase of construction, reconstruction, or maintenance of
the sanitary sewer facilities or related improvements.
3. That the County Administrator or Assistant County
Administrators are hereby authorized to execute such documents and
take such actions on behalf of Roanoke County in this matter as are
necessary to accomplish the exercise of the option and acquisition
of the property which shall be approved as to form by the County
Attorney.
4. That this ordinance shall be effective on and from the
date of its adoption.

Roanoke County is assisting the Kroger Co. with an expansion of their Mid-Atlantic Distribution
Facility in the Glenvar area. Koppers Industries, Inc. (Koppers) owns a 0.226 acre tract upon which
Roanoke County proposes to build road improvements to reconstruct Garman Road so that it may
be eligible for acceptance into the Virginia Secondary Highway System. Roanoke County has
negotiated an Option to Purchase Agreement with Koppers. Kroger is desirous for the County to
exercise the option so that the Koppers property may be acquired for road construction purposes.
Staff has contacted Koppers about amending the Option to Purchase Agreement in order to obtain
two sanitary sewer easements and an additiona10.056 acres of land for the Garman Road right of
way. The company is supportive of this request.
SUMMARY OF INFORMATION:
The subject property is necessary for the reconstruction of Garman Road. Koppers owns this parcel
of land at the end of Garman Road. The property is described in the legal description in the attached
ordinance and is shown on the attached plat.
The County's independent appraiser has determined an initial value of $2,800 fora 0.17 acre parcel
and associated construction, slope and grading easements totaling an additiona10.15 acres. Koppers
has advised the County staff that they will amend the option agreement and grant the two sewer
easements and sell the additiona10.056 acres for right of way at no cost to the County. The Board
of Supervisors previously approved an Option to Purchase Agreement for this property at its March
1 1, 1997 meeting and a first reading of the ordinance on June 24, 1997.

Staff has obtained an environmental assessment of the property that shows no environmental hazards
present on the property that requires mitigation or cleanup.
Staff recommends that Roanoke County acquire the 0.226 acre tract and the two sewer easements
in accordance with the performance agreement with the Kroger Co. for the reconstruction of Garman
Road.
FISCAL IMPACT:
The Board of Supervisors appropriated funds for the Kroger expansion project at their January 27,
1997 meeting. Funds for $2,800 for land acquisition costs from Koppers were included in this
request.
STAFF RECOMMENDATION:
Staff recommends that the Board of Supervisors adopt the second reading of the proposed ordinance
approving the exercise of an Option to Purchase Agreement with Koppers Industries, Inc.

ORDINANCE AUTHORIZING EXERCISE OF AN OPTION TO PURCHASE
AGREEMENT WITH KOPPERS INDUSTRIES, INC. TO OBTAIN TWO
SANITARY SEWER EASEMENTS AND TO PURCHASE APPROXIMATELY
0.226 ACRES OF RIGHT OF WAY ON THE WEST SIDE OF THE PRIVATE
PORTION OF GARMAN ROAD (BEING IDENTIFIED AS A PORTION OF
COUNTY TAX MAP PARCEL 55.03-2-11) FOR ROAD IMPROVEMENTS AS
PART OF THE KROGER PROJECT
WHEREAS, by Resolution #012897-12, the Board of Supervisors of Roanoke County
authorized and approved an economic development project, known as the Kroger Project,
authorized execution of a Performance Agreement with the Industrial Development
Authority of Roanoke County, Virginia, ("IDA"), and the Kroger Co., and appropriated the
sum of $1,780,000 to pay for the County's and the IDA's performance obligations under
the Agreement; and,
WHEREAS, by Resolution #031197-4, the Board of Supervisors of Roanoke County
approved the Option to Purchase Agreement dated March 3, 1997, with Koppers Industries,
Inc., for 0.17 acres of proposed right of way and 0.15 acres of grading, slope and
construction easements on the west side of the private portion of Garman Road, being
further shown on the Roanoke County land records as Tax Map Number 55.03-2-11 ("the
Property"); and,
WHEREAS, under the terms of said agreement, the purchase price for the Property
is $2,800 and the option must be exercised on or before July 31, 1997; and,
WHEREAS, the agreement provides for settlement within 30 days of the notice of
exercise of the Option; and,

WHEREAS, the property is necessary for construction of a cul-de-sac at the terminus
of the improved Garman Road, and the funds are available in the Kroger Project account
as appropriated by the Board on January 28, 1997; and,
WHEREAS, as construction plans have progressed, it has been determined that
revisions to the "the Property" are necessary in order to comply with the requirements of
the Virginia Department of Transportation for acceptance of the improved Garman Road
into the state secondary road system; and,
WHEREAS, by Amendment to Option to Purchase Agreement dated June 19, 1997,
Koppers Industries, Inc. agreed to the changes in the proposed right-of-way and easements
to be acquired in connection to the road improvement project at no additional cost to the
County; and,
WHEREAS, Section 18.04 of the Roanoke County Charter directs that the acquisition
of real estate interests be accomplished by ordinance; the first reading of this ordinance
was held on June 24, 1997; the second reading was held on July 8, 1997.
THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That the Amendment to Option to Purchase Agreement dated June 19, 1997,
between Koppers Industries, Inc., Grantor, and the Board of Supervisors of Roanoke
County, Virginia, Grantee, and the terms and conditions provided for in said agreement,
is hereby approved and the execution of said agreement by the County Administrator is
hereby authorized and ratified.

2. That the County Administrator is hereby authorized to exercise the option to
purchase from Koppers Industries, Inc. the following described real estate, to-wit:
All that certain lot or parcel of land, together with any improvements
thereon, rights incident thereto, and appurtenances thereunto belonging,
situate in the Catawba Magisterial District of the County of Roanoke,
Virginia, containing 0.226 acre, more or less, and being shown and
designated as "FUTURE AREA TO BE DEDICATED FOR GARMAN ROAD
RIGHT-OF-WAY" upon the'Plat Showing New 20' Sanitary Sewer Easements
Being Dedicated To The County of Roanoke, Virginia, By Koppers Industries,
Inc. and Showing A Future Portion of Property To Be Dedicated For The
Right-Of-Way Of Garman Road', dated June 5, 1997, prepared by Lumsden
Associates, P.C., Engineers-Surveyors-Planners, a copy of which is attached
hereto and made a part hereof.
This being a portion of the same real estate conveyed unto Koppers
Industries, Inc., by deed dated December 29, 1988, from Koppers Company,
Inc., recorded in the Clerk's Office of the Circuit Court of Roanoke County,
Virginia, in Deed Book 1298, page 1003.
TOGETHER WITH the perpetual RIGHTS and EASEMENTS, twenty feet (20')
in width, to construct, install, improve, operate, inspect, use, maintain,
remove, monitor, repair or replace a sanitary sewer line or lines, system, or
facilities, and related improvements, together with the right of ingress and
egress thereto from a public road, upon, over, under, and across a tract or
parcel of land belonging to the Grantor, acquired by deed dated December
29, 1988, and recorded in the aforesaid Clerk's Office in Deed Book 1298,
page 1003, and designated on the Roanoke County Land Records as Tax Map
No. 55.03-2-9, No. 55.03-2-6, and No. 55.03-2-11. The location of said
easements are shown and designated as "NEW SANITARY SEWER
EASEMENT "A"" and "NEW 20' SANITARY SEWER EASEMENT "B"" upon the
'Plat Showing New 20' Sanitary Sewer Easements Being Dedicated To The
County of Roanoke, Virginia, By Koppers Industries, Inc. and Showing A
Future Portion of Property To Be Dedicated For The Right-Of--Way Of
Garman Road', dated June 5, 1997, prepared by Lumsden Associates, P.C.,
Engineers-Surveyors-Planners, a copy of which is attached hereto and
incorporated herein; and,
TOGETHER WITH temporary construction easements of an additional ten
feet (10') on each side of the permanent easements hereinabove described for
use as a temporary work space and to allow for necessary grading during any
phase of construction, reconstruction, or maintenance of the sanitary sewer
facilities or related improvements.

WHEREAS, the first reading of this ordinance was held on March
25, 1997, and the second reading and public hearing were held April
22, 1997; and
WHEREAS, this matter was reconsidered by the Board of
Supervisors on May 13, 1997, and a public hearing and reconsidered
second reading of this ordinance were held on June l0, 1997; June
24, 1997; and July 8, 1997; and,
WHEREAS, the Roanoke County Planning Commission held a public
hearing on this matter on April 1, 1997; and
WHEREAS, legal notice and advertisement has been provided as
required by law; and,
WHEREAS, a letter from Ottis L. Burgher dated 6/17/97 reciting
the Shenandoah Homes Retirement Village Mission Statement regarding
"providing housing and health care options for the elderly of all
race, creeds, and financial positions"; and stating that it is the
policy of the Church of God (to which the Petitioner is affiliated)
to help any resident experiencing financial reversals, and further
stating that it would not evict or bring legal action against a

resident for nonpayment of rent is attached to this ordinance as
Exhibit 3.
BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That the zoning classification of a certain tract of real
estate containing 17.5 acres and located east of Airport Road north
of the terminus of Woodbury Street, designated as Tax Map Number
38.14-1-5, in the Hollins Magisterial District, is hereby changed
from the zoning classification of R-3, Medium Density Multi-Family
Residential District, to the zoning classification of C-2, General
Commercial District.
2. That this action is taken upon the application of
Shenandoah Homes Retirement Villages, Inc.
3. That the owner of the property has voluntarily proffered
in writing the following conditions which the Board of Supervisors
of Roanoke County, Virginia, hereby accepts:
(A) Development of the property shall be generally in
accord with the conceptual site plan entitled "The Village at
Shenandoah" prepared by E. T. Boggess and dated 6/9/97. The
conceptual site plan indicates the phased construction of the
project and Exhibit (1) sets out the time line projections for each
phase. Minor revisions to the concept plan shall be allowed to
accommodate zoning compliance and storm water management needs,
provided such changes do not fundamentally change site circulation,
or the overall development concept that is depicted on the concept
plan.

(B) Public vehicle access to the property shall be
limited to only the Airport Road access as shown on the conceptual
site plan; which public access will be constructed during Phase 1
of the development. Restricted emergency vehicle access shall be
provided from either Woodbury Street or through the existing
Shenandoah Homes property.
(C) Storm water runoff from the site shall not be
directed toward Santa Anita Terrace or Sierra Drive. No storm
water from the site shall be directed such that it ultimately
discharges into the existing detention area at the intersection of
Sierra Drive and Fenwick Drive. All storm water runoff from the
site shall be discharged into an adequate receiving channel.
(D) The Petitioner, its successors and assigns, shall
dedicate sufficient land to the Board of Supervisors of Roanoke
County for the purpose of construction "T-turn-grounds" at the
terminus of Sanita Anita Terrace and Sierra Drive, and the
construction cost thereof shall be borne entirely by Roanoke
County. The land to be dedicated shall be limited to that property
within the 35' buffer yard required by Section 30-92-4 of the
Roanoke County Zoning Ordinance in existence on the date of the
adoption of this Ordinance. The County shall not require the
dedication of any additional land other than that contained within
the 35' buffer yard as set out by said Section. Should any land be
dedicated pursuant to this Proffer, the Petitioner shall not be
required to provide any additional buffer yard. This dedication
shall occur no later than the application for a land disturbing

permit for the property.
4. That the Board finds that the granting of a special use
permit to construct a home for adults located east of Airport Road
north of the terminus of Woodbury Street (Tax Map No. 38.14-1-5) in
the Hollins Magisterial District is substantially in accord with
the general purpose of promoting the health, safety and general
welfare of the public by encouraging economic development and
enlarging the tax base, and substantially in accord with the
adopted 1985 Comprehensive Plan pursuant to the provisions of §
15.1-456 of the 1950 Code of Virginia, as amended, and said Special
Use Permit is hereby approved with the following conditions related
to the design, scale, use and operation:
(A) Development of the property shall be generally in
accord with the conceptual site plan entitled "The Village at
Shenandoah" prepared by E. T. Boggess and dated 6/9/97. The
conceptual site plan indicates the phased construction of the
project and Exhibit (1) sets out the time line projections for each
phase. Minor revisions to the concept plan shall be allowed to
accommodate zoning compliance and storm water management needs,

(C) Architectural styles of the proposed assisted living
units, independent living units and Galleria shall be as generally
depicted in the submitted plans, elevations and renderings dated
12/7/96.
(D) Public vehicle access shall be prohibited to
Woodbury Street, Hearthstone Road, Darby Road, Abney Road, Sierra
Drive, and Santa Anita Terrace. Restricted emergency vehicle
access shall be required and allowed from either Woodbury Street or
through the existing Shenandoah Homes property.
(E) Afire suppression system shall be installed in all
residential units. The developer shall be responsible for all
costs associated with providing the adequate fire flows required
for this fire suppression system.
(F) The property owner shall pay real estate taxes on
that area of the property designated on the conceptual site plan as
Independent Living (9.75 acres) and that area of the project
identified as Congregate Care Facilities (1.75 acres). The area of
the project designated as Assisted Living (6 acres) shall be tax
exempt with the provision that the property owner shall pay a
service charge in lieu of taxes on said portion of the project at
the rate of 20~; except retail areas in Galleria, which area shall
be taxed at 100 of the value of the prorata share of space
utilized by the retail business. Payment of said service charge in
lieu of taxes shall be conditioned upon the adoption of a

resolution by the Board of Supervisors and the enactment of
legislation of the General Assembly to provide for such pursuant to
Section 30-19.04. (See Exhibit 2 - Total Estimated Real Estate Tax
Generated by the Project.)
5. That this ordinance shall be in full force and effect
thirty (30) days after its final passage. All ordinances or parts
of ordinances in conflict with the provisions of this ordinance be,
and the same hereby are, repealed. The Zoning Administrator is
directed to amend the zoning district map to reflect the change in
zoning classification authorized by this ordinance.

amended and approve the Special Use Permit by the following

road ways and main gate at the entrance on Airport Road. The road will be extended
from the front entrance around to the emergency gate connected to the existing Facility

The Shenandoah Homes Retirement Village Mission State-
ment states that our ministry is to serve God and fellowman
by providing housing and health care options for the elderly
of all race, creeds, and financial positions within the
context of Christian service.
The residents of the village cocna~unity Will have a lease
agreement on a month to month basis. If a resident moves in
after the first of the month his rent will be pro-rated based
upon arrival date. •Subsequent rent will be due and payable
on the first of each succeeding month. vo entrance fee or
rnonchly maintance fee, or life care endowment will be offered
or available to ehe resident.
It has been the policy and the unique ministry of the
Church of God to help any resident who experiences financial
reversals. The Church has never evicted or brought legal
action against a resident for nonpayment of sent. We do not
intend to do so in the future. We will minister to the individual
using all of the resources available in the community and the
church to resolve the residents financial hardship.

COUNTY ADMINISTRATOR'S COMMENTS:
EXECUTIVE SUMMARY:
This ordinance is before the Board after the successful motion to
reconsider of May 13, 1997 and after the continuation of the public
hearing from June 10, 1997 to June 24, 1997 and then to July 8, 1997, so
that the following issues could be addressed: (a) time line projections
for construction of Phase I, II, and III (See Exhibit 1); (b) revision
of estimated real estate tax to be generated by the project (See Exhibit
2); (c) statement of the policy of Shenandoah Homes Retirement Village
regarding treatment of residents with financial hardships (See Exhibit
3); (d) language regarding the T-turn-arounds (See Proffer 3.D.); (e)
construction of emergency entrances into the facility (See Exhibit 1 -
Phase 1 construction).
BACKGROUND:
On April 22, 1997, this ordinance to rezone this 17.5 acre tract of
real estate to the zoning classification of C-2 and grant a special use
permit to construct a home for adults was denied. On May 13, 1997, a
motion to reconsider was made and passed, which rescheduled a public
hearing and reconsideration of this application by Shenandoah Homes
Retirement Village, Inc. This matter was advertised, and public notice

provided, as required by law.
SUMMARY OF INFORMATION:
The Board has expressed its concerns with the steady erosion of the
County's tax base to tax exempt uses. Almost 10% of the overall assessed
value of property in the County is tax exempt.
Section 15.1-489 of the Code of Virginia lists the purposes of local
zoning ordinances. One listed purpose is "(vii) to encourage economic
development activities that provide desirable employment and enlarge the
tax base." Taking appropriate action to prevent the erosion of that tax
base is a valid purpose of local zoning power and authority.
Section 30-19-3 (C) of the Roanoke County Zoning Ordinance addresses
conditions which the Board may attach to special use permits. "Any such
conditions shall be related to the design, scale, use or operation of the
proposed special use."
with respect to this application the Board raised questions
concerning the proposed tax exempt uses of this development, the
corporate structure and organization of this development, and management
and development contracts with a profit-making corporation. The
applicant and representatives of HCMF and ConstantCare-Shenandoah, Inc.
have provided the County Attorney with documentation to address some of
these concerns, which have been distributed to the Board.
The applicant is not exempt from local taxation by classification,
nor is it exempt from local taxation by designation. Similar uses in
other jurisdictions have been determined to be taxable, both by the
Virginia Supreme Court and through an opinion by the Attorney General.
This ordinance includes a condition attached to the special use
permit that identifies those portions of the project which are taxable
(the Independent Living and Congregate Living facilities, and 70% of the
Galleria) and those portions which could be designated as tax exempt (the
Assisted Living facilities and the remainder of the Galleria) and subject
to the 20% service charge in lieu of real estate taxes.
The Petitioner has advised that it will petition the Board for the
adoption of a resolution (after a public hearing) supporting its request
to the General Assembly for legislation designating this limited portion
of the project exempt from location taxation, in accordance with Sectin
30-19.04 of the State Code. This public hearing could be scheduled no
earlier than July 22, 1997.

FISCAL IMPACTS:
It is anticipated that this development has the potential to
generate local real estate taxes of approximately $130,415 per year;
however, once tax exempt status is granted to the Assisted Living and
part of the Galleria portions of the development, the property owner will
pay a service charge of 20% in lieu of real estate taxes on that portion
of the project and full real estate tax on the Congregate Care,
Independent Living and 70% of the Galleria facilites. The project's
Total Estimated Real Estate Tax will be reduced from about $130,415 to
$90,082.
STAFF RECOMMENDATION:
It is recommended that the Board hold the required public hearing,
and thereafter, favorably consider the adoption of the proposed
ordinance.

classification of R-3, Medium Density Multi-Family Residential District,
to the zoning classification of C-2, General Commercial District.
2. That this action is taken upon the application of Shenandoah
Homes Retirement Villages, Inc.
3. That the owner of the property has voluntarily proffered in
writing the following conditions which the Board of Supervisors of
Roanoke County, Virginia, hereby accepts:
(A) Development of the property shall be generally in accord
with the conceptual site plan entitled "The Village at Shenandoah"
prepared by E. T. Boggess and dated 6/9/97. The conceptual site plan
indicates the phased construction of the project and Exhibit (1) sets out
the time line projections for each phase. Minor revisions to the concept
plan shall be allowed to accommodate zoning compliance and storm water
management needs, provided such changes do not fundamentally change site
circulation, or the overall development concept that is depicted on the
concept plan.
(B) Public vehicle access to the property shall be limited
to only the Airport Road access as shown on the conceptual site plan;
which public access will be constructed during Phase 1 of the
development. Restricted emergency vehicle access shall be provided from
either Woodbury Street or through the existing Shenandoah Homes property.
(C) Storm water runoff from the site shall not be directed
toward Santa Anita Terrace or Sierra Drive. No storm water from the site

shall be directed such that it ultimately discharges into the existing
detention area at the intersection of Sierra Drive and Fenwick Drive.
All storm water runoff from the site shall be discharged into an adequate
receiving channel.
(D) The Petitioner, its successors and assigns, shall
dedicate sufficient land to the Board of Supervisors of Roanoke County
for the purpose of construction "T-turn-arounds" at the terminus of
Sanita Anita Terrace and Sierra Drive, and the cost thereof, shall be
borne entirely by Roanoke County. The land to be dedicated shall be
limited to that property within the 25' buffer yard required by Section
30-92-4 of the Roanoke County Zoning Ordinance in existence on the date
of the adoption of this Ordinance. The County shall not require the
dedication of any additional land other than that contained within the
25' buffer yard as set out by said Section. Should any land be dedicated
pursuant to this Proffer, the Petitioner shall not be required to provide
any additional buffer yard. This dedication shall occur no later than
the application for a land disturbing permit for the property.
4. That the Board finds that the granting of a special use permit
to construct a home for adults located east of Airport Road north of the
terminus of Woodbury Street (Tax Map No. 38.14-1-5) in the Hollins
Magisterial District is substantially in accord with the general purpose
of promoting the health, safety and general welfare of the public by
encouraging economic development and enlarging the tax base, and
substantially in accord with the adopted 1985 Comprehensive Plan pursuant

to the provisions of § 15.1-456 of the 1950 Code of Virginia, as amended,
and said Special Use Permit is hereby approved with the following
conditions related to the design, scale, use and operation:
(A) Development of the property shall be generally in accord
with the conceptual site plan entitled "The Village at Shenandoah"
prepared by E. T. Boggess and dated 6/9/97. The conceptual site plan
indicates the phased construction of the project and Exhibit (1) sets out
the time line projections for each phase. Minor revisions to the concept

Anita Terrace. Restricted emergency vehicle access shall be required and
allowed from either Woodbury Street or through the existing Shenandoah
Homes property.
(E) A fire suppression system shall be installed in all
residential units. The developer shall be responsible for all costs
associated with providing the adequate fire flows required for this fire
suppression system.
(F) The property owner shall pay real estate and any other
applicable local taxes on that area of the property designated on the
conceptual site plan as Independent Living (9.75 acres), that area of the
project identified as Congregate Care Facilities (1.75 acres), and 70%
of that portion of the project identified as the Galleria (including
land, buildings and related improvements). The remaining portion of the
project identified as Assisted Living (including the remaining 30%
portion of the "Gallery") shall be exempt from local taxation with the
provision that the property owner shall pay a service charge in lieu of
local taxation on this portion of the project in an amount equal to 20%
of the real estate tax rate on such property. Payment of this service
charge shall be conditioned upon the adoption of a resolution by the
Board of Supervisors and the enactment of legislation by the General
Assembly for the Commonwealth of Virginia designating this portion of the
project exempt from local taxation pursuant to Section 30-19.04 of the
Code of Virginia and Article X, Section 6(a)(6) of the Constitution.

1. Presentation on Virginia Association of Counties projects and
programs. (Dean A. Lynch, VAC Director of Local Government
Affairs.
Mr. Lynch updated the Board on the activities of VACO's to assist localities,
especially in the legislative area. He presented copies of VACO's 1997 Mate Legislation
Affecting Counties to the Board members and encouraged them to be active in the state
association. In response to inquiries about VACO's positions on Jim Gilmore's proposal
to eliminate the personal property tax. and taxing authority for elected school boards, Mr.
Lynch advised that he would .provide this information to the Board members by mail.
Supervisor Minnix arrived at 3:30 p.m.
Supervisor Nickens asked whether the Board had to approve raising the
County's personal property tax exemption for the elderly and disabled in view of recent
legislation that gave local governments the opportunity to increase the exemption from
$75,000 to $100,000 for financial worth. Mr. Mahoney advised that he would check into
this and if appropriate, bring back an ordinance for approval.
IN RE: NEW BUSINESS
1. Recommendations for 1998 Legislative Program for Virginia
General Assembly. (Paul Mahoney. County Attorney)
Mr. Mahoney advised that each year the Virginia Association of Counties
asked its members to submit their legislative program so that the final legislative program
can be approved at VACO's conference in November. This legislative program outlines

back to the Board with recommendations for utilization of these funds. The Vinton Town
Council approved the agreement at their meeting on May 20, 1997. Supervisor Eddy
advised that he agreed with the concept but preferred along-range and all-encompassing
document rather than a general agreement. Supervisor Nickens expressed appreciation
to the staff and the Vinton Town officials and advised that the agreement has been signed
and this action is to place the funds into a capital account.
Supervisor Nickens moved to approve the agreement and appropriate the
$125,000 into a capital fund. The motion carried by the following recorded vote:

3. Resolution approving the funding distribution methodology for
incentive funds to be distributed among the participating local
governments in the Fifth Planning District Regional Alliance.

Mr. Hodge advised that the State allocated $3 Million last year and $3 Million
this year for the Regional Alliance, and one of the requirements of the Regional
Competitiveness Program is that all participating local governments in a region must
approve a funding formula for distribution of incentive funds from the State in order ~to be

WHEREAS, at the AprFl 24 meeting of the Regional Alliance's Board of ~~~
Directors, the Board recommended to local governments the following funding distribution
methodology:
90% of the total funds to be distributed on a per capita basis;
8% of the total funds to be distributed based on the level of fiscal
stress of each local government as calculated by the Virginia
Commission on Local Government; and
2% of the total funds be allocated to the Regional Alliance for
administrative and research; support.
NOW, THEREFORE BE IT RESOLVED that. the Roanoke County Board of
Supervisors approves the funding distribution methodology as recommended by the Board
of Directors of the Fifth Planning District Commission.

4. Request for appropriation for Supplement #4 of the Roanoke

Mr. Mahoney advised that $6,837.70 is needed for Supplement #4 and the
amount being requested from the Board Contingency Fund is $3,419 and not $4,227 as
stated in the Board Report. Supervisor Nickens suggested that since supplements are
being issued every 18 months to two years, this item should be budgeted for in the future.

2. That the County Adm+nistrator may authorize or delegate the authorization
of the transfer of any unencumbered balance or portion thereof from one department to
another within a fund.
3. That all funded outstanding encumbrances, both operating and capital,
at June 30, 1997, are reappropriated to the 1997-98 fiscal year to the same department
and account for which they are encumbered in the previous year.
4. That appropriations designated for capital projects will not lapse at the
end of the fiscal year but shall remain appropriated until the completion of the project or
until the Board of Supervisors, by appropriate action, changes or eliminates the
appropriation. Upon completion of a capital project, staff is authorized to close out the
project and transfer to the funding source any remaining balances. This section applies
to appropriations for Capital Projects at June 3.0, 1997, and appropriations in the 1997-98
budget.
5. That all school fund appropriations remaining at the end of the 1996-
97 fiscal year not lapse but shall be appropriated to the School Capital Improvements Fund
in fiscal year 1997-98.
6. That all General Fund appropriations remaining unexpended at the
end of the 1996-97 fiscal year not lapse but shall be reappropriated as follows:
a) 40% of these unexpended appropriations shall be transferred to the
unappropriated Capital Fund Balance;
b) 60% of these unexpended appropriations shall be re-appropriated to
the same department far expenditure in fiscal year 1997-98 as
provided by Resolution 042396-5.

Review" on June 2, 1997. In response to an inquiry, he stated that State Code Title 15.1,
Section 456, provides for Planning Commissions to look at the acquisition or creation of
public facilities fo determine if they are in conformance with the adopted Comprehensive
Plan.

Supervisor Eddy nominated Buford Butts, alternate member, to complete the
term of the late Larry Lester which will expire April 27, 2000. Chairman Johnson advised
that nominations for another alternate member will be taken at next meeting.

Supervisor Nickens nominated Roger I. Fails to serve another four year term
which will expire June 30, 2001.

RESOLUTION 052797-9.1 OF APPRECIATION TO DENISE SWANSON
FOR HER EFFORTS IN MAKING ROANOKE COUNTY SCHOOL
BUILVINGS ACCESSIBLE TO EVERYONE
WHEREAS, all children deserve the opportunity to attend school in a
supportive, accessible, and safe atmosphere; and
WHEREAS, many older Roanoke County school buildings are not yet
accessible to children with disabilities, and prevent students from obtaining an education
in a dignified and equitable manner; and
WHEREAS, the "Open Doors, :Open Minds: Accessible Schools. for All"
program was developed to place automated entry doors at every school building in the
County through private donations, helping special education students obtain the access
to schools which they need and deserve, so that they can prepare themselves for a happy
and productive future; and
WHEREAS, Denise Swanson has been instrumental in the "Open Doors,
Open Minds: Accessible Schools forAl!' project, working with the Roanoke County school
system, elected and appointed officials, and private contributors and organizations to help
achieve the goal of Accessible Schools for All.
NOW, THEREFORE, BE IT RESOLVED, that the Roanoke County Board of
Supervisors, does hereby extend its sincere appreciation to Denise Swanson. for the hard
work, dedication and effort she has expended in making our school .buildings accessible

suggestion for the creation of the Blue Ribbon Committee is being developed, and he will

Mr. Mahoney advised that this is the first reading of the ordinance and public
hearing to increase the salaries of the Board of Supervisors by 32% which is the same

work, medical appointments, etc. may be placed on a route system ~to maximize the {I
efficiency of the CORTRAN benefit to all County residents. The Board added $35,000 to
the County budget for public transportation services to pay for these services. He
recommended that a survey be done after the transition period of approximately thirty to
sixty days. In response to an inquiry, he advised that RADAR and Social Services will
work with citizens unable to pay the fare. He also responded to several questions from
Supervisor Eddy.
Supervisor Nickens moved to approve the s#aff recommendations. The

RESOLUTION 061097-1 ADOPTING A LEGISLATIVE PROGRAM FOR
THE 1998 SESSION OF THE VIRGINIA GENERAL ASSEMBLY, AND
PETITIONING THE GENERAL ASSEMBLY TO FAVORABLY CONSIDER
THE TOPICS AND ISSUES ADDRESSED HEREIN
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, has
iden#ified major legislative issues of state-wide concern to be considered by the 1998
session of the Virginia General Assembly; and
WHEREAS, the Board hereby recommends these issues to its state-wide
organization, the Virginia Association of Counties, for consideration in the adoption of its
legislative program; and
WHEREAS, the Board adopts this resolution as its Legislative Program for
the Virginia Association of Counties for the 1998 session of the Virginia General Assembly.
NOW, THEREFORE, Be It Resolved by the Board of Supervisors of Roanoke
County, Virginia, that the following legislative initiatives are submitted to the Virginia
Association of Counties for its legislative program for the 1998 session of the Virginia
General Assembly for its favorable consideration and adoption.
I.
A. Education. Realizing that public education is the foundation of
American democracy and the cornerstone of our future economic well being, the County
urges the General Assembly to consider favorably the following actions.
1) The Constitution of the Commonwealth of Virginia should be
amended to provide that elected school boards may be granted the authority and
responsibility for taxation to support public education.
2) The General Assembly should enhance funding for public
education, including increasing the funds available to the Literary Fund for local school
capital construction or renovation projects. The General Assembly should increase funding
for capital construction and renovation projects based upon the locality's local effort in
support of these capital projects.

H. Roanoke. County supports continued and increased funding for
Regions! Competitiveness Act.
I. Roanoke County vigorously opposes anv attempt to restrict or
eliminate local sources of taxation, including personal property taxation and business and
professional occupational licensing, unless local governments are guaranteed the
opportunity to replace lost sources of local revenue with comparable, equivalent,
independent sources of revenue to allow localities to fulfill their public service obligations.
J. Roanoke County supports authority to impose an additional one-half
percent ('/%) local option sales tax.
K. Roanoke County supports expanding local authority to create
transportation districts, to impose local option motor vehicle fuels taxes, and to expend
these tax proceeds for local transportation improvements.
L. Roanoke County supports legislation appropriating funds and directing
the State Compensation Board to modify staffing standards for local jails and court
services positions for Sheriff's offices.
M. Roanoke County supports amending Chapter 6.1, "Virginia Tire Tax"
of Title 58.1, "Taxation" (a) to increase the tire tax from $.50 to $1.25, and (b) to direct and
authorize the Department of Waste Management to utilize the increased Waste Tire Trust
Fund to remediate illegal or abandoned waste tire dumps.
N. Roanoke County supports increasing state aid for public libraries by
$1.4 Million each for FY 99 and FY 2000; That the Commonwealth fully fund state aid by
FY 2001; and that the Commonwealth shall adopt and fund a statewide technology plan
for public libraries. The objective of such a plan will be to provide public libraries with the
technological support for public, universal access to networked information.
II.
That the Clerk to the Board of Supervisors is directed to send a certified copy
of this resolution to the Virginia Association of Counties.

to execute a Performance Agreement with Country East LLC

Mr. Mahoney advised that this pertormance agreement settles pending
eminent domain litigation with Country East LLC, secures the real estate necessary to
complete the Kroger economic development project, and authorizes a new economic
development project with Country East, LLC. Key elements in the settlement and
performance agreement are: (1) Country East LLC shall convey to the Industrial
Development Authority 0.658 acres of real estate which the IDA will recanvey to the Kroger
Co., (2) Country East LLC shall dedicate 0.530 acres for the relocation of Garman Rd.; (3)
Country East LLC shall dedicate a new drainage easement to the County; {4) the County
shall pay to Country East LLC the sum of $70,000 for this real estate; (5) the IDA shall
convey to Country East LLC the eastern remaining portion of the Burritt property,
approximately 1.044 acres; (6) Country East LLC shall construct improvements with a -
taxable value of at least $2 million within four years; (7) Country East LLC shall reimburse

1. Ordinance authorizing the renewal of a lease of real estate for a

Mr. Rand reported that the County has a 911 site located on Tinker Mountain
in Botetourt County. The site was (eased for three years at $2,000 per year and expires
on July 1, 1997. Anew lease has been negotiated at $2,300 per year for three years
ending June 30, 2000, and $2,600 for the following two years ending June 30, 2002.
Funds are available in the E911 account.
Supervisor Eddy noted that the site location in the report stated Hollins
Magisterial District when the site is actually in Botetourt County.

3 Ordinance authorizing acquisition of 0.368 acre parcel of real
estate in Montclair Estates Section 9. (George Simpson}

Mr. Simpson advised that Parcel A was recorded as a stormwater
management parcel in Montclair Estates, Section 9, in 1983. Due to lack of maintenance
and nonpayment of real estate taxes by the homeowners association, the parcel was sold
at an escheat sale in December 1996. The parcel has been maintained by Roanoke
County over the past several years and contains asmalltwo-year detention pond that is
directly adjacent to the proposed Montclair Regional Pond. Staff has discussed acquiring
this parcel from the current owner for $100 which was his purchase price at the escheat
sale for the purpose of conveying it to the City of Roanoke for use in the regional facility
or abandoning the detention pond and conveying the parcel to adjacent property owners.
In response to questions, Mr. Simpson advised that if the City wants the
parcel they will seed it anal it will no longer be a nuisance, but if the City is not interested,
staff will contact the adjacent property owners.

WHEREAS, this section provides that the maximum annual salaries therein
provided may be adjusted in any year by an inflation factor not to exceed five (5%) percent;
and
WHEREAS, the first reading and public hearing on this ordinance was held
on May 27,1997; the second reading was held on June 10, 1997:
NOW, THEREFORE, it is hereby ORDAINED by the Board of Supervisors
of Roanoke County, Virginia, that the annual salaries of members of the Board of
Supervisors of Roanoke County, Virginia, are hereby increased by an inflation factor of
3.2% pursuant to the provisions of Section 3.07 of the Roanoke County Charter and
Section 14.1-46.01:1 of the 1950 Code of Virginia, as amended. The new annual salaries
shall be $11,473.36 for members of the Board. In addition, the chairman of the Board will
receive an additional annual sum of $1,800 and the vice-chairman of the Board will receive
an additional sum of $1,200.
This ordinance shall take effect on July 1, 1997.

Mr. Hartley advised that on April 22, 1997, this request to rezone and grant
a special use permit to construct a home for adults was denied. On May 13, 1997, a
motion to reconsider was passed and the public hearing was rescheduled and was

The following individuals spoke concerning the proposed rezoning and
special use permit:
1. Jim Milder. 5015 Hubert Road, Roanoke, Pastor of the First Church of
od advised that his church operates assisted living centers throughout the state, and
that they should be allowed to minister to senior citizens. He felt that there was a
perception that the Board of Supervisors did not want senior citizens in the Valley
Supervisor Nickens asked that the church provide information on what would
happen to those living in the assisted living facility when they could no longer pay their
rent.
2. Malcolm Jamison, 5715 Santa Anita Terrace, asked for a map of the
phases of the project. Chairman Johnson asked staff to provide a map to post at the
Hollins Library.
3. Tony Riquelmyt 5756 Sierra Drive expressed appreciation to the Board
for assuring that everyone pays their fair share of taxes.
Supervisor Eddy moved to continue the rezoning until June 24, 1997,so that
the Board members could review the revisions to the proposed conditions from the

Supervisor Minnix: (1) He has received calls from senior citizens
requesting consideration for a reduction in the cost to ride CORTRAN. He asked John
Chambliss and Mr. Hodge to look at establishing zones and that fares would be based on
the zones. Mr. Hodge will check on this and bring it back to Board in several weeks. (2)
He asked about the plans #o allow fishing at the Spring Hollow Reservoir. Gary Robertson
advised that the staff has received a preliminary study from Virginia Tech and that he will
provide a copy to the Board members. If fishing is allowed, the fish will have to be
stocked. (3) He asked Mr. Hodge about the Certificates of Appreciation to the Coffee Pot
Ladies Auxiliary for their work on the Route 221-419 triangle. Mr. Hodge advised that he
was getting their names and would have them ready shortly.
Supervisor Eddv• (1) He advised that he sent a memo to Mr. Hodge
requesting him to look at the fees charged for the County meeting spaces and suggested
that the fees and rules should be consistent. He asked if any of the other Board members
were interested in pursuing. No interest was indicated by other Board members. (2) He

Elementary Schools, Brandon Oaks Nursing Home and the Roanoke Valley History
Museum; to Harold M. Swank and his wife for mentoring a student and providing
academic, emotional and social support; to Tony Hehn for his volunteer efforts at the
American Legion Post 3, teaching Bridge at Roanoke County and working at the Apple
Butter Festival, and volunteering at the Veterans Hospital; and to the Retired Senior
Volunteer Program who help volunteers find the right volunteer job.

The Roanoke Area Tech Prep Consortium, established in 1992,
consists of Virginia Western Community College and the seven
school divisions surrounding the college. Roanoke County has
been the fiscal agent for state administered Carl Perkins federal
funds which the consortium has received annually since 1992.
Each year money has been appropriated for the grant amount and
reimbursed quarterly to the county by the state.
The grant of $75,000 for fiscal year 1997-98 will continue Tech
Prep Consortium activities including a part-time director's
salary, secretarial pay, staff development activities, student
recruitment, curriculum development, articulation, work place
experiences for students and teachers, classroom materials and
supplies, and program evaluation.
FISCAL IMPACT: None
Staff recommends that the Board of Supervisors authorize
acceptance of the grant and appropriation of the funds.

During the Fall months of 1996 and the early winter months of 1997, Martin &
Associates, along with the Blue Ribbon Committee, developed a comprehensive facility
program for all of Roanoke County Public School facilities. This plan was presented
on March 17, 1997, in-~ joint presentation to the Roanoke- County School- Board and
the Roanoke County Board of Supervisors.
A critical part of this comprehensive facility study, and the final recommendations, was
the prioritization of the necessary projects. In considering the individual facility needs,
along with the ability of Roanoke County to fund the necessary improvements, it was
the recommendation that all proposed projects be placed into one of three (3) phases,
to be implemented over a time period of approximately ten (10) years.
All capital improvement projects contained within Phase I of the recommendations,
were considered as critical facility needs. Subsequently, the Blue Ribbon Committee
suggested that each of these projects be unplemented at the earliest possible time.

County High School and the existing Cave Spring High

As a part of the comprehensive facility study, a graphic chart was included which
represented the three (3) project phases being developed over a ten (10) year time span.
This graphic chart also indicated that the initial construction costs provided would
escalate with inflation,. and the initial $100 million required for capital improvements,.
could become $121 million by the end of this ten (10) year time frame.
~I ~ It becomes readily apparent that Phase I be implemented as soon as possible, in order
to minimize inflationary cost increases. With this factor in mind, it was the direction
of the Roanoke County School Board, at their regular monthly meeting held on May 8,
1997, that all Phase I projects begin immediately, pending adequate funding from the
Roanoke County Board of Supervisors.
With this direction, the objective of further studies became threefold.
The initial task was to estimate the total project costs of implementing each of the
Phase I projects. These costs were to include estimates of site acquisition, utilities,
connection fees, Architectural/Engineering services, outside engineering consultants,
site development, construction costs, furnishings, technology, media resources, and
equipment costs.

Secondly, was the requirement to establish a time frame for completion of each capital '
improvement project. Each time line was to begin with the issuance of a Request for
Proposal for ArchitecturaUEngineering services and continue through the completion
and occupancy of the individual facility. Then, in conjunction with the above cost
figures; our task-was to estimate-the monthly-breakdown-af expenditures during-the- - -- - - --- - -
entire duration of the project.
Finally, was the task of compiling all of the above information into an estimated
monthly tabulation of project expenditures, for all projects considered in Phase I of
the Blue Ribbon Committee's recommendations.
It is the intent of this report to summarize that information in an effort to produce a
working document which can be used in evaluating the availability, methods and
schedule of funding required to accomplish all work indicated herein.

ASSUMPTIONS
The preparation of acry study and/or budget requires numerous assumptions to be made
regarding future actions. Likewise, the information contained in this report is a result
_ of assumptions based upon the best available information and knowledge of the
I~ Roanoke County school system, as of this date. Some of the assumptions which have
helped in the development of this report include the following:
• It is the desire of the Roanoke County School Board to move
forward with all Phase I projects, in an expeditious manner,
pending funding by the Roanoke County Board of Supervisors.
With this in mind, all projects are scheduled to begin, directly
following the procurement of Architectural/Engineering services.
For purposes of this report, this procurement process is scheduled
to take place during the months of June and July, 1997.
f The scope of work included within each project is a direct result of
findings contained within the Comprehensive Facility Study and
recommendations made by the Blue Ribbon Committee. Before
any project is started, a review of this scope of work is crucial to
insure that all educational requirements are satisfied.
J • The time schedules stated herein assume an "average" amount of
time required for completion of the specific tasks. It is also
assumed that reviews, approvals, funding and award of contracts
will be expedient, in order to keep each individual project on

• Prior to finalizing any specific time line or award of any individual
contract, adequate information should be considered regarding the
final scope of work and the ability to produce that work within the
necessary deadline.
• Where construction projects are scheduled to begin within the 1998
calendar year, an inflation factor of four percent (4%) has been
included within the projected coashuction costs. In instances where
projects are scheduled to begin within the 1999 calendar year, an
inflation factor of eight percent (8%) has been included within the
projected construction costs.
• Amhitechunl /Engineering fees have been established by means of
the Commonwesilth of Vugiuia Capital Outlay Manual, plus 0.04%
for reimbursable expenses. Schedule'A' has been utilized for new
construction aad Schedule 'B' has served as a guideline for
renovation/additionprnjects. These fees should be considered and
negotiated individually, based upon the actual scope of work.

• Land acquisition costs assume purchase options, geological
investigations, sale price, real estate commissions, legal- fees,
availability and connection to off-site utilities, VDOT approvals
and other related costs directly attributable to the site acquisition.
Exact acreage and purchase price will need to be carefully
considered as a potential site is identified.
• The renovation costs included for the interior of Burlington
Elementary School and Clearbrook Elementary School are of a
general nature (i.e. technology wiring, fire alarms, general repairs
and replacement ofnecessary floor & ceiling materials, etc.). The
costs provided are not all inclusive, to make these facilities appear
as new. Should this be a priority, significant dollars will need to be
added to these projects.
• The construction costs for Clearbrook Elementary School includes
an eight (8) classroom addition, in lieu of the six (6) classroom
addition as recommended by the Blue Ribbon Committee. The
Comprehensive Facility Study recommended a 6-8 classroom
addition and after review of the proposed student transfers from the
Penn Forest Elementary School, at least two additional classrooms
will be necessary for this school. This modification has added
approximately $225,000 to the overall construction costs.

PROJECT DESCRIPTION:
Design and construct a new Pyramid V High School, located within the southern portion of
Roanoke County. This new facility will have a core capacity to accommodate a future
enrollment of 1,400 students, with. sufficient square footage capacity to provide educational
programs and activities for 1,100 students. Land purchased for this new facility should he of
sufficient size to accommodate future growth for all activities.
