AGENDA ITEM: RESOLUTION ESTABLISHING A MEETING SCHEDULE FOR THE BOARD
OF SUPERVISORS OF ROANOKE COUNTY FOR CALENDAR YEAR 1998
AND ADOPTING RULES OF PROCEDURE FOR SUCH MEETING
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
In January of every year the Board of Supervisors reorganizes itself
by electing a chairperson and vice-chairperson, by establishing a meeting
schedule for the upcoming year, and by adopting rules of procedure. The
attached resolution suggests a meeting schedule for the calendar year
1998 and certain rules of procedure to govern your meetings.
In reviewing the proposed meeting schedule you should note the
following:
Regular meetings twice a month on the second and fourth Tuesdays
(the evening public hearing meeting being scheduled for the fourth
Tuesday of each month).
Joint meetings with Roanoke City have been scheduled for February
2, April 14, July 6, and October 13, 1998.
Only one meeting scheduled for August (August 18, 1998) (often the
need for formal board action decreases in the summer months, an
abbreviated meeting schedule is followed by many localities).
The Board may consider two alternatives for meetings during the
month of November. Staff recommends the alternative set out in the
prepared resolution which provides for one meeting in November on
Tuesday, November 17. The second alternative is to schedule two
meetings in November - Tuesday, November 10 and Tuesday, November
24. Election Day is Tuesday, November 3; Veteran's Day (State and
Federal holiday) is Wednesday, November 11. The Virginia
Association of Counties routinely schedules its annual meeting for
the second weekend in November (in this case, November 8 through

10). Thanksgiving is scheduled for November 26.
The 1999 organizational meeting is scheduled for Monday, January 4,
1999.
Next, the Board will note that the rules of procedure are the same
as previously adopted by the Board.
STAFF RECOMMENDATION:
It is recommended that the Board consider the adoption of the
attached resolution.

RESOLUTION ADOPTING A LEGISLATIVE PROGRAM FOR THE 1998 SESSION
OF THE VIRGINIA GENERAL ASSEMBLY, AND PETITIONING THE GENERAL
ASSEMBLY TO FAVORABLY CONSIDER THE TOPICS AND ISSUES ADDRESSED
HEREIN
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, has
identified major legislative issues of state-wide concern to be
considered by the 1998 session of the Virginia General Assembly; and
WHEREAS, the Board adopts this resolution as its Legislative Program
for the 1998 session of the Virginia General Assembly.
NOW, THEREFORE, Be It Resolved by the Board of Supervisors of
Roanoke County, Virginia, that the following legislative initiatives are
submitted for its legislative program for the 1998 session of the
Virginia General Assembly for its favorable consideration and adoption.
I.
A. Education. Realizing that public education is the foundation
of American democracy and the cornerstone of our future economic well
being, the County urges the General Assembly to consider favorably the
following actions.
1) The Constitution of the Commonwealth of Virginia should
be amended to provide that elected school boards may be granted the
authority and responsibility for taxation to support public education.

2) The General Assembly should enhance funding for public
education, including increasing the funds available to the Literary Fund
for local school capital construction or renovation projects. The General
Assembly should increase funding for capital construction and renovation
projects based upon the locality's local effort in support of these
capital projects.
3) Local school divisions should be authorized to establish
opening dates for school.
4) Disparity funding should be based not only upon the
number of students eligible for free or reduced fee lunches, but also
upon the locality's local tax effort in support of education. Disparity
funding should be based upon the composite index (which measures a
locality's relative fiscal ability to provide its share of the cost of
a local school system that meets the standards of quality) and the
locality's local effort in support of that school system.
5) Roanoke County opposes legislation that would permit the
creation of charter schools. The establishment of charter schools would
promote the creation of select schools that would benefit only select
children, thereby damaging equal opportunity and equal access to public
education. The elimination, modification or waiver of laws or
regulations to benefit charter schools should instead be considered for
implementation in all public schools and for all children.
B. Roanoke County supports additional new construction and
maintenance funding for the Virginia Department of Transportation for

secondary and primary roads. Additional funding for new construction
projects will address critical transportation needs of all local
governments. Additional maintenance funding shall be used for an
expanded program to mow grass and weeds, and inspect and clean drainage
pipes and culverts.
C. Roanoke County supports legislation amending Section 14.1-
46.0:1 to increase the salary supplement for the Chairman of the Board
of Supervisors from $1,800 to $2,500 per year.
D. Roanoke County supports continued and increased funding for
the Comprehensive Services Act, the Virginia Community Juvenile Crime
Control Act, the Family Preservation Act, local police departments (HB
599 funding), and the Regional Competitiveness Act.
E. Roanoke County vigorously opposes any attempt to restrict or
eliminate local sources of taxation, including personal property taxation
and business and professional occupational licensing, unless local
governments are guaranteed the opportunity to replace lost sources of
local revenue with comparable, equivalent, independent sources of revenue
to allow localities to fulfill their public service obligations.
F. Roanoke County supports authority to impose an additional
one-half percent (~%) local option sales tax.
G. Roanoke County supports expanding local authority to create
transportation districts, to impose local option motor vehicle fuels
taxes, and to expend these tax proceeds for local transportation
improvements.

H. Roanoke County supports legislation appropriating funds and
directing the State Compensation Board to modify staffing standards for
local jails and court services positions for Sheriff's offices.
I. Roanoke County supports amending Chapter 6.1, "Virginia Tire
Tax" of Title 58.1, "Taxation" (a) to increase the tire tax from $.50 to
$1.25, and (b) to direct and authorize the Department of Waste Management
to utilize the increased Waste Tire Trust Fund to remediate illegal or
abandoned waste tire dumps.
J. Roanoke County supports increasing state aid for public
libraries by $1.4 Million each for FY 99 and FY 2000; That the
Commonwealth fully fund state aid by FY 2001; and that the Commonwealth
shall adopt and fund a statewide technology plan for public libraries.
The objective of such a plan will be to provide public libraries with the
technological support for public, universal access to networked
information.
K. Roanoke County requests that Section 46.2-1001 be amended to
add Roanoke County to the list of jurisdictions whose law-enforcement
officers are authorized to perform vehicle safety inspections.
L. Roanoke County requests that Section 33.1-75.3 be amended to
add Roanoke County to the list of counties authorized to expend general
revenues, revenues derived from the sale of bonds, or federal revenue
sharing funds for the purpose of constructing or improving primary or
secondary highways.
M. Request the General Assembly to authorize the establishment of

a commission to fund and/or operate a joint juvenile detention facility
for the Counties of Roanoke and Franklin, and the Cities of Roanoke and
Salem.
N. Roanoke County supports increasing the "Two-for-Life" funding
for the benefit of rescue squads and the emergency medical services
system to a "$4-for-Life" Program.
O. Roanoke County supports legislation relieving local
governments of the responsibility of meeting recycling rates on all
wastes collected by private haulers and diverted from waste disposal
facilities identified to receive such wastes as set out in the local
solid waste management plan. This legislation should also require that
private haulers diverting such wastes be held accountable and responsible
to meeting the same recycling rates and requirements as the local
governments.
Section 10.1-1411 imposes a 25% recycling mandate on local
governments. The General Assembly has severely limited the ability of
local governments to regulate the flow of waste. This proposal would
relieve local governments of the responsibility of meeting this recycling
mandate on all wastes collected by private haulers. It would also
require that private haulers be subject to the same recycling mandates
as local governments.
P. Roanoke County supports allowing the disposal of land clearing
vegetative debris (including tree stumps) in less expensive facilities
in a manner not detrimental to the environment. This would require

groundwater and methane gas monitoring, financial assurances from the
owner/operator, and local governing body certification of compliance with
all local ordinances.
II.
That the Clerk to the Board of Supervisors is directed to send a
certified copy of this resolution to Senator John S. Edwards, Senator
Malfourd W. "Bo" Trumbo, Delegate H. Morgan Griffith, Delegate Clifton
"Chip" Woodrum, Delegate C. Richard Cranwell, Delegate A. Victor Thomas;
Mary F. Parker, Roanoke City Clerk; Members of the Roanoke City Council;
Forest Jones, Clerk for Salem City Council; Members of the Salem City
Council; and the Fifth Planning District Commission, and the Virginia
Association of Counties.

WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened
an executive meeting on this date pursuant to an affirmative recorded vote and in
accordance with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by the
Board of Supervisors of Roanoke County, Virginia, that such executive meeting was
conducted in conformity with Virginia law.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke
County, Virginia, hereby certifies that, to the best of each members knowledge:
1. Only public business matters lawfully exempted from open meeting requirements
by Virginia law were discussed in the executive meeting which this certification resolution
applies, and
2. Only such public business matters as were identified in the motion convening

IN ROANOKE, VIRGINIA, ON MONDAY,
MEETING DATE: January 5, 1998
AGENDA ITEM: Ordinance approving a purchase agreement with Virginia Polytechnic Institute
& State University and the Commonwealth of Virginia for 377 acres of real
estate known as the Catawba Farm, being shown on the Roanoke County land
records as part of Tax Map Number 7.00-1-5 and authorizing the purchase
of the property for economic development purposes.
COUNTY ADMINISTRATOR'S COMMENTS:
EXECUTIVE SUMMARY:
Roanoke County has identified the Virginia Tech property in the Catawba Valley as a tract of real
estate valuable to the quality of life of its citizens. In April of 1996, the Governor's Commission on
Conversion of State-Owned Property identified the Catawba Farm as property that COULD be sold
to increase the state's general fund revenues. In the past, this property has been considered for uses
such as a regional jail or a training center for VDOT.
The Catawba Farm is also on the Vuginia National Historic Registry list. Although the property does
not hold the "official"designation as an historic site. Catawba Farm is a substantial tract of real estate
consisting of 377 acres that is strategically located to Interstate 81 (approximately 7 miles); serves
as an asset to the County for scenic beauty and the agriculture base; and abuts the Appalachian Trail.
With the expanding opportunities in the economic development arena with tourism and technology
(specifically the smart technologies for transportation and medical research), this property has the
potential to offset the majority of purchase price as an economic development project. Purchase of
this property would grant the County the ability conserve or preserve the property to meet the needs
of the citizens.

FISCAL IMPACT:
The County will make the payment for this property over a ten year period. At closing, $100,000 will
be paid. The balance will be paid at one year increments of $100,000 each. Interest will not be
charged. The first payment of $100,000 will need to be appropriated from the Unappropriated Fund
Balance.
ALTERNATIVES:
1. Adopt the first reading of the proposed ordinance approving the Purchase Agreement with
Virginia Polytechnic Institute & State University/Commonwealth of Virginia to acquire the
property with ten equal payments of $100,000 without interest for a total purchase price of
$1 million. Appropriation language to be drafted and presented during the second reading
of the proposed ordinance.
2. Decline to exercise the option.
STAFF RECOMMENDATION:
Staff recommends alternative No.l in order to acquire the Catawba Farm site for economic
development, preservation, or conservation purposes.

ORDINANCE AUTHORIZING THE ACQUISITION OF CERTAIN REAL ESTATE
LOCATED ON STATE ROUTE 779 (CATAWBA) FROM THE COMMONWEALTH OF
VIRGINIA FOR THE PURPOSE OF PROMOTING ECONOMIC DEVELOPMENT AND
PROTECTING VALUABLE ENVIRONMENTAL RESOURCES, AND ASSIGNMENT TO
THE INDUSTRIAL DEVELOPMENT AUTHORITY
WHEREAS, Section 18.04 of the Roanoke County Charter provides that
the acquisition of real estate shall be accomplished only by ordinance;
and, the first reading of this ordinance was held on January 5, 1998, and
the second reading of this ordinance was held on January 13, 1998; and,
WHEREAS, the County of Roanoke, Virginia, (the "County") intends to
acquire approximately 377 acres of real estate, being a identified as Tax
Map Number and which is located in the Catawba Valley from the
Commonwealth of Virginia, Virginia Polytechnic Institute and State
University, and which is known as the Catawba Farm, for the purposes of
promoting economic development and protecting valuable environmental
resources; and,
WHEREAS, County staff has negotiated a Contract of Purchase and Sale
'for this real estate with the Commonwealth of Virginia, Virginia
Polytechnic Institute and State University; and
WHEREAS, pursuant to §15.2-1205 of the Code of Virginia (1950, as
amended), the Board of Supervisors is authorized to donate and assign its
rights under a Contract of Purchase And Sale to the .Industrial
Development Authority (IDA), in furtherance of the purposes for which the
IDA was created; and,

WHEREAS, it is in the public interest of the citizens of Roanoke
County to acquire this real estate in the Catawba Valley for these
purposes.
BE IT ORDAINED, By the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That the acquisition by contract of purchase and sale of
approximately 377 acres of real estate located on State Route 779 in the
Catawba Valley, and being identified as Tax Map Parcel No. for
the purposes of promoting economic development and protecting valuable
environmental resources from the Commonwealth of Virginia, Virginia
Polytechnic Institute and State University, for the sum of One Million
($1,000,000) Dollars, is hereby authorized and approved.
2. That the acquisition of this property shall be accomplished
through deferred purchase money financing in ten (10) equal annual
installments. The installment payments shall be subject to future
appropriations by the Board of Supervisors. Nothing in this Ordinance
shall constitute a debt pledging the full faith and credit of the County.
3. That the County Administrator is hereby authorized and
directed to assign the County's contract rights to acquire this real
estate to the Industrial Development Authority of Roanoke County, which
shall proceed with acquisition of this real estate, subject to the terms
and conditions provided in the contract, and the IDA shall assume all
obligations and responsibilities of the County provided for in the
contract.

4. The County Administrator or Assistant County Administrators
are hereby authorized to take such actions and to execute such documents
as may be necessary to accomplish the purposes of this transaction, all
upon form approved by the County Attorney.
5. That this ordinance shall take effect immediately upon its
adoption.
