Mahoney County Attorney CULINTY ADI~IINITRATOR'S +GC!I~MENTS.~ SUMMARY +DP INFORMATION: Section 27-'I (~ of the Code of Virginia allows the Board of Supervisors to dissolve any firelemergency medical services GEMS} company if that company has failed for three months successively to consist of twenty effective members or if it has failed to keep its equipment in good and serviceable condition or for any reason it deems advisable. The Clearbrook First Aid and Rescue Squad, Inc. has unfortunately suffered a significant reduction in the number of its members and volunteers and it has fallen below the "twenty effective members" minimum. In addition, it has been unable to respond to any medical emergencies or calls for service for more than the past six years. Therefore, it is necessary for the Board of Supervisors to consider taking this difficult step and dissolving this failed first aid and rescue squad. In October 2009 at the Board's direction I filed a petition for a Writ of Quo Warranto to inquire into the lawfulness of the activities of the Clearbrook First Aid' and Rescue Squad, Inc. to revoke its corporate charter, to enter a decree for dissolution, to appoint a receiver, to collect its books, papers, records and assets and to distribute its funds in accordance with its charter and the laws of the Commonwealth of Virginia in order to benefit the citizens of the Clearbrook community and the taxpayers of Roanoke C©unty. After several hearings before Judge Swanson of the Circuit Court, the Court decreed that the net assets of this corporation be distributed to~ the County. These net assets total ~F9,932.05. These funds will be utilized by Chief Burch to purchase first aid and life saving equipment from the list of equipment shown on the attached exhibit, This Page 1 of 2 equipment would be used to benefit the citizens in the Clearbrook community since these funds are derived from appropriations from the Board of Supervisors and donations from the citizens in the Clearbrook community. The Board is requested to accept these funds and to appropriate them to the Fire and Rescue Department to purchase first aid and life saving equipment for the benefit of the Clearbrook community. The Chief is authorized to exercise his discretion in the acquisition of the equipment listed in the exhibit to the extent that funds are sufficient and available. The department will endeavor to expend these funds by the end of the fiscal year; however, due to the receipt of these funds being so late in the fiscal year, we request approval to roll over 100 percent of any remaining balance to next fiscal year should we encounter obstacles that prevent the completion of the expenditures. The County will be responsible for any claims by creditors of the Clearbrook First Aid and Rescue Squad, Inc. up to the amount of the assets awarded to it by the Court's decree. Staff is unaware of any liabilities for claims of creditors. STAFF RECOMMENDATION: It is recommended (1 } the Board favorably consider the adoption of the attached resolution and (2} accept and appropriate the sum of $69,932.05 to the Fire and Rescue Department's operating budget and approval to roll over 100 percent of any unspent funds to the next fiscal year. This presentation allows the same level of budget comparison as is required by Generally Accepted Accvur~ting Principles for financial reporking purposes. AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, MAY 11, 2010 ORDINANCE TO APPROPRIATE FUNDS FOR THE FISCAL YEAR 2010-2011 BUDGET WHEREAS, upon notice duly published in the newspaper, a public hearing was held on April 27, 2010, concerning the adoption of the annual budget for Roanoke County for fiscal year 2010-2011; and WHEREAS, the Board of Supervisors of Roanoke County, Virginia, approved said budget on May 25, 2010, pursuant to the provisions of Section 13.02 of the Roanoke County Charter and Chapter 25 of Title 15.2 of the 1950 Code of Virginia, as amended; and WHEREAS, the first reading of this appropriation ordinance was held on May 11, 2010, and the second reading of this ordinance was held on May 25, 2010, pursuant to the provisions of Section 18.04 of the Roanoke County Charter. BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the following appropriations are hereby made from the respective funds for the period beginning July 1, 2010, and ending June 30, 2011, for the functions and purposes indicated: 2. That the County Administrator may authorize or delegate the authorization of the transfer of any unencumbered balance or portion thereof from one department to another. 3. That all funded outstanding encumbrances, both operating and capital, at June 30, 2010, are re-appropriated to the 2010-2011 fiscal year to the same department and account for which they are encumbered in the previous year. 4. That appropriations designated for capital projects will not lapse at the end of the fiscal year but shall remain appropriated until the completion of the project or until the Board of Supervisors, by appropriate action, changes or eliminates the appropriation. Upon completion of a capital project, staff is authorized to close out the project and transfer to the funding source any remaining balances. This section applies to appropriations for capital projects at June 30, 2010, and appropriations in the 2010- 2011 budget. 5. That all school fund appropriations remaining at the end of the 2009-2010 fiscal year not lapse but shall be appropriated to the School Capital Fund in fiscal year 2010-2011 as follows: a.) Two-thirds of the year-end balance in the school operating fund will be allocated to the Major School Capital Reserve; b.) One-third of the year-end balance in the school operating fund, not to exceed $1,000,000, will be allocated to the Minor School Capital Reserve; c.) If the one-third allocation to the Minor School Capital Reserve exceeds $1,000,000, the excess will be added to the Major School Capital Reserve. 6. That all General Fund unexpended appropriations at the end of the 2009- 2010 fiscal year not lapse but shall be re-appropriated, as provided by Resolution 122104-4, as follows: a) 40 percent of these unexpended appropriations shall be transferred to the un- appropriated Minor County Capital Fund Reserve; b) 60 percent of these unexpended appropriations shall be re-appropriated to the same department for expenditure in fiscal year 2010-2011. 1. That all General Fund revenues collected in excess of appropriated revenues shall be re-appropriated, as provided by Resolution 122104-5, as follows: a.) Revenues in excess of budget will first be allocated to the General Fund Un- appropriated Balance, until the maximum amount for the current year is met, as specified in the General Fund Un-appropriated Balance Policy, as adopted by Resolution 122104-2; b.) The remainder of revenues in excess of budget will then be allocated to the Major County Capital Fund Reserve 8. Rescue fees collected by the Fire and Rescue Department in excess of budgeted amounts will be re-appropriated and allocated to the Fire and Rescue Capital Reserve. 9. That two million dollars from the Unappropriated Fund Balance is hereby appropriated to a reserve for contingency for unanticipated or emergency expenditures that may arise during the 2010-2011 fiscal year; and money allocated to the reserve for contingency must be appropriated by the Board of Supervisors before such money may be expended. 10. This ordinance shall take effect July 1, 2010. It has been nearly nineteen years since the ordinance was enacted, during which time some issues have arisen, including: The overdue fine of x.10 per day has become a minimal incentive to return materials • The current list of materials includes defunct formats, such as video and audio cassettes • It specifies replacement prices that reflect what an item cyst in 1991, rather than in 210 • It allows a delinquent patron to carry a relatively high fine limit of $25.00 before borrowing privileges are suspended In order to address these problems, the Library requests approval to revise the fine and fee schedule, as follows: Increase the daily fine to x.20 per day for ali borrowers Page 1 of 2 • eliminate the list of specific formats, which quickly may become obsolete, and generalize the list to allow far the introduction of new formats • Replace a default price for a last or damaged item with the item's current price • Lower the blocked account limit to $1 o to reduce the potential loss of County property and help patrons be more aware of overdue materials • Add a fee to partially offset the cost of borrowing through interlibrary loan The proposed revisions may have little impact on patrons since no one is charged a fine or fee unless materials are kept beyond the due date or are damaged or lost. Patrons may also avoid charges if they renewan item in person, by phone, online ortheymay registerto receive email reminders of any upcoming due dates. If approved, the changes would take effect, from and after July 1, Zg~ 0. FISCAL IMPACT: No additional funding is required. ALTERNATIVES: Leave the ordina~~nce unchanged, which could require manual overdue calculations by staff if the other localities in the Consortium approve the proposed fines and fees schedule. That the Policy for County Health Insurance Reserves is hereby adopted as follows; and 2. That this policy shall be in effect for fiscal year 2009-2010, and the subsequent fiscal years unless otherwise amended by the Board of Supervisors County of Roanoke, Virginia Policy for County Health Insurance Reserves Background The County of Roanoke participates in a joint health insurance program for eligible employees. This medical plan is self-funded with reinsurance coverage to protect the financial risk assumed. Reinsurance is composed of two elements: specific and aggregate stop loss. The specific stop loss protects the plan from any catastrophic claims paid on a member during the plan year. The aggregate limit protects the total financial liability assumed for the plan at a percentage above "expected" claims level. The County of Roanoke recognizes one of the keys to sound financial management is the development of financial policies. II. Purpose This policy will establish guidelines to maintain adequate health insurance reserves. Policy Guidelines a. Funds will be deposited into the Health Insurance Reserve from the following sources: i. The revenues from both employer and employee contributions and other income in excess of expenditures ii. Any additional funds that the Board of Supervisors appropriates to the Reserve b. Funds may be allocated from the Health Insurance Reserve for the following purposes: i. Health insurance premium increases ii. Aggregate limit iii. Uvellness program iv. Health Care Reform Fees v. Professional and consortium fees vi. SUIVII~IARY of INFORI~IATION: Since September of 2UD8, there has been an unusual amount of turnover in the Clerk's office. Due to budget constraints, the third staff position of Assistant Deputy Clerk was frozen and eventually eliminated. As a result of these staffing issues, the clerk's office has not been able to complete the minutes of the Board of Supervisors meetings in a timely manner. At the first Board meeting of 2910, minutes were fifteen meetings ~6'/~ months} behind. Although the retired Deputy Clerk and a transcriptionist were hired to work part-time strictly on minutes, as of today's meeting, minutes continue to be twelve meetings ~4 months} behind. Since July 1, 2009, the Clerk's office has paid part-time wages in the amount of X9,042.50 to produce minutes, which averages $9.32 per page. This does not include the Clerk's proofing time and cost of printing and materials. With current staff and budget, the Clerk"s vffce will. not be able to bring current and maintain the minutes in anear-verbatim form. {Note: Thetranscriptionistbeing utilized has found other full-time employment. and has relinquished her employment with the Clerk's office.} The Clerk's office is not able to meet our production goals on a regular basis. The initial investment would range from approximately $19,000 to $29,000 with annual hosting fees of roughly $9,000 to i ,ooor 3. A new, nonexempt secretarial position could be created at a pay grade 12, at which the starting annual salary could be $21,343 based on the fiscal year 2009- 2,010 Classification Plan.
