ITEM NUMBER ~- AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: July 13, 1999 AGENDA ITEM: Recognition of George Simpson and Butch Workman from Community Development Department for receiving National Flood Insurance Program Community Rating System Award COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION The Community Rating System (CRS) is a program to encourage communities to enact and enforce flood plain regulations. The National Flood Insurance Program (NFIP) provides federally backed flood insurance for homeowners and businesses located in the 100 year flood plain. Roanoke County was the first county in Virginia to obtain a Class 9 rating. To qualify for the CRS program, a community must be in good standing and enforce flood plain management ordinances in flood hazard area. Under the CRS, there is an incentive for communities to do more than just regulate to minimum national standards. Flood insurance premiums are adjusted to reflect community activities that reduce flood damage to existing and new buildings beyond NFIP protection level. Roanoke County citizens have received a 5% reduction in flood insurance premiums each year since 1991. This translates into a total savings of over $50,000. As an indirect result of our CRS activities, Roanoke County has received a $2.1 million grant from the Federal Government, and has been awarded a National Flood Insurance Program Community Rating System Award. I would like to recognize Assistant Director George Simpson and Engineer Butch Workman from the Community Development Department for their efforts at securing this grant and re iving this award. Hodge County Administrator Item No. ~ " AT A REGULAR MEETING OF THE ROANOKE COUNTY, VIRGINIA BOARD OF SUPERVISORS, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER, ROANOKE COUNTY, VIRGINIA MEETING DATE: July 13, 1999 AGENDA ITEM: Briefing on Roanoke County Water COUNTY ADMINISTRATOR'S COMMENTS: EXECUTIVE SUMMARY: This information is being provided in advance of the briefing, as many residents have had questions and concerns about the County water supply. Production from Spring Hollow increased over the July 4 weekend from 4.4 million gallons/day (mgd) to 5.7 mgd, due to increased County consumption and providing assistance to the City of Roanoke. This production could increase another 2 mgd following completion of the Loch Haven Road water line. Current capacity at the treatment plant is 15 mgd, which can be expanded to 23 mgd in the future. The County has not pumped water into the Reservoir since April 16, 1999, because of low flow in the Roanoke River. As the Board will recall, our withdrawal permit includes features to protect the environment of the river during times of low flow, which will be more fully explained during the briefing session. Based on anticipated water production of up to 8 mgd, Spring Hollow should have an adequate supply through the end of the year without pumping additional water. The City of Roanoke is currently under mandatory water conservation measures, but County residents are not affected by those regulations, even if their homes are served by water from Carvins Cove. The majority of the water used in North County is being offset by water supplied to the City through the interconnects in South County. The Roanoke County water systems in eastern Roanoke County, Campbell Hills and along Route 221 at the base of Bent Mountain still rely on groundwater as a supply. At this time, the water supplies are remaining steady. The Delaney Court (Mt. Pleasant area), Martin Creek (Bent Mountain) and Campbell Hills water systems do not presently have a secondary source of water available and the Utility Department has made provisions with water haulers to transport water to these areas if it becomes necessary. The remaining eastern Roanoke County areas have a secondary source of water through the City and the Town of Vinton. Water will continue to be available at Fire and Rescue facilities, 8 am - 8 p.m., seven days a week, throughout the County for residents on private wells experiencing difficulty with their water. It will enable us to provide 2 million gallons per day of water to our North County customers and the City, and is an important step in a regional system. Due to the current drought conditions, we have expedited the project, and shaved a month off the construction time by using two crews for ten hours per day. This has cost us an additional $5, 000, but the emergency nature of the situation called for a fast response. BACKGROUND: The Roanoke County Utility Department capital improvement program includes $2,470,000 for installation of future sections of the north transmission line between the years 1999 and 2004. The 1999-2000 budget funded $850,000 of this amount for the section of line between Dow Hollow Road and RCCRT. In anticipation of a reduction in Roanoke City contractual water purchases for the year 2003 - 2004, the CIP included $370,000 to be funded in the year 2002 - 2003. This project would extend the north transmission line along Loch Haven Road, across I-81 to Woodhaven Road. This water line extension will allow Spring Hollow water to be provided to many North County areas and some areas in northern Roanoke City. Because of present drought conditions, it has become necessary to construct this line now and thereby allow Roanoke County to provide an additional 2 million gallons per day of water to the North County and northern Roanoke City service areas. This will help the County assure our customers of an adequate supply of water during this drought and will allow the County to provide further assistance to Roanoke City. Construction of this line began June 15, 1999 and is expected to be completed by July 16, 1999. .. FISCAL IMPACT: ~- / This project was included in the Utility Capital Improvements Program, but was anticipated to occur in the fiscal year 2002-2003. The amount of $370,000 will need to be appropriated at this time from the Water Fund Unappropriated Balance. STAFF RECOMMENDATION: Staff recommends approval of funding in the amount of $370,000. ITEM NUMBER ~-~ AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: July 13, 1999 AGENDA ITEM: Authorization to Execute an Updated Contract with the Unified Human Services Transportation System, Inc. to provide the CORTRAN Services for Roanoke County COUNTY ADMINISTRATOR' S COMMENTS : ~~V,~,~,~.rw~,C ,~30, vow BACKGROUND: Unified Human Services Transportation System, Inc. (RADAR) provides the paratransit services of CORTRAN on behalf of Roanoke County. Riders must be 60 years of age or be physically or mentally challenged as per Americans with Disabilities Act (ADA) requirements. The County budgeted $105,200 for FY 1999-2000 to provide the County share of funding. The CORTRAN program provides service to qualified County residents for the hours of 7:00 a.m. to 5:00 p.m., Monday through Friday. Reservations are made on a first-come, first-served basis, utilizing any of the vehicles available through the RADAR system. We charge each passenger $2.50 per one-way trip. The contract with RADAR is based a $24 per hour rate, less fares received. The average one-way trip for County residents takes 45 minutes. The hourly rate for last fiscal year was $22.75 per hour. The increase by RADAR is necessary to cover the increased cost of labor, fuel, and insurance. The CORTRAN service provides portal-to-portal (door at home of the rider to the door of the destination) for qualified County residents to any point within the outside perimeter of Roanoke County (including points inside the Cities of Roanoke and Salem). Earlier this year, we reviewed the roster and found 750 County residents on the list of eligible clients of which 332 were ambulatory and 318 used wheelchair or assistive devices. The travel patterns were appropriate. Last fiscal year, our riders used nearly 6,400 hours of service (some of which was funded through roll-over monies within the account and some by Section 18 monies, neither of which is available for the new fiscal year). Based on the amount budgeted, we can fund approximately 27 one-way trips per day compared to the average usage last year of 34 trips per day. Based on current usage patterns, it would require an additional appropriation of $38,000 to meet the same usage as last fiscal year. Without the added funding, we should instruct RADAR to cap the use at 27 trips per day on a first-come, first-served basis. The Board may also recall that one of the recommendations of the Commission for the Senior and Disabled to the Board of Supervisors was to increase the publicity of the availability of CORTRAN. Obviously that suggestion would increase the impact to the budgetary constraints and, if additional funding were not provided, could frustrate many more with a service that they could not depend on. Staff suggests capping the number of trips per day that will be funded on a first-come, first-served basis. ALTERNATIVES: 1. Authorize the County Administrator to execute the contract for FY 1999-2000 capped at the budget of $105,200 and directing CORTRAN to cap the usage at 27 trips per day on a first-come, first-served reservation basis. 2. Increase the allocation to the budget to the CORTRAN account to allow greater participation by County residents. FISCAL IMPACT: None unless the Board desires to increase the budget to the CORTRAN account. RECOMMENDATIONS: Staff recommends alternative Number 1 unless the Board wishes to increase the funding to this program. The ridership does not appear to be abusing the system so a change in criteria is not suggested at this time. The Board should be advised, however, that this form of transportation may not now be dependable for persons needing on-going medical treatments or for qualified persons who may have depended on this service for work or education. ITEM NUMBER AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: July 13, 1999 AGENDA ITEM: Authorization to Execute an Updated Contract with the Roanoke Valley SPCA Increasing the Fees for the Impoundment of Animals COUNTY ADMINISTRATOR'S COMMENTS: q~ BACKGROUND: On January 12, 1999, the Board of Supervisors approved the current contract with the Roanoke Valley SPCA to provide impoundment facilities for animals brought in by the Police Department. This contract is for operations only and does not include any funding for their capital facilities. The rates approved at that time were $8.75 per day. The SPCA has advised that the current fees are insufficient to cover their operational costs and new rates have been negotiated for the 1999-2000 fiscal year. The new rate will be $8.75 per day for each animal taken to the shelter by the Police Department plus a new one-time fee of $4.00 per animal to cover the cost of the first day charge related to the administration and checking of the animals. All other fees and charges will remain the same. The SPCA has advised that it is conducting its own capital campaign at this time and hopes to be in their new facility in the late spring of 2000 and does not plan to provide impoundment facilities at the new location. Representatives from Roanoke City, Roanoke County, Vinton, Botetourt and Craig (current users of the SPCA for impoundment facilities) are meeting to secure other options for the impoundment of the animals. We have met with the City of Salem to discuss our future course of action and to consider the possibility of establishing a regional program, perhaps as an expansion of the City of Salem's facility. Salem advised on July 2 that their site would not support a regionally sized facility and that their plan was to expand their present facility to meet their needs. At this point, Salem does not appear interested in participating in a new regional facility. Staff will continue to work with the other localities towards a solution to the facility need and will bring a report back to the Board of Supervisors with alternatives for your consideration. ,~ ~.. A separate contract for operations will have to be negotiated for the next fiscal year (beginning July 1, 2000) which will be brought to the Board for inclusion in the upcoming budget process. At this time, the SPCA has not shown an interest in providing the impoundment services for the next fiscal year. ALTERNATIVES: At the present time, the Roanoke Valley SPCA facility is the only local facility with accommodations for the impoundment of the Valley's animals. Staff is working to find alternate solutions for the future efforts of the management of animals. FISCAL IMPACT: Based on historical placements at the shelter, the new contract provision is expected to cost an additional $3, 000 for the current fiscal year. Funds are included in the Police Department budget to cover this cost. RECOMMENDATIONS: Staff recommends authorizing the new contract with the Roanoke per day, retroactive to July 1, $4.00 per animal for the first approved by the County Attorney. On January 12, 1999, the Board of Supervisors adopted an ordinance establishing your rules of organization and procedure. These rules included a requirement that changes in the time and place of your meeting would be published in the newspaper 24 hours prior to the meeting. The 1999 session of the Virginia General Assembly substantially amended the FOIA. This amendment eliminated the requirement to publish notices of such changes in the newspaper, but required the posting of such notices in a "prominent public location at which notices are regularly posted" or "in the office of the clerk of the public body." This notice shall be posted at least three working days before the meeting. Finally for special or emergency meetings notice "shall be given contemporaneously with the notice provided members of the public body." This proposed ordinance amends Sections 2-102 and 2-103 to incorporate these recent changes. FISCAL IMPACTS: None. This contract provided for Roanoke County to provide surplus water to Botetourt County along the Route 604 corridor. The contract period was five (5) years in duration and expired in May 1995. The sale of surplus water has continued since that time under the previous contract conditions. Both parties have expressed a desire to renew the contract. Under the attached Ordinance the contract would be extended for an additional five (5) years. Botetourt County would be allowed to purchase a maximum of 250,000 gallons per day. The present usage is approximately 50,000 gallons per day. STAFF RECOMMENDATION: Staff recommends approval of the agreement following the second reading on July 27, 1999. NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the County Administrator is hereby authorized to execute an agreement with Botetourt County for the sale of surplus bulk water, upon the concurrence of the Utility Director, and upon form approved by the County Attorney. 2. That the rates or charges for said water shall be the "volume charge" per 1000 gallons in effect at the time of billing in accordance with Section 22-82 of the Roanoke County Code with a 25% surcharge. Botetourt County shall not be charged with the "base charge." 3. That the initial term of this agreement shall expire July 1, 2004. This agreement may be renewed for additional five (5) year terms as agreed by both parties by resolutions of the respective governing bodies. 4. WAT 1 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, JULY 13, 1999 ORDINANCE 071399-4 AUTHORIZING QUIT-CLAIM AND RELEASE OF A SANITARY SEWER EASEMENT WITHIN THE BOUNDARIES OF CORTLAND ROAD, RECORDED IN PLAT BOOK 18, PAGE 91, "THE ORCHARDS," SECTION NO. 5, "BOTETOURT SOUTH," SITUATED IN THE HOLLINS MAGISTERIAL DISTRICT WHEREAS, in order for Cortland Road to be accepted into the state secondary road system, the Virginia Department of Transportation (VDOT) requires that the right-of-way be free and clear of any third party rights or encumbrances; and, WHEREAS, VDOT has requested quit-claim and release of an existing 20' sanitary sewer easement within the boundaries of Cortland Road, extending 550.13 feet, more or less, from the intersection of Orchard Park Drive to the "New 20' Botetourt County Sanitary Sewer Easement" shown on Plat Book 21, page 192, to the Commonwealth of Virginia, subject to certain conditions; and, WHEREAS, it will serve the interests of the public to have Cortland Road accepted into the state secondary road system and the release, subject to the issuance of a permit and other conditions, will not interfere with other public services and is acceptable to the Roanoke County Utility Department. THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That pursuant to the provisions of Section 18.04 of the Roanoke County Charter, the acquisition and disposition of real estate can be authorized only by ordinance. A first reading of this ordinance was held on June 22, 1999; and a second reading and public hearing was held on July 13, 1999; and, 2. That pursuant to the provisions of Section 16.01 of the Charter of Roanoke County, the interests in real estate to be released are hereby made available for other public uses by conveyance to the Commonwealth of Virginia for acceptance of Cortland Road into the state secondary road system by the Virginia Department of Transportation (VDOT). 3. That quit-claim and release of the sanitary sewer easement within the boundaries of Cortland Road extending 550.13 feet, more or less, from the intersection of Orchard Park Drive to the "New 20' Botetourt County Sanitary Sewer Easement" shown on Plat Book 21, page 192, to the Commonwealth of Virginia, is hereby authorized subject to the following conditions: a. VDOT issuance of a permit for the sanitary sewer line or facilities. b. The facilities located within the 60-foot right-of-way, extending 550.13 feet, more or less, from the intersection of Orchard Park Drive under Cortland Road to the "New 20' Botetourt County Sanitary Sewer Easement" shown on Plat Book 21, page 192, may continue to occupy the street or highway in the existing condition and location. c. The release would be for so long as the subject section of Cortland Road is used as part of the public street or highway system. 4. That the subject easement is not vacated hereby and shall revert to the County in the event of abandonment of the street or highway. 5. That the County Administrator, or an Assistant County Administrator, is hereby authorized to execute such documents and take such further actions as may be necessary to accomplish this conveyance, all of which shall be on form approved by the County Attorney. 6. COUNTY ADMINISTRATOR'S COMMENTS: a~ `~ EXECUTIVE SUMMARY: This is the second reading of the proposed ordinance to authorize quitclaim and release of the sanitary sewer easement recorded in Plat Book 18, Page 91, within the boundaries of Cortland Road. BACKGROUND: The sanitary sewer easement was initiated to provide sanitary sewer service for the development "The Orchards," Section No. 5, "Botetourt South." Said easement being conveyed by Fralin and Waldron Community Development Corporation to Roanoke County is shown and designated as a new 20 ft. sanitary sewer easement upon subdivision plat "The Orchards," Section No. 5, "Botetourt South" recorded in the Clerk's Office of the Circuit Court of Roanoke County, Virginia, in Plat Book 18, Page 91. In March 1999, Fralin and Waldron Community Development Corporation subsequently extended Cortland Road as shown by plat "Cortland Road Extension," recorded in the aforesaid Clerk's Office, Plat book 21, Page 192, a copy of which is attached hereto as Exhibit A. The 20 ft. sanitary sewer easement described above lies within Cortland Road. 1 -1 In order for this portion of Cortland Road to be accepted into the State Secondary Road System, The Virginia Department of Transportation (VDOT) requires that the right-of-way be free and clear of any third party rights or encumbrances. The quitclaim and release of the subject portion of the sanitary sewer easement to the Commonwealth of Virginia would be subject to VDOT issuing a permit for such facility and the condition that the facilities located within the 60 ft. right-of-way of Cortland Road, may continue to occupy the street in the existing condition and location. The release would be for as long as the subject section of Cortland Road is used as part of the public street or highway system. However, said easement would not be vacated by the Board and would revert to the County in the event of abandonment of the street or highway. The Utility Department is in agreement with this request. 1. Adopt the proposed ordinance authorizing the County Administrator to execute the necessary documents for quitclaims and release of the sanitary sewer easement within the boundaries of Cortland Road. 2. Decline to adopt the proposed ordinance, which would result in Cortland Road remaining a private road. The Pledge of Allegiance was recited by all present. IN RE: NEW BUSINESS June 8, 1999 405 Vital Signs indicators at Hollins University this week. Mr. Manetta described the funding and organizations that were involved in the project. He also advised that the report will be on their web site on the Internet. He presented copies of the Vital Signs Indicators book and explained that there was a form included for feedback. IN RE: NEW BUSINESS 1. Approval of a resolution adopting a legislative program for the 2000 session of the Virginia General Assembly to be submitted to VACo. (Paul Mahoney, County Attorney R-060899-1 Mr. Mahoney reported that each year, VACo requests that its members provide issues or proposals with statewide implications for inclusion in its legislative program for the upcoming General Assembly session. He explained that he had included last year's resolution for Board review with several deletions which he explained. He also advised that he had received suggestions for additional requests from Supervisors Johnson and Harrison, and the Police Department. Supervisor Nickens suggested addressing the revenue shortfall from the reduction in the car tax, and that the state wants to reduce taxing at the local level but not the state level. In response to a question from Supervisor McNamara, Mr. Mahoney responded that item K in the resolution concerning a tire tax was unique to Roanoke County. Supervisor Nickens moved to adopt the 1998 resolution with changes June 8, '1999 40,, local solid waste management plan. This legislation should also require that private haulers diverting such wastes be held accountable and responsible to meeting the same recycling rates and requirements as the local governments. Section 10.1-1411 imposes a 25% recycling mandate on local governments. The General Assembly has severely limited the ability of local governments to regulate the flow of waste. This proposal would relieve local governments of the responsibility of meeting this recycling mandate on all wastes collected by private haulers. It would also require that private haulers be subject to the same recycling mandates as local governments: C. Roanoke County supports additional new construction and maintenance funding for the Virginia Department of Transportation for secondary and primary roads. Additional funding for new construction projects will address critical transportation needs of all local governments. Additional maintenance funding shall be used for an expanded program to mow grass and weeds, and inspect and clean drainage pipes and culverts. D. Roanoke County supports allowing the disposal of land clearing vegetative debris (including tree stumps) in less expensive facilities in a manner not detrimental to the environment. This would require groundwater and methane gas monitoring, financial assurances from the owner/operator, and local governing body certification of compliance with all local ordinances. E. Roanoke County supports legislation amending Section 14.1-46.01:1 to increase the salary supplement for the Chairman of the Board of Supervisors from $1,800 to $2,500 per year. F. Roanoke County supports continued and increased funding for the Comprehensive Services Act, the Virginia Community Juvenile Crime Control Act, the Family Preservation Act, local police departments (HB 599 funding), and the Regional Competitiveness Act. G. Roanoke County vigorously opposes any attempt to restrict or eliminate local sources of taxation, including personal property taxation and business and professional occupational licensing, unless local governments are guaranteed the opportunity to replace Lost sources of local revenue with comparable, equivalent, independent sources of revenue to allow localities to fulfill their public service obligations. H. Roanoke County supports authority to impose an additional one-half percent ('/2%) local option sales tax. I. Roanoke County supports expanding local authority to create transportation districts, to impose local option motor vehicle fuels taxes, and to expend these tax proceeds for local transportation improvements. J. Roanoke County supports legislation appropriating funds and directing the State Compensation Board to modify staffing standards for local jails and court services positions for Sheriffs offices. K. Roanoke County supports amending Chapter 6.1, "Virginia Tire Tax" of Title 58.1, "Taxation" (a) to increase the tire tax from $.50 to $1.25, and (b) to direct and authorize the Department of Waste Management to utilize the increased Waste Tire Trust Fund to remediate illegal or abandoned waste tire dumps. L. Amend Sec. 22.1-280.1 to allow the sharing of criminal incident June 8, 1999 409 Compensation Board, he would not proceed with the accreditation process. Following additional discussion and questions from the Board members, It was their consensus that they will forward their questions and concerns to Sheriff Holt and Mr. Hodge, and that this item will be brought back at the meeting on June 22, 1999. IN RE: SECOND READING OF ORDINANCES 1. Second reading of an ordinance to acquire the Read Mountain Water System. (Gary Robertson Utility Director 0-060899-2 Mr. Robertson reported that when the water system was owned by Fralin and Waldron, staff functions were contracted out at a cost of $71,327. The cost of adding two staff to the County will be $66,000 including amortization of the vehicles and equipment, and will reduce overtime in other areas of the department. He also advised that the Planning Commission reviewed the purchase on June 1, and indicated that it was in accordance with the Community Plan. Supervisor Johnson asked for an analysis of the $300,000 in overtime costs. Supervisor Johnson move to adopt the ordinance and add two positions and vehicles. The motion carried by the following recorded vote: AYES: Supervisors McNamara, Minnix, Harrison, Nickens, Johnson NAYS: None ORDINANCE 060899-2 AUTHORIZING ACQUISITION OF THE READ MOUNTAIN WATER COMPANY WHEREAS, the Utility Director has negotiated an agreement to acquire the June 8, 1999 411 community development and housing needs in relation to Community Development Block Grant (CDBG) funding for a proiect in Roanoke County. (Terry Harrington, County Planner) County Planner Terry Harrington reported that Roanoke County anticipates submitting a CDBG grant application to the Virginia Department of Housing and Community Development to be used for community development purposes. CDBG requires that localities must hold two public hearings. This public hearing is forthe purpose of soliciting general public input on the County's general community development and housing needs. The second public hearing is for the purpose of soliciting public input on the specific grant application and the proposed project. The following individuals spoke: (1) M. Bill Poe, 2031 Cantle Lane, Roanoke, a commercial real estate broker living in Roanoke County since 1956, spoke in support of using the grant funds to provide infrastructure for economic development. He pointed out that he was a member of the Society of Industrial Realtors which is the premier industrial group in the Country, and he receives brochures every day from all over the County with developed sites with infrastructure improvements such as streets, water and the light poles already available. These same improvements are needed in Roanoke County to market sites for development. Budget Manager) A-062299-2 Budget Analyst Steve Kleiber advised that during 1998-99, the inmate population at the Roanoke County Jail remained above capacity and that ayear-end deficit of $67,100 is projected forthe Sheriffs Office. Roanoke County is reimbursed by the state for salaries, mileage, office expenses, and for housing state prisoners, but many factors, such as the state prisoner populations, general assembly appropriations and political factors make it hard to determine revenue projections. Based on the conservative revenue estimates versus the projected revenues anticipated to be collected from the state for the Sheriffs Departmentfor FY98-99, revenues in excess of budgetforthese categories should total approximately $250,000. The Board has previously appropriated $78,000 of these additional funds for the elevator repairs within the jail facility. If the State ever releases that road from state maintenance, then the easement would once again be in effect. Ms. Carver displayed a map which designated all the exceptions to the current refuse collection policy. The Board discussed and was in general agreement that: (1) the policy should be fair and equitable; (2) there should be no trash pick up provided on private roads; and (3) there should be no commercial pickup unless there is a charge for the service. Mr. Hodge and Ms. Carver were directed to review and revise the policy with staff and bring back the Code changes to the Board. Mr. Hodge was also asked to work towards a similar policy such as that of Roanoke City and Town of Vinton. 3. Work Session to discuss private road issues as they relate to future development. (5:00 P.M_J The work session was held from 4:25 p.m. until 5:25 p.m and presented by Terry Harrington. Supervisor Minnix arrived at 4:25 p.rn. Also present were Janet Scheid, and members of the Roanoke County Planning Commission. It was the consensus of the Board for the staff and the Planning Commission to go forward with developing a policy for cluster homes development which would include limited provisions for private roads. Supervisor Nickens asked for a copy of the example used in the presentation of the Miller project as it was originally requested, and the Hunting Hills and Miller projects as they were finally approved. Supervisor Nickens suggested that standards could beset but each one should be brought to the Board for its approval for at least five years. Resolution establishing salaries for the County Administrator and the County Attorney R-062299-5 Supervisor Nickens moved to spread a resolution in the minutes to approve a salary increase for the County Administrator from $111,484.74 to $114,546.54 and County Attorney from $94,936.34 to $97,532.61, effective July 1, 1999. Public hearing and adoption of resolution regarding issuance of up to $5,725.000 in bonds to finance the County's portion of the Roanoke Regional Wastewater Treatment Facility. (Diane Hyatt, Finance Director) R-062299-6 Ms. Hyatt advised that this is public hearing on the issuance of revenue bonds and that the County wishes to borrow an additional $5,725,000 to finance the County's portion of the joint Regional WastewaterTreatmentflant. The County previously borrowed $13,100,000 to begin this project but the costs have expanded so that an additional amount needs to be borrowed. This loan will be at a 4% interest rate through the Virginia Wastewater Revolving Loan Fund. There will be some contingencies in it so that as the project is completed, which is scheduled for December, if there are additional amounts that come up between now and then, they will be included in this supplemental loan. It is structured such that if the entire amount of the loan is not needed, a lessor amount can be used and paid back. She advised that this loan will not affect sewer rates. There were no citizens to speak on this issue. Supervisor Nickens moved to adopt the resolution. The motion carried by the following recorded vote: AYES: Supervisors Minnix, Harrison, Nickens, Johnson NAYS: None ABSENT: Supervisor McNamara RESOLUTION 062299-6 OF THE BOARD OF SUPERVISORS OF THE COUNTY OF ROANOKE, VIRGINIA, AUTHORIZING AND APPROVING June 22, 1999 NOW, THEREFORE, be it resolved by the Board of Supervisors of the County of Roanoke, Virginia that: 1. Election to Proceed Under Public Finance Act of 1991. The Board hereby elects to issue the Bond under the provisions of the Public Finance Act of 1991, Chapter 26, Title 15.2 of the Virginia Code (the "Public Finance Act") without regard to the requirements, restrictions or other provisions contained in the Charter of the County. 2. Authorization of Bond and Use of Proceeds. The Board hereby finds and determines that it is advisable and in the best interest of the County to contract a debt and to issue the Bond in the maximum principal amount of $5,725,000, and to award and sell the Bond to the Fund, all pursuant to the Public Finance Act and the terms of this Resolution and the Financing Agreement. Such issuance, award and sale of the Bond are hereby authorized and approved. The Bond shall be known as the "County of Roanoke, Virginia, Sewer Revenue Bond, Series 1999." The proceeds from the issuance and sale of the Bond shall be used, together with other available funds, if any, to pay the costs of the Project. 3. Details of Bond. The Band shall be issued as a single bond in fully registered form and shall be dated the date of its issuance and delivery. The County Administrator is authorized and directed to determine and approve all of the other final details of the Bond, including without limitation, the maximum principal amount authorized to be advanced thereunder, the interest rate, the maturity or payment dates and amounts and the final maturity date; provided, however, that (I) the maximum principal amount authorized to be advanced under the Bond shall not exceed $5,725,000, (ii) the interest rate on the Bond shall not exceed four percent (4%) per annum, (iii) the Bond shall have a substantially level maturity or payment schedule from and after the date on which the first payment of principal is due thereunder, and (iv) the final maturity date of the Bond shall be no later than December 31, 2020. The County Administrator's approval of such details shall be evidenced conclusively by the due execution and delivery to the Fund of the Bond on the County's behalf. 4. Pledge of Revenues. The Bond shall be a limited obligation of the County and, except to the extent payable from the proceeds of the sale of the Bond or the income, if any, derived from the investment thereof, is payable exclusively from the Revenues of the System which the County hereby pledges to the payment of the principal of and interest on the Bond pursuant to the terms of the Financing Agreement. The Bond will be issued as a Parity Bond as defined in the 1996 Financing Agreement, and will be secured on parity with the 1996 Bond with respect to the pledge of Revenues. Neither the Commonwealth of Virginia nor any of its political subdivisions, including the County, shall be obligated to pay the principal of or interest on the Bond or other costs incident to it except from the revenues and any other money or property pledged for such purpose, and neither the faith and credit nor the taxing power of the Commonwealth of Virginia or any of its political subdivisions, including the County, is pledged to the payment of the principal of or interest June 22, 1999 4~7 A new Bond delivered upon any transfer or exchange shall be a valid limited obligation of the County, evidencing the same debt as the Bond surrendered and shall be entitled to all of the security and benefits of this Resolution to the same extent as the Bond surrendered. 10. Charges for Exchange or Transfer. No charge shall be made for any exchange or transfer of the Bond, but the Director of Finance may require payment by the holder of the Bond of a sum sufficient to cover any tax or any other governmental charge that may be imposed in relation thereto. 11. Mutilated, Lost, Stolen or Destroyed Bond. If the Bond has been mutilated, lost, stolen or destroyed, the County shall execute and deliver a new Bond of like date and tenor in exchange and substitution for, and upon delivery to the Director of Finance and cancellation of, such mutilated Bond, or in lieu of and in substitution for such lost, stolen or destroyed Bond; provided, however, that the County shall execute, authenticate and deliver a new Bond only if its registered owner has paid the reasonable expenses and charges of the County in connection therewith and, in the case of a lost, stolen or destroyed Bond (I) has filed with the Director of Finance evidence satisfactory to him or her that such Bond was lost, stolen or destroyed and that the holder of the Bond was its registered owner and (ii) has furnisf~ed to the County indemnity satisfactory to the Director of Finance. If the Bond has matured, instead of issuing a new Bond, the County may pay the Bond without surrender upon receipt of the aforesaid evidence and indemnity. 12.Approval of Financing Agreement. The Financing Agreement is approved in substantially the form presented to this meeting, with such changes, insertions or omissions as may be approved by the Chairman or Vice Chairman, whose approval shall be evidenced conclusively by the execution and delivery of the Financing Agreement on the County's behalf, and the Chairman or Vice Chairman is authorized to complete the Financing Agreement with the final terms and details of the Bond as determined pursuant to paragraph 3. The Chairman or Vice Chairman is authorized to execute and deliver the Financing Agreement and such other documents and certificates as such officer may consider necessary in connection therewith. 13. Further Actions; Authorized Representative. The Chairman, the County Administrator and the Director of Finance and such officers and agents of the County as may be designated by any of them are authorized and directed to take such further actions as they deem necessary regarding the issuance and sale of the Bond and the execution, delivery and performance of the Financing Agreement, including, without limitation, the execution and delivery of closing documents and certificates. All such actions previously taken by such officers and agents are ratified and confirmed. The Chairman, County Administrator and the Director of Finance are designated the County's Authorized Representatives for purposes of the Financing Agreement. 14. Filing of Resolution. The County Attorney is authorized and directed to file a June 22, 1999 439 the end of June for $700,000 in funds to design and construct drainage improvements to the Boxley Hills neighborhood. This grant will provide the funds for the County to correct a long standing stormwater drainage issue in this North County neighborhood. The CDBG program requires that a minimum of 10% of the total project costs be derived from local sources, either in-kind services or cash contribution. The County's share will consist of up to $70,000 and of this amount, a maximum of $39,000 will be a cash contribution. It is anticipated that public/private partnership funds will be used for this local cash match. CDBG requirements specify that any localities considering a grant application must hold two public hearings. The first hearing, which was held on June 8, 1999, was for the purpose of soliciting general .public input on Roanoke County's general community development and housing needs. Three people provided comments at this hearing. The second hearing today is for the purpose of soliciting public input on the specific grant application and project proposed. He asked that the Board hold a public hearing and approve the resolution authorizing the County Administrator to sign and submit the application for this grant. The Planning Commission recommended approval with three conditions: (1) The entire 4.50 +- acre site, including architectural materials, landscaping, exterior lighting and signage, shall be developed in general conformance with the Williamson Road Design Guidelines. (2) The site, including the realignment of Marson Road, shall be developed in substantial conformity with the concept plan dated May 18, 1999, prepared by Balzer and Associates, Inc. (3) Should the state issued Certificate of Need be denied for this facility, the Special Use Permit will be null and void. Craig Balzer, architect with Balzer & Associates, representing the petitioner, described and presented the architectural rendering of the project which was dated March 22, 1999, and requested by the Planning Commission. This appropriation was approved by the County Board of Supervisors on May 27, 1999. The FDECT has now agreed to fund the project for six weeks and therefore the amount of the grant has been increased by $7,646.75. FISCAL IMPACT: The Summer Youth Grant was originally approved on May 27, 1999 for $85,000. This grant has now increased to $92,646.75 therefore, we need to appropriate an additional $7,646.75. COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: Vaughn, Inc., the developers of "Autumn Park Subdivision" requests that the Board of Supervisors approve a resolution to the Virginia Department of Transportation requesting that they accept Autumn Park Road (0.42 mi.), Amber Court (0.05 mi.), and Ann Lane (0.06 mi.) into the State's Secondary System. Staff has inspected these roads, with representatives of the Virginia Department of Transportation, and found these roads to be acceptable. FISCAL IMPACTS: No County funding is required. The Authority has prepared engineering studies and analyses of the costs of developing Phase I of the Park and has applied for various State and Federal grants to assist in site development and infrastructure. A Local Participation Agreement has been drafted that sets forth criteria for investment and management of those local governments that choose to participate in the New River Valley Commerce Park project. Roanoke County has been asked to formally vote on the form of the Local Participation Agreement and to indicate its willingness to financially invest in the project over the next 10 years. The Director of Economic Development and Senior County Attorney wish to present a Power Point presentation on the New River Valley Commerce Park project and to address questions and concerns of the Board of Supervisors. No action is asked of the Board at this time. The Local Participation Agreement and a report and recommendation for an appropriation for financial participation will be presented at the July 27, 1999 Board of Supervisors meeting to meet the Authority's target of August 17, 1999. Representatives fi-om School Administration and the School Board will be present to review the status of each of the projects. In addition an update will be given on an availability of funds that have been set aside in the future School Capital Fund. Several questions have been raised by the Board of Supervisors. These questions can be directed to the School staff and the School Board at this worksession. What is the status of the Glenvar Middle School? When will it be ready for construction bids? 2. What is the status of the South County High School? When will the construction bids be ready to issue? 3. What is the anticipated cost on the construction of Glenvar Middle School? 4. What is the anticipated cost on the construction of the South County High School? In Phase II the projected cost of Cave Spring Middle School is approximately $12,000,000. There have been indications that this project may be downsized to a smaller project. Is this true? The attached worksheets will be discussed in detail with the Board at this worksession. Gubala, Director of Economic Development I ~ M Subject: Virginia's First Regional Industrial Facility Authority Date: June 18, 1999 I have been attending meetings of the Authority since August 1998. The Authority has developed a plan for the Phase I development of the New River Valley Commerce Park near the New River Valley Airport in Dublin, Virginia. This includes: 1. Acquisition of 326 acres of land 2. Extended options on 739 additional acres 3. Site grading of 40 acres to demonstrate construction of a 150 acre and 200 acre building pads 4. Construction of a one mile, four lane divided access road 5. Preliminary engineering for land requirements, utility easements and planning to extend sewer and improve water capacity for 6 million gallons to serve the Park A Local Participation Agreement has been prepared that would allow member local governments to invest in the development of the Park. At the Authority meeting on June 16, 1999; seven of the 15 member jurisdictions voted to endorse the participation agreement and participate in the development of the Phase I project. Two jurisdictions voted not to participate in this project. None of the Roanoke Valley governments voted; as the attorneys from the County and Cities of Roanoke and Salem have written a letter to the Authority with concerns and questions about the language and form of the Local Participation Agreement. The Authority's counsel will travel to Roanoke and meet with our attorneys and local Authority representatives to resolve the issues on the agreement. The Authority is offering each local participating jurisdiction a share of the annual debt service on two Rural Development Loans totaling $4,083,500 over 10 years. The Board of Supervisors will be asked to vote on the form of the Local Participation Agreement and to adopt a resolution that would commit the County to purchase up to 10,000 shares (@$2.75 a share - $27,500 a year) for ten years ($275,000 total) I recommend that the Board of Supervisors schedule a work session on the New River Valley Commerce Park project for the July 13, 1999 meeting. This would allow the attorneys time to meet and resolve concerns prior to the Board meeting. We can schedule a formal vote on the project for July 27, 1999 which meets the Authority's August 10, 1999 deadline for notification of Roanoke County's participation. THE COMMUNITY RATING SYSTEM (CRS) IS A PROGRAM TO ENCOURAGE COMMUNITIES TO ENACT AND ENFORCE FLOOD PLAIN REGULATIONS. THE NATIONAL FLOOD INSURANCE PROGRAM (NFIP) PROVIDES FEDERALLY BACKED FLOOD INSURANCE FOR HOMEOWNERS AND BUSINESSES LOCATED IN THE 100 YEAR FLOOD PLAIN. ROANOKE COUNTY WAS THE FIRST COUNTY IN VIRGINIA TO OBTAIN A CLASS 9 RATING. TO QUALIFY FOR THE CRS PROGRAM, A COMMUNITY MUST BE IN GOOD STANDING AND ENFORCE FLOOD PLAIN MANAGEMENT ORDINANCES IN FLOOD HAZARD AREAS. UNDER THE CRS, THERE IS AN INCENTIVE FOR COMMUNITIES TO DO MORE THAN JUST REGULATE TO MINIMUM NATIONAL STANDARDS.
