ALTIZER FOR HIS SERVICE AS CHAIRMAN OF THE BOARD OF SUPERVISORS IN 2009 WHEREAS, Michael W. Altizerserved as Chairman of the Roanoke County Board of Supervisors during 2009; and WHEREAS, during Mr. Altizer's term as Chairman, many noteworthy achievements took place, including the dedication and opening of the following facilities: > Western Virginia Regional Jail > North County Fire and Rescue Station > Fleet Service Center > Green Ridge Recreation Center > Roanoke Valley Regional Fire Training Tower; and WHEREAS, the following other accomplishments also occurred during Mr. Altizer's term as Chairman: > Groundbreaking for the South County Library > Completion of the $9 million upgrade of the emergency radio system > Welcoming of Franklin County as a memberof the Western Virginia WaterAuthority > Completion of the Route 220 water line project in Roanoke County > Inauguration of a Roanoke County e-newsletter for citizens > Ribbon cutting and dedication celebrating completion of work to restore Mudlick Creek at Garst Mill Park; and WHEREAS, Chairman Altizer consistently supported the improvement of schools by approving major construction and renovation projects; and WHEREAS, Chairman Altizer was a steadfast supporter of economic development and participated in the Coca-Cola expansion to the Valley Gateway shell building; and WHEREAS, Chairman Altizer was instrumental in supporting and celebrating Kroger's continued investment in the County, which included more than 80,000 square feet of newly renovated and expanded store space at locations in Vinton, Hollins, and Page 1 of 2 Tanglewood and over $28 n~iillion in new investment, most notably Kroger's newest and largest retail facility in the region - an 84,000-square-foot store and mixed-use retail development on Route 460 at Valley Gateway; and WHEREAS, Chairman Altizer assisted with the opening of the 15,000-square-foot Division of Motor Vehicles Customer Service Center on Peters Creek Road; and WHEREAS, Chairman Altizer chose a positive approach to governing by encouraging open communication and prompt responses to citizens; and WHEREAS, Chairman Altizer worked diligently throughout the year to represent the citizens of Roanoke County by emphasizing sound financial strategies and practices to benefit all of the residents of the Roanoke Valley. G-1 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: January 12, 2010 AGENDA ITEM: Request to approvethe SecondAmendmenttothe NewRiver Valley Commerce Park Project Participation Agreement (Attachment A} Request to support an amendment to Section 15.2-6415 of the Code of Virginia related to the Virginia Regional Facilities Act, specifically the withdrawal of a locality from the Authority (Attachment B) SUBMITTED BY: Doug Chittum Director of Economic Development Director APPROVED BY: B. Clayton Goodman III County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: Roanoke County entered into the New River Valley Commerce Park Agreement on October 14, 1999. On August 8, 2001, the Agreement was amended allowing Wythe County to sell its shares to the remaining participants and withdraw from the Agreement. It is now necessary to amend the Agreement a second time to allow for the following four changes: 1. Expand the scope of the Project Description to include all actions taken place to date and to acknowledge the Commerce Plan adopted Program of Work 2. Amend the required voting approval before the Participation Committee can take certain actions 3. Amend the Finance Plan for the project by including the use of money from surplus property sales and surplus dues upon unanimous consent of all member jurisdictions Page 1 of 3 4. Amend the Revenue Sharing provision to includethesharing ofBusiness Personal Property and Real Estate Taxes between the host community Pulaski County and the Participants, with a portion of this additional revenue to be eligible to be offered as incentive to attract businesses to the Commerce Park Also, non-participating members of this Authority have requested an amendment to the Code of Virginia, Section15.2-6415, to allowforwithdrawalfrom theAuthority if theirlegal obligations are satisfied and upon certain other conditions. Their potential exit from this Authority would have no effect on Roanoke County's standing, nor would it have any effect on Roanoke County's financial position or responsibility to the Authority. Several New River Valley legislators have agreed to sponsor this legislation, if it is the desire of the Authority and their member localities to seek such change. In summary, both theAmendmentto the Participation Agreementand the proposed Code amendment have been reviewed by the Roanoke County Attorney, the Attorney for the Authority and the various County and City Attorneys, Administrators and Managers who represent the membership of Virginia's First Regional Industrial Development Authority. These proposed actions have the support of the member localities, and are deemed necessary for the orderly development of the Commerce Park. FISCAL IMPACT: No additional funding will be needed as a result of these actions. ALTERNATIVES: Alternative one: Board of Supervisors approves the Second Amendmenttothe New River Valley Commerce Park Project Participation Agreement, and authorizes the Chairman to execute the Amendment on behalf of Roanoke County. The Board of Supervisors support the proposed Amendment to Section 15.2-6415 of the Code of Virginia related to the Virginia Regional Facilities Act. Alternative two: Do not approve the Second Amendmenttothe Agreement or support the Code Amendment. STAFF RECOMMENDATION: Staff recommends alternative one. THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That pursuant to the provisions of Section 18.04 of the Roanoke County Charter, the acquisition and disposition of real estate can be authorized only by ordinance. A first reading of this ordinance was held on December 15, 2009, and a second reading and public hearing was held on January 12, 2010. 2. That pursuant to the provisions of Section 16.01 of the Roanoke County Charter, the interest in real estate to be conveyed is hereby declared to be surplus, and is hereby made available forother public uses by conveyance to WVWAforthe provision of sanitary sewer service. 3. That donation to WVWA of an 20' and variable width easement and a 10' temporary construction easement for an underground sanitary sewer and related improvements, within the easement area designated on the attached Exhibits "A"and "B", which are incorporated herein by reference, on the County's property known as Hanging Rock Battlefield Trail, to provide sanitary sewer service to the Hanging Rock area of Roanoke County is hereby authorized and approved. 4. That the County Administrator, or any Assistant County Administrator, is hereby authorized to execute such documents and take such further actions as may be necessary to accomplish this conveyance, all of which shall be on form approved by the County Attorney. 5. That this ordinance shall be effective on and from the date of its adoption. COOPER, JR., LIBRARY ASSISTANT, UPON HIS RETIREMENT AFTER MORE THAN THIRTY-THREE YEARS OF SERVICE WHEREAS, Freddie L. Cooper, Jr. was hired on July 21,1976, as a Library Page and was promoted to Library Assistant on January 1, 1980; and WHEREAS, Mr. Cooper retired as Library Assistant on January 1, 2010, after a total of thirty three years and five months of devoted and accomplished service to Roanoke County; and WHEREAS, during his time as Library Assistant, Mr. Cooper assumed numerous important responsibilities for the Library, including creating and managing an efficient patron record and request system; regularly submittingsccurate branch financial reports; and expanding a vertical file that contained unique and valuable information, which benefited many patrons, especially students; and WHEREAS, fir. Cooper also provided in-depth research assistance, answered diverse reference questions, resolved computer and Internet issues for patrons and managed interlibrary loans for the Vinton Branch Library; and WHEREAS, he was consistently patient, with a friendly smile for all visitors, and provided such excellent customer service to the patrons of the Vinton Branch and Headquarters libraries that people regularly sought him out when visiting the library and repeatedly commended him to his supervisors; and WHEREAS, fir. Cooper has been a valued and respected colleague and friend to everyone in the Library system. Clayton Goodman III County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: The indoorportions of the Green Ridge Recreation Centerare operational with onlypunch list items and minor changes left to complete. The grand opening was successfully held on January 1, 2010, as scheduled. However, due to an excessively wet November, an unforeseen snowstorm in December and unusually lowtemperatures in January, work is not yet complete on the outdoor pool and concessions building. In order to ensure the remaining work is performed in accordance with the comprehensive agreement with FirstChoice Public Private Partners, it is necessary to extend the project management contract with Arcadis on an hourly/as needed basis. Therefore, staff requests that a Change Order for the Arcadis contract be approved for up to $22,000 in order to ensure successful completion of the project. The funds for this change are available in the project's contingency account. With the exception of the final landscaping that cannot be completed until spring, the remaining construction workshould be completed in February, depending on the weather. Normally this type of Change Order could be approved administratively as all project funds have been previously appropriated; however, as the contract with Arcadis has been increased by more than 25% of the original amount by a previous vote of the Board of Supervisors on November 17, 2009, this change must also have Board of Supervisors' approval understate procurement regulations. A summary of the changes made to the Arcadis contract to date is as follows: Page 1 of 2 Original Arcadis contract amount Previously approved changes: Special Inspections required by code Design reviews /coordination beyond scope through November Request for additional hours for outdoor pool and concessions Total Arcadis contract after changes Fiscal Impact $1,125, 846 The overall project is well within the original budget. After this Change Order is executed, there will be $224,116.42 remaining in the project contingency, which should be more than sufficient to deal with any issues that may come up with the completion of the outdoor pool and concession building. Staff will only utilize the additional hourlyservices as necessary; therefore, it may not be necessary to actually spend all of the additional $22,000. Staff Recommendation Staff recommends the approval of a Change Order in an amount of up to $22,000 with Arcadis, Inc. to be paid from the project contingency. Clayton Goodman III County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: Fire and Rescue's Length of Service Awards ProgramlVolunteer Incentive Program (LOSAP/VIP} Board of Trustees is requesting that the Board approve volunteers Jeff Edwards and Wayne Guffey to serve on the LOSAP/VIP Board for a standard four-year term from January 1, 2010 to December 31, 2013. Jeff Edwards is being recommended to serve as the LOSAP/VIP Fire Volunteer representative. Jeff is a citizen of Roanoke County and has volunteered with the Hollins Volunteer Fire and Rescue Company since 2006. He is EMT/Basic and Firefighter certified. Wayne Guffey is being recommended to serve as the LOSAP/VIP Volunteer At-Large representative. Wayne has been a volunteer with the Vinton Volunteer First Aid Crew since 1985. For the past 12 years he has served as an officer with the crew. Wayne is currently the Assistant Chief at the station and with that role he is tasked with the responsibility of assisting volunteer members with completing theirVlP point records appropriatelyand on time. Wayne is certified at the EST/Intermediate level. The LOSAP/VIP Board manages the previous LOSAP retirement program which was frozen December 2005, butstillhas several hundred volunteerswho are eitherreceiving a benefit or are due to receive a benefit upon turning 55 years of age. Additionally, the board manages the current VIP program, which offers an annual maximum benefit of $500 to those volunteers who have met minimum criteria standards and are currently serving as an active volunteer as of the last day of the calendar year. Clayton Goodman III County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: Roanoke County Schools requests that the Board accept and appropriate the following: 1. Roanoke County Schools received the Jobs for Virginia Graduates (JVG} grant in the amount of $21,000. The grant mission is to assist youth who are disadvantaged and not achieving in school to complete high school as well as secure and retain quality jobs. With these funds, a school division must employ a job specialistwho will assist students in completing high school, gain employability skills and secure employment. Our most recentdata suggests that 35 students (18 of them seniors} were serviced with the JVG grant. Staff recommends an appropriation in the full amount of the grant award of $21,000. 2. Roanoke County Schools and Virginia Western Community College (VWCC} have an agreement whereby the college provides college level courses in English, US History, AP Calculus and certain technical and sciencesubjects. These courses are taught by Roanoke County teachers who meet the college's criteria for adjunct professors. Monies that have been collected exceed the expenses; therefore, there is a request for these additional funds to be appropriated. Roanoke County Schools collected $178,275 tuition from 1,249 students. VWCC will reimburse $286,004.99 for services rendered (teachers, administrating expenses, rooms, utilities, and maintenance}. Roanoke County Schools owes VWCC $381,339.99 for tuition and technology fees and college service fees. The difference between what was collected and what was spent is $82,940. Page 1 of 2 Roanoke County Schools requests that $82,940 be appropriated to the instructional program. 3. The Roanoke County School Board recently sold the Southview School located at 3568 Peters Creek Road, Tax Map Number 37.1-1-21.2 to the Commonwealth of Virginia for the amount of $2,000,000. The school board is requesting that the funds be appropriated to the Major Capital Improvement Plan Fund. FISCAL IMPACT: 1. The Jobs for Virginia Graduates grant will be increased by $21,000. 2. The Secondary Instruction Budget will be increased by $82,940. 3. The Major Capital Improvement Plan Fund would be increased by $2,000,000. ALTERNATIVES: None STAFF RECOMMENDATION: Staff recommends the appropriation in the amount of $2,103,940 to the Roanoke County Public Schools.
