Ho/~gee~,%~unty Administrator CC: Chief Richard Burch, Chief Jim Grigsby and Clearbrook Volunteers Date: August 7, 2001 Re: Regional Cooperation Effort at Clearbrook The purpose of this memorandum is to provide City Council and Board of Supervisors members with an update on discussions related to the cooperative agreement between Roanoke City and Roanoke County for joint Fire and Rescue operations at the Clearbrook Fire Station. At a meeting held last Friday, August 3, City and County staff discussed plans for the sharing of staff and facilities at Clearbrook Fire Station. Since that meeting there has been excellent progress made toward the fulfillment of the cooperative agreement. The schedule for training and deployment of personnel to the Clearbrook station has been finalized, and the two Fire and Rescue Chiefs have created a transition team. The transition team includes County volunteers and career staff from both localities. This team will provide input on contract development, in addition to working through operational procedures and other issues related to the joint venture. Attorneys from both localities are currently in the process of drafting a contract, which will address operational and liability concerns for each partner government. Upon completion of the contract, a joint meeting will be planned for adoption and signing of the final agreement. On September 4, recruits from Roanoke City, Roanoke County, Salem and Vinton, will begin classes at the Regional Fire Training Center. This marks the first time that all four partners in the training center effort have had recruits in a joint class. We ask that you mark this date on your calendars for a joint meeting at the training center. The event spotlights the cooperative efforts of the center's partnering localities, and offers the opportunity to welcome these new recruits. W. -Room 431 Roanoke, VA 24018-0798 Phone 772-2007 -FAX 772-2089 MEMORANDUM To: Board of Supervisors From: Paul Mahoney Date: 30 August 2001 Subject: Clearbrook Joint Staffing Agreement Enclosed you will find a draft copy of the Fire and Emergency Medical Agreement to staff Roanoke County Clearbrook Station between the City of Roanoke and the County of Roanoke. This draft agreement provides that the City and the County will cooperatively and jointly assign full time career staff positions to the Clearbrook Station to provide fire and emergency medical response and related rescue services. City and County staff have negotiated this agreement over the past month, and are prepared to submit it to their respective governing bodies for your review and approval. City and County staff will brief City Council and the Board of Supervisors on this joint staffing agreement at our meeting scheduled for Tuesday, September 4, 2001, at 10:30 a.m. at the Regional Fire Training Center. Both staffs are pleased to submit this agreement to City Council and the Board of Supervisors since it signifies a historic milestone in regional cooperation in the Roanoke Valley. Hodge Chief Rick Burch FIRE AND EMERGENCY MEDICAL AGREEMENT TO STAFF ROANOKE COUNTY CLEARBROOK STATION THIS AGREEMENT made this day of , 2001, by and between the CITY OF ROANOKE, a municipal corporation of the Commonwealth of Virginia (the "City"), and the COUNTY OF ROANOKE, a chartered county of the Commonwealth of Virginia (the "County"). WITNESSETH: WHEREAS, § §27-2 and 27-23.9, Code of Virginia (1950), as amended, authorizes local governments to cooperate in the furnishing of fire and emergency medical response and related rescue issues, and § 15.2-1300, Code of Virginia authorizes agreements for the joint exercise of powers by political subdivisions of the Commonwealth. WHEREAS, the City and the County have determined that cooperatively and jointly staffing the station located at Clearbrook in Roanoke County to provide fire and emergency medical response and related rescue services and providing across city and county jurisdictional lines will improve such service in the areas that can be served by such station. WHEREAS, it is deemed to be mutually beneficial to the parties hereto to enter into an Agreement concerning the joint staffing of the Clearbrook Station with regards to fire and rr,EC~-ral emergency m~e,ei~f response and related rescue services. NOW, THEREFORE, in consideration of the mutual benefits to be derived from this Agreement, the parties hereto covenant and agree as follows: 1. The County will operate, maintain and control the Clearbrook Fire Station. 2. The County will provide and maintain at least one fire engine and one ambulance at the Clearbrook Station. 3. The County will assign a staff of twelve (12) full-time career positions to staff the equipment described in Paragraph 2. The City will assign six (6) full-time career positions to Clearbrook Station to staff the equipment described in Paragraph 2. The rank and skill levels of those assigned shall be agreed upon by the Fire Chiefs of the City and the County. The primary response for emergency incidents in the City will be by career personnel. 4. The County shall have jurisdiction over emergency calls within the County. The City shall have jurisdiction over such calls within the City. 5. The County will routinely respond with fire and emergency medical equipment and personnel for the City from the Clearbrook Station into the 220 South/Southern Hills area. Specific boundaries are to be determined and mutually agreed upon by the respective Fire Chiefs. 6. The County will provide working and living space at the station for City personnel assigned to Clearbrook Station. 7. City residents shall pay to the City the ambulance fee imposed by the City; for calls originating in the City; County residents shall pay to the County the ambulance fee imposed by the County for calls originating in the County. 8. The parties agree to develop and adopt operational, communication, dispatch, safety and medical protocols that meet professional standards. All operational protocols are to be mutually agreed upon in writing by the Fire Chiefs of the City and the County. 9. All fire and emergency medical services and resource personnel, agents and other employees of the parties to this Agreement who are acting pursuant to this Agreement shall have the same powers, rights, privileges and immunities C:\WINDOWS\TEMPW-CITYCI.1 2 as provided by law in each jurisdiction while providing fire and emergency services. 10. The services performed and expenditures made under this Agreement shall be deemed to be for public and governmental purposes and all immunities from liability enjoyed by the County and the City and their fire/emergency medical services and resource personnel within its boundaries shall extend to its participation in this Agreement. 11. All pension, disability, workers' compensation, life and health insurance and other benefits to which fire/emergency medical services and rescue personnel are entitled shall be extended to the services performed by such personnel under this Agreement. Each party agrees that provisions of these benefits shall remain the responsibility of the respective employer of the individuals assigned to staff the Clearbrook Station. 12. Each party agrees that, in all activities undertaken pursuant to this Agreement, each party hereby waives any and all claims against the other party. The parties shall not be liable to each other for reimbursement for injuries to or death of personnel or damage to equipment incurred when providing services pursuant to this Agreement, including when going to or returning from another jurisdiction. Neither party shall be liable to the other for any other costs associated with or arising from the provision of services or the rendering of assistance under this Agreement, except as specifically provided under this Agreement. Each party shall indemnify and save harmless the other party from all claims by third parties for personal injury and death or property damage which may arise from activities under this Agreement, to the extent permitted by law. 14. Administrative details and future unforseen issues that may arise from activities associated with this Agreement shall be resolved by a mutually agreed upon solution of the respective Fire Chiefs. Any disagreement between the Fire Chiefs shall be resolved by the City Manager and County Administrator. 15. This Agreement shall be effective from January 1, 2002, until December 31, 2002. Thereafter, it shall automatically renew for additional terms of one (1) year, unless either party gives at least ninety (90) days prior written notice of termination to the other party.
