Regular meetings are held on the second Tuesday and the fourth Tuesday at 3:00 p.m. Public hearings are held at 7:00 p.m. on the fourth Tuesday of each month. Pleasant Civic League, spoke and requested that the Board adopt a resolution opposing all the proposed routes for I-73. M. REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Nickens: suggested to ECH that the BOS and citizens would benefit from a briefing from Billy Driver on how real estate assessments are handled. ECH responded he would schedule a briefing for 1 /22102. Supervisor Flora: Announced that he and ECH would be meeting with the residents in Bonsack concerning the new Walmart. Supervisor McNamara: (1) Wished everyone a Happy 2002. Announced that the Board met with the area legislators on Jan. 2 and thanked them for attending the meeting. He advised that the County will have some fiscal stress in the upcoming year and will be impacted by the state budget but the County is fairly stable but will have to make up some of the shortfalls. He felt that the School Board and Board will work very hard on behalf of the citizens. Supervisor Church: Also thanked the legislators for attending their meeting He felt that this~ear will test the resolve of the Board but believes they will meet the challenge. O. WORK SESSIONS (4t" Floor Conference Room) Work Session to discuss proposed revisions to the Subdivision Ordinance. (John Murphy, Assistant Planner) HELD FROM 4:00 P.M. TO 4:30 P.M. ODELL "FUZZY MINNIX FOR HIS SERVICE AS CHAIRMAN OF THE BOARD OF SUPERVISORS IN 2001 WHEREAS, H. Odell "Fuzzy" Minnix served as Chairman of the Roanoke County Board of Supervisors during 2001; and WHEREAS, during Mr. Minnix' term as Chairman, the County achieved a variety of accomplishments, including: ^ Ongoing Construction of the new Hidden Valley High School and renovations to Glenvar Middle School. ^ Continued regional cooperation efforts through participation in the Regional Summit meetings of the local governments in Southwest Virginia. ^ Dedication and Grand Opening of the Blue Ridge Parkway Visitors Center, a unique partnership that included the National Park Service, the County of Roanoke and Explore Park. ^ The first graduation class at the Roanoke Valley Regional Fire/EMS Training Center. ^ The dedication of Camp Roanoke, another successful public-private partnership venture. ^ The installation of the first Automated External Defibrillators in County buildings. ^ The hiring of 35 additional firefighters to increase response time in the County of Roanoke, and the signing of the cooperative agreement with the City of Roanoke to jointly staff the Clearbrook Fire Station. ^ The first State of the County Address given by a Roanoke County Board Chairman; and WHEREAS, Mr. Minnix worked diligently during his term to represent all the citizens 1 of Roanoke County and to promote regional projects which would benefit all the residents of the Roanoke Valley; and WHEREAS, while Chairman Minnix encouraged and supported economic development and growth, he always emphasized that the needs of the residents and their communities must also be considered when making these decisions, and he served as a role model following the tragic terrorist events of September 11, when he decided to move forward with a scheduled Board meeting for that day, because he felt that the terrorists could not break our democratic spirit. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia, does hereby extend its deepest appreciation to H. Odell "Fuzzy" Minnix for his service as Chairman during 2001 and for his belief in democracy and participation by citizens in local government. FOR BEING NAMED ONE OF THE RETAIL ONE HUNDRED IN THE UNITED STATES AND FOR CELEBRATING THEIR 91sT ANNIVERSARY DURING 2001 WHEREAS, Davidsons Inc. was founded by Joseph Davidson, who immigrated from Lithuania to Germany to Rhode Island to Roanoke; and WHEREAS, Joseph Davidson married the daughter of a mercantile owner and founded Davidsons in 1910, expanding its retail business into Roanoke County in 1973; and WHEREAS, Davidsons Inc. is one of the oldest retail family-owned businesses in the Roanoke Valley, and is still managed by the Davidson family; and WHEREAS, Davidsons has a history of community service leadership with involvement in organizations such as Big Brothers/Big Sisters, Literacy Volunteers of America of the Roanoke Valley, Affair in the Square, To the Rescue Museum, Consumer Credit Counseling Services, TRUST, and the United Way; and WHEREAS, in 2001, Davidsons received national recognition from Esquire Magazine, being named One of the Retail One Hundred in the United States - one of only two mens' fine clothiers chosen from the Commonwealth of Virginia; and WHEREAS, in 2001, Davidsons also celebrated their 91S` anniversary in the Roanoke Valley. ITEM NUMBER ~" AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: January 08, 2002 AGENDA ITEM: Appointments of Board Members to Committees, Commissions and Boards for 2002 COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: Attached is a list of the 2001 Committee Assignments with the following exceptions: The appointments specific to the chairman and vice chairman are now listed under Chairman Church's and Vice Chairman McNamara's name. At this time, the Board of Supervisors may make any modifications they wish. Many of the appointments are for specific terms and those appointments should be made at the expiration of the terms, although the Board may also make changes to these appointments if they desire. Listed below is information about several of the Committees: Liaisons to the Virginia Association of Counties In 1994, VACo requested that a member of the governing body be appointed to interact directly with VACo regarding legislative matters. At a 1994 meeting, The Board recommended that the Vice Chairman of the Board of Supervisors serve in this capacity. However, any Board member may be appointed. In 1992, VACo requested that a member of the governing body be appointed to work directly with the regional representative on the VACo Board of Directors. The Chairman has served in this capacity for several years, but any Board member may be appointed. Roanoke Valley Economic Development Partnership The Chairman of the Board of Supervisors serves on this organization. Therefore Chairman Church should be appointed to this position. C.. Roanoke County Cable Television Committee This is similar to the Roanoke Valley Cable Television Committee and the same members serve with the addition of the Supervisor who represents the Catawba Magisterial District, the primary area served by Adelphia Cable TV. Total Action Against Poverty Board of Directors The TAP Board of Directors by-laws requires that an elected official serve on the TAP Board. For many years, former Clerk of Circuit Court Elizabeth Stokes was appointed. When Ms. Stokes retired from her elected position, former Supervisor Bob Johnson was appointed but asked Ms. Stokes to remain as the designee on behalf of the Board of Supervisors. The Board may appoint a Supervisor to replace former Supervisor Johnson who will play an active role on the TAP Board, or the Board may appoint a Supervisor who is willing to have Ms. Stokes continue, if she desires, to serve as the Board's designee. The first reading of this ordinance is scheduled for January 8, 2002. A second reading and public hearing is scheduled for January 22, 2002. SUMMARY OF INFORMATION: This ordinance divides the existing Glenvar Precinct # 103 and creates a new precinct, Wildwood Precinct #108 in order to conform with the Congressional redistricting found in Chapter 7, Acts ofAssembly, 2001, Special Session. The General Assembly has divided Roanoke Countybetween the 6th and the 9th Congressional Districts. The General Assembly moved the following precincts from the 6th to the 9th Congressional district: Catawba (101), Northside (104), Peters Creek (105), Bennett Springs (107), and Botetourt Springs (204). The General Assembly moved the following precincts from the 9th to the 6th Congressional district: Green Hill (106) and Poages Mill (302). The movement of these precincts does not require any action of the Board. However, the General Assembly action that divided the Glenvar Precinct between the two Congressional districts requires Board action to create a new precinct. The Glenvar Precinct currently contains 3959 persons. The new Glenvar Precinct will contain 2119 persons, and the new Wildwood Precinct will contain 1840 persons. ROANOKE REGIONAL AIRPORT The four-year term of Jane Milliron expires February 10, 2002. 9. ROANOKE VALLEY ALLEGHANY REGIONAL COMMISSION Because of Roanoke County's population increase in the 2000 U. S. Census, the Commission Charter now allots six representatives from Roanoke County, instead of the current five representatives. They have recommended that County Administrator Elmer Hodge be the sixth representative and he is willing to serve, if appointed by the Board of Supervisors. 10. SOUTHWEST DEVELOPMENT FINANCING INC The two year term of Wendi Schultz, Tourism and Event Coordinator for Parks Recreation and Tourism, will expire January 12, 2002. These courses are taught by Roanoke County teachers who meet the college's criteria for adjunct professors. Monies that have been collected exceed the expenses; therefore, there is a request for these additional funds to be appropriated for inservice and materials that will be used in the program. SUMMARY OF INFORMATION: Roanoke County Schools collected $30,750.00 tuition from 628 students. VWCC will reimburse $58,503.89 for services rendered (teachers, administrating expenses, rooms, utilities, and maintenance). Roanoke County Schools owes VWCC $78,005.18 for tuition and technology fees and college service fees. The difference between what was collected and what was spent is $11,248.71. FISCAL IMPACT: Roanoke County Schools requests that $11,248.71 be appropriated to the instructional program for use in the dual enrollment program. According to the Code of Virginia, Section 15.2-953, the County can declare a vehicle surplus, and then donate it to a nonprofit organization. The County currently has a 1992 Crown Victoria with 114,000 miles, valued at approximately $1,000, that is not needed by the other County departments. Representatives from Hollins University have seen this vehicle and determined that it would meet their needs. FISCAL IMPACT: None. This vehicle has exceeded its useful life to the County. STAFF RECOMMENDATION: Staff recommends declaring the 1992 Crown Victoria as surplus properly, and then donating the vehicle to Hollins University. Roanoke County is no different, as this board has looked to maximize tax revenue while keeping the burden of it's citizens to a minimum. Over the course of the past several years the Roanoke County Board of Supervisors has been told that a "new terrain" interstate project will bring to the Roanoke Valley economic development, thus increasing the tax base. Many advocates and opponents of I-73 agree that it may be 15-20 years before I-73 would become a reality, if at all. Let's look at three questions: What will happen to southeastern Roanoke County during that period? How has I-73 already impacted the County? Other that I-73, what improvements does VDOT have planned to address traffic problems on Rt.-220 in Roanoke County? First, let's start with what we know to be true thus far; I-73 has caused the loss of a $10-million dollar golf course development project. This loss includes approximately 80 homes, valued between $250,000 and $400,000 resulting in the loss of over $291,000 in tax dollars to the County. Although the tax revenue received from real estate assessment does not recover the costs of educating a child in each of these homes, this board has never advocated a policy of "build your homes here, but leave your kids elsewhere", that said, Roanoke County has always looked at other economic benefits. Let's continue with this "real life"example. A golf course of championship caliber would have drawn additional tourism dollars to the valley, as there would be undoubtedly be tournaments as well as recreational usage. The participants of these events would require food and lodging, as well as the benefits from added retail sales. Roanoke County spends untolled dollars promoting tourism, encouraging those from outside our area to visit, then we slam the door in the face of an opportunity that would have increased tourism. The result? No return on our marketing investment. Let's look at the jobs lost to I-73 thus far. 80 homes that would require the work of well drillers and septic systems, 80 homes that would require the talents of roofers, carpenters and other craftsmen- Services such as lawn care and landscaping. Homes that would have require water, lights, and utilities. All of these would ultimately add jobs and increased tax revenue. How many $10-million dollar projects is this board willing to say "no" to over the next 15-20 years because of an interstate project that currently has no funding and may not be built at all? Now, let's look at the future. Why would a current homeowner build a garage or add a deck to a home that is in the path of; or near a proposed interstate? Why bother with adding vinyl siding? Why bother painting? Cutting the grass? Making repairs? As the blight of an interstate starts to take effect, property values deteriorate. 15-20 years of deterioration. Ultimately, with this deterioration, property values will decrease, resulting in decreased tax revenue. ~.. Can we realistically expect new businesses to locate in our county when all they see from traffic lanes of I-73 is blight? We have to encourage economic stimulus from within, and the first steps to accomplish this is to remove the "rain clouds" of I-73 from our county. Finally, we come to last of our questions: What does VDOT have planned to address traffic problems on Rt.-220 through Roanoke County? Route 220 needs improvement. I have here two documents, take from the VDOT website. One is their Capitol Improvement Program for the Salem District, the other is their Feasibility Plan for the Salem District. Out of the 211 projects listed by VDOT, there not one improvement listed for Rt.-220 in Roanoke County. The future of Roanoke County cannot be placed on hold for 15-20 years. Economic stimulus cannot be placed on hold for 15-20 years. Improvements to Rt.-220 cannot be pushed aside for years. Therefore, the citizens of Mt. Pleasant request that a new resolution be adopted by this board opposing all proposed routes of I-73 through Roanoke County. By adopting and supporting this resolution, we can begin our future today, not 20-years from now. Thank You. f ~ Virginia Department of Transportation: Va. Currently, Botetourt County has three representatives on the Regional Commission and Roanoke County has five representatives. / Mr. Strickland stated that the 12th Annual Virginia Geographic Information Systems (GIS) Conference held November 1-2 at The Hotel Roanoke 8~ Conference Center was a big success. Over 500 individuals from Virginia and other states attended. The Regional Commission hosted the event, which is sponsored annually by the Virginia Association of Planning District Commissions. The staff were commended for their hard work on the conference. / Chairman Kessinger reported that copies of the Commission's 2001 Annual Report were available at the meeting. / Mr. Lee Osborne, chairman of the Commission's SERDI Assessment Committee, updated Commission members on the progress of the recommendations, which were adopted by the Commission in May of 2001. The progress report will be discussed in greater detail at the January 2002 Commission meeting. Mr. Osborne reported that the Assessment Committee had met earlier and was recommending that the old format for developing the Commission's work program, which included individual meetings with local governments, be replaced as follows. The staff will hold focus group type meetings with chief administration officials, economic development specialists, the transportation technical committee, and planning directors, to be followed up by a Commission "retreat" to focus on critical regional issues. Mr. Osborne noted that if any local government wishes to hold individual meetings with the Executive Director, they should feel free to do so. / The Regional Commission's 32"d Annual Dinner followed, with The Honorable Rick Boucher, U.S. Congressman, Virginia's Ninth District, serving as guest speaker. COUNTY ADMINISTRATOR'S COMMENTS: BACKGROUND: The existing subdivision ordinance was adopted in the mid 1950s. There have been minor amendments to the ordinance since that time. Since the adoption of the ordinance there have been significant changes to the zoning ordinance, the Code of Virginia, as well as other supporting documents. Due to these changes, the administration of the existing ordinance has become more challenging and staff's goal is to develop a more comprehensive and user-friendly document. Staff evaluated the existing ordinance to see if it was feasible to make amendments to the existing ordinance or to rewrite the entire subdivision ordinance. Staff believes it more realistic to completely rewrite the subdivision ordinance to replace the existing document. Since the spring of 2001 staff has involved many surveying and engineering professionals from the Roanoke Valley, the Roanoke Regional Homebuilders Association and Virginia Department of Health, as well as other County departments. Significant recommendations have been incorporated into the draft ordinance as a result of the input received during this process. SUMMARY: Staff has developed a comprehensive subdivision ordinance that provides the information necessary for surveying professionals to follow for the subdivision of parcels of land within Roanoke County. IN GENERAL. 17-1.1 Title. This ordinance shall be known and cited as the "Subdivision Ordinance of the County of Roanoke, Virginia," or the "Subdivision Ordinance," or "Ordinance." The provisions of this ordinance shall apply to all property within the County of Roanoke, Virginia, including any property within the county that may be assessed in an adjoining jurisdiction and excluding any property within the incorporated Town of Vinton, Virginia. In the construction of this and all other ordinances of the County, the following rule shall be observed, unless such construction would be inconsistent with the manifest intent of the board of county supervisors or the context clearly requires otherwise. A word importing the masculine gender only shall extend and be applied to females and to firms, partnerships and corporations as well as to males. 17-1.2 Purpose. The purpose of this ordinance is to establish procedures and regulations for the subdivision of land within the limits of the County, and to accomplish the objectives listed below: a) To achieve the orderly development of land through reasonable standards of design and procedures for subdivision and resubdivision of land; and ensure proper legal description. b) To protect and provide for the public health, safety and general welfare. c) To guide future growth and development in accordance with the policies of the comprehensive plan, applicable zoning regulations and other adopted policy documents of the County. d) To coordinate proposed public facilities and streets in new subdivisions with existing public services in a manner that minimizes adverse effects on adjacent or nearby neighborhoods. e) To reduce and prevent water pollution and flooding. To ensure appropriate development with regard to natural resources and open space, which will contribute to the beauty of the community and value of the land. 17-1.3 Jurisdiction and applicability of chapter a) This chapter shall constitute the comprehensive regulations governing all subdivision of land located within the County occurring on or after the effective date of this ordinance. No land may be subdivided using any legal description other than with reference to a plat approved by the subdivision agent in accordance with this chapter. b) The provisions of this chapter shall not apply to any subdivision for which a currently effective preliminary plat was approved on or before the effective date of this chapter. These plats or subdivisions shall be reviewed and acted on under applicable prior subdivision ordinances. Any subdivision for which a preliminary or final plat has received written approval prior to the effective date of this chapter and for which a final plat for the subdivision or a section thereof is recorded within six months of the date of such approval, may be developed in accordance with the subdivision ordinance in effect on the date of such approval. c) No existing subdivision shall be modified except by the agent's approval in accordance with this and other applicable ordinances of the County. d) This ordinance shall govern residential and nonresidential subdivisions. 4 Final Draft 11/29/01 ~'- 17-1.4 Adoption, amendment, and recordation of this ordinance a) The Planning Commission shall review and recommend approval of the subdivision ordinance and transmit it to the County of Roanoke Board of Supervisors. The Board shall approve and adopt the subdivision ordinance only after notice has been published, and a public hearing held, in accordance with the Code of Virginia § 15.2-2204. b) The Commission, on its own initiative may or at the request of the Board shall prepare and recommend amendments to the subdivision ordinance. The procedure for amendments shall be the same as for the preparation, recommendation, approval and adoption of the original ordinance; if no amendment shall be adopted by the Board without a reference of the proposed amendment to the Commission for recommendation, nor until 60 days after such reference, if no recommendation is made by the commission. c) When the subdivision ordinance has been adopted or amended, a certified copy of the ordinance and all amendments thereto shall be filed in the Clerk's Office of the Circuit Court for the County of Roanoke. State law reference - Va. Code §§ 15.2-2251, 15.2-2252, 15.2-2253 17-1.5 Relationship to zoning ordinance. The zoning ordinance and zoning map shall control the type and intensity of use of all property within the County. Particular reference is made in the zoning ordinance to the minimum lot sizes, setback requirements, road frontage and use restrictions for all zoning districts. ARTICLE II. ADMINISTRATION 17-2 DIVISION 1. IN GENERAL. 17-2.1 Agent. a) The Director of Community Development, or his designees, is appointed by the Board to be the County's Subdivision Agent to administer and enforce this ordinance. The agent's approval, disapproval, or other action shall be that of the governing body. b) The agent shall exercise authority to review, approve and disapprove the concept, preliminary, and final plats for the subdivision of land within the portions of the County including any property as stated in the title of this document. c) The agent may call for opinions or decisions, either oral or written, from other departments or agencies in considering details of any submitted plat. d) The agent may establish any reasonable administrative procedures deemed necessary for the proper administration of this ordinance. e) The agent designated by the Board to review preliminary subdivision plats shall complete action on the preliminary plats within sixty days of submission. However, if approval of a feature or features of the preliminary plat by a state agency is necessary, the agent shall forward the preliminary plat to the appropriate state agency or agencies for review. State law reference - Va. Code§ 15.2-2260 5 Final Draft 11/29/01 /' .. 17-2.2 Regulations. a) No person shall subdivide any tract of land that is located within the jurisdiction of the County except in conformity with the provisions of this ordinance and any other applicable County ordinances. b) No person shall subdivide land without making and recording a plat of such subdivision and without fully complying with the provisions of this subdivision ordinance and of general law. c) No such plat of any subdivision shall be recorded unless or until it shall have been submitted to and approved by the agent. d) No person shall sell or transfer any land of a subdivision before a plat has been approved and recorded as provided herein unless such subdivision was lawfully created before the adoption of this ordinance or any predecessor subdivision ordinance. Nothing herein shall be construed as preventing the passage of title of property that has not been legally subdivided. e) Any person violating the foregoing provisions of this section shall be subject to a fine of not more than five hundred dollars ($500.00) for each lot or parcel of land so subdivided or transferred or sold; and the description of such fot or parcel by metes and bounds in the instrument of transfer or other document used in the process of selling or transferring shall not exempt the transaction from such penalties or from the remedies herein provided. f) The agent and County attorney, or his designee, may take such other legal action as may be necessary to enforce the provisions of this ordinance, including suit for injunction, for abatement or restraining order or other appropriate proceeding. g) The agent, before finally approving any subdivision plat, may personally inspect the proposed subdivision on the ground. Upon approving such final subdivision plat, the agent shall clearly endorse his approval thereon. State law reference - Va. Code § 15.2-2254 17-2.3 Authority and process to grant a waiver or variation of the subdivision ordinance. a) In cases of unusual situations or where strict adherence to the general regulations in this ordinance would result in a hardship, the Commission may vary or waive any of the provisions of this ordinance, under the terms, procedures, and conditions established in this division. No waiver shall be granted which is illegal or which would prejudice the health and safety of citizens of this County. b) This waiver or variation procedure only applies to Roanoke County Standards. When compliance with a particular subdivision requirement that incorporates these standards unduly burdens the applicant, or causes harm to an adjacent property, the applicant may request a waiver of the requirement. The applicant shall examine alternative methods to attempt to comply with the intent of that requirement. c) The applicant shall make a request for a waiver of a requirement to the Director of Community Development. The request must be made in writing stating what relief is requested and the reasons the request should be granted. The appropriate application fee shall be included with this request. Any supportive drawings necessary to review the request must be made and acted upon before the submittal of any subdivision plat. The county will normally accept or reject a waiver application within seven (7) working days. If rejected, the application will be returned to the applicant with the reason for the rejection outlined in writing. Upon acceptance by the Director, the waiver application will be transmitted to the Commission for review and approval. Action on a waiver request, or an alternative method provided in lieu of strict compliance will be made at the next regularly scheduled Commission hearing date. The Commission shall preserve and record the application and the basis for granting or denying the request. 6 Final Draft 11/29/01 O- d) During the review of a subdivision plat, if a violation or error that is not in accordance with the approved standards is noted, the applicant will be notified through the normal review procedure. If the applicant requests a waiver or variance at this time, the review process will cease until the waiver requirements are met. e) A variation or waiver of the requirements of this ordinance may be permitted if, in the opinion of the Commission, the topography or other special or unusual conditions necessitate such. ARTICLE III. EXPLANATIONS AND DEFINITIONS 17-3 DIVISION 1. EXPLANATIONS. In the construction of this and all other ordinances of the County, the following rules shall be observed, unless such construction would be inconsistent with the manifest intent of the Board or the context clearly requires otherwise. a) The specific shall control the general. b) The word "person" includes a "firm, association, organization, partnership, trust, company," as well as "individual." c) A word importing the masculine gender only shall extend and be applied to females and to firms, partnerships and corporations as well as to males. d) The word "parcel" is interchangeable with the words "lot," "tract," "plot," or other words defined as a piece of land. e) The present tense includes the future tense; the singular number includes the plural: the plural number includes the singular. f) The word "shall" is mandatory; the word "may" or "should" is permissive. g) All public officials, bodies, and agencies referred to in this ordinance are those of the County of Roanoke, Virginia, unless otherwise specifically indicated. h) Any reference to this ordinance includes all ordinances amending it. i) All distances and areas refer to measurement in a horizontal plane. 17-4 DIVISION 2. DEFINITIONS. For the purposes of this ordinance, the words and phrases listed below in this section shall have the meaning described. Where terms are not defined, they shall have their ordinarily accepted meaning, or such as the context may imply. Agent: The duly authorized representative of the Planning Commission who has been appointed by the Board of Supervisors to serve as its agent in the review and approval of subdivision plats or his designee. Also, Subdivision Agent. Aggrieved person: A person or group of people with an immediate, pecuniary and substantial interest in a subdivision as opposed to a remote or indirect interest. The subdivider may be an aggrieved person. A person is also aggrieved if the person suffers a denial of some personal or property right or imposition of a burden or obligation different from that suffered by the public in general. 7 I+inal Draft 11/29/01 ~-" Alley: An open way that affords a service (i.e., garbage collection, delivery, mail) means of access to an abutting property, but is not maintained by the Virginia Department of Transportation. Building Envelope: That area within which the principal structure may be located on a property in compliance with all minimum setback requirements of the zoning ordinance. Chapter. The Subdivision Ordinance of the County of Roanoke, Virginia. Clerk' Office: Clerk's Office of the Circuit Court for the County of Roanoke. Commission: The Planning Commission of the County of Roanoke, Virginia. County: The County of Roanoke, Virginia. Conservation Parcel: A parcel that has been dedicated to a land trust, homeowners, condominium, or similar association, government agency or other entity through an easement or other transfer of ownership, and set aside in perpetuity as open space. Department of Transportation Standards of Virginia: The "Subdivision Street Requirements," Virginia Department of Highways and Transportation (1996); "Road and Bridge Standards," Vols. I and II, Virginia Department of Highways and Transportation (1994); and comparable or later revisions of these works. Developer. Any person or legal entity proposing to undertake the construction of buildings or other structures, or the development of land upon or within a subdivision or any portion thereof. Development: A proposed construction of improvements upon a lot, or lots, as a single unit under single ownership or unified control, which will be used for any commercial or industrial purpose or which will contain five (5) or more residential dwelling units. Driveway: A private ingress/egress easement of no less than 10' and no more than 30' wide providing vehicular access to no more than two (2) parcels. Easement: A right expressed in recorded writing, given by the owner of land to another party of specific limited use of that land (i.e., access, pedestrian, greenway, utility, drainage). Family, Immediate -Any person who is a biological or legally defined offspring, spouse, sibling, grandchild, grandparent, or parent of the owner. This definition shall automatically be amended in the event of a mandatory change to the definition in the State Code of Virginia and shall not automatically include any elective family members as allowed in the State Code of Virginia. State law reference - Va. Code § 15.2-2244 Final subdivision plat: The final plat of a proposed subdivision of land that has been preliminarily approved by the agent as a preliminary plat, subsequently to be recorded with the County of Roanoke Circuit Court. Governing body: The Board of Supervisors of the County of Roanoke, Virginia. Health Official: The health director as designated by the Commonwealth of Virginia or the agent that represents the County of Roanoke, Virginia. Official Property Identification Maps: The series of tax appraisal maps utilized by the Office of Real Estate Valuation for tax assessment purposes. Owner. Any person having sufficient proprietary interest in the land sought to be subdivided under this chapter to commence and maintain proceedings to subdivide such land under this chapter. 8 Final Draft 11/29/01 (,!_°"" Parcel: A piece of land shown with a separate identification on the official property identification maps. Also, interchangeable with "lot," "tract," "plot," or other words defined as a piece of land. Person: Any individual, firm, corporation, partnership, joint venture, public or private corporation, association of persons, body politic, trust, estate, or other legal entity, or any agent of any of the foregoing. Plat: A survey prepared and sealed by a land surveyor licensed by the Sate of Virginia showing thereon a subdivision of land submitted for obtaining final approval. Plat, Concept: A general drawing for a development of a subdivision submitted to the agent by the subdivider before an official preliminary submission. Plat, Preliminary: A plat of a proposed subdivision, submitted for the purpose of obtaining provisional approval prior to the submittal of a final plat. Public Improvement: Any drainage ditch, utility, or street for which the County or state may ultimately assume the responsibility for maintenance and operation, or which may effect an improvement for which local or state government responsibility is established. Public Street: A vehicular way owned, operated, provided and maintained by a local, state or federal government. The term shall include street, road and highway. Resubdivision: Any adjustment or vacation of a boundary line or lines within a subdivision in accordance with the terms of this chapter. Right-of--way: A legally established area or strip of land on which an irrevocable public right of passage has been recorded, and which is occupied or intended to be occupied by a street, utility service, water main, sanitary or storm sewer main, or other similar use. Road Maintenance Agreement: A recorded document prepared to control the maintenance and use of an ingress/egress easement serving three (3) of more parcels. Street: An area of travel used for the purpose of access and conveying vehicular traffic (which right-of-way may also in part serve as a way for pedestrian or bicycle traffic.) Subdivider. Any person, including an owner or developer, or his assignee or successor in interest, commencing, or required by law to commence, proceedings under this chapter to effect a subdivision of land hereunder for himself or for another. Subdivision: The division of a parcel of land into two (2) or more parcels of any size by the establishment of new boundary lines or by the adjustment, relocation, or vacation of existing boundary lines, for the purpose, whether immediate or future, of transfer of ownership or building development. A subdivision includes all changes in street or lot lines, and any portion of any such subdivision previously recorded in which building development or street creation occurs, or is required, subsequent to such recordation. The transfer of ownership of land to the Commonwealth of Virginia or a political subdivision thereof and the division of lands by court order or decree shall not be deemed a subdivision as otherwise herein defined. Subdivision Agenf: A person appointed by the Board of Supervisors to administer and enforce the subdivision ordinance. Also "agent." Subdivision, Major. A subdivision of five (5) or more lots. Subdivision, Minor. A subdivision of four (4) or fewer lots. Survey, ALTA/AGSM: A plat generally prepared for lending institutions showing an as-built survey and includes an easement guarantee and title report. This type of plat does not require the approval of the agent. 9 final Draft 11/29/01 1 Survey, Boundary: A plat delineating the form, extent and position of a parcel of land. This type of plat does not require the approval of the agent. Vacation of Recorded Plat: The nullification of a previously recorded plat, or portion thereof, before or after the sale of any lot created therein. VDOT: The Virginia Department of Transportation Waiver: An exemption from or variation of the terms of this subdivision ordinance. ARTICLE IV. PLAT SUBMISSIONS 17-4 DIVISION 1. IN GENERAL 17-4.1 Submission of plat to agent a) Whenever a subdivision is proposed to be made and before any sale of the subdivision as a whole or any part thereof is made, the owner or proprietor of a proposed subdivision, or his duly authorized representative, shall file a plat of the proposed subdivision with the agent for approval. The plat and all procedures relating thereto shall in all respects be in full compliance with the provisions of this chapter and all applicable laws and ordinances affecting or regulating the subdivision of land, the use thereof and the erection of buildings or structures thereon. b) Any change in a recorded subdivision plat that modifies, creates, or adjusts boundary lines in the manner and under the requirements provided herein. This section applies to any subdivision plat of record, whether or not recorded before the adoption of a subdivision ordinance. Where a street, alley, easement for public passage, or other public area or easement laid out or described in such plat is affected, the plat, or pertinent part thereof, shall be vacated before resubdivision. State law reference - Va. Code § 15.2-2258 c) All subdivision plats require the review and approval of the agent with the exception of those that show boundary or ALTA/ACSM surveys or those waived by the agent. 17-4.2 Minor subdivision An applicant for a subdivision creating four or fewer lots shall submit a preliminary plat to the agent for review. After the approval of the preliminary plat, the applicant shall submit a final plat to the agent for review and approval. 17-4.3 Major subdivision An applicant for a subdivision creating five or more lots shall submit a preliminary plat and plan to the agent for review. After the approval of the preliminary plat and plan, the applicant shall submit a final plat and plan to the agent for review and approval. 17-4.4 Family Exempt Subdivision An applicant for a subdivision to create a lot or parcel for the purpose of sale or gift to a member of the immediate family shall submit a preliminary plat to the agent for review. Specific requirements are set out in this ordinance and must be followed to obtain final plat approval. 10 final Draft 11/29/01 -~ For the purpose of this section, a member of the immediate family is defined as any person who is a biological or legally defined offspring, spouse, sibling, grandchild, grandparent, or parent of the owner. This definition shall automatically be amended in the event of a mandatory change to the definition in the State Code of Virginia and shall not automatically include any elective family members as allowed in the State Code. The subdivider must subdivide his real estate for purposes consistent with the objective of enhancing the values society places upon the disposition of family estates between living persons free of government regulation, such as keeping the family estate within the immediate family, and passing real property interests from one living family member to another, rather than for the purpose of short-term investment. The subdivider must complete affidavits swearing and affirming that the proposed family subdivision is not for the purpose of circumventing the requirements of this ordinance and must have a proposed deed prepared and presented to the County before final plat approval can be obtained. 17-4.5 Series of minor subdivision plats. The Director of Community Development may determine that a series of minor subdivision plats submitted during atwo-year period constitutes a major subdivision if the series of plats relates to the same parcel or parcels. Should the series of plats require any physical improvements including, but not limited to, storm water management, public road improvements, or the extension of public water and/or sewer, the director may determine that the series of plats in fact constitutes a major subdivision. If so, he shall require the subdivider to follow the process for the review of major subdivision plats. 17-4.6 Changing plats after approval. No change, erasure or revision shall be made on any preliminary or final plat of a subdivision, after approval by the agent, unless the agent has granted authorization for such change. In no case shall the agent approve a revision of a previously approved plat unless the date and reason of the revision and the fact that it is a revised plat is clearly stated thereon. 17-6 DIVISION 2. CONCEPT AND PRELIMINARY PLATS 17-6.1 Process of review -Concept plat review The applicant may schedule a conference with the agent to review a concept sketch for a proposed subdivision, in order to determine whether the sketch generally meets the requirements of the Zoning and Subdivision Ordinances, and to identify any concerns or issues raised by the proposed subdivision. The agent's comments on the sketch shall be informal, and shall not constitute a formal approval or disapproval of the subdivision plat. 17-6.2 Concept sketch standards. The concept sketch shall conform to the following guidelines: a) Include the name, location, dimensions of all streets entering the property, adjacent to the property or terminating at the boundary of the property to be subdivided; b) Show the approximate location of natural features, such as slopes with approximate gradients, watercourses; c) Include approximate dimensions of existing and proposed property lines; d) Show existing utilities and easements. 11 Final Draft 11/29/01 ~~ J 17-6.3 Process of Review -Preliminary/Final Plat Review a) A preliminary plat accepted for review and accompanied by the subdivision review fee shall be deemed officially submitted to the County. b) The agent is authorized to review the preliminary plat for conformity with County and State ordinances. The agent shall address any items required for final plat approval in writing to the applicant. c) These items must be addressed within six (6) months of the written notification or the project will be considered null and void. Should this occur, a resubmission of the plat and payment of new review fees may be required. d) Once the items have been addresses, the applicant shall submit a mylar, vellum, or black line paper copy of the final plat with original signatures of the owners and land surveyor for the agent's approval signature. Plats may be submitted digitally in accordance with County regulations. e) The owner's signature shall certify that the owner is aware of the requirements imposed by applicable State and County codes, and shall further certify that the owner agrees to comply with these requirements. This certification is set forth in the following statement which must be shown on the plat: "The platting or dedication of the following described land (here insert a correct description of the land subdivided) is with the free consent and in accordance with the desire of the undersigned owners, proprietors, and trustees, if any." The statement shalt be signed by the owners, proprietors, and trustees, if any, and shall be duly acknowledged before an officer authorized to take acknowledgment of deeds. State law reference - Va. Code § 15.2-2264 f) Every final subdivision plat which is intended for recording shall be prepared by a licensed professional engineer or land surveyor, who shall endorse upon each plat a certificate signed by him setting forth the source of title of the owner of the land subdivided and the place of record of the last instrument in the chain of title. When the plat is of land acquired from more than one source of title, the outlines of the several tracts shall be indicated upon the plat. State law reference - Va. Code § 15.2-2262 g) Once the agent reviews the final plat and finds it to be in conformity with the State and County ordinances, it must be signed within sixty (60) days after it has been officially submitted or resubmitted for approval. h) The final plat must be recorded in the Clerk's Office within sixty (60) days of the agent's approval signature. If the final plat is not recorded within sixty (60) days, the agent's approval will be withdrawn and the final plat will become void. After recordation, three (3) paper copies of the recorded minor subdivision plat must be returned to the agent; one mylar or black line copy of a recorded major subdivision plat must be returned to the agent. 17-6.4 Size, information, and requirements for apreliminary/final plat a) Each parcel, with the exception of utility, conservation, and private road lots must have an appropriate building envelope. b) Where public utilities are unavailable, each parcel shall pass a soil evaluation test for the installation of a septic system with both a primary and a one hundred percent (100%) reserve on-site drain field area and have a suitable location for a well contained on the lot it serves. The specific regulations governing septic systems and wells can be found in the Commonwealth of Virginia State Board of Health Sewage Handling and Disposal Regulations and Private Well Regulations, as amended. Parcels may be exempted from the soil evaluation and well requirements in special circumstances such as in the creation of utility, conservation, and private road lots. The agent shall approve all such exempted parcels. 12 Final Draft 11/29/01 V "~ c) All preliminary plats submitted for final approval shall be eighteen (18) by twenty-four (24) inches and drawn to a scale no smaller than 1"=100' unless otherwise approved by the agent. d) There shall be a reasonable fee charged for the review of a preliminary plat. Such fee schedule shall be established by resolution by the Board and a copy shall be maintained in the agent's office. The plat review fee shall be paid prior to final plat approval. e) Plat standards shall generally conform to The Library of Virginia Standards and Guidelines for Microfilm, Plats, Instruments, and Circuit Court Records. f) Both the preliminary and final plats shall demonstrate compliance with the requirements of the County of Roanoke Zoning Ordinance and this chapter. They shall contain the elements as shown in Table 1 below, unless otherwise directed by the agent. Table 1 Subdivision name. Name of the subdivider. Name of the surveyor or engineer. Surveyor's professional seal signed with a permanent marker. All owners, trustees, and beneficiaries must sign and notarize the plat with a permanent marker. If the plat is drawn from record or from a current field survey. Ori final tax ma numbers and tax map numbers assi ned to new lots. All monuments and iron pins. Deed references. Date of the plat. Magisterial district. A legend. The scale. All monuments and iron pins. Boundary coordinates. Bearings and distances of all boundaries. Labeled lots. Acreage or area of all new tracts, including common open space, park, or public lands, and the remaining tract. All adjacent property owners, deed book and page references, lots, blocks, section numbers and the County's tax map numbers. Identification of graves, objects, or structures marking a place of human burial. A vicinity map with a north arrow. A north arrow that references either true or magnetic meridian. All existing building structures showing setbacks to nearest property line. Show and name all natural watercourses. Note the following on the plat: "This property is/is not located in a special flood hazard area designated as Zone 'X.' This determination is based on the current FEMA flood insurance rate ma sand has/has not been verified b actual field elevations." Show FEMA Map Number or Community Panel Number and FEMA flood hazard zone. Topography map on a suitable scale and contour intervals when required by the agent. Show a signature and date blank for the agent, Roanoke County Planning Commission. Where applicable, the surveyor must determine whether the natural watercourse(s) adjacent to or on this site drains an upstream area of greater than 100 acres. If so, the surveyor must show the elevation of the 100-year floodplain on each lot and add the following note to the plat: "The watercourse crossing this property drains an upstream area of greater than 100 acres. A detailed flood study must be made and an elevation certificate ma be re uired before an buildin permits can be issued on this pro ert ." 13 Final Draft 11/29/01 L./ ""~ Show the statement of consent to subdivisions from the State Code of Virginia, 1950 (as amended), and the County of Roanoke Subdivision Ordinance reference. Note the following on the plat: "Approval hereof by the Roanoke County Subdivision Agent is for the purposes of ensuring compliance with the Roanoke County Subdivision Ordinance. Private matters, such as compliance with restrictive covenants or other title requirements, applicable to the roperties shown hereon, are not reviewed or a roved with re and to this subdivision or resubdivision." The general location of existing drain fields and reserve areas (if applicable), but not proposed drain fields. A note stating "All lots shown on this subdivision plat have been reviewed by the personnel of the Roanoke CountyNinton Health Department and have met the criteria as set forth in the Commonwealth of Virginia Sewage Handling and Disposal Regulations entitled 32.1 Code of Virginia, as amended to date, and each lot or arcel is eli ible for a se tic ermit." A note stating the type of septic system being used (i.e., conventional, nonconventional). Any non-public means of water service. Any existing or proposed public utility or other easements and a dedication statement. Any existing or proposed private utility or other easements and a statement describing which easements serve which lots. If any water meters and/or sewer lateral connections were set at old property lines, then private easements may be required to provide service to the newly confi ured lots. Other important features such as railroad rights-of-way, lakes, greenways, etc. Access easements from the public right-of-way to the created tract(s). All parcels of land designated, or reasonably expected to be required, for future street widening shall be dedicated. A dedication statement for street rights-of-way that will be accepted by the VDOT. For private access easements, show the following note on each sheet of the plat: "The road serving this lot is private and its maintenance, including snow removal, is not a public responsibility. It shall not be eligible for acceptance into the state secondary system for maintenance until such time as it is constructed and otherwise complies with all requirements of the Virginia Department of Transportation for the addition of subdivision streets current at the time of such request. Any costs required to cause this street to become eligible for addition into the state s stem shall be rovided with funds other than those administered b the Vir inia De artment of Trans ortation." The names and VDOT route numbers for all existing, platted, and proposed streets. Width of existing, platted, and proposed streets indicating a prescriptive easement if one exists. A note referring to a road maintenance agreement as follows: "The lots in this subdivision are subject to a road maintenance agreement recorded contem oraneousl with this plat." If applicable, a note stating that "Tax map number _ is to be added and combined with tax map number _ and is not to be used as a separate building lot." Plats showing Boundary and ALTA/ACSM surveys may show the following note on the plat and will not require the signature of the agent: "This surve does not constitute a subdivision under the current Roanoke County Subdivision and/or Zoning Ordinance." If a proposed subdivision is using the Family Exemption provision, in addition to the above requirements, the requirements shown in Table 2 must also be included. Table 2 A note stating "Approval of this subdivision is subject to the condition that the parcel subdivided can only be conveyed to a member of the immediate family as set forth in Roanoke County's Subdivision Ordinance, as amended, and the Code of Virginia, as amended. Conveyance to any other person or entity voids approval. This restriction does not apply to subsequent reconveyance." Affidavits that are available in the Development Review office stating that the family subdivision is for the passing of real property interests from one famil member to another, rather than for the ur ose of short-term investment. A copy of the proposed deed(s) from one family member to the other. A description of the family relationship in the consent statement or the following shown and notarized on the plat: "I, , do hereby certify that is my legal .New tract is being conveyed to 17-6.5 Term of validity of preliminary plat. The subdivider shall have six months from the date of approval of the preliminary plat within which to file a final plat and final engineering plan meeting all of the submittal requirements established by this chapter for the subdivision or section thereof. Failure to do so shall make the preliminary plat approval null and void. The agent may, on written request of the subdivider received no fewer than ten (10) working days prior to expiration of validity and for good cause shown, grant one six month extension of preliminary plat approval. 14 Final Draft ~- 11/29/01 17-6.6 Appeal of failure to act on preliminary plat. If the agent fails to approve or disapprove the preliminary plat within ninety (90) days after it has been officially submitted for approval, the subdivider, after ten days' written notice to the agent, may petition the circuit court for an order with respect thereto as it deems proper, which may include directing approval of the plat. 17-6.7 Appeal of disapproval of preliminary plat. If the agent disapproves a preliminary plat and the subdivider contends that the disapproval was not properly based on the ordinance applicable thereto, or was arbitrary or capricious, he may appeal to the circuit court of the county, which court shall hear and determine the case as soon as may be. The appeal must be filed with circuit court within sixty days of the written disapproval by the agent. State law reference - Va. Code § 15.2-2260 17-7 DIVISION 3. FINAL PLATS 17-7.1 Deadline for filing final subdivision plat for major subdivisions. The subdivider shall file with the agent the final plat meeting the standards of this ordinance for all or one or more sections of the subdivision within six months of the agent's approval of the preliminary plat. For good cause, and with satisfactory progress in the subdivision process being demonstrated to the agent, the agent may grant one extension of this period of up to six months. 17-7.2 Final plat documents submitted prior to approval. a) The final subdivision plat, including the final plat for each phase of a multi-phase development, shall demonstrate compliance with this chapter, the Zoning Ordinance and other applicable County ordinances. b) The agent shall not approve a final plat until any necessary deed of dedication has been submitted and approved by the County attorney. A deed of dedication is required to convey parkland, pump station sites, and other property to the County. One is not necessary to convey streets, any easement for public utilities, or an easement for the conveyance of stormwater, domestic water or sewage. c) A subdivision plat showing two or more new lots on a private ingress/egress easement or driveway shall reference a road maintenance agreement signed by involved parties. This agreement shall be recorded contemporaneously with the approved plat. d) The agent shall not approve a final plat until any necessary subdivision agreement, with surety has been submitted and approved by the County attorney. The agent shall receive any payment due for the fabrication and installation of street name and traffic regulatory signs prior to the approval of the final plat. e) Where appropriate, the agent shall not approve a final plat until any required deeds of easement to Roanoke County are submitted and approved by the County attorney. State law reference - Va. Code § 15.2-2259 17-7.3 Disapproval of final plat. In case of disapproval, the agent shall give the subdivider specific reasons for denial including code or ordinance references where applicable. They shall relate in general terms such modifications or corrections as will permit approval of the plat if any there be. State law reference - Va. Code § 15.2-2259 15 Final Draft 11/29/01 ~-" 17-7.4 Effect of approval on final plat. a) Only a final plat approved by the agent may be recorded in the Clerk's Office. Boundary and ALTA/ACSM surveys do not require the approval of the agent. Other plats may be exempted by the agent. b) An approved final plat must be recorded in the Clerk's Office within sixty (60) days of the date of approval. However, this time period may be extended if the subdivider has commenced the construction of facilities to be dedicated to public use, pursuant to an approved plan, or permit with security approved by the agent. These exceptions apply only if construction has commenced or surety has been approved and accepted before the expiration of the time period. The deadline for filing the plat may be extended for the period specified in the surety agreement. c) In any case where a deed of dedication accompanies the final plat, both the final plat and the deed of dedication shall be recorded contemporaneously. d) The subdivider shall record any required deeds of easement to a homeowner's association contemporaneously with the final plat. e) No permit or other approval authorizing the erection of any building or structure to be located in any subdivision, a plat of which is required pursuant to the provisions of this ordinance, shall be issued by the building commissioner until such plat has been admitted to record as provided for in this ordinance. f) If the subdivider fails to timely record the final plat, then the approval shall become null and void and the subdivider shall return the plat to the agent so that it may be so marked. State law reference - Va. Code § 15.2-2241(8) 17-7.5 Recordation in phases. If the subdivider records a final plat which is a section or phase of a subdivision as shown on the approved preliminary plat within the sixty day period established in this section, then he may record the remaining sections or phases for a period of five years from the recordation date of the first section, in accordance with this section. The subdivider shall furnish the County with a certified check, cash escrow, bond, or letter of credit in the amount of the estimated cost of construction of the facilities to be dedicated within said section for public use and maintained by the County, the Commonwealth, or other public agency. The five year time period provided herein may be extended by the agent at the time of approval of the preliminary plat, as provided in this section. State law reference - Va. Code § 15.2-2241 17-7.fi Effect of recordation of approved plat. a) The recordation of an approved plat shall operate to transfer, in fee simple, to the County the portion of the premises set apart for streets or other public use, and to convey facilities and easements for the conveyance of stormwater, public water and sewage. d) When the agent approves in accordance with this ordinance a plat or replat of land, then upon the recording of the plat or replat in the office of the Clerk's Office all rights-of-way, easements or other interest of the County in the land included on the plat or replat, except as shown thereon, shall be terminated and extinguished. However, an interest acquired by the County by condemnation, by purchase for valuable consideration and evidenced by a separate instrument of record, and streets and/or easements for public passage shall not be affected thereby. If the agent disapproves a final plat and the subdivider contends that the disapproval was not properly based on the ordinance applicable thereto, or was arbitrary or capricious, he or she may appeal to the circuit court within sixty days of the written disapproval. State law reference - Va. Code § 15.2-2259 17-8 -17-10 Reserved ARTICLE V. STANDARDS 17-11 DIVISION 1. GENERAL REQUIREMENTS a) In addition to the requirements established by this ordinance, all subdivision plats shall comply with all applicable chapters of the County Code, County Zoning Ordinance, County Land Development Procedures, County Water and Sewer Regulations, County Stormwater Management Ordinance, Commonwealth of Virginia State Board of Health regulations, VDOT, and any other applicable federal, state, or local requirements. b) Monuments shall be set by the subdivision owner or proprietor or his agent as required by the agent and shown on the final plat. 17-12 DIVISION 2. STREET REQUIREMENTS a) Right-of-way widths shall be as required by the Virginia Department of Transportation. The setback or building line shall conform to the requirements of the zoning regulations of the County for the district in which the subdivision is located. b) All dead-end streets shall terminate in a circular right-of-way with a minimum radius of fifty (50) feet. c) As far as practicable, all proposed streets shall be continuous and made to connect with existing streets without offset. d) No new lot shall embrace any portion of a public street. e) In general, side lot lines shall be at right angles or radial to street lines. f) Reverse frontage of lots at street intersections shall be avoided, where possible. g) Reserved strips restricting access to streets, public ways and easements shall not be permitted. h) In cases where a new lot in a large subdivision fronts on two streets, the dwelling shall face the street which conforms to the orientation of the dwellings on the remaining lots in the subdivision. i) Where practicable, the center lines of all intersecting streets shall meet in a common point and shall intersect one another as near to a right angle as it is practicable in each case. 17 Final Draft 11/29/01 _" j) Whenever a proposed subdivision abuts a road that is included in the state system of primary highways as designated by VDOT, an access road extending for the full length of the subdivision along such highway and providing limited access thereto may be provided at a distance suitable for the appropriate use of the land between such access road and highway. k) Street names shall be shown on the preliminary and final plats and shall be approved by the agent. Proposed streets that are in alignment with existing streets shall bear the name of the existing street. In no case shall the name of the proposed streets duplicate or be similar, literally or phonetically, to existing street names, regardless of the use of the terms street, avenue, boulevard, driveway, place, lane, court, or other suffixes approved by the County for E-911. Any street that is a prolongation or approximately a prolongation of an existing street shall be given the same name. Names of existing streets shall not be changed except by the approval of the County. I) Except as provided in subsection k) of this section, no street shall be designated by the same name as that heretofore borne by any other street in the region as determined by the agent, irrespective of the use of any suffix. m) The subdivider shall make provision for the dedication to the County of Roanoke of proposed street extensions as set forth in the comprehensive plan or in other formal documents approved by the Board and for the dedication to the County of the fee simple title to land for other proposed streets in the subdivision. n) Street name and traffic regulatory signs of a design approved by the County and VDOT, as required, shall be installed at the owner's expense at all street intersections if deemed necessary. o) All streets shall conform to the duly adopted standards relating to the street design and construction, established in the VDOT of Transportation Subdivision Street Requirements and the County's Public Street and Parking Design Standards and Specifications Manual. 17-13 DIVISION 3. STORMWATER MANAGEMENT REQUIREMENTS a) Streets, pedestrian paths, and greenways shall be designed to minimize their potential for increasing and aggravating the flood level. b) A drainage system shall be provided for by means of culverts under roadways, outlet drains, necessary head walls, easement for drainage through adjacent properties and other structures that are necessary to provide adequate drainage of both natural and storm water for all streets and adjoining properties. c) Land in the floodplain overlay district of the zoning ordinance and land deemed to be topographically unsuitable because of flooding shall not be platted for residential occupancy or for such other uses that may increase danger to health, life or property, or cause erosion or flood hazards. Such land within the subdivision shall be identified on the plat as flood hazard areas. d) All developments shall comply with the County Stormwater Management Ordinance. 17-14 -17-16 Reserved 18 final Draft 11/29/01 ARTICLE VI. PLATS 17-17 DIVISION 1. REPEATS 17-17.1 Relocation or vacation of boundary lines. v-~ a) Any plat recordation or part thereof, having been recorded, may be vacated in accordance with the provisions of the Code of Virginia. b) The boundary lines of any lot or parcel of land may be relocated or otherwise altered as a part of an otherwise valid and properly recorded plat of subdivision or resubdivision approved by the agent and executed by the owner or owners of such land with their free will and consent. Such action of approval shall not involve the relocation or alteration of streets, alleys, easements for public passage or other public areas; provided further, that no easements or utility rights-of-way shall be relocated or altered without the express consent of all persons holding any interest therein. 17-18 DIVISION 2. VACATIONS 17-18.1 Vacation of plat before sale of lot therein by the owners. a) The owners, proprietors and trustees, if any, who signed the statement of consent to subdivide on the final recorded subdivision plat of any subdivision, may apply in writing for the vacation of the recorded plat or part thereof. The agent shall review the application. The agent shall forward the application, with its recommendation, to the Board. b) With the consent of the Board, the owners, proprietors and trustees shall duly execute, acknowledge and record in the Clerk's Office a written instrument declaring the plat or part thereof to be vacated. The agent's consent shall appear on the face of the instrument. The effect of recording this instrument shall be to divest all public rights in, and to reinvest the owners, proprietors and trustees, if any with the title to the streets, alleys, easements for public passage and other public areas laid out or described in the plat. State law reference - Va. Code § 15.2-2271 17-18.2 Vacation of plat before sale of lot therein; ordinance of vacation. a) The Board may adopt an ordinance vacating a recorded plat, or part thereof, where no lot has been sold. b) The ordinance shall not be adopted until after notice has been given as required by Virginia Code, 1950, as amended § 15.2-2204. The notice shall clearly describe the plat or portion thereof to be vacated and state the time and place of the meeting of the governing body at which the adoption of the ordinance will be voted upon. Any person may appear at the meeting for the purpose of objecting to the adoption of the ordinance. c) An appeal from the adoption of the ordinance may be filed with the County of Roanoke Circuit Court within thirty days of the adoption of the ordinance. Upon appeal, the court may nullify the ordinance if it finds that the owner of the property shown on the plat will be irreparably damaged. d) If no appeal from the adoption of the ordinance is filed within the time provided or if the ordinance is upheld on appeal, a certified copy of the ordinance of vacation may be recorded in the Clerk's Office. e) The execution and recordation of the ordinance of vacation shall operate to destroy the force and effect of the recording of the plat, or any portion thereof, so vacated, and to divest all public rights in and to the property and reinvest the owners, proprietors an trustees, if any with the title to the streets, alleys, and easements for public passage and other public areas laid out or described in the plat. Code § 15.2-2271 19 Final Draft 11/29/01 ~~1 17-18.3 Vacation of plat after sale of lot; consent of all owners. a) The owners of all lots shown on a subdivision plat may apply in writing for the vacation of the recorded plat or part thereof. For the purposes of this section, the word "owners" shall not include lien creditors except those whose debts are secured by a recorded deed of trust or mortgage and shall not include a consort of an owner. b) In cases involving drainage easements or street rights-of-way where the vacation does not impede or alter drainage or access for any lot owners other than those lots owners immediately adjoining or contiguous to the vacated area, only the signature of those lot owners immediately adjoining or contiguous to the vacated area shall be required. c) The agent shall refer the application to the Board. d) With the consent of the Board, the owners shall duly execute, acknowledge and record in the Clerk's Office a written instrument declaring the plat or portion thereof to be vacated. The agent's consent shall appear on the face of the instrument. The effect of recording this instrument shall be to divest all public rights in, and to reinvest the owners, proprietors and trustees, if any, with the title to the streets, easements for public passage and other public areas laid out or described in the plat. Code § 15.2-2272 17-18.4 Vacation of plat after sale of lot; ordinance of vacation. a) The Board may adopt an ordinance vacating a recorded plat, or part thereof, where a lot has been sold. The ordinance may be initiated by motion of one of the Board members or on the application of any interested person. b) The ordinance shall not be adopted until after notice has been given as required by Virginia Code, 1950, as amended § 15.2-2204. The notice shall clearly describe the plat or portion thereof to be vacated and state the time and place of the meeting of the governing body at which the adoption of the ordinance will be voted upon. Any person may appear at the meeting for the purpose of objecting to the adoption of the ordinance. c) An appeal from the adoption of the ordinance may be filed with the County of Roanoke Circuit Court within thirty days of the adoption of the ordinance. Upon appeal, the court may nullify the ordinance if it finds that the owner of the property shown on the plat will be irreparably damaged. d) If no appeal from the adoption of the ordinance is filed within the time above provided or if the ordinance is upheld on appeal, a certified copy of the ordinance of vacation may be recorded in the Clerk's Office. e) The execution and recordation of the ordinance of vacation shall operate to destroy the force and effect of the recording of the plat, or any portion thereof, so vacated, and to divest all public rights in and to the property and reinvest the owners, proprietors and trustees, if any, with the title to the streets, alleys, and easements for public passage and other public areas laid out or described in the plat. State law reference - Va. Code § 15.2-2272 17-18.5 Effect of vacation of plat after lot has been sold. a) The recordation of the instrument as provided in State law reference - Va. Code § 15.2-2272, provision 1 or of the ordinance as provided in State law reference - Va. Code § 15.2-2272, provision 2 shall operate to destroy the force and effect of the recording of the plat or part thereof so vacated, and to vest fee simple title to the centerline of any streets, alleys or easements for public passage so vacated in the owners of abutting lots free and clear of any rights of the public or other owners of lots shown on the plat, but subject to the rights of the owners of any public utility installations which have been previously erected therein. 20 `Final Draft 11/29/01 ~~~ b) If any street or easement for public passage is located on the periphery of the plat, the title for the entire width thereof shall vest in the abutting lot owners. The fee simple title to any portion of the plat so vacated as was set apart for other public use shall be revested in the owners, proprietors and trustees, if any, who signed the statement of consent to the subdivision, on the final recorded subdivision plat, free and clear of any rights of public use in the same. However, a plat must be prepared and reviewed at the owner's expense and then recorded in the Clerk's Office for the vacated portion to be considered a part of the subject property. ADOPTION In order to effectuate the provisions of this chapter, the Board shall adopt by resolution regulations and policies that shall have the force of law. These regulations shall include, among other things, standards for the implementation of the various sections of this chapter and may include other policies, criteria, standards and regulations to implement the provisions of the Subdivision Ordinance and Zoning Ordinance. 17-23 DIVISION 2. AMENDMENTS Nothing contained herein shall prevent the Board from considering and adopting amendments to such ordinance at any time it is deemed appropriate. 21 A ACTION NO. Compliance mandated by March, 2003. •Construction of projects identified in the Regional Stormwater Management Plan and the continuation of flood mitigation projects akeady underway. GIS Phase II -Integration •Is needed to support eGovernment initiative and intergrates mapping with E-911 Dispatch Center, School bus/Refuse Collection/Emergency vehicle routing. •Digitizes water, sanitary sewer, and storm sewer sytems and replaces aging Microfilm Management System. Roanoke River Greenwav -Green Hill Park •Backbone of the Greenway network and is viewed as a priority by the public •Funds will be matched through TEA-21 grants. GPS Ground Monumentation •Placement of 20 additional monuments to allow for improved accuracy for future reflights and will benefit local developers and surveyors (more accurate base mapping) GPS Base Station and So tware •Allows instant processing of GPS location information; currently, the County uses outside vendor to "post process" data. •Will work in conjunction with public safety mobile data terminals to track location of emergency vehicles. Mudlick Creek Greenwav •This project is an extension of the Garst Mill Greenway along Mudlick Creek downstream toward the City and upstream to the new high school. •Included as a condition of new County high school special use permit. Tinker Creek Greenwav •Preliminary engineering/development of cost estimates for TCG from Roanoke City line to Carvins Cove. GIS Phase III - Reflight and Orthophotos •Continuation of project begun in 1995. Scope of project includes reflight and replacement of digital aerial photography. Drainage Maintenance Building •Current situation provides insufficient space for equipment maintenance, materials storage, and efficient drainage maintenance operations. Economic Development Site Devel~ment -CRT Elections Voter Equipment Replacement •Replacement of voting machines; mandated by recent (HR3295, December 12, 2001) and pending Senate legislation. 9.3 Printed: 01 /08/2002:1:5 PM Department/Proiect Fire and Rescue Network Fire and Rescue Facilities •Establish a LAN system to link each fire and rescue station (13 sites) to the Administrative office, other County departments, and CAD system. •Required for a more cohesive information flow and the computation of more accurate statistics. Station Fuel Control Svstem •Installation of automated fuel system and all stations and will allow computer fuel tracking and provide triggers for preventive maintenance. Station Security Systems •Enhanced security systems to cover all fire and rescue stations and will include new locking mechanisms and keys for all buildings. Bav Heater Uz~Qrades •Upgrade of 20 year-old heaters for Catawba, Hollins, and Fort Lewis. Equipment must be kept within a constant temperature range. Vinton Rescue Public Safety Building •Provide construction of building for housing rescue apparatus and personnel. Increased call volume necessitated an increase in staffing hours and current facility does not have sleeping quarters. Upgraded Paging Capabilities •Upgrade current low band paging system to a more reliable system (currently 15-20 years old). Coverage lacking in some remote areas of county. Station Additions -Back Creek and Read Mountain •Positioning for the future based on projected area growth rates. Bunk Room Additions •Addition and upgrade sleeping facilities at Bent Mountain and Masons Cove. This project would provide separate male and female accommodations. Hanging Rock Public Safety Center •Construction of fire/rescue building, including land purchase, in the area of I-81 and Route 419. Includes 3 bays and sleeping quarters. Hollins Road Public Safety Buildi>~ •Construction of fire/rescue building, including land purchase in the area of Hollins Rd near Plantation Rd. General Services New Count Garage at Kessler Mill Information Technology HP Svstem Replacement •HP has announced that the HP/3000 and the operating system will no longer be supported as of 12/31/06. Cost of replacement systems mandate that the County begin planning and allocating funding now for the inevitable transition. •Transition will affect 13 critical County applications. Computer Networklnfrastructure Upgrade •Upgrade of Network Infrastructure over 3-year period and includes replacement and/or consolidation of servers, cabling, routers, switches, etc. Building E~;nansion or IT •Expansion of existing office space by 1,308 sq ft by construction of addition to building to accommodate growth in office over last 10 years. •Building expansion will allow for expanding the E911 dispatch center, a move necessitated by anticipated service level increases based on cellular E911 calls. Present daily traffic exceeds 1,000 patrons per day. Glenvar Branch Expansion -This structure, built in 1978, has never been expanded or refurbished to accommodate the growing population in the western portion of Roanoke County. Mount Pleasant Branch Library -Current facility, located inside Mount Pleasant School, is restricted by school operations. Bent Mountain Branch Renovation -Current facility, located on Bent Mountain School property, at 700 sq.ft. Vinton Branch Libran~ Refurbishment -Was expanded in 1983 after the roof collapsed; however, the interior has not been renovated since its construction in 1970. Parks and Recreation Br•ambleton Center -Continues renovation that includes HVAC improvements, playground, landscaping, restrooms, plumbing, sewer and drainage, etc. Burton Athletic Complex -Landscaping, security lighting, field lighting improvements, field improvements, major fence replacement, and a playground. Carnp Roanoke -Pool construction and lake marina with 10-slip dock access to Spring Hollow Reservoir. Community Recreation Center •40,000 sq. ft. indoor recreation center to include swimming pool, senior citizen area, fitness area, and gymnasium. Crai~Avenue Recreation Center -Install new storm windows, paint exterior, vinyl siding for soffitt ,replace exterior doors, and build walking track at rear of soccer fields. Famil~quatic Center •Contruction of an outdoor, free form designated pool with water slides, zero depth beach entrance, and water play features, bathouse and concessions. Gm-st Mill Park bn~•ovements -Stream bank stabilization phase II, perimeter loop trail, upgrade restroom and existing shelter, additional play apparatus, and bridge improvement. Green Hill Park Plzase III -Continue development of park by providing an amphitheater, restroom building, large picnic shelter, electricity, landscaping, lighting 2 soccer fields, new football field, outbuildings, trails, security lighting, additional barrier system, and a maintenance yard. North Roanoke Soccer Complex -Lighting of 2 soccer fields, pave parking lot, and construct a shelter and playground. Parking Areas Improvements -Renovation and repair at 15 parks sites and includes installation of base materials and asphalt overlay. Parks and Recreation Land Bank -Acquisition of parkland for reported deficits in the County. Picnic Shelters •Constuet and install accessible picnic shelters at Mt. Police Renovation ofFirst Floor Restrooms •This project is designed to modernize first floor restrooms built in 1939, and includes installing shower facilities to support EOC operations. Bomb Disposal Equipment •Though Roanoke County police have responded to 101 bomb threats since 1991, the department relies on the Virginia State Police for anything other than initial response to such threats. Purchases include officer protection equipment, detection and disposal equipment, and an explosive storage facility. Sheriff Renovate Roanoke County/Salem Jail •Renovation of 6th floor of current jail facility (addition of 26 beds), addition of a 7th floor (54 beds), and expansion of kitchen facility. Enclose Court House Breezeway •Project will permit screening (metal detectors and Xray) of all visitors and packages entering the facility. Slumping sales and decreased interest from outside developers, along with an increasing industry emphasis on open-standard systems, prompted the e3000 series' demise, HP said in a statement. HP will continue selling certain e3000 b;vs-.~.~s-s until Nov. 1, 2003, and will maintain support services for the ~_~rs/:~rs until Jan. 1, 2007, the company said. Trade-in credits and discounts toward the purchase of HP ~;~?-~1~.:~-s running HP- UX, ~e_l~~c~~~r~, or Linux will be offered, and A-class and N-class customers will receive free conversion kits and unlimited HP-UX user licenses, HP said. The company also is working with e3000 application vendors to transition their applications and customers to other HP systems and is working with third-party tools and ~~;;~~~'W^~;~~~.developers on migration applications and services. The e3000 series carries on HP's 3000__Ut ,~~_ line, launched in 1972. HP 3000 s~.r~~s run on a proprietary ~=.~=~~ai~~._s~'°s~:~~~~~., MPE (Multi-Programming Executive); current e3000 ~ ~ ,t_ use MPE/iX. In recent years, customers have demonstrated "a clear preference for solutions based on low-cost, open platforms," according to aquestion-and-answer section at the HP Web site. That preference has meant HP could no longer generate enough profit from the e3000 line to maintain the level of investment needed to keep MPE/iX current, the Web site said. One possible format would be to invite business or economic development people to attend for an hour or two so that we might benefit from their suggestions. We could follow the same format with short meetings with the School Board and the Planning Commission to gather information that will be helpful to us throughout the upcoming year. These meetings could be scheduled during the morning session. Following lunch we could discuss and reach closure on these and other issues the Board member might wish to include.
