Regular meetings are held on the second Tuesday and the fourth Tuesday at 3:00 p.m. Public hearings are held at 7:00 p.m. on the fourth Tuesday of each month. Roanoke County and Shinshiro City share many similarities including geography, quality of life, and the presence of Yokohama Tire Corporation. Our two localities have entered into a business and cultural relationship during the past few years, and we are honored to have Mayor Yamamoto and his delegation with us. No area of health care is changing more than mental health. Advances are prompted by better science and more research, the information revolution, the important role consumers play in advocating for themselves, and family members who speak out for their loved ones; and WHEREAS, treatment works-if a person with a mental illness can get it. Science has greatly expanded our understanding and treatment of severe mental illnesses. Individuals with these disorders have a real chance at reclaiming full and productive lives if they have access to the treatments, services, and programs so vital to recovery; and WHEREAS, research on mental illness is significantly underfunded in relation to its economic and public health impact. Depression, bipolar disorder, schizophrenia, and obsessive-compulsive disorder account for an estimated 20 percent of the world's total disability resulting from all diseases and injuries; and WHEREAS, stigma continues to be the single most significant barrier to people getting the help they need. As underscored by the U.S. Surgeon General David Satcher in his 1999 report on mental health, stigma toward mental illness remains a pervasive and 1 C-~ potentially lethal barrier to mental illness recovery. The most damage was incurred on the following day, October 9, 1871, which is the date most often recognized with the tragic conflagration. The Great Chicago Fire killed more than 250 people, left 100,000 homeless, destroyed more than 17,400 structures and burned more than 2000 acres. In 1920, President Woodrow Wilson issued the first National Fire Prevention Day Proclamation, and since 1922, National Fire Prevention Week has been observed on the Sunday through Saturday period in which October 9 falls. The proclamation will be accepted by Chief Rick Burch and Captain Gary Huffman. Various activities are being planned by individual stations to commemorate Fire Prevention Week. Neighboring localities such as Botetourt County have already been approved for this assistance. We would like to provide this assistance to agricultural farmers in Roanoke County. It allows farmers affected to get low-interest loans and other benefits. BACKGROUND: Roanoke County continues to feel the impacts of groundwater shortages that are the result of a cumulative effect of precipitation deficits since July 1998. On-going drought conditions have continued since September 2001 with additional effects from excessive heat. During recent months the County suffered from a severe lack of precipitation in addition to a series of weeks with temperatures above 90 degrees. Governor Warner visited the County and local producers to see first hand the impacts felt by the current drought. SUMMARY OF INFORMATION: Major Crops impacted by the disaster include: Grass hay and alfalfa, corn utilized for livestock feed, apples, potatoes, numerous vegetable crops, and pasture. Additional losses include timber losses, milk production losses (due to excessive heat), extensive cattle weight gain losses, income loss through early cattle sales, and summer feeding costs averaging $1200 per producer due to lack of pasture forage for animals. Over 500 Roanoke agricultural producers are feeling the drought impacts financially. Many of those producers have reported 40% to 60% losses, which in turn impact their family income and continued farming operations. Staff has submitted to the State and Federal agencies reports indicating the extent of damages being experienced and now offers the attached resolution asking the State and Federal governments to declare Roanoke County as a drought disaster area, thus allowing our farmers to secure financial assistance that may become available. ~~ f FISCAL IMPACT: There will be no County dollars involved in seeking this drought disaster designation. COUNTY ADMINISTRATOR'S COMMENTS: EXECUTIVE SUMMARY: This is the first reading of the proposed ordinance to vacate a 50-foot public right of way, 20-foot drainage easement, 40-foot drainage easement and portions of 15- foot public utility easement (Plat Book 24, Page 35) ,Stonegate -Phase 1. BACKGROUND: By plat of subdivision of February 26, 2001, recorded in the Clerk's Office of the Circuit Court of Roanoke County, Virginia, Plat Book 24, Page 35, Stonegate Properties, LLC, as owner of Stonegate -Phase 1 conveyed to the Board of Supervisors of Roanoke County a 50-foot public right of way, 20-foot drainage easement, 40-foot drainage easement and portions of 15-foot public utility easement situated along Stoneledge Drive. F~ SUMMARY OF INFORMATION: The petitioner, Stonegate Properties, LLC, are the current owners of the properties over which the above described right of way and easements are located, said properties being Lot 60 (Tax Map No. 28.10-2-4), Lot 59 (Tax Map No. 28.10-2-5), Lot 58 (Tax Map No. 28.10-2-6).and Lot 7 (Tax Map No. 28.10-2-7), being situated along Stoneledge Drive. Stonegate Properties, LLC, have requested that the Board of Supervisors vacate the public right of way and easements described above, and as shown on Exhibit "A" attached, in order to allow the resubdivision of the properties. Roanoke County staff has received no objections to this petition and requests that the described public right of way and easements shown on the attached map (Exhibit "A") be vacated. The public right of way to be vacated in accordance with Chapter 22, Title 15.2-2272(2), Code of Virginia 1950, as amended. FISCAL IMPACT: All costs associated with the adoption of this ordinance will be the responsibility of Stonegate Properties, LLC. ALTERNATIVES: 1. The Board of Supervisors approve the first reading of this Ordinance to vacate a 50-foot public right of way, 20-foot drainage easement, 40-foot drainage easement and portions of 15-foot public utility easement, as shown on Attachment A. 2. BE IT ORDAINED By the Board of Supervisors of Roanoke County, Virginia, as follows: § 1. That the Board hereby determines and finds that a state of emergency exists, as proclaimed in the Executive Order of the Governor of this Commonwealth, due to extreme drought conditions in the County, neighboring localities, and throughout the Commonwealth, and that a water supply emergency continues to exist in the County, due to current water levels in the Roanoke River and water levels in the County's Spring Hollow Reservoir and its groundwater wells for its public water system and anticipated demand in the immediate future, which together necessitate the adoption of this Ordinance mandating restrictions on the use of water in the County under the terms and conditions set forth in this Ordinance. § 2. That the Code of the County of Roanoke is hereby amended and reenacted by adding a new Article IV of Chapter 22, entitled "Water Supply Emergencies and Conservation Measures" as follows: ARTICLE IV. WATER SUPPLY EMERGENCIES AND CONSERVATION MEASURES Sec. 22-200. Generally. (a) Purpose. The purpose of this division is to establish water conservation reduction measures to be imposed when drought, water shortage and low flows in the Roanoke River require water conservation measures to be in effect for public water supply use. It shall also apply to water supplied from private groundwater sources and to surface water withdrawals. (b) Exemptions from application. The provisions of this Article shall not apply to any governmental activity, institution, business, residence, or industry when it has been determined by the County Administrator that an exemption is necessary for the public health, safety and welfare, for the 2 prevention of severe economic hardship or the substantial loss of employment, or for the health of any person. Recycled water shall also be exempt from the provisions of this Article. Sec. 22-201. Definitions. As used in this division: (a) "Fountain" shall mean a water display where water is sprayed strictly for ornamental purposes. (b) "Paved areas" shall mean streets, sidewalks, driveways, patios, parking lots, service station aprons, and other surface areas covered with brick, paving, tile, or other material through which water cannot pass. (c) "Swimming pool" shall mean any structure, basin, chamber, or tank, including hot tubs, containing an artificial body of water for swimming, diving or recreational bathing and having a depth of two (2) feet or more at any point. (d) "Person" shall mean any individual, corporation, partnership or other legal entity in the County. (e) "Recycled water" shall mean water originally potable but circulated for reuse after delivery from the public water system. Sec. 22-202. Declaration. The Board shall declare the imposition of either voluntary or mandatory water conservation measures whenever the County is experiencing a water supply emergency or the need to avert a water supply emergency. The need to avert an emergency and to implement voluntary conservation measures shall be deemed to exist whenever the flows in the Roanoke River drop to levels that require the limitation of withdrawals for Spring Hollow Reservoir, the water level in the Reservoir is below normal for that time period, and meteorological projections indicate consideration of such measures. The need to 3 avert an emergency and to impose mandatory water conservation measures shall be deemed to exist when the Reservoir contains less than a 150 days supply at current usage patterns for the period between June 1 and October 1, or a 100 day supply for the period between October 1 and June 1, and very limited supplies of water are available. Notices of the implementation and termination of the water conservation measures shall be publicly announced and published in a daily newspaper for at least one (1) day. The implementation or termination of the measures shall become effective immediately upon publication of the respective notice. Sec. 22-203. Voluntary water conservation measures. When voluntary water conservation measures are in effect, the Board shall request the general public, businesses and public agencies in the county to implement and comply with the following water use reduction measures: (a) Lawns and Gardens. Reduce watering to only when necessary to maintain viability, and then only between the hours of 8:OOp.m. and 8:OOa.m. (b) Paved areas. Reduce washing. Washing paved areas for immediate health and safety is exempted. (c) Swimming pools. Reduce filling and replenishing to levels required to maintain health and safety. (d) Vehicle washing. Reduce non-commercial washing of mobile equipment. Commercial mobile equipment washing businesses are exempt (e) Restaurants. Serve water to customers only upon request. (f) Public Utilities. Reduce scheduled sewer and hydrant flushing by fifty percent (50%). Flushing to meet immediate health and safety requirements is exempt. Sec. 22-204. Mandatory water conservation measures. 4 When mandatory water conservation measures are in effect, the general public, businesses and public agencies shall comply with the following water use restrictions: (a) Fountains. Operation prohibited. (b) Paved areas. Washing prohibited except for immediate health and safety requirements, or except for commercial or industrial operations using high pressure low consumption equipment. Washing for maintenance purposes one time within any twelve (12) month period is permitted. (c) Swimming pools. Prohibit filling of outdoor swimming pools. Replenishing to maintain the structural integrity of the pool or to ensure swimmer health and safety is permitted. (d) Vehicle washing. Prohibit non-commercial washing of automobiles, trucks, trailers, boats, airplanes or any other type of mobile equipment, except in commercial facilities if operating with high pressure low consumption equipment or operating with a water recycling system. The County Administrator may order the curtailment of the hours of operation of such commercial facilities or operations offering such services to the public or washing their own equipment. (e) Restaurants. Serve water to customers only upon request. (f) Public Utilities. Conduct sewer and hydrant flushing only for the purpose of fire suppression or other public emergency. Flushing to meet immediate health and safety requirements is exempt. (g) Lawns and Gardens. Eliminate watering of shrubbery, trees, lawns, grass, plants or other vegetation, ,except indoor plantings, greenhouse or nursery stocks and watering by commercial nurseries of freshly planted plants upon planting and new and replanted or resodded lawns for a period not to exceed thirty (30) days. (h) Eliminate the washing of the exteriors of commercial or industrial buildings, homes or apartments. Washing for maintenance purposes one time within any twelve (12) month period is permitted. 5 (I) Private wells and surface water withdrawals. Eliminate watering of lawns, gardens, shrubbery, trees, grass, plants or other vegetation (except indoor plantings, greenhouse or nursery stocks is permitted), washing of automobiles, trucks, trailers, boats, airplanes or any other type of mobile equipment, or filling of outdoor swimming pools (replenishing to maintain the structural integrity of the pool or to ensure swimmer health and safety is permitted). Watering of freshly planted plants upon planting and new and replanted or resodded lawns for a period not to exceed thirty (30) days, tees and greens on golf courses, athletic fields and facilities, is permitted. Sec. 22-205. Violation; evidentiary presumptions; penalty for violation; appeals. (a) Violation. It shall be a violation of this Article for any person to intentionally, knowingly, recklessly or negligently use, cause the use of or permit the use of water in violation of any of the mandatory provisions of this division. (b) Evidentiary presumptions. For purposes of this Article, in any case where water has been used in a manner contrary to any mandatory provision of this division, it shall be presumed that the person in whose name a water meter connection is registered with the Utility Department has knowingly used, caused the use of or permitted the use of water in such a contrary manner. Proof that a particular premises had a water meter connection is registered in the name of the defendant cited in a criminal complaint filed pursuant to this Article shall constitute in evidence a prima facie presumption that the defendant is the person who used, caused the use of or permitted the use of water in a manner contrary to any mandatory provision of this division. (c) Penalty for violation. Any person convicted of violating any of the provisions of this article shall be guilty of a Class 3 misdemeanor. In lieu of a criminal prosecution for a violation of this article, the County may impose a civil penalty for any violation. For a first offense the person will receive a written warning. On the second offense, the person will be assessed as a civil penalty a water bill surcharge fee of fifty dollars ($50.00) per violation for a residential account and one hundred dollars ($100.00) per violation for aninstitutional/commercial/industrial account. On the third and any 6 subsequent offense, the person will be assessed as a civil penalty a water bill surcharge fee of one hundred dollars ($100.00) per violation for a residential account and two hundred dollars ($200.00) per violation for aninstitutional/commercial/industrial account. In addition, the Utility Department may suspend the service of any person violating any of the mandatory water use restrictions. All fines shall be imposed on the violator's next water bill. (d) Appeals. The person shall have the right to appeal to the County Administrator upon receiving written notice of any violation or intent to discontinue service. That person may then appeal the decision of the County Administrator to the Roanoke County Board of Supervisors. The procedure to be followed in any appeal is the same procedure as set out in Section 18-156.5 of this Code. (e) Each violation by a person shall be counted as a separate violation by that person, irrespective of the location at which the violation occurs. Sec. 22-206. Enforcement. The Chief of Police and the Director of the Utility Department, through their agents or employees, shall be jointly responsible for the administration and enforcement of this ordinance. The Director of the Utility Department is authorized to designate qualified Utility Department personnel to enforce this ordinance in the manner and to the extent allowed by law, including the filing of notices of violations of this Article and the filing of complaints with the Police Department for such violations. § 3. This ordinance shall not apply to that portion of the County served with public water by the Town of Vinton. § 4. This ordinance shall be in full force and effect upon its adoption. § 5. That the provisions of this Ordinance are severable, and the unenforceability of any provision of this Ordinance, as determined by a court of competent jurisdiction, shall not affect the enforceability of any other provision in the Ordinance. 7 On motion of Supervisor Nickens to adopt the ordinance with the following change: under Section 22-204 "Mandatory Water Conservation Measure", Item (g) the wording "golf courses and athletic fields and facilities" shall be deleted, and carried by the following recorded vote: AYES: Supervisors Flora, McNamara, Minnix, Nickens, Church NAYS: None A COPY TESTE: Diane S. Subsequent to the first reading, we have received calls from businesses and private citizens asking how the ordinance will be implemented and enforced. This has given rise fo questions about the way we were approaching water conservation. As it is proposed, we have chosen two levels of enforcement: voluntary and mandatory. We now think it is preferable to add a third level to allow for extreme drought situations. We have left the ordinance as originally submitted to you to give the Board an alternative of adopting the ordinance in That form or allowing us two additional weeks to further refine it. We will then be able to categorize more clearly the restrictions that will be placed on golf courses, farmers, private citizens with their own wells, etc. A case in point is Hanging Rock Golf Course which has its own lake from which the greens are watered. As long as they have sufficient water, it is difficult to prevent them from using it. If the Board concurs, we would ask for additional time to refine the document and allow for meetings with business owners and organizations. Please be assured that we will take every step necessary to safeguard the water supply necessary for our citizens. 4 G •- EXECUTIVE SUMMARY: This is the second reading of a proposed ordinance to declare a water supply emergency and to implement water conservation measures. This ordinance will allow Roanoke County to enforce the Governor's Executive Order. BACKGROUND: On Friday, August 30, 2002, the Governor of the Commonwealth of Virginia issued an Executive Order (Number 33) entitled "Declaration of a State of Emergency Due to Extreme Drought Conditions Throughout the Commonwealth" to alleviate conditions resulting from drought, forest fire or extreme heat, and to implement prevention, response, and recovery operations and activities so as to alleviate impacted areas of the Commonwealth from the effects of these conditions. This Declaration provided, in part, that [I]n order to enforce these restrictions, local governments may establish, collect, and retain fines for violations of these restrictions. Section 15.2-924 of the Code of Virginia (1950), as amended, authorizes the governing body of any locality, when it finds that a water supply emergency exists or is reasonably likely to occur if water conservation measures are not taken, to restrict the use of water for the duration of such emergency or for a period of time necessary to prevent the occurrence of a water supply emergency, by adopting a local ordinance. Flows in the Roanoke River have recently approached historic low levels. Drought conditions exist in the Roanoke Valley. These events necessitate limiting use of this public water source for the protection of the health, safety and general welfare of the citizens of the County. SUMMARY OF INFORMATION: This ordinance establishes a series of voluntary and mandatory water conservation measures. These measures are similar to the ones recommended by staff to the Board at a briefing on August 27, 2002. This ordinance applies to water supplied by the County water system, private water systems, and private wells; it does not apply to that portion of the County served with public water by the Town of Vinton water system. At the first reading of this ordinance held on September 24, 2002, staff made several changes to the draft ordinance in response to comments and questions from the Board. These changes are as shown in the attached ordinance. These changes clarify that the ordinance will apply to surface water withdrawals, and that any determination of a state of emergency would include conditions in neighboring localities, that the mandatory water conservation measures apply to golf courses and athletic fields, and that a person may appeal a violation to the Board of Supervisors. 2 G-~ It provides that any violation is a Class 3 misdemeanor (fine of not more than $500). In the alternative this ordinance establishes a series of civil penalties to be added to a person's water bill for violations of the mandatory provisions. It establishes an appeal procedure to the County Administrator and to the Board. See sections 22-205 and 22-206. The primary enforcement efforts will be done by the Utility Department through warnings and civil penalties applied to water bills. In difficult situations and for private wells the assistance of the Police Department and the threat of a Class 3 misdemeanor may be required. To trigger the mandatory water conservation measures, the Board must make a finding that a water supply emergency exists or is reasonably likely to occur if water conservation measures are not taken, and publish a notice in a newspaper of general circulation within the County. To terminate the mandatory water conservation measures, the Board must take formal action and publish a notice in a newspaper of general circulation within the County. Notice has been published in the Roanoke Times and World News. A copy of this public notice is attached. Sec. 22-204 imposes mandatory water conservation measures. It prohibits water usage as recommended by the Governor, and in some instances, it is more stringent than recommended by the Governor. Sub-section (d) prohibits the washing of vehicles by new or used car dealers, unless they use high pressure low consumption equipment or operate a water recycling system. Sub-section (g) prohibits watering golf courses and athletic fields, unless the grass is new, replanted, or resodded. The ordinance creates an exception to allow water of tees and greens on golf courses and athletic fields if the water comes from a private well or from surface water withdrawal. FISCAL IMPACT: This ordinance may result in an increase in revenues to the Utility Fund as a result of penalties imposed and collected for violations; however, these revenues may be offset by reductions in water usage and the costs of enforcement. RECOMMENDATIONS: Staff recommends that the Board approve the second reading of this ordinance. Upon adoption of this ordinance, the mandatory conservation measures will go into effect on October 9, 2002, and shall remain in effect until ended by the Board of Supervisors. BE IT ORDAINED By the Board of Supervisors of Roanoke County, Virginia, as follows: § 1. That the Board hereby determines and finds that a state of emergency exists, as proclaimed in the Executive Order of the Governor of this Commonwealth, due to extreme drought conditions in the County, neighboring localities, and throughout the Commonwealth, and that a water supply emergency continues to exist in the County, due to current water levels in the Roanoke River and water levels in the County's Spring Hollow Reservoir and its groundwater wells for its public water system and anticipated demand in the immediate future, which together necessitate the adoption of this Ordinance mandating restrictions on the use of water in the County under the terms and conditions set forth in this Ordinance. § 2. That the Code of the County of Roanoke is hereby amended and reenacted by adding a new Article IV of Chapter 22, entitled "Water Supply Emergencies and Conservation Measures" as follows: ARTICLE IV. WATER SUPPLY EMERGENCIES AND CONSERVATION MEASURES Sec. 22-200. Generally. (a) Purpose. The purpose of this division is to establish water conservation reduction measures to be imposed when drought, water shortage and low flows in the Roanoke River require water conservation measures to be in effect for public water supply use. It shall also apply to water supplied from private groundwater sources and to surface water withdrawals. (b) Exemptions from application. The provisions of this Article shall not apply to any governmental activity, institution, business, residence, or industry when it has been determined by the County Administrator that an exemption is necessary for the public health, safety and welfare, for the G:\BOARD\2002\Oct8\Ordinances\10-08-ord-WaterEmergencyConservationOrdinance.doc 2 ~7 prevention of severe economic hardship or the substantial loss of employment, or for the health of any person. Recycled water shall also be exempt from the provisions of this Article. Sec. 22-201. Definitions. As used in this division: (a) "Fountain" shall mean a water display where water is sprayed strictly for ornamental purposes. (b) "Paved areas" shall mean streets, sidewalks, driveways, patios, parking lots, service station aprons, and other surface areas covered with brick, paving, tile, or other material through which water cannot pass. (c) "Swimming pool" shall mean any structure, basin, chamber, or tank, including hot tubs, containing an artificial body of water for swimming, diving or recreational bathing and having a depth of two (2) feet or more at any point. (d) "Person" shall mean any individual, corporation, partnership or other legal entity in the County. (e) "Recycled water" shall mean water originally potable but circulated for reuse after delivery from the public water system. Sec. 22-202. Declaration. The Board shall declare the imposition of either voluntary or mandatory water conservation measures whenever the County is experiencing a water supply emergency or the need to avert a water supply emergency. The need to avert an emergency and to implement voluntary conservation measures shall be deemed to exist whenever the flows in the Roanoke River drop to levels that require the limitation of withdrawals for Spring Hollow Reservoir, the water level in the Reservoir is below normal for that time period, and meteorological projections indicate consideration of such measures. The need to G:\BOARD\2002\Oct8\Ordinances\10-08-ord-WaterEmergencyConservationOrdinance.doc 3 ~~ avert an emergency and to impose mandatory water conservation measures shall be deemed to exist when the Reservoir contains less than a 150 days supply at current usage patterns for the period between June 1 and October 1, or a 100 day supply for the period between October 1 and June 1, and very limited supplies of water are available. Notices of the implementation and termination of the water conservation measures shall be publicly announced and published in a daily newspaper for at least one (1) day. The implementation or termination of the measures shall become effective immediately upon publication of the respective notice. Sec. 22-203. Voluntary water conservation measures. When voluntary water conservation measures are in effect, the Board shall request the general public, businesses and public agencies in the county to implement and comply with the following water use reduction measures: (a) Lawns and Gardens. Reduce watering to only when necessary to maintain viability, and then only between the hours of 8:OOp.m. and 8:OOa.m. (b) Paved areas. Reduce washing. Washing paved areas for immediate health and safety is exempted. (c) Swimming pools. Reduce filling and replenishing to levels required to maintain health and safety. (d) Vehicle washing. Reduce non-commercial washing of mobile equipment. Commercial mobile equipment washing businesses are exempt (e) Restaurants. Serve water to customers only upon request. (fj Public Utilities. Reduce scheduled sewer and hydrant flushing by fifty percent (SO%). Flushing to meet immediate health and safety requirements is exempt. Sec. 22-204. Mandatory water conservation measures. G:\BOARD\2002\Oct8\Ordinances\10-O8-ord-WaterEmergencyConservationOrdinance.doc 4 ~--~ When mandatory water conservation measures are in effect, the general public, businesses and public agencies shall comply with the following water use restrictions: (a) Fountains. Operation prohibited. (b) Paved areas. Washing prohibited except for immediate health and safety requirements, or except for commercial or industrial operations using high pressure low consumption equipment. Washing for maintenance purposes one time within any twelve (12) month period is permitted. (c) Swimming pools. Prohibit filling of outdoor swimming pools. Replenishing to maintain the structural integrity of the pool or to ensure swimmer health and safety is permitted. (d) Vehicle washing. Prohibit non-commercial washing of automobiles, trucks, trailers, boats, airplanes or any other type of mobile equipment, except in commercial facilities if operating with high pressure low consumption equipment or operating with a water recycling system. The County Administrator may order the curtailment of the hours of operation of such commercial facilities or operations offering such services to the public or washing their own equipment. (e) Restaurants. Serve water to customers only upon request. (f) Public Utilities. Conduct sewer and hydrant flushing only for the purpose of fire suppression or other public emergency. Flushing to meet immediate health and safety requirements is exempt. (g) Lawns and Gardens. Eliminate watering of shrubbery, trees, lawns, grass, plants or other vegetation, golf courses and athletic fields and facilities, except indoor plantings, greenhouse or nursery stocks and watering by commercial nurseries of freshly planted plants upon planting and new and replanted or resodded lawns for a period not to exceed thirty (30) days. (h) Eliminate the washing of the exteriors of commercial or industrial buildings, homes or apartments. Washing for maintenance purposes one time within any twelve (12) month period is permitted. Eliminate watering of lawns, gardens, shrubbery, trees, grass, plants or other vegetation (except indoor plantings, greenhouse or nursery stocks is permitted), washing of automobiles, trucks, trailers, boats, airplanes or any other type of mobile equipment, or filling of outdoor swimming pools (replenishing to maintain the structural integrity of the pool or to ensure swimmer health and safety is permitted). Watering of freshly planted plants upon planting and new and replanted or resodded lawns for a period not to exceed thirty (30) days, tees and greens on golf courses, athletic fields and facilities, is permitted. Sec. 22-205. Violation; evidentiary presumptions; penalty for violation; appeals. (a) Violation. It shall be a violation of this Article for any person to intentionally, knowingly, recklessly or negligently use, cause the use of or permit the use of water in violation of any of the mandatory provisions of this division. (b) Evidentiary presumptions. For purposes of this Article, in any case where water has been used in a manner contrary to any mandatory provision of this division, it shall be presumed that the person in whose name a water meter connection is registered with the Utility Department has knowingly used, caused the use of or permitted the use of water in such a contrary manner. Proof that a particular premises had a water meter connection is registered in the name of the defendant cited in a criminal complaint filed pursuant to this Article shall constitute in evidence a prima facie presumption that the defendant is the person who used, caused the use of or permitted the use of water in a manner contrary to any mandatory provision of this division. (c) Penalty for violation. Any person convicted of violating any of the provisions of this article shall be guilty of a Class 3 misdemeanor. In lieu of a criminal prosecution for a violation of this article, the County may impose a civil penalty for any violation. For a first offense the person will receive a written warning. On the second offense, the person will be assessed as a civil penalty a water bill surcharge fee of fifty dollars ($50.00) per violation for a residential account and one hundred dollars ($100.00) per violation for aninstitutional/commercial/industrial account. On the third and any G:\BOARD\2002\Oct8\Ordinances\ 10-OS-ord-WaterEmergencyConservationOrdinance.doc 6 ~- _r subsequent offense, the person will be assessed as a civil penalty a water bill surcharge fee of one hundred dollars ($100.00) per violation for a residential account and two hundred dollars ($200.00) per violation for aninstitutional/commercial/industrial account. In addition, the Utility Department may suspend the service of any person violating any of the mandatory water use restrictions. All fines shall be imposed on the violator's next water bill. (d) Appeals. The person shall have the right to appeal to the County Administrator upon receiving written notice of any violation or intent to discontinue service. That person may then appeal the decision of the County Administrator to the Roanoke County Board of Supervisors. The procedure to be followed in any appeal is the same procedure as set out in Section 18-156.5 of this Code. (e) Each violation by a person shall be counted as a separate violation by that person, irrespective of the location at which the violation occurs. Sec. 22-206. Enforcement. The Chief of Police and the Director of the Utility Department, through their agents or employees, shall be jointly responsible for the administration and enforcement of this ordinance. The Director of the Utility Department is authorized to designate qualified Utility Department personnel to enforce this ordinance in the manner and to the extent allowed by law, including the filing of notices of violations of this, Article and the filing of complaints with the Police Department for such violations. § 3. This ordinance shall not apply to that portion of the County served with public water by the Town of Vinton. § 4. This ordinance shall be in full force and effect upon its adoption. § 5. That the provisions of this Ordinance are severable, and the unenforceability of any provision of this Ordinance, as determined by a court of competent jurisdiction, shall not affect the enforceability of any other provision in the Ordinance. The staff has inspected this road along with representatives of the Virginia Department of Transportation and finds the road is acceptable. FISCAL IMPACT: No county funding is required. RECOMMENDATIONS: The staff recommends that the Board approve a resolution to VDOT requesting that they accept the remaining portion of Carolina Trail into the Secondary Road System. These grants help with capital costs and also provide some of the operating monies for the CORTRAN service for Roanoke County. The grant for FY 2002- 03 include the following items: CAPITAL Two Vans State Amt. - $95,000 Local Amt. - 5.000 Total $100,000 OPERATING Operating monies for CORTRAN in the rural portion of the County State Amt. - $20,719 The local match for these grant programs will be provided by Unified Human Transportation Services, Inc. This is a pass-through grant where Roanoke County is the named agent on behalf of our CORTRAN program. FISCAL IMPACT: The County needs to accept and appropriate the above pass- through grant monies and forward them to Unified Human Transportation Services, Inc. They will be responsible for all administration efforts of this grant. (RADAR) provides the paratransit services of CORTRAN on behalf of Roanoke County. Riders must be 60 years of age or be physically or mentally challenged as per Americans with Disabilities Act (ADA) requirements. The CORTRAN program provides service to qualified County residents during the hours of 7:00 a.m. to 6:00 p.m., Monday through Friday. Reservations are made on a first-come, first- served basis, utilizing any of the vehicles available through the RADAR system. We charge each passenger $3.50 per one-way trip. The new contract with RADAR is based on a $27.00 per hour rate, less fares received. The average one-way trip for County residents takes 45 minutes. By comparison, the hourly rate for last fiscal year was $26.00 per hour. The increase by RADAR is necessary to cover the increased cost of labor, fuel, and insurance. The CORTRAN service provides curb-to-curb service for qualified County residents to any destination within the outer perimeter of Roanoke County (including points inside the Cities of Roanoke and Salem). We are completing the re-enrollment and review of eligibility of the users of the CORTRAN system in an effort to contain costs and prevent abuse. Last fiscal year, CORTRAN riders used 9,059.7 hours of service resulting in 13,585 one-way trips which cost $191,438.20 after deducting the $3.50 fares paid by the riders. $194,462 is included in the FY 2002-03 budget for this program. 1 FISCAL IMPACT: $194,462 is included in the FY 2002-03 budget for the net cost of this program. No new appropriation of monies is requested at this time. Staff feels that the re-enrollment project and monitoring of any abuse of the system will continue to improve the availability of this program to the citizens needing such service. RECOMMENDATIONS: Staff recommends authorizing the County Administrator to sign the renewal contract based on the $27 per hour rate for the FY2002- 03 service period. COUNTY ADMINISTRATOR'S COMMENTS: BACKGROUND:: Roanoke County operates eleven preschool classrooms. Each program provides services for sixteen preschool children. Prior to August 2000, the program only served children with special needs. Currently seven classrooms are integrated serving eight children of normal development funded by the Preschool Initiative Grant. Licensure from the Department of Social Services was obtained in August 2001 to operate the remaining four sites as a State Licensed Preschool Program. These sites accept tuition paying children SUMMARY OF INFORMATION: The Tuition Sites are located at Green Valley Elementary, Bonsack Elementary, Mountain View Elementary, and Back Creek Elementary. We are able to serve up to 8 students at each site. Currently we are serving 16 students. The proceeds from the tuition will be used to expand and enhance our program. FISCAL IMPACT: The tuition received will offset the cost of the program. (CVC) held its regular monthly meeting on September 24, 2002, starting at 12:15 pm, at the headquarters of the Roanoke Valley Resource Authority. Executive Director Ann Masters reported that future competitive grant funds from the state DEQ may be subject to further reductions. She said that generally CVC finances look ok for now. She also stated that the CVC was about to send out its annual fund raising letters, and asked board members to each submit the names of 10 people to whom the letters should be sent. Ms. Masters reminded the members of the River Clean Up Day scheduled for October 5. Bonny Branch, the CVC educator, described plans for this year's Earth Summit (1-day seminar for high school juniors and seniors), which will be held on November 7th at the Higher Education Center, starting at 8:30 am. The main theme will be "H20 and You". The program will include presentations and work shops. Ann Masters distributed a copy of a special logo prepared in recognition of the 25th anniversary of CVC. She reported that the City of Roanoke will hold a Household Hazardous Waste Day at the Civic Center December 7, 2002, from 9 am till 3 pm. This is likely to be the last such day organized as part of the City's settlement over environmental issues. Bonny Branch asked for donations of 2" wide 3-ring binders to hold environmental information to be placed in the library of each school in the service area. The CVC will add special covers to obscure any business names or advertising information on the binders. AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, OCTOBER 8, 2002 RESOLUTION 100802-2 DECLARING A DROUGHT EMERGENCY IN ROANOKE COUNTY, AND REQUESTING DISASTER ASSISTANCE FROM THE COMMONWEALTH OF VIRGINIA AND THE UNITED STATES WHEREAS, over the past several months, Roanoke County has suffered with above normal temperatures and a significant deficit in rainfall creating drought conditions throughout the agricultural areas of the County; and WHEREAS, these drought conditions caused by extreme weather have resulted in serious and irreversible damage to crop production and pasture growth, both of which have been reduced by forty to fifty percent from normal production; and WHEREAS, in recognition of these serious drought conditions and financial losses that are being experienced by local farmers, the County desires and respectfully urges that the appropriate Federal and State agencies declare Roanoke County to be experiencing a drought disaster in order that any available financial assistance be provided to it. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the Board of Supervisors recognizes that a drought disaster exists in Roanoke County and respectfully requests that the appropriate Federal and State agencies recognize these conditions and have the County declared a drought disaster area in order for the County to qualify for all financial assistance which may be available to the local farmers through this or a similar designation; and 2. That the Honorable Mark Warner, Governor of the Commonwealth, is 1 hereby petitioned by Roanoke County to request that the President of the United States or the United States Secretary of Agriculture recognize Roanoke County's emergency situation and make any Federal drought assistance programs available to those who need them in Roanoke County; and 3. That the Clerk is directed to send a copy of this resolution to Governor Warner, Congressmen Goodlatte and Boucher, and Senators Warner and Allen, and the Commissioner of Agriculture. No area of health care is changing more than mental health. Advances are prompted by better science and more research, the information revolution, the important role consumers play in advocating for themselves, and family members who speak out for their loved ones; and WHEREAS, treatment works-if a person with a mental illness can get it. Science has greatly expanded our understanding and treatment of severe mental illnesses. Individuals with these disorders have a real chance at reclaiming full and productive lives if they have access to the treatments, services, and programs so vital to recovery; and WHEREAS, research on mental illness is significantly underfunded in relation to its economic and public health impact. Depression, bipolar disorder, schizophrenia, and obsessive-compulsive disorder account for an estimated 20 percent of the world's total disability resulting from all diseases and injuries; and WHEREAS, stigma continues to be the single most significant barrier to people getting the help they need. As underscored by the U.S. Surgeon General David Satcher in his 1999 report on mental health, stigma toward mental illness remains a pervasive and 1 ..... potentially lethal barrier to mental illness recovery. How much water do we have? This will change over time. Right now the Spring Hollow Reservoir has approximately 61 percent capacity remaining. The current reservoir level is approximately 6 to 8 feet lower than normal for this time of year. The flow in the Roanoke River is presently at very low levels. 2. When do mandatory restrictions start? The county adopted the restrictions issued by the Governor on September 4, 2002. Roanoke County began mandatory restrictions on October 8, 2002. 3. Can I water my lawn and shrubbery? Lawn watering is prohibited except for new lawns and aerated and over-seeded lawns. Lawns that have been aerated or thatched, then seeded, maybe watered daily for up to 30 days. In addition, new shrubbery maybe watered for a period of 30 days. 4. What are the penalties if someone does not follow the restrictions? Current penalties for those properties on the County water system are as follows: First Offense: Written Warning Second Offense: $50 water bill surcharge fee for residential account and $100 water bill surcharge fee for institutional/commercial/industrial account Third Offense and Each Subsequent Offense: $100 surcharge fee per violation for residential accounts and $200 surcharge fee per violation for institutional/commercial /industrial account 5. Can I be fined if I am on a private well? The current fines are as follows: First Offense: Written Warning Second Offense: $50 fine for residential property and $100 fine for institutional/commercial/industrial property Third Offense and Each Subsequent Offense: $100 fine per violation for residential property and $200 per violation for institutional/commercial /industrial property 6. How will you locate violators? The Utility Department will investigate complaints of violations and the Police Department will be monitoring for violations. 7. If I am on a private well do I have to follow the water restrictions? Yes -This includes elimination of watering of lawns, gardens, shrubbery, trees, grass, plants or other vegetation; washing of automobiles, trucks, trailers, boats, airplanes or any type of mobile equipment and filling of outdoor swimming pools. Watering of freshly planted plants and replanted or resodded lawns for a period not to exceed thirty (30) days is permitted. Watering of golf course tees and greens, athletic fields and facilities is permitted from private wells or surface water withdrawals. 8. Can I use a lake or pond for watering? A lake or pond is treated the same as a private well in No. 7 above. 9. Can we water new sod? If it is a new lawn it maybe watered daily for up to 30 days. 10. Can nurseries water everyday as needed? Nurseries can water plants, shrubs and trees like anyone else. Like everyone else, they also cannot water their lawn except in accordance wifh these restrictions. 11. Can restaurants wash their parking lots and sidewalks? Only if necessary to address health or safety concerns. 12. Can paving contractors wash down their finalized projects, which were recently constructed? No. Paved areas may not be cleaned for cosmefic purposes and is prohibited except for health and safety requirements. 13. If I own a house power washing company, will the restrictions affect me in any way? Washing of pavement is prohibited except for cone-time power washing in a twelve (12) month period for maintenance purposes or to address health and safety concerns. Aone-time power washing of the exteriors of commercial or industrial buildings, homes or apartments houses for maintenance purposes is permitted wifhin any twelve (12) month period. 14. Can a charitable organization such as a church youth group or recreation league team conduct a car wash under mandatory restrictions? No 15. Where does Roanoke County get its water? Water from the Roanoke River is pumped into the Spring Hollow Reservoir. In addition, approximately 2 million gallons a day are provided from groundwater wells and a small amount of treated water from Carvins Cove. 16. Can a new pool or repaired pool that is empty be filled? Per the Governor's office: "New or repaired swimming pools may be filled as needed to maintain structural integrity of the pool, and indoor pools maybe filled as necessary to ensure swimmer health and safety." 17. Why do schools continue to water their fields? Athletic fields are not covered under the Governor's restrictions. This allows athletic fields and facilities to be watered from private wells and untreated surface wafer sources. County water restrictions apply if athletic fields are watered from the County water system. 18. Why is the Utility Department allowed to flush fire hydrants resulting in thousands of gallons of water being run on the ground and being wasted? The Utility Department is making a concerted effort to reduce the amount of flushing from fire hydrants. However, due to the nature of public water supplies, some lines have dead ends and in order to maintain safe water quality, flushing is necessary. 19. Can I fill my decorative water garden? Yes -Decorative water gardens, which contain fish or water plants, maybe filled. However, operation of fountains, which spray water for ornamental purposes, is prohibited. 20. How are golf courses affected? Golf courses can only water greens and tees from groundwater wells or untreated sun`ace water sources. 21. When do the mandatory restrictions expire? The Governor's restrictions expire June 30, 2003. Roanoke County's restrictions remain in effect until removed by the Roanoke County Board of Supervisors. 22. Why should private wells and surface use water be regulated? Per the Governor's office webpage: (www.naturalresources.state.va.us/drought/waterRestrictionsFAQ.cfm) "Groundwater is not inexhaustible. The State is responsible for both surface waters and ground waters in the Commonwealth and the Commonwealth has a responsibility to manage these resources for the benefit of all citizens. From a practical standpoint, withdrawals from one private well may impact another user of a different private well. In addition, private wells are failing at an alarming rate throughout the state.
