MEETINGS HAVE BEEN HELD WITH THE BUSINESS COMMUNITY, VIRGINIA TECH, AND 17 LOCALITIES THROUGHOUT VIRGINIA AND PARTS OF WEST VIRGINIA. A BUSINESS ADVISORY GROUP HAS BEEN FORMED, AND A PROGRAM WILL SOON BE LAUNCHED THAT WILL ALLOW BUSINESSES TO RESERVE SEATING AT LOWER AIR FARES. THE AGREEMENT STILL NEEDS TO BE FINALIZED -THE STATE GRANT TOTALED $25,000, ROANOKE CITY IS FUNDING $22,500 AND ROANOKE COUNTY $12,500. 4 R-011403-8 HOM MOTION TO ADOPT CONSENT RESOLUTION URC 1. REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Flora: (1) He requested that staff approach VDOT with a request to lower the speed limit on Route 221. The current speed limit is 45 mph. (2) He expressed appreciation on behalf of the schools to the police department for their assistance in patrolling the school zones. Supervisor Church: (1) He extended his condolences to the family of Tor Thepsimuang, a Roanoke County employee who was killed in an automobile accident this week. (2) He extended his appreciation to Billy Driver, Arnold Coven, George Simpson, and Ray Lavinder for their efficient handling of his requests for assistance on behalf of citizens. Supervisor McNamara: (1) He requested that Mr. Hodge draft a letter to VDOT regarding the speed limit on Route 221, particularly in light of the recent traffic fatality at the intersection of Route 221 and Pleasant Hill. (2) He asked citizens to please drive safely in lictht on the recent traffic fatalities. (3) He thanked the Board for allowing him the opportunity to serve as Chairman, and extended his appreciation to the residents of the Windsor Hills district for supporting him as their representative. O. WORK SESSIONS (4th Floor Conference Room) 1. Work session to discuss the impact of development on water and sewer lines and County roads. (Gary Robertson, Director of Utility; Arnold Covey, Director of Community Development) TIME: 4:21 P.M. UNTIL 4:50 P.M. PRESENTED BY: GARY ROBERTSON, UTILITY DIRECTOR; ARNOLD COVEY, DIRECTOR OF COMMUNITY DEVELOPMENT DISCUSSION FOCUSED ON THE GROWTH IN RESIDENTIAL DEVELOPMENT AND THE IMPACT THIS IS HAVING ON WATER AND SEWER AND COUNTY ROADS. IT WAS NOTED THAT THE ORIGINAL INTENT OF THE OFFSITE FACILITIES FEES POLICY, ADOPTED IN 1997, WAS THAT WHEN DEVELOPMENT OCCURRED IT COULD DO SO WITH PUBLIC WATER AND SEWER TO AVOID THE USE OF PRIVATE WELLS. THERE WAS DISCUSSION CONCERNING ZONING ISSUES AND THE USE OF PUMP STATIONS VS. GRAVITY LINES. IT WAS THE CONSENSUS OF THE BOARD THAT: (1) GARY ROBERTSON WILL DEVELOP PROPOSED REVISIONS TO THE OFFSITE FACILITIES FEES. (2) ARNOLD COVEY WILL REVIEW THE LEGISLATION PENDING IN THE GENERAL ASSEMBLY, AS REFERENCED BY RCF, THAT WOULD GIVE COUNTIES THE AUTHORITY TO STOP DEVELOPMENT IN AREAS WHERE WATER AND SEWER, SCHOOLS, ETC. WOULD BE NEGATIVELY AFFECTED. Work session to review response from Whitt Clement regarding proposed construction schedule for I-73. TIME: 4:50 P.M. UNTIL 5:05 P.M. IT WAS THE CONSENSUS OF THE BOARD THAT I-73 IS IMPORTANT TO THE REGION. SUPERVISOR MINNIX REPORTED THAT A BILL IS PENDING IN THE GENERAL ASSEMBLY THAT WOULD COMPENSATE HOMEOWNERS ALONG THE PROPOSED I-73 ROUTE IMMEDIATELY. IT WAS THE CONSENSUS OF THE BOARD TO POSTPONE ACTION UNTIL THE ENVIRONMENTAL IMPACT STUDY IS COMPLETED AND THE GENERAL ASSEMBLY DETERMINES WHETHER TO ADOPT THE PENDING LEGISLATION. Work session to discuss Fire & Rescue staffing allocation and response overview for 2002. (Richard Burch, Fire and Rescue Chief) TIME: 5:06 P.M. UNTIL 6:09 P.M. PRESENTED BY: RICK BURCH, FIRE & RESCUE CHIEF CHIEF BURCH REVIEWED THE STAFFING ALLOCATIONS AND RESPONSE TIMES FOR ALL STATIONS IN THE COUNTY. THERE WAS DISCUSSION CONCERNING A PROPOSED NEW STATION IN THE HANGING ROCK AREA, AS WELL AS STAFFING CONCERNS AT THE CATAWBA AND HOLLINS STATIONS. JACK WARD, CATAWBA HOSPITAL, WAS PRESENT AND A POSSIBLE PARTNERSHIP WITH CATAWBA HOSPITAL WAS DISCUSSED. ANNIE KROCHALIS AND GLEN BRANSCOM SPOKE IN FAVOR OF STAFFING THE CATAWBA STATION. JBC REQUESTED THAT THE BOARD APPROVE FUNDING FOR STAFFING AT THE CATAWBA STATION. ECH IS TO PROVIDE AN OVERVIEW OF COSTS TO PROVIDE THE NECESSARY STAFFING AT THE HOLLINS AND CATAWBA STATIONS. IN ADDITION, STAFF WILL CONTINUE TO PURSUE A PARTNERSHIP WITH CATAWBA HOSPITAL. HOM LEFT THE MEETING AT 6:09 P.M. PRESENTED BY: DAN O'DONNELL, ASSISTANT COUNTY ADMINISTRATOR DOD PRESENTED AN OVERVIEW OF THIS FEDERAL LEGISLATION DESIGNED TO PROTECT THE PRIVACY OF PERSONAL HEALTH INFORMATION. HIPAA REGULATIONS APPLY TO SELF-FUNDED HEALTH INSURANCE PROGRAMS SUCH AS HEALTH AND DENTAL INSURANCE, EMPLOYEE ASSISTANCE PROGRAM, AND FLEXIBLE BENEFITS PROGRAM. OTHER AREAS POSSIBLY AFFECTED INCLUDE AMBULANCE BILLING, CPMT, AND THE JAIL. COMPLIANCE IS MANDATED BY APRIL 14, 2003, WITH ADDITIONAL ELECTRONIC REGULATIONS TO BE IMPLEMENTED IN OCTOBER 2003. 5. Work session with Treasurer and Commissioner of the Revenue to discuss pending House Joint Resolution 701. (Fred Anderson, Treasurer; Nancy Horn, Commissioner of the Revenue) TIME: 6:27 P.M. UNTIL 6:32 P.M. MR. ANDERSON REPORTED THAT PENDING HOUSE JOINT RESOLUTION 701 WOULD AMEND THE CONSTITUTION OF VIRGINIA TO ABOLISH THE OFFICES OF THE TREASURER AND THE COMMISSIONER OF THE REVENUE. THIS LEGISLATION, IF ADOPTED, WOULD RESULT IN A LOSS OF REVENUE TO THE COUNTY OF $500,000 PER YEAR AND A COST SAVINGS TO THE STATE OF VIRGINIA OF $35 MILLION PER YEAR. HE VOICED HIS OPPOSITION TO THIS LEGISLATION, AND ASKED THAT THE BOARD CONTACT AREA LEGISLATORS TO EXPRESS THEIR OPPOSITION. IF ENACTED, THE LEGISLATION WOULD STATE THAT INDIVIDUALS ELECTED IN 2003 WOULD BE ALLOWED TO SERVE THEIR FULL TERM (UNTIL 2007). MR. ANDERSON AND MS. HORN ARE BOTH UP FOR ELECTION IN 2003. P. Hodge County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: Dr. AI Durham, a Roanoke orthopedic surgeon, has donated the first conservation easement on Read Mountain. The Western Virginia Land Trust will hold the easement on 89.1 acres on the upper eastern slope overlooking downtown Roanoke and I-581. Durham will receive substantial state tax credits and retain ownership of the land. The easement prohibits the subdivision or logging of the land. Dr. Durham has expressed interest in donating the land for public recreation and the easement terms leave open this option. Conservation easements are voluntary agreements between a private landowner and a conservation organization such as the Western Virginia Land Trust. The grassroots organization, Read Mountain Alliance was instrumental in facilitating this easement and has as its goal the preservation of all the property at the top of the mountain. S. k cooperatively in When completed, the plan will be brought back to the governing bodies of the four participating localities for approval. SUMMARY OF INFORMATION: The Roanoke Valley Area Metropolitan Planning Organization (MPO) approved an Early Action Compact to address the problem of ozone non-attainment for the Roanoke Valley. Mr. McNamara endorsed this Early Action Compact on December 16, 2002, as Roanoke County's representative on the MPO. This Compact includes the cities of Roanoke and Salem, the counties of Roanoke and Botetourt, the Town of Vinton, the Virginia Department of Environmental Quality, and the U.S. Environmental Protection Agency. This Compact allows the local governments in the Roanoke Valley additional time to work cooperatively and to prepare a plan for ozone reduction. Reducing ozone levels may allow the Roanoke Valley to avoid being designated as anon-attainment area under the Clean Air Act. The Compact is the first step under EPA's approved Early Action Program. The Early Action Program allows local governments the flexibilityto develop appropriate measures to reduce ozone levels. Reducing ozone levels will improve the health of all the citizens in the Roanoke Valley, and in particular the elderly and those with respiratory problems. This program has very strict time lines for the development of a plan to reduce ozone levels by 2007. Failure to participate in this program could result in EPA declaring the Roanoke Valley a non-attainment area which would negatively affect future transportation improvements and industrial development efforts. FISCAL IMPACT: The Roanoke Valley-Allegheny Regional Commission working through the MPO will coordinate this planning process. No funding is required for the development of the Plan. The Commission will allocate funds to hire a consultant to assist in this planning process. STAFF RECOMMENDATION: It is recommended that the Board ratify and confirm the execution of the Early Action Compact on behalf of Roanoke County. Hodge County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: In December 2001, the Board approved a pilot program encouraging recycling with non- profit agencies and authorized a contract with the Rescue Mission of the Roanoke Valley. The Rescue Mission picks up materials from County residents and recycles the majority of those goods, either through resale at its store, use by its clients, or through recycling markets. The remainder of the material is taken by the Rescue Mission to the Roanoke Valley Resource Authority where it is disposed of at the County's tipping rate. The Resource Authority bills Roanoke County, and the County then bills the Rescue Mission. The program has worked well, and the County and the Rescue Mission recently extended the agreement. Goodwill Industries of the Valleys has approached the County with a request to participate in this program. Goodwill meets the criteria set forth in the policy (attached), and has signed the agreement. FISCAL IMPACT: There is no direct fiscal impact with this program, although staff time is involved in billing the agencies and posting the payments. The program does support recycling efforts, which will extend the life of the regional landfill. _.~ STAFF RECOMMENDATION: Staff recommends that the Board of Supervisors approve Goodwill Industries of the Valleys for inclusion in this program. Mahoney, County Attorney ~ 4 ~' Policy for Reducing Tipping Fee at Landfill for Recycling Activities The City of Roanoke, the County of Roanoke and the Town of Vinton jointly oversee and fund the Roanoke Valley Resource Authority (RVRA). These local governments are committed to encouraging recycling in the community, recognizing that reducing the waste stream is important to the environmental future of the Roanoke Valley. Certain non-profit entities in the Valley provide recycling services to the community through the acceptance of donations of used clothing, furniture and other items, which are then either reused or sent out of the area for recycling. Anything left is then disposed of through the Resource Authority, at the regular commercial rate. Based on the service which is provided through these recycling efforts, the members of RVRA have authorized the Authority to bill qualifying non-profit entities at the local government tipping fee rate. Those organizations wishing to qualify for this rate must present to the Resource Authority the following information: • Amount of tonnage picked up annually in the Roanoke Valley • Amount of tonnage disposed of through the Resource Authority • Description of recycling activities, including methodology and percentage removed from waste stream. The appointments which are specific to the Chairman and Vice Chairman are indicated on the attachment. The Board may make any desired modifications to the appointments. Many of the appointments are for specified terms and, whenever possible, changes to these appointments should be made at the expiration of the term. Below is listed information regarding several of the committees: • Liaisons to the Virginia Association of Counties (VACo): In 1994, VACo requested that a member of the governing body be appointed to interact directly with VACo regarding legislative matters. At a 1994 meeting, the Board recommended that the Vice Chairman of the Board of Supervisors serve in this capacity. Any Board member is, however, eligible for appointment. In 1992, VACo requested that a member of the governing body be appointed to work directly with the regional representative on the VACo Board of Directors. The Chairman has served in this capacity for several years, but any Board member may be appointed. • Roanoke Valley Economic Development Partnership The Chairman of the Board of Supervisors serves on this organization. Accordingly, Chairman McNamara should be appointed to this position. • Roanoke County Cable Television Committee The Board member appointed to serve on the Roanoke Valley Cable Television Committee is automatically appointed to serve on the Roanoke County Cable Television Committee. Membership of these two committees is the same except the Roanoke County Cable TV Committee also includes the Supervisor representing the Catawba Magisterial District, the primary area served by Adelphia Cable TV. • Total Action Against Poverty Board of Directors The TAP Board of Directors By-Laws requires that an elected official serve on the TAP Board. For many years, former Clerk of Circuit Court Elizabeth Stokes was appointed. When Ms. Stokes retired from her elected position, former Supervisor Bob Johnson was appointed but asked Ms. Stokes to remain as the designee on behalf of the Board of Supervisors. Since that time, Ms. Stokes has continued to serve as the designee of Supervisor Richard Flora. The Board may choose to appoint a Supervisor to play an active role on the TAP Board of Directors or continue with the custom of appointing a Supervisor who is willing to have Ms. Stokes continue, if she desires, to serve as the Board=s designee. Hodge ~~ ~~~ County Administrator COUNTY ADMINISTRATOR'S COMMENTS: ~~,p a~ SUMMARY OF INFORMATION: Roanoke Catholic School has never owned their own athletic fields and has used a variety of fields to meet their sports needs. As their athletic programs have grown, they have developed a strong desire to acquire quality-playing facilities to create a "home field complex" for all their outdoor sports teams. Unfortunately their existing campus, located adjacent to downtown Roanoke, does not have enough developable space to meet their current or future field needs. In May 2002 a representative of Roanoke Catholic School contacted Roanoke County Parks and Recreation to see if there was a park site (convenient to their campus), as well as interest in a potential partnership, to improve and/or develop facilities in return for long- term use by Roanoke Catholic. Specifically they requested a game and practice soccer field, a game and practice football field, one 300' baseball field, and a softball field. In addition to fields, there was also a need to develop support facilities including a restroom/concession stand, expanded parking, and the lighting of the football/baseball field as well as other support amenities. G- ~ After conferring with County Administration, staff recommended Vinyard Park as a potential site. Vinyard Park was identified for numerous reasons: • The proposed development plan matches the identified needs of the Vinton Booster Club and has the strong support of the Vinton Booster Club. • It is located 3.2 miles from the Roanoke Catholic campus. • The majority of times of use required by Roanoke Catholic (Monday-Friday from 3:30 to 5:30 p.m.) are times that are not used by the Booster Club and are readily available. • It has enough fields and/or land to accommodate the majority of Roanoke Catholic's needs. • Required capital improvement costs fit within the available budget of Roanoke Catholic. It is important to note that the Vinton Booster Club, working in conjunction with Roanoke County, had identified Vinyard Park for development as a premier sports complex. The existing park master plan was recently updated to include a 300' baseball field, restroom and concession building, lighted football game field, batting cages, trails, etc. Recognizing that this potential partnership would generate interest and require cooperation within the community, staff met with members of the Vinton Booster Club to determine their level of interest. As the major user of these fields, the Booster Club's support was essential prior to seriously considering a partnership of this nature. Staff met with members of the Vinton Booster Club Board of Directors, as well as Vinton's representatives to the Parks and Recreation Advisory Commission. After receiving positive feedback from all parties, staff scheduled a joint meeting between Roanoke Catholic school administrators and coaches and the Vinton Booster Club Board. It was a very positive meeting with the Vinton Booster Club Board strongly supporting the development of a partnership with Roanoke Catholic School. To ensure the success of the partnership, it was decided to create a Field Use Committee comprised of members of the Vinton Booster Club, Roanoke Catholic School, and Roanoke County Parks, Recreation, and Tourism. The committee is responsible for managing field use issues and coordinating schedules to ensure the smooth operation of all programs. More importantly, the committee will maintain quality playing fields for all parties. The proposed improvements are estimated to cost $328,500. As part of the lease agreement, Roanoke County and Roanoke Catholic will share development responsibilities as follows: Roanoke County: • Expansion of the existing 200' field to a 300' field • Addition of portable fencing for the baseball and softball fields • Addition of bleachers to the football field G~ • Purchase and installation of goal posts • Landscaping These improvements have an estimated value of $65,000 which will be funded from the initial payment of $80,000 when the lease is executed. Roanoke Catholic: • Installation of lights on the joint football/baseball field • Expansion of parking and trails • Construction of a restroom/concession stand • Installation of football and baseball scoreboards • Construction of dugouts and bleacher pads at the baseball field These improvements have a combined value of $198,500 which will be paid to the contractor of Roanoke Catholic's choice. All improvements shall be pre-approved by Roanoke County and built to Roanoke County standards. In addition to capital improvements, Roanoke County Parks, Recreation and Tourism will receive a total of $65,000 for short and long-term maintenance and small improvements. These payments will be spread over six years, with $15,000 received when the lease is executed and $10,000 per year for the next five years. The length of the agreement is 15 years with an additional 5-year renewal subject to approval by the County. Following the 5-year renewal period, use will be on a year-to-year basis. Any extension beyond the initial 15 year lease will require Roanoke Catholic to pay yearly rental fees based on the existing field rental rates, less 25%. Included in the agreement is a buyout clause that stipulates that if Roanoke County wishes to cancel this agreement within the 15-year period, the County shall give two years notice plus pay the value of the depreciated improvements. Overall, staff feels this is an excellent opportunity for both Roanoke County citizens and Roanoke Catholic School and recommends the Board support the proposal. FISCAL IMPACT: The value of this agreement is $328,500. The lease has provided for additional and routine day to day maintenance costs ($65,000), as well as providing for small capital maintenance improvements. It allows Roanoke County to develop planned additional park facilities, which are part of the long-range master plan, at no cost to the general fund. ALTERNATIVES: Alternative 1. AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, JANUARY 14, 2003 ORDINANCE 011403-7 AUTHORIZING THE CREATION OF AND FINANCING FOR A LOCAL PUBLIC WORKS IMPROVEMENT PROJECT IN THE CLEARBROOK AREA -AMANDA LANE WATER LINE EXTENSION PROJECT WHEREAS, Ordinance 112288-7 authorizes the financing of local public works improvements and the imposition of special assessments upon abutting property owners upon the adoption of an appropriate ordinance by the Board of Supervisors; and WHEREAS, the County Administration has negotiated the extension of the public water system to Amanda Lane in the Clearbrook community; and WHEREAS, the extension of the public water system and the creation of a special utility (water) service area will alleviate a critical public health and safety problem; and WHEREAS, several of the residents have requested that the County allow them to pay their portion of the costs of connection to the public water system over ten years at an interest rate of 8%; and WHEREAS, the first reading of this Ordinance was held on December 17, 2002, and the second reading was held January 14, 2002; and BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That pursuant to the authority of Ordinance 112288-7, the Board authorizes and approves a local public works improvement project, namely, public water 1 extension to Amanda Lane in the Clearbrook community. The total construction cost of this public water project is estimated to be $56,705.00, to be initially financed as follows: Citizen Participation (6 at $5,155.00) $30,930 each) Advance from the Public Works $25,775 Participation Fund TOTAL $56,705 That there is hereby appropriated for this project the sum of $25,755 from the Public Works Participation Fund. Any citizen participation under paragraph 3 will be advanced as a loan from the Water Fund. 2. That the "Project Service Area" is shown and designated on the attached plat entitled "Clearbrook Area -Amanda Lane Water Line Extension Project" prepared by the Roanoke County Utility Department, dated 12/17/02. The Project Area is created for a period of ten (10) years. Any owner of real estate within this service area may participate in and benefit from the public water extension to this service area by paying at a minimum the sum of $6,500 ($5,155 toward construction costs plus, plus $1,345 toward the off-site facility fee) said costs to be paid in full and in advance of connection to the public water extension. 3. That the Board authorizes and approves the payment by the property owners in the project service area who elect to participate on or before March 15, 2003, of their portion of the cost of extending the public water system to their properties in accordance with the following terms and conditions: 2 (a) The total amount per property owner/residential connection may be financed for 10 years at an interest rate of 8% per annum. Down payment of $1,345.00 will be applied to the off-site facility fee. (b) Property owners agree to execute a promissory note or such other instrument as the County may require to secure this installment debt. (c) Property owners further agree to execute such lien document or instrument as may be required by the County; said lien document or instrument to be recorded in the Office of the Clerk of the Circuit Court of Roanoke County. This lien instrument or document shall secure the repayment of the promissory note by the property owners to the County and shall be a lien against the property of the owners. Property owners also agree to pay the County any Clerk's fees or recordation costs which may be required to record any lien instrument or documents in the Office of the Clerk of the Circuit Court. (d) Property owners who wish to participate after the March 15, 2003, deadline (other than new property owners) shall pay a minimum of $9,134 [$5,155 construction costs plus 25% (plus $30 x length of road frontage in excess of 250 feet) plus the off-site facility fee in effect at that time (currently $2,690)]. New property owners (defined as persons who acquire ownership of real estate within the Project Service Area after the date of the adoption of this Ordinance) shall have ninety (90) days from the date of their acquisition of the real estate to participate in and benefit from the public water/sewer extension to this service area by the payment of $6,500, said costs to be paid in full and in advance of connection to the 3 public water/sewer extension. New property owners are not eligible to participate in the installment financing payment method described above in paragraph 3. 4. That the payment by citizens in the project service area, in excess of those anticipated in this ordinance, who elect to participate shall be made to the various funds as follows: The off-site facility fee shall be returned to the Water Fund, and payment of the construction costs shall be returned to the Public Works Participation Fund until such time as the advance has been repaid; any further payment of construction costs shall be returned to the Water Fund. 5. That the County Administrator is authorized to take such actions and execute such documents as may be necessary to accomplish the purposes of this transaction, all upon form approved by the County Attorney. Hodge L~C~ ~~~~ County Administrator COUNTY ADMINISTRATOR'S COMMENTS: BACKGROUND: At the request of several property owners on Amanda Lane located in the Clearbrook Community of the Cave Spring magisterial district, Utility Department staff performed a preliminary engineering study to evaluate the feasibility of constructing a water line extension along Amanda Lane. These property owners have experienced problems with water quantity and/or quality of their private wells. A letter dated October 31, 2002 was sent to 14 property owners on Amanda Lane. From this mailing, Utility Department staff received seven responses (6 in favor and 1 not interested). Based on this response and the location of interested property owners, a proposed service area, which can serve 11 properties, has been established as shown on the attached location map noted as Attachment "A." The first reading was held on December 17, 2002. SUMMARY OF INFORMATION: Providing public water to the interested property owners would require construction of a 1,600 feet water line extension at an estimated cost of $56,705. This construction cost includes installation of water laterals up to the property line and meter boxes, which would serve all properties in the service area. G-a The attached ordinance establishes a special water service area for the project with each participating property owner paying their share of the cost through a special connection fee of $6,500. This connection fee includes the fair share of the construction cost ($5,155.00) required to extend the public water system to serve the 11 properties within the proposed service area plus $1,345.00, which represents 50 percent of the off-site water facility fee of $2,690. The ordinance also establishes a method of financing up to $5,155 for the initial participating property owners. The proposed connection fee of $6,500 would be applicable only if property owners financially commit to participate in the proposed project within 60 days of enactment of the ordinance. ALTERNATIVES: Alternative 1: Establish a special water service area along Amanda Lane, which could potentially serve 11 properties, as indicated on the attached sketch. Approve construction of an 8-inch diameter water line extension as shown on attached sketch. The estimated cost to construct this alternative is $56,705. For those property owners, who choose to not connect during the initial sign-up period, the construction cost would have a one time 25 percent increase (based on 5% annual increase for five years). Under this alternative, the total cost for initial participants would be $6,500 with later participants paying $9,134 (based on the present off-site facility fee of $2,690). Altemative 2: Do not approve request for extension of public water service to the proposed service area along Amanda Lane. FISCAL IMPACT: If Alternative 1 is selected, the total construction cost would be $56,705. The six (6) interested property owners would contribute $30,930. A transfer from the Public Works Participation Fund would fund the remaining $25,775. That pursuant to the authority of Ordinance 112288-7, the Board authorizes and approves a local public works improvement project, namely, public water 1 G- a, extension to Amanda Lane in the Clearbrook community. That the "Project Service Area" is shown and designated on the attached plat entitled "Clearbrook Area -Amanda Lane Water Line Extension Project" prepared by the Roanoke County Utility Department, dated 12/17/02. The Project Area is created for a period of ten (10) years. Any owner of real estate within this service area may participate in and benefit from the public water extension to this service area by paying at a minimum the sum of $6,500 ($5,155 toward construction costs plus, plus $1,345 toward the off-site facility fee) said costs to be paid in full and in advance of connection to the public water extension. 3. That the Board authorizes and approves the payment by the property owners in the project service area who elect to participate on or before March 15, 2003, of their portion of the cost of extending the public water system to their properties in accordance with the following terms and conditions: 2 ~` (a) The total amount per property owner/residential connection may be financed for 10 years at an interest rate of 8% per annum. Down payment of $1,345.00 will be applied to the off-site facility fee. (b) Property owners agree to execute a promissory note or such other instrument as the County may require to secure this installment debt. (c) Property owners further agree to execute such lien document or instrument as may be required by the County; said lien document or instrument to be recorded in the Office of the Clerk of the Circuit Court of Roanoke County. This lien instrument or document shall secure the repayment of the promissory note by the property owners to the County and shall be a lien against the property of the owners. Property owners also agree to pay the County any Clerk's fees or recordation costs which may be required to record any lien instrument or documents in the Office of the Clerk of the Circuit Court. (d) Property owners who wish to participate after the March 15, 2003, deadline (other than new property owners) shall pay a minimum of $9,134 [$5,155 construction costs plus 25% (plus $30 x length of road frontage in excess of 250 feet) plus the off-site facility fee in effect at that time (currently $2,690)]. New property owners (defined as persons who acquire ownership of real estate within the Project Service Area after the date of the adoption of this Ordinance) shall have ninety (90) days from the date of their acquisition of the real estate to participate in and benefit from the public water/sewer extension to this service area by the payment of $6,500, said costs to be paid in full and in advance of connection to the 3 ~~~ public water/sewer extension. New property owners are not eligible to participate in the installment financing payment method described above in paragraph 3. 4. That the payment by citizens in the project service area, in excess of those anticipated in this ordinance, who elect to participate shall be made to the various funds as follows: The off-site facility fee shall be returned to the Water Fund, and payment of the construction costs shall be returned to the Public Works Participation Fund until such time as the advance has been repaid; any further payment of construction costs shall be returned to the Water Fund. 5. Staff has inspected this road along with representatives from the Virginia Department of Transportation (VDOT) and finds the roads acceptable. FISCAL IMPACT: No County funding is required. THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, IN REGULAR MEETING HELD ON JANUARY 14, 2003, ADOPTED THE FOLLOWING: RESOLUTION REQUESTING ACCEPTANCE OF BEAR CREEK DRIVE AND TWIN CREEK CIRCLE INTO THE VIRGINIA DEPARTMENT OF TRANSPORTATION SECONDARY SYSTEM WHEREAS, the street described on the attached Addition Form SR-5(A), fully incorporated herein by reference are shown on plats recorded in the Clerk's Office of the Circuit Court of Roanoke County, and WHEREAS, the Resident Engineer for the Virginia Department of Transportation has advised this Board the streets meet the requirements established by the Subdivision Street Requirements of the Virginia Department of Transportation, WHEREAS, the County and the Virginia Department of Transportation have entered into an agreement on March 9, 1999 for comprehensive stormwater detention which applies to this request for addition, NOW, THEREFORE, BE IT RESOLVED, this Board requests the Virginia Department of Transportation to add the streets described on the attached Additions Form SR-5(A) to the secondary system of state highways, pursuant to §33.1-229, Code of Virginia, and the Department's Subdivision Street Requirements, and BE IT FURTHER RESOLVED, this Board guarantees a clear and unrestricted right-of-way, as described, and any necessary easements for cuts, fills and drainage, and BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to the resident Engineer for the Virginia Department of Transportation. In April 2002, Mr. Barry Duval, of Kaufman & Canoles Consulting (KKC), was hired by the City of Roanoke to assist in establishing the RRAA, and to recruit other localities and businesses to join the RRAA. The contract with KKC totals $61,200. This contract is for a twelve month period beginning April 1, 2002. The group was able to get a $25,000 grant from the Regional Competitiveness Program. Roanoke City agreed to pay $22,500 and Roanoke County agreed to pay up to $12,500. At this time, staff would request that $12,500 be appropriated from the Board contingency to pay for the County portion of this contract. FISCAL IMPACT: The County portion of the contract with KKC is a maximum of $12,500. The amount can be appropriated from the Board contingency. STAFF RECOMMENDATION: Staff recommends appropriating $12,500 from the Board contingency to be paid to the City of Roanoke for reimbursement of the County share of the contract with KKC. On December 19, 2002, the School Board adopted a tentative budget calendar. As part of their budget calendar they would like to have a joint work session with the Board of Supervisors on March 11, 2003. This is a regularly scheduled meeting of the Board of Supervisors. These amendments are in addition to executive reductions of $857.7 million that were implemented in October, 2002. At a work session in December, staff briefed the Board on the impact of the reductions to the County and the estimated revenue loss totaled $227,000. At this time, it is difficult to estimate what effect the additional amendments will have on Roanoke County's revenues. In addition, it is possible the General Assembly will make changes to these proposals during its session. Based on information received from VaCO, VML, and state agencies as of January 10, the impact of the governor's amendments to the County's revenues is summarized as follows: Compensation Board Implements a reduction of 5% to the sheriffs reimbursements made by the Comp Board for FY03 and FY04. While it is anticipated the reduction will be based on total Sheriff Department reimbursements (salaries and office/vehicle expenses), the reduction in funding will be reflected in reduced funding for per diem payments to reimburse jails for housing state responsible inmates. The Sheriff has provided information that indicates a loss of revenue in the current year of as much as $93,000 and reduced revenues in FY04 as high as $178,000. • Implements a reduction of 5% each year for commonwealth's attorneys. This reduction is less than the 7% that was targeted in the October reductions and adjusts the revenue loss from the Commonwealth Attorney's office from $$29,729 to $21,235, a change of $8,494. The rest of the constitutional officer's reductions remain at 11 %. General Government Reduces distributions to localities for ABC profits and wine taxes. These distributions will be reduced by 25% in the current year and 50% in FY04 as a result of an increase in the amounts transferred to the general fund for expenses incurred for the care, treatment, study, and rehabilitation of alcoholics by the Department of Mental Health. These adjustments will reduce revenues for the County by $55,727 in the current year and reduce revenues in FY04 by an additional $52,614. Libraries • While the total grant for state aid to localities is unchanged after the October reductions, the Library of VA has informed Roanoke County that its grant for the current year and FY04 is $195,691. This figure is $6,948 less than the figure reported earlier in the fall. The library director has indicated the difference is most likely the result of a redistribution of the overall state grant according to a formula, which can shift funding to the smaller libraries in the state. M -~1 Education While direct aid to public education (K-12) was spared in the executive reductions implemented in October, it was feared that significant reductions in this area were likely in order to balance the projected shortfall in the state budget. Based on preliminary information, it appears these fears did not come to pass. Not only were county schools not cut, they are scheduled to receive additional funding in the current year and in FY04. Schools staff is currently evaluating this information to ascertain the exact amount of additional funding expected. The Board of Supervisors will be informed as soon as this information is available. Public Safety • No additional reductions have been targeted for HB599/Law Enforcement Funding beyond the October reductions, which will result in a County revenue loss in the current year of $70,448. Statewide Wireless E-911 funds have been reduced by $3 million for FY04. These funds are collected by the state from an individual's monthly cell phone bill and remitted to localities to offset some of the costs associated with having to answer wireless E-911 calls (previously handled by the state police). The County currently receives $110,000 that is used to fund the E-911 center. The direct impact to the County concerning the loss of a portion of these fees has not yet been determined. Summary At present, staff is still accumulating and analyzing information received from the state, VML, and VaCO regarding state funding for FY03 and FY04. While the proposed reductions are not as bad as we feared, they are still significant in light of the many needs that the County faces currently and in the upcoming budget development. The additional reductions, estimated at approximately $150,000, combined with the October reductions of $227,000 brings the total current year loss of state revenues to $377,000. The compounded loss of state revenue in FY04 will be at least this number again- probably more. An additional item of concern is how the governor has proposed balancing the remaining biennial budget. Of the projected $2.1 billion deficit, almost one-third ($583 million) of the balancing action involve the use of "one-time" revenues or remaining balances. Without healthy economic growth, balancing the state's budget in FY05-06 could be quite a challenge. M -~1 • Page 2 -~ ACTION NO. ITEM NO. Prior to 1987 Roanoke County did not have this policy and could only participate through reimbursement contracts for future connections. This policy resulted in development of many residential areas with wells (or private water system) and septic systems because it was not feasible to extend public utilities. In 1987, the Board of Supervisors adopted anoff-site facility fee for water and sewer. This requires that all parties connecting to water and sewer pay an off-site fee. These fees are used to help fund water and/or sewage treatment, storage, pumping, and mains designed to serve properties outside the proposed development. SUMMARY OF INFORMATION: It is the intent of this work session to review this policy and discuss some of the following issues: (1) What are off-site facility fees? (2) When is connection to public water and/or sewer required? o-i (3) How much revenue is generated from these fees? (4) Recent examples of projects partially funded from these fees. The Board expressed concerns about the large group of County citizens being affected by the proposed construction who are anxious for information regarding if and when the process will begin. On November 20, 2002, a follow up letter was sent to Mr. Clement stating that no response had yet been received to the Board's previous inquiry. On November 27, Mr. Clement issued a response to the Board's request. Copies of the above correspondence are attached. I apologize for the delay in responding. Working through the EIS process is a lengthy endeavor. The Virginia Department of Transportation (VDOT) is proceeding as expeditiously as possible, given the complexity of the environmental issues, to complete this study process. VDOT and its consultant team have been working to put together the information required for the FEIS and to complete the natural resource surveys required as part of this process. The survey for the Smooth Coneflower and Schweintz's Sunflower have been completed, and there were no occurrences of these plants within the study area. The survey for the James Spiny mussel also is complete and there were no occurrences in the study area. There was a population of the Roanoke Logperch found in the Pigg River, and the Federal Highway Administration (FHWA) is working with the U.S. Fish & Wildlife Service to address this resource. The recent decision by the Keeper of the National Register of Historic Places overruled a decision on the eligibility of the Southeast Roanoke neighborhood made by the Virginia State Historic Preservation Officer as well as professional staff from VDOT and the FHWA. This determination now requires additional engineering and environmental investigation by VDOT as well as further coordination with state and federal agencies. With regard to the new information recently brought presented by the Virginians for Appropriate Roads related to the Oak Hill Oid German Baptist Brethren Community, VDOT and the FHWA are assessing this information and intend to coordinate their findings with the Virginia State Historic Preservation Officer. Prior to these recent discoveries, VDOT was on schedule to complete the FEIS by the end of the year. The research and coordination required to validate this new information will add an additional 6 to 8 months to the study process. o-~ Mr. Joseph B. Church November 27, 2002 Page Two Barring no additional unforeseen discoveries, we expect to complete the FEIS by mid 2003; it will then be submitted to FHWA for review. Following FHWA review, that agency will issue a Record of Decision, completing the location study process. It may take FHWA 60 days or more before they sign the document and issue a Record of Decision. Not until this study process is complete can VDOT begin to design detailed construction plans on a portion of the approved alignment. It is impossible at this time to identify where within the more than 65 miles of alignment this detailed design would begin. In addition, it is reasonable to expect funding issues to continue to be a critical contingency, dependent largely on federal appropriations. VDOT is committed to respect the beauty,. natural resources and heritage of Virginia. I am confident you and your constituents share these same feelings. While we are unable to provide you with a more detailed schedule at this time, this is the most accurate information available. BMCL 9428 Patterson Drive, Bent Mountain I am the current Secretary, and past President of the Bent Mountain Civic League. I live on Bent Mountain, and I support the full staffing of all Fire and Rescue stations. 1 support the equal service delivery in all our communities; and yes, this includes library services as well as fire and rescue services, my concern today. Many of you will recall the approximately twro years of discussion on this issue leading to our present plan. During that time, the Civic League stated our joint support for staff at the Mount Pleasant, Catawba, and Bent Mountain stations. This support continues. It is not a matter of numbers or volume of calls to most citizens. It is a matter of public safety. It is a basic service for which we pay taxes and now a user fee, and for which most service is provided by volunteers.~ere ~'~dn unexpended funds balance from the fees for service. Can this be used for full staffing? Can this be used for capitol improvements still needed at some stations, such as the paving of the apron and repairs to the heating service at the Bent Mountain station. The statement is one that implies a lesser value on lives and property in our more rural areas. to this sense, I would agree with Mr. Church, it is a moral question. I have tried to look at this as a legal question. i found that the Code of Va. provides two interesting ideas. The first, found in section 10.1-1125, suggests that the State Forester can contract to provide forest fire protection in areas, which are covered by " 80 welt distributed seedlings or sprouts of woody species per acre". The State Forester also has the authority to "summon to serve" able- bodied folks ages 18 to 50 to ftght fires, A refusal to serve is a Class 4 misdemeanor, section 10.1-1139. Perhaps the more heavily wooded areas of Catawba could band together and form a forest militia of sorts! Th"rs of course, would effect the revenues of the County because the Code suggests that areas of the county can be "excluded from protection if in the boundaries of a sanitary district providing fire protection" and that such areas are not subject to "levy" of fees, section 27 23.1-6. This would require a multi-task oriented forest militia t arrr sure we could recruit at the General Store, or the State Forester could simply summon folks away from home and hearth. There are certain "Administrative Requirements" that the County must enact to comply with the law. We will be presenting an overview of the law and the steps necessary to be incompliance. Failure to comply could present the County with the risk of substantial fines. A power point presentation is included in your packet. FISCAL IMPACT: We are attempting to comply within existing budgets, but minor funding maybe necessary in the future for employee training. ALTERNATIVES: This work session is informational only. The Board of Supervisors will be presented with a resolution for approval in the January 24 Board meeting. Smith SUBMITTED BY: Joseph B. Obenshain Senior Assistant County Attorney COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: On December 20, 2002, the Roanoke County Attorney's Office received a letter of claim from an attorney representing former County employee, Gardner W. Smith. Mr. Smith's employment with Roanoke County terminated as of June 30, 2002. His attorney asserts a claim for salary and benefits from July 1, 2002 until Mr. Smith reaches age 65 which will occur on January 8, 2006. This notice of claim was filed to satisfy the requirements of Section 15.2-1243 et seq. of the Code of Virginia, 1950, as amended, if necessary. The Code of Virginia allows a citizen to submit a claim to the Board for payment or denial. Mr. Smith's employment with Roanoke County terminated as of June 30, 2002 as a result of restructuring of the County's administration which affected several departments. This restructuring which eliminated several positions, including Mr. Smith's position as Director of Purchasing, was precipitated by the severe budget situation confronting the County. Mr. Smith is a vested member of the Virginia Retirement System (VRS) and is eligible to draw retirement benefits. Department heads in local government fall outside the typical personnel policies applicable to public employees. Under the County Charter, Mr. Smith served at the pleasure of the County Administrator and was terminable at will. The decision to terminate Mr. Smith's employment with the County and the manner in which the termination was carried out was done in accordance with the law. Mr. Smith had filed a charge of race and age discrimination with the U.S. Equal Employment Opportunity Commission (EEOC). By notice dated December 23, 2002, EEOC informed Mr. Smith that it was unlikely that it would complete its investigation of his charge within the time period specified. EEOC closed its file. EEOC issued Mr. Smith a notice of a right to sue at his request. His lawsuit must be filed within 90 days of receipt of this notice. FISCAL IMPACT: Based upon Mr. Smith's salary during his last year of his employment with Roanoke County, his claim exceeds $ 100,000.00. STAFF RECOMMENDATION: Staff recommends that the claim of a former county employee, Gardner W. By ISAK HOWELL THE ROANOKE TIMES Roanoke Valley governments pledged Monday to ~;~~~ ~»~~~ clean up the area's smog -before the federal ~ a _ to ~~~. government uses economic sanctions to force the (' -`' ~ ~r~enell issue. Elected leaders from Roanoke, Salem, Vinton, Roanoke County and Botetourt County signed an agreement to write a plan that will bring the valley's ozone levels into compliance with federal clean air standards. We stand an excellent chance of being successful and improving air quality in the very near future," Roanoke City Councilman Bill Bestpitch said. The agreement kicks off a process that could mean taxpayer-funded education campaigns to reduce driving and lawn mowing; the use of public buses powered by electricity; and tighter regulation of businesses. Such specifics and cost estimates aren't determined, but within a year the five governments are set to approve and implement a plan to reduce ozone pollution. That means reducing the waste from automobiles, industries and other sources. The Roanoke Valley has exceeded federal clean air standards for ozone, the primary component of smog. That means the area could be tagged by the U.S. Environmental Protection Agency as a "nonattainment" area - a designation that carries sanctions such as the withholding of federal highway dollars and years of strict regulation of new and expanded businesses. To avoid that designation, the governments agreed to devise a clean air plan themselves. Instead of being designated a nonattainment area in early 2004, as was nearly certain, the valley will have unti12007 to demonstrate a reduction in ozone levels. If there's improvement, the valley could avoid the sanctions altogether. "We wanted to control our own destiny," said Wayne Strickland, executive director of the Roanoke Valley-Alleghany Regional Commission. Strickland said Roanoke is the first Virginia city and only the second city in the United States after San Antonio, Texas, to sign such an agreement. The federal deadline is Dec. 31. The governments will form a task force of business leaders, environmental groups and government officials to decide how to clean the air. Possible measures include encouraging car pooling, inspecting vehicle emissions and controlling industrial waste. Ozone is created when sunlight reacts with certain emissions such as car exhaust, industrial waste and products like paint. Volatile organic compounds, such as in gasoline vapors, and oxides of nitrogen, such as from industrial emissions, typically react with the sunlight on hot summer days. Page 2 of 3 Ozone is a respiratory irritant. Children, the elderly, people who work outside and people with chronic lung and heart diseases are most vulnerable to its effects. The federal government's benchmark is a three-year average of the fourth-highest "bad air" days in a year, as measured by an eight-hour average. Roanoke's three-year average for "bad air" days is 87 parts per billion of ozone, as measured by a monitor in Vinton. The federal standard is 85 parts per billion. Other Virginia areas that face the nonattainment designation are Northern Virginia, Fredericksburg, Richmond, Hampton Roads and Winchester. "You're actually going to see air quality improve more quickly than waiting for me or somebody else to tell you what to do," said Robert Burnley, director of the Virginia Department of Environmental Quality. At the same time that state and local budgets were being reduced, there were demands for additional staff. The Virginia State Police accepted 9-1-1 calls from cell phone users until July of last year. In order to reduce their budgets, the State Police passed this responsibility on to Virginia localities, including Roanoke County. Roanoke County added six dispatchers to accommodate an almost 50% increase in calls. We transferred some of the vacant positions to the Dispatch Center for this purpose. A School Resource Officer was added and assigned to the new Hidden Valley High School. Another position was reclassified as a Zoning Enforcement Officer to handle the increase in violations throughout the County. While I regret the elimination of Mr. Smith's position, I also believe that our review process was both sound and necessary to adequately prepare for state budgets cuts and tax revenue shortfalls without reducing citizen services. As the state considers further cuts this year, it is important that we keep a review system in place to deal with budgeting difficulties as they arise.
