one of two procedures: (1) The chair or any two members may call a special
meeting and notice must be in writing and delivered to all the remaining Board
members. (2) The Board can vote to adjourn to a special meeting for a stated
purpose and no other business can be transacted at the meeting that was not
stated in the notice.
SECTION 2-103. Special Meetings.
(a) The Chair or two members of the Board may call special
meetings of the Board whenever in their opinion the public business may
require it.
(b) Whenever a special meeting shall be called, notice in
writing signed by the Chair of the Board or two members of the Board
shall be filed with the Clerk and delivered upon each member of the
Board either in person or by notice left at his place of residence or
business, stating the date and hour of the meeting and the purpose for
which such meeting is called, and no business shall be transacted at the
meeting except such as is stated in the notice.
(c) The notice may be waived if all members of the governing
body attend the special meeting or sign a waiver.

The Roanoke County Board of Supervisors has called a special meeting
to be held on Tuesday, September 30, 2003, at 12:00 Noon at the Roanoke
County Administration Center, 5204 Bernard Drive, Roanoke, VA 24018.
The purpose of this special meeting is to hold a closed meeting pursuant
to Section 2.2-3711 A (7) consultation with legal counsel pertaining to probable
litigation and regarding specific legal matters requiring the provision of legal
advice by the County Attorney, namely the location of the methadone clinic. No
action is anticipated following the closed meeting.

We, the undersigned members of the Board of Supervisors of Roanoke County,
request a special meeting of the Board of Supervisors, pursuant to Section 2-103 of the

September 30, 2003
WHEREAS, on September 30, 2003, two members of the Board of Supervisors of
Roanoke County requested a special meeting pursuant to Section 2-103 of the County
Code to be held at noon, on Tuesday, September 30, 2003, at the Roanoke County
Administration Center, 5204 Bernard Drive, Roanoke, Virginia, 24018,
WHEREAS, the purpose of this meeting is to hold a closed meeting pursuant to
Section 2.2-3711A.7, consultation with legal counsel pertaining to probable litigation and
regarding specific legal matters requiring the provision of legal advice by the County
Attorney, namely the location of the methadone clinic.
WHEREAS, notice of this special meeting may be waived if all members of the
governing body attend this special meeting or sign a waiver. Accordingly, we the
undersigned members of the Board of Supervisors of Roanoke County, hereby waive any
defects in the notice for this special meeting.

This is a special meeting of the Board of Supervisors for the purpose of a Closed
Meeting as stated below. No action is anticipated following the Closed Meeting.
Good afternoon and welcome to our meeting for September 30, 2003. Regular
meetings are held on the second Tuesday and the fourth Tuesday at 3:00 p.m. Public
hearings are held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from
this schedule will be announced. The meetings are broadcast live on RVTV, Channel 3,
and will be rebroadcast on Thursdays at 7:00 p.m. and on Saturdays at 4:00 p.m. The
meetings are now closed-captioned. Individuals who require assistance or special
arrangements to participate in or attend Board of Supervisors meetings should contact
the Clerk to the Board at (540) 772-2005 at least 48 hours in advance.

Chairman McNamara noted that Supervisor Minnix was unable to attend today's
meeting and that he had wanted to participate via telephone; however, this type
of electronic meeting is not allowed. Supervisor Minnix will be briefed regarding
today's meeting.

RESOLUTION 093003-1 CERTIFYING THE CLOSED MEETING WAS
HELD IN CONFORMITY WITH THE CODE OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened a
closed meeting on this date pursuant to an affirmative recorded vote and in accordance
with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the
Board of Supervisors of Roanoke County, Virginia, that such closed meeting was
conducted in conformity with Virginia law.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke
County, Virginia, hereby certifies that, to the best of each members knowledge:
1. Only public business matters lawfully exempted from open meeting requirements
by Virginia law were discussed in the closed meeting which this certification resolution
applies, and
2. Only such public business matters as were identified in the motion convening the
closed meeting were heard, discussed or considered by the Board of Supervisors of
Roanoke County, Virginia.
