Good afternoon and welcome to our meeting for January 12, 2010. Regular meetings
are held on the second Tuesday and the fourth Tuesday at 3:00 p.m. Public hearings
are held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from this
schedule will be announced. The meetings are broadcast live on RVTV, Channel 3,
and meetings will be rebroadcast on Thursday at 7:00 p.m. and on Saturday at 4:00
p.m. Our meetings are now closed-captioned, so it is important that anyone addressing
the Board speak directly into the microphones at the podium. Individuals who require
assistance or special arrangements to participate in or attend Board of Supervisors
meetings should contact the Clerk to the Board at (540) 772-2005 at least 48 hours in
advance.

SUMMARY OF INFORMATION:
Each year at the annual organizational meeting of the Board of Supervisors, the Board
elects a chairman and vice-chairman. Section 3.08 of the Roanoke County Charter
provides as follows:
Section 3.08. Chairman and vice-chairman. -The board shall, at its first meeting in
January of each year, elect one of its number as chairman, who shall preside at such
meeting and all other meetings during the term for which so elected, if present. The
board also may elect avice-chairman who shall, if so elected, preside at meetings in the
absence of the chairman and may discharge any other duty of the chairman during his
absence or disability. The chairman and vice-chairman shall preside for a term of one
year. The chairman and vice-chairman may succeed themselves in office. In the case
of the absence from any meeting of the chairman and vice-chairman, the members
present shall choose one of their number as temporary chairman. In addition to the
compensation provided members of the board of supervisors, the board may by
ordinance fix an additional sum to be paid to the chairman and vice-chairman, not to
exceed the limit established by general law, without regard to the maximum salary
limits.

Resolution establishing a meeting schedule for the Board of
Supervisors of Roanoke County for calendar year 2010

COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
The Board of Supervisors of Roanoke County annually establishes a schedule for its
meetings. It has been the custom of this Board toschedule its meetings on thesecondand
fourth Tuesdays of each month. The attached resolution continues this tradition, except for
the months of November and December.
Attached to this report you will find four options for the Board's meetings in November and
December. Option No. 1 has only one Board meeting in November and December
(November 16 and December 14). Option No. 2 has two Board meetings in November and
one in December (November 9 and 23 and December 14). The second Board meeting in
November is during the week of Thanksgiving. Option No. 3 has one meeting in November
and two in December (November 16 and December 7 and 21). The second Board meeting
in December is during the week before Christmas. Option No. 4 has two Board meetings in
November and one in December (November 2 and 16 and December 14).
Staff recommends Option No. 1. This option avoids any possible conflicts with the annual
meeting of the Virginia Association of Counties (November 7 through 9, 2010) and the
Thanksgiving or Christmas holidays.
Finally, the Board must schedule an organizational meeting for January 2011. Staff
recommends that the Board schedule its organizational meeting for Tuesday, January 11,
2011, at 2:00 p.m.
STAFF RECOMMENDATION:
It is recommended that the Board favorably consider the adoption of the attached
resolution, which incorporates the dates recommended in Option No. 1.

RESOLUTION OF APPRECIATION TO MICHAEL W. ALTIZER FOR HIS
SERVICE AS CHAIRMAN OF THE BOARD OF SUPERVISORS IN 2009
WHEREAS, Michael W. Altizer served as Chairman of the Roanoke County Board of
Supervisors during 2009; and
WHEREAS, during Mr. Altizer's term as Chairman, many noteworthy achievements
took place, including the dedication and opening of the following facilities:
> Western Virginia Regional Jail
> North County Fire and Rescue Station
> Fleet Service Center
> Green Ridge Recreation Center
> Roanoke Valley Regional Fire Training Tower; and
WHEREAS, the following other accomplishments also occurred during Mr. Altizer's
term as Chairman:
> Groundbreaking for the South County Library
> Completion of the $9 million upgrade of the emergency radio system
> Welcoming of Franklin County as a member of the Western Virginia Water Authority
> Completion of the Route 220 water line project in Roanoke County
> Inauguration of a Roanoke County e-newsletter for citizens
> Ribbon cutting and dedication celebrating completion of work to restore Mudlick
Creek at Garst Mill Park; and
WHEREAS, Chairman Altizer consistently supported the improvement of schools by
approving major construction and renovation projects; and
WHEREAS, Chairman Altizer was a steadfast supporter of economic development
and participated in the Coca-Cola expansion to the Valley Gateway shell building; and
WHEREAS, Chairman Altizer was instrumental in supporting and celebrating
Kroger's continued investment in the County, which included more than 80,000 square feet
of newly renovated and expanded store space at locations in Vinton, Hollins, and

Tanglewood and over $28 million in new investment, most notably Kroger's newest and
largest retail facility in the region - an 84,000-square-foot store and mixed-use retail
development on Route 460 at Valley Gateway; and
WHEREAS, Chairman Altizer assisted with the opening of the 15,000-square-foot
Division of Motor Vehicles Customer Service Center on Peters Creek Road; and
WHEREAS, Chairman Altizer chose a positive approach to governing by
encouraging open communication and prompt responses to citizens; and
WHEREAS, Chairman Altizer worked diligently throughout the year to represent the
citizens of Roanoke County by emphasizing sound financial strategies and practices to
benefit all of the residents of the Roanoke Valley.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke
County, Virginia, does hereby extend its deepest appreciation to MICHAEL W. ALTIZER
forhisserviceas Chairman during 2009 and forhis belief in democracyand championing of
citizen participation in local government.

SUMMARY ~F INFGRMATIGN:
The Roanoke Valley experienced record snow fall starting on Friday, December 18, 2009,
and continuing through December 19, 2009. The Governordeclared a State of Emergency
based on the projected snow fall. Roanoke County Fire and Rescue Department took pre-
emptiveaction to increase firelrescue staffing by placing additional units in-service.
The most significant issue that the firelrescue department faced was a request from the
Virginia State Police starting just before midnight on Friday, December 18, 2009, based on
numerous calls for stranded motorists on Interstate 81. An operation plan was put into
action by firelrescue staff and Roanoke County Police. Initially, there were only two
families that needed assistance, but once firelrescue units arrived on the scene it was
apparent that there were hundreds of stranded motorists on both north and south bound
lanes of Interstate 81, starting at the 132 mile-marker going into Montgomery County.
Unfortunately, the weather prohibited the Red Cross from establishing a shelter for these
stranded motorists, and the firelrescue department adapted to the situation by creating a
temporary shelter at the Fort Lewis #9 FirelRescue Station. A total of l0 stranded
motorists, almost half being children, were sheltered at the station with firelrescue staff
providing sleeping arrangements, food, hotlcold drinks and medical evaluations.
Firelrescue staff also sheltered the stranded motorists' petslanimals that included dogs,
cats and horses.

once daybreak came the morning of Saturday, Decerber 19, 2DD9, the Fire and Rescue
Department opened the ESC to assistthe Fort Lewis shelteroperations. Furthermore, the
County enacted a local emergency and notified the Virginia Department of Emergency
Management of the situation. Starting at 9:DD am firelrescue staff, working in conjunction
with the State Police, went back out to the interstate and literally dug the stranded
motorists' cars out of the snow, and were ableto return the cars to the stranded motorists.
Additional foodldrinkwas provided to all sheltervictims along with providing information on
how they could continue on with their travel plans. Shortly after noon on Saturday,
December 19, 2009, the temporary shelter was closed.
Firelrescue personnel involved were both volunteer and career from the following stations;
Fort Lewis #9, FirelRescue AdministrativelCorr~mand Staff, Masons Cove #1 D, Hollins #5,
Cave Spring #3, North County #1 and Ciearbrook #l.

Section 15.2-2501 of the Code of Virginia, as amended, provides that whenever such
amendment exceeds 1 percent of the total expenditures shown in the adopted budget or
$500,000, whichever is lesser, the County must publish notice of a meeting and public
hearing. The notice must state the County's intentto amend the budgetand include a brief
synopsis of the proposed budget amendments}. This notice was published on January 5,
2010.

There is no fiscal impact as a result of the public hearing. Requests for the appropriations
will occur later on this agenda.
STAFF RECOMMENDATION:
It is recommended that the Board hold the required public hearing. Board action
appropriating funds, as provided in this notice, will occur later during this meeting.
Conducting the public hearing does not guarantee the requested appropriations will be
approved. Each request will be reviewed individually by the Board of Supervisors.

SUMMARY of INFORMATION:
Roanoke County entered into the New River Valley Commerce Park Agreement on
October 14, 1999. on August 8, 2001, the Agreement was amended allowing Wythe
County to sell its shares to the remaining participants and withdraw from the Agreement. It
is now necessary to amend the Agreement a second time to allow for the following four
changes:
1. Expand the scope of the Project Description to include all actions taken place to
date and to acknowledge the Commerce Plan adopted Program of Work
2. Amend the required voting approval before the Participation Con~~n~ittee can take
certain actions
3. Amend the Finance Plan for the project by including the use of money from surplus
property sales and surplus dues upon unanimous consent of all member
jurisdictions

4. Amend the Revenue Sharing provisionto includethe sharing of B~~siness Personal
Property and Real Estate Taxes between the host community Pulaski County and
the Participants, with a portion of this additional revenue to be eligible to be offered
as incentive to attract businesses to the Commerce Park
Also, non-participating members of this Authority have requested an amendment to the
Code of Virginia, Section15.2-6415, to allowforwithdrawalfrom theAuthority if their legal
obligations are satisfied and upon certain other conditions. Their potential exit from this
Authority would have no effect on Roanoke County's standing, nor would it have any effect
on Roanoke County's financial position or responsibility to the Authority. Several New
River Valley legislators have agreed to sponsor this legislation, if it is the desire of the
Authority and their member localities to seek such change.
In summary, both the Amendment to the Participation Agreement and the proposed Code
amendment have been reviewed by the Roanoke County Attorney, the Attorney for the
Authority and the various County and City Attorneys, Administrators and Managers who
represent the membership of Virginia's First Regional Industrial Development Authority.
These proposed actions have the support of the member localities, and are deemed
necessary forthe orderly development of the Commerce Park.
FISCAL IMPACT:
No additional funding will be needed as a result of these actions.
ALTERNA'T`IVES:
Alternative one: Board of Supervisors approves the Second Amendment to the New River
Valley Commerce Park Project Participation Agreement, and authorizesthe Chair~~~an to
execute the Amendment on behalf of Roanoke County.
The Board of Supervisors supportthe proposed Amendment to Section 15.2-6415 of the
Code of Virginia related to the Virginia Regional Facilities Act.
Alternative two: Do not approve the Second Amendment to the Agreement or support the
Code Amendment.
STAFF RECOMMENDATION:
Staff recommends alternative one.

SECOND AMENDMENT TO THE NEW RIVER VALLEY COMMERCE PARK PROJECT
PARTICIPATION AGREEMENT
THIS SECOND AMENDMENT TO THE PARTICIPATION AGREEMENT (the
"Second Amendment to Participation Agreement") is dated this day of , 2010 between
and among Virginia's First Regional Industrial Facility Authority and the Participants defined below.
WITNESSETH:
WHEREAS, the undersigned governing bodies are each member localities of Virginia's First
Regional Industrial Facility Authority ("the Authority") a body corporate, organized and created
pursuant to the Virginia Regional Industrial Facilities Act, Chapter 64 Title 15.2 of the Code of
Virginia, 1950, as amended ("the Act"); and
WHEREAS, pursuant to the authority granted under the Act to enter into agreements for the
development of regional economic development projects the Authority and the County of Craig,
Virginia, the County of Giles, Virginia, the County of Montgomery, Virginia, the County of Pulaski,
Virginia, the County of Roanoke, Virginia, the County of Wythe, Virginia, the County of Bland,
Virginia, the City of Radford, Virginia, the City of Roanoke, Virginia the Town of Dublin, Virginia,
the Town of Pearisburg, Virginia and the Town of Pulaski, Virginia each entered into the New River
Valley Commerce Park Project Participation Agreement -Initial Phase dated as of October 14, 1999
("the Participation Agreement") for the development of the Commerce Park Project; and
WHEREAS, on August 8, 2001, the Participation Agreement was amended whereby County
of Wythe was allowed to sell its shares to the remaining participants and withdraw from the
Participation Agreement leaving the County of Craig, Virginia, the County of Giles, Virginia, the
County of Montgomery, Virginia, the County of Pulaski, Virginia, the County of Roanoke, Virginia,
the County of Bland, Virginia, the City of Radford, Virginia, the County of Roanoke, Virginia, the

Town of Dublin, Virginia, the Town of Pearisburg, Virginia, and the Town of Pulaski, Virginia as the
remaining participants ("the Participants"); and
WHEREAS, the Authority and the Participants desire to amend the Participation Agreement a
second time by (1) expanding the scope of the Project Description to include all actions taken place to
date and to acknowledge planning and feasibility analysis of those activities and projects that are in
the Commerce Park adopted Program of Work; (2) amending the required voting approval before the
Participation Committee may act to lease, use, sell encumber, transfer or dispose of any real or
personal property comprising of part or all of the Project; (3) amending the Finance Plan for the
project by including the use of money from the sale of surplus property and the use of surplus
Authority dues money upon unanimous consent of all member jurisdictions of the Authority,(?)
allowing the Authority to pledge such surplus Authority money, as well as confirm the outstanding
debt on behalf of the Commerce Park; and (4) amending the Revenue Sharing provision to provide
for the sharing of Business Personal Property taxes and Real Estate Taxes between the host
community Pulaski County and the Participants with a portion of this additional revenue to be eligible
to be offered by the Participants as incentive to attract businesses to the Commerce Park.
NOW, THEREFORE, The Authority and the Participants agree and consent as follows:
1. That the Participation Agreement is amended in accordance with this Second Amendment to
the New River Valley Commerce Park Project Participation Agreement and except as amended by the
First Amendment and this Second Amendment, the Agreement is confirmed, reiterated and ratified.
2. The Scope of the Project Description as defined in paragraph I. of the Participation Agreement
is hereby amended to include the following additional components:

3. Paragraph II of the Participation Agreement is hereby amended to require that

personal property comprising the Project or authorize the Authority to do the same without an
affirmative vote of both a majority of the shares entitled to vote and an affirmative vote of two-
thirds of the Participants, which two-thirds is agreed to be seven of the eleven current members.
4. The Financing Plan as defined in paragraph IX of the Participation Agreement is
hereby amended to recognize the current debt obligations for the Commerce Park and include the
following additional sources of revenue:
• The proceeds of:
• Rural Development Revenue Bond of March 19, 2002 with annual interest of
4.75% and June 30, 2009 outstanding balance of $1,971,008;
• Rural Development Revenue Bond of March 2, 2005 with annual interest of 4.35%
and June 30, 2009 outstanding balance of $2,218,409; and
• A commercial bank loan of March 19, 2002 with variable interest and June 30,
2009 outstanding balance of $1,177,588.
• The use of money from the sale of surplus property that was previously purchased by
the Participants but now deemed surplus.
• The use of surplus Authority dues money upon unanimous consent of all member
jurisdictions of the Authority authorizing the use of the surplus dues.
• An estimated $3.1 million loan or other financing to the Pulaski County Public Service
Authority to match a grant from the US Department of Commerce Economic
Development Administration to be used for the purpose of extending water and sewer
infrastructure to serve the New River Valley Commerce Park, of which financing one-
third is to be pledged as a capacity reservation fee to provide one million gallons per
day (MGD) water and sewer capacity to the Commerce Park.
• Refunding of bonds, such as through procurement of new commercial bank financing,
to replace existing commercial bank financing, or other changes in debt financing,
when deemed advantageous by the Commerce Park Participation Committee to reduce
the cost of existing borrowing.
This amendment to the Financing Plan shall not result in the Participants incurring any
additional costs beyond the existing annual dues and their individual share payments.

5. The Revenue Sharing as defined in paragraph XII of the Agreement is hereby
amended to include the sharing of additional tax revenues to include business personal property
taxes and real estate taxes assessed by the host community Pulaski County to be shared between
the host community Pulaski County and the Participants for a period of fifteen years as defined
below once these taxes are assessed due to a business locating in the Park. The parties agree that
for the years 1 through 9 Pulaski County and the Participants shall share equally 100% of the
business personal property and real estate taxes assessed. For years 10 through 11 Pulaski County
and the Participants shall share equally 75% of the business personal property and real estate
taxes assessed. For years 12 through 13 Pulaski County and the Participants shall share equally
50% of the business personal property and real estate taxes assessed. For years 14 through 15
Pulaski County and the Participants shall share equally 25% of the business personal property and
real estate taxes assessed. The parties recognize that Pulaski County's agreement to share the
business personal property taxes and the real estate taxes assessed by Pulaski County as the host
community with the Participants is a moral obligation and not a legal debt of Pulaski County and
the payment of those additional tax revenues to the Participants is subject to annual appropriation
of the Board of Supervisors of Pulaski County. The revenue generated from the business personal
property taxes and the real estate taxes shall not be subject to the 5% host fee or the 1% Authority
administrative fee that is applicable to revenue generated by machinery and tools tax.
The Participants agree that the business personal property and real estate taxes
referenced above that would be generated in the first seven (7) years may be offered by the
Participants as incentive to locate industry to the New River Valley Commerce Park upon an
affirmative vote of both a maj ority of the shares entitled to vote and two-thirds of the Participants,
which two-thirds is determined to be seven of the eleven current members.

6. If any provision of this Second Amendment to the Participation Agreement shall be
held invalid by any court of competent jurisdiction such holding shall not invalidate any other
provisions hereof.
7. This Second Amendment to the Participation Agreement may be executed in any
number of counterparts each of which shall be an original, together they shall constitute but one
and the same Second Amendment to the Participation Agreement.

Suggested wording to amend and reenact § 15.2-6415 of the Code of Virginia, relating to the
Virginia Regional Industrial Facilities Act.
Be it enacted by the General Assembly of Virginia:
1. That § 15.2-6415 of the Code of Virginia is amended and reenacted as follows:
§ 15.2-6415. Dissolution of authority; withdrawal of locality.
A member locality of an authority may, with the majority approval of all other members of such
authority, withdraw from the authority only (i) upon dissolution of the authority as set forth
herein, or (ii) upon a resolution adopted by the governing body of a member locality and after
satisfaction of such member locality's legal obligations, including repayment of its portion of any
debt incurred, with regard to the authority, or after making contractual provisions for the
repayment of its portion of any debt incurred, with regard to the authority, as well as pledging to
pay general dues for operation of the authority for the current and succeeding fiscal year
following the effective date of withdrawal. No member seeking withdrawal shall retain, without
the consent of a majority of the remaining members, any rights to contributions made by such
member, to any property held by such authority or to any revenue sharing as allowed by 15.2-
6406 and 15.2-6407. Upon withdrawal, the withdrawing member shall also return to the
authority any dues or other contributions refunded to such member during its membership in the
authority. Whenever the board determines that the purpose for which the authority was created
has been substantially fulfilled or is impractical or impossible to accomplish and that all
obligations incurred by the authority have been paid or that cash or a sufficient amount of United
States government securities has been deposited for their payment, or provisions satisfactory for
the timely payment of all its outstanding obligations have been arranged, the board may adopt
resolutions declaring and finding that the authority shall be dissolved. Appropriate attested
copies of such resolutions shall be delivered to the Governor so that legislation dissolving such
authority may be introduced in the General Assembly. The dissolution of an authority shall
become effective according to the terms of such legislation. The title to all funds and other
property owned by such authority at the time of such dissolution shall vest in the member
localities which have contributed to the authority in proportion to their respective contributions.

During the Board of Supervisors recent review of the Ballyhack golf cart crossing on
Pitzer Road, the Board directed the County Attorney to draft a proposed ordinance
regulating the operation of golf carts on public highways in Roanoke County. The
primary purpose of this regulation is to shift the costs of installing and maintaining signs
warning the public of such crossings from the Co~~inty to the golf course owners.
Section 46.2-916.2 allows local governments to adopt ordinances authorizing the
operation of golf carts and utility vehicles on designated public highways subject to
certain findings, including the speed, volume and character of motor vehicle traffic along
such highways and compatibility with certain state and local transportation plans. This
legislation also allows the locality to recover its costs of the signs and maintenance from
the organizations, individuals or entities requesting the crossings.
This legislation does not specify how the County may recover these costs from golf cart
crossings previously approved by the Virginia Department of Transportation.

The draft ordinance provides for a review and approval process, It would require the
adoption of an ordinance by the Board to approve these crossings. It also imposes a
$50o fee as well as a financial corr~mitment from the applicant to pay the costs of
installation and continuing maintenance of any required traffic control devices.

WHEREAS, the 2004 session of the Virginia General Assembly (Acts of
Assembly 746, codified as Sections 46.2-916.2 and 46.2-916.3) authorized the
governing bodies of counties, cities and towns to adopt local ordinances to regulate the
operation of golf carts and utility vehicles on designated public highways; and,
WHEREAS, public health, safety and welfare require that the County review and
approve the highway usage for golf cart crossings at locations on designated highways;
and,
WHEREAS, there are four golf courses located in Roanoke County: Hanging
Rock, Hunting Hills, Hidden Valley and Ballyhack; and each of these golf courses have
locations where golf carts cross a public highway; and,
WHEREAS, the County intends to recover any and all costs associated with the
review and approval of the use and operation of golf carts and utility vehicles on
designated public highways, and to shift the costs of installation and continuing
maintenance to the organizations, individuals or entities requesting such highway
usage; and,

vUHEREAS, the first reading of this ordinance was held on January 12, 2010, and
the second reading was held on January 26, 2010.
BE IT ORDAINED by the Board of Supervisors of Roanoke County as follows:
1. That Chapter 12 of the Roanoke County Code is amended by the addition
of a new article VI "Golf Cart and Utility vehicle Operations" as follows:
Sec. 12-130.
No portion of any public highway in Roanoke County may be designated for use by golf
carts and utility vehicles unless such use has been reviewed and approved such
highway usage as provided herein.
Sec. 12-131.
Any person seeking to designate a portion of a public highway for use by golf carts or
utility vehicles shall submit to the County Administrator or his/her designee an
application consisting of the following information:
a) A plat or map showing the location of the public highway and the proposed
designated crossing(s);
b) Data showing the speed, volume and character of motor vehicle traffic using the
public highway;
c) Schematic engineering diagrams showing the design, placement, types and
location of traffic control devices and signalization in accordance with the current edition
of the Manual on Uniform Traffic Control Devices for Streets and Highways for the
proposed crossing(s);
d) Explanation of how the proposed crossing(s) are compatible with transportation
plans of the Commonwealth of Virginia and Roanoke County;
e) Explanation of how the proposed crossing(s) are compatible with the
Commonwealth's Statewide Pedestrian Policy provided for in Section 33.1-23.03:001 of
the Code of Virginia.
f) Payment of an application and review fee of $500.00.
Sec. 12-132.
The County Administrator orhis/her designee shall review this application with the Chief
of Police, Director of Community Development, the Commonwealth of Virginia, Virginia

Department of Transportation, and such other agencies and departments as may be
necessary, and shall report hislher findings and recommendations to the Board of
Supervisors. This review shall be completed within 60 days of the receipt of a complete
application and payment of fees; if additional information is requested from the
applicant, the review time period shall be extended until that additional information is
provided.
The Board of Supervisors shall review the application information and materials, the
recommendation of the County Administrator, and such other information it deems
relevant and material to the application. The Board shall render a decision by
considering the adoption of an ordinance approving or disapproving the proposed
highway usage within 30 days of receipt of the County Administrator's recommendation.
Any ordinance approving designated highway usage by golf carts and utility vehicles
may impose such restrictions and limitations of such operations, provided that such
restrictions and limitations are no less stringent than the restrictions or limitations
imposed by Article 13.1 of Chapter 8 of Title 46.2 of the Code of Virginia.
No such golf cart or utility vehicle operation shall be permitted on any public highway
where the speed limit is greater than 35 miles per hour.
The design, placement and types of traffic control devices shall be in accordance with
the Manual on Uniform Traffic Control Devices (MUTCD~.
Sec. 12-133.
Upon approval of designated public highway usage by golf carts and utility vehicles, the
applicant shall furnish the County with a letter of credit or cash escrow or such other
financial assurances acceptable by the County, guaranteeing that the applicant shall be
responsible for the costs of installation and continuing maintenance of any signs and
traffic control devices and signalization pertaining to the operation of the golf carts or
utility vehicles. The County declines to be responsible for the installation and continuing
maintenance of signs and traffic control devices and signalization that may be required
for such highway usage by the operation of golf carts or utility vehicles, nor shall it pay
the cost of installation and continuing maintenance of any signs and traffic control
devices and signalization pertaining to the operation of golf carts or utility vehicles.
The applicant agrees to immediately repair or replace any traffic control devices which
may be damaged. The applicant agrees to cease golf cart crossing operations across
the designated public highway until the signs, traffic control devices and signalization
are repaired or replaced. Failure to repair or replace any sign, traffic control devices or
signalization shall result in an immediate termination of the operation of golf carts or
utility vehicles at this public highway and the County's revocation or cancellation of the
VDOT crossing permit.

The words and phrases used in this ordinance shall have the meanings as provided in
Title 46.2 of the Code of Virginia.
2. That this ordinance is effective from and after the date of its adoption. This
review and approval provisions of this ordinance shall not apply to those golf cart or
utility vehicle usage and crossings previously approved either by the Commonwealth of
Virginia, Virginia Department of Transportation, or Roanoke County. If the
Commonwealth of Virginia requires the County to review and approve the highway
usage by golf carts or utility vehicles that the Commonwealth had previously approved,
then the provisions of this ordinance shall apply to that review and approval. The cost
recovery provisions for installation and continuing maintenance of signs and traffic
control devices and signalization shall apply to all previously approved golf cart or utility
vehicle highway usage and crossings.

This is the second reading of an ordinance that dedicates an easement to be located within
the bounds of the Hanging Rock battlefield Trail in order for the Western Virginia Water
Authority ~WVWA} to provide sanitary sewer service along Kessler Mill Road to the
Hanging Rock area in the Catawba Magisterial District. This will allow the opportunity for
existing b~~sinesses in this area to hook onto public sewer, thus eliminating ~rhe use of
antiquated and inadequate private sewer systems. It will also encourage future economic
development of this area by providing a public utility where none has been previously
provided. The Board of Supervisors recently approved a joint funding agreement forthis
project between the County, the WVWA and a private business Hanging Rock Grocery}
which limits the Counties financial contribution to $57,500. Exhibits A and B which are
attached to the following ordinance} were prepared by ACS Design on Gctober 21, 2009,
and illustrate the 20' and variable width easements that need to be secured in order for this
important project to move forward.

Roanoke County's contribution to this project is not to exceed $51,500.

WHEREAS, the Western Virginia WaterAuthority (WVWA) requires an easement for
an underground sanitary sewer and temporary construction easement within the parcel
known as Hanging Rock Battlefield Trail, to provide sewer service to the Hanging Rock
area of Roanoke County, all as shown on the plats entitled "Easement Plat from Records
for WESTERN VIRGINIA WATER AUTHORITY Showing A New 30,931 +/-Square Feet
Sanitary Sewer Easement Located on Tax Parcel 36.03-1-62, Property of Roanoke County

WHEREAS, Roanoke County previously acquired the real estate on which is located
a portion of the Hanging Rock Battlefield Trail, Tax Map Number 36.10-1-62, by deed
recorded in Deed Book 1671, page 474, in the Roanoke County Circuit Court Clerk's
Office; and
WHEREAS, the Western Virginia Water Authority has proposed to extend sanitary
sewer service within the parcel containing the existing Hanging Rock Battlefield Trail to
businesses located in the Hanging Rock area of Roanoke County in the vicinity of the
intersection of Thompson Memorial Drive, State Secondary Route 311 and State
Secondary Route 419; and

WHEREAS, the proposed easement will serve the interests of the public and is
necessary for the public health, safety, and welfare of the citizens of Roanoke County.
THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That pursuant to the provisions of Section 18.04 of the Roanoke County
Charter, the acquisition and disposition of real estate can be authorized only byordinance.
A first reading of this ordinance was held on December 15, 2009, and a second reading
and public hearing was held on January 12, 2010.
2. That pursuant to the provisions of Section 16.01 of the Roanoke County
Charter, the interest in real estate to be conveyed is hereby declared to be surplus, and is
hereby made available forother public uses by conveyance to WVWAforthe provision of
sanitary sewer service.
3. That donation to WVWA of an 20' and variable width easement and a 10'
temporary construction easement for an underground sanitary sewer and related
improvements, within the easement area designated on the attached Exhibits "A"and "B",
which are incorporated herein by reference, on the County's property known as Hanging
Rock Battlefield Trail, to provide sanitary sewer service to the Hanging Rock area of
Roanoke County is hereby authorized and approved.
4. That the County Administrator, or any Assistant County Administrator, is
hereby authorized to execute such documents and take such further actions as may be
necessary to accomplish this conveyance, all of which shall be on form approved by the
County Attorney.
5. That this ordinance shall be effective on and from the date of its adoption.

~LGSAPNIP~ Board of Trustees is requesting that the Board approve volunteers Jeff
Edwards and Wayne Guffey to serve on the LGSAPNIP Board for a standard four-year
term from January 1, 2010 to December 31, 2013.
Jeff Edwards is being recommended to serve as the LGSAPNIP Fire Volunteer
representative, Jeff is a citizen of Roanoke County and has volunteered with the Hollins
Volunteer Fire and Rescue Company since 2006. He is EMT1Basic and Firefighter certified.
Wayne Guffey is being recommended to serve as the LGSAPNIP Volunteer At-Large
representative. Wayne has been a volunteer with the Vinton Volunteer First Aid Crew since
1985. For the past 12 years he has served as an officer with the crew. Wayne is currently
the Assistant Chief at the station and with that role he is tasked with the responsibility of
assisting volunteer members with completing theirVlP point records appropriately and on
time. Wayne is certified at the EMTllntermediate level.
The LGSAPNIP Board manages the previous LGSAP retirement program which was
frozen December 2005, but still has several hundred volunteers who are either receiving a
benefit or are due to receive a benefit upon turning 55 years of age. Additionally, the board
manages the current VIP program, which offers an annual maximum benefit of $500 to
those volunteers who have met minimum criteria standards and are currently serving as an
active volunteer as of the last day of the calendar year.

WHEREAS, Freddie L. Cooper, Jr. was hired on July 21,1976, as a Library Page
and was promoted to Library Assistant on January 1, 1980; and
WHEREAS, Mr. Cooper retired as Library Assistant on January 1, 2010, after a total
of thirty three years and five months of devoted and accomplished service to Roanoke
County; and
WHEREAS, during his time as Library Assistant, Mr. Cooper assumed numerous
important responsibilities for the Library, including creating and managing an efficient
patron record and request system; regularly submitting accurate branch financial reports;
and expanding a vertical file that contained unique and valuable information, which
benefited many patrons, especially students; and
WHEREAS, Mr. Cooper also provided in-depth research assistance, answered
diverse reference questions, resolved computer and Internet issues for patrons and
managed interlibrary loans for the Vinton Branch Library; and
WHEREAS, he was consistently patient, with a friendly smile for all visitors, and
provided such excellent customer service to the patrons of the Vinton Branch and
Headquarters libraries that people regularly sought him out when visiting the library and
repeatedly commended him to his supervisors; and
WHEREAS, Mr. Cooper has been a valued and respected colleague and friend to
everyone in the Library system.

County, Virginia expresses its deepest appreciation and the appreciation of the citizens of

Roanoke County Schools requests that the Board accept and appropriate the following:
1. Roanoke County Schools received the Jobs for Virginia Graduates ~JVG} grant in
the amount of $21,000. The grant mission is to assist youth who are disadvantaged
and not achieving in school to complete high school as well as secure and retain
quality jobs. With these funds, a school division must employ a job specialist who
will assist students in completing high school, gain employability skills and secure
employment. Our most recent data suggests ~~hat 35 students X18 of them seniors}
were serviced with the JVG grant. Staff recommends an appropriation in the full
amount of the grant award of $21,000.
2. Roanoke County Schools and Virginia Western Community College ~VINCC}have
an agreement whereby the college provides college level courses in English, US
History, AP Calculus and certaintechnicaland sciencesubjects. These courses are
taught by Roanoke County teachers who meet the college's criteria for adjunct
professors. Monies that have been collected exceed the expenses; therefore, there
is a request for these additional funds to be appropriated.
Roanoke County Schools collected $118,215 tuition from 1,249 students. VINCC
will reimburse $286,004.99 for services rendered teachers, administrating
expenses, rooms, utilities, and maintenance}. Roanoke County Schools owes

VWCC $381,339.99 for tuition and technology fees and college service fees. ~fhe
difference between what was collected and what was spent is $82,940.
Roanoke County Schools requests that $82,940 be appropriated to the instructional
program.
3. The Roanoke County School Board recently sold the Southview School located at
3568 Peters Creek Road, Tax Map Number 37.1-1-21.2 to the Commonwealth of
Virginia for the amount of $2,000,000. The school board is requesting that the funds
be appropriated to the Major Capital Improvement Plan Fund.
FISCAL IMPACT:
1. The Jobs for Virginia Graduates grant will be increased by $21,000.
2. The Secondary Instruction Budget will be increased by $82,940.

SUMMARY OF INFQRMA'r14N:
The indoor portions of the Green Ridge Recreation Center are operational with only punch
list items and minor changes left to complete. The grand opening was successfully held on
January 1, 2010, as scheduled. However, due to an excessively wet November, an
unforeseen snowstorm in December and unusually low temperatures in January, work is
not yet corplete on the outdoor pool and concessions building. In order to ensure the
remaining work is performed in accordance with the comprehensive agreement with
FirstChoice Public Private Parkners, it is necessary to extend the project management
contract with Arcadis on an hourlylas needed basis. Therefore, staff requests that a
Change Order for the Arcadis contract be approved for up to $22,000 in order to ensure
successful completion of the project. The funds for this change are available in the
project's contingency account. Vllith the exception of the final landscaping that cannot be
completed until spring,the remaining constructionworkshould becompleted inFebruary,
depending on the weather. Normally this type of Change Order could be approved
administratively as all project funds have been previously appropriated; however, as the
co~~tract with Arcadis has been increased by more than 25% of the original amount by a
previous vote of the Board of Supervisors on November 17, 2009, this change must also
have Board of Supervisors' approval under state procurement regulations.

The overall project is well within the original budget. After this Change order is executed,

therefore, it may not be necessary to actually spend all of the additional $22,000.

WHEREAS, the representative for the Virginia Department of Transportation has
advised this Board that the street(s) meet the requirements established by the Virginia
Department of Transportation's Subdivision Street Requirements, and
WHEREAS, the County and the Virginia Department of Transportation have entered
into an agreement on March 9, 1999, for comprehensive stormwater detention which
applies to this request for addition,
NOW, THEREFORE, BE IT RESOLVED, this Board requests the Virginia

CENTER ON TUESDAY, JANUARY 12, 2010
RESOLUTION CERTIFYING THE CLOSED MEETING WAS HELD IN
CONFORMITY WITH THE CODE OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened a
closed meeting on this date pursuant to an affirmative recorded vote and in accordance
with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the
