Regular meetings are held on the second and fourth Tuesday at 3:00 p.m. Public hearings are held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule will be announced. Clayton Goodman III County Administrator ~~ C~'t COUNTY ADMINISTRATOR'S COMMENTS: The Arts Council of the Blue Ridge in partnership with Roanoke Valley Sister Cities and others will present Artview: "Visions and Voices" - a contemporary international art exhibition. The purpose of Artview is to facilitate cultural exchange and raise the level and awareness of art in our region. To help achieve these goals, an artist from each of the Roanoke Valley's seven Sister Cities was invited to participate in Artview. Roanoke County is part of the Roanoke Valley Sister Cities organization. This time has been set aside to meet Mr. Robert Suchinski, who is one of the artists selected to participate in Artview. Mr. Suchinski is from Roanoke County's Sister City Opole, Poland. Artview is part of the 40 Days and 40 Nights of Arts and Culture initiative and is an official eventof the Blue Ridge Parkway's 75th Anniversary. The event is scheduled for November 5-7 at the Roanoke Civic Center's Special Events Center. Clayton Goodman III County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: A \,R~~~~"'' The School and the County both have policies for the use of their respective year-end policies. The School Board policy is currently as follows: All school fund appropriations remaining at the end of the fiscal year will not lapse but shall be appropriated to the School Capital Fund in the following year as follows: 1. Two-thirds of the year-end balance in the school operating fund will be allocated to the Major School Capital Reserve. 2. One-third ofthe year-end balance in the school operating fund, notto exceed $1,000,000 will be allocated to the Minor School Capital Reserve; 3. If the one-third allocation to the Minor School Capital Reserve exceeds $1,000,000, the excess will be added to the Major School Capital Reserve. On October 14, 2010, the School Board took action to change the above policy, by removing the $1,000,000 cap on the one-third amount that is allocated to the Minor School Capital Fund. This policy is included as paragraph five of Roanoke County Ordinance #052510-7 appropriating funds for the fiscal year 2010-2011 Budget. Page 1 of 2 FISCAL I M PACT: The result of this change will allow more School year-end moneyto go towardsthe School Minor Capital Fund and less towards the School Major Capital Fund. STAFF RECOMMENDATION: Staff recommends approving the first reading ofthe attached ordinance which removesthe $1,000,000 cap on the allocation of the School year-end balance to the Minor Capital Reserve, The second reading of this ordinance will be held on November 16, 2010. Page 2 of 2 ATA REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, OCTOBER 26, 2010 ORDINANCE AMENDING ORDINANCE NUMBER 052510-7 BY PROVIDING FOR THE USE OF APPROPRIATIONS FROM THE SCHOOL BOARD YEAR-END BALANCE WHEREAS, the Board of Supervisors approved the appropriation of funds for the 2010-2011 budget by Ordinance # 052510-7, that was adopted on May 25, 2010; and WHEREAS, paragraph five of this appropriation ordinance included the approval for the use of the 2009-2010 School year-end funds; and WHEREAS, on October 14, 2010, the School Board approved an amendment to the policy for the use of School funds remaining at the end of the fiscal year, and requested that this amendment be approved by the County Board of Supervisors; and WHEREAS, this first reading of this appropriation ordinance was held on October 26, 2010, and the second reading of this ordinance was held on November 16, 2010, pursuant to the provisions of Section 18.04 of the Roanoke County Charter. Clayton Goodman III Count Administrator ~~ Y COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: The Commonwealth of Virginia Department of Juvenile Justice (DJJ~ currently has office space in Roanoke County's Court Services Building, across the street from the County courthouse in Salem. Localities are mandated to provide space forthis service at no cost, because it is an arm of the state court system. Several years ago, Mike Lazurri, who managed the Court Services Unit, was promoted to Regional Operations Manager, Western Region, and he now shares office space with the Department of Corrections on Peters Creek Road. With the recent state budget cuts, several positions at the Court Services Unit are vacant due to retirement, leaving emptyoffice space. From an operational standpoint, DJJ would benefitfrom using one of the emptyofficesforthe Regional Operations Manager, and has requested that Roanoke County lease space for that purpose. The terms of the proposed lease are $175/month, and a two year period, which will become month to month at the end of that time, when we will also have the opportunity to adjust the rent if necessary. Page 1 of 2 FISCAL I M PACT: There is no fiscal impact from an operational standpoint, as the County already provides utilities, custodial and maintenance service to the building, The Commonwealth will pay $21001year for the use of this office, which monies should be placed in the facilities management account to cover some of the cost of operating the building. ALTERNATIVES: 1. Approve the second reading of the attached ordinance permitting the Commonwealth of Virginia Department of Juvenile Justice to lease office space at the Roanoke County Court Service Building, and direct ~rhe rent proceeds to be placed in the General Services Facility Management Account for payment of utility and custodial costs. 2. Page 2 of 2 ATA REGULAR MEETING OFTHE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER, TUESDAY, OCTOBER 26, 2010 ORDINANCE AUTHORIZING AND APPROVING EXECUTION OF A LEASE AGREEMENT WITH THE COMMONWEALTH OF VIRGINIA DEPARTMENT OF CRIMINAL JUSTICE FOR OFFICE SPACE IN THE COURT SERVICES BUILDING AT 400 EAST MAIN STREET, SALEM, VIRGINIA, OWNED BY THE BOARD OF SUPERVISORS OF ROANOKE COUNTY WHEREAS, the Board of Supervisors of Roanoke County, Virginia, is the owner of an office building located at 400 East Main Street directly across the street from the Roanoke County Courthouse and known as the Court Services Building; and WHEREAS, the Commonwealth of Virginia Department of Juvenile Justice (DJJ) has requested the lease of office space in the Court Services Building for use by the Regional Operations Manager for the Western Region; and WHEREAS, Section 18.04 of the Roanoke County Charter directs that the acquisition or conveyance of an interest in real estate, including leases, shall be accomplished by ordinance; the first reading of this ordinance was held on October 12, 2010; and the second reading was held on October 26, 2010. THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That lease of approximately 224 square feet of office space in the Court Services Building located at 400 East Main Street, Salem, Virginia, to the Commonwealth of Virginia Department of Juvenile Justice for use by the Regional Operations Manager for the Western Region an initial lease term of two (2) years from November 1, 2010, until October 31, 2012, at an initial rental of $175 per month or Page 1 of 2 $2100 per year, said term becoming month to month at the end of the initial two year term is hereby authorized and approved. 2. That the County Administrator or an Assistant County Administrator is hereby authorized to execute a lease agreement on behalf of the Board of Supervisors of Roanoke County and to execute such other documents and take such further actions as are necessary to accomplish this transaction, all of which shall be upon form and subject to the conditions approved by the County Attorney. 3. That the funds generated by this lease shall be placed in the General Services Facility Management Account for payment of utility and custodial costs. 4. This program will include parent meetings for each of our five high schools with the potential of reaching over 1200 students and their families. The goal of the Roanoke County program is to present one or two parent meetings in each of the five high schools by March 2011. The target audience will be parents of teens preparing for or those in the process of acquiring a driver's license. Clayton Goodman III .. ~-~^ County Administrator ~~ COUNTY ADMINISTRATOR'S COMMENTS: SUMMARYOF INFORMATION: The Chairman of the Board of Supervisors has suggested that the Board consider canceling the 2011 Organizational Meeting of the Board of Supervisors originally scheduled to be held on Monday, January 3, 2011, and reschedule to Tuesday, January 11, 2011 at 1:00 p.m. Attachedtothis board report is a resolution canceling the January3, 2011, Organizational Meeting and rescheduling the meeting for Tuesday, January 11, 2011 at 1:00 p.m. STAFF RECOMMENDATION: It is recommended that the Board favorably consider the adoption of the attached resolution. AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, OCTOBER 26, 2010 RESOLUTION CANCELING THE 2011 ORGANIZATIONAL MEETING OF THE BOARD OF SUPERVISORS TO BE HELD ON MONDAY, JANUARY 3, 2011, AND RESCHEDULING THE MEETING FOR TUESDAY, JANUARY 11, 2011 WHEREAS, by Resolution 011210-1 the Board of Supervisors established a meeting schedule for the 2010 calendar year which scheduled an organizational meeting for Monday, January 3, 2011, at 10:00 a.m.; and WHEREAS, due to a reduced agenda at the organizational meeting, the Board of Supervisors desires to cancel this meeting scheduled to be held on Monday, January 3, 2011, and reschedule the meeting for Tuesday, January 11, 2011, at 1:00 p.m. NOW, THEREFORE, be it resolved by the Board of Supervisors of Roanoke County that this Board hereby cancels its organizational meeting scheduled for Monday, January 3, 2011, and reschedules that meeting to Tuesday, January 11, 2011, at 1:00 p.m. BE IT FURTHER resolved that the Clerk to the Board be, and hereby is directed to post this resolution in a public location at which notices are regularly posted and in the office of the Clerk to the Board. H-4 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: AGENDA ITEM: SUBMITTED BY: APPROVED BY: October 26, 2010 Entering into a revised Fire/EMS Mutual Aid Agreement with the County of Franklin, Virginia. Clayton Goodman III County Administrator ~~~ ~~ COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: Roanoke and Franklin Counties have a long history of assisting each otheras it pertainsto fire and rescue services. In particular there are two sections of Franklin County that Roanoke County Fire and Rescue Department regularly (Automatic Aid) provides assistance to which are the Coopers Cove and Bent Mountain areas of Franklin County. These areas are extremely hard for Franklin County Fire/Rescue units to respond to in a timely manner since they actually have to come into Roanoke County to get each respective area. The revised agreementclarifies the specific areas of mutual aid but does not change the original agreement from 1992. FISCAL I M PACT: The revised agreement will not have a fiscal impact since no changes to the response criteria is involved. ALTERNATIVES: None STAFF RECOMMENDATION: Staff recommends the entering into the revised mutual aid agreement with the County of Franklin, Virginia for fire and rescue services. The revised agreement does not change any current response standards that were established in 1992. This Agreement, made and entered into this day of by and between the COUNTY OF FRANKLIN, VIRGINIA, hereinafter referred to as Franklin County and the COUNTY OF ROANOKE, VIRGINIA, hereinafter referred to as Roanoke County. WITNESSETH WHEREAS, the Board of Supervisors of Franklin County desire to provide the best and most cost- effective fire protection, EMS, and rescue services for their citizens; and WHEREAS, both Franklin County and Roanoke County maintain firefighting and EMS equipment and provide for some of these services with the help of dedicated volunteers, as authorized by sections 27-b.1 and 27-23.6 of the Code of Virginia; and WHEREAS, both the County of Franklin and the Board of Supervisors of Roanoke County have concurred in the effort to develop a mutual aid agreement for improved firefighting and EMS capabilities within and around the jurisdictions of Franklin County and Roanoke County, as authorized by Sections 27-1, 27-2, 27- 4, and 27-23.1 of the Code of Virginia. NOW THEREFORE, for and in consideration of the undertakings hereinafter set out, the parties covenant and agree as follows: 1. Mutual Aid in Firefi hating and EMS/Rescue: a. The Franklin County Department of Public Safety will respond or cause response to any call for mutual aid within Roanoke County, when personnel and equipment are available and can be safely spared. b. The Roanoke County Fire and Rescue Department will respond to any call for mutual aid within Franklin County, when personnel and equipment are available and can be safely spared. Response will be initiated automatically as outlined in the current Standard Operating Procedures of the Franklin County Department of Public Safety or anytime at the request of Franklin County or Franklin County Department of Public Safety units. Automatic mutual aid will be initiated within the boundaries of the fire and EMS/Rescue response zones depicted in the maps Bent Mountain area 1, Bent Mountain area 2, and Mount Pleasant area attached to this document. 2. Assistance in non-designated areas: Franklin County and Roanoke County agree to respond when called to assist in the other areas not described in this agreement when the personnel and equipment are available and can be safely spared. 3. Desi nation of officials: Franklin County and Roanoke County Fire and EMS/Rescue units shall respond to a call for service only upon request of the official designated for that purpose. The parties shall notify one another of the identity of the official or officials designated to request such assistance. 4, Notification of calls: The Roanoke County Communications Center will notify units from Roanoke County of all fire and EMS/Rescue calls received within Franklin County where mutual aid assistance is required. Calls for service received by either locality within the borders of the other jurisdiction will be directed to that jurisdiction for appropriate handling. 5. Application of Department policies: Officers, employees, agents, and volunteers shall comply with the operational policies of their respective departments, The parties agree to hold their own officers, agents, employees, and volunteers, respectively, responsible and accountable for compliance with operational policies of the respective departments. 6. Supervision and control of joint services: Pursuant to Section 27-23.9 of the Code of Virginia, whenever two or more fire companies or departments are called to provide joint services in any district or political subdivision, the commander of the first company to arrive shall have general supervision and control of all such participating companies and departments until an officer of such district or political subdivision who is otherwise authorized by law to do so shall assume such general supervision and control. For the purposes of this section, districts and political subdivisions are concurrent and general supervision and control of firefighting and EMS activities within Franklin County shall be conducted by officers designated in the latest command structure of the Franklin County Department of Public Safety as maintained in writing in that office and approved by the Franklin County Board of Supervisors. 7. Retention of benefits: While acting under this agreement, officers, agents, employees, and volunteers shall have all of the immunities from liabilities and exemptions from laws, ordinances, and regulations and shall have all the pension, relief, disability, workers compensation, and other benefits enjoyed by them while performing their respective duties within the territorial limits of their own political subdivision. 8. Indemnification, save harmless, and liability protection: a. As provided for in Section 27-2 of the Code of Virginia, each party hereby agrees to (1) waive any and all claims against the other parties thereto which may arise out of their activities outside their respective jurisdictions under such agreement; and (2) indemnify and save harmless the other parties for property damage or personal injury which may arise out of the activities of the other parties to such agreement outside of their respective jurisdictions under such agreement. b. To protect the financial interests of each party against liability that may arise, both Franklin County and Roanoke County will provide insurance coverage, or a line-of credit payment bond for services in the amount of no less than $1,000,000 for liability claims that may arise out of activities of the respective parties. Each shall provide the other with sufficient documentation of the coverage's provided in the form of a Certificate of Insurance or Letter of Credit. 9. Liability for lama ed ec~uip_ ment: Neither party shall have liability for destruction, Loss, or damage of any motor vehicle, equipment, or personal property belonging to the other party or representatives of the other party in exercise of any power under or pursuant to this agreement. 10. Immunities not impaired hereby This agreement shall not be construed to impair or affect any sovereign or governmental immunity or official immunity that may otherwise be available to Franklin County or any officer, agent, or employee of Franklin County, or to Roanoke County or any officer, agent, or employee of Roanoke County. 11. Commencement of A reement: This agreement shall become effective upon execution by both parties. 12. Termination of A reement: Any party to this agreement may terminate same, with or without cause, by giving written notice to the other party by certified mail, return receipt requested. Any termination notice must be given at least ninety (90} days prior to July 1st of any given year. This agreement shall continue to be in force from year to year unless terminated as indicated above, or all parties mutually agree to terminate. 13. Entire A reement: This agreement represents the entire and integrated agreement between the parties and supersedes all prior negotiations, representations, or agreement, either oral or written. This agreement may be amended only by written instrument signed by authorized representatives ofall parties. The Multiple Dog Permit shall be for a maximum of five (5) dogs. This is a request by Laura Bryant to obtain a Special Use Permit fora Multiple Dog Permit to allowfive dogs at4607 Fort Lewis Church Road. The 1.005 acre parcel is zoned R-1, Low Density Residential, and designated as Neighborhood Conservation by the 2005 Roanoke County Community Plan. The property meets the zoning ordinance use and design standardsfor Multiple Dog Permits and the request is generally consistent with the policies and guidelines in the Community Plan. 1. APPLICABLE REGULATIONS A Multiple Dog Permit is allowed by Special Use Permit in the R-1 district and is defined as "the keeping, breeding, raising, showing ortraining of four ~4) or more dogs overfour ~4) months of age for personal enjoyment of the owneroroccupants of the property, and forwhich commercial gain is not the primary objective." The Use and Design Standards for a Multiple Dog Permit are: 1. Minimum lot size: One (1) acre; 2. A multiple dog permit shall be permitted only when accessory to asingle-family dwelling; 3. Exterior runs, pens and other confined areas designed to house four (4) or more animals shall be set back at least twenty-five (25) feet from any property line. For the purposes of this section, perimeter fencing of a yard shall not be considered a confined area. 2. ANALYSIS OF EXISTING CONDITIONS Back round -According to the Roanoke County Real Estate records the property is 1.005 acres and zoned R-1, Low Density Residential. The existing one-story, single-family residence was built in 1914 and is located on the southern portion of the property. The property has a private well and septic system. The petitioner attempted to obtain licenses for her dogs and was informed that she would need a Multiple Dog Permit in orderto keep five dogs on her property. She immediately began the process of obtaining a Multiple Dog Permit. She was informed that she did not have the required acreage forthe Permit and went through the process of combining two parcels to bring her lot size to 1.005 acres. The five dogs, all Chihuahuas, are housed indoors with no outside runs. They are allowed outside onlywhen supervised. CONFORMANCE WITH ROANOKE COUNTY COMMUNITY PLAN The property is designated Neighborhood Conservation in the 2005 Roanoke County Community Plan. Neighborhood Conservation areas are where established single-family neighborhoods are delineated and the conservation of the existing development pattern is encouraged. Special Use Permits for Multiple Dog Permits are issued only as an accessory use to asingle-family dwelling. Approval of the requested Special Use Permitwould not change the existing development pattern in the neighborhood. BRYANT WHEREAS Laura F. Bryant has filed a petition for a special use permit for a Multiple Dog Permit to allow five dogs at 4607 Fort Lewis Church Road, (Tax Map No. 054.02-04-10.00-0000 in the Catawba Magisterial District; and WHEREAS the Planning Commission held a public hearing on this matter on October 5, 2010; and WHEREAS the Board of Supervisors of Roanoke County, Virginia, held a first reading on this matter on September 28, 2010; the second reading and public hearing on this matter was held on October 26, 2010. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the Board finds that the granting of a special use permit to Laura F. Bryant for a Multiple Dog Permit for five dogs on 1.005 acres located at 4607 Fort Lewis Church Road in the Catawba Magisterial District is substantially in accord with the 2005 Community Plan, as amended pursuant to the provision of Section 15.2-2232 of the 1950 Code of Virginia, as amended, and that it shall have a minimum adverse impact on the surrounding neighborhood or community, and said special use permit is hereby approved with the following conditions: Page 1 of 2 a.
