HomeMy WebLinkAbout2/13/1996 - Adopted Board RecordsAT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, FEBRUARY 13, 1996 RESOLUTION 021396-1 EXPRESSING THE INTENTION OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO LIMIT ANY INCREASE IN THE REAL ESTATE TAX RATE TO TWO (2) CENTS OR $1.15 PER $100 ASSESSED VALUATION FOR PURPOSES OF RETIRING THE PROPOSED GENERAL OBLIGATION DEBT FOR SCHOOL CAPITAL PROJECTS WHEREAS, the Board of Supervisors of Roanoke County, Virginia has requested the Circuit Court to order the special election to determine the wishes of the citizens of Roanoke County with respect to incurring general obligation debt for public school purposes; and, WHEREAS, said special election is scheduled for April 2, 1996; and, WHEREAS, the School Board for Roanoke County, Virginia, has requested the Board of Supervisors to determine the method of retiring the proposed general obligation debt for public school capital projects; and, NOW THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia hereby expresses its intent to limit any increase in the real estate tax rate to two (2) cents or $1.15 per $100 assessed valuation for the purpose of retiring the proposed general obligation debt for public school purposes and public school capital projects which is the subject of the special election scheduled for April 2, 1996. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF ROANOKE, VIRGINIA: 1. The Board of Supervisors adopts this declaration of official intent under Treasury Regulations Section 1.150-2. 2. The Board of Supervisors reasonably expects to reimburse advances not to exceed $500,000 made or to be made by the County to pay the costs of acquiring, constructing, equipping and developing the Project from the proceeds of its debt or other financings. The maximum amount of debt or other financing expected to be issued for the Project is $4,600,000. 3. This resolution shall take effect immediately upon its adoption. ITEM NUMBER y AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: February 13, 1996 AGENDA ITEM: Request from Virginia Western Community College for Funds for a Natural Science Center and site improvements COUNTY ADMINISTRATOR'S COMMENTS: BACKGROUND: In 1995, Virginia Western Community College requested additional funds from Roanoke County for two purposes. The largest request was for $66,379 toward site improvements. VWCC is required by the Virginia Community College System policy to request :coney for such improvements from the local supporting communities. The second request was for $7,250 for a planned Natural Science Center at the Community Arboretum. The total amount of funds requested for both projects was $73,629. During the 1995/96 budget process, the Board of Supervisors approved funds in amount of $18,801; $5,274 for the scholarship fund, and $13,527 which was the County's share toward construction of the Student Activity Center. The Board did not approve the request for funding for the science center and site improvements. Other local governing bodies approved their share of funds for this projects, and Virginia Western Community College has requested that the County reconsider the request for funds. SUMMARY OF INFORMATION: Virginia Western Community College is requesting additional funds for the following projects: Site Improvements The college is planning to improve student parking conditions through better accessibility and the addition of parking spaces. They are also mandated by the State of Virginia to construct a water retention facility to accommodate current funded construction projects. VWCC requested that the localities contribute $196,340 toward the projects. Roanoke County's share is $66,379. See Attachment A for the local budget request distribution. Natural Science Center at the Community Arboretum The Natural Science Center would complement the greenhouse and Community Arboretum and provide a working area for planting projects, a center for independent research and group lectures, and restroom facilities for volunteers, students and visitors. The proposed facilities would reduce crowding and inefficient use of the greenhouse and would allow expansion of the horticulture programs. VWCC is requesting a $7,250 donation from Roanoke County. See Attachment B for more information on the proposal. ALTERNATIVES AND FISCAL IMPACT: If the Board of Supervisors wishes to provide funds for these two projects, $73,629 should be appropriated from the General Fund Unappropriated Balance. As an alternative, the Board may wish to defer the request until next year's budget. STAFF RECOMMENDATION: Staff recommends that the Board of Supervisors appropriate $73,629 from the General Fund Unappropriated Balance for Roanoke County's share of the site improvements ($66,379) and the Natural Science Center ($7,250) at Virginia Western Community College. The Virginia Western Community College Foundation requests $7,250 from the County of Roanoke to enable construction of a Natural Science Center. This multi- purpose resource facility will complement our greenhouse and Community Arboretum by providing a workirQ area for planting projects, a center for independent research and group lectures, and restroom facilities for volunteers, students, and visitors. While the greenhouse was constructed with state funds, the $139,000 Community Arboretum has been funded entirely by donations from corporations, foundations, citizens and area governments. The proposed facility is needed to reduce crowding and inefficient use of our greenhouse, and to allow both the college and the Friends of the Arboretum, our primary volunteer support group, to expand the horticulture programs that are offered to traditional students and civic groups. Donations of $32,000 have been secured for the purchase of equipment and furnishings. The college president has committed funds for personnel to oversee the operation of the center. The architect has estimated a cost of S187,000 for site preparation and facility construction. A $7,250 donation from the County of Roanoke would contribute greatly to the success of this community project. The Virginia Western Community College Foundation The Virginia Western Community College Foundation was formed in 1981 to facilitate civic and corporate support that promotes a more effective utilization of college programs and facilities. Donations have been used to establish scholarships, provide extracurricular programs and support faculty curricular initiatives. The foundation board administers fund raising programs and provides financial management of funds donated to the college. Please see Appendix A for verification of our 501(c)(3) status.) B. The Community Arboretum The Community Arboretum has been funded, constructed and maintained through a cooperative agreement between the college and the Community Arboretum Advisory Committee. Planning and construction were started in 1989, and the final conifer plant section was completed in 1993. Over $139,000 and innumerable volunteer hours have been given by the community for the construction and operation of the facility. The college provides administrative. maintenance and promotional support. (Please see Appendix B for a pictorial development of the arboretum.) 2 II. Project Description The Natural Science Center, which % ill be constructed adjacent to the greenhouse, % ill address three functional requirements of the horticulture program: 1. A "resource ::enter," which will enable horticulture research, planning and instruction with computer ,programs, drafting boards and a presentation area, 2. A "head house," which will ,provide space for planting projects and equipment storage, thereby enabling efficient use got the greenhouse, and 3. Restrooms and «ash facilities for volunteers, visitors, students and faculty. (Please see Appendix C for architectural design.) These three requirements must be met for the Community Arboretum to effectively provide horticultural education and a nature -based recreational experience. The programs provided by The Natural Science Center will advance the community's understanding of ecological processes, botanical relationships. and horticultural practices. Furthermore. The Community Arboretum promotes the appreciation of natural beauty that is often a prerequisite for the development of an individual's environmental ethic. III. Project Benefits As the only comprehensive public educational garden in the eight -county Virginia Western Community College service area, the arboretum serves as the primary source for horticulture site visits by scholarly and civic organizations. (Please see Appendix D for a list of organizations that received structured tours.) The Natural Science Center will 3 J, r f� 7 provide arbo; twrn visitors with the opportunity to go beyond a visual appreciation of the garden and L elop a scientific understanding of plants. By providing demonstrations on soil analvsis. --omputer-assisted landscape planning, and traditional propagating, planting and potting p-actices, the center will illustrate the entire :ife process rather than just the static product. Also, as a living laboratory, the center v. -ill offer the hands-on experiences that reinforce classroom studies and fulfill curricular requirements for experiential learning. The arboretum has frequently been visited by school groups interested in using plant projects to integrate experiential -based studies of the environment with the traditional science curriculum. The site visits have been useful in providing inspiration and an understanding of the challenges involved in creating a garden. The research center and head house would provide the infrastructure needed to provide guidance to these classes. Warren Crawford, principal at Fairview Magnet School for Plants and Animals, has asked for assistance in providing teacher and volunteer training. Tom Dunleavy, principal at Fishburn Elementary School, has asked for help in developing a site plan for a landscaped amphitheater. Other school officials have called for information on planting wildflowers.:rees and flower gardens. The new facility would enable the offering of a multi -stage visitation and training program that follows the plant cycle from site preparation and species selection to planting and maintenance. This program will provide inter -generational opportunities by allowing students and volunteers of all ages to share their expertise with one another. 4 The Natural Scien;. Center will also facilitate individual and group efforts to plan, plant and maintain beautir---ation projects. The resource center will provide the informational resources required for planning, and the head house will provide the laboratory for learning the techniques needed for successful plant management. The local extension service, which offers a Master Gardener program for plant enthusiasts, has agreed to provide voluntet.-s for the horticulture program in exchange for use of the facilities. This partnership will be especially valuable as the center becomes integrated with the one -credit hortic;:iture seminars which are currently oversubscribed. (Please see Appendix E for seminar i::ting.) The facility will alio allow for a significant increase in greenhouse productivity. Inadequate storage and planting operations currently limit the greenhouse to 75% capacity and suboptimal performan: e. The increased productivity will allow for an expansion of our annual plant giveaway. our periodic plant sales, and our contribution of plants to college departments which want to recognize visitors. IV. Evaluation The Natural Science Center has been specifically designed to enhance the effectiveness of the existing greenhouse, arboretum and horticulture program. Following construction, the arboretum committee will document changes in the level of external partnerships with school and civic groups, the accessibility of information for research and planning, the quantity- and quality of structured site visits and related class 5 enrollments, and the productivity of the greenhouse. Each of these indicators �vili be measured through analysis of data, sur: eys and personal interviews with K-12 teachers, Master Gardeners, and students and vi_itors of all ages. V. Future Funding The college has committed funds for personnel cost, operating and maintenance costs. The research facility equipment. which cost $32,200, has been purchased through budgeted local funds. The Beirne Caner Foundation has approved a grant for $1.000 for construction of the horticulture center. This proposal is part of a comprehensive campaign which will receive internal foundation support and target the following two groups: 1. Presently supportive individuals, corporations, foundations and local governments. These include the "Friends of the Arboretum," Roanoke Gas, Shenandoah Life Insurance, The Valley Beautiful Foundation, Roanoke City and County, Salem City, Franklin County, and others. 2. Potential new sources of support such as regional foundations and corporations. These include potential "in-kind" donors such as SFCS Engineering and Architectural Firm, Appalachian Power Company, Lionberger Construction, and others. i Vie V111 also approach The Allstate Foundation. Other Foundation Support $50.000 15,000 rcvd A-021396-5 ACTION # ITEM NUMBER E—S AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: February 13, 1996 SUBJECT: Request for Funding for Survey of East County Residents COUNTY ADMINISTRATOR'S COMMENTS: /� BACKGROUND INFORMATION: The Board of Supervisors instructed Staff to investigate the cost of conducting a survey of residents living in the East County area between the Town of Vinton and the Bedford County border. The survey is to determine the satisfaction level of County residents in that area, and to elicit the opinion of those residents on the topic of annexation into the Town of Vinton. There are approximately 4,000 residents living in that part of Roanoke County. SUMMARY OF INFORMATION: Staff has been advised by two research organizations that due to the complexity of the issue to be addressed, at least 300-400 residents should be contacted to obtain a valid survey result. The survey can be conducted by Martin Research within 30 days of approval by the Board, with results available shortly thereafter. FISCAL IMPACT: The cost of drafting the document, conducting the telephone survey, and preparing a report analyzing the results is $7500. Funds are currently available in the Board contingency account. RECOMMENDATION: $7500 from the Board residents. Hyatt, Director, Finance A-021396-6 Action Number - " Item Number = '-D AT A REGULAR MEETING OF THE ROANOKE COUNTY BOARD OF SUPERVISORS HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: February 13, 1996 SUBJECT: Request from Town of Vinton for County to Provide Water if Wells Become Contaminated in the Future COUNTY ADMINISTRATOR'S COMMENTS: BACKGROUND: In November, 1994, the Board of Supervisors approved the petition of Shanks Associates P.C. for rezoning of a tract of land at the intersection of Washington Avenue and Feather Road and authorized a Special Use Permit to allow construction of a convenience store there. Conditional approval of the use of coal combustion byproduct (CCBP) as fill material at the site was included. The convenience store site is close to the public wells that supply water to the Town of Vinton and east County. During the rezoning procedure, there were questions about possible contamination from the fill material. Before the rezoning was approved, the County received assurance from the U. S. Environmental Protection Agency and from the State Depart- ment of Environmental Quality that CCBP is not considered hazardous, that its use as fill material is appropriate, and that there is no risk to humans or the environment. At the October 17, 1995, meeting of the Roanoke County Board of Supervisors and the Vinton Town Council, Council members expressed concern about the possible contamination of Bush wells 1, 2, and 3 by the CCBP. Councilmen Buford Barton and Bill Obenchain asked if the County would be responsible for providing water to the Town if those wells become contaminated. The Board responded that the CCBP material has passed all federal and State tests for this use and that the County has been assured that there will be no contamination. In fact, denial of the property owner's request to use CCBP for fill could have resulted in a law suit against the County. However, the Town has requested official commitment from the Board that if it becomes necessary the County will provide water to Vinton at a cost no greater than the Town's then -effective water rate. Because this issue is so important to the Town and because of the -2- E-6 potential cost to the County, staff felt documentation of the wells' water quality was desirable and had the wells tested to establish a baseline. They will be re -tested in six months to a year and periodically there- after. Copies of all correspondence and tests have been sent to KBK Enterprises, Inc., the company providing the fill material. It will be clear to them that they are considered responsible for any contamination. FISCAL IMPACT: There will be an ongoing cost of about $1,000 annually for testing the three wells. If approved, the cost will come from the Utility Fund, which will be reimbursed from the General Fund. RECOMMENDATION: Staff recommends that the following actions be taken: [1] That the County, at its expense, monitor Bush wells 1, 2, and 3 on a semiannual or annual basis; [2] That if the wells become contaminated and it is determined that the contamination came from the CCBP fill material, the County will act jointly with the Town as necessary to provide the Town and east County with water; and [3] That the generator (American Electric Power, formerly Appalachian Power Company) and the provider (KBK Enterprises, Inc.) of the fill material and the property owner (Gerald W.
