RESOLUTION 120297-1 OF CONGRATULATIONS TO WILLIAM BYRD HIGH
SCHOOL GOLF TEAM FOR WINING THE 1997 AA STATE CHAMPIONSHIP
WHEREAS, team sports are an important part of the curriculum at schools in
Roanoke County, teaching cooperation, sportsmanship and athletic skill; and
WHEREAS, the William Byrd High School Golf Team, won the 1997 AA State
Championship, shooting 29 shots better than Salem, the second place team; and
WHEREAS, the William Byrd golf team also won the Group AA State Championship
in 1992, and during this season won the Heritage Invitational Championship and the
Region III Championship.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke
County, Virginia, does hereby extend its sincere congratulations to the members of the
William Byrd High School Golf Team: Robbie Craft, Mike Damiano, Scott Wise, Tommie
Austin, Brian Mahanes, Chris Koon, Marc Patrouch, and Coach Tim Chocklett, for their
athletic ability, their team spirit, and their commitment to each other; and
FURTHER, BE IT RESOLVED, that the Board of Supervisors extends its best
wishes to the team members, the coach,and the school in their future endeavors.

AGENDA ITEM: Request for an appropriation to complete projects at the Valley Gateway
Business Park in eastern Roanoke County
COUNTY ADMINISTRATOR'S COMMENTS:
Recommend approval of this request with funds to be taken from the Economic Development
account. Your approval is necessary because the cost has exceeded the appropriation by $10, 000
due to additional land being required. This makes the project more valuable and we will be
reimbursed when the property sells in the near future.
EXECUTIVE SUMMARY:
Roanoke County executed a multi-party agreement on December 22, 1996 with the Greater Roanoke
Valley Development Foundation, the Industrial Development Authority of Roanoke County and
Fralin & Waldron that outlined the responsibilities of each party regarding the construction of the
shell building and the development of Valley Gateway. The Board of Supervisors approved an
appropriation of $599,250 on November 19, 1996 that allocated funds to various project elements
at Valley Gateway. The shell building site has been acquired and conveyed to the Greater Roanoke
Valley Development Foundation and an industrial shell building is being constructed thereon.
Roanoke County was successful in obtaining approval of $200,000 of industrial access road funding
for the construction of Valley Gateway Boulevard. Subsequently, a construction contract has been
awarded to E.C. Pace for the construction of the industrial access road, turning lanes in Route 460,
and on-site utility improvements. Completion of the shell building and industrial access road are
scheduled for late December 1997.
SUMMARY OF INFORMATION:
The actual costs for the completion of the Valley Gateway project are estimated to be $609,312.54
This projection is $10,062.54 higher than the appropriation of $599,250 (see attached). The cost of
the shell building site was higher because the final survey showed additional acreage that needed to
be conveyed to the Foundation.
Under the terms of the multi-party agreement, the County is obligated for $75,000 of grading costs,
plus one-half of additional grading costs over $200,000. The County's share of the grading costs are
$131,232.50 because rock was encountered during excavation.
Administrative costs for engineering, legal, appraisals, environmental assessments and bond costs are
less than the projected $40,000 amount. The $40,000 projected for the County's portion of the
VDOT Revenue Sharing Program was paid from funds appropriated for that purpose by the Board
and not charged to the Valley Gateway appropriation.
Staff is also seeking a grant as reimbursement up to $1,000 from American Electric Power Company
for the costs of preparing a marketing brochure for the shell building.
Staff requests that the Board of Supervisors authorize an expenditure of $10,062.54 from the
Economic Development Fund to complete the Valley Gateway project.
FISCAL IMPACT:
Roanoke County has appropriated $599,250 for the Valley Gateway project. An additional
$10,062.54 is projected to be needed to close out the project. Funds for this purpose are available
in the Economic Development Capital Fund balance.
ALTERNATIVES:
1. Authorize an expenditure of $10,062.54 from the Economic Development Capital account
to complete the Valley Gateway project.
2. Authorize an appropriation of $10,062.54 from the Unappropriated Fund balance to complete
the Valley Gateway project.
3. Do not take any action at this time.

Staff recommends that the Board of Supervisors approve Alternative # 1.

BACKGROUND INFORMATION:
The 456.60 acres recently purchased by the County from Glenn -Mary Associates included three
occupied houses and 200+ acres of fenced farm land. Until the entire tract is developed, it will be
mutually beneficial to the County to the tenants to continue the current usages. We have issued a
Request for Proposal for the farm lease and expect that the current rental/leasing arrangements
will be in place for the next two years, although they could continue after the first two years if
conducive to the development plans. The farmland and each of the residences would require
individual contracts from the County which will be brought to the Supervisors at a later date for
consideration.
FISCAL IMPACT:
Beginning with December 1997, the monthly rental checks deposited with the County will total
$1,125. An exact payment amount for the farm lease has not been determined as the potential
leasees were given the option of monetary payments and/or improvements.
Past experience with property management in the County has demonstrated that maintenance and
upkeep of residential property can be expensive. The Maintenance and Repair line item is
requested as an attempt to defray future expenses.

STAFF RECOMMENDATION:
Staff recommends the authorization of a self balancing account entitled Maintenance and Repair
for the Corporate Technology Park (CTP) to be funded from the corresponding rental income, as
a devise to encourage the property management portion of the project to be self-supporting.

AGENDA ITEM: Request for an Additional Appropriation for the
Underground Storage Tank Removal Project
COUNTY ADMINISTRATOR'S COMMENTS:
BACKGROUND:
The Department of General Services has been coordinating the
removal of underground storage tanks on County properties.
$160,000 was previously appropriated for the removal of tanks at
the Fire Department sites. We were unable to predict the cost of
any remedial action that might be required from tanks which had
leaked product into the soils or which may have ruptured during
removal. Once work starts on a particular site, you must continue
with the remediation of that site under the guidelines established
by the Department of Environmental Quality (DEQ) using contractors
who are qualified and licensed to handle environmental monitoring
and clean-up of such sites. To date, tank closure (removal of the
old tank, site remediation if required and installation of newer,
smaller, above ground tanks) has been completed and approved at the
Catawba Fire Station, Hollins Public Safety Building and Mason's
Cove Public Safety Building. Work has generally been completed and
we are awaiting final approval of the closure at the Mt. Pleasant
and Ft. Lewis sites. Follow up (remediation) work will be required
at the Clearbrook, Bent Mountain and Cave Spring sites where
leakages had occurred. We are awaiting the direction of DEQ and
working with the County's consultant to close these sites as
quickly and inexpensively as possible.
The cost for the removal of tanks to date is $146,985 plus the
cost associated with the concrete pads at the fuel pump sites and
for the disposal of contaminated soils and product in drums of
$17,722 which has been charged to the original appropriation.
In addition to the tanks at the Fire Station sites, there are
two tanks which were not identified in the original inventory which
must still be addressed. A 1,000 gallon tank at the Jail/Courthouse
complex which fuels the emergency generator must be replaced and a
10,000 gallon tank at Kessler Mill Road that has not been used by
the County must be removed.
The chart below shows the projected costs for the known work
to be accomplished at the sites noted above:

The tank removal process must be completed by December 31,
1998. Delays would likely result in higher costs because the
qualified contractors are quickly filling their schedules with
other requests to remove tanks before the deadline.
The school system is responsible for removing and/or testing
the tanks at their fueling and storage sites which is not covered
under this request. Their work is continuing at this time.
FISCAL IMPACT:
The balance required to complete the removal of the tanks and
remediation of any preliminary findings is $65,983. Should
additional work be required by the Department of Environmental
Quality to close out these sites, an additional appropriation may
be necessary. It is suggested that this appropriation come from
the unappropriated fund balance.

ORDINANCE 120297-5 AUTHORIZING THE EXECUTION OF A LEASE OF
REAL ESTATE, OFFICE SPACE FOR THE COURT SERVICES UNIT
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That pursuant to the provisions of Section 18.04 of the Charter of Roanoke
County and pursuant to the authority found in §§ 15.1-262 and 15.1-897 of the 1950 Code
of Virginia, as amended, the acquisition of any interest in real estate, which includes a
lease of office space, shall be accomplished by ordinance; and
2. That pursuant to the provisions of Section 18.04 of the Charter of Roanoke
County the first reading on this ordinance was held on November 18, 1997, and the
second reading was held on December 2, 1997, concerning the lease of office space for
the use of the Court Service Unit at the Salem Bank and Trust Building in the City of
Salem, together with all appurtenances thereto belonging; and
3. That this lease is with East Main Street Properties, L.L.C. of approximately
550 square feet of office space for a term commencing the 1 st day of January, 1998, and
ending the 31st day of December, 1998, for an annual rental of $4,812.50, payable in
equal monthly installments of $401.04.
4. That the lease agreement setting forth the terms and conditions of this lease
is incorporated herein by reference.

5. That the County Administrator is authorized to execute this lease on behalf
of the County of Roanoke and to execute such other documents and take such other
actions as are necessary to accomplish this transaction all of which shall be upon form
approved by the County Attorney.

ORDINANCE 120297-06 AUTHORIZING QUIT -CLAIM AND RELEASE OF
WATER AND SANITARY SEWER EASEMENT WITHIN BOUNDARIES OF
CHAGALL DRIVE AND LOCATED BETWEEN LOT 1, BLOCK 3, SECTION
2, AND LOT 3A, BLOCK 2, SECTION 1, OF THE GARDENS OF COTTON
HILL.
WHEREAS, in order for Chagall Drive to be accepted into the state secondary road
system, the Virginia Department of Transportation (VDOT) requires that the right-of-way
be free and clear of any third party rights or encumbrances; and,
WHEREAS, VDOT has requested quit -claim and release of an existing water and
sanitary sewer easement within the boundaries of Chagall Drive and located between
Lot 1, Block 3, Section 2, and Lot 3A, Block 2, Section 1, of the Gardens of Cotton Hill,
to the Commonwealth of Virginia, subject to certain conditions; and,
WHEREAS, it will serve the interests of the public to have Chagall Drive accepted
into the state secondary road system and the release, subject to the issuance of a permit
and other conditions, will not interfere with other public services and is acceptable to the
Roanoke County Utility Department.
THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That pursuant to the provisions of Section 18.04 of the Roanoke County
Charter, the acquisition and disposition of real estate can be authorized only by ordinance.
A first reading of this ordinance was held on November 18, 1997; and a second reading
was held on December 2, 1997; and,
2. That pursuant to the provisions of Section 16.01 of the Charter of Roanoke
County, the interests in real estate to be released are hereby made available for other
public uses by conveyance to the Commonwealth of Virginia for acceptance of Chagall
Drive into the state secondary road system by the Virginia Department of Transportation
(VDOT).
3. That quit -claim and release of the water and sanitary sewer easement within
the boundaries of Chagall Drive and located between Lot 1, Block 3, Section 2 and Lot 3A,
Block 2, Section 1 of the Gardens of Cotton Hill, to the Commonwealth of Virginia, is
hereby authorized subject to the following conditions:
a. VDOT issuance of a permit for the water and sanitary sewer lines or
facilities.
b. The facilities located within the 50 -foot right-of-way, between Lot 1,
Block 3, Section 2, and Lot 3A, Block 2, Section 1, of the Gardens of
Cotton Hill, may continue to occupy the street or highway in the
existing condition and location.
C. The release would be for so long as the subject section of Chagall
Drive is used as part of the public street or highway system.
4. That the subject easement is not vacated hereby and shall revert to the
County in the event of abandonment of the street or highway.
5. That the County Administrator is hereby authorized to execute such
documents and take such further actions as may be necessary to accomplish this
conveyance, all of which shall be on form approved by the County Attorney.
6. That this ordinance shall be effective on and from the date of its adoption.

WHEREAS, Thomas Moore, the petitioner, has requested that the Board of
Supervisors of Roanoke County, Virginia, vacate and close an unimproved, unnamed and
unused right-of-way, ninety feet (90') in width at its intersection with Wildwood Road
(Virginia Secondary Route 619), shown on the plat of Lee Mitchell Subdivision recorded
in the Clerk's Office of the Circuit Court of Roanoke County, Virginia, in Plat Book 3, page

in the Catawba Magisterial District of Roanoke County, Virginia; and,
WHEREAS, §15.1482 (b) of the 1950 Code of Virginia, as amended, requires that
such action be accomplished by the adoption of an ordinance by the governing body; and,
WHEREAS, notice has been given as required by §15.1-431 of the 1950 Code of
Virginia, as amended, and the public hearing and first reading of this ordinance was held
on November 18,1997; and the second reading of this ordinance was held on December
2, 1997.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That an unimproved, unnamed, and unused right-of-way, being ninety feet (90')
in width at its intersection with Wildwood Road (Route 619), shown on the plat of Lee
Mitchell Subdivision recorded in the aforesaid Clerk's Office in Plat Book 3, page 203,

being designated on the Roanoke County Land Records as Tax Map No. 44.04-2-37.3 and
being specifically shown on Exhibit A attached hereto, be, and hereby is, vacated and
closed pursuant to Section 15.1-482(b) of the 1950 Code of Virginia, as amended; and,

public utility installations as provided in §15.1-483 of the Code of Virginia, (1950, as
amended).
3. That all costs and expenses associated herewith, including but not limited

RESOLUTION 120297-8.d SUPPORTING THE INCREASE OF THE
"TWO -FOR -LIFE" FUNDING FOR THE BENEFIT OF RESCUE SQUADS
TO A 14 -FOR -LIFE" PROGRAM
WHEREAS, the emergency medical services system of the Commonwealth of
Virginia provides invaluable service to the citizens of Virginia; and
WHEREAS, there exists a need to adequately fund the infrastructure of the E.M.S.
system, which includes funds that are returned to the localities for E.M.S., funds for
equipment grants, support for the regional E.M.S. councils, and funding for training and
many other elements of the E.M.S. system; and
WHEREAS, funding for all of these needs has remained constant for the past seven
years, and is provided totally through the "Two -for -Life" motor vehicle registration add-on
special fund without any support from the State's general fund; and
WHEREAS, the Board of Supervisors of the County of Roanoke recognizes the
increased costs to operate Virginia's E.M.S. system, and the need to increase that source
of funding to carry the system into the next century and to meet the many increased
demands.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the
County of Roanoke does hereby endorse the proposed 14 -for -Life" initiative to be
presented to the Virginia General Assembly at its upcoming session; and
FURTHER RESOLVED that the Board of Supervisors of the County of Roanoke
communicates this endorsement to appropriate members of the Virginia General

Assembly.

CRIME CONTROL MONIES FOR THE 1996-98 BI-ENNIUM
WHEREAS, the County of Roanoke has previously submitted budget plans for
the expenditure of the VJCCCA Crime Control monies for each fiscal year of the
biennium to the Department of Juvenile Justice, and
WHEREAS, at June 30, 1997, $246,008 of the County's allocation remained
unspent which we now need to allocate to different categories to pay for services to the
qualified youth of our community, and
WHEREAS, in order to reallocate said monies, a resolution of support from the
governing body and letters of support from the Court Service Unit and Juvenile Court
are to be submitted to the Department of Juvenile Justice for consideration.
NOW, THEREFORE BE IT RESOLVED by the Board of Supervisors of Roanoke
County that the Department of Juvenile Justice is hereby requested to reallocate the
unspent monies from FY 1996-97 for use during FY 1997-98 in the following
categories:

SUBJECT: Acceptance of Water and Sanitary Sewer Facilities Serving Parkway Place,
Section 1

SUMMARY OF INFORMATION:
The Developers of Parkway Place, Section 1, V&S Development, L.L.C., have requested that
Roanoke County accept the Deed conveying the water and sanitary sewer facilities serving the
subdivision along with all necessary easements.
The water and sewer facilities are installed, as shown on plans prepared by Lumsden Associates
entitled Parkway Place, Section 1, which are on file in the County Engineering Department. The
water and sanitary sewer facility construction meets the specifications and the plans approved by the
County.
FISCAL IMPACT:
The value of the water and sanitary sewer construction is $32,800 and $ 55,000 respectively.
RECOMMENDATION:
Staff recommends that the Board of Supervisors accept the water and sanitary sewer facilities serving
the Parkway Place, Section 1 subdivision along with all necessary easements, and authorize the
County Administrator to execute a Deed for the transfer of these facilities.

by and between: V & S Development, L.L.C. , a Virginia corporation, hereinafter referred
to as the "Developer," parry of the first part; and the BOARD OF SUPERVISORS OF ROANOKE
COUNTY, VIRGINIA, its successors or assigns, hereinafter referred to as the "Board," party of the
second part.
:WITNESSETH:
THAT FOR AND IN CONSIDERATION of the mutual benefits accruing to the parties, the
receipt and sufficiency of which is hereby acknowledged, the Developer does hereby GRANT,
CONVEY, ASSIGN AND TRANSFER, with the covenants of GENERAL WARRANTY OF
TITLE, in fee simple unto the Board all water and/or sewer lines, valves, fittings, laterals,
connections, storage facilities, sources of water supply, pumps, manholes and any and all other
equipment and appurtenances thereunto belonging, in and to the water and/or sewer systems in the
streets, avenues, public utility, easement areas, water and sewer easement areas that have been or
may hereafter be installed by the Developer, along with the right to perpetually use and occupy the
easements in which the same may be located, all of which is more particularly shown, described and
designated as follows, to wit:

As shown on the plan entitled Parkway Place, Section I , made by Lumsden
Associates P.C. and on file in the Roanoke County Engineering Department.
The Developer does hereby covenant and warrant that it will be responsible for the proper
installation and construction of the said water and/or sewer systems including repair of surface areas
affected by settlement of utility trenches for a period of one (1) year after date of acceptance by the
Board and will perform any necessary repairs at its cost.
Elmer C. Hodge, County Administrator of Roanoke County, Virginia, hereby joins in the
execution of this instrument to signify the acceptance of this conveyance pursuant to Resolution No.
adopted by the Board of Supervisors of Roanoke County, Virginia, on the

RESOLUTION 120297-9 CERTIFYING EXECUTIVE MEETING WAS HELD
IN CONFORMITY WITH THE CODE OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened
an executive meeting on this date pursuant to an affirmative recorded vote and in
accordance with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by the
Board of Supervisors of Roanoke County, Virginia, that such executive meeting was
