AGENDA ITEM: Request to Appropriate Funds to the Reserve for Future School Capital
COUNTY ADMINISTRATOR'S COMMENTS:
This shows significant and continuing support of the Blue Ribbon Committee Phase I School Capital Plan.
Financially, we are preparing ourselves, as planned in January 1996, to fund $47.7 million for Phase 1.
All of these funds will be needed for debt service payments for Phase 1.
SUMMARY OF INFORMATION: The FY 1997-98 Debt Fund budget contains several line items that will
not need to be expended during the current fiscal year while certain Literary Loans are in the process of
being finalized. These include budgets for the Northside Gym, Cave Spring Junior High, William Byrd
High, and Fort Lewis Elementary. Since these Literary Loans have only recently been closed or are now
in the process of being closed, the first debt payment will be scheduled for FY 98-99. The total amount
budgeted in the 1997-98 debt budget for these projects was $321,772.
Due to the timing of the literary loan closings, staff requests permission to transfer $321,772 from the Debt
budget to the Future School Capital budget. These funds will be used to offset debt payments that will be
incurred as a result of Phase I of the School Capital Improvement Program. The balance in the Future
School Capital Fund is as follows:

AGENDA ITEM: Request to appropriate funds for four emergency -funded
corrections deputy positions, to be partially funded by the State
Compensation Board for FY98-99. This request also includes an
amendment to the County Classification and Pay Plan to temporarily
accept these positions into the plan until state funding expires on
June 30, 1999.
COUNTY ADMINISTRATOR'S COMMENTS:
Recommend approval of the 4 positions and funding as requested. I prefer Alt. #2, using any funds
remaining in the Sheriff's budget this year. If there are no funds or insufficient funds for the full County
share of $33,740, then the funds would be taken from the Unappropriated Fund Balance.
BACKGROUND: On several occasions, the Sheriff has updated the Board
on staffing needs at the Roanoke County -Salem Jail due to an
increased inmate population. For FY 97-98 the State Compensation
Board granted Roanoke County two temporary positions to deal with
overcrowding in the jail. These positions were primarily funded by
the Compensation Board for a period of one year, with continuation
of funding to be evaluated on a yearly basis. The Board of
Supervisors provided supplemental funding for the unreimbursed cost
of the two emergency positions out of Board Continency. Recent
notification from the Compensation Board has indicated that for
FY98-99, the Sheriff's Office will receive funding to provide four
emergency corrections deputies for jail overcrowding. These
positions are designated for FY 98-99 and would be reevaluated in
FY 99-00.
SUMMARY OF INFORMATION: I am requesting that the Roanoke County
Board of Supervisors accept the state funding for one Grade 23,
Administrative Analyst and three Grade 19, Deputy Sheriff positions
and include them in the Roanoke County Classification and Pay Plan,
effective for FY1998-99.
FISCAL IMPACT: The total impact is $130,188.74. The State
Compensation Board will be responsible for $96,448.88, leaving a
difference of $33,739.86 to be supplemented by the county. The
county supplement is needed because the Compensation Board does not
cover all fringe benefits and also recognizes a lower salary
reimbursement rate for corrections deputies than is paid by Roanoke
County.
STAFF RECOMMENDATION: Staff recommends appropriation of $96,448.88,
in revenue reimbursement from the Compensation Board and a related
expenditure increase in the Sheriff's personnel budget of
$130,188.74. The difference between the increased revenue
appropriation and the increased expenditure appropriation of
$33,739.86 will have to be allocated from existing funds.
Alternative 1: Transfer of $33,740 from the Board Contingency
account on 7/1/98. This alternative is consistent
with prior years' funding for this purpose.
Alternative 2: Allocate year-end expenditure savings by rolling
FY97-98 funds over to cover the FY98-99
expenditures; however, year-end savings are not
guaranteed. A shortage of funds available to
rollover would dictate the supplemental funds be
allocated from Unappropriated Fund Balance.

SUBJECT: Request to amend the Roanoke Area Libraries automation contract
and establish the position of RAL Automation Coordinator

BACKGROUND INFORMATION:
In 1989, Roanoke County entered into a contract with the cities of Salem and Roanoke to
establish and maintain a shared integrated automation system. The resultant consortium,
Roanoke Area Libraries (RAL), has successfully and economically operated a shared online
catalog and circulation system, and has also made it easier to share books and services through
the use of a unified catalog and valley -wide library card. Library users in all participating
localities have benefitted from improved services and the cost -savings realized through the use
of shared resources. The terms of the original contract defined a cost allocation formula based
on factors such as use levels and database size; broadly outlined general system support
obligations, including the provision of a central processing site in Roanoke City; and, established
the means for governance of the system. All of the members contribute funding, based on the
contractual formula, toward database application maintenance and licenses, equipment
maintenance, central site services, and the services of a shared coordinator position. The
Automation Coordinator monitors all systems hardware and software applications performance;
detects and corrects technical problems; provides on-call troubleshooting assistance for staff at
all 17 sites; supervises system upgrades and improvements; designs and produces system reports;
serves as the primary vendor liaison for the system; and, provides training sessions and materials
for staff and the public. In 1995, the contract was amended to allow Botetourt County to join
RAL as a full partner.
SUMMARY OF INFORMATION:
The position of RAL Automation Coordinator will soon become vacant. This circumstance, and
the RAL directors' concern regarding continual and rapid technological change, motivated the
directors to seek some changes in the operational arrangements of the RAL consortium.
The directors recommend that the contract be amended to allow the coordinator position to be
attached to Roanoke County Public Library. In addition, by a majority decision of the
participants and by action of the contract's Library Automation Committee, the position could
in the future be moved to any of the partners' library systems. The position's placement with
Roanoke County seems appropriate given the leadership role the county has assumed within the
RAL and considering the fact that we are the heaviest user of the automated system. Also, after
eight years as a city position, the directors felt that movement among the members could be
beneficial and help emphasize that the position serves all RAL members. In addition to this
provision, the RAL directors also request that the contract be amended to allow for flexibility
in responding to the changes that will be introduced by a likely transition from a central
processing structure to a server -based environment where much of the processing is
accomplished with client software on pc's. With less dependence on a central site we may
logically anticipate some alterations in our hardware distribution and in the services needed to
support the processing functions of the automated system. Attachment A presents the full text
of the proposed amendment.
FISCAL EVIPACT:
There is no direct fiscal impact on the County. Salary and benefits for the coordinator position
would remain subject to the contractual formula and continue to be shared by all parties. Future
changes in the central site configuration will probably help contain costs.
ALTERNATIVES:
Alternative t: Authorize the County Administrator to execute the amendment to the RAL
contract which is approved as to form; and, authorize the addition of the RAL Automation
Coordinator position to the County Classification Plan in a category similar to those reserved
for Roanoke Valley Television and the Roanoke Valley Greenway Project. These actions are
contingent on the formal approval of the other RAL participants. Alternative 2: Do not approve
the amendment and RAL operations will continue under the original provisions of the contract.
STAFF RECOMMENDATION:
The staff recommends that the Board adopt alternative 1.

AMENDMENT NO. 2
THIS AMENDMENT, made and entered into this day of 11998,
between the CITY OF ROANOKE, a municipal corporation chartered under the laws of the
Commonwealth of Virginia; CITY OF SALEM, a municipal corporation chartered under the laws
of the Commonwealth of Virginia; COUNTY OF ROANOKE, a county chartered under the laws
of the Commonwealth of Virginia; and the COUNTY OF BOTETOURT, a political subdivision
of the Commonwealth of Virginia.
WHEREAS, by Contract dated January 26, 1990, (the "Contract"), the City of Roanoke,
City of Salem, and County of Roanoke, agreed to establish an Integrated Automated Library System
(the "System"), more particularly described in that Contract and to allow allocation of the System's
cost; and
WHEREAS, by Amendment dated May 8,1995 (Amendment No. 1 "), the City of Roanoke,
City of Salem, County of Roanoke, and County of Botetourt, amended the Contract to provide for
Botetourt County to participate in the System and to allow allocation of the System's cost; and
WHEREAS, the City Councils for the Cities of Roanoke and Salem, and the Boards of
Supervisors for the Counties of Roanoke and Botetourt, have authorized by appropriate resolution
or ordinance this Amendment which allows the Automation Coordinator to be in the classified
service of any of the parties and provides that the Advisory Committee by agreement can amend the
definition of Central site components, based on new technology.
THEREFORE, IN CONSIDERATION of the above premises and other good and valuable
consideration, the parties hereto mutually agree as follows:
1. Paragraph No. 4 of the Contract is amended to read as follows:
The membership of the Library Automation Committee shall consist of:
City of Roanoke Librarian
Director of the City of Salem Public Library
Director of the County of Roanoke Public Library
Director of the County of Botetourt Public Library
Data Processing Manager of the City of Roanoke
Data Processing Manager of the City of Salem
Data Processing Manager of the County of Roanoke
Micro Computer Analyst of the County of Botetourt; and
Automation Coordinator
The Automation Coordinator will be a library employee in the classified service of the
County of Roanoke. However, should one of the other parties to this Amendment wish to have the
Automation Coordinator be in the classified service of that locality, and the Library Advisory
Committee determines that it is appropriate for the Automation Coordinator to be in the classified
service of that locality, the Automation Coordinator shall be thereafter in the classified service of
said locality.
ATTACHMENT A
In any and all matters requiring a vote by the members of the Library Automation Committee,
each participating library shall have one vote.
2. Paragraph No. 6 of the Contract is amended to read as follows:
The City of Roanoke shall provide space, at no cost to the participating libraries, to house
the Central Site Components of the System, such space hereinafter referred to as the Central Host
Site. Central Site Components shall consist of the products set forth in Appendix D of the
Contract.
Given technology which may develop, the parties recognize that the definition of the
Central site Components may need to be changed in the future. The Library Advisory
Committee can amend Appendix D to reflect any necessary changes, subject to the approval of
the City Managers and County Administrators of the localities. Additionally, the Library
Advisory Committee may, at its discretion, determine that one or more of the jurisdictions other
than or in addition to the City of Roanoke shall provide space, at no cost to the participating
libraries, to house the Central Site Components of the system provided the City Manager or
County Administrator for the locality agrees to house such Central Site Components.
3. Except as changed or modified herein, the terms, conditions and obligations of
Amendment No. 1 and the Contract remain in full force and effect as if fully stated herein.

their signature and seals to this Amendment No. 2, executed in quadruplicate.

AGENDA ITEM: Request for Acceptance of the School Board Resolution
establishing a Joint School Construction Advisory Committee
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
Attached is a resolution adopted by the School Board outlining the scope and purpose of
the Joint School Construction Advisory Committee. The committee will be comprised of
two members of the School Board and two members of the Board of Supervisors, the
School Superintendent and the County Administrator. The resolution was adopted at a
special meeting of the School Board today, June 23, 1998.
1 recommend acceptance of the resolution that is attached because of the importance of
moving forward with construction on the projects that have already been bid.
The following steps need to be accomplished:
(1) Finalize this resolution and adopt it at this meeting.
(2) Schedule a meeting of the Joint School Construction Advisory Committee to
develop a scope of work for each of the three projects.
(3) Schedule a joint meeting of the School Board and Board of Supervisors to approve
the funding of the projects on Friday, June 26, or Monday, June 29, at a time that
is convenient to both boards.
STAFF RECOMMENDATION:
It is recommended that the Board of Supervisors accept the attached resolution adopted
by the School Board and move forward with the steps outlined above.

JOINT RESOLUTION
WHEREAS, the School Board will be undertaking the construction of two new schools and the
renovation of three schools (the "Projects"); and
WHEREAS, the School Board and the Board of Supervisors, recognizing that the School Board has
the constitutional and statutory authority and duty to construct school facilities, desire to facilitate
communication between the two bodies regarding the progress of the construction of the Projects.
NOW, THEREFORE, BE IT RESOLVED that the School Board and the Board of Supervisors hereby
create a Joint School Construction Advisory Committee for the purpose of receiving reports on the status of
construction of the Projects from the School Board employees responsible for overseeing such construction;
and
BE IT FURTHER RESOLVED that the School Board and the Board of Supervisors shall each appoint
two of its members to serve on the Advisory Committee, which members shall serve at the pleasure of their
respective appointing body; and
BE IT FURTHER RESOLVED that the Superintendent of Schools and the County Administrator shall
be ex officio members of the Advisory Committee; and
BE IT FURTHER RESOLVED that each member of the School Board and the Board of Supervisors
shall be entitled to attend all meetings of the Advisory Committee; and
BE IT FURTHER RESOLVED that the Advisory Committee shall have no authority to make
decisions respecting the Projects and that such decisions are the sole responsibility of the School Board.

1. BUILDING CODE BOARD OF ADJUSTMENTS AND APPEALS
The four year term of Larry W. Degen, Alternate, will expire July 28, 1998. Mr.
Degen is eligible for reappointment.
2. LEAGUE OF OLDER AMERICANS - ADVISORY COUNCIL
The one year term of Dee Pincock expired March 31, 1998. Mr. Pincock is eligible
for reappointment but has indicated he does not wish to serve another term.
3. TASK FORCE FOR SENIOR AND PHYSICALLY CHALLENGED CITIZENS
Assistant County Administrator John Chambliss has received resignations from
Betty Dangerfield and Nancy Hall who represent the Cave Spring Magisterial
District on this Task Force, and these representatives need to be replaced. See
attached letters of resignation. There is no set term for these appointments.
4. ROANOKE REGIONAL AIRPORT COMMISSION
Supervisor Johnson nominated Jane Milliron to serve a four-year term effective July
8, 1998 and expiring July 8, 2002. Action was taken at this meeting.

2. Parks and Recreation Advisory Commission

SUMMARY OF INFORMATION:
Section 15.2-1229 of the Code of Virginia of 1950, as amended, authorizes the
Board of Supervisors of any county to establish one or more petty cash funds not
exceeding $5,000. The Department of Community Development is requesting an
amount of One Hundred ($100.00) Dollars for the cash register at the Permit
counter. This amount is in addition to the One Hundred ($100.00) Dollars approved
by the Board on May 23, 1998. This amount will remain in the cash register to
provide change to customers.
This was a service identified by the Design Team as part of the reengineering
process to improve customer service. Currently, they send cash transactions to the
Treasurer for payment. This action will be a great benefit to our customers. It will
eliminate an extra step and provide prompt service.
This request for petty cash requires a specific action of the Board of Supervisors
and is audited annually by our independent auditors to assure that it is being used
correctly.

WHEREAS, George T. Madagan was first employed on July 9, 1979, as a Motor
Equipment Operator I; and retired on June 1, 1998, after nineteen years of service; and
WHEREAS, Mr. Madagan has received many letters during his service with the
County complimenting him for being prompt, professional and courteous while performing
his duties; and
WHEREAS, Mr. Madagan is well known and liked throughout the County
departments for his honesty, personality, and humorous nature; and
WHEREAS, Mr. Madagan, through his employment with Roanoke County, has been
instrumental in improving the quality of life for its citizens.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke
County expresses its deepest appreciation and the appreciation of the citizens of Roanoke
County to GEORGE T. MADAGAN for nineteen years of capable, loyal, and dedicated

BACKGROUND: The Roanoke County School Board serves as the fiscal agent for
the Roanoke Valley Regional Special Education Board. The budget for the regional
board for 1997-98 was $3,993,054. The board -adopted budget for 1998-99 is
$4,221,197.
The Regional Program began operation during the fiscal year 1986-87. The Regional
consortium is comprised of six school divisions: Roanoke County, Roanoke City,
Salem City, Botetourt County, Craig County and Franklin County. Services are
provided to children with autism, multiple disabilities, severe and profound
disabilities and hearing impairments.
Regional classes are currently housed in the following school divisions:
Roanoke County
Roanoke City
Botetourt County
Franklin County
FISCAL IMPACT: Revenue received from participating school divisions is based on
a per pupil cost. Program cost for each division is offset through reimbursement
from the State Department of Education.
STAFF RECOMMENDATION: Staff recommends appropriation of the Roanoke Valley
Regional Special Education Board's budget for 1998-99.

The Extension of Water and Sewer to the Dixie Caverns Landfill is being

involves the acquisition of several easements necessary for the construction, as
shown on the attached location map and list of properties.

BACKGROUND:
In 1995, the Board of Supervisors approved a program which recognizes employees with
20 or more years of full-time service to the County by awarding them an additional $600
of pay each year. Through the current program, employees begin receiving payments at
the beginning of the fiscal year after completion of the 20th year of full-time employment.
In some cases an employee may wait up to eleven months after his/her anniversary date
to begin receiving the service pay. If an employee should leave for any reason during the
fiscal year, the service payment ceases.
County employees have expressed their desire to make this program more meaningful
through more timely recognition of the attainment of the 20th year of service. The revision
of this policy would allow for the service payment to begin upon the attainment of the
employee's 20th anniversary. The payments would be made over 24 pay periods. When
the employee retires, he/she would receive the remainder of the service pay for that year.
The school's practice is similar to our current practice in that payments begin with the new
fiscal year. However, service pay with the school system ranges from $600 with 20 years
of service to $2,400 with 35 years of service.
SUMMARY OF INFORMATION:
The minor change in this policy, requires an amendment to the Roanoke County Employee
Handbook. The revised "Amendment to Roanoke County Employee Handbook" would
read as follows:

anniversary date. This expense will be distributed over the departments with affected
employees and will be absorbed by the existing departmental budgets of said departments.
No new monies are requested for the revision to this policy.

Economic Development Specialist Brian T. Hamilton replace him on this Board and County
Administrator Elmer Hodge has approved the replacement. Before Mr. Hamilton accepted
employment with Roanoke County, he represented Montgomery County on the same
Board so he is familiar with their activities.
STAFF RECOMMENDATION
It is recommended that the Board of Supervisors ratify the appointment of Brian Hamilton
to fill the unexpired term of Tim Gubala on the Southwest Development Financing Board
of Directors. The term will expire January 12, 2000.

BACKGROUND: The Roanoke County Department of Social Services
received in FY 97-98 $533,979 in child day care funds. These funds
were available for Welfare Reform, Temporary Assistance to Needy
Families, Headstart, at -risk and fee-based day care. Lack of staff
for case management forced the Social Services Department to return
to the State $127,301 in day care funds. The day care allocation
just received for FY 98-99 has been increased to $789,276. This
increase is due to change in federal dollars with enhanced funding
for child day care. Failure to spend at least 800-o of the local
allocation will result in a 20o reduction of Roanoke County's 99-00
total allocation. Based upon prospective federal legislation for
increasing child care spending, DSS may see as much as $30 million
increase in day care funding from FY99 to FY 2000.
The 98-99 allocation includes $67,803 for local day care staff
allowance. The Board of Supervisors is requested to increase the
total number of full time positions authorized by the Department of
Social Services by one to allow for the employment of a child day
care worker.
FISCAL IMPACT: None. The total funds for the additional day care
position is funded with state dollars. There is no required local
match.

which will allow for the employment of a child day care worker. No

for public use in connection with a County project to correct an existing drainage problem
across the property of Nyna S. Murray, located on Shadwell Drive and designated on the
Roanoke County Land Records as Tax Map #28.09-2-4, and to provide for future
maintenance of said easement.
2. That the project is necessary for the general health, safety and welfare of the
public, and specifically is necessary to enable the County of Roanoke to guarantee
adequate drainage to the Virginia Department of Transportation for the streets in Belle
Grove Subdivision, currently serving approximately fifteen (15) households of County
citizens, to be accepted into the Virginia secondary road system, and in order to ensure
proper management of drainage along Shadwell Drive for the benefit of all citizens using
that road.
3. That acquisition of a permanent 20' drainage easement, with right of access
and a temporary construction easement, is required for the management, collection,
transmission, and distribution of any form of drainage, including but not limited to
stormwater drainage, and for the installation of facilities related thereto, specifically
including an underground conduit system, extending from the outfall of the stormwater
detention area in Belle Grove Subdivision, through the Nyna S. Murray property along the
western boundary of the adjoining property owned by Michael and Joy Ann Murray, to the
existing drainage easement along Route 605 (Shadwell Drive).
4. That the easement required for this project is through the property of
Nyna S. Murray, located on Shadwell Drive in the Hollins Magisterial District of the County
of Roanoke, Virginia, and is more particularly described as follows:
A perpetual DRAINAGE EASEMENT, approximately twenty feet (20') in width
and consisting of 0.18 acre, to construct, install, improve, operate, inspect,
use, maintain, remove, monitor, repair or replace present or future drainage
courses, ditches, lines, pipes, conduits, facilities, and other necessary or
related structures, appurtenances and improvements, for management,
collection, transmission and distribution of any form of drainage, including
but not limited to stormwater drainage, together with the right of ingress and
egress thereto from a public road, and together with a temporary
construction easement, upon, over, under, and across a tract or parcel of
land conveyed to Alfred M. Murray and Nyna S. Murray, husband and wife
as tenants by the entireties with right of survivorship, by deed dated
November 13, 1952, and recorded in the Clerk's Office of the Circuit Court
of Roanoke County, Virginia, in Deed Book 481, page 324, and designated
on the Roanoke County Land Records as Tax Map No.28.09-2-4. Alfred M.
Murray departed life on February 19, 1991, and fee simple title became
vested in Nyna S. Murray by right of survivorship.
The location of said perpetual drainage easement is shown stippled and
designated as "DRAINAGE EASEMENT' upon the plat entitled'Plat Showing
Temporary Construction Easement and Drainage Easement' dated
February 13, 1998, prepared by Lumsden Associates, P.C., attached hereto
as Exhibit A and by reference incorporated herein. The location of the
temporary construction easement and the easement for ingress and egress,
consisting of 9,635 square feet, more or less, is shown cross -hatched and
designated as "TEMPORARY CONSTRUCTION EASEMENT' on the above-
described plat attached as Exhibit A. The temporary construction easement
and easement for ingress and egress shall be operative and in effect during

any period or phase of construction, installation, improvement, inspection,
maintenance, repair, replacement, or alteration of the drainage system and
appurtenant facilities, but shall otherwise be inoperative and of no force and
effect upon completion of the project.
5. That the fair market value of the permanent drainage
easement, together with right of access and the temporary construction easement, is
$2,873.00. The sum of $2,873.00 has been offered, and is hereby re -offered, to the
property owner for purchase of the above-described easements by the Board of
Supervisors of Roanoke County, Virginia.
6. That it is immediately necessary for the County to enter upon and take
possession of such property and commence construction of said drainage improvements
in order to ensure proper management of the drainage, to have the streets in Belle Grove
Subdivision accepted into the Virginia secondary road system for maintenance purposes,
and to more adequately serve the needs of the citizens of Roanoke County, and to institute
and conduct appropriate condemnation proceedings as to the above-described easements
as provided by law.
7. That a certified copy of this resolution, to be sent by certified mail to
Nyna S. Murray on or before June 26, 1998, shall constitute notice to said property owner
of the offer to purchase as set forth above and the intent to enter upon and take
possession of the subject easements to commence construction, as provided for in
Sections 15.2-1904 and 15.2-1905, and Sections 33.1-119 through 33.1-132 of the Code
of Virginia (1950, as amended).

8. That the Capital Fund is hereby designated as the fund from which the
judgment of the court in the condemnation proceedings shall be paid to the property
owner.
9. That the Board does hereby invoke all and singular the rights, privileges, and
provisions as to the vesting of powers in the County under the Virginia General
Condemnation Act (§25-46.1, et seQ.), Sections 15.2-1904 and 15.2-1905, and Sections
33.1-119 through 33.1-132, of the Code of Virginia (1950, as amended), all as made and
provided by law.
10. That the County Administrator, or an Assistant County Administrator, and the
County Attorney are hereby authorized to execute such documents and take such actions
as may be necessary to accomplish this acquisition through eminent domain proceedings,
or otherwise.
11. That this resolution shall be effective on the date of its adoption and the
property owner shall have thirty (30) days following the sending of notice, i.e. the certified
mailing of this resolution as provided herein, within which to contest this taking and
immediate right of entry as provided in Section 15.2-1905.C. of the Code of Virginia (1950,
as amended).

WHEREAS, the first reading of this ordinance was held on May 26, 1998, and the

WIRELESS AND THE CITY OF SALEM TO CONSTRUCT A 120 FOOT
BROADCASTING TOWER LOCATED ON LITTLE BRUSHY MOUNTAIN (TAX
MAP NO. 45.01-1-71), CATAWBA MAGISTERIAL DISTRICT
WHEREAS, CFW Wireless and the City of Salem have filed a petition to construct
a 120 foot broadcasting tower located on Little Brushy Mountain (Tax Map No. 45.01-1-71)
in the Catawba Magisterial District; and
WHEREAS, the City of Salem is the owner of the real estate located on Little Brushy
Mountain (Tax Map No. 45.01-1-71); and
WHEREAS, the Planning Commission held a public hearing on this matter on June 2,
1998; and
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, held a first reading
on this matter on May 26, 1998; the second reading and public hearing on this matter was
held on June 23, 1998.
NOW, THEREFORE BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Board finds that the granting of a special use permit to CFW Wireless
and the City of Salem to construct a 120 foot broadcasting tower located on Little Brushy
Mountain (Tax Map No. 45.01-1-71) in the Catawba Magisterial District is substantially in
accord with the adopted 1985 Comprehensive Plan pursuant to the provisions of § 15.2-2232
of the 1950 Code of Virginia, as amended, and said Special Use Permit is hereby approved
with the following conditions:
1
(1) The height of the proposed tower, shall not exceed 100 feet above
existing grade. A monopole type structure shall be constructed. The structure
shall have a structural capacity to be increased in height to 160 feet, however,
the tower shall not be increased in height above 100 feet unless the increase
is required to accommodate co -location of equipment for another
vendor/provider, and any increase in tower height above 100 feet shall be
subject to an additional special use permit application.
(2) The tower structure and all attached hardware shall be a flat matted
color so as to better blend into the landscape and reduce visibility and light
reflection.
(3) No lighting shall be installed on the tower structure or equipment
building except as may be required by the FAA.
(4) This tower shall be structurally designed to carry sufficient loading and
the site shall be developed to accommodate the additional buildings necessary
to accommodate co -locating of communications equipment of at least two other
vendor/providers in addition to the City of Salem and CFW. In addition, by
executing the Special Use Permit, the applicant and owner of the land agree to
make the tower and tower site available for lease within the structural capacity
of the tower and at reasonable costs adequate to recover the capital, operating
and maintenance costs of the tower location required for the additional
capacity.
(5) If the use of the tower structure for wireless communications is
discontinued, the tower structure shall be dismantled and removed from the site

within 30 days of notice by the County, and the Special Use Permit shall
become void.
(6) The location of the tower structure and related equipment shall be as
shown on a site plan for Little Brushy dated 4/24/98.
(7) As part of construction, all unused structures, poles and antennas on
the property shall be removed and 8 foot security fencing shall surround the
compound.
2. That this ordinance shall be in full force and effect thirty (30) days after its final
passage. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance be, and the same hereby are, repealed. The Zoning Administrator is directed to
amend the zoning district map to reflect the change in zoning classification authorized by this
ordinance.

WHEREAS, by subdivision plat entitled "Wexford, Phase I", dated February 8,

management easement located on Lots 5 and 6, was shown and created along the

Virginia (1950, as amended), and the first reading of this ordinance was held on June 9,
1998; the public hearing and second reading of this ordinance was held on June 23, 1998.
NOW THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That an existing twenty -foot (20') access easement, shown and designated
as "20' ACCESS DRIVEWAY AND WATER LINE EASEMENT" on the 'Subdivision Plat of
Wexford, Phase 1', recorded in the Clerk's Office of the Circuit Court of Roanoke County,
Virginia, in Plat Book 16, page 122, said easement running along the boundary line of Lots
4 and 5, and continuing along the westerly boundary line of Lot 5, to provide access to and
from the stormwater management easement located on Lots 5 and 6, Phase I, Wexford,
as shown on said plat and as further shown on Exhibit A attached hereto, be, and hereby

ORDINANCE 062398-13 TO VACATE AN EXISTING 15' ACCESS
EASEMENT ALONG THE NORTHERN BOUNDARY OF LOT 20 AND
EXTENDING NORTHERLY ALONG THE EASTERN (REAR) LOT LINES
OF LOTS 19, 18, AND 17, AND TO VACATE AN EXISTING 10' ACCESS
DRIVE AND 15' STORMWATER MANAGEMENT ACCESS EASEMENT
ALONG THE BOUNDARY BETWEEN LOT 13 AND LOT 14A IN
WEXFORD AT STEEPLECHASE SUBDIVISION, IN PLAT BOOK 181
PAGE 51, AND RESUBDIVISION PLAT OF WEXFORD AT
STEEPLECHASE, IN PLAT BOOK 19, PAGE 67.
WHEREAS, by subdivision plat entitled "WEXFORD AT STEEPLECHASE", dated
July 14, 1995, and recorded in the Clerk's Office of the Circuit Court of Roanoke County,
Virginia, in Plat Book 18, page 51, a fifteen -foot (16) stormwater management access
easement was shown and created along the northern boundary of Lot 20 and extending
northerly along the eastern (rear) lot lines of lots 19, 18, and 17, the subject easement
being designated on said plat as "15' ACCESS EASEMENT"; and,
WHEREAS, by said subdivision plat, a ten -foot (10') access drive and fifteen -foot
(15') stormwater management access easement was shown and created along the
boundary line of Lots 13 and 14 (now 14A), the subject drive and easement being
designated on said plat as "10' ACCESS DRIVE" and 15' S.W.M. ACCESS ESM'T.", and
being further shown along the boundary line of Lots 13 and 14A on the 'Plat of
Resubdivision Showing The Resubdivision of Lots 14, 15, & 16, Wexford At Steeplechase,
Plat Book 18, Page 51, Creating Hereon Lots 14A, 15A, and 16A, Wexford At
Steeplechase', recorded in the aforesaid Clerk's Office in Plat Book 19, Page 67; and,

WHEREAS, the Petitioner, Wexford of Roanoke, Inc., is the developer of said
subdivision and has requested that the above-described existing 15' access easements
and 10' access drive be vacated; and,
WHEREAS, in exchange, the Petitioner proposes that alternative 15' access
easements on Lots 15A and 16A, designated and shown as "NEW 15' STORMWATER
MANAGEMENT ACCESS EASEMENT" on the 'Easement Plat Creating New 15'
Stormwater Management Access Easement Crossing Lots 14A, 15A and 16A', dated
March 20, 1998, prepared by Balzer and Associates, Inc., be conveyed to the Wexford
Homeowners Association, t/a Wexford at Steeplechase Homeowners Association, which
has responsibilities for maintenance of the stormwater management easements located
on Lots 14A and 15A and on Lot 16A; and,
WHEREAS, the County's engineering staff has reviewed and approved the
proposed exchange of access easements, which will allow for a less burdensome,
consolidated access to the stormwater management easements, and will not impose any
greater burden on the Homeowners Association; and,
WHEREAS, §15.2-2272.2 of the Code of Virginia (1950, as amended) requires that
such action be accomplished by the adoption of an ordinance by the governing body; and,
WHEREAS, notice has been given as required by §15.2-2204 of the Code of
Virginia (1950, as amended), and the first reading of this ordinance was held on June 9,
1998; the public hearing and second reading of this ordinance was held on June 23, 1998.
NOW THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:

1. That an existing 15' stormwater management access easement, shown and
designated as "15' ACCESS EASEMENT" on the subdivision plat of "WEXFORD AT
STEEPLECHASE", dated July 14, 1995, and recorded in the aforesaid Clerk's Office in
Plat Book 18, page 51, said easement being along the northern boundary of Lot 20 and
extending northerly along the eastern (rear) lot lines of lots 19, 18, and 17, and further
shown as "EXISTING 15' STORMWATER MANAGEMENT ACCESS ESM'T. TO BE
VACATED" on Exhibit A attached hereto, be, and hereby is, vacated pursuant to Section
15.2-2272 of the Code of Virginia (1950, as amended), subject to the conditions contained
herein.
2. That an existing 10' access drive and 15' stormwater management access
easement, shown and designated as "10' ACCESS DRIVE" and "15' S.W.M. ACCESS
ESM'T." on the subdivision plat of "WEXFORD AT STEEPLECHASE" (P. B. 18, pg. 51),
and being shown and designated as "10' EXISTING ACCESS DRIVE" and "15' EXISTING
S.W.M. ACCESS ESM'T." on the resubdivision plat of "WEXFORD AT STEEPLECHASE"
(P. B. 19, pg. 67), said drive and easement being along the boundary line of Lots 13 and
14A (formerly Lot 14), and being further shown as "10' ACCESS DRIVE TO BE VACATED"
and "15' S.W.M. ACCESS ESM'T. TO BE VACATED" on Exhibit A attached hereto, be,
and hereby is, vacated pursuant to Section 15.2-2272 of the Code of Virginia (1950, as
amended), subject to the conditions contained herein.
3. That alternative access easements on Lots 15A and 16A, designated as
"NEW 15' STORM WATER MANAGEMENT ACCESS EASEMENT" on the 'Easement Plat
Creating New 15' Stormwater Management Access Easement Crossing Lots 14A, 15A and

16A', dated March 20, 1998, prepared by Balzer and Associates, Inc., a copy of which is
attached hereto as Exhibit A and incorporated herein, shall be conveyed to the Wexford
Homeowners Association, t/a Wexford at Steeplechase Homeowners Association, for
purposes of ingress and egress to and from the stormwater management easements, said
Association being responsible for the continuing maintenance of said stormwater
management easements located on Lots 14A and 15A and Lot 16A.
4. That all costs and expenses associated herewith, including but not limited
to publication, survey and recordation costs, shall be the responsibility of the Petitioner.
5. That the County Administrator, or an Assistant County Administrator, is
hereby authorized to execute such documents and take such actions as may be necessary
to accomplish the provisions of this ordinance, all of which shall be on form approved by
the County Attorney.
6. That this ordinance shall be effective on and from the date of its adoption, and
a certified copy of this ordinance shall be recorded in the Clerk's Office of the Circuit Court
of Roanoke County, Virginia, in accordance with §15.2-2272.2 of the Code of Virginia
(1950, as amended).
On motion of Supervisor McNamara to adopt the ordinance, and carried by the
following recorded vote:

ORDINANCE 062398-14 TO INCREASE THE SALARIES OF THE
MEMBERS OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY
PURSUANT TO SECTION 3.07 OF THE ROANOKE COUNTY CHARTER
AND SECTION 14.1-46.01:1 OF THE CODE OF VIRGINIA
WHEREAS, Section 3.07 of the Charter of the County of Roanoke provides for the
compensation of members of the Board of Supervisors and the procedure for increasing
their salaries; and
WHEREAS, Section 14.1-46.01:1 of the 1950 Code of Virginia, as amended,
establishes the annual salaries of members of boards of supervisors within certain
population brackets; and
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, has heretofore
established the annual salaries of Board members at $11,473.36 by Ordinance 061097-4
and further has established the additional annual compensation for the chairman for the
Board to be $1,800 and for the vice-chairman of the Board to be $1,200; and
WHEREAS, this section provides that the maximum annual salaries therein
provided may be adjusted in any year by an inflation factor not to exceed five (5%) percent;
and
WHEREAS, the first reading on this ordinance was held on June 9, 1998; the
second reading and public hearing was held on June 23, 1998.
NOW, THEREFORE, it is hereby ORDAINED by the Board of Supervisors of
Roanoke County, Virginia, that the annual salaries of members of the Board of Supervisors

of Roanoke County, Virginia, are hereby increased by an inflation factor of 3% pursuant
to the provisions of Section 3.07 of the Roanoke County Charter and Section 14.1-46.01:1
of the 1950 Code of Virginia, as amended. The new annual salaries shall be $11.817.56
for members of the Board. In addition, the chairman of the Board will receive an additional
annual sum of $1,800 and the vice-chairman of the Board will receive an additional sum
of $1,200.
This ordinance shall take effect on July 1, 1998.
On motion of Supervisor Nickens to adopt the ordinance setting salaries at 3%
increase or $11,817.56, and carried by the following recorded vote:
AYES: Supervisors McNamara, Minnix, Nickens, Johnson
NAYS: Supervisor Harrison

AGENDA ITEM: Reallocation of budgeted funds from Board Contingency to Tourism
contributions.
COUNTY ADMINISTRATOR'S COMMENTS:
Recommend approval. It is our understanding that the RVCVB will provide additional information
on their marketing strategies and results of their advertising efforts, and we have become more
aware of the needs of the CVB.
SUMMARY OF INFORMATION: The second reading of the Appropriation Ordinance for the
1998-99 fiscal year budget was held on June 9, 1998. This second reading represented final
approval and appropriation of expenditure budgets for the County of Roanoke for the period July
1, 1998 to June 30, 1999.
At the request of the Board of Supervisors, funding in the amount of $107,500 designated for
the Roanoke Valley Convention and Visitors Bureau was reallocated to the Board Contingency
account pending a future work session to discuss concerns and activities of the organization.
STAFF RECOMMENDATION: Effective July 1, 1998, staff recommends that $107,500 be
transferred from the Board Contingency Account and allocated to Economic Development -
Marketing for payment of the FY98-99 annual contribution to the Convention and Visitors
Bureau.

2. That the annual salary for the County Attorney shall be increased from
