Mahoney County Attorney COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY O F INFORMATI On February 22, 2011, the Board of Supervisors held a public hearing on an ordinance amending the Roanoke County Zoning Ordinance by the addition of amendments relating to small wind energy systems. After the citizens spoke at this public hearing, the Board adopted numerous amendments to the draft ordinance that was in the published agenda. Due to the complex nature of these numerous amendments, and to comply with the procedures under Roberts Rules of Order, it is requested that the Board review, reaffirm and readopt this ordinance. The purpose of this requested action is to clarify the Board's previous actions, and to assure that this ordinance accurately reflects the intentions of the Board in its consideration and adoption of these amendments. STAFF RECOMMENDATION: It is recommended that the Board reaffirm and readopt this ordinance. AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, MARCH 8, 2011 ORDINANCE READOPTING ORDINANCE 022211 -4 TO AMEND THE ROANOKE COUNTY ZONING ORDINANCE BY THE ADDITION OF AMENDMENTS RELATING TO SMALL WIND ENERGY SYSTEMS WHEREAS, in June of 2009 the Roanoke County Planning Commission and Community Development staff identified various provisions of the Roanoke County Zoning Ordinance to review and update as provided in Section 30 -14 of the Roanoke County Code and Section 15.2 -2285 of the Code of Virginia; and, WHEREAS, wind energy was one topic identified not only by County staff but also requested by citizens for further research to develop provisions to recommend be incorporated into the Zoning Ordinance; and, WHEREAS, the Planning Commission has reviewed wind energy issues in ten work sessions over the past eighteen months, and on January 24, 2011, completed its recommendations for proposed amendments incorporating small wind energy systems; and, WHEREAS, wind energy is a renewable source of alternative energy and alternative sources of energy are beneficial to Roanoke County, the Commonwealth of Virginia and the United States of America; and, WHEREAS, public necessity, convenience, general welfare and good zoning practice are valid public purposes for such recommendations by the Planning Commission and action by the Board of Supervisors; and, Page 1 of 9 WHEREAS, the Planning Commission held its public hearing on these proposed amendments on February 1, 2011, after legal notice and advertisement as required by law; and, WHEREAS, the Board of Supervisors held its first reading on this ordinance on February 8, 2011, and its second reading and public hearing after legal notice and advertisement as required by law on February 22, 2011; and WHEREAS, the Board of Supervisors hereby reaffirms and readopts this ordinance on March 8, 2011. NOW, THEREFORE, be it ordained by the Board of Supervisors of Roanoke County as follows: 1. That the following sections of the Roanoke County Zoning Ordinance be amended to read and provide as follows: Article II, Section 30 -28 — Definitions and Use Types Anemometer: An instrument fog measuring wind force and velocity. Net metering: A program offered by cz utility company that allows customers with eligible renewable energy systems to offset a portion of the electric energy provided by the utility. Rated nameplate capacity: The maximum rated output of electric power production equipment specified by the manufacturer. Shadow flicker: The visible flicker effect that occurs when rotating turbine blades cast shadows on the ground and nearby structures, causing the repeating pattern of light and shadow. Wind energy: Power generated by converting the mechanical energy of wind into electrical energy through use of a wind generator. Wind energy conversion system: An electric generating device, the main purpose of which is to convert the kinetic energy available in the wind to mechanical energy, consisting of one or more wind turbines, a tower, associated control or conversion electronics and other accessory structures and buildings, including substations, electrical infrastructure, transmission on lines and other appurtenant structures and facilities. Wind energy system, micro (building integrated): Abuilding- mounted wind energy conversion system that has cr manufacturer's rating of 10 kW or less. Page 2of9 Wind energy system, small: A wind energy conversion system consisting of a single wind turbine, a tower, and associated control or conversion electronics, having a rated nameplate capacity of not more than 50 kilowatts (kW) for residential uses and not more than 100 kW for other uses. For the purpose of residential net metering, Virginia Code X56 -594B limits the electrical generating facility to a capacity of not more than 10 kilowatts (kW). Wind energy tower: The structure on which the wind turbine is mounted. Wind monitoring or temporary meteorological tower: A temporary tower equipped with devices to measure wind speeds and direction; used to determine how much wind power a site can be expected to generate. Wind turbine: A wind energy conversion device that converts wind energy into electricity through use of a wind turbine generator; typically having one, two or three blades, nacelle, rotor, generator, controller and associated mechanical and electrical conversion components mounted on top of a tower. Windmill: A machine designed to convert the energy of the wind into more useful forms of energy, such as grinding, pumping, etc., using rotating blades driven by the force of the wind to turn mechanical equipment to do physical work, without producing energy. (D) The following uses are allowed only by special use permit pursuant to section 30 -19. An asterisk ( *) indicates additional, modified or more stringent standards as listed in article IV, use and design standards, for those specific uses. 1. Miscellaneous Uses Wind Energy System, Small Article IV —Use and Design Standards SECTION 30 -87 -6. Wind Energy System, Small (A) Purpose and Intent: The purpose of this section is to regulate the placement, construction, and modification of small wind energy systems while promoting the safe, effective and efficient use of small wind energy systems and not unreasonably interfering with the development of independent renewable energy sources. The requirements set forth in this section shall govern the sitting of small wind energy systems used to generate electricity or perform work which may be connected to the utility grid pursuant to Virginia's net metering laws or serve as an independent source of energy. (B) General Standards: 1. Type of Tower: The tower component of any small wind energy system shall be one that is recommended and certified by the manufacturer. 2. Tower Color: Small wind energy system towers shall maintain a galvanized steel finish, unless Federal Aviation Administration (FAA) standards require otherwise. The zoning administrator may allow a property owner, who is attempting to conform the tower to the surrounding environment and architecture, to paint the tower to reduce its visual obtrusiveness. A photo simulation may be required by the zoning administrator. 3. System Height: Page 5of9 (a) System height is defined as the vertical distance measured from average grade at the base of the tower or other supporting structure, whether mounted on the ground or on a rooftop, to the highest point of the turbine rotor or tip of the turbine blade when extended to its highest elevation. Parcel Size ( Acres) Maximum System Height U to 1.00 80 eet Greater than 1.00 100 feet (b) A small wind energy system may exceed the height limitations listed in this section if a special use permit has been obtained by the property owner. (c) The applicant shall provide evidence that the proposed height of the small wind energy system does not exceed the height recommended by the manufacturer or distributor of the system. 4. Setbacks: The small wind energy system shall be set back a distance at least equal to one hundred ten percent (110 %) of the height of the wind energy system from all property lines, and roadways. The setbacks for a small wind energy system may be reduced if a special use permit has been obtained by the property owner. Setbacks established in this section or through a special use permit shall supersede any other setback requirement in the zoning ordinance. S. Ground Clearance /Safety: The minimum distance between the ground and any protruding blades utilized on a small wind energy system shall be 20 feet, as measured at the lowest point of the arc of the blades. The lowest point of the arc of the blade shall also be twenty (20) feet above the height of any structure within one hundred fifty (150) feet of the base. The supporting tower shall also be enclosed with a 6-foot tall fence or the base of the tower shall not be climbable for a distance of 12 feet. 6. Number of Towers: More than one tower may be permitted on an individual piece of property provided that all setback requirements have been met. 7. Noise: The wind energy system shall not exceed 60 decibels (dBA), as measured at the closest property line, except during short -term events such as severe windstorms. 8. Li No lighting shall be incorporated on the tower or wind turbine unless required by the Federal Aviation Administration (FAA) or other appropriate authority. 9. Advertising: Signs, writing, pictures, flags, streamers, or other decorative items that may be construed as advertising are prohibited on wind energy systems, except as follows: (a) Manufacturer's or installer's identification on the wind turbine, and (b) Appropriate warning signs and placards. 10. Speed Controls: A small wind energy system shall be equipped with manual (electronic or mechanical) and automatic overspeed controls to limit the blade rotation speed to within the design limits of the small wind energy system. 11. Electric Utility Notification: The applicant shall provide evidence that the provider of electric utility service to the site has been informed of the applicant's intent to install can interconnected customer -owned electricity generator, unless the applicant intends, and so states on the application, that the system will not be connected to the electricity grid. Page 6of9 12. Use: A small wind energy system shall be considered an accessory use. The applicant shall provide information demonstrating that the small wind energy system will be used primarily to reduce on -site consumption of electricity. 13. Wind Monitoring or Temporary Meteorological Towers: Small wind energy systems shall comply with the following: (a) A wind monitoring meteorological tower with an anemometer and other wind measuring devices may be installed with the issuance of a zoning permit for the purpose of monitoring wind and other environmental conditions relevant to sitting wind energy systems and used to determine how much wind power a site can be expected to generate. The zoning permit shall be valid for a period of one year. (b) No wind monitoring meteorological tower for small wind energy systems may rise more than the allowable height of the proposed small wind energy system and shall meet the setback requirements in Sec. 30- 87 -6(B)4 of this ordinance. 14. Removal of Defective or Abandoned Small Wind Enemy Systems: (a) Each year following the issuance of a zoning permit for a small wind energy system, the owner of such small wind energy system shall submit to the Zoning Administrator an affidavit that verifies continued operation of the wind turbine use and compliance with all requirements of this ordinance and other applicable regulations. Failure to submit required documentation shall result in the Zoning Administrator considering the small wind energy system abandoned. The owner of the small wind energy system shall remove the small wind energy system within ninety (90) days of receipt of notice from the County instructing the owner to remove the abandoned small wind energy system. (b) Any small wind energy system and micro wind energy system found to be unsafe or inoperable by the building official shall be repaired by the owner to meet federal, state and local safety standards or removed within ninety (90) clays. 15. Compliance with Other Regulations: Small wind energy systems shall comply with all applicable local, state and federal regulations. SECTION 30 -88. Accessory Uses and Structures (A) As defined in section 30 -28, accessory uses and structures maybe commonly found and associated with principal use types. Principal uses which are allowed by right or by special use may include accessory uses and activities, provided such accessory uses and activities are appropriate and incidental to the principal use, and provided they are designed and located in accord with the intent and provisions of this ordinance. (Attachment A) and appropriate $100,000 from the Western Virginia Water Authority (WVWA), Catawba Magisterial District Doug Chittum Economic Development Director B. Clayton Goodman III County Administrator 'KAr COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: Edward Rose Properties (the Company) desires to construct a new mixed use commercial development with potential uses including a hotel, office, medical buildings and multi- family structures on 31.4 acres of land off of Cove Road (Attachment B). The company plans to invest a minimum of $20,000,000 by December 31, 2017. As part of the project, the Company needs to construct certain public infrastructure improvements including water and sewer extensions with an estimated value of $225,000, a new public access road and intersection improvements from and along Cove Road and the new development and a right turn lane on Cove Road at the intersection of route 419. Of special note is the proposed water line extension. This extension will serve as a critical link in the eventual interconnection of water lines in the vicinity, thereby improving service for the nearby citizens of Roanoke County, and it is also consistent with the long range capital plan of the WVWA. In recognition of this, the WVWA will contribute $100,000 to the County, and the County will contribute $100,000 'from the Public Private Partnership account to - the EDA to provide a $200,000 Public Infrastructure Incentive Grant to the Company. The Grant will be paid to the Company by the EDA within thirty days of final Page 1 of 2 construction of the water line extension, and acceptance of the public infrastructure improvements by the WVWA. The Board of Supervisors and the EDA desire to promote and encourage economic development and vitality of Roanoke county and the region through the construction of new businesses in order to provide increased employment and corporate investment in the County. Therefore the County and the EDA will award up to a $300,000 Economic Development Incentive Grant to the company after one or more commercial buildings have been constructed and occupied within the development. The Grant will be based on the amount of New Tax Revenue realized by the county from this new development. New Tax Revenues are defined as Real Estate tax, Business Professional Occupational License (BPOL) taxes, Business Personal Property and Transient Occupancy taxes. If the New Tax Revenues are less than $300,000, then the Grant will be less, and will only be calculated using the actual new taxes generated by - the project. The Company may request a yearly Grant for any two calendar years from tax years 2013, 2014, 2015, 2010, or 2017. If no commercial buildings are built within this time frame, no Grant will be awarded. No new tax revenue from the residential multi - family units will be considered when calculating any potential Grant. FISCAL IMPACT: The $100,000 from the county for the Public Infrastructure Incentive Grant will be allocated from the Economic Development Public Private Partnership Account so no new funds will need to be identified. The WVWA will contribute $1 00,000 to go towards the public infrastructure incentive grant and these funds will need to be appropriated. The Economic Development Incentive Grant will be an amount equal to new tax revenues realized by - the project so the company will be "reimbursed" by foregone New Tax Revenues and appropriated in future budgets. ALTERNATIVES: Alternative One: Authorize the execution of the Performance Agreement between Roanoke county, the Roanoke county EDA and Edward Rose Properties, Inc. and appropriate $100,000 from the Western Virginia Water Authority for the public infrastructure incentive grant. Alternative Two: Do not authorize the execution of the Performance Agreement between Roanoke county, - the Roanoke county EDA and Edward Rose Properties, Inc. or the appropriation of funds from the WVWA. STAFF RECOMMENDATION: Staff recommends Alternative One- Authorize the execution of the Performance Agreement between Roanoke county, the Roanoke County EDA and Edward Rose Properties, Inc. and appropriate $100,000 from the western Virginia Water Authority for the public infrastructure incentive grant. Page 2 of 2 ATTACHMENT A PERFORMANCE AGREEMENT THIS PERFORMANCE AGREEMENT (the "Agreement ") is made as of this day of , 2011, by and between ROANOKE COUNTY, VIRGINIA, a political subdivision of the Commonwealth of Virginia, (hereafter, the "County "); THE ECONOMIC DEVELOPMENT AUTHORITY OF ROANOKE COUNTY, VIRGINIA, a political subdivision of the Commonwealth of Virginia, (hereafter, the "Authority "); and EDWARD ROSE PROPERTIES, INC., a Michigan corporation, (hereafter, the "Company ") . WITNESSETH WHEREAS, the Roanoke County Board of Supervisors and the Authority desire to promote and encourage the economic development and vitality of Roanoke County and the Roanoke Valley through the construction of new business and the retention and expansion of existing business in order to provide for retained and increased employment and corporate investment in Roanoke County; and WHEREAS, the Company desires to provide development services and /or construct a new mixed use commercial development with potential uses including but not limited to hotel, office, medical buildings, and multi - family residential structures (the "Project ") on real estate consisting of approximately 31.4 acres located off Cove Road, further described as tax map parcel numbers 36.11- 02 -04, 36.11- 02 -03, 36.11- 02 -02 Page 1 of 10 ATTACHMENT A 36.11- 02 -01, 36.11 -02- 01.01, and a portion of 36.11 -02 -36 in Roanoke County (the "Property "); and WHEREAS, the County adopted an ordinance, number 052609-21, rezoning this Property upon petition by the Company on May 26, 2009 (the "Ordinance "), which Ordinance included certain conditions voluntarily proffered by the Company limiting the uses, size, scale, design and appearance of the buildings to be constructed, and the construction of certain public road improvements; and, WHEREAS, the County and the Authority expect that the Company will maintain high quality employment opportunities for the citizens of the Roanoke Valley with the completion of the Project which will promote economic development and generate new local tax revenues for Roanoke County; and WHEREAS, this increased employment and investment constitutes a valid public purpose for the expenditure of public funds. NOW, THEREFORE, in consideration of the premises and the mutual covenants contained herein, the parties agree to the following: 1. Site Development by the Company A. The Company will cause the Project to be constructed and developed, subject to obtaining ordinary and necessary governmental approvals from the County and any other governmental agencies. B. The Company shall construct or (cause a third party to construct) the Project on the Property with an estimated construction cost of $20 Million. The cost may increase or decrease based upon the time of actual construction. Some or all of the Page 2 of 10 ATTACHMENT A commercial buildings for the Project are expected to be completed by December 31, 2017. C. As part of the Project, the Company shall construct certain public infrastructure improvements, including: (i) public water and sewer extensions with an estimated value of $225,000 built to the standards of the Western Virginia Water Authority to serve this Project, (ii), storm water detention facilities as required by the County and the Commonwealth of Virginia, (iii) a new public commercial access road and intersection improvements built to Virginia Department of Transportation standards from and along Cove Road and the new planned commercial development as shown on the concept plan dated May 21, 2009, as the same may be modified by the Company as necessary, and (iv) a right -turn lane on Cove Road at the intersection of Route 419 per the Ordinance and as required by the Virginia Department of Transportation (collectively, the "Site Development Improvements "). The Company shall take all commercially reasonable steps necessary to have the road improvements accepted into the Commonwealth's system of public highways, and the water and sewer extensions accepted by the Western Virginia Water Authority. D. As part of the Site Development Improvements described in paragraph 1.C. above, the Company will install at its expense approximately 2,200' of twelve inch (12 ") ductile iron water line extension along with all necessary appurtenances to serve the Project. The water line will connect to an existing City of Salem twelve inch (12 ") water line in the vicinity of Sheraton Drive and Route 419 and be placed in the south right -of -way of Route 419 to the intersection of Cove Road. Page 3 of 10 ATTACHMENT A Traversing Route 419 will be accomplished by a 'jack and bore' process to avoid open cutting the roadway and minimize impact on traffic flow. The new water line will be placed in the western right -of -way of Cove Road to the proposed intersection of the driveway cut serving the western entrance of the Project. This proposed water line extension will also serve as a critical link in the eventual interconnection of water lines in the vicinity, thereby improving service for the nearby citizens of Roanoke County and which is consistent with the long range capital plan of the Western Virginia Water Authority. 2. Procedures for the Disbursement of Authority Funds to the Company A. Upon completion of the construction of the Site Development Improvements described in paragraph 1.C., acceptance of the new road improvements into the Commonwealth's system of public highways, acceptance of the water and sewer utilities by the Western Virginia Water Authority, and the recordation of the subdivision plat, the issuance of a final certificate(s) of occupancy as to one or more commercial buildings on the Property, and the generation of "New Local Tax Revenues" in the amounts as hereinafter set out, the Authority shall, with funds provided by the County, make an Economic Development Incentive Grant (the "Grant ") to the Company in an amount not to exceed $300,000.00. B. Beginning in calendar year 2012, the County shall appropriate to the Authority in two annual installments sums sufficient for the Grant for the benefit of the Company. These sums will be in sufficient amounts to equal a total of two years of "New Local Tax Revenues." The term, "New Local Tax Revenues," Page 4 of 10 ATTACHMENT A means the total of (i) new local real estate taxes generated solely by the new commercial development; (ii) Business Professional Occupational License (BPOL) taxes; (iii) business personal property; and (iv) transient occupancy taxes; each as generated by the Project during any two calendar years at the Company's choice from tax years, 2013, 2014 2015, 2016 or 2017 (such two (2) years being the "Tax Years ") . It is estimated that the total amount of the New Local Tax Revenues will total $300,000; however if the Company generates in excess of the New Local Tax Revenues estimated, then the actual Grant shall not exceed the total of $300,000. If the Company generates less than the estimated New Local Tax Revenues, then the actual Grant shall be actual New Local Tax Revenues generated and will be less than the estimated total. The Authority, upon receipt of this annual appropriation of funds from the County, will award to the Company that portion of the Grant equivalent to the New Local Tax Revenues for the preceding Tax Year to assist with its start -up and site development costs, construction of the Company's improvements and facilities, and new employment all in the manner specified in paragraph 2.C. below. C. Within sixty (60) days after the end of each Tax Year, the Company shall provide such financial and tax revenue data relating to the Project as may be reasonably required by the Authority so that the Authority may calculate the actual Grant award amount. The Company hereby authorizes the Commissioner of the Revenue for Roanoke County and the Commonwealth of Virginia to release to the Authority and the County its confidential tax information and data so that the Authority may calculate the portion of the Grant award amount due to the Company. Page 5 of 10 ATTACHMENT A The Authority shall pay the annual Grant award amount to the Company at an address designated by the Company within thirty (30) days after receipt by the Authority of the data. D. If the Company (and /or any successors) does not complete construction of any of the commercial buildings on the Property by December 31, 2017, then the Authority shall be relieved of any obligation to the Company for the Grant and the Company shall be relieved of any obligations under this Agreement. 3. In addition to the Grant described in paragraphs 2.A and B, above, the County shall provide an additional public infrastructure commercial development incentive to the Company by contributing $200,000 to the cost of the construction of public water extension described in paragraph 1.D. to serve this mixed use commercial development as well as this portion of the County. The Western Virginia Water Authority shall contribute $100,000 to the County for this economic development incentive. The County shall appropriate and contribute an additional $100,000 for this economic development incentive. The County shall appropriate to the Authority this total of $200,000 for this public infrastructure commercial development incentive (the "Incentive "). The Authority shall pay the Incentive to the Company within thirty (30) days of final construction of the water extension, and acceptance of such water utility improvements by the Western Virginia Water Authority. 4. The Company shall have the right to assign this Agreement, in whole or in part, to a separate entity provided that any such assignment shall not relieve the Company of its obligations herein. If any party is unable to perform its commitments under this Agreement by reason of force majeure,, then that party shall not be deemed to be in default of its obligations under this Agreement, and any deadlines for the performance of its obligations and, if applicable, the deadlines for the performance of the other party's obligations shall be extended for a time equal to the time period of the force majeure event, plus ten days. The term a "force majeure" as used herein, shall include without limitation acts of God; hurricanes, floods, fire, tornadoes, earthquakes, storms; strikes or other industrial disturbances; acts of public enemies; orders of governmental authorities; insurrections; riots; epidemics. 6. This Agreement shall be governed by and all disputes related hereto shall be determined in accordance with the laws of the Commonwealth of Virginia. 7. All notices and other communications hereunder shall be in writing and shall be deemed to have been duly given on the date of delivery if delivered in person or the following business day after being sent by overnight delivery by a nationally recognized overnight delivery service such as UPS or Federal Express, addressed as follows: Page 7 of 10 ATTACHMENT A To To County: Authority: To Michael E. Clayton Goodman III County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: The County Of Roanoke's Investment policy was first established in 1087. We consider the investment policy to be a Living Document and subject to revision due to the ever changing investment market. The policy has been changed on six different occasions with the last revision occi .,i rring in 2007. The last change occurred when the U.S. Investment markets had a long period of positive interest rates for short -term Government Securities and money market funds, which actually had higher interest rates than those of long -term investments. This advantageous environment ended in 2008 following the collapse of the mortgage lending sector. The fallout from the reversal created a prolonged time small returns that have crossed into the banking sector and subsequently into money market fund yields. This has affected overnight funds held with our local bank that serve to boost our returns by utilizing all of our cash. To offset these declines, it has become necessary to utilize the Local Government Investment Pool (LGIP) which is a AAA rated fund run created in 1981 run by the State. Page 1 of 2 We have used this fund for many years and it is very effective with short term yields. However, the language within the investment policy is conflicting and outdated. We allow for up to seventy -five percent (75 %) of our total funds to be placed within the LGIP, but left language which limited that same seventy -five percent (75 %) to be no more than $15,000,009. This language has been carried over through subsequent policy changes since the early 1990's without regard to our total portfolio value which is four to five (4 to 5) times larger today. At this time, we request that we strike the limitation of $15,000,000 and allow the allocation percentage of seventy -five percent (75 %) to remain on its own merit. The County is presently only limited by our own Investment policy as to the specific allocation that we allow ourselves to invest into this category, since the stated investments are authorized under Section I B -8 , and 2 A -1 of our own investment policy as allowed by Sec. 2.2 -4591 of the Code of Virginia, 1959, as amended. By changing this outdated restriction, we will allow increase the return of our short term funds in this unfavorable market without incurring any additional risk. FISCAL IMPACT: Adopting the change to the Investment policy will increase the interest earning potential of County funds. There will be no negative impact. The intent of this section is to provide adequate standards for Roanoke County private roads. Such roads may be provided only in selected urban residential developments including the Cluster Subdivision Option, the Planned Residential Development District, Townhouse and Manufactured Home Park developments. Easement: A right expressed in recorded writing, given by the owner of land to another party of specific limited use of that land (i.e., access, pedestrian, greenway, drainage, water, sewer, public utility). Plat, Final: The plat of a proposed subdivision of land that has been preliminarily approved and signed by the agent as a preliminary plat, subsequently recorded or to be recorded with the Clerk's Office. Private Street /Road: A vehicular way owned, operated, provided, and maintained by an individual, developer, homeowners' association, or any other entity other than a local, state, or federal government. Intent. Shoulder and ditch sections are intended primarily for Planned Residential Developments characterized by larger residential lots (generally 1 /4 acre or greater) that may have longer driveways that allow parking for several vehicles. Only in rare instances would residents or guests park along the shoulder of a private road. b. General Parking. If shoulders will be frequently utilized for parking, each shoulder shall measure four feet in widthu and shall be constructed of either stone or bituminous pavement. Standard Notes. Include a notation on the construction plans identifying the proposed private roads. y. Stormwater Management Facilities. Entry to privately owned and maintained stormwater management facilities and accesses shall be provided per the latest County of Roanoke Stormwater Management Design Manual. An easement shall be provided to Roanoke County for access and maintenance of a stormwater management facility. Such easements shall be noted on the plat. See Section (D)1. Drainage Easements, for additional standards. z. Traffic Control Devices and Signage. Each private road shall be identified with a street name sign at each intersection which shall be white with green lettering, per Roanoke County standards. Provide stop signs at entrance and interior intersections. Comply with the MUTCD Manual, as amended. Traffic signs and street name signs do not require sign permits. For all other signs, refer to Zoning Ordinance Section 30 -93, Signs, to determine the need for a Sign Permit. Additional regulations: i. Installation and Maintenance: The developer shall be responsible for purchasing, installing and maintaining all signs. When the private road is turned over to the Homeowners' Association it shall then be the responsibility of the Homeowners' Association to maintain all signs. ii. Enforcement: The Roanoke County Police Department is unable to enforce traffic regulations on private roads. Parking enforcement shall be the responsibility of the owner of the private road or the Homeowners' Association. iii. Maintenance of Traffic through Construction Areas: Refer to the MUTCD Manual, as amended. aa. Trip Generation /Average Daily Trips (ADT). Refer to the Institute of Transportation Engineers (ITE) Trip Generation manual, as amended. bb. Vertical Clearance Height. Private roads through forested areas or under other overhead obstructions must maintain proper clearance heights above the traveled way to allow passage of emergency vehicles. Drainage Easements: a. The width and location of drainage and stormwater pond facility easements shall comply with the Stormwater Management Ordinance and Stormwater Design Manual, as amended. b. Private drainage easements shall be platted and dedicated to the homeowners' association for maintenance and notes to this effect shall be indicated on the final plat. c. Public drainage easements shall be platted and dedicated for public use. 2. Sight Distance Easements: Width and location to be determined by VDOT for public and private road intersections. For intersections of two or more private roads, dedicated right -of -way may be needed to preserve the line -of- sight. A sight distance easement may be an alternative to dedicated right -of -way. 3. Water and Sewer Easements: Width and location to be determined by the Western Virginia Water Authority or the Town of Vinton Department of Public Works depending upon the service provider. 4. Public /Private Utility Easements: Width and location to be determined by the appropriate utility company(ies) (E) Public Services 1. School Bus Service: The private road standards generally meet Roanoke County Public Schools standards for school bus service; however, Roanoke County School Administration staff reserve the right to discontinue or relocate service on private roads if school buses cannot safely pick up children, pending advance notice to the owner of the private road, due to the following situations: a. Cars are frequently parked in No Parking zones or in other locations where parking is not permitted, prohibiting the bus from passing or turning around; b. Snow has not been plowed adequately from private roads to allow school buses to safely navigate them on more than one occasion; c. Ongoing construction creates an unsafe condition for either the children or the bus; Roanoke County Design Handbook 3 -38 March 8, 2011 Chapter 3: Transportation d. Other conditions which would create an unsafe condition for either the children or the bus; or e. The Homeowners' Association requests that the bus be removed due to noise, lighting, road damage or other unforeseen reasons. 2. Solid Waste: To receive public solid waste collection, a Private Road Waiver shall be completed and signed prior to site plan /subdivision plan approval. If a Private Road Waiver is not completed, the homeowners and /or homeowners' association has the responsibility for addressing the collection of solid waste. 3. Fire and Rescue Service: A representative of the Fire and Rescue Department shall review the design and location of all proposed private streets, and shall advise the applicant whether or not the proposed private streets meet the standards for emergency services. (F) Process 1. Plan Submittal Requirements: Refer to the Roanoke County Land Development Procedures, as amended. 2. Erosion and Sediment Control: All land disturbing activities shall comply with the Roanoke County Erosion and Sediment Control Ordinance, as amended. 3. Inspections: A third -party inspector shall inspect private roads following the requirements below: a. Developer must contract with a licensed inspection firm certified to perform inspections not related to or affiliated with the developer or contractor; b. Inspection procedures, testing methodology, and frequency of inspections are completed in accordance with VDOT Materials Division's Manual of Instructions and the Virginia Department of Transportation Road and Bridge Specifications. Inspections include but are not limited to: i. Completion of subgrade, prior to the placement of any ballast material; ii. Completion of ballast, prior to the placement of any top course of material; and iii. Completion of installation of road signs, installation of any appurtenant structures, and reseeding of disturbed area and slopes. Final Report and As -Built Drawings: At the completion of the road construction a report including two copies of As -Built drawings shall be submitted to Roanoke County Community Development by the developer. Roanoke County shall provide one copy of the As -Built drawings to the Roanoke County Fire Marshal. a. Final Report: The Final Report shall include all material receipts, dates of inspection, work performed, changes or repairs ordered, inspection steps completed, certification of the results of inspections referenced in (F)3b, above, and confirmation that the streets were built to the approved plans, specifications and pavement design. The Final Report shall be signed and stamped by a Virginia licensed Professional Engineer. b. As -built drawings: Requirements for As -Built drawings are as follows: i. Changes to water, sewer, storm sewer, road grade and alignments. ii. Drainage improvements as required by the Roanoke County Stormwater Management Ordinance and the Stormwater Design Manual, as amended. iii. Public water and public sewer improvements per the Town of Vinton, if applicable. iv. Private water and private sewer improvements per the Virginia Department of Health. V. If requested, slope verification for road sections designed with grades of 15 percent or greater. vi. If requested, a centerline as -built or right -of -way staking for confirmation of the road location. S. Turnover to Homeowners' Association: To ensure that the Homeowners' Association does not receive substandard private roads, include the following notation on the plans: "Immediately prior to the turnover of the private roads to the Homeowners' Association, Roanoke County shall inspect the private roads and any defects shall be repaired by the responsible party before the turnover occurs." 6. Maintenance: A Homeowners' Association is required to be established to be responsible for all private roads, to include maintenance and upkeep of the private roads. On February 22, 2011, the Beard held a public hearing on the adoption of these guidelines, and it received numerous citizen comments. The attached resolution reflects the comments and concerns of the citizens of Roanoke County as well as the members of the Board of Supervisors. STAFF RECOMMENDATION: It is recommended that the Board favorably consider the adoption of the attached resolution. AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, MARCH 8, 2011 RESOLUTION ADOPTING GUIDELINES FOR THE 2011 REDISTRICTING PROCESS OF ROANOKE COUNTY, VIRGINIA WHEREAS, on February 22, 2011, the Board of Supervisors of Roanoke County held a public hearing to receive public comments on developing guidelines for the redistricting of Roanoke County in accordance with the decennial census; and WHEREAS, notice of this public hearing was published in the Roanoke Times, the Salem Times Register, the Vinton Messenger and the Roanoke Tribune; and written notice was sent to numerous civic organizations; and WHEREAS, the Board of Supervisors finds that the following procedures shall guide the 2011 redistricting process. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County as follows: 1. That Roanoke County shall continue to be divided into five single- member election districts; and 2. That the Town of Vinton should be contained entirely within one district; _1R 3. That each district will have equal population based upon 'the 2010 Census, with no more than a plus /minus five percent (5 %) deviation between districts; and 4. That each district should reflect "communities of interest" taking into consideration rural, suburban and urban interests, as well as income and neighborhood characteristics; and that election districts should attempt to conform with high school attendance zones; and Page 1 of 2 5. Mahoney County Attorney COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: This work session will report to the Board of Supervisors the initial work performed by your staff Redistricting Committee based capon the 2010 Census and - the Policy Guidelines adopted by the Board. Staff has prepared 3 options for your consideration. These options are attached to this report with mapping, population and percentage deviation data. Option #1 is the "No Change" Option. The critical weakness in this option is that the percentage deviation of population between election districts is nine point six eight percent (9.88 %). This deviation is dangerously close to exceeding the federal courts `rule of thumb' of ten percent (10 %) deviation being permissible in limited circumstances. Staff does not recommend this option. Option #2 results in a total deviation of population between election districts of four point six percent (4.6 %) which is within the limit of five percent (5 %) recommended by the Commonwealth of Virginia. It has 3 major changes: (1) expands Cave Spring District north and east up to Rt. 116 but south and east of the Blue Ridge Parkway, (2) expands Vinton District north and west into The Orchards in the Huntridge Road area; and (3) moves Woodhaven Road area back to Hollins and re- establishes the clearly observable boundary between Hollins and Catawba Districts at I -581. The primary weakness of this option is that it divides communities of interest in the Orchards area. Option #3 results in a total deviation of population between election districts of only four point two percent (4.2 %). It modifies option #2 by keeping the Bandy Road /Back Creek area in the Vinton District. It utilizes Back Creek as a clearly observable boundary. It has the same weakness as Option #2.
