RESOLUTION 060899-1 RECOMMENDING PROPOSALS
FOR THE VIRGINIA ASSOCIATION OF COUNTIES 1999
LEGISLATIVE PROGRAM, AND PETITIONING THE
GENERAL ASSEMBLY TO FAVORABLY CONSIDER THE
TOPICS AND ISSUES ADDRESSED HEREIN
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, has
identified major legislative issues of state-wide concern to be considered by the 1999
session of the Virginia General Assembly; and
WHEREAS, the Board hereby recommends these issues to its state-wide
organization, the Virginia Association of Counties, for consideration in the adoption of its
legislative program; and
WHEREAS, the Board adopts this resolution as its Legislative Program for
the Virginia Association of Counties for the 1999 session of the Virginia Generai Assembly.
NOW, THEREFORE, Be It Resolved bythe Board of Supervisors of Roanoke
County, Virginia, that the following legislative initiatives are submitted to the Virginia
Association of Counties for its legislative program for the 1999 session of the Virginia
General Assembly for its favorable consideration and adoption.
A. Education. Realizing that public education is the foundation of American
democracy and the cornerstone of our future economic well being, the County urges the
General Assembly to consider favorably the following actions.
1) The Constitution of the Commonwealth of Virginia should be amended to

provide that elected school boards may be granted the authority and responsibility for
taxation to support public education.
2) The General Assembly should authorize a reliable, recurring, independent
source of local funding for school capital construction, that does not require annual or
biennial appropriation by the General Assembly.

of education. Disparity funding should be based upon the composite index (which
measures a locality's relative fiscal ability to provide its share of the cost of a local school
system that meets the standards of quality) and the locality's local effort in support of that
school system.
B. Roanoke County supports legislation relieving local governments of the
responsibility of meeting recycling rates on all wastes collected by private haulers and
diverted from waste disposal facilities identified to receive such wastes as set out in the
local solid waste management plan. This legislation should also require that private haulers
diverting such wastes be held accountable and responsible to meeting the same recycling
rates and requirements as the local governments.
Section 10.1-1411 imposes a 25% recycling mandate on local governments.
The General Assembly has severely limited the ability of local governments to regulate the
flow of waste. This proposal would relieve local governments of the responsibility of
meeting this recycling mandate on all wastes collected by private haulers. It would also

require that private haulers be subject to the same recycling mandates as local
governments.
C. Roanoke County supports additional new construction and maintenance
funding for the Virginia Department of Transportation for secondary and primary roads.
Additional funding for new construction projects will address critical transportation needs
of all local governments. Additional maintenance funding shall be used for an expanded
program to mow grass and weeds, and inspect and clean drainage pipes and culverts.
D. Roanoke County supports allowing the disposal of land clearing vegetative
debris (including tree stumps) in less expensive facilities in a manner not detrimental to the
environment. This would require groundwater and methane gas monitoring, financial
assurances from the owner/operator, and local governing body certification of compliance
with all local ordinances.
E. Roanoke County supports legislation amending Section 14.1-46.01:1 to
increase the salary supplement for the Chairman of the Board of Supervisors from $1,800
to $2,500 per year.
F. Roanoke County supports continued and increased funding for the
Comprehensive Services Act, the Virginia Community Juvenile Crime Control Act, the
Family Preservation Act, local police departments (HB 599 funding), and the Regional
Competitiveness Act.
G. Roanoke County vigorously opposes any attempt to restrict or eliminate
local sources of taxation, including personal property taxation and business and
professional occupational licensing, unless local governments are guaranteed the
opportunity to replace lost sources of local revenue with comparable, equivalent,

independent sources of revenue to allow localities to fulfill their public service obligations.
H. Roanoke County supports authority to impose an additional one-half
percent ('/2%) local option sales tax.
I. Roanoke County supports expanding local authority to create transportation
districts, to impose local option motor vehicle fuels taxes, and to expend these tax proceeds
for local transportation improvements.
J. Roanoke County supports legislation appropriating funds and directing the
State Compensation Board to modify staffing standards for local jails and court services
positions for Sheriff's offices.
K. Roanoke County supports amending Chapter 6.1, "Virginia Tire Tax" of
Title 58.1, "Taxation" (a) to increase the tire tax from $.50 to $1.25, and (b) to direct and
authorize the Department of Waste Management to utilize the increased Waste Tire Trust
Fund to remediate illegal or abandoned waste tire dumps.
L. Amend Sec. 22.1-280.1 to allow the sharing of criminal incident
information between local law enforcement agencies and school officials within or among
political jurisdictions.
M. Amend Sec. 15.2-901 (weeds and trash) and 15.2-904 (inoperable motor
vehicles) to allow enforcement through the use of civil penalties, as authorized for violations
of zoning ordinances under Sec. 15.2-2209,, or for violations of erosion and sediment
control ordinances under Sec. 10.1-562.J.
II. That the Clerk to the Board of Supervisors is directed to send a certified
copy of this resolution to the Virginia Association of Counties.

ORDINANCE 060899-2 AUTHORIZING ACQUISITION OF THE READ
MOUNTAIN WATER COMPANY
WHEREAS, the Utility Director has negotiated an agreement to acquire the assets
of the Read Mountain Water Company owned by Read Mountain Water Company, Inc.;
and,
WHEREAS, on June 1, 1999, the Roanoke County Planning Commission reviewed
the acquisition of the assets of the Read Mountain Water Company and approved said
acquisition as being substantially in accord with the adopted Community Plan, as required
by Section 15.2-2232; and
WHEREAS, Section 18.04 of the Roanoke County Charter directs that the
acquisition of real estate be accomplished by ordinance; the first reading of this ordinance
was held on May 27, 1999, and the second reading was held on June 8, 1999.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF
ROANOKE COUNTY, VIRGINIA:
1. That the acquisition and acceptance of the assets of the Read Mountain
Water Company, serving an area located in Roanoke County and Botetourt County as
shown on the map designated as Exhibit C, from the Read Mountain Water Company, Inc.
for the sum of $600,000 is hereby authorized and approved.
2. That the accounts receivable from the last quarter billing of Read Mountain
Water Company, Inc. will be purchased at 95% of value (estimated to cost $30,000); and
3. That a contingency of $10,000 is necessary for contingencies, surveys, etc.;

4. That the sum of $640,000 is hereby appropriated to fund the purchase of the
assets of the Read Mountain Water Company for the purposes herein described, and for
related expenses of closing this transaction. This money is appropriated from the following
sources: (a) $269,737.51 from the Water Repair and Replacement Fund for water system
acquisition and (b) $370,262.49 from the Water Fund Unappropriated Balance.
5. That the County agrees to pay off-site facility fees for up to 256 residential
connections over a period not to exceed six years. The Water Capital fund will reimburse
the Water Operating Fund for the 256 connections.
6. That the County Administrator is hereby authorized to execute such
documents and take such actions as may be necessary to accomplish these transactions,
all of which shall be on form approved by the County Attorney.
On motion of Supervisor Johnson to adopt the ordinance and add two positions and
vehicles, and carried by the following recorded vote:

BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as

SUMMARY OF INFORMATION:
Each winter the special event section of the Parks and Recreation department sponsors the Children's
Entertainment series. This year Parks and Recreation sponsored a performance by Theatre IV of
Richmond. Theatre IV is a sanctioned program of the Virginia Commission of the Arts which makes
localities eligible for grants to help pay for performances by sanctioned groups. Parks and Recreation
applied and received $1,000 for this program.
FISCAL IMPACT:
Increase the Parks and Recreation special event budget by $1,000.
STAFF RECOMMENDATION:
The Board of Supervisors appropriate $1,000 to Parks and Recreation Department to offset the expense of
Theatre IV.

COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
The Board of Supervisors has previously approved the construction of phase 1 of the South County Park.
Part of this process authorized the Parks and Recreation department to apply for recreational access funds.
In March 1999, the Commonwealth Transportation Board approved a $190,000 recreational access grant to
construct the access road for the new South County Park. County policy requires these funds be
appropriated to the Parks and Recreation budget.
FISCAL IMPACT:
Increase the Parks and Recreation capital budget by $190,000.
STAFF RECOMMENDATION:
Staff recommends that the Board of Supervisors appropriate the $190,000 access grant for the South
County Park development

AGENDA ITEM: Request for advance spending of $728,000 Technology Funding and
appropriating to the Technology Grant Fund
BACKGROUND: Chapter 935, 1999 Virginia Acts of Assembly (the 1998-2000
Appropriation Act) authorizes the Virginia Public School Authority to conduct an education
technology grant program in the spring of the year 2000. This program focuses on: a) school
networks; b) providing network -ready multimedia computers for every classroom; and
c) providing a 5 to 1 ratio of pupils to network -ready computers. Roanoke County's portion of
this grant is $728,000. With the attached resolution, localities are authorized to expend these funds
immediately and reimburse the locality upon the sale of the bonds.
SUMMARY OF INFORMATION: This money will be used to provide a general purpose
Pentium or PowerPC computer lab for each school not having one and additional Windows®
computers to achieve the objective of having a networked, multimedia computer in each high
school classroom.
FISCAL IMPACT (Alternatives, if applicable):
The required local match of $145,600 is included in the media services budget for 1999-2000.
STAFF RECOMMENDATION:
Staff recommends approval of the resolution and appropriation of $728,000 to the Grant Fund for
the purchase of classroom computers, related peripherals, and networking.

COUNTY MEETING IN REGULAR SESSION AT 7:00 P.M. ON MAY 27, 1999 IN
THE BOARD ROOM OF THE ROANOKE COUNTY SCHOOLS ADMINISTRATIVE
OFFICES.
RESOLUTION OF THE SCHOOL BOARD OF ROANOKE COUNTY
DECLARING ITS INTENTION TO REIMBURSE ITSELF FROM THE
PROCEEDS OF ONE OR MORE GRANTS MADE BY THE
COMMONWEALTH OF VIRGINIA FOR CERTAIN
EXPENDITURES TO BE MADE IN CONNECTION WITH CERTAIN
CAPITAL IMPROVEMENTS
WHEREAS, Roanoke County Public Schools (the "Division") is a political
subdivision organized and existing under the laws of the State of Virginia; and
WHEREAS, the Division will pay, after June 15, 1999, certain expenditures (the
"Expenditures") in connection with the capital project (the "Project"), as more fully
described in Appendix A attached hereto; and
WHEREAS, the Roanoke County School Board of the Division (the "Board") has
determined that the money to be advanced on and after the date hereof to pay the
Expenditures are available only for a temporary period and it is necessary to reimburse
the Division for the Expenditures from the proceeds of one or more grants to be made by
the Commonwealth of Virginia (the "Grants") from the proceeds of its tax exempt notes
(the Notes");
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD AS FOLLOWS:
Section 1. The Board hereby declares the Division's intent to reimburse the
Division with the proceeds of the Grants for the Expenditures with respect to the Project
made on and after June 15, 1999. The Division reasonably expects on the date hereof that
it will reimburse the Expenditures with the proceeds of the Grants.
Section 2. Each Expenditure will be of a type properly chargeable to a capital
account under general federal income tax principles (determined in each case as of the
date of the Expenditure).
Section 3. The maximum cost of the Project is expected to be $728,000.

Section 4. The Division will make a reimbursement allocation, which is a written
allocation by the Division that evidences the Division's use of proceeds of the Grants to
reimburse an Expenditure, no later than 18 months after the later of the date on which the
Expenditure is paid or the Project is placed in service or abandoned, but in no event more
than three years after the date on which the Expenditure is paid. The Division recognizes
that exceptions are available for certain "preliminary expenditures," costs of issuance,
certain de. minimus amounts, expenditures by "small issuers" (based on the year of
issuance and not the year of expenditure) and expenditures for construction projects of at
least 5 years.
Section 5. This resolution shall take effect immediately upon its passage.

Appendix A
Classroom Computers and Networking
Technology Initiative Project
Roanoke County School Board
The Roanoke County School Board, in accordance with its Plan for Instructional
Technology and the Six -Year Educational Technology Plan for Virginia, will use the proceeds
from this grant for the purchase of classroom computers, peripheral devices, and equipment
necessary to connect computers to Local Area Networks in each building and a proposed Wide
Area Network within Roanoke County.
Equipment to be purchased includes multimedia, network -ready computers (either
Macintosh or Windows), printers, display devices, CD-ROM drives, ethernet cards, and graphic
devices such as scanners and digital cameras. Where needed for optimum use, portable computers
may be substituted.
All buildings within the Roanoke County School Division have been wired with an ethernet
network. A limited amount of additional wiring and network equipment has been identified as
necessary to complete and enhance the Local Area Networks. Equipment to facilitate connection to
Virginia's PEN and the Internet may also be purchased.

COUNTY ADMINISTRATOR'S COMMENTS:
BACKGROUND: For fiscal year 1999, Congress has provided a down payment of $1.2 billion that will be available to
States on July 1, 1999, to hire new classroom teachers for the 1999-2000 school year in grades 1, 2 and 3. Since research
shows the value of lowering class size, the goal of this Class -size Reduction initiative is to help schools improve student
achievement by adding additional, highly qualified teachers to the workforce. The addition of these teachers would ensure
that class size in some of the aforementioned grades be reduced to no more than 18 children per class.
SUMMARY OF INFORMATION:
Roanoke County is eligible to receive $121,586 for hiring teachers to reduce class size to 18 or below. After close
examination of class size averages and space availability at each of the 17 elementary schools, the following schools will
receive one additional teacher in 2nd grade for the 1999-2000 school year: Burlington, Cave Spring Elementary, Clearbrook
and Mountain View.
FISCAL IMPACT:
The grant money in the amount of $121,586 will become available after July 1, 1999.

COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
The Developers of The Orchards, Botetourt South, Section 5, F & W Community Development,
have requested that Roanoke County accept the Deed conveying the sanitary sewer facilities
serving the subdivision along with all necessary easements.
The sewer facilities are installed, as shown on plans prepared by Lumsden Associates entitled
Botetourt South, Section 5, dated December 5, 1995, which are on file in the Community
Development Department. The sanitary sewer facility construction meets the specifications and
the plans approved by the County.
FISCAL IMPACT:
The value of the sanitary sewer construction is $27,400.
RECOMMENDATION:
Staff recommends that the Board of Supervisors accept the sanitary sewer facilities serving the
Botetourt South, Section 5 subdivision along with all necessary easements, and authorize the
County Administrator to execute a Deed for the transfer of these facilities.

THIS CHATTEL DEED, made this 23rd day of December , 19 97 , by and
between: F & W Community Development , a Virginia corporation, hereinafter referred to
as the "Developer," parry of the first part; and the BOARD OF SUPERVISORS OF ROANOKE
COUNTY, VIRGINIA, its successors or assigns, hereinafter referred to as the 'Board," party of the
second part.

THAT FOR AND IN CONSIDERATION of the mutual benefits accruing to the parties, the
receipt and sufficiency of which is hereby acknowledged, the Developer does hereby GRANT,
CONVEY, ASSIGN AND TRANSFER, with the covenants of GENERAL WARRANTY OF
TITLE, in fee simple unto the Board all water and/or sewer lines, valves, fittings, laterals,
connections, storage facilities, sources of 70^ m oles and any and all other
pumps,
equipment and appurtenances thereunto belonging, in and to the u4t*elrand/or sewer systems in the
streets, avenues, public utility, easement areas, water and sewer easement areas that have been or
may hereafter be installed by the Developer, along with the right to perpetually use and occupy the
easements in which the same may be located, all of which is more particularly shown, described and
designated as follows, to wit:

Associates and on file in the Roanoke County Engineering Department.
The Developer does hereby covenant and warrant that it will be responsible for the proper
installation and construction of the said water and/or sewer systems including repair of surface areas
affected by settlement of utility trenches for a period of one (1) year after date of acceptance by the
Board and will perform any necessary repairs at its cost.
Elmer C. Hodge, County Administrator of Roanoke County, Virginia, hereby joins in the
execution of this instrument to signify the acceptance of this conveyance pursuant to Resolution No.
adopted by the Board of Supervisors of Roanoke County, Virginia, on the

AGENDA ITEM: Request to appropriate inmate forfeited Social Security Administration
Payments
COUNTY ADMINISTRATOR'S COMMENTS:
BACKGROUND: In accordance with section 1611(e) (1) (1) (1) (11) of the Act, SSA will pay
an incentive payment to a facility/institution covered by this agreement for information on
a confined individual which the Compensation Board Reporter furnishes to SSA within the
time periods specified in the agreement. The Roanoke County Sheriff's Office furnishes
a LIDS (Local Inmate Data System) report on a monthly basis to the State Compensation
Board to receive revenue per diem payments. This report is also being utilized to assist
the SSA with identifying inmates who are receiving social security payments while
incarcerated. Once the SSA has this information they suspend payment to the inmate and
pay the County an incentive payment of $200 or $400 for the information. The amount of
payment depends on the time frame in which the SSA receives information from the
Compensation Board, 30 days/$400 and 90 days/$200.
Due to the increase in inmate population from an ADP of 159 in FY97/98 to an ADP of 180
in FY98/99 the Jail Facility is projecting a 44% increase in total medical supply costs
(medicine) for inmates in FY98/99 over the previous fiscal year. [FY97/98 total medical
supply costs were $22,463.11 (budget - $14,000) and FY98/99 projected costs will total
$32,369 (budget - $16,000)]. The Roanoke County Sheriff's Office would like to use these
revenues in the same manner as the Inmate Co -Payment Program. We anticipate annual
revenue of $600-$1,000 from this source which would assist in offsetting the escalating
medical supply costs for inmates.
SUMMARY OF INFORMATION: I request that the Board of Supervisors appropriate the
fees collected from inmate forfeited social security payments for medical supply (medicine)
costs and direct the Roanoke County Department of Finance to credit the Jail Medical
Account an amount equal to that collected each month.
FISCAL IMPACT: None
ALTERNATIVES: Place fees collected in to the Roanoke County General Fund and
increase the target budget for medical care for Roanoke County/Salem prisoners.

AGENDA ITEM: NAMING OF SOFTBALL FIELD AT SHELL PARK
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION
Supervisor Minnix has requested that the softball field at Shell Park next to the Penn
Forest Elementary School be named in honor of a Southwest County resident who has
worked with County youth and the softball program for many, many years.
The proposed name for the softball field is not being made public at this time so that
this citizen and his family may be recognized at a dedication ceremony at a later date.
All of the Board members were notified earlier of this request and have agreed that
it would be fitting that this softball field be named for this citizen. Also, Director of Parks &
Recreation Pete Haislip has been notified of this proposed action, and concurs with the
request.
STAFF RECOMMENDATION:
Staff recommends that the softball field be named in honor of this citizen and his life-
long contributions to youth athletics in Roanoke County, and that the name be made public
at the time of the dedication ceremony.

RESOLUTION 060899-4 CERTIFYING EXECUTIVE MEETING WAS HELD
IN CONFORMITY WITH THE CODE OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened
an executive meeting on this date pursuant to an affirmative recorded vote and in
accordance with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by the
Board of Supervisors of Roanoke County, Virginia, that such executive meeting was
conducted in conformity with Virginia law.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke
County, Virginia, hereby certifies that, to the best of each member's knowledge:
