HomeMy WebLinkAbout11/14/2000 - Adopted Board RecordsAT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY,VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, NOVEMBER 14, 2000 RESOLUTION 111400-1 ADOPTING A LEGISLATIVE PROGRAM FOR THE 2001 SESSION OF THE VIRGINIA GENERAL ASSEMBLY, AND PETITIONING THE GENERAL ASSEMBLY TO FAVORABLY CONSIDER THE TOPICS AND ISSUES ADDRESSED HEREIN WHEREAS, the Board of Supervisors of Roanoke County, Virginia, has identified major legislative issues of state-wide concern to be considered by the 2001 session of the Virginia General Assembly; and WHEREAS, the Board adopts this resolution as its Legislative Program for the 2001 session of the Virginia General Assembly. NOW, THEREFORE, Be It Resolved by the Board of Supervisors of Roanoke County, Virginia, that the following legislative initiatives are submitted for its legislative program for the 2001 session of the Virginia General Assembly for its favorable consideration and adoption. A. Education. Realizing that public education is the foundation of American democracy and the cornerstone of our future economic well being, the County urges the General Assembly to consider favorably the following actions. 1) The Constitution of the Commonwealth of Virginia should be amended to provide that elected school boards may be granted the authority and responsibility for taxation to support public education. 2) The General Assembly should enhance funding for public education, including increasing the funds available to the Literary Fund for local school capital construction or renovation projects. The General Assembly should increase funding for capital construction and renovation projects based upon the locality's local effort in support of these capital projects. for school. 3) Local school divisions should be authorized to establish opening dates 1 4) Disparity funding should be based not only upon the number of students eligible forfree or reduced fee lunches, but also upon the locality's local tax effort in support of education. Disparity funding should be based upon the composite index (which measures a locality's relative fiscal ability to provide its share of the cost of a local school system that meets the standards of quality) and the locality's local effort in support of that school system. B. Public Service Corporations. 1) Roanoke County supports legislation to provide citizens better notice of proposed construction of public service corporation facilities. "Interested parties" requiring written notice should include property owners directly affected by the proposed location of new facilities. 2) Roanoke County supports legislation to provide the State Corporation Commission with expanded authority to require joint use of existing easements for the installation of new facilities of public service corporations. Further the grant of all certificates of public convenience and necessity and the right to exercise the power of eminent domain to acquire any lands or estates or interests therein shall be conditioned upon the future joint use of existing easements or rights-of-way. C. Environment. 1) Roanoke County supports amending Chapter 6. 1, "Virginia Tire Tax" of Title 58. 1, "Taxation" (a) to increase the tire tax from $.50 to $1.25, and (b) to direct and authorize the Department of Waste Management to utilize the increased Waste Tire Trust Fund to remediate illegal or abandoned waste tire dumps. 2) Roanoke County supports allowing the disposal of land clearing vegetative debris (including tree stumps) in less expensive facilities in a manner not detrimental to the environment. D. Local Taxation and Funding. 1) County vigorously opposes any attempt to restrict or eliminate local sources of taxation, including personal property taxation and business and professional occupational licensing, unless local governments are guaranteed the opportunity to 2 replace lost sources of local revenue with comparable, equivalent, independent sources of revenue to allow localities to fulfill their public service obligations. 2) Roanoke County supports restructuring the distribution of tax revenues in the Commonwealth, by returning a portion of the state income tax collections to localities for their unrestricted use. 3) Roanoke County supports continued and increased funding for the Comprehensive Services Act, the Virginia Community Juvenile Crime Control Act, the Family Preservation Act, local police departments (HB 599 funding), and the Regional Competitiveness Act. 4) Roanoke County requests funding for the Virginia Recreational Facilities Authority (Explore Park), Blue Ridge Parkway Interpretive Center, and capital construction funding for the Explore Park Education Center. 5) Roanoke County supports authority to impose an additional one-half percent ('h%) local option sales tax. 6) Roanoke County supports increased capital construction funding for regional juvenile detention facilities, and that such facilities receive at least 50% of their operating costs from the Commonwealth. 7) Roanoke County supports legislation amending Section 14.1-46.0:1 to increase the salary supplement for the Chairman of the Board of Supervisors from $1,800 to $2,500 per year. That the Clerk to the Board of Supervisors is directed to send a certified copy of this resolution to Senator John S. Edwards, Senator Malfourd W. "Bo" Trumbo, Delegate H. Morgan Griffith, Delegate Clifton "Chip" Woodrum, Delegate C. Richard Cranwell, Delegate A. Victor Thomas; Mary F. Parker, Roanoke City Clerk; Members of the Roanoke City Council; Forest Jones, Clerk for Salem City Council; Members of the Salem City Council; Clerk for the Town of Vinton; Members of the Vinton Town Council and the Fifth Planning District Commission, and the Virginia Association of Counties. Campbell, Executive Director, Virginia Association of Counties 4 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, NOVEMBER 14, 2000 RESOLUTION 111400-2 TO ADVANCE FUNDS FOR CERTAIN EXPENDITURES MADE AND/OR TO BE MADE IN CONNECTION WITH THE ACQUISITION, RENOVATION, CONSTRUCTION AND EQUIPPING OF CERTAIN CAPITAL IMPROVEMENTS FOR SCHOOL PROJECTS WHEREAS, the Board of Supervisors of the County of Roanoke, Virginia (the "County Board") adopted a resolution on August 19, 1997 declaring its intention to reimburse itself from the proceeds of one or more tax-exempt financings for certain expenditures made and/or to be made in connection with the acquisition, renovation, construction and equipping of certain capital improvements for school projects, and WHEREAS, the School Board (the "School Board") of the County of Roanoke, Virginia (the "County") adopted a resolution on August 28, 1997 declaring its intention to reimburse itself from the proceeds of one or more tax-exempt financings for certain expenditures made and/or to be made in connection with the acquisition, renovation, construction and equipping of certain capital improvements for school projects, and WHEREAS, the School Board requested an advance to award contracts of $318,000 for site development, $129,300 for architecture and engineering costs, value engineering, and surveying/testing, and $226,651 for project management for Glenvar Middle School, for a total advance of $673,951, on June 13, 2000, and WHEREAS, the School Board requested an advance to award contracts of $592,100 for site development, $500,000 for road construction, and $757,992 for project management for the new south county high school, for a total advance of $1,850,092, on 1 June 13, 2000, and WHEREAS, the County Board approved an advance of $1,850,092 for the new south county high school and an advance of $673,951 for Glenvar Middle School on June 13, 2000, and WHEREAS, the School Board requested an advance of $9,500,000 to award the construction contract for the new south county high school for $19,094,000 on October 9, 2000, and WHEREAS, the County Board authorized the School Board to enter into a construction contract for $19,094,000 and approved an advance of $9,500, 000 for the new south county high school on October 10, 2000, and WHEREAS, the School Board now desire to award the construction contract for the renovations of Glenvar Middle School, and WHEREAS, the Schools Board requested as advance of $4,000,000 to award the construction contract for renovations at Glenvar Middle School for $6,125,000 on November 10, 2000, NOW THEREFORE BE IT RESOLVED, that the County Board approves the total budget for the Glenvar Middle School project of $7,819,767, authorizes the School Board to enter into a construction contract for $6,125,000, and advances the sum of $4,000,000, for renovations to Glenvar Middle School. Swortzel was assigned to the first accreditation team for the Police Department and was instrumental in receiving the first accreditation in 1992; and WHEREAS, Sgt. Swortzel has been assigned to the School Services Unit for the past five years; was responsible for implementing many of the successful School -Police programs in place today; and worked very hard with the students to make the programs effective; and WHEREAS, Sgt. Swortzel, through his employment with Roanoke County, has been instrumental in improving the quality of life for its citizens. Robinson retired from Roanoke County on October 1, 2000 as a Police Officer Sergeant after more than twenty-six years of service; and WHEREAS, Sgt. Robinson was the first Public Information Officer in the Sheriff's Office and served in that capacity for approximately two years; and WHEREAS, Sgt. Robinson spent his last eight years assigned to the Criminal Investigations Division, daily managing the activities of the detectives, and was noted for his ability to relate to citizens and reduce their concerns in very stressful situations; and WHEREAS, Sgt. Robinson, through his employment with Roanoke County, has been instrumental in improving the quality of life for its citizens. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to ROGER F. ROBINSON for more than twenty-six years of capable, loyal and 1 dedicated service to Roanoke County; and BE IT FURTHER RESOLVED, that the Board of Supervisors does express its best wishes for a happy, restful, and productive retirement. Shotwell was first employed by Roanoke County on September 1, 1980 in as a Deputy Sheriff - Uniform Division in the Sheriffs Office; and also served as Deputy Sheriff Sergeant - Corrections before transferring to the Police Department; and WHEREAS, Officer Shotwell retired from Roanoke County on August 1, 2000 as a Police Officer - Uniform Division after more than twenty years of service; and WHEREAS, Officer Shotwell, prior to working for Roanoke County, had a distinguished career in the United States Army serving as a Noncommissioned Officer; and WHEREAS, Officer Shotwell's favorite duty was patrol; and he was well known and respected as a patrol officer in the Glenvar and Bradshaw areas of the County; and WHEREAS, Officer Shotwell possessed an extra -ordinary ability to work with people regardless of their situation as victim or offender; and WHEREAS, Officer Shotwell, through his employment with Roanoke County, has been instrumental in improving the quality of life for its citizens. Hogan was first employed by Roanoke County on July 1, 1971 as a dispatcher; and has also served as Lead PBX Operator and Lead Dispatcher; and WHEREAS, Ms. Hogan retired from Roanoke County on August 1, 2000, as the Chief Communications Officer with the Police Department after more than twenty-nine years of service; and WHEREAS, Ms. Hogan, as manager of the communications section, was an advocate for the communications personnel, and was respected and held in high esteem by her co-workers; and WHEREAS, as the result of Ms. Hogan's efforts, working conditions in the 911 Center improved greatly under her management; and WHEREAS, Ms. Hogan had an excellent rapport with County residents and was able to assist them in many life threatening situations, saving countless lives, and was instrumental in improving the quality of life for all citizens. There were 11 members on the commission representing various organizations and agencies interested in transportation safety. One of their most important duties was to approve grant requests. Grants are no longer processed in this manner. The commission now meets three or four times a year. They have an annual dinner to present awards and recognize various individuals for safety awareness. There are currently five vacancies on the commission that have not been filled. The remaining active members would have the opportunity to join the Blue Ridge Transportation Safety Board if they wished to. SUMMARY OF INFORMATION: At the September 12 Board meeting, the Board of Supervisors requested that staff investigate the continuing need for this commission and whether the Blue Ridge Transportation Safety Board might be a more effective organization for safety awareness. Police Chief Ray Lavinder recommends rescinding the original resolution, abolishing the Roanoke County Highway Transportation Safety Commission and putting our efforts into the Blue Ridge Transportation Safety Board. The Blue Ridge Transportation Safety Board is made up of 16 counties, 8 cities and 23 towns. They meet quarterly with their primary focus on safety issues. They are currently involved in efforts such as Interstate 81 safety and emphasis on the importance of using child safety seats and bicycle helmets. The membership of the Board is comprised of individuals who are interested in various aspects of traffic safety and include police officers, insurance companies, and members of the legal, medical and law enforcement communities. Membership is by invitation of the Blue Ridge Transportation Safety Board and there is no established number of representatives from each locality. Roanoke County currently has two representatives serving on the Board, Police Officer Lee Linkous and Judge Phillip Trumpeter. Attached is a letter from Police Chief Ray Lavinder, a list of the current members and the localities who are members of the Blue Ridge Transportation Safety Board. STAFF RECOMMENDATION: Staff recommends that the Board of Supervisors rescind resolution 84-37, abolish the Roanoke County Highway Transportation Safety Commission and focus our efforts on the Blue Ridge Transportation Safety Board. Because of changes in the last sixteen years in the way grants are processed, the approval of a local "board" is no longer necessary. It appears that the commission has outlived it original purpose. The board does bring various members of the community together to discuss local safety issues. The board also annually recognizes persons who have contributed to local safety, as does many other local organizations. There is the possibility that we could be criticized for doing away with a "safety commission" at a time when highway safety is very much an issue with local citizens i.e. I-81 and 220-I-73. My recommendation would streamline our operations by putting all our efforts into the Blue Ridge Transportation Safety Board. It is located locally on Airport Road and addressees the same issues as does the County's Commission, it is composed of the same type of citizen groups as the commission. The Roanoke County Police Department has a member on its board; we are represented by Officer Lee Linkous. Hyatt, Chief Financial Officer AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, NOVEMBER 14, 2000 RESOLUTION 111400-3.s RECOGNIZING PRESERVATION EFFORTS ON READ MOUNTAIN AND APPROVAL OF APPLICATION FOR FUNDING FOR CONSERVATION EASEMENTS AND LAND ACQUISITION WHEREAS, a group of property owners and interested citizens have initiated efforts to enhance and preserve Read Mountain; and WHEREAS, the mountains and ridgelines in Roanoke County are unique and vital resources of both scenic and natural value; and WHEREAS, goals of the Roanoke County Community Plan include the preservation and management of the natural, historic and scenic resources of Roanoke County; and WHEREAS, objectives of the Roanoke County Community Plan include the requirement that land management policies preserve the natural scenic and historic environment while accommodating future growth and development, protect the mountainsides and ridgetops, and encourage land use patterns that conserve and protect open space thereby providing wildlife habitat and recreational opportunity; and WHEREAS, the views and preservation of Read Mountain have been identified as important to the Hollins and Bonsack Community Planning Areas; and WHEREAS, the acquisition of conservation easements and/or real property on Read Mountain would be the cornerstone for the preservation of Read Mountain as an urban forest for all citizens of the Roanoke Valley to enjoy; NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia: 1 1. That Roanoke County has an interest in the preservation of Read Mountain. 2. That Roanoke County shall work with property owners and citizens to achieve these goals. 3. That efforts to preserve Read Mountain should include the acquisition of conservation easements or real property. 4. That Roanoke County should attempt to secure funding from state or federal resources in these preservation efforts. 5. That the Board of Supervisors approves the application to the Virginia Land Conservation Foundation's Land Conservation Fund Grant Program for funding towards the preservation of Read Mountain. NOW THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the Zoning Ordinance of the County of Roanoke is hereby amended and reenacted to provide as follows: I. ARTICLE IV. SECTION 30-82 (RESIDENTIAL USES) IS HEREBY AMENDED AS FOLLOWS: Amend Section 30-82-12 (B) 4 as follows: 4. No two dwelling units built under these provisions shall be attached along the common property line (See Single Family, Attached). . A perpetual five-foot wall -maintenance easement shall be provided on the lot adjacent to the zero lot line property line. This easement shall be kept clear of structures or any other improvement which would infringe on the use of the easement, with the exception of freestanding walls and fences. This easement shall be shown on the plat and incorporated into each deed transferring title to the property. G. A copy of the plat approved by the subdivision agent of the County shall be submitted to the administrator. The After School Day Program will operate following the schedule of the Roanoke Area School Calendars. One hundred and fifty (150) campers shall be allowed. Two -hundred (200) campers shall be allowed beginning in September 2002, excluding half-day campers. B. The morning half-day program will be as follows: -There shall be a maximum of 25 children, 3.5 to 5 years old. -The program shall operate two days per week, 9:30am to 12:30pm. -The program will operate following the schedule of the Roanoke Area School Calendars. C. The program shall maintain a state day care license. (2) Summer Camps A. The program will operate following the schedule of the Roanoke Area School Calendars. One hundred and fifty (150) campers shall be allowed. Two -hundred (200) campers shall be allowed beginning in June 2002, including half-day campers. (3) Developmental Team Camps A. The camps will operate 6:OOpm to 9:OOpm Monday thru Friday. The gate will close at 9:30 pm, except during indoor soccer season, (November 15 — February 15) when operating hours will be to 10:OOpm and the gate shall close at 10:30pm. 2 B. Saturday hours shall be from 9:00am to 9:0Opm. (Gate shall close at 9:30pm). C. Sunday hours shall be 1:00pm to 6:00pm except during indoor soccer season (November 15 — February 15) when operating hours shall be until 9:00pm (Gate shall close at 9:30pm). D. All camps shall be run by Rising Star staff. E. All camp enrollments shall be individual. All instruction shall be given by Rising Star staff. (4) Single Function Clinics A. Single function clinics of up to a maximum of four (4) hours would be permitted during operating hours. (5) Weekend Tournaments A. No more than 8 outdoor (3 Fall, 3 Spring, 2 Summer) and 16 indoor tournaments shall be held during any calendar year. All tournaments (except Commonwealth Games) shall be sponsored and operated by Rising Star. B. No more than 20 teams shall participate in any indoor tournament. No more than 10 teams shall participate in any outdoor tournament. C. Pre -registration, with Rising Star, shall be required for all tournament teams. K D. Tournaments could be held on Friday evening, Saturday, and Sunday during normal operating hours as set above, except that Sunday tournaments can be held between the hours of 10:00am and 6:OOpm. E. Abutting property owners shall be notified in writing one week in advance of all tournaments. (6) Operations A. Lighting shall not be provided for any outdoor field, court or other athletic area. B. There shall be no loud speakers or other sound amplification device used on Rising Star property. C. Rising Star shall not allow or encourage the parking of any vehicle associated with Rising Star on Yellow Mountain Road. This parking prohibition shall be publicized in Rising Star publications and newsletters. D. No alcoholic beverages shall be allowed on the property. E. No outside vendors shall be allowed on Rising Star property. F. No professional or semi-professional sports teams shall be allowed to play or practice at Rising Star except Roanoke Steam, subject to the following conditions: 1. No other professional sports team would be allowed to practice at Rising Star other than the Roanoke Steam due to its uniqueness. 4 2. There would be no alcohol or profanity allowed. 3. No loud speakers permitted. 4. No buses would be allowed for transportation of the Roanoke Steam. 5. Use of the Rising Star facility would be within the operating hours of 9:00 a.m. to 10:00 p.m. 6. This would be one season limit for year 2001 only. (7) Holiday Closings A. Rising Star shall be closed on the following holidays: New Year's Day, Easter, Memorial Day, Labor Day, Thanksgiving Day, Christmas Eve, Christmas Day. (8) Activity Supervision A. Rising Star's personnel shall be present in a supervisory role at the site at all times. (9) Physical Development A. The site shall be developed generally in accord with a concept plan entitled " Concept Plan, Pollock Soccer Camp, Yellow Mountain Road, Prepared by Lang Engineering, and dated June 19, 1997. B. A 4 -foot high chain link fence shall be installed on the property line along the entire length of the two athletic fields, where these fields adjoin Roanoke County Tax Parcel 98.04-1-23, said parcel currently owned by Donald Dean. The fence will be installed by August 2001. 5 C. A maximum of 12, 6 -foot tall pine trees shall be planted and maintained, and evenly spaced along the mutual property line of Darlene Overstreet (98.04-1-21.1), where said property line abuts the athletic field. The trees shall be planted by August 2001. D. Rising Star will install and maintain a marker ribbon 200 feet from the property line of Clovis Hartman (Tax Parcels 99.00-2-13,14, and 15). Children shall not be allowed within this 200 foot boundary. 2. That this ordinance shall be in full force and effect thirty (30) days after its final passage. All ordinances or parts of ordinances in conflict with the provisions of this ordinance be, and the same hereby are, repealed. The Zoning Administrator is directed to amend the zoning district map to reflect the change in zoning classification authorized by this ordinance. WHEREAS, by an agreement between the Authority, the County, F&W Properties 11, Inc., and the Greater Roanoke Valley Development Foundation ("the Foundation") a shell building was constructed at Valley Gateway. This agreement provides that the Authority will begin making the interest payments on the construction loan held by the Foundation beginning two years after the completion of construction (November 11, 2000) and continuing until either (a) the building is sold, or (b) the Foundation's five year note to the Authority has become due (May 15, 2002). NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the sum of $45,000 is hereby appropriated and donated to the Authority. That this appropriation of public funds is made from funds available and previously appropriated in the County's Public Private Partnership account. 2. That this appropriation and donation to the Authority is made for the following economic development purposes: to pay the interest payments on the construction loan held by the Foundation on the shell building in Valley Gateway from November 11, 2000 through June 30, 2001. 3. ITEM NUMBER` AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: November 14, 2000 AGENDA ITEM: Request for Appropriation as a Result of Operations for the Year Ended June 30, 2000 COUNTY ADMINISTRATOR'S COMMENTS: The results of the YE financial operations are very favorable and I am most pleased. Several things are noteworthy. First, I wish more of the increase had come from commercial and industrial Real Estate taxes which would reflect improvements in our economic development efforts. RIE taxes were actually slightly UNDER our expectations. Perhaps this is indicative of lessening dependency on RIE taxes and a trend to other sources such as personal property, sales taxes, meals taxes, and fees. -The greatest increase came from Personal Property taxes ($1,085,997). This indicates that we have a large dependence on the currently good economy that is encouraging consumer spending. It should be noted that expenditure savings are getting smaller each year as we tighten the budgets on the departments. We really provide great services, with great customer service, with less money than most other localities in the State. This is reflected in the 'yellow book" that we receive each year from the Auditor of Public Accounts. It is also meaningful to me that our budget this year is very good and the staff and I appreciate your support in this. We funded the operating costs of the new high school, bought new fzretrucks, new trash trucks, and we gave good increases to our employees. It has been a very good year. SUMMARY OF INFORMATION: KPMG has completed their audit of the financial operations of the County of Roanoke and the County of Roanoke Schools for the year ended June 30, 2000. The County received a favorable opinion. The printed Comprehensive Annual Financial Report will be distributed to the Board of Supervisors as soon as it is received from the printers in a few weeks. The Audit Committee will meet on November 17, 2000 to review the results of the year's operations and the management letter comments from the auditors. The County operations for the year ended June 30, 2000 resulted in expenditure savings of $457,936 as shown on Attachment A. Based upon the policy for the rollover of year end savings the departments were able to request up to 60% of the savings within their own department for special purchases and programs as approved by the County Administrator. These approved departmental rollovers total $233,235, which are outlined in Attachment C. This leaves a net M:\FINANCE\COMMON\Board-Reports\2000\11-14-00b.wpd "- — expenditure savings of $224,701. Based upon the rollover policy this amount will be transferred to the capital unappropriated balance. The general fund revenues were $3,362,649 over budget, as shown on Attachment A. A more detailed analysis of general fund revenues is outlined in Attachment B. From this amount, the Board approved a rollover of $723,267 as part of the original 2000-2001 budget appropriation. This rollover was for the following items: Building upgrades for fire and rescue $500,000 Financial system upgrade 100,000 GASB 34 - Restructure Financial Reporting 50,000 VA Western Comm College - site preparation 32,267 Treasurer - Investment Tracking Software 41,000 Total $723,267 This leaves a balance of $2,639,382 to be added to the general fund unappropriated balance. The general fund unappropriated balance at June 30, 2000 is $9,908,641. This is an increase of $2,099,688 or 26.89% from last year. As of June 30, 2000 the general fund unappropriated balance was 8.63 % of the general fund revenues. STAFF RECOMMENDATION: In accordance with County policy, staff recommends the following: 1. The County net surplus of $224,701 be appropriated to the capital unappropriated fund according to the rollover policy. 2.
