RESOLUTION 012301-2 APPROVING AND CONCURRING IN CERTAIN
ITEMS SET FORTH ON THE BOARD OF SUPERVISORS AGENDA
FOR THIS DATE DESIGNATED AS ITEM J - CONSENT AGENDA
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That the certain section of the agenda of the Board of Supervisors for January
23, 2001, designated as Item J - Consent Agenda be, and hereby is, approved and
concurred in as to each item separately set forth in said section designated Items 1
through 10, inclusive, as follows:
1. Confirmation of committee appointments to the Library Board and
Social Services Advisory Board
2. Cancellation of joint meeting with Roanoke City Council on February
5, 2001.
3. Designation of John Murphy as Subdivision Agent for Roanoke
County and designation of alternates.
4. Acceptance and appropriation of Virginia Department of Health
Development Block Grant of $8,025 for the reimbursement of 3
automated external defibrillators.
5. Acceptance and appropriation of $7,500 grant for reimbursement of
a computer and projector for the Regional Fire/EMS Training center.

Supervisor Nickens is nominating Douglas C. Forbes to a four-year term which will expire
August 1, 2004, representing the Vinton Magisterial District.

COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
By Resolution No. 010201-1 the Board of Supervisors of Roanoke County established
a meeting schedule for calendar year 2001. At that time a joint meeting with Roanoke City
Council was scheduled for Monday, February 5, 2001 at 12 noon.
Since you recently met with Roanoke City Council and representatives of the other local
governments in the region on January 8, 2001, for the Roanoke Valley Regional Summit,
Roanoke City Council has requested that a meeting scheduled for February 5, 2001, be
cancelled. It is proposed that a future meeting be scheduled laterthis spring 2001. The Clerk
to the Board of Supervisors will coordinate scheduling for this future meeting with her
counterpart in Roanoke City.
STAFF RECOMMENDATION:
It is recommended thatthe Board cancel the previously scheduled meeting for Monday,
February 5, 2001, with Roanoke City Council.

AGENDA ITEM: Appointment of John Murphy as Subdivision
Agent for Roanoke County; Designation of
Alternate Agents
COUNTY ADMINISTRATOR'S COMMENTS:
BACKGROUND:
Section 15.2-2255 of the Code of Virginia specifies that a
local governing body shall be vested with the responsibility to
administer and enforce the subdivision regulations of the
jurisdiction. The local governing body also has the right to
delegate this responsibility to the Planning Commission or other
individual or entity.
Historically, the Board has delegated this responsibility to
an administrative subdivision agent. Arnold Covey, Director of
Community Development is currently Roanoke County's subdivision
agent, and Terrance Harrington serves as alternate subdivision
agent. These two individuals are thus authorized by code to
approve subdivision plats on behalf of the Board of Supervisors.
The creation of the Department of Community Development in
1998 has provided many opportunities to improve the efficiency of
the delivery of Roanoke County services. Under our current
organization, Associate Planner John Murphy, Engineering/GIS

Technician Denise Sowder, and Development Review Coordinator
Kristie Hayslett are all closely involved in the day-to-day
review of subdivision plats and other aspects of administering
the subdivision ordinance. It is appropriate that these three
individuals have the responsibility to ensure compliance with the
ordinance and the authority to approve submitted plats that
comply with the ordinance.
STAFF RECOMMENDATION:
Staff recommends as follows:
1. That the Board of Supervisors appoint John Murphy as
Subdivision Agent for Roanoke County Virginia; and,
2. That the Board of Supervisors appoint Denise Sowder and
Kristie Hayslett as Alternate Subdivision Agents for Roanoke
County Virginia.

AGENDA ITEM: Request to Appropriate Virginia Department of Health,
Developmental Block Grant funding of $8,025.00 to the Fire
and Rescue budget for the reimbursement of 3 automated
external defibrillators (AED's).
COUNTY ADMINISTRATOR'S COMMENTS:
BACKGROUND:
A Block Grant was requested and awarded to the Fire and Rescue Department to
purchase 3 automatic external defibrillators (AED's) from the Virginia Department of
Health through the Office of EMS. The Block Grant was specific in that only AED's
could be purchased for fire/rescue vehicles not already equipped with a cardiac
monitor. The AED's were purchased with budgeted funds with the understanding
from the Department of Health that they would reimburse the County for the
expenditure.
SUMMARY OF INFORMATION:
An AED is used when a person goes into cardiac arrest and their heart needs to be
electrically shocked (defibrillated) to restore a life sustaining cardiac rhythm.
Studies (American Heart Association & American Medical Association) have shown
that cardiac arrest survival rates are the highestwhen an AED is used in conjunction
with Advance Life Support (ALS) care during a cardiac emergency
FISCAL IMPACT:
The Block Grant covers all expenses for the purchase of 3 AED's and the cost of
upkeep per year is extremely minimal and will not impact the County negatively.
The Block Grant funds are specific in that they only can be used to purchase the
AED's.
STAFF RECOMMENDATION:
Staff recommends the acceptance and appropriation of the Virginia Department of
Health Block Grant funding to the Fire and Rescue's budget to support the
improvement of providing quality emergency medical services.

SUMMARY OF INFORMATION:
Recently, the Virginia Department of Fire Programs implemented a mini -grant
program designed to provide training equipment for local and regional training
centers. Roanoke County Fire and Rescue Department submitted a grant request to
fund the purchase of a computer and projector for one of the classrooms at the
regional training center. This grant must be used to purchase a computer and
projector for regional training. At their October 2000 meeting the Virginia Fire
Services Board approved our request in the amount of $7,500.
FISCAL IMPACT:
This is a request for one time appropriation of grant funds to the Regional Fire and
EMS Training Center account.
STAFF RECOMMENDATION:
Staff recommends acceptance of this grant and appropriation of the funding to the
Regional Fire and EMS Training Center account.

BACKGROUND:
Roanoke County Schools and Virginia Western Community College have an agreement
whereby the college provides college level courses in English, US History, and certain
vocational subjects. These courses are taught by Roanoke County teachers who meet the
college's criteria for adjunct professors. Monies that have been collected exceed the expenses;
therefore, there is a request for these additional funds to be appropriated for inservice and
materials that will be used in the program.
SUMMARY OF INFORMATION:
Roanoke County Schools collected $26,300.00 tuition from 528 students. VWCC will reimburse
$48,618.93 for services rendered (teachers, administrating expenses, rooms, utilities, and
maintenance). Roanoke County Schools owes VWCC $64,825.24 for tuition and technology
fees and college service fees. The difference between what was collected and what was spent
is $10,093.69.

AGENDA ITEM: Acceptance and appropriation of federal grants to
provide language services for Refugee Children
COUNTY ADMINISTRATOR'S COMMENTS:
BACKGROUND: In early October, State Superintendent's Memo #57 informed
Roanoke County Schools that the Department of Education has received a
continuation of two federal grants to provide services to school divisions
that serve Language English Proficient and refugee students. Upon
completion of the state -generated survey, Roanoke County Schools was found
eligible for funds to serve refugee children.
SUMMARY OF INFORMATION: ESL (English Second Language) teachers were
surveyed for information needed by the survey. It was found that in
Roanoke County there were fifty-seven (57) refugee students enrolled as of
September 30, 2000. After being notified of the grant, the teachers were
asked for input as to how to utilize the funds to best serve these
students. Their suggestions were to employee more tutoring help for the
students and to contract interpreter services for conferences, etc.
FISCAL IMPACT: None, no local match required.
STAFF RECOMMENDATION:
Staff recommends appropriation of $7,553 to the
Grant fund to be used as stated.

SUBJECT: Acceptance of Water and Sewer Facilities Serving Plantation Grove,
Section 2
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
The Developers of Plantation Grove, Section 2, DVW, Inc., have requested that Roanoke County
accept the Deed conveying the water and sanitary sewer facilities serving the subdivision along
with all necessary easements.
The water and sanitary sewer facilities are installed, as shown on plans prepared by Lang
Engineering entitled Plantation Grove, Section 2, which are on file in the Community
Development Department. The water and sanitary sewer facility construction meets the
specifications and the plans approved by the County.
FISCAL IMPACT:
The value of the water and sanitary sewer construction is $35,510.00 and $70,614.00
respectively.
RECOMMENDATION:
Staff recommends that the Board of Supervisors accept the water and sanitary sewer facilities
serving the Plantation Grove, Section 2 subdivision along with all necessary easements, and
authorize the County Administrator to execute a Deed for the transfer of these facilities.

THIS CHATTEL DEED, made this 9th day of _ January , 2001,
by and between _DVW, Inc. , a Virginia Corporation, hereinafter
referred to as the "Developer," party of the first part; and the BOARD OF SUPERVISORS OF
ROANOKE COUNTY, VIRGINIA, its successors or assigns, hereinafter referred to as the
"Board," party of the second part.
WITNESSETH:
THAT FOR AND IN CONSIDERATION of the mutual benefits accruing to the parties,
the receipt and sufficiency of which is hereby acknowledged, the Developer does hereby
GRANT, CONVEY, ASSIGN AND TRANSFER, with the covenants of GENERAL
WARRANTY OF TITLE, in fee simple unto the Board all water and/or sewer lines, valves,
fittings, laterals, connections, storage facilities, sources of water supply, pumps, manholes and
any and all other equipment and appurtenances thereunto belonging, in and to the water and/or
sewer systems in the streets, avenues, public utility, easement areas, water and sewer easement
areas that have been or may hereafter be installed by the Developer, along with the right to
perpetually use and occupy the easements in which the same may be located, all of which is more
particularly shown, described and designated as follows, to wit:
As shown on the plan entitled Plantation Grove, Section II ,
made by LangEngineering Company And on file in the Roanoke County Department of
Community Development.
The Developer does hereby covenant and warrant that it will be responsible for the proper
installation and construction of the said water and/or sewer systems including repair of surface
areas affected by settlement of utility trenches for a period of one (1) year after date of
acceptance by the Board and will preform any necessary repairs at its cost.

RESOLUTION 012301-2.11 ADOPTING ROANOKE COUNTY'S INTERNET
PRIVACY POLICY
WHEREAS, the 2000 Session of the General Assembly adopted amendments to
the Virginia Privacy Protection Act of 1976 designed to strengthen the protections to the
privacy rights of citizens who use Internet websites established by public entities in the
Commonwealth including local governments; and,
WHEREAS, Section 2.1-380 B of the Code of Virginia, 1950, as amended, requires
that every public body, as defined by the Virginia Freedom of Information Act (§ 2.1-341),
which has an Internet website shall develop an Internet privacy policy and an Internet
privacy statement that explains the policy to the public; and,
WHEREAS, the State Council on Technology Services has developed draft
suggestions for privacy policies and statements for public bodies consistent with the scope
of their individual websites; and,
WHEREAS, representatives of the Department of Information Technology, the
Community Relations Director and the Office of County Attorney have worked together to
develop this policy and privacy statement.
NOW THEREFORE, BE IT RESOLVED, BY THE BOARD OF SUPERVISORS OF
ROANOKE COUNTY, VIRGINIA, as follows:
1. That it is the policy of Roanoke County that personal information about website
visitors will be collected only to the extent necessary to provide the service or
benefit desired; that only appropriate information will be collected; that the website

visitor shall understand the reason the information is collected and be able to
examine their personal record which is maintained by Roanoke County. Further,
Roanoke County will not disclose this information to any private or public entity
outside of Roanoke County unless authorized by the visitor or as required by the
Virginia Freedom of Information Act.
2. That the County Administrator, or his designee, is hereby authorized to revise the
County's Internet Privacy Policy statement from time to time as the circumstances
may require.
3. That this resolution shall be in full force and effect from and after January 23, 2001.

AGENDA ITEM: Appropriation of Compensation Board reimbursement for additional capital
purchase for the Treasurer's Office.
COUNTY ADMINISTRATOR'S COMMENTS: 4,4
SUMMARY OF INFORMATION: During the course of a fiscal year, the Compensation Board
reimburses localities for specific expenses relating to the operations of the Constitutional
Officers. Reimbursable expenses include salaries, fringe benefits, certain operational costs,
and limited capital expenditures. An additional capital item has been funded bythe Comp Board
for the Treasurer that was not included in the original budget appropriation.
During the course of some fiscal years, Compensation Board budgets are not depleted and,
upon request of the Constitutional Officer, may be reallocated to cover previously unbudgeted
items. The Treasurer has requested additional funds from the Compensation Board for the
purchase of a replacement computer, printer, calculator, and folding machine. The Comp Board
has approved this request (copy of approval attached) and the reimbursable cost is $3,034.
FISCAL IMPACT: No fiscal impact to County funds. Approval of this request will increase state

STAFF RECOMMENDATION: Staff recommends an appropriation adjustment to increase

AGENDA ITEM: Request for Appropriation of Final Year -End Balance from School Operations for
Year Ended June 30, 2000
COUNTY ADMINISTRATOR COMMENTS:
1 talked with the School staff and / support their request. The new construction and remodeling of existing
facilities is going forward as planned. This request will accommodate other ongoing capital needs. This is
an opportunity to keep up the existing facilities and equipment. Since June 94, 9989, the School Board
has had the authority to spend their year-end balance for capital expenses as outlined in the annual
budget ordinance which is attached. Both Boards later agreed by consensus to spend at least $500, 000
of the year-end surplus on school buses.
SUMMARY OF INFORMATION: As a result of year-end operations, school revenue exceeded the
budgeted amount by $691,389, while savings in our major spending categories accounted for $1,783,813.
This generates a year end balance for school operations of $2,475,202. The details of the budget to
actual comparison for the year ended June 30, 2000 are shown on Attachment A.
In past years, the Board of Supervisors has allowed the School Board to purchase school buses with year-
end funds and set aside the remaining funds for other specific purposes. The Attachment B outlines the
school staff requests for capital and/or non-recurring expenditures that have not been funded within the
regular school operating fund. The School Board approved this recommended list of appropriations at its
meeting on December 11, 2000. The School Board cannot proceed with the expenditure of these funds
until the County Board of Supervisors appropriates the funds.
At the Board meeting on January 9, 2001, the Board approved the appropriation of $650,000 for buses.
The remainder of the items will be discussed in a work session on January 23, 2001 prior to consideration
of this item.
STAFF RECOMMENDATION: The School staff requests that the Board of Supervisors appropriate
remainder of the year-end balance for capital/non-recurring expenditures as outlined in Attachment B and
that the unallocated balance of $115,098 be appropriated to the school capital fund for future school
capital needs.

ORDINANCE 061300-6 APPROPRIATING FUNDS FOR
THE 2000-01 FISCAL YEAR BUDGET FOR ROANOKE
COUNTY, VIRGINIA
WHEREAS, upon notice duly published in the newspaper, a public hearing was
held on May 9,2000 concerning the adoption of the annual budget for Roanoke County
for fiscal year 2000-01; and
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, approved
said budget on May 23, 2000, pursuant to the provisions of Section 13.02 of the
Roanoke County Charter and Chapter 4 of Title 15.2 of the 1950 Code of Virginia, as
amended; and
WHEREAS, the first reading of this appropriation ordinance was held on May 23,
2000, and the second reading of this ordinance was held on June 13, 2000, pursuant to
the provisions of Section 18.04 of the Roanoke County Charter.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That the following appropriations are hereby made from the respective funds
for the period beginning July 1, 2000, and ending June 30, 2001, for the functions and
purposes indicated:
2. That the County Administrator may authorize or delegate the authorization of
the transfer of any unencumbered balance or portion thereof from one department to
another within a fund.
3. That all funded outstanding encumbrances, both operating and capital, at
June 30, 2000, are re -appropriated to the 2000-01 fiscal year to the same department
and account for which they are encumbered in the previous year.
4. That appropriations designated for capital projects will not lapse at the end of
the fiscal year but shall remain appropriated until the completion of the project or until
the Board of Supervisors, by appropriate action, changes or eliminates the
appropriation. Upon completion of a capital project, staff is authorized to close out the
project and transfer to the funding source any remaining balances. This section applies
to appropriations for Capital Projects at June 30, 2000, and appropriations in the 2000-
01 budget.
5. That all school fund appropriations remaining at the end of the 1999-00 fiscal
year not lapse but shall be appropriated to the School Capital Improvements Fund in
fiscal year 2000-01.
6. Utility Fund appropriations include a transfer for repayment of the outstanding
balance owed to the Water Fund by the Sewer Fund for construction projects approved
in FY95-96
7. That all General Fund appropriations remaining unexpended at the end of
the 1999-00 fiscal year not lapse but shall be re -appropriated as follows:
a) 40% of these unexpended appropriations shall be transferred to the
unappropriated Capital Fund Balance;

b) 60% of these unexpended appropriations shall be re -appropriated
to the same department for expenditure in fiscal year 2000-01 as
provided by Resolution 042396-5.
8. Revenues collected for FY99-00 that exceed revenue appropriations for the
year shall be re -appropriated for specific capital expenditures as follows:

easement be vacated in order for Monet Drive to be accepted into the state secondary road
system, free and clear of any third party rights or encumbrances; and,
WHEREAS, it will serve the interests of the public to have Monet Drive accepted into
the state secondary road system and, upon receipt of a permit from VDOT for the existing
facilities within the right-of-way of Monet Drive, the subject easements are no longer
required; and,
WHEREAS, this vacation will not involve any cost to the County and will not interfere
with the provision of public services; and,
WHEREAS, notice has been given as required by § 15.2-2204 of the Code of
Virginia (1950, as amended); the first reading of this ordinance was held on January 9,
2001, and the public hearing and second reading of this ordinance was held on January
23, 2001.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:

CENTER ON TUESDAY, JANUARY 23, 2001
ORDINANCE 012301-7 GRANTING A SPECIAL USE PERMIT TO JERRY
LETTERMAN TO CONSTRUCT AND OPERATE MINI -WAREHOUSES IN
AN 1-2 ZONING DISTRICT, TO BE LOCATED AT 4530 BARLEY DRIVE
(TAX MAP NO. 64.02-2-2), CATAWBA MAGISTERIAL DISTRICT
WHEREAS, Jerry Letterman has filed a petition for a special use permit to construct
and operate mini -warehouses in an 1-2 zoning district, to be located at 4530 Barley Drive
(Tax Map No. 64.02-2-2) in the Catawba Magisterial District; and
WHEREAS, the Planning Commission held a public hearing on this matter on
January 2, 2001; and
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, held a first
reading on this matter on December 19, 2000; the second reading and public hearing on
this matter was held on January 23, 2001.
NOW, THEREFORE BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Board finds that the granting of a special use permit to Jerry
Letterman to construct and operate mini -warehouses in an 1-2 zoning district, to be located
at 4530 Barley Drive (Tax Map No. 64.02-2-2) in the Catawba Magisterial District is
substantially in accord with the adopted 2000 Community Plan pursuant to the provisions
of § 15.2-2232 of the 1950 Code of Virginia, as amended, and said Special Use Permit is
hereby approved with the following conditions:
(1) All storage buildings and doors be neutral or earthtone in color.
(2) All mini -warehouses located on the site will be of a portable/mobile
design, and shall not be attached to any permanent foundation. If the
property is needed for the improvements to Route 11/460, the
buildings shall be removed by the applicant, and the value of the
buildings, or the cost to remove them shall not be a cost to VDOT.
(3) The construction of the units will be similar to the phasing plans as
stated on the submitted site plan dated November 27, 2000.
2. That this ordinance shall be in full force and effect thirty (30) days after its
final passage. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance be, and the same hereby are, repealed. The Zoning Administrator is directed
to amend the zoning district map to reflect the change in zoning classification authorized
by this ordinance.

RESOLUTION 012301-8 SUPPORTING THE TEA -21 GRANT APPLICATION
FOR PHASE III OF THE BLUE RIDGE PARKWAY INTERPRETIVE CENTER.
WHEREAS, the Transportation Enhancement Act for the 21 st Century (TEA -21) was
signed into federal law in June 1998, and
WHEREAS, the Act authorizes $18.5 million a year through 2003 in Virginia for
transportation enhancement, and
WHEREAS, a transportation enhancement grant application has been submitted by
Roanoke County for Phase III of the Blue Ridge Parkway Interpretive Center, for exhibit
fabrication and installation, related upfit and landscaping; and
WHEREAS, the purpose of the Interpretive Center is to orient visitors to the Blue
Ridge Parkway and surrounding region and to interpret the cultural heritage, scenic
qualities and recreational features of the Parkway region in this area of Virginia and to
provide tourist information about attractions in the Roanoke Valley and western Virginia,
and
WHEREAS, the grant application requests $460,000 in TEA -21 funds, matched by
$115,000 in National Park Service and Roanoke County in-kind services and private
donations, and
WHEREAS, each grant application must be accompanied by a resolution of support
from the local government by January 31, 2001;
BE IT THEREFORE RESOLVED, that the Board of Supervisors of Roanoke County
supports the TEA -21 grant application for Phase II of the Blue Ridge Parkway Interpretive

Center.

WHEREAS, the Act authorizes $18.5 million a year through 2003 in Virginia for
transportation enhancement, and
WHEREAS, a supplementary transportation enhancement grant application has
been submitted by Roanoke County and the City of Salem for the Roanoke River
Greenway project, a 7.2 mile section in western Roanoke County and the City of Salem,
and
WHEREAS, the grant application requests $1.6 million in TEA -21 funds, matched
by right-of-way donations, in-kind services and capital funds, and
WHEREAS, Roanoke County's share of the capital funds would be $32,000 over
three years, and
WHEREAS, the Roanoke River Greenway is considered the backbone of the
Roanoke Valley greenway system, and
WHEREAS, each grant applications must be accompanied by a resolution of support
from the local government by January 31, 2001;
THEREFORE BE IT RESOLVED, that the Board of Supervisors of Roanoke County,
Virginia, supports the TEA -21 grant application for the Roanoke River Greenway project.
