HomeMy WebLinkAbout6/26/2001 - Adopted Board RecordsAT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON JUNE 26, 2001 RESOLUTION 062601-1 REQUESTING VDOT TO CONTINUE FUNDING PROJECTS CURRENTLY IDENTIFIED ON THE PLAN AND ADOPT THOSE PROJECTS IDENTIFIED AS "PROJECTS NOT ON PLAN" FOR INCLUSION INTO THE 2001-2007 PRIMARY AND INTERSTATE SIX YEAR IMPROVEMENT PLAN WHEREAS, the Six Year Improvement Program is the Commonwealth Transportation Board's plan for identifying funds anticipated to be available for highway and other forms of transportation construction; and WHEREAS, this program is updated annually to assist in the allocation of federal and state funds for interstate, primary, and secondary roads. BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia as follows: and 1. That the following projects identified as "Projects on Plan" are recommended to continue to receive funding for planning and construction Interstate 73 — Roanoke County continues to be very supportive of this project. In a letter dated June 3, 2001, the Board of Supervisors encouraged VDOT to work closely with the impacted citizens to address their concerns and mitigate any negative impacts to them. This is in addition to the resolution 120500-2 passed December 5, 2000 reaffirming the Boards support for 1-73. Interstate 81 — Roanoke County continues to support VDOT's proposed plan to widen 1-81 from its present four lanes. We look forward to reviewing the prioritized segments of 1-81 and want to continue to work with local VDOT staff to develop regional cooperation for stormwater detention facilities and potential utility crossings. Route 11/460 (West Main Street) — Roanoke County continues to support the ongoing design for improvements in this important commercial and residential development area. Improvements will provide an increase in the level of service bringing it up to standards required for the expected growth. Route 221 (Bent Mountain Road) — Roanoke County is requesting continued allocation of funds for this road project. The residential development expected to occur within this area will place additional demands on the road system that is currently providing an inadequate service level. 1 5. That the following projects identified as "Projects Not on Plan" have been identified by the Board of Supervisors as extremely important to the growth of Roanoke County or for safety improvements and are requested to be included in the Virginia Transportation Development Plan for Fiscal Years 2001-2007. They are listed in Priority Order: 1. Route 11 (Williamson Road) — Need: Now that Route 11 has been widened from Plantation Road to Hollins College, there remains one section of three lane road from Peters Creek Road (Rte. 117) to the Roanoke City Limits. Additionally, the existing bridge over Carvins Creek does not meet current standards, and the alignment of Florist Road with Route 11 creates additional congestion and safety concerns. The existing section of road, 1.52 miles, is currently a three -lane with the center lane used for turning movements. Ninety percent of the tracts adjacent to Williamson Road are developed for commercial use. Traffic Counts: 15,000 vehicles per day from the Roanoke City limits to Peters Creek Road. This stretch has also been identified as an alternate route in the event of blockage on 1-81/581. Recommended Improvements: A four -lane divided highway with appropriate cross over and turn lanes, which will complete improvement of Williamson Road from the city limits to the Botetourt County line. Cost: $12,000,000 2. Route 115 (Plantation Road) Need: The existing road, 2.43 miles, is tow lanes with numerous side connections to residential neighborhoods. The road needs to be improved from Roanoke City limits north to Route 11. If full funding is not available , various spot improvements, such as turn lanes, alignment and grade improvements would help with safety issues. Additional land is available along the road for future development, which will increase traffic and construction costs in the future. Traffic Counts: From the Roanoke City limits to Williamson Road, 11,000 vehicles per day. Recommended Improvements: Additional lanes and intersection improvements. Cost: $12,000,000415,000,000 3. Route 220 S (Franklin Road) 2 Need: This section of 220 is approximately 2.0 miles long and is a four - lane divided highway. Recently a traffic study was conducted for a commercial development and the report predicted a level of service of D or F within the next couple of years. Additional lanes and improved vertical alignment is required from the Roanoke City limits south to Rte. 668 (Yellow Mountain Road). Spot improvements are needed now at the intersection of 419 and 220 S. Traffic Counts: From the Roanoke City limits south is approximately 44,000 vehicles per day. Recommended Improvements: Additional lanes and intersection improvements. Cost: $5,000,000 - $8,000,000 4. Route 116 (Jae Valley Road) Need: The Salem Residency has notified staff that the bridge over Back Creek is in need of repair and we wish to offer our support for improvements to the approaches and bridge replacement. This road is serving the growing commuter traffic from Franklin County and recreational traffic to Smith Mountain Lake. Traffic Counts: From the Roanoke City limits south: approximately 4,000 vehicles per day. Recommended Improvements: Improve approaches and replace existing bridge. Cost: $3,000,00044,000,000 5. Route 311 (Catawba Valley Road) — Intersection Improvements Need: This area has experienced steady growth over the last several years and the congestion at this intersection has increased. Traffic Counts: Rte. 311 has an average daily traffic of 11,000 vpd and Bradshaw Road (Rte. 864) carries approximately 3,200 vpd. Recommended Improvements: Construct a right hand passing lane (left turn lane). Other primary roads in Roanoke County which deserve consideration for spot improvements: 3 6. Route 419 (Electric Road) Intersection improvements, Route 118 (Airport Road), Route 24, (Washington Ave.) improvements at the intersection of William Byrd High School, Route 460 (Challenger Ave.), left and right turn lanes at several existing secondary roads. ITEM NUMBER E` -2` AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: June 26, 2001 AGENDA ITEM: Request from Norfolk Southern to negotiate a settlement agreement concerning wayside noise in Roanoke County COUNTY ADMINISTRATOR'S COMMENTS: It is my recommendation that Norfolk Southern negotiate directly with the property owners who are affected by the increased traffic. The property owners are the ones most affected and therefore should receive any funds from Norfolk Southern. If you wish for staff to assist the property owners with the negotiations, we will be pleased to do so. BACKGROUND: On July 26, 1998, The Surface Transportation Board (STB) approved the acquisition and control of Conrail, Inc. by NS and CSX Transportation. One of the conditions of the agreement was that NS and CSXT were ordered to take steps to address certain environmental effects on surrounding communities, including increased wayside train noise. The STB established a noise contour boundary along the NS Shenandoah Line from Front Royal to Roanoke, including track in Roanoke County. The STB defined a noise threshold based on technical criteria and identified specific structures that could experience wayside noise from the increased railroad traffic. The criteria includes: (1) the structures must be located within 73 feet of the center of the railroad track; and (2) the structures must meet the noise threshold established by the STB. SUMMARY OF INFORMATION: The STB identified specific structures within the boundary where NS and CSXT must reduce or "mitigate" the increase in wayside train noise. Qualified structures include homes, schools, churches and hospital. Commercial establishments and unoccupied structures did not qualified, nor was the use of locomotive horns at grade crossings included. The County GIS system has identified the following structures which are located within 73 feet of the center of the railroad track. The County will confirm with NS if these structures are included in the noise abatement program. 1. 6201 Nell Circle 2. 6204 Nell Circle 3. 7803 Shadwell Drive 4. 5675 Hollins Road It must be emphasized that the STB developed very specific technical criteria for determining which structures qualify. This means that in many situations one structure will be eligible but a neighboring structure will not be, depending on small differences in the position of the structures relative to the tracks or an imperceptible difference in noise levels between one structure and another. NS has offered two options for settlement: They are: Negotiate Settlement Agreement with Property Owners NS can negotiate with the individual property owner to reduce the noise. The goal for the noise reduction is a 10 decibel (dBA) noise reduction with a minimum reduction of 5 dBA. NS offers several options for noise reduction controls. They include: (1) Building sound walls along the railroad tracks. Sound walls could be unsightly, would encourage graffiti and may create potential safety issues. VDOT has estimated that a sound wall could cost between $500 to $1,000 per linear foot depending upon the height and location of the wall. (2) Installing sound insulation, including air conditioning, in residences that qualify. The major problem with sound insulation is the perception of inequity between neighbors. The STB has estimated that sound insulation would cost about $10,000 per structure. Negotiate Settlement with Local Government Rather than negotiate individually with each property owner, NS and CSXT have been working with the impacted communities to reach negotiated settlements with the local governments. They propose a lump -sum payment to the community based on the number of STB identified structures. Sixty-three structures in 23 localities qualify for the noise abatement payment. According to a recent newspaper article, four of the localities have negotiated and 2 accepted a NS financial settlement. Other localities have requested that NS negotiate directly with the property owners. FISCAL IMPACT: Based on previous negotiations, Roanoke County could receive $10,000 per structure if it chooses to negotiate a settlement. ALTERNATIVES: (1) Authorize the County Administrator to contact the property owners who meet the noise threshold to see if they wish the County to negotiate a settlement on their behalf. (2) Do not negotiate with NS and request that they negotiate with the individual property owners. (3) Authorize the County Administrator to negotiate a settlement with NS with the settlement funds being used to benefit the entire County. STAFF RECOMMENDATION: Staff recommends that the Board approve Alternative #1, that the County negotiate with NS on behalf of the property owners; or Alternative #2, that the property owners negotiate with NS themselves. Either of these options would benefit the individual property owners who are most negatively impacted by the increased railroad noise. Elmer C. AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: June 26, 2001 AGENDA ITEM: Acceptance of Infopowering Grants for $40,620 Awarded by the Library of Virginia and Appropriation of Grant Funds to the Public Library Budget COUNTY ADMINISTRATOR'S COMMENTS: We are pleased to bring this grant to you for approval. Staff is to be commended for their efforts to obtain this second library grant in the past six months. SUMMARY OF INFORMATION: Roanoke County Public Library has been awarded two Infopowering partnership grants by the Library of Virginia. The Infopowering program is a statewide initiative to bring readily accessible Internet access to all citizens of the Commonwealth. The grants total $40,620 and will be used in conjunction with the Bill and Melinda Gates Foundation grants, which were awarded and accepted in January, 2001. The Gates grants were given specifically to establish a computer instructional lab at the Vinton Branch Library and to buy computers and software for the Mt. Pleasant Branch Library. In contrast, the Infopowering funds are intended to provide either computer equipment or supporting materials and supplies to enhance Internet availability and are intended for libraries serving populations that are defined by specific demographic characteristics. Within the County system, Glenvar, Vinton, and Bent Mountain branch libraries met the requirements of the Infopowering program and were categorized as "partially eligible buildings." Based on that eligibility, the Library was awarded a grant of $30,800 to purchase eleven computers. Glenvar and Vinton will each add four Internet stations, while Bent Mountain will receive three. All the computers will be specially configured with the same software and peripherals as those which were supplied by the original Gates Foundation grants. Along with supplemental financial assistance from the Friends of the Library and the Vinton Women's Club, the second grant for $9,820 will be used to pay for construction expenses, such as wiring, telecommunication connectivity, furniture, and a security camera system. When combined, the Gates and Infopowering grants represent an additional 24 computers, a server, printers, a projector, and software for the Library system to help meet the escalating public demand for electronic services. FISCAL IMPACT: Acceptance and appropriation of the donated funds will require no additional expenditure by the County. STAFF RECOMMENDATION: Staff recommends the acceptance of the Infopowering grants from the Library of Virginia and appropriation of the $40,620 to the Library's budget. ITEM NUMBER AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: June 26, 2001 AGENDA ITEM: Request to appropriate $197,377 State funds for housing inmates to Sheriff's Department budget to offset expenses already incurred COUNTY ADMINISTRATOR'S COMMENTS: This is a routine year-end closing transaction. At the end of each year, we adjust the final payment from the state depending upon the inmate population during the year. SUMMARY OF INFORMATION: During FY 2000-01, as in previous years, the inmate population at the Roanoke County Jail has remained above capacity. In addition, the average inmate population increased from 198 to 212 through the first 3 quarters of FY2001, an increase of 7% over the prior calendar year. As a result, operational costs such as food, utilities, medical costs, etc. continue to consume a substantial portion of the Jail's budget. After reviewing the Sheriffs year-to-date expenditures, a year-end deficit of $197,377 is projected. Roanoke County is reimbursed by the state for salaries, mileage, office expenses, and for housing state prisoners. The reimbursement for state responsible inmates varies between a rate of $6 and $81day. In addition, the City of Salem reimburses the County for housing its prisoners on a per diem basis. State reimbursement for commonwealth responsible prisoners is subject to state prisoner population, general assembly appropriations, and political factors, variables difficult to consider in revenue projections. Given this fact, revenues for these items are estimated conservatively with the intention of seeking additional appropriations from the Board of Supervisors if the inmate population increased expenses and the related reimbursements. Based on the conservative revenue estimates versus the projected revenues anticipated to be collected from the state and from the City of Salem for the Sheriffs Department for FY00-01, revenues in excess of budget for these categories should total approximately $300,000. STAFF RECOMMENDATION: Staff recommends an appropriation adjustment to recognize an additional $197,377 of state revenue for personnel and operations reimbursement and increasing the Care and Confinement budget within the Sheriffs department by $197,377 to cover increased operational costs of the jail caused by increased inmate population, staffing requirements, and capital reimbursements. George Simpson and Arnold Covey have done it again. This is the second grant to remove buildings from our most affected flood plain in the past two years. If the Board approves this grant, we will have put in more than $1,300,000 into flood reduction and returned the affected land to beautiful greenways. Recommend approval. SUMMARY OF INFORMATION: The Commonwealth of Virginia Department of Emergency Management has notified us of the approval of our grant application to fund the acquisition of flood -prone homes in the Sun Valley/Palm Valley area of Roanoke County. Listed below is a summary and costs for this project. Proiect Summa As a result of the Roanoke Valley Regional Stormwater Management Plan, the Sun Valley/Palm Valley community was identified as having the largest concentration of homes in the County with flooding depths of 3 feet or greater. Twenty-three homes in this area were identified in the Regional Stormwater Management Plan as candidates for acquisition based on severity of flooding. The five homes selected were based on a ranking within the floodway and the flooding depths. The grant is awarded by FEMA (Federal Emergency Management Agency) and is administered by the Commonwealth of Virginia Department of Emergency Management. A summary of the proposed costs for this project is outlined below. Hazard Mitigation Grant Project, Carvin Creek, Phase I, was completed last year and removed eight homes from the 100 yr. flood plain at a cost of $750,000. Phase II is a continuation of this effort to acquire flood prone properties where no other feasible solutions have been found. The estimated cost of Phase II is $550,000. 1 Summary of Costs: Federal Share $412,529.00 75.0% Administrative Costs (to locality) 12,001.00 2.2% State Share (VADEM) 110,008.00 20% County Share 15.462.00 2.8% TOTAL PROJECT COST $550,000.00 100% The 1992 bond referendum included $210,000 for projects identified from the Regional Stormwater Management Plan and is available for Roanoke County's share of this project. ALTERNATIVES AND IMPACTS: Alternative 1. Accept the grant and authorize staff to match with funds and in- kind labor from the Department of Community Development. Alternative 2. THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That pursuant to the provisions of Section 18.04 of the Roanoke County Charter, the acquisition and disposition of real estate can be authorized only by ordinance. A first reading of this ordinance was held on June 12, 2001, and a second reading was held on June 26, 2001. 2. That pursuant to the provisions of Section 16.01 of the Charter of Roanoke County, the interests in real estate to be conveyed are hereby declared to be surplus, and are hereby made available for other public uses by conveyance to Appalachian Power Company for the provision of electrical service in connection with Roanoke County's Starkey Park development. 3. That donation of a right-of-way for an overhead line(s) and related 1 improvements across Starkey Park to provide electric service for lighting the ball fields, as shown on APCO Drawing No. V-1183, dated May 1, 2001, to Appalachian Power Company is hereby authorized. 4. The water and sanitary sewer facilities are installed, as shown on plans prepared by Lumsden and Associates entitled Waterford, Section 7, which are on file in the Community Development Department. The water and sanitary sewer facility construction meets the specifications and the plans approved by the County. FISCAL IMPACT: The value of the water and sanitary sewer construction is $21,670.00 and $32,000.00 respectively. (6) No access shall be permitted from Franklin Road to the property. 2 (7) The church shall be required to extend public water and sewer to the site and the location of these utilities shall generally be located within the right-of-way of Indian Grave Road. The church shall be authorized for cost reimbursements in accordance with the off-site and oversized utility facilities policy contained in section 18-168(D) 3 and 4, and 22-82 (b) (a) (c) and (d) of the Roanoke County Code. 2.
