S. Marine Corps Reserve Unit and the Marine Corps League and appropriation of $7,500 proceeds from the 6th Annual Marine Mud Run COUNTY ADMINISTRATOR'S COMMENTS: 1 SUMMARY OF INFORMATION: For the past six years the Marine Corps Reserve Unit, Company B, 4t" Combat Engineer Battalion and the Marine Corps League, in cooperation with the Roanoke County department of Parks, Recreation, and Tourism and many other corporate sponsors has sponsored the Mud Run in Green Hill Park. The event is designed to raise funds for the Toys For Tots program and Camp Roanoke. This event continues to be one of the largest and most successful running events in the Valley and has received wonderful media support from around the state. It is a family event that includes runners from ages three years old to the 70's. This year the contribution to Camp Roanoke from the Marines was $7,500 and brings the total amount contributed to $27,200. Attending the meeting to make the presentation of the check will be Marine Corp League Commandant Mike Shepherd and Race Director Jeff Baker, and others who were involved in the Marine Mud Run. They will also present plaques to Eddie Ford, Parks, Recreation and Tourism and to the County of Roanoke for their participation and support of the event. The County is deeply grateful to the Marine Corps League and the U. S. Marine Corps Reserve Unit for their financial support of Camp Roanoke over the years and will present to them Certificates of Recognition expressing our appreciation. FISCAL IMPACT: The funds will be added to the Camp Roanoke renovation fund. STAFF RECOMMENDATION: Staff recommends that the Board accept the $7,500 check and appropriate the funds to the Camp Roanoke renovation fund, and that the Marine Corps Reserve Unit and Marine Corps League be presented Certificates of Recognition for their financial support of Camp Roanoke for six years. A-012202-2 ITEM NUMBER AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: January 22, 2002 AGENDA ITEM: Authorization to enter into an agreement with Roanoke Gas to extend a natural gas line into the Center for Research and Technology. COUNTY ADMINISTRATOR'S COMMENTS: / 1 BACKGROUND: The 457 -acre Center for Research and Technology has been undergoing infrastructure improvements since 1998. To date, preliminary roads have been established, water and sewer lines extended, and a site has been preliminarily graded for development purposes. The extension of the gas line to the park is the next phase of improvement critical to the future development success of the CRT, and is necessary for the Novozymes project. SUMMARY OF INFORMATION: It is proposed that Roanoke County enter into an agreement with Roanoke Gas Company to construct a natural gas line into the CRT. The proposed extension consists of 15,624 feet of line with a 6 -inch minimum line from Rt. 460 to the entrance to the CRT, and a 4 -inch minimum line within the park. The cost of the line extension is to be paid by Roanoke County initially, with the monies being reimbursed by Roanoke Gas as the County attracts new tenants to the park. The County will have six years to recruit enough users on the system to fulfill the terms of the agreement, which should pay for the cost of the construction. It is estimated that the entire cost of the line will be covered by the gas use projected by Novozymes, upon implementation of the first two phases of their development. FISCAL IMPACT: $152,000, to be reimbursed by Roanoke Gas, as the County secures new users on the line. Funds are available in the CRT account. STAFF RECOMMENDATION: Staff recommends approval of the Agreement. As funds are recovered from Roanoke Gas they will be redeposited into the CRT account. Mahoney, County Attorney Danial Morris, Director, Finance Vickie Huffman, Assistant County Attorney AGREEMENT THIS AGREEMENT, made and entered into this day of , 2002, by and between the ROANOKE GAS COMPANY, a Virginia Corporation , its successors and assigns, party of the first part, (hereinafter referred to as the "Gas Company"), and the BOARD OF SUPERVISORS OF THE COUNTY OF ROANOKE, VIRGINIA, a political subdivision of the Commonwealth of Virginia, its successors or assigns, party of the second part (hereinafter referred to as "Roanoke County"). WITNESSETH: WHEREAS, Roanoke County and Roanoke Gas Company desire to extend natural gas service to the Roanoke County Center for Research and Technology ("RCCRT"), the County's new business center located off of Interstate 81 at Exit 132 west of Salem; and, WHEREAS, there are no current users or prospective users of natural gas in RCCRT that would economically justify the investment by the Gas Company required for pipeline construction to and inside the center; and, WHEREAS, Roanoke Gas Company has a policy that requires contributions by the user or developer to fund the portion of pipeline extensions not economically justified by reasonably projected customer usage; and, WHEREAS, Roanoke Gas Company estimates the cost to extend service to and inside RCCRT to be $152,000; and, WHEREAS, Roanoke County has determined that the Gas Company is the sole source practicably available for the services and reimbursement terms which are the subject of this agreement. NOW, THEREFORE, in consideration of the mutual covenants and conditions herein, and other good and valuable consideration, the receipt of which is hereby acknowledged by each of the parties, the parties hereby agree as follows: 1. Roanoke Gas Company agrees to obtain all necessary easements and to construct a natural gas line to and inside RCCRT, generally as shown on Exhibit A attached hereto, hereinafter referred to as the "project". The location and width of the easement(s) to be granted by Roanoke County shall be subject to approval by the Board of Supervisors of Roanoke County. The project shall include a minimum of a 6" diameter plastic line to be extended approximately 6,324 feet to the RCCRT entrance and a minimum of a 4" diameter plastic line to be extended 9,300 feet within RCCRT, for an estimated total footage of 15,624 feet at an estimated average cost of $9.73 per foot. The project shall be completed as soon as practical, but in any event no later than August 1, 2002, assuming no delays caused by the Virginia Department of Transportation. 2. Prior to commencement ofconstruction, Roanoke County agrees to pay Roanoke Gas Company the sum of $152,000 toward the cost of the project. 3. Upon completion of the project, Roanoke Gas Company will provide Roanoke County an accounting of the actual costs of the project. If the actual cost is less than $152,000, Roanoke Gas Company agrees to immediately refund the difference to the County. If the actual cost is greater than $152,000, Roanoke Gas Company will absorb the increase. In the event that Roanoke Gas Company fails to complete the project or fails to complete it within the time period specified above, excepting for delays that might arise as a result of failure of the Virginia Department of Transportation to grant needed easements in a timely manner, the Gas Company agrees to immediately refund the total amount of $152,000. 4. In the event that a natural gas user(s) or customer(s) locates (acquires or leases property and commences construction) in Roanoke County's business park (including any expansion areas) during the six year period following the date of execution of this agreement, Roanoke Gas will reimburse to the County all or any portion of the County's funding toward the project that is justified as an economic investment under the Gas Company's main extension policy as provided in the Company Tariff governing the extension of distribution facilities, as reflected in sections 7 & 16 of the Company's approved Tariff as of this date, a copy of which is attached hereto as Exhibit B. Examples of the calculations under the Gas Company's reimbursement policy are attached hereto as Exhibit C. For purposes of calculating reimbursement, the main extension cost shall not exceed $152,000. Reimbursement will be calculated by the Gas Company as of December 31 of each year, and payments will be made within ninety (90) days thereof. 5. This Agreement constitutes the entire agreement between the parties. No modification hereof shall be effective unless in writing and signed by both parties. ITEM NUMBER AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: January 22, 2002 AGENDA ITEM: Appointment of Roanoke County Representative to the Advisory Board for the Roanoke Valley Regional Pound Facility COUNTY ADMINISTRATOR'S COMMENTS: BACKGROUND: The Roanoke Valley Regional Pound Facility is the proposed animal impoundment facility to be owned and operated by the Roanoke Valley SPCA on behalf of the area's local governments. Pursuant to the agreement which the Board of Supervisors approved on December 4, 2001, the participating localities will appoint a member to the Advisory Board. The Advisory Board will be responsible for the following items: - Consider for approval the final design, construction and equipping of the New Pound Facility - Selection of administrator of the facility. - The initial adoption of rules, regulations, policies and guidelines for the operation and maintenance of the New Pound Facility. - Arrangements for financing the construction of the New Pound Facility. - Consider for approval any subcontractor to operate the New Pound Facility other than Animal Care Services, Inc. - Consider for approval the hours of operation. - Receive, review, and consider reports received by it from the RVSPCA including all material reports to be filed by the RVSPCA with any federal, state or local department and/or agency. - Consider for approval the Annual Budget and the Per Diem Charge for the next fiscal year for the New Pound Facility - To set the rate charged to other jurisdictions - To consider for approval any unbudgeted disbursements from the Maintenance Reserve Fund - To receive, review and consider monthly financial reports from the RVSPCA with regard to the New Pound Facility. - To review usage criteria and if necessary revise the Use Percentages as provided in the agreement. During the negotiations of the agreement, it was suggested that the local government representative be a Department Head or higher position because of the understanding of policy matters, budget information, personnel issues, and access to the top administration and/or governing body. The RVSPCA is moving ahead with the design drawings for the New Pound Facility and it is necessary to mobilize the Advisory Board to approve the design and begin the process for construction and financing of the facility. FISCAL IMPACT: The New Pound Facility is anticipated to become functional in the Spring of 2003 and will impact the last quarter of the FY 2002- 03 budget. No new monies are requested at this time. ITEM NUMBER AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: January 22, 2002 AGENDA ITEM: Request acceptance of donation in the amount of $1251.60 from the FAB 5K Race held in August 2001 COUNTY ADMINISTRATOR'S COMMENTS: BACKGROUND: The FAB 5k Race is held annually at Green Hill Park to provide a competitive running event and to raise funds for the improvement of Green Hill Park as an event venue. This year's race with 225 runners was held in August 2001. It generated $1251.60, which was presented to Parks, Recreation, and Tourism on December 5, 2001. The event sponsors have requested that these funds be used towards Green Hill Park's continuing development. SUMMARY OF INFORMATION: In 2001, the Board of Supervisors established a Green Hill Park Improvement Fund to receive donations of this type. The current balance including the above donation is $2270.53. Staff is currently developing a master plan for needed improvements to position Green Hill Park as a special event venue and working with outside organizations to raise capital. These funds will be held pending the completion of that plan and then utilized to make phased improvements. FISCAL IMPACT: None STAFF RECOMMENDATION: Staff recommends acceptance of the FAB 5k Race donation in the amount of $1251.60. COUNTY ADMINISTRATOR'S COMMENTS: BACKGROUND: The Sheriff's Office has received approval for a grant which provides continued funds from the Department of Criminal Justice Services for a Criminal Justice Record System Improvement program. This program will provide funds to purchase additional equipment and will allow the Sheriff's Office to continue to upgrade the new Jail Management System software, as well as the Civil Process Service software. SUMMARY OF INFORMATION: The continuation grant was approved by letter on December 26, 2001. This grant award is for a twelve month period, from January 1, 2002 through December 31, 2002. The grant is in the amount of $66,862.00 in federal funds and $22,288.00 in local cash match for a total of $89,150.00 and requires no additional funding from the Board of Supervisors. The funds requested will be used to purchase software upgrades and modifications, as well as computer equipment. FISCAL IMPACT: None. Matching funds are available in the Sheriff s Office budget.
