AGENDA ITEM: Request from Roanoke Valley Development Foundation to extend
due date on Note for Valley Gateway Tract B
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION
On December 20,1996, the County of Roanoke, The Industrial Development
Authority of the County of Roanoke, F&W Properties, and the Greater Roanoke Valley
Development Authority entered into an agreement to jointly develop and market an
industrial and commercial site known as Valley Gateway, located in Roanoke County off
U.S. 460, including the construction of a shell building. As part of this agreement, the
County agreed to convey the site known as Tract B to the Greater Roanoke Valley
Development Authority in exchange for an interest free note receivable from the
Authority in the amount of $264,440.50 due at the time of the sale of the shell building,
or five years from the date of the note. The note is dated May 15, 1997.
Ms. Beth Doughty, on behalf of the Roanoke Valley Development Foundation, is
requesting by the attached letter that the County extend the due date on the note (May
15, 2002) for the Valley Gateway Tract B for one year or until the sale or lease of the
site by the Foundation during that period.
Since the County and Industrial Development Authority are part of the
agreement, the IDA will also have to approve the extension of the note. The note does
have a provision for renewal by the County and Industrial Development Authority if the
Foundation fails to sell the site within the initial term.
STAFF RECOMMENDATION:
It is requested that the County Administrator be authorized to execute such
documents or take such action as may be necessary to accomplish the purpose of this
action, namely, extension of the due date on the note, subject to form approved by the
County Attorney.

On behalf of the Roanoke Valley Development Foundation, I'm writing to request that
R.ominke County agree to extend the due date on the Note for Valley Gateway Tract B for
one year or until the sale or lease of the site by the Foundation during that period.
I'm sure I speak for both the County and the Foundation when I say that it is unfortunate
that I must make this request. As you know, the Foundation is doing everything it can to
facilitate the sale of this property and will price and market the property for easier sale.
The Foundation board was very accommodating in pricing the shell building for your last
industrial prospect. Last week, the list price was lowered by $200,000.
The Note does provide that "if the Foundation fails to sell the site within the initial term,
the obligation may be renewed by the Industrial Development Authority, with the
County's consent which shall not be unreasonably witl-ffield." I hope that we can work
together for an amicable extension to our original agreement.

Agreement with Virginia Hospitality Ventures, Inc.
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
Virginia Hospitality Ventures, Inc. (VHV) has notified the Economic Development Department
of their intention to expand the Country Inn & Suites located at 7860 Plantation Road with 34
additional hotel rooms.
VHV has requested $71,073 in assistance from the Public Private Partnership program to cover
water and sewer infrastructure costs for the expansion. After qualifying the expansion project
based on VHV's investment, the annual estimated new tax revenue of $70,103 is anticipated to
be realized by Roanoke County. This request exceeds the amount authorized by the County's
Public Private Partnership Policy. Board approval is required to authorize the modification of
the policy and the assistance.
FISCAL IMPACT:
Fiscal impact to the County will be one year of foregoing new local tax revenue up to $71,073.
STAFF RECOMMENDATION:
The staff recommends authorization of payment of up to $71,073 (equal to one years' new local
tax revenue) to Virginia Hospitality Ventures, Inc. after a one-year audit documents the
generation of the same amount of new local tax revenue.

AGENDA ITEM: Appropriation of $52,000 Additional TEA -21 Grant Funds for Exhibit
Fabrication in the Blue Ridge Parkway Visitor Center
COUNTY ADMINISTRATOR'S COMMENTS:
BACKGROUND:
The County was previously awarded $211,000 in TEA -21 Grant Funds for exhibit fabrication in
the Blue Ridge Parkway Visitor Center. On January 23, 2001, the Board approved the
application for additional funds through this program.
SUMMARY OF INFORMATION:
The County has been notified that we have been awarded an additional $52,000 TEA -21 funds
for exhibit fabrication in the Blue Ridge Parkway Visitor Center. This makes a total of $263,000
available for this project. Approval from VDOT was received in May 2002 to proceed with bids
for audiovisuals and furnishings in the theatre portion of the project. Currently, we are finalizing
the construction specs for the exhibit fabrication, and we hope to bid the project in the summer of
2002. The $52,000 in additional grant money will go toward the actual construction of the
exhibits.
The design envisions three exhibit sections:
1. The Region Today (funded in the initial $211,000 award) — Highlights the Roanoke Valley
today.
2. History of the Blue Ridge Parkway
3. History of the Roanoke Valley — Highlights the natural and cultural history of the Valley.
We have recently applied for a third TEA -21 grant to finalize the project. Based upon the size of
that award, we will decide how much of the exhibit we will be able to bid in the first phase of
construction. We will know the amount of that award in August 2002.
FISCAL IMPACT:
TEA -21 Funds require a 20% match; however, the money that the County has already spent on
the preliminary design will meet this requirement.
STAFF RECOMMENDATION:
Staff recommends appropriating the $52,000 TEA -21 grant funds for the exhibit fabrication in the
Blue Ridge Parkway Visitor Center.

SUBJECT: Acceptance of Water and Sewer Facilities Serving The Orchards,
Applewood Section 10
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
The Developers of "The Orchards" Applewood Section 10, F & W Community Development
Corporation, have requested that Roanoke County accept the Deed conveying the water and
sanitary sewer facilities serving the subdivision along with all necessary easements.
The water and sanitary sewer facilities are installed, as shown on plans prepared by Lumsden
Associates, P.C. entitled "The Orchards" Applewood Section 10, which are on file in the
Community Development Department. The water and sanitary sewer facility construction meets
the specifications and the plans approved by the County.
FISCAL IMPACT:
The value of the water and sanitary sewer construction is $32,965.00 and $35,445.00
respectively.
RECOMMENDATION:
Staff recommends that the Board of Supervisors accept the water and sanitary sewer facilities
serving the "The Orchards" Applewood Section 10 subdivision along with all necessary
easements, and authorize the County Administrator to execute a Deed for the transfer of these
facilities.

F&W COMMUNITY DEVELOPMENT CORP. , an individual, hereinafter referred to as the
"Developer," party of the first part; and the BOARD OF SUPERVISORS OF ROANOKE COUNTY,
VIRGINIA, its successors or assigns, hereinafter referred to as the "Board," party of the second part.

THAT FOR AND IN CONSIDERATION of the mutual benefits accruing to the parties, the receipt
and sufficiency of which is hereby acknowledged, the Developer does hereby GRANT, CONVEY, ASSIGN
AND TRANSFER, with the covenants of GENERAL WARRANTY OF TITLE, in fee simple unto the Board
all water and/or sewer lines, valves, fittings, laterals, connections, storage facilities, sources of water supply,
pumps, manholes and any and all other equipment and appurtenances thereunto belonging, in and to the water

that have been or may hereafter be installed by the Developer, along with the right to perpetually use and

The Developer does hereby covenant and warrant that it will be responsible for the proper installation and
construction of the said water and/or sewer systems including repair of surface areas affected by settlement
of utility trenches for a period of one (1) year after date of acceptance by the Board and will perform any
necessary repairs at its cost.

Appropriation of E -Rate Reimbursements
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION: Roanoke County Schools will receive reimbursements from
the Universal Service Fund (E -Rate) Program for the 2001-2002 year in the
amount of $118,185.91. In the past we have utilized this funding for the
purchase of additional classroom equipment and/or upgrades to our
instructional network. As part of the 2001-02 network upgrade and
development of the budget, we understood that a portion of this
reimbursement would be required to meet the current budget. Of the $118,
185.91 that will be received, $43,758.95 is required to meet the current
budgeted amount for the Wide Area Network and $26,262.67 is required to
meet the Internet budget. This will leave an unallocated balance of
$48,164.29. Staff requests that this amount be allocated for the purchase of
instructional equipment and network components.
FISCAL IMPACT: None
STAFF RECOMMENDATION: Staff recommends appropriation from the e -rate
reimbursement of $43,758.95 to the WAN account,
$26,262.67 to the Internet Account and $48,164.29 to the
Instructional Equipment account

SUMMARY OF INFORMATION:
This consent agenda item involves acceptance of the following easements conveyed to the
Board of Supervisors for drainage purposes in connection with the Autumn Park Rural Addition
Project in the Vinton Magisterial District of the County of Roanoke:
a) Donation of a drainage easement, fifteen feet (15') in width, across Lot 1A, Mountain
Meadow Estates, from Mary Ferrante (Deed Book 1612, page 1914; Tax Map No.
50.01-5-1), as shown on a plat prepared by the Roanoke County Department of
Community Development, dated August 6, 2001, a copy of which is attached hereto
as Exhibit A.
b) Donation of a drainage easement, fifteen feet (15') in width, across Lot 2A, Mountain
Meadow Estates, from Theodore R. King and Linda J. King (Deed Book 1601, page
1401; Tax Map No. 50.01-5-2), as shown on a plat prepared by the Roanoke County
Department of Community Development, dated August 6, 2001, a copy of which is
attached hereto as Exhibit B.
C) Donation of a drainage easement, fifteen feet (15) in width, across Lot 4, Mountain
Meadow Estates, from Michael W. Lyle and Michelle G. Williamson (Deed Book
1641, page 1740; Tax Map No. 50.01-5-4), as shown on a plat prepared by the
Roanoke County Department of Community Development, dated August 6, 2001, a
copy of which is attached hereto as Exhibit C.
d) Donation of a drainage easement, fifteen feet (15') in width, across Lot 5, Mountain
Meadow Estates, from G & S Developers, Inc., (Deed Book 1524, page 350; Tax
Map No. 50.01-5-5), as shown on a plat prepared by the Roanoke County
Department of Community Development, dated October 12, 2001, a copy of which

The location and dimensions of these easements have been reviewed and approved by the
County's engineering staff.

WHEREAS, Stephen Ferguson was first employed by Roanoke County on May 1,
1974 as a Deputy Sheriff in the Corrections Division of the Sheriff's Office; and also served
as a Transportation Officer, Deputy Sheriff— Uniform Division, Deputy Sheriff— Court Bailiff
and Deputy Sheriff - Sergeant; and
WHEREAS, Mr. Ferguson retired from Roanoke County on April 1, 2002 as a
Deputy Sheriff— Sergeant in the Sheriff's Office following more than twenty seven years of
service and supervising court security for Roanoke County courts; and
WHEREAS, Mr. Ferguson, through his employment with Roanoke County, has
been instrumental in improving the quality of life for its citizens by providing training for law
enforcement personnel through Cardinal Criminal Justice Academy and professional
services to the citizens of Roanoke County.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke
County expresses its deepest appreciation and the appreciation of the citizens of Roanoke
County to STEPHEN G. FERGUSON for more than twenty seven years of capable, loyal
and dedicated service to Roanoke County.

MAGISTERIAL DISTRICT
WHEREAS, Fellowship Community Church. has filed a petition for a special use
permit to operate a religious assembly at Red Lane Extension at Interstate 81, (Tax Map
No. 45.02-1-15) in the Catawba Magisterial District; and
WHEREAS, the Planning Commission held a public hearing on this matteron April 2,
2002; and
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, held a first
reading on this matter on March 26, 2002; the second reading and public hearing on this
matter was held on May 14, 2002.
NOW, THEREFORE BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Board finds that the granting of a special use permit to Fellowship
Community Church to conduct a religious assembly on 15.562 acres located on Red Lane
Extension at Interstate 81 (Tax Map No. 45.02-1-15), Catawba Magisterial District, and is
substantially in accord with the adopted 2000 Community Plan pursuant to the provisions of
§15.2-2232 of the 1950 Code of Virginia, as amended, and said Special Use Permit is
hereby approved with the following conditions:
(1) Signage on Red Lane would be monument type only, and if lit at all, will
be lit from the front.
(2) The property be developed in substantial conformity to the Concept plan
dated February 20, 2002, subject to any modifications required during site
plan review or agreed to by Roanoke County, including requirements related
to buffering and screening the proposed use from adjoining properties.
2. That this action is taken upon the application of Fellowship Community
Church, and with the consent of the owner of this property, the Baptist Orphanage of
Virginia.
3. That this ordinance shall be in full force and effect thirty (30) days after its final
passage. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance be, and the same hereby are, repealed. The Zoning Administrator is directed to
amend the zoning district map to reflect the change in zoning classification authorized by
this ordinance.

WHEREAS, the first reading of this ordinance was held on February 26, 2002, and
the second reading and public hearing were held March 26, 2002, which were continued to
April 23, 2002, and then continued again to May 14, 2002; and,
WHEREAS, the Roanoke County Planning Commission held a public hearing on
this matter on March 5, 2002; and
WHEREAS, legal notice and advertisement has been provided as required by law.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That the zoning classification of a certain tract of real estate containing
approximately 15 acres, as described herein, and located at 5022 Hollins Road (Tax Map
Number 39.09-1-2) in the Hollins Magisterial District, is hereby changed from the zoning
classification of I -1C, Industrial District, to the zoning classification of C-1, Commercial
District, removing the following conditions:
(a) The following permitted uses will not be allowed: (i) flea markets, (ii)
commercial laundries and dry cleaning, (iii) commercial kennels, (iv)
seed and feed stores, (v) manufacture of pottery, etc., (vi) automobile
repair, etc.

(b) Type "E" screening where adjacent to residential use.
(c) Noise levels to be limited to 60 decibels when measured at adjacent
residence.
(d) Dust mitigation measures during site development and construction.
2. That this action is taken upon the application of Fellowship Baptist Church.
3. That said real estate is more fully described as containing approximately 15
acres designated as Tax Map No. 39.09-1-2 and owned by Friendship Manor, Inc.
4. That the Board finds that the granting of a special use permit to Fellowship
Baptist Church for a Religious Assembly and Daycare to be located at 5022 Hollins Road
(Tax Map No. 39.09-1-2) in the Hollins Magisterial District is substantially in accord with
the adopted 2000 Community Plan pursuant to the provisions of § 15.2-2232 of the 1950
Code of Virginia, as amended, and said Special Use Permit is hereby approved with the
following condition:
(a) Building(s) constructed on the site will be brick to grade on all sides
with a pitched roof.
5. That this ordinance shall be in full force and effect thirty (30) days after its
final passage. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance be, and the same hereby are, repealed. The Zoning Administrator is directed to
amend the zoning district map to reflect the change in zoning classification authorized by
this ordinance.
