BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as
follows:

RESOLUTION 052802-1 FOR APPROVAL OF COUNTY -STATE
AGREEMENT WITH THE VIRGINIA DEPARTMENT OF
TRANSPORTATION TO CONSTRUCT IMPROVEMENTS TO GLENMARY
DRIVE
WHEREAS, Title 33.1 of the Code of Virginia provides for the availability of funds
for implementing approved improvements to public streets to enhance and promote
economic and industrial development and continued public safety along public streets; and
WHEREAS, Roanoke County is desirous of developing the Roanoke County Center
for Research and Technology for the purpose of job creation for the citizens of the Roanoke
Valley; and
and
WHEREAS, the Commonwealth Transportation Board has approved this project;
WHEREAS, the Virginia Department of Transportation (VDOT) has estimated the
cost of this road construction to be $872,000; and
NOW, THEREFORE, BE IT RESOLVED that the Roanoke County Board of
Supervisors hereby authorizes the County Administrator or his designee to enter into a
County -State agreement allowing the County to advertise, bid, award, and administer the
construction contract for certain road improvements to Glenmary Drive (Project # 0778-
080-315, 501) to upgrade the access to the Roanoke County Center for Research and
Technology.

COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION
1. PARKS AND RECREATION ADVISORY COMMISSION (Appointed by District)
Supervisor McNamara nominated William M. Skelton, Jr., Windsor Hills District; and
Jerry Williams, Member at Large, and with the concurrence of Supervisor Minnix,
Mrs. Lee Blair, Cave Spring District, to additional three-year terms. Their terms will
expire June 30, 2005.
2. ROANOKE VALLEY GREENWAY COMMISSION
Supervisor Minnix nominated Donald Witt to an additional three-year term. His term
will expire April 2 8, 2005.
3. ROANOKE VALLEY-ALLEGHANY REGIONAL COMMISSION
Supervisor McNamara advised that he was willing to serve another three-year term
as the Elected Representative. He was nominated by consensus of the Board, and
his term will expire June 30, 2005.
4. ROANOKE VALLEY AREA METROPOLITAN PLANNING ORGANIZATION
MPO
Supervisor McNamara nominated Joseph McNamara and Richard Flora as Elected
Representatives, and Fuzzy Minnix, Alternate, to additional three-year terms. Their
terms will expire June 30, 2005.

5. TOTAL ACTION AGAINST POVERTY BOARD OF DIRECTORS
Supervisor Flora nominated Elizabeth Stokes to another tree two-year term as his
designee. Her term will expire May 5, 2004.

BACKGROUND:
The Community Policy and Management Team (CPMT) for the County
of Roanoke is established according to the policies and practices
established for the administration of the State's Comprehensive
Services Act. One of the required positions is a representative
from a private provider of related services.
Gary Wilburn has served two terms in this capacity (current
term expires June 30, 2002) and he brings a great knowledge of
available community service resources and needs of the juveniles to
this board. Gary has agreed to continue in this capacity and has
been approved by the CPMT to serve another three year term.
The Board of Supervisors is respectfully requested to confirm
this appointment to the CPMT.

AGENDA ITEM: Request to Accept a Passthrough Grant on Behalf of
RADAR for the Purchase of Two Vans
COUNTY ADMINISTRATOR'S COMMENTS:
BACKGROUND:
Unified Human Transportation Services, Inc. (RADAR) which
operates the CORTRAN program for Roanoke County has been notified
by the Commonwealth of Virginia's Department of Rail and Public
Transportation that they have been awarded a grant to purchase two
replacement lift -equipped vans for use in their fleet. This money
must be channeled through a political subdivision and the vans will
be included in the fleet which supports our CORTRAN program.
The grant is in the amount of $97,500 of which $78,000 is
Federal, $15,600 is State and $3,900 is local. RADAR will pay the
required local match and will also be responsible for all record
keeping and reporting related to this grant.
FISCAL IMPACT:
None.
RECOMMENDATIONS:
Staff recommends that the Board of Supervisors accept this
grant on behalf of RADAR and appropriate said monies to them for
the purchase of said vans.

AGENDA ITEM: Request to Accept Monies from the Virginia Juvenile
Community Crime Control Act and to Appropriate
these funds for the Fiscal Year 2002 - 03
COUNTY ADMINISTRATOR'S COMMENTS:
BACKGROUND:
In 1995, the Virginia General Assembly discontinued many block
grant programs and established the Virginia Juvenile Community
Crime Control Act (VJCCCA) to serve the needs of juveniles before
the Juvenile and Domestic Relations Court. Originally, the funding
was $511,617 with a local match (maintenance of effort) of $24,644.
For FY 2002 - 03, the state grant has been reduced to $251,526 with
the local match remaining at $24,644 which is included in the local
budget of the Court Service Unit. The allocation of VJCCCA monies
by the State is based on juvenile crime statistics statewide and is
allocated by their formula.
The localities are required to prepare a plan for the use of
these monies and to obtain approval from the multi -disciplinary
team (Community Policy and Management Team (CPMT)), the Director of
the Court Service Unit and the Chief Judge of the Juvenile and
Domestic Relations Court. Roanoke County's plan for FY 2002-03 has
been reviewed and considers the priority needs of the youth before
the Court over the past few years. Some of the services are being
established as group treatment programs or services which may be
purchased by other agencies to offset the cost of operation.
Attachment A represents the Life Skills / Mentoring Program
budget included in the VJCCCA Grant. There are no new local monies
required.

BACKGROUND: Each year the County writes off the Utility delinquent accounts over five years old.
This policy is consistent with the procedures used by the Treasurer for the write off of delinquent personal
property accounts as prescribed by law. The following efforts have been made to collect these accounts:
1. Collection letters requesting payment.
2. Filing with the Department of Taxation Debt Set-off Program.
3. Filing Warrants in Debt where a valid address is available.
4. Continuing to research for delinquent accounts through the DMV, VEC and Department of
Taxation Records.
SUMMARY OF INFORMATION: The delinquent utility accounts to be written off at this time are:

This consent agenda item involves acceptance of the following easement conveyed to the
Board of Supervisors for drainage purposes in connection with the Autumn Park Rural Addition
Project in the Vinton Magisterial District of the County of Roanoke:
Donation of a drainage easement, fifteen feet (15') in width, across Lot 3A, Mountain
Meadow Estates, from Robert M. Moses and Katherine M. Moses, (Instrument No.
200122994; Tax Map No. 50.01-5-3), as shown on a plat prepared by the Roanoke
County Department of Community Development, dated May 1, 2001, a copy ofwhich
is attached hereto as Exhibit A.
The location and dimensions of this easement have been reviewed and approved by the
County's engineering staff.

The National Association of Counties Annual Conference will be held July 12 - 16,
2002, in Orleans Parish (New Orleans), Louisiana. Treasurer Alfred C. Anderson has
advised that he plans to attend this conference and is willing to serve as the voting delegate
for Roanoke County at the business meeting. The Credentials Identification Form must be
returned to NACo by June 18, 2002.
STAFF RECOMMENDATION:
It is recommended that the Board of Supervisors confirm the designation of Alfred
C. Anderson to serve as Roanoke County's voting delegate and that the credentials form
be forwarded to NACo.

MEETING DATE: May 28, 2002
AGENDA ITEM: Request to Lift 90 -Day Moratorium on the Colonial Avenue Project,
Listed as Priority Number 4, in Roanoke County's Six -Year Secondary
System Construction Plan for Fiscal Year 2002-2008.
COUNTY ADMINISTRATOR'S COMMENTS:
The Board may recall that at the March 26, 2002, Board Meeting, the Board
deferred action on this item. 1 want to thank the Colonial Avenue Alliance,
the Virginia Department of Transportation, County staff, and Supervisor
Minnix for their cooperation and assistance in coming to a satisfactory
resolution of this matter. There does need to be improvements on this
section of Colonial Avenue since the volume of traffic keeps increasing and
it is a connector road.
The action being taken by the Board today does not specify or approve the
design of the project but simply lets the project remain on the Six -Year Plan.
Therefore, we do not have a set of plans to share with the public at this time.
At the proper time and when funds are allocated, 1 am sure that VDOT will
provide opportunities for public input on the design as is done with any
project. The Colonial Avenue Alliance has already made substantial
improvements to the project, and they, along with the County staff, will
continue to work with VDOT when the design takes place.
BACKGROUND:
DECEMBER 18. 2001
The Board of Supervisors approved the proposed Six -Year Secondary Road
Construction Plan and placed Colonial Avenue on a 90 -day moratorium to allow for
further study of proposed changes to the road originally presented to the public on
November 8, 2001. Since December 18, the Colonial Avenue Alliance, the Virginia
Department of Transportation and Roanoke County staff have attempted to devise
an alternative design that would be a less invasive approach to widening the road
than VDOT's original three -lane proposal for improvements to Colonial Avenue from
Penn Forest Boulevard to Route 419.

JANUARY 23. 2002
The Virginia Department of Transportation presented a new design alternative to the
Colonial Avenue Alliance and county staff. This option eliminated the continuous
center -turn lane and proposed a two-lane roadway with individual turn lanes at
Colonial Avenue's intersections at Penn Forest Boulevard, Vest Drive, Colonial
Place, the east and west entrances to North Cross School and Girard Drive. This
plan still included the proposed purchase of right-of-way for five lanes. VDOT
representatives also responded to questions from the Colonial Avenue Alliance and
other concerned citizens. Methods of projecting future traffic estimates were also
discussed.
FEBRUARY 6, 2002
The Colonial Avenue Alliance requested another meeting with County staff to
discuss their concerns over the potential for five lanes of right-of-way, the absence
of traffic calming measures on either design alternative and differences regarding
traffic estimate methodology. At this meeting citizens raised a variety of traffic
issues, presented their challenges to VDOT's traffic projections and discussed the
Community Village concept. Staff proposed that any additional funding earmarked
for the proposed project be used exclusively for preliminary engineering until the
issues of traffic and right-of-way acquisition are resolved.
MARCH 26, 2002
The Board of Supervisors authorized an additional 60 days for citizens, VDOT and
County staff to try to resolve traffic and right-of-way issues.
MAY 2, 2002
Ms. Ilona Kastenhofer, State Traffic Engineer, met with citizens and staff to address
traffic concerns. Ms. Kastenhofer explained the concept of traffic calming (such as
raised crosswalks, traffic circles, crosswalk refuges across medians, chicanes,
chokers and speed humps) as applied in Virginia. Only subdivisions and other
specifically local streets are eligible for traffic calming measures under VDOT's
policy. Citizens suggested "context sensitive design" as an alternative to traffic
calming for consideration on Colonial Avenue. Ms. Kastenhofer agreed that flexible
design techniques should be employed, and through her work with the State's
location and design engineer, will work with the community to provide the best
facilities without compromising mobility and safety.
MAY 15, 2002
County staff was provided information from VDOT showing that Roanoke County's
Secondary Construction and Unpaved Road Allocation for FY 2001/2002 and FY
2002/2003 is being reduced by 30 percent. Because of the funding reduction and
the impact this will have on current and future road projects, staff has decided, after
consulting with VDOT, to not pursue purchasing the ultimate right-of-way for
Colonial Avenue. Roanoke County and VDOT staff have agreed to the following
conditions that the Colonial Avenue Alliance supports:

1. Drop the ultimate right-of-way request.
2. Staff will continue to work with the CAA (Colonial Avenue Alliance) and
VDOT on the two -lanes with individual turn lanes design to achieve the best
possible design for the community without compromising mobility and safety
using "context sensitive design."
3. The CAA was given assurance that there will be several additional meetings
to voice their concerns if the final design is found unacceptable.
ALTERNATIVES AND IMPACT:
1. Lift the moratorium on the Colonial Avenue Project based on the conditions
listed above.
2. Not lift the moratorium.

RESOLUTION 052802-5 OF CONGRATULATIONS TO WILLIAM BYRD
HIGH SCHOOL CHEERLEADING COMPETITION TEAM FOR WINNING
THE GROUP AA STATE CHEERLEADING CHAMPIONSHIP
WHEREAS, team sports are an important part of the curriculum at schools in
Roanoke County teaching cooperation, sportsmanship and athletic skill; and
WHEREAS, the William Byrd High School Cheerleading Competition Team is
comprised of members of both the Junior Varsity and Varsity squads who are judged and
selected for membership on the competition team; and
WHEREAS, the competition team won the Group AA state cheerleading
championship this year at Virginia Commonwealth University in Richmond, defeating 15
other schools to become the first school in the Roanoke Valley to win a state cheerleading
competition; and,
WHEREAS, the team won the Region III Championship for the third consecutive
year and also won the Blue Ridge District Competition; and
WHEREAS, the team is coached by Barbara Shutt and Assistant Coaches Shawna
Hastings, Belinda West, Ruth Overfelt and Corie Goin; and,
WHEREAS, teamwork is essential in the sport of cheerleading with each member
contributing to the success of the team; and
WHEREAS, individual members of the team were recognized for the following
accomplishments: First Team All District: Kelly McClung and Ashley Simpson; 2nd Place
All District: Ashley Conner and Monica West; All Star UCA Camp: Kelly McClung.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke
County, Virginia does hereby extend its sincere congratulations to the members of the

2002-2003 BUDGET FOR ROANOKE COUNTY, VIRGINIA
WHEREAS, Section 15.2-2503 of the 1950 Code of Virginia, as amended, provides
that the governing body of the County shall prepare and approve an annual budget; and
WHEREAS, said budget shall be prepared and approved for informative and fiscal
planning purposes only; and
WHEREAS, this budget contains a complete itemized and classified plan of all
contemplated expenditures and all estimated revenues and borrowings for the ensuing
fiscal year; and
WHEREAS, a brief synopsis of said budget was published as required by the
provisions of Section 15.2-2506 of the State Code, and the public hearing as required
thereon was held on May 14, 2002.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia:
1. That there is hereby approved the annual budget for Fiscal Year 2002-2003

AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE
COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION
CENTER ON TUESDAY, MAY 28, 2002
ORDINANCE 052802-7 APPROPRIATING FUNDS FOR THE 2002-03
FISCAL YEAR BUDGET FOR ROANOKE COUNTY, VIRGINIA
WHEREAS, upon notice duly published in the newspaper, a public hearing was
held on May 14, 2002 concerning the adoption of the annual budget for Roanoke
County for fiscal year 2002-03; and
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, approved
said budget on May 28, 2002, pursuant to the provisions of Section 13.02 of the
Roanoke County Charter and Chapter 25 of Title 15.2 of the 1950 Code of Virginia, as
amended; and
WHEREAS, the first reading of this appropriation ordinance was held on May 14,
2002, and the second reading of this ordinance was held on May 28, 2002, pursuant to
the provisions of Section 18.04 of the Roanoke County Charter.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That the following appropriations are hereby made from the respective funds
for the period beginning July 1, 2002, and ending June 30, 2003, for the functions and
purposes indicated:

In addition to the above revenues and expenditures, the following beginning balance will be
appropriated to the Unappropriated Balance of the respective fund:
General Fund $ 9,070,000
Capital Fund 1,342,000
The Capital Fund Revenue and Expenditure Budget includes a reallocation of funds from
the Capital Fund Unappropriated Fund Balance in the amounts listed for the following projects:
IT Infrastructure Upgrades 500,000

2. That the County Administrator may authorize or delegate the authorization of
the transfer of any unencumbered balance or portion thereof from one department to
another within a fund.
3. That all funded outstanding encumbrances, both operating and capital, at
June 30, 2002, are re -appropriated to the 2002-03 fiscal year to the same department
and account for which they are encumbered in the previous year.
4. That appropriations designated for capital projects will not lapse at the end of
the fiscal year but shall remain appropriated until the completion of the project or until
the Board of Supervisors, by appropriate action, changes or eliminates the
appropriation. Upon completion of a capital project, staff is authorized to close out the
project and transfer to the funding source any remaining balances. This section applies
to appropriations for Capital Projects at June 30, 2002, and appropriations in the 2002-
03 budget.
5. That all school fund appropriations remaining at the end of the 2001-02 fiscal
year not lapse but shall be appropriated to the School Capital Improvements Fund in
fiscal year 2002-03.
6. That all General Fund appropriations remaining unexpended at the end of
the 2001-02 fiscal year not lapse but shall be re -appropriated as follows:
a) 40% of these unexpended appropriations shall be transferred to the
unappropriated Capital Fund Balance;
b) 60% of these unexpended appropriations shall be re -appropriated to the same
department for expenditure in fiscal year 2000-01 as provided by Resolution
042396-5.

7. This ordinance shall take effect July 1, 2002.

AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE
COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION
CENTER, TUESDAY, MAY 28, 2002
ORDINANCE 052802-8 TO CHANGE THE ZONING CLASSIFICATION OF
A 3.33 -ACRE TRACT OF REAL ESTATE FROM C-2 GENERAL
COMMERCIAL DISTRICT WITH CONDITIONS, TO C-2 GENERAL
COMMERCIAL DISTRICT AND TO OBTAIN A SPECIAL USE PERMIT ON
A 4.20 ACRE PARCEL TO EXPAND MINI -WAREHOUSES, LOCATED AT
2205 WASHINGTON AVENUE, VINTON MAGISTERIAL DISTRICT, UPON
THE PETITION OF WINTER PROPERTIES PARTNERSHIP, LLP
WHEREAS, the first reading of this ordinance was held on April 23, 2001, and the
second reading and public hearing were held May 28, 2002; and,
WHEREAS, the Roanoke County Planning Commission held a public hearing on this
matter on May 7, 2002; and
WHEREAS, legal notice and advertisement has been provided as required by law.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That the zoning classification of a certain tract of real estate containing 3.33
acres, as described herein, and located at 2205 Washington Avenue (Tax Map
Number61.15-2-10.1) in the Vinton Magisterial District, is hereby changed from the zoning
classification of C-2, General Commercial District with conditions, to the zoning
classification of C-2, General Commercial District, without conditions, REMOVING the
following conditions imposed in 1986:
(1) Northern 2.66 acres +/- to remain as B-2 zoning in keeping with
comprehensive plan for transition property.
(2) Eastern 0.9 acres +/- between R-1 property to remain as natural
buffer zone.

(3) Construction will be in accordance with the concept plan submitted
with petition, specifically in accordance with planting and paving as
shown.
(4) Mini -warehouses will be the only use permitted in the M-1, Industrial
District.
(5) The color and architectural design of the mini -warehouses will be in
accordance with the photographs submitted with petitions.
2. That this action is taken upon the application of Winter Properties Partnership,
3. That the Board finds that the granting of a special use permit to Winter
Properties Partnership, LLC and E. B. Knighton to expand mini -warehouses to be located
at 2205 Washington Avenue (Tax Map Nos. 61.15-2-10.1 and 61.15-2-10) in the Vinton
Magisterial District is substantially in accord with the adopted 2000 Community Plan
pursuant to the provisions of § 15.2-2232 of the 1950 Code of Virginia, as amended, and
said Special Use Permit is hereby approved with the following conditions:
(1) Eastern .9 acres of the original mini -warehouse development shall
remain as a natural buffer zone. Type C screening and buffer yard
shall be installed between expansion area and adjoining residential
property.
(2) Expansion of the mini -warehouses shall be in substantial conformance
with the concept plan dated February 22, 2002.
(3) The color and architectural design of the new structure shall match the
existing structures.

4. That said real estate is more fully described as follows:
P/O Tax Map No. 61.15-2-10 - E. B. Knighton
BEGINNING at a point on the northeast corner of property of Vinton Lodge
#1121, said point located on the southerly right-of-way of Washington
Avenue (Va. Rte. 24); thence leaving Vinton Lodge and with the southerly
right-of-way of Washington Avenue N. 75 deg. 58' 00" E. 30.39 feet to the
actual place of beginning, this with said right-of-way N. 75 deg. 57' 00" E.
45.59 feet to a point; thence with 2 new division lines through the property of
E. B. Knighton (being Tax Map No. 61.15-2-10); thence S. 04 deg. 50'50" E.
135.42 feet to a point; thence N. 89 deg. 29' 13" E. 362.31 feet to a point,
said point located on the westerly boundary of Parcel 2, Map #3, Lindenwood
(PB 3, Page 151); thence continuing with Lindenwood S. 10 deg. 00'00" E.
78.91 feet to a point, said point being the northeasterly corner of Winter
Properties Partnership, LLP (DB 1314, page 1285); thence leaving
Lindenwood and with Winter Properties for the following 2 courses: S. 889
deg. 34'29" W. 414.60 feet to a point; thence N. 04 deg. 50'50" W. 202.15
feet to the place of beginning, and containing 0.87 acres.

BEGINNING at a point being the northeast corner of property of Vinton
Lodge No. 1121 (DB 1415, page 153), said point also located on the
southerly right-of-way of Washington Avenue; thence leaving Vinton Lodge
and with Washington Avenue N. 75 deg. 58' 00" E. 30.39 feet to a point;
thence said point being the original northwest corner of property of E. B.
Knighton; thence leaving Washington Avenue and with the property of E. B.
Knighton S. 04 deg. 50'50" E. 202.15 feet to a point; thence N. 89 deg. 34'
28" E. 414.60 feet to a point, said point located on the westerly boundary of
Map No. 3 of Lindenwood (PB 3, page 151); thence leaving Knighton and
with Lindenwood S. 10 deg. 00'00" E. 245.63 feet to a point, said point being
the northeasterly corner of Mary Cook Bush property (DB 1415, page 153);
thence leaving Lindenwood and with Mary Cook Bush for the following 2
courses: S. 31 deg. 56'30" W. 175.95 feet to a point; thence N. 64 deg. 34'
40" W. 416.89 feet to a point, said point being the southeasterly corner of
Vinton Lodge #1121; thence leaving Bush and with Vinton Lodge N. 04 deg.
50'50" W. 404.66 feet to the place of beginning and containing 3.33 acres.
5. That this ordinance shall be in full force and effect thirty (30) days after its
final passage. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance be, and the same hereby are, repealed. The Zoning Administrator is directed
to amend the zoning district map to reflect the change in zoning classification authorized

1. That the zoning classification of approximately 7,883 square feet, as
described herein, of a certain tract of real estate located at the south side of U.S. 11 at
North Brook Drive (a portion of Tax Map No. 028.05-01-13) in the Hollins Magisterial
District, is hereby changed from the zoning classification of C-2, General Commercial
District, to the zoning classification of R -3C, Medium Density Multi -Family Residential
District, with conditions, for the construction of townhouses.
2. That this action is taken upon the application of Barrens Development
Corporation.

3. That in 1983 the Owner of the property did petition to the Board of
Supervisors to amend the site plan and conditions (from a 1981 rezoning) for a 25.67 -acre
tract of land located in the Hollins Magisterial District in order to include an additional 0.53
acres to the development; and
4. That the Owner of the property voluntarily proffered in writing the following
conditions which the Board of Supervisors of Roanoke County, Virginia, hereby accepts:
a) The maximum number of dwelling units to be constructed on the 26.2
acre tract (original 25.67 acre tract plus an additional 0.53 acre tract) shall be
146 units.
b) No dwelling unit shall have less than 1,100 square feet of gross space.
c) No structure shall be higher than two stories. Dwelling units shall be
physically located on the 26.2 acres as shown and specified on the plan
submitted by the applicant for the April 1982 Planning Commission meeting.
d) No bridge or bridges will be constructed across Tinker Creek from North
Ardmore or Shadwell Drive.
e) No private sewer system or above ground sewage treatment system shall
be constructed on the 25.76 acres.
f) All units on the 25.76 acres shall be finished to grade.
g) The lighting for the pool and tennis courts will be directed and screened
to minimize its penetration into the residential subdivisions known as North
Ardmore and Waterfall Lake.
h) All structures to be constructed on the 25.76 acres where Tinker Creek
separates the 25.76 acres from the residential dwellings on Biscayne Road

will be set back at least 100 feet from the center of Tinker Creek.
i) Along the perimeter of the 25.76 acres adjacent to Biscayne Road and
adjacent to the recreation areas along Shadwell Drive will be landscaped in
an appropriate manner to provide reasonable screening of the 25.76 acres
from the adjoining residential subdivisions.
5. That said real estate is more fully described as follows:
BEGINNING at Point No. 28 on the east side of Northbrook Drive,
said point being corner to parcels 5 and 6 of the J. D. Fralin
subdivision; thence with the line between Parcels 5 & 6 of said
subdivision, No. 640 27'06" E. 260.65 feet to Point No. 16 on the
property of LCP Summerview, Inc. and being a corner to Lot 5 and
6 of said subdivision; thence with the line between Parcel 5 and LCP
Summerview, Inc. property S. 03' 43' 15" E. 32.32 feet to Point
No. 17; thence with the existing zoning line through Parcel 5, S.
640 27' 06" W. 264.87 feet to Point NO. 27 on the east side of
Northbrook Drive; thence following the east side of Northbrook Drive
with a curve to the left whose radius is 757.09 feet and whose length
is 34.12 feet (chord equals No. 02053' 06" E. 34.12 feet) to the
Point of Beginning, and being a strip If land approximately 30 foot
wide and 260 foot long and containing 7,883 square feet.
6. That this ordinance shall be in full force and effect thirty (30) days after its
final passage. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance be, and the same hereby are, repealed. The Zoning Administrator is directed
to amend the zoning district map to reflect the change in zoning classification authorized
by this ordinance.
