COUNTY ADMINISTRATOR'S COMMENTS:
I am pleased with the efforts of the staff to reduce expenditures for the year ended
June 30, 2002. They took the situation seriously, and eliminated most capital items and
travel from their budgets. If they had not done this, we would be facing a year-end deficit.
When implementing, the Board of Supervisors promised the excess ambulance fees
would remain in fire and rescue. $50, 000 of the excess fees is due to the Town of Vinton
for calls that they have run. The remaining $170,484 will be used for one-time expenses,
such as SCBAs (self-contained breathing apparatus). In the current budget, the revenues
from ambulance fees are budgeted at a higher level and used to offset the additional staff
time due to higher calls. We will behaving a work session with the Board in January 2003
to review the staffing and workload at each of the stations.
I continue to be concerned about the safety of some of the County vehicles. 1
recommend that a portion of the year-end surplus be used to fund the purchase of
vehicles. We will return to the Board in January 2003 with a plan to lease purchase the
remainder of the needed vehicles.
SUMMARY OF INFORMATION:
KPMG has completed their audit of the financial statements of the County of Roanoke and
the County of Roanoke Schools for the year ended June 30, 2002. The Audit Committee
met earlier today with KPMG to review their findings. KPMG delivered a favorable opinion
to the County and did not have any Management Letter comments. The Comprehensive
Annual Report is currently at the printers and should be delivered in the next week.
As shown on Attachment A, revenues for the year were $119,629,564, which was
$335,370 less than budget. The largest variance in the revenues was in the personal
property tax, which was $1,205,068 below budget. However, overall the revenues were
0.3% under budget.
Included in these revenues is $220,484 of Fee for Service revenues in excess of budget.
Of this amount, approximately $50,000 is due to the Town of Vinton for calls run in their
area. At the time the Ambulance Fee was approved, these revenues were committed to
the Fire and Rescue Department.
In anticipation of a revenue shortfall, the County departments reduced their operating
budgets by $954,671 as a mid -year adjustment. In addition, the departments saved
another $750,864 throughout the year. These savings were achieved in a variety of ways.
The County postponed all capital purchases that could be delayed. Travel and training
were allowed only on a limited basis. All vacancies were reviewed by a Job Bank
Committee to see if the position was absolutely necessary, and positions were frozen or
transferred to higher priority needs in the County. In addition, there were personnel layoffs.
Because of the deliberate actions taken to reduce expenditures, the County ended the year
with a surplus of $1,442,705 at June 30, 2002, as summarized on Attachment B. Of this
amount $220,484 is committed to Fire and Rescue as explained above and $35,510 is the
result of an accounting entry to adjust the investments to market. This leaves $1,186,711
that is available to be appropriated.
If we follow the year-end rollover policy that the Board has adopted, the shortfall of revenue
items totaling $591,364 would be deducted from the General Fund Unappropriated
Balance. 60% of the expenditure savings of $750,864 (approximately $450,000) would be
returned to the departments for capital or other one-time purchases. The remaining funds
(approximately $1,328,075) would be transferred to the County Capital Fund Balance.
However, in light of the current State revenue problems, and the uncertainty of what that
will cost us in lost State revenues for the remainder of the current fiscal year and next fiscal
year, we recommend that the net amount of $1,186,711 be used as follows:
1. $450,000 to replace unsafe high mileage County vehicles
2. $736,711 set aside in a Reserve for Revenue Shortfall, until we are able to
assess the full impact of the State budget reductions.
The General Fund Unappropriated Balance at June 30, 2002 is $9,070,656. This is an
increase of $498,067, or 5.8% from last year. At June 30, 2002 the General Fund
Unappropriated Balance was 7.2% of the General Fund Revenues.
Results of Operations of the Roanoke County Schools for the Year Ended June 30, 2002 —
Attachment C is the report that was presented to the School Board on November 21, 2002.
The School Board took final action to approve this report on December 9, 2002. The
Schools ended the year with a surplus of $4,008,278. Based upon the adopted County
budget ordinance, these funds will automatically be appropriated to the School Capital

Fund. A detailed schedule of the proposed uses discussed with the School Board is
included in Attachment C. Included in the total is $2,828,098 that will be reserved in the
School Capital Fund for revenue shortfalls. This is added to the $738,302 that was
reserved for revenue shortfalls from the June 30, 2001 surplus. The School Board will need
to request, and the County Board approve, for this money to be transferred to the School
Operating Fund if this shortfall does occur. No action is required by the County Board at
this time.
STAFF RECOMMENDATION:
Staff recommends the following actions:
1. The Fee for Service in excess of budget of $220,484 be appropriated to the
Fire and Rescue department.
2. $450,000 be appropriated for vehicle replacement.
3. $736,711 be appropriated to a Reserve for Revenue Shortfall, until such time
as the full impact of the State budget reductions are known.

AGENDA ITEM: Request for Appropriation of Final Year -End Balance from School Operations for Fiscal
Year Ended June 30, 2002
BACKGROUND: As a result of year-end operations, actual revenue received exceeded budgeted revenue by
$150,087 (or .15%), while under -expenditures in the major spending categories accounted for $3,987,545 (or
3.8%) of the year-end balance (Attachment A).
As noted in the finalized audit for fiscal year 2001-02, the year-end fund balance for school operations is
$4,047,632 less outstanding encumbrances of $39,354 or a net of $4,008,278. The budget ordinance adopted
by the Board of Supervisors on May 22, 2001 indicated "that all school fund appropriations remaining at the
end of the 2001-02 fiscal year not lapse but shall be appropriated to the School Capital Improvements Fund in
fiscal year 2002-03."
SUMMARY OF INFORMATION: Historically, the School Board has asked staff to identify and prioritize
capital needs to be considered for funding with the year-end balance. Last year, the School Board appropriated
$650,000 for bus replacements in FY02-03 and then reserved $738,302 for potential revenue shortfalls in
FY01-02. The appropriation for school buses last year is being used for the bus replacements in FY02-03. In
addition, staff is recommending that the revenue reserve appropriated last year, and not needed in FY01-02,
continue to be reserved for potential shortfalls during FY02-03 as Governor `Varner is currently in the process
of reducing the state budget to balance a current year state budget deficit.
Recently, the Governor reduced the budgets of a number of state agencies, including local governments, for
approximately one-half ofthe state deficit. Although he has expressed a desire to protect public education, it is
becoming increasingly apparent that the state deficit cannot be covered without cuts to basic aid. The
Department of Education has not released any detailed information on cuts in basic aid for either the current
year or fiscal year 2003-04. However, they have verbally indicated that the Governor's budget submission in
December may include cuts to the current year budget or the General Assembly could revise downward the
state budget during the legislative budget process this winter.
For the second year in a row, staff has agreed that the current local, state, and national econor es warrant a
conservative approach to spending the year-end balance. Consequently, staff is recommending the following:
® $650,000 for school bus purchases during summer 2003.
• $365,000 for the balance of the estimated A&E costs on Phase 2 projects.
® $100,000 for the CSHS softball field (Phase 2 minor project) which addresses a Title Ix concern.
® $65,000 for carpet removal and tile replacement at Back Creek ($61,000) and Northside ($6,000).
o $2,828,278 reserved for state revenue shortfalls in FY02-03 or FY03-04 and/or other future school
obligations (including health insurance increases, other Phase 2 minor projects, and laptop technology
initiative).
Attachment B outlines the recommendations and the reservation of prior year balances still available to the
School Board.

STAFF RECOMMENDATION: Staff recommends appropriation of the fiscal year 2001-02 year-end balance of
$4,047,632 per Attachment B. An informational report will be forwarded to the Board of Supervisors and the
year-end funds will be placed in the School Capital Fund per the approved budget ordinance. At some point in
the future, if the School Board determines that the reserve funds should be appropriated for non -capital
expenditures, a new report will be presented for both School Board and Board of Supervisors approval.

RESOLUTION 121702-2 REQUESTING ASSISTANCE FROM OUR
CONGRESSIONAL DELEGATION TO OBTAIN DISASTER ASSISTANCE FOR
ROANOKE COUNTY FARMERS FOR THE RECENT DROUGHT DISASTER
WHEREAS, the Board of Supervisors of Roanoke County approved a resolution on
October 8, 2002 declaring a drought disaster, citing serious and irreversible damage to
crop production and pasture growth resulting in financial losses to local farmers; and,
WHEREAS, Governor Warner forwarded the request for assistance for Roanoke
County farmers to Secretary Veneman on October 17 with an additional request that the
U.S. Department of Agriculture review the arbitrary deadline of September 19 to file for
assistance; and,
WHEREAS, staff and citizens have spoken with the U.S. Department of Agriculture
and others seeking relief for the farmers, and have been advised that there does not
appear to be any new or supplemental funding available for this program.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, that a copy of this resolution and supporting documentation be forwarded
to our Congressional delegation to formally request their assistance in trying to identify
funding alternatives which could benefit the Roanoke County farmers who suffered losses
as a result of the drought disaster.

ORDINANCE 121702-3 AMENDING SECTION 12-8 OF THE ROANOKE
COUNTY CODE "ADOPTION OF STATE LAW" TO INCORPORATE BY
REFERENCE THE AUTHORITY TO ENFORCE CERTAIN LAWS AND
REGULATIONS CONCERNING VEHICLE SAFETY INSPECTIONS
WHEREAS, Section 46.2-1001 authorizes law enforcement officers of certain
designated counties and cities to perform vehicle safety inspections as prescribed by
the state police and by the regulations promulgated by the U.S. Department of
Transportation, Federal Highway Administration, Bureau of Motor Carrier Safety; and
WHEREAS, Section 52-8.4 authorizes the superintendent of state police to
promulgate regulations pertaining to commercial motor vehicle safety, and the state
police together with all other law enforcement officers certified to perform vehicle safety
inspections as defined by Section 46.2-1001 shall enforce these regulations and other
requirements of the Federal Motor Carrier Safety Regulations, safety inspection
procedures, and out -of -service criteria; and
WHEREAS, Section 52-8.4:2 provides that any violation of said regulations shall
constitute traffic infractions and be subject to the pre-trial waiver of appearance, plea of
guilty, and fine payment as provided therein; and
WHEREAS, Section 46.2-1313 authorizes local governments to adopt
ordinances which incorporate these provisions into such ordinances by reference; and
WHEREAS, the public health, safety, and welfare of the citizens of Roanoke
County shall be served by authorizing its law enforcement officers who have been
certified to perform vehicle safety inspections to perform said inspections and to charge

any violators under the provisions of the Roanoke County Code; and
WHEREAS, the first reading of this ordinance was held on December 3, 2003;
and the second reading was held on December 17, 2003.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That Section 12-8 of the Roanoke County Code be amended and
reenacted as follows:
Sec. 12-8. Adoption of state law.
Pursuant to the authority of section 46.2-1313 of the Code of Virginia, all of the
provisions and requirements of the laws of the state contained in title 46.2, in section
52-8.4 and 52-8.4:2, in article 9 (section 16.1-278 et seq.) of chapter 11 of title 16. 1, and
in article 2 (section 18.2-266 et seq.) of chapter 7 of title 18.2 of the Code of Virginia,
except those provisions and requirements which, by their very nature, can have no
application to or within the county, are hereby adopted and incorporated in this chapter
by reference and made applicable within the county. References to "highways of the
state" contained in such provisions and requirements hereby adopted shall be deemed
to refer to the streets, highways, and other public ways within the county. Such
provision and requirements, as amended from time to time, are hereby adopted and
made a part of this chapter as fully as though set forth at length herein, and it shall be
unlawful for any person within the county to violate or fail, neglect or refuse to comply
with any such provision or requirement; provided, that in no event shall the penalty
imposed for the violation of any provision or requirement hereby adopted exceed the

penalty imposed for a similar offense under the state law hereby adopted.
The phrase "all of the provisions and requirements of the laws of the state" as
used hereby shall be construed to include all amendments to said laws made effective

SUMMARY OF INFORMATION:
Roanoke County Schools and Virginia Western Community College have an agreement
whereby the college provides college level courses in English, US History, and certain
technical subjects. These courses are taught by Roanoke County teachers who meet the
college's criteria for adjunct professors. Monies that have been collected exceed the
expenses; therefore, there is a request for these additional funds to be appropriated for in-
service and materials that will be used in the program. The school system collected
$35,145 in tuition from 691 students. VWCC will reimburse $73,306.50 for services
rendered (teachers, administrating expenses, rooms, utilities and maintenance). The
school division owes VWCC $97,742 for tuition, technology fees and college service fees.
The difference between the amount collected and the amount spent is $10,709.50

Roanoke County Schools requests that $10,709.50 be appropriated to the instructional

SUMMARY OF INFORMATION:
In 1989, the Length of Service Awards Program (LOSAP) for the Volunteer Fire/Rescue
and Auxiliary Police personnel was approved by the Board of Supervisors. This program
provides retirement benefits to volunteers meeting the criteria based on yearly
requirements of service. A LOSAP Board of Trustees, consisting of six volunteers, County
personnel and advisory members oversees the administration of this program.
The original program bylaws are quite thorough, but the LOSAP Board felt that the
Eligibility Requirements should be updated to be more specific, to meet the changing
requirements of the fire/rescue service, and to ensure the integrity of the program. A copy
of the proposed revisions is attached.
Approval of the following amendments is being requested:
1. Section (7) — Eligibility Requirements
• Addresses age requirements in terms of eligibility for the program to correspond
with the programs entitlement age of 55.
Includes certifications that are considered minimum standards in the fire or
rescue volunteer organizations.
Parallels County requirements in terms of application procedures and Standard
Operating Procedure Policies.
2. Section (11) Time of Benefit Payment
Allows the active volunteer to receive credit for a year of service during the year
in which they become 55 years old. Previously, the active volunteer who
couldn't earn the total amount of points before their 55th birthday would not
receive points for that year of service.
(Le. The active volunteer who became 55 years of age in January could not
receive points for that year because they did not earn enough points before
they became 55, whereas the active volunteer who turned 55 years of age in
December received that last year of service.)
FISCAL IMPACT:
No additional funding should be required for these amendments.
STAFF RECOMMENDATION:
Staff recommends that the Board approve these two amendments to the LOSAP bylaws.

(7) Eligibility Requirements
A LOSAP eligible member is defined as:
• A volunteer member who is 18 —54 years of age or older
and has been approved by the Roanoke County Fire and
Rescue Department application process as a
Firefighter/Rescuer;
• and has been accepted by a Roanoke County Volunteer
Fire/Rescue Organization as a Firefighter/Rescuer;
• and meets Firefighter/Rescuer SOP's, certifications, etc as
indicated by Roanoke County Fire & Rescue Department and
Fire/Rescue Organization;
• Firefighters/Rescuers must be certified at minimum level
within 18 months of acceptance into organization. This
means a Firefighter must have Firefighter I within 18
months of acceptance into organization; and Rescuers must
have EMT -B within 18 months of acceptance into an
organization.

3. That the owner of the property has voluntarily proffered in writing the
following conditions which the Board of Supervisors of Roanoke County, Virginia,

WHEREAS, Van and Teresa Johnson have filed a petition for a special use permit
to operate a commercial kennel on 2.657 acres located at 3900 Carvins Cove Road (Tax
Map No. 16.00-1-12) in the Catawba Magisterial District; and
WHEREAS, the Planning Commission held a public hearing on this matter on
December 3, 2002; and
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, held a first
reading on this matter on November 19, 2002; the second reading and public hearing on
this matter was held on December 17, 2002.
NOW, THEREFORE BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Board finds that the granting of a special use permit to Van and
Teresa Johnson to operate a commercial kennel on 2.657 acres located at 3900 Carvins
Cove Road (Tax Map No. 16.00-1-12) in the Catawba Magisterial District is substantially
in accord with the adopted 2000 Community Plan pursuant to the provisions of § 15.2-
2232 of the 1950 Code of Virginia, as amended, and said Special Use Permit is hereby
approved with the following conditions:
(1) There shall be a limit of 35 dog runs allowed with this facility.
(2) A septic system shall be required for the disposal of all animal waste for this

facility or another method approved by the Health Department to prevent
contamination of the adjoining creek.
(3) There shall be a maximum of 10 feet of signage for the use. Any
freestanding sign shall not be lighted.
(4) The dogs shall be housed inside the kennel between the hours of 7pm and
lam.
2. That this ordinance shall be in full force and effect thirty (30) days after its
final passage. All ordinances or parts of ordinances in conflict with the provisions of this

WHEREAS, plans for the extension of and improvements to Indian Grave Road at
its intersection with U.S. Route 220 have been completed and the project will require
acquisition of and dedication of certain real estate and necessary easements across
certain properties; and
WHEREAS, Section 18.04 of the Roanoke County Charter directs that the
acquisition of or dedication of any interest in real estate be accomplished by ordinance;
and
WHEREAS, the Board of Supervisors declares this real estate to be surplus, and is
available for other public purposes, namely, for public highway purposes; and
WHEREAS, the first reading of this ordinance was held on November 19, 2002;
and the second reading was postponed on December 3, 2002; and held on December 17,
2002.
NOW, THEREFORE, be it ordained by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the acquisition of certain real estate and necessary easements for the
construction of the Indian Grave Road Extension and U. S. Route 220 intersection
improvements is hereby authorized across the following properties, referenced by tax map
