RESOLUTION R-011403-1 OF APPRECIATION TO JOSEPH B. "BUTCH"
CHURCH FOR HIS SERVICE AS CHAIRMAN OF THE BOARD OF
SUPERVISORS IN 2002
WHEREAS, Joseph B. "Butch" Church served as Chairman of the Roanoke County
Board of Supervisors during 2002; and
WHEREAS, during Mr. Church's term as Chairman, the County achieved a variety
of accomplishments, including:
• Adoption of a Regional Economic Development Strategy
• Providing assistance to Roanoke City during the drought by selling water and
joined with other local governments to search for a long-range solution including
the formation of a water authority
• Approval of a resolution concerning prayer in public buildings, including schools,
and in support of U.S. House Joint Resolution 81 proposing an amendment to
the Constitution restoring religious freedom
• Celebration of the opening of Novozymes Biological, the first business to locate
in the Center for Research and Technology
• Adoption of a DUI ordinance to add civil penalties to drunken driving convictions
resulting in accidents
• Continuation of regional cooperation efforts through participation in the Regional
Summit meetings of local governments in Southwest Virginia
• Opening of the new Hidden Valley High School and completion of renovations to
Glenvar Middle School
• Celebration of the completion of the Roanoke Regional Tactical Training Facility,
a cooperative effort between Roanoke City and Roanoke County
• Extinguishing of the Starlight Lane Tire Fire without injury or loss of life
• Approval of funding for Fire & Rescue to increase career staffing by 20
firefighter/paramedics
• Approval of a plan to enhance countywide Advanced Life Support coverage by
providing for 24 -hours a day, 7 -days a week Advanced Life Support at the Fort
Lewis, Hollins, and Vinton Stations
• Approval of the lease -purchase of two new ladder trucks and two pumper trucks
• Approval of funding to place Automatic External Defibrillators in County buildings
and fire stations
• Combination of Roanoke County and Roanoke City personnel for 24 -hours a
day, 7 -days a week fire and rescue coverage at the Clearbrook Station
• Recognition of Roanoke County Library as the first public library to receive the
SOLINET Outstanding Library Programs Award
• Hosting of the National Softball Association World Series in cooperation with the
Cities of Salem and Roanoke
WHEREAS, Mr. Church worked diligently during his term to represent all the citizens
of Roanoke County and to promote regional projects that benefit all the residents of the
Roanoke Valley.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke
County, Virginia does hereby extend its deepest appreciation to Joseph B. "Butch" Church
for his service as Chairman during 2002 and for his belief in democracy and championing
of citizen participation in local government.

Ratification of Early Action Compact with the U. S.
Environmental Protection Agency to work cooperatively in
preparing a plan for ozone reduction

When completed, the plan will be brought back to the governing bodies of the four
participating localities for approval.
SUMMARY OF INFORMATION:
The Roanoke Valley Area Metropolitan Planning Organization (MPO) approved an Early
Action Compact to address the problem of ozone non -attainment for the Roanoke Valley.
Mr. McNamara endorsed this Early Action Compact on December 16, 2002, as Roanoke
County's representative on the MPO.
This Compact includes the cities of Roanoke and Salem, the counties of Roanoke and
Botetourt, the Town of Vinton, the Virginia Department of Environmental Quality, and the
U.S. Environmental Protection Agency. This Compact allows the local governments in the
Roanoke Valley additional time to work cooperatively and to prepare a plan for ozone
reduction. Reducing ozone levels may allow the Roanoke Valley to avoid being designated
as a non -attainment area under the Clean Air Act.
The Compact is the first step under EPA's approved Early Action Program. The Early
Action Program allows local governments the flexibility to develop appropriate measures to
reduce ozone levels. Reducing ozone levels will improve the health of all the citizens in the
Roanoke Valley, and in particular the elderly and those with respiratory problems. This
program has very strict time lines for the development of a plan to reduce ozone levels by
2007. Failure to participate in this program could result in EPA declaring the Roanoke
Valley a non -attainment area which would negatively affect future transportation
improvements and industrial development efforts.
FISCAL IMPACT:
The Roanoke Valley -Allegheny Regional Commission working through the MPO will
coordinate this planning process. No funding is required for the development of the Plan.
The Commission will allocate funds to hire a consultant to assist in this planning process.
STAFF RECOMMENDATION:
It is recommended that the Board ratify and confirm the execution of the Early Action
Compact on behalf of Roanoke County.

RESOLUTION 011403-3 IN SUPPORT OF HOUSE BILL 1397
AMENDING SECTIONS 15.2-204 AND 15.2-1200 OF THE CODE OF
VIRGINIA TO GRANT COUNTIES THE SAME POWERS OF TAXATION
AS CITIES AND TOWNS
WHEREAS, sixty-two percent of the revenue generated by Virginia's local
governments to pay for local services is generated at the local level; and
WHEREAS, seventy-five percent of this local revenue is derived from four
sources: the real estate tax, the personal property tax, charges for services, and the
sales tax; and
WHEREAS, the real estate tax makes up the largest portion of local revenue at
forty-three percent of the total; and
WHEREAS, in Roanoke County the real estate tax comprises 50.9 percent of
locally generated revenue; and
WHEREAS, because counties have very few unrestricted revenue options
available, the burden to balance county budgets often falls on the real estate tax; and
WHEREAS, counties in Virginia need to diversify their revenue base to reduce
the burden on the real estate tax; and
WHEREAS, Section 15.2-1104 of the Code of Virginia sets forth the financial
powers of cities and towns but counties do not have comparable language in the Code;
and
WHEREAS, Section 15.2-1104 of the Code of Virginia therefore allows cities and
towns to raise taxes and assessments on property, persons, and other subjects of

taxation that are not otherwise prohibited by law and the practical application of this
results in the ability of cities and towns to levy cigarette taxes and admissions taxes,
levy transient occupancy taxes without a cap or restrictions, and levy a meals tax
without a cap and without holding a voter referendum; and
WHEREAS, Section 15.2 of the Code of Virginia should be amended to grant
counties the same powers of taxation as cities and towns; and
WHEREAS, HB 1397 (Hull) amends Sections 15.2-204 and 15.2-1200 of the
Code of Virginia to grant counties the same powers of taxation as cities and towns; and
NOW, THEREFORE, BE IT RESOLVED, that Roanoke County supports HB
1397 and urges its General Assembly delegation to support HB 1397 in the 2003
General Assembly.

SUMMARY OF INFORMATION:
In December 2001, the Board approved a pilot program encouraging recycling with non-
profit agencies and authorized a contract with the Rescue Mission of the Roanoke Valley.
The Rescue Mission picks up materials from County residents and recycles the majority of
those goods, either through resale at its store, use by its clients, or through recycling
markets. The remainder of the material is taken by the Rescue Mission to the Roanoke
Valley Resource Authority where it is disposed of at the County's tipping rate. The
Resource Authority bills Roanoke County, and the County then bills the Rescue Mission.
The program has worked well, and the County and the Rescue Mission recently extended
the agreement.
Goodwill Industries of the Valleys has approached the County with a request to participate
in this program. Goodwill meets the criteria set forth in the policy (attached), and has
signed the agreement.
FISCAL IMPACT:
There is no direct fiscal impact with this program, although staff time is involved in billing
the agencies and posting the payments. The program does support recycling efforts,
which will extend the life of the regional landfill.
STAFF RECOMMENDATION:
Staff recommends that the Board of Supervisors approve Goodwill Industries of the Valleys
for inclusion in this program.

Policy for Reducing Tipping Fee at Landfill for Recycling Activities
The City of Roanoke, the County of Roanoke and the Town of Vinton jointly oversee and
fund the Roanoke Valley Resource Authority (RVRA). These local governments are
committed to encouraging recycling in the community, recognizing that reducing the waste
stream is important to the environmental future of the Roanoke Valley.
Certain non-profit entities in the Valley provide recycling services to the community through
the acceptance of donations of used clothing, furniture and other items, which are then
either reused or sent out of the area for recycling. Anything left is then disposed of through
the Resource Authority, at the regular commercial rate.
Based on the service which is provided through these recycling efforts, the members of
RVRA have authorized the Authority to bill qualifying non-profit entities at the local
government tipping fee rate. Those organizations wishing to qualify for this rate must
present to the Resource Authority the following information:
• Amount of tonnage picked up annually in the Roanoke Valley
• Amount of tonnage disposed of through the Resource Authority
• Description of recycling activities, including methodology and percentage removed from
waste stream. In order to qualify, the organization must recycle at least 25% of the
materials picked up annually in the Valley.
• Proof of non-profit status
The organization must also qualify for a charge account at the Resource Authority, so that
billing procedures can be put into place.

SUMMARY OF INFORMATION:
Attached is a list of proposed 2003 Committee Assignments for each member of the Board
of Supervisors. The appointments which are specific to the Chairman and Vice Chairman
are indicated on the attachment.
The Board may make any desired modifications to the appointments. Many of the
appointments are for specified terms and, whenever possible, changes to these
appointments should be made at the expiration of the term.
Below is listed information regarding several of the committees:
• Liaisons to the Virginia Association of Counties WACO
In 1994, VACo requested that a member of the governing body be appointed to interact
directly with VACo regarding legislative matters. At a 1994 meeting, the Board
recommended that the Vice Chairman of the Board of Supervisors serve in this
capacity. Any Board member is, however, eligible for appointment.
In 1992, VACo requested that a member of the governing body be appointed to work
directly with the regional representative on the VACo Board of Directors. The Chairman
has served in this capacity for several years, but any Board member may be appointed.
Roanoke Valley Economic Development Partnership
The Chairman of the Board of Supervisors serves on this organization. Accordingly,
Chairman McNamara should be appointed to this position.
• Roanoke County Cable Television Committee
The Board member appointed to serve on the Roanoke Valley Cable Television
Committee is automatically appointed to serve on the Roanoke County Cable
Television Committee. Membership of these two committees is the same except the
Roanoke County Cable TV Committee also includes the Supervisor representing the
Catawba Magisterial District, the primary area served by Adelphia Cable TV.
• Total Action Against Poverty Board of Directors
The TAP Board of Directors By -Laws requires that an elected official serve on the TAP
Board. For many years, former Clerk of Circuit Court Elizabeth Stokes was appointed.
When Ms. Stokes retired from her elected position, former Supervisor Bob Johnson
was appointed but asked Ms. Stokes to remain as the designee on behalf of the Board
of Supervisors. Since that time, Ms. Stokes has continued to serve as the designee of
Supervisor Richard Flora.
The Board may choose to appoint a Supervisor to play an active role on the TAP Board
of Directors or continue with the custom of appointing a Supervisor who is willing to
have Ms. Stokes continue, if she desires, to serve as the Board=s designee.
STAFF RECOMMENDATION:
Staff recommends that the Board approve the Board of Supervisors appointments for
calendar year 2003.

ORDINANCE 011403-6 AUTHORIZING THE EXECUTION OF A LEASE
AGREEMENT WITH ROANOKE CATHOLIC SCHOOL FOR THE
EXPANSION, DEVELOPMENT AND JOINT USE OF VINYARD PARK
FOR INTERSCHOLASTIC ATHLETIC AND RECREATIONAL
PURPOSES
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, is the owner
of several 32.18 acres of real estate, located in Roanoke County, Virginia, and
designated on the Roanoke County Land Records as Tax Map #060.12-09-01.01-0000,
and commonly referred to as Vinyard Park; and,
WHEREAS, the County has developed this property for the purpose of providing
parks, recreation and tourism benefits to the citizens of Roanoke County; and,
WHEREAS, the County has implemented partnership agreements with private
organizations to develop public facilities in exchange for beneficial and priority uses of
public property; and,
WHEREAS, Roanoke Catholic School has submitted an offer to make certain
improvements to Vinyard Park, and to pay the County to construct additional
improvements and facilities, and staff has negotiated with it to lease the premises for a
period of fifteen years from January 1, 2003, with the option to renew the lease for an
additional five years, with annual renewals thereafter; and
WHEREAS, it would serve the public interest to lease the premises to Roanoke
Catholic School in order to develop, expand and jointly use interscholastic athletic and
recreational facilities; and

WHEREAS, Section 18.04 of the Roanoke County Charter directs that the
acquisition or conveyance of an interest in real estate, including leases, shall be
accomplished by ordinance; the first reading and public hearing of this ordinance was
held on December 17, 2002; and the second reading was held on January 14, 2003.
THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That lease of commencing as of January 1, 2003, and ending on
December 31, 2017, with the option to renew said lease for an additional period of five
years, with year to year renewals thereafter, is hereby authorized and approved.
2. That the County Administrator or an Assistant County Administrator is
hereby authorized to execute a lease agreement on behalf of the Board of Supervisors
of the County of Roanoke and to execute such other documents and take such further
actions as are necessary to accomplish this transaction, all of which shall be upon form
and subject to the conditions approved by the County Attorney.
3. That the funds generated by this lease shall be placed in an account with
the Department of Parks, Recreation and Tourism for the construction of improvements
and facilities as required by the lease agreement and for future maintenance.
4. That this ordinance shall be effective on and from the date of its adoption.

ORDINANCE 011403-7 AUTHORIZING THE CREATION OF AND
FINANCING FOR A LOCAL PUBLIC WORKS IMPROVEMENT
PROJECT IN THE CLEARBROOK AREA - AMANDA LANE WATER
LINE EXTENSION PROJECT
WHEREAS, Ordinance 112288-7 authorizes the financing of local public works
improvements and the imposition of special assessments upon abutting property
owners upon the adoption of an appropriate ordinance by the Board of Supervisors; and
WHEREAS, the County Administration has negotiated the extension of the public
water system to Amanda Lane in the Clearbrook community; and
WHEREAS, the extension of the public water system and the creation of a
special utility (water) service area will alleviate a critical public health and safety
problem; and
WHEREAS, several of the residents have requested that the County allow them
to pay their portion of the costs of connection to the public water system over ten years
at an interest rate of 8%; and
WHEREAS, the first reading of this Ordinance was held on December 17, 2002,
and the second reading was held January 14, 2002; and
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That pursuant to the authority of Ordinance 112288-7, the Board
authorizes and approves a local public works improvement project, namely, public water

extension to Amanda Lane in the Clearbrook community. The total construction cost of
this public water project is estimated to be $56,705.00, to be initially financed as follows:

That there is hereby appropriated for this project the sum of $25,755 from the
Public Works Participation Fund. Any citizen participation under paragraph 3 will be
advanced as a loan from the Water Fund.
2. That the "Project Service Area" is shown and designated on the attached
plat entitled "Clearbrook Area - Amanda Lane Water Line Extension Project" prepared
by the Roanoke County Utility Department, dated 12/17/02. The Project Area is created
for a period of ten (10) years. Any owner of real estate within this service area may
participate in and benefit from the public water extension to this service area by paying
at a minimum the sum of $6,500 ($5,155 toward construction costs plus, plus $1,345
toward the off-site facility fee) said costs to be paid in full and in advance of connection
to the public water extension.
3. That the Board authorizes and approves the payment by the property
owners in the project service area who elect to participate on or before March 15, 2003,
of their portion of the cost of extending the public water system to their properties in
accordance with the following terms and conditions:

(a) The total amount per property owner/residential connection may be
financed for 10 years at an interest rate of 8% per annum. Down payment of $1,345.00
will be applied to the off-site facility fee.
(b) Property owners agree to execute a promissory note or such other
instrument as the County may require to secure this installment debt.
(c) Property owners further agree to execute such lien document or
instrument as may be required by the County; said lien document or instrument to be
recorded in the Office of the Clerk of the Circuit Court of Roanoke County. This lien
instrument or document shall secure the repayment of the promissory note by the
property owners to the County and shall be a lien against the property of the owners.
Property owners also agree to pay the County any Clerk's fees or recordation costs
which may be required to record any lien instrument or documents in the Office of the
Clerk of the Circuit Court.
(d) Property owners who wish to participate after the March 15, 2003,
deadline (other than new property owners) shall pay a minimum of $9,134 [$5,155
construction costs plus 25% (plus $30 x length of road frontage in excess of 250 feet)
plus the off-site facility fee in effect at that time (currently $2,690)].
New property owners (defined as persons who acquire ownership of real
estate within the Project Service Area after the date of the adoption of this Ordinance)
shall have ninety (90) days from the date of their acquisition of the real estate to
participate in and benefit from the public water/sewer extension to this service area by
the payment of $6,500, said costs to be paid in full and in advance of connection to the

public water/sewer extension. New property owners are not eligible to participate in the
installment financing payment method described above in paragraph 3.
4. That the payment by citizens in the project service area, in excess of
those anticipated in this ordinance, who elect to participate shall be made to the various
funds as follows: The off-site facility fee shall be returned to the Water Fund, and
payment of the construction costs shall be returned to the Public Works Participation
Fund until such time as the advance has been repaid; any further payment of
construction costs shall be returned to the Water Fund.
5. That the County Administrator is authorized to take such actions and
execute such documents as may be necessary to accomplish the purposes of this
transaction, all upon form approved by the County Attorney.

The Division of Teacher Education and Licensure, Department of Education, has officially
forwarded a request for Mentor Teacher Program allocations to Roanoke County Schools.
The funds are used to support new teacher induction programs for new teachers to
Roanoke County Schools. The allocation in the amount of $7,727.64 is to be distributed
electronically in ten (10) monthly installments. The school division will receive $773
monthly over the next ten months.
FISCAL IMPACT:
The grant requires a 50 percent match ($3,863.82) which will be taken from existing
accounts.
ALTERNATIVES:
None
STAFF RECOMMENDATION:
Staff recommends acceptance and appropriation of the Mentor Teacher Program funds of

WHEREAS, the street described on the attached Addition Form SR -5(A), fully
incorporated herein by reference are shown on plats recorded in the Clerk's Office of
the Circuit Court of Roanoke County, and
WHEREAS, the Resident Engineer for the Virginia Department of Transportation
has advised this Board the streets meet the requirements established by the
Subdivision Street Requirements of the Virginia Department of Transportation,
WHEREAS, the County and the Virginia Department of Transportation have
entered into an agreement on March 9, 1999 for comprehensive stormwater detention
which applies to this request for addition,
NOW, THEREFORE, BE IT RESOLVED, this Board requests the Virginia

SUMMARY OF INFORMATION:
The Roanoke Regional Alliance (RRAA) was formed to improve the air service to the
Roanoke Regional Airport. In April 2002, Mr. Barry DuVal, of Kaufman & Canoles
Consulting (KKC), was hired by the City of Roanoke to assist in establishing the RRAA,
and to recruit other localities and businesses to join the RRAA.
The contract with KKC totals $61,200. This contract is for a twelve month period beginning
April 1, 2002. The group was able to get a $25,000 grant from the Regional
Competitiveness Program. Roanoke City agreed to pay $22,500 and Roanoke County
agreed to pay up to $12,500.
At this time, staff would request that $12,500 be appropriated from the Board contingency
to pay for the County portion of this contract.
FISCAL IMPACT:
The County portion of the contract with KKC is a maximum of $12,500. The amount can
be appropriated from the Board contingency.
STAFF RECOMMENDATION:
Staff recommends appropriating $12,500 from the Board contingency to be paid to the City
of Roanoke for reimbursement of the County share of the contract with KKC.
VOTE:
Supervisor Minnix motion to approve staff recommendation.

RESOLUTION 011403-8.h EXPRESSING THE APPRECIATION OF THE
BOARD OF SUPERVISORS OF ROANOKE COUNTY UPON THE
RETIREMENT OF JACK H. McCORKLE, JR., POLICE DEPARTMENT
WHEREAS, Jack H. McCorkle, Jr., was employed by Roanoke County on
November 15, 1973, as a Deputy Sheriff, and advanced to the rank of Assistant Chief of
Police; and
WHEREAS, Assistant Chief McCorkle was one of the original members of the
Police Department which was established in 1990; and
WHEREAS, Assistant Chief McCorkle retired from Roanoke County on January 1,
2003, after more than twenty-nine years of service; and
WHEREAS, Assistant Chief McCorkle served as the Officer in Charge of every
major Division in the Police Department including Patrol, Investigations, and Services,
improving the quality of service to the public in each of those divisions and making
substantial contributions to the establishment and command of the newly formed County
Police Department in 1990; and
WHEREAS, Assistant Chief McCorkle was responsible forthe timely construction of
the Police Firing Range at Dixie Caverns within budget allocations due to his knowledge of
construction and his ability to assemble a cohesive work crew; and
WHEREAS, Assistant Chief McCorkle served until his retirement on the Command
Staff of the Department where his knowledge, wisdom, and insight into human nature
served him well in this capacity; and
WHEREAS, the status of the Roanoke County Police Department today is due in
part to the many contributions made by Assistant Chief McCorkle; and
WHEREAS, Assistant Chief McCorkle has served with professionalism and
integrity, and through his employment with Roanoke County, has been instrumental in
improving the quality of life for its citizens.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke
County expresses its deepest appreciation and the appreciation of the citizens of Roanoke
County to JACK H. McCORKLE, JR. for more than twenty-nine years of capable, loyal and
dedicated service to Roanoke County; and.
FURTHER, the Board of Supervisors does express its best wishes for a happy,
restful, and productive retirement.
On motion of Supervisor Minnix to adopt the Resolution and carried by the following

WHEREAS, Yvonne M. Robinson was employed by Roanoke County on August 10,
1970, as a Clerk in the Social Services Department; and
WHEREAS, Ms. Robinson retired from Roanoke County on January 1, 2003, after
thirty-two years and five months of service in the Social Services Department ; and
WHEREAS, Ms. Robinson fulfilled herjob responsibilities each day in an efficient
and effective manner; and
WHEREAS, Ms. Robinson maintained an exemplary attendance record and was an
extremely dependable and conscientious employee; and
WHEREAS, Ms. Robinson has served with professionalism and integrity; and
through her employment with Roanoke County, has been instrumental in improving the
quality of life for its citizens; and
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke

SUMMARY OF INFORMATION:
Roanoke County Public Schools was awarded a formula grant under Title II -Part D. This is
new funding from the federal government that is intended to replace several previous
grants primarily for training in the use of technology.
Staff recommends that this grant be used for training in the development and use of digital
curricula at the high school level and integration of technology at all levels.
FISCAL IMPACT:
The School Board will receive $26,527.14 in additional funding from the federal
government for technology training in FY02-03.
ALTERNATIVES:
None
STAFF RECOMMENDATION:
Staff recommends approval of this appropriation in the amount of $26,527.14.
VOTE:
Supervisor Minnix motion to approve staff recommendation.

SUMMARY OF INFORMATION:
On December 20, 2002, the Roanoke County Attorney's Office received a letter of claim
from an attorney representing former County employee, Gardner W. Smith. Mr. Smith's
employment with Roanoke County terminated as of June 30, 2002. His attorney asserts
a claim for salary and benefits from July 1, 2002 until Mr. Smith reaches age 65 which
will occur on January 8, 2006.
This notice of claim was filed to satisfy the requirements of Section 15.2-1243 et seq. of
the Code of Virginia, 1950, as amended, if necessary. The Code of Virginia allows a
citizen to submit a claim to the Board for payment or denial.
Mr. Smith's employment with Roanoke County terminated as of June 30, 2002 as a
result of restructuring of the County's administration which affected several
departments. This restructuring which eliminated several positions, including Mr.
Smith's position as Director of Purchasing, was precipitated by the severe budget
situation confronting the County. Mr. Smith is a vested member of the Virginia
Retirement System (VRS) and is eligible to draw retirement benefits. Department
heads in local government fall outside the typical personnel policies applicable to public
employees. Under the County Charter, Mr. Smith served at the pleasure of the County
Administrator and was terminable at will. The decision to terminate Mr. Smith's
employment with the County and the manner in which the termination was carried out
was done in accordance with the law.
Mr. Smith had filed a charge of race and age discrimination with the U.S. Equal
Employment Opportunity Commission (EEOC). By notice dated December 23, 2002,
EEOC informed Mr. Smith that it was unlikely that it would complete its investigation of
his charge within the time period specified. EEOC closed its file. EEOC issued Mr.
Smith a notice of a right to sue at his request. His lawsuit must be filed within 90 days
of receipt of this notice.
FISCAL IMPACT:
Based upon Mr. Smith's salary during his last year of his employment with Roanoke
County, his claim exceeds $ 100,000.00.
STAFF RECOMMENDATION:
Staff recommends that the claim of a former county employee, Gardner W. Smith, for
future salary and benefits from the date of his termination of employment until he
reaches the age of 65 be denied
VOTE:
Supervisor McNamara motion to approve staff recommendation. (Deny the Claim)

I write with regard to the above -captioned matter and as a follow up to previous
correspondence to yourself and Elmer Hodge, County Administrator, dated June 7, 2002 and
June 24, 2002. As you know, this firm represents Mr. Smith with regard to any and all
employment claims related to the elimination of his employment with the County of Roanoke. It
is Mr. Smith's position that the County's elimination of his position effective July 1, 2002,
violated Title VII of the Civil Rights Act of 1964 and the Age Discrimination and Employment.
Act of 1967. Mr. Smith is presently pursuing his claim via a complaint with the Richmond
Office of the Equal Employment Opportunity Commission.
I hereby give notice, pursuant to Virginia Code Section 15.2-1243 et seq. of a potential
claim for Gardner Smith's salary and benefits from the effective date of his termination of
employment, July 1, 2002, until the time Mr. Smith reaches 65 years of age. Mr. Smith's salary
at the time his employment was terminated was $65,424.08 annually. The County of Roanoke
has all of the records detailing the value of Mr. Smith's benefits. I enclose copies of the
correspondence which I previously referred to further outlining Mr. Smith's position.
