HomeMy WebLinkAbout8/24/2004 - Adopted Board RecordsAT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, AUGUST 24, 2004 RESOLUTION 082404-1 AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN ROANOKE COUNTY AND ROANOKE CITY RELOCATING PORTIONS OF THE BOUNDAY LINE BETWEEN SAID GOVERNMENTAL ENTITIES, AND AUTHORIZING THAT CERTAIN OTHER ACTIONS RELATING TO SUCH BOUNDARY LINE BE TAKEN AS PROVIDED BY LAW WHEREAS, pursuant to the provisions of Article 2, Chapter 31, Title 15.2 of the 1950 Code of Virginia, as amended, the governing bodies of Roanoke County and Roanoke' City wish to petition the Circuit Court for approval to relocate portions of the boundary line between the two jurisdictions; and WHEREAS, the relocation the boundary line of such governmental entities in the areas proposed will permit more effective and efficient delivery of municipal services and promote the public health, safety, and welfare; and WHEREAS, the governing body of Roanoke City has adopted a measure reflecting its desire to relocate and change portions of the boundary line between the two localities as required by certain property owners within said areas; and WHEREAS, Roanoke City and Roanoke County have agreed to the boundary relocations by action of their respective governing bodies. THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, that: 1. The Chairman of the Board of Supervisors is hereby authorized to execute an agreement between Roanoke City and Roanoke County, on a form approved by the County Attorney, establishing a new boundary line at certain points between said jurisdictions, as more particularly shown on plats prepared by Lumsden Associates, dated June 2, 2004, which are incorporated by reference herein (Exhibits A, B, and C). 2. The boundary line set forth in said agreement is described as set out in the Notice of Public Hearing (Exhibit D) which was published as required by §15.2-3107 of the 1950 Code of Virginia, as amended. 3. Upon approval of the execution of the agreement between the governing bodies, the County Attorney is authorized to petition the Circuit Court of one of the affected jurisdictions to relocate the boundary line in accordance with the plats and the agreement. 4. Upon entry of an order by the Circuit Court establishing the new boundary line, certified copy of such order will be forwarded to the Secretary of the Commonwealth. 5. The County Administrator and County Attorney are authorized to take, or cause to be taken, such other actions, and to execute other documents as may be required by law to effect the change in the boundary line as set forth herein. 6. The Clerk to the Board of Supervisors is directed to forward an attested copy of this resolution to the Roanoke City Clerk. W Exhibit D NOTICE OF PROPOSED BOUNDARY LINE RELOCATIONS TO WHOM IT MAY CONCERN: Pursuant to Sections 15.2-3106, et seq, of the 1950 Code of Virginia, as amended, the Board of Supervisors of Roanoke County, on Tuesday, August 24, 2004, at 7:00 p.m. in the Roanoke County Administration Center, Board Meeting Room, 5204 Bernard Drive, Roanoke, Virginia, and the City Council of the City of Roanoke, on Monday, August 16, 2004, at 7:00 p.m. in the Roanoke City Council Chambers, Room 450, Noel C. Taylor Municipal Building, 215 Church Avenue Roanoke, Virginia, will consider adoption of an agreement authorizing the relocation of portions of the boundary line between the two jurisdictions. The boundary line adjustments are described as follows: (1) A parcel of real estate owned by Roanoke County and containing 53.038 acres being located along Berkley Road and known as Vinyard Park 11 (Tax Map #7020101) and currently located in Roanoke City will be included within the corporate boundary of Roanoke County. (2) Parcels of real estate owned by the Western Virginia Water Authority containing 33.094 acres (Tax Map No. 70.11-1-1); A.P.J., LLC containing 5.131 acres (Tax Map No. 70.11-1-3), and James R. Chisom containing 0.753 acres (Tax Map No. 70.11-1- 19.1) being located along Underhill Avenue and currently located in Roanoke County will be included within the corporate boundary of Roanoke City. (3) A parcel of real estate owned by Rockydale Quarries Corporation and containing 9.024 acres (Tax Map No. 88.03-1-36) being located at the intersection of Draper Road and Old Rocky Mount Road currently located in Roanoke County will be included within the corporate boundary of Roanoke City. Hodge County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: The Department of Social Services receives additional appropriations throughout the year for public assistance and services delivery. During FY03-04, the department provided services for various programs including transitional day care, aid to foster children, and adoption subsidy that are 100% reimbursable from the federal government. The Department of Social Services cannot access these funds until the County has appropriated the departmental budget. Hodge County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: During FY 2003-2004, as in previous years, the inmate population at the Roanoke County jail has remained above capacity. In addition, the average daily inmate population increased from 240 to 259 through FY 2004, an increase of 8% over the prior fiscal year. The average population for the final quarter for FY 2004 was approximately 268. As a result, operational costs such as food, utilities, medical costs, etc. continue to consume a substantial portion of the jail's budget. Due to the increased inmate population, the Sheriff is projecting expenditures related to inmate care to exceed original budget allocations by $98,000 for FY 2003-2004. For comparative purposes, the year-end adjustment approved by the Board for the prior year was $147,000. Roanoke County is reimbursed by the state for salaries, mileage, office expenses, and for housing state prisoners. The reimbursement for state responsible inmates varies between a rate of $6 and $8/day. In addition, the City of Salem reimburses the County for housing its prisoners on a per diem basis. State reimbursement for commonwealth responsible prisoners is subject to state prisoner population, general assembly appropriations, and political factors, variables difficult to consider in revenue projections. During previous fiscal years, state revenue receipts have exceeded the conservative state budget projections by an amount that would cover increased jail expenditures caused by higher than normal inmate populations. The mid -year reductions employed by the state in the prior and current fiscal years have greatly reduced these additional funds. Based on the revenue estimates versus the projected revenues anticipated to be collected from the state and from the City of Salem for the Sheriff's Department for FY 2003-2004, revenues in excess of budget for these categories should total approximately $110,000. The FY 2004-2005 expenditure budget for the jail has been adjusted to reflect the increased inmate population that has steadily grown over the last several years; therefore, if additional appropriations are needed at the end of the current fiscal year the addition should be minimal. FISCAL IMPACT: No fiscal impact — 100% state funds STAFF RECOMMENDATION: Staff recommends an appropriation adjustment to recognize an additional $98,000 of revenue for FY 2003-2004 for personnel and operations reimbursement and increasing the FY 2003-2004 care and confinement budget within the Sheriffs department by $98,000 to cover increased operational costs of the jail caused by increased inmate population, staffing requirements, and capital reimbursements. These expenses were reimbursed by the state through technology funds earmarked for this purpose and now need to be appropriated to the Clerk of Circuit Court. FISCAL IMPACT: No fiscal impact -100% state funds STAFF RECOMMENDATION: Staff recommends appropriating $24,810 to the Clerk of Circuit Court for fiscal year 2003- 2004. At the July 27, 2004 Board meeting, Supervisor Altizer nominated Mike Roop, Vinton Magisterial District, to serve an additional one-year term that will expire on August 31, 2005. Supervisor McNamara has requested that Barbara Bushnell, Windsor Hills Magisterial District, be added to the consent agenda for confirmation at this meeting. This term will expire on August 31, 2005. 1 Supervisor Wray has requested that Pam Berberich, Cave Spring Magisterial District, be added to the consent agenda for confirmation at this meeting. Her one-year term will expire on August 31, 2005. Grievance Panel Supervisor Flora has requested that R. Vincent Reynolds' name be added to the consent agenda for confirmation at this meeting. RCPS then applied with the County of Roanoke for the capital improvement incentive grant to obtain matching funds necessary to purchase playground mats for the high use areas in each of the elementary school playgrounds. RCPS has been awarded funding in the amount of $5,120 from the County of Roanoke capital improvement incentive fund to be used for Project Safe Surface. The goal of this project is to install playground mats on RCPS playgrounds to stabilize and limit the loss or displacement of loose -fill material in areas of high traffic and/or kick -out to consistently meet the American Society for Testing and Materials (ASTM) specifications for surface material. The target areas will be slide exits and the area immediately under swings. There are 17 elementary schools in Roanoke County with playgrounds, eight of which host the Roanoke County Parks and Recreation After School for Kids (ASK) programs. There are 16 schools which host preschool programs. Both programs are inspected on a regular basis by a licensing specialist from the Virginia Social Services Department. The playgrounds have been cited in the past for insufficient surface material, most often in the target areas mentioned above. Mats of this type were installed at Glenvar Elementary School (three at slide exits) and Mount Pleasant Elementary School (one under single axis swing) in spring 2003 and have proven to be very effective. FISCAL IMPACT: The total cost of the mats will be covered by the United Way and CIIF grants. Installation will be done in-house.
