SUMMARY OF INFORMATION: The State Board of Elections (SBE) has called for a dual primary on June 14, 2005, with the office of Lt. Governor on the Democratic ballot and the offices of Governor, Lt. Governor, and Attorney General on the Republican ballot. The cost of this primary was not included in the current budget because it was not certified by SBE until March 18, 2005. No reimbursement will be made by the state. NOW, THEREFORE, be it resolved by the Board of Supervisors of Roanoke County that: The Board hereby approves the agreement for creation of the Western Virginia Regional Jail Authority presented to the Board this date, and authorizes the County Administrator to execute the agreement on behalf of the County. Inasmuch as the Sheriff is a member of the Board of the Authority by law and agreement, the Board also appoints John M. Chambliss, Jr., Administrative Official, and Michael A. Wray, Board Member, to be the County members of the Authority, and Diane D. Hyatt and Joseph P. McNamara as alternate members. On amended motion of Supervisor McNamara to adopt the resolution as follows: adopt the resolution and appoint the following representatives: John M. E-3 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: May 24, 2005 AGENDA ITEM: Request to extend the option on the Higginbotham site for the regional jail to April 30, 2006 SUBMITTED BY: John M. Hodge County Administrator COUNTY ADMINISTRATOR'S COMMENTS: It is anticipated that the County or the Authority will close on the property following the completion of all necessary Planning Commission and Roanoke County public hearings. The appropriation of funds for the land purchase will be made at a later time. SUMMARY OF INFORMATION: At the January 11, 2005 meeting, the Board of Supervisors authorized County staff to obtain an option on the Higginbotham site for the regional jail. The option was obtained at a cost of $10,000 for the period ending June 30, 2005. The option agreement also contained a provision allowing an extension for an additional ten months through April 30, 2006. The first option period allowed the County to perform due diligence testing to see if the site was appropriate for the jail. The tests have been completed and the site appears suitable for a jail facility. The extended option period will allow time for the following: (1) the Jail Authority to be created; (2) the Board of Corrections to review and approve the project; (3) the Governor's Office to include the project in the state capital budget; and (4) the General Assembly to consider the budget request. A "supplemental option fee" in the amount of $20,000 is required to extend the option. The option payments will be applied to the purchase price if the site is purchased, but are forfeited if the option is not exercised. This language was included in the original option agreement and the monies were included in the $250,000 appropriated on January 11, 2005. FISCAL IMPACT: Funds in the amount of $250,000 were appropriated by the Board of Supervisors at the January 11, 2005 meeting to cover the cost of the options, testing for the site, and a feasibility study for the existing jail site in downtown Salem. The $20,000 required for the supplemental option fee is included in the $250,000 appropriation and no new money is required. The money for the options and testing of the site are eligible for reimbursement to the County when financing is approved for the Jail Authority. STAFF RECOMMENDATION: Staff respectfully requests that it be authorized to extend the option for the Higginbotham site at a cost of $20,000 as outlined in the option agreement for an additional ten months until April 30, 2006. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia: 1. That the County Administrator may authorize or delegate the authorization of the transfer of any unencumbered balance or portion thereof from one department to another within a fund. 3. That all funded outstanding encumbrances, both operating and capital, at June 30, 2005, are re -appropriated to the 2005-06 fiscal year to the same department and account for which they are encumbered in the previous year. 4. That appropriations designated for capital projects will not lapse at the end of the fiscal year but shall remain appropriated until the completion of the project or until the Board of Supervisors, by appropriate action, changes or eliminates the appropriation. Upon completion of a capital project, staff is authorized to close out the project and transfer to the funding source any remaining balances. This section applies to appropriations for Capital Projects at June 30, 2005, and appropriations in the 2005- 06 budget. 5 5. That all school fund appropriations remaining at the end of the 2004-05 fiscal year not lapse but shall be appropriated to the School Capital Improvements Fund in fiscal year 2005-06. 6. That all General Fund appropriations remaining unexpended at the end of the 2004-05 fiscal year not lapse but shall be re -appropriated as follows: a) 40% of these unexpended appropriations shall be transferred to the un- appropriated Capital Fund Balance; b) 60% of these unexpended appropriations shall be re -appropriated to the same department for expenditure in fiscal year 2005-06 as provided by Resolution 042396-5. 7. That Two Million Dollars from the Unappropriated Fund Balance is hereby appropriated to a Reserve for Contingency for unanticipated or emergency expenditures that may arise during the 2005-06 fiscal year; and money allocated to the Unappropriated Fund Balance must be appropriated by the Board of Supervisors before such money may be expended. 8. This ordinance shall take effect July 1, 2005. Board of Zoning Appeals (Appointed by District) Supervisor Altizer has requested that Mr. Eric Thomas, Vinton Magisterial District representative, be appointed to serve an additional five-year term that will expire on June 30, 2010. He requested that confirmation of this appointment be placed on the consent agenda. 2. Clean Valley Council Supervisor Wray has requested that Stephen McTigue be appointed to fill the unexpired portion of the term of Wes Thompson, who has resigned from the committee, and to serve an additional two-year term which will expire on June 30, 2007. He requested that confirmation of this appointment be added to the consent agenda. 3. Community Policy and Management Team (CPMT) Staff and the CPMT recommend that Mr. Gary Wilburn be appointed to serve an additional three-year term that will expire on June 30, 2008. It has been requested that confirmation of this appointment be placed on the consent agenda. ill 4. Parks and Recreation Advisory Commission (Appointed by District) Supervisor Wray has requested that Ms. Lee Blair, Cave Spring Magisterial District representative, be appointed to serve an additional three-year term that will expire on June 30, 2008. Roanoke Valley -Alleghany Regional Commission Supervisor McNamara has requested that Elmer Hodge, sixth representative, be appointed to serve an additional three-year term which will expire June 30, 2008. He further advised that he would be willing to serve an additional three-year term as the County's elected representative on this committee. He requested that confirmation of these appointments be added to the consent agenda. STAFF RECOMMENDATION: It is recommended that the above appointments to the Board of Zoning Appeals; Clean Valley Council; Community Policy and Management Team; Parks and Recreation Advisory Commission; and the Roanoke Valley -Alleghany Regional Commission be confirmed. The funds are available for immediate reimbursement. Although the school system has until September 30, 2006, to spend the funds in the grant, it is desirable that the school system order and receive as many laptops as possible by June 15 to facilitate distribution in the fall. FISCAL IMPACT: The 2004-2005 Technology Budget will be increased by $114,718. ALTERNATIVES: None STAFF RECOMMENDATION: Staff recommends the acceptance and appropriation of funds in the amount of $114,718 to the 2004-2005 budget for Title II -D purchase of laptop computers for instruction. Hodge, Jr. County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: As a result of legislation enacted by the 2003 General Assembly, the Virginia Emergency Services and Disaster Laws of 2000, each jurisdiction is required to submit an annually updated emergency management assessment to the State Coordinator of Emergency Management by July V' of each year. The purpose of the LCAR is to provide a self- assessment instrument for our jurisdiction to identify our emergency management program strengths and areas of improvement, provide collaborative dialogue between local and state management agencies, and assist the state in accurately assessing the status of its partnership with each jurisdiction. These funds are being provided to assist the jurisdictions in meeting these state requirements. The deadline for expending these funds is June 30, 2005. FISCAL IMPACT: There is no fiscal impact. This grant fund must be used for the sole purpose of conducting an LCAR. The grant funds will be electronically transferred by the state but any unused portion must by returned. STAFF RECOMMENDATION: Staff requests that the Board of Supervisors accept and appropriate the amount of $2,000.00 to the Fire and Rescue Department for the administration of the grant and the appropriate purchasing procedures necessary to complete this project.
