AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE
COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER
ON TUESDAY, AUGUST 25, 1992
RESOLUTION 82592-1 IN SUPPORT OF ROANOKE RIVER
PARKWAY, ALTERNATIVE 4 FOR ACCESS TO
VIRGINIA'S EXPLORE PARK.
WHEREAS, the National Park Service has prepared a Final
Environmental Impact Statement for the Roanoke River Parkway; and
WHEREAS, Roanoke County supported Alternative 2, the preferred
alignment in the Draft Environmental Impact Statement, in a letter
dated August 27, 1990, to Gary Everhardt, Blue Ridge Parkway
Superintendent; and
WHEREAS, the Final Environmental Impact Statement proposes
that Alternative 4, the construction of a 1.5 mile spur road from
the Blue Ridge Parkway to Virginia's Explore Park, will have
minimal impact; and
WHEREAS, Roanoke County staff has been active through the
Explore Management Group to assist in the coordination of efforts
to locate the Parkway spur road (Alternative 4) through property
owned by the Roanoke Valley Solid Waste Management Board; and
WHEREAS, the Roanoke County Explore Advisory Committee
recommended support of Alternative 4 at their August 19, 1992
meeting.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF
ROANOKE COUNTY, VIRGINIA, AS FOLLOWS:
1. That the Board does reaffirm its support for the
construction of a 1.5 mile spur road (Alternative 4) from
the Blue Ridge Parkway to Virginia's Explore Park,
superseding the previous support of Alternative 2 in
1990.
2. That the Board encourages expedited processing of plans
for the design and construction of such road to assist in
the implementation of the Explore project.
On motion of Supervisor Kohinke to adopt the resolution, and
carried by the following recorded vote:

RESOLUTION 82592-2 APPROVING THE ROANOKE
VALLEY RESOURCE AUTHORITY CAPITAL BUDGET FOR THE
SOLID WASTE SYSTEM REVENUE BONDS, SERIES 1992
WHEREAS, Section 5.9 of the Roanoke Valley Resource Authority
Members Use Agreement provides that the Authority shall prepare and
submit its budgets to the Board of Supervisors of the County, the
City Council of the City of Roanoke, and the Town Council of the
Town of Vinton; and
WHEREAS, on August 20, 1992, the Roanoke Valley Resource
Authority adopted the capital budget for the Solid Waste System
Revenue Bonds, Series 1992, a copy of which is on file in the
office of the Clerk of the Board:
THEREFORE, BE IT RESOLVED by the Board of Supervisors of
Roanoke County, Virginia that the capital budget totaling
$33,414,005 for the Solid Waste System Revenue Bonds is hereby
APPROVED, and the County Administrator and the Clerk are authorized
to execute and attest, respectively, on behalf of the County, any
documentation, in form approved by the County Attorney, necessary
to evidence said approval.

BACKGROUND
Roanoke County Schools serves as the LEA for the Roanoke Area Tech
Prep Consortium. The consortium is comprised of the Botetourt
County, Craig County, Franklin County, Roanoke County, Roanoke City
and Salem City school divisions, and Virginia Western Community
College. Two project grants have been awarded to the consortium:
International Marketing Development/ Implementation and Arts/Media.
Each project will receive $80,000 over a three-year period --1992-
1995. The 1992-93 allocation is $30,000 with $25,000 to be funded
in each of the years 1993-94 and 1994-95. Both the International
Marketing and Arts/Media projects will expose students to new
programs designed to extensively interact participants from
business, industry, government and education.
In addition to the tech prep awards, Roanoke County Schools has
been awarded a Consumer and Homemaking grant of $60,000 over a
three-year period --1992-1995. Funding will be divided equally over
the three years. These funds will be used to develop and implement
the integration of academics into an articulated home economics
education program.
The balance of the grant funding to be received for 1993-94 and
1994-95--$25,000 per year per project for International Marketing
and Arts/Media and $20,000 per year for Consumer and Homemaking --
will be budgeted in the respective years.
SUMMARY OF INFORMATION:
For the 1992-93 school year, Roanoke County Schools will receive
grant funding of $30,000 for an International Marketing
Development/Implementation Tech Prep project, $30,000 for an
Arts/Media Tech Prep project, and $20,000 for a Consumer and
Homemaking project. Appropriations of these amounts to the School
Grant Fund are requested as per the attached resolution.
FISCAL IMPACT: None. The grants are 100% funded and require no
county matching funds.

IN REGULAR SESSION AT 7 P.M. ON AUGUST 13, 1992 IN THE BOARD ROOM OF
THE SCHOOL ADMINISTRATION BUILDING, SALEM, VIRGINIA.
RESOLUTION REQUESTING APPROPRIATIONS TO
THE SCHOOL GRANT FUND FOR VOCATIONAL
EDUCATION PROJECTS
WHEREAS, the following grants have been awarded in the area
of vocational education for the period of 1992 - 1995,
BE IT RESOLVED that the County School Board of Roanoke
County, on motion of Barbara B. Chewning and duly seconded, requests
the Board of Supervisors of Roanoke County to appropriate funding for
the 1992-93 school year to the School Grant Fund. The balance of
funding for the 1993-94 and 1994-95 school years will be budgeted
respectively.
1. International Marketing Development/ Implementation Tech
Prep Project awarded to the Roanoke Area Tech Prep Consortium (for
which Roanoke County is the LEA). A grant of $80,000 for the three-
year period, $30,000 will be received for FY 1993. The project will
combine international academic area --social studies, foreign language
and economics --with marketing education at the secondary and
postsecondary levels to provide instruction to students in cultural
trade.
2. Arts/Media Project awarded to the Roanoke Area Tech Prep
Consortium (for which Roanoke County is the LEA). A grant of $80,000
for the three-year period, $30,000 will be received for FY 1993. The
project will plan, develop, and implement a program in the career
field of arts/media that will prepare students for employment and
advanced educational options.
3. Consumer and Homemaking Grant awarded to Roanoke County
Schools. A grant of $60,000 for the three-year period, $20,000 will
be received for FY 1993. The project will integrate home economics
education and academics to prepare students to cope with ever-changing
methodologies in the field of home economics.

AGENDA ITEM: Approval of Two Change Orders for the Spring Hollow
Reservoir Contract
COUNTY ADMINISTRATOR'S COMMENTS:
BACKGROUND:
The Board of Supervisors approved a procedure for approval of
Change Order on the Spring Hollow reservoir Project. This
procedure requires Board of Supervisor approval for Change Orders
that will cost in excess of $200,000.
SUMMARY OF INFORMATION:
Two change orders are currently pending that require approval of
the Board of Supervisors.
Change order No. 7 in an amount of $755,563.43 is for material and
construction required to add two (2) pumps with associated motors,
piping, electrical equipment, intake screens and sluice gates to
the river intake pump station. Also included in the above amount
is $23,520 for the cost to install the concrete plug/cap in the dam
foundation area requiring excavation.
Hayes, Seay, Mattern & Mattern, Inc. has negotiated the price with
the contractor and finds the $755,563.43 cost to be fair and
equitable and recommends acceptance.
Change Order No. 8 in an amount of $714,544 is for material and
construction required to add water lines associated with the water
treatment plant and located within the Reservoir Project. These
water lines are identified as lines B, C, and D on the construction
drawings. The work involves:
(1) Approximately 1,094 linear feet of 36 inch raw water line from
the gate house to crossing beneath and north of the Roanoke
River,

(2) Approximately 1,020 linear feet of 30 inch water line from the
railroad tracks to crossing beneath and north of the Roanoke
River,
(3) Approximately 920 linear feet of 36 inch water line from the
railroad tracks to discharge at the river near the river pipe
crossing.
Hayes, Seay, Mattern & Mattern, Inc. has negotiated the price with
the contractor and finds the $714,544 cost to be fair and equitable
and recommends acceptance.
FISCAL IMPACT:
Funds required for Change Orders No. 7 and No. 8 in the amount of
$1,470,107.43 are available within the Spring Hollow Reservoir
Project Budget portion of the 1991 Water Projects Fund.
STAFF RECOMMENDATION:
Staff recommends that the Board of Supervisors approve Change Order
No. 7 in the amount of $755,563.43 and approve Change Order No. 8
in the amount of $714,544. It is further recommended that the
Board of Supervisors authorize the County Administrator to execute
Change Order No. 7 and Change Order No. 8 on behalf of Roanoke
County.

placed on the Consent Agenda. His term will expire September 10,
1994.
Highway and Transportation Safety Commission
Supervisor Minnix nominated Carl E. Wright to a four-year term,
representing the neighborhood organizations, and requested that
confirmation of this appointment be placed on the Consent Agenda.
His term will expire June 30, 1996.

BUSHDALE ROAD RURAL ADDITION PROJECT
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
This consent agenda item involves the donation of the
following rights-of-way to the Board of Supervisors of Roanoke
County, Virginia, in connection with the Bushdale Road Rural
Addition Project in the Vinton Magisterial District:
a) Donation of all right, title and interest in and to the
existing "Private Road", known as Bushdale Road, varying
in width from twelve feet (121) to thirty-one (311),
leading to and from Virginia Secondary Route 659
(Mayfield Drive, formerly Gearhart Road) from Sarah B.
Poff, widow, (Deed Book 339, page 406, and Deed Book 523,
page 82).
b) Donation of: (i) a parcel of land shown and designated as
"PROPOSED RIGHT OF WAY (.085 Ac.)" on a plat, dated
January 3, 1991, prepared by the Roanoke County
Engineering Department, a copy of which is attached
hereto; and (ii) all right, title and interest in and to
the existing "Private Road", known as Bushdale Road,
varying in width from twelve feet (121) to thirty-one
(311), leading to and from Virginia Secondary Route 659
(Mayfield Drive, formerly Gearhart Road); from Lelia B.
Robertson Draper, single, (Deed Book 1273, page 1525, and
Deed Book 1275, page 373). This donation is subject to
certain specific conditions in connection with
construction on the project, namely that the County
agrees to:
(i) Limit the 10' temporary construction easement to use
as a temporary work space for necessary slope grading and
reseeding of the property; placement of cut trees which
are to be retained by the Grantor; and installation of
temporary and permanent fencing.
(ii) Take measures in accordance with standard
engineering practices to ensure proper stabilization of
areas subject to construction, including grading of the

bank to a uniform slope (2:1) along the length of the
property and seeding of this area with proper vegetation.
(iii) Instruct the contractor to save the oak trees (to be
marked by ribbons), which are cut from the right-of-way
area, and to place them on the Draper property in an
orderly manner within the temporary construction easement
area for future use by the property owner.
(iv) Instruct the contractor to maintain a single wire,
flagged fence along the new property line during
construction, except for temporary removal when needed
for use of the temporary construction easement for the
purposes specified in the deed. Upon completion of
construction, a 6' chain link fence is to be installed
along the new property line (the new western boundary
line of your property), extending approximately 247'
between the existing northerly and southerly boundary
lines.
County staff has inspected and approved the location and
dimensions of the right-of-way for the project.
FISCAL IMPACT:
The Board has previously appropriated the sum of $15,000.00
from the General Fund Unappropriated Balance to proceed with right-
of-way acquisition, based upon the fact that the road construction
is provided by VDOT through Rural Addition Funds, but the costs
associated with engineering and right-of-way acquisition are funded
by Roanoke County.
The maximum cost to the County in connection with the
conditions for donation of right-of-way from Lelia Draper is
$2,500.00. The Board has previously authorized expenditure of a
total of $7,193.00 of the appropriated $15,000.00 for right-of-way
acquisitions, leaving a balance of $7,807.00. The money required
to comply with the conditions set forth above is therefore
available from the funds previously allocated by the Board for this
project.
STAFF RECOMMENDATION:
Staff recommends acceptance of the donations of right-of-way,
subject to the stated conditions, for the Bushdale Road Rural
Addition Project.

Magisterial District of the County of Roanoke:
a) Donation of: a parcel of land shown and designated as
"PROPOSED R/W" on a plat, dated February 3, 1992,
prepared by the Roanoke County Engineering Department, a
copy of which is attached hereto; (ii) a drainage
easement of variable width as shown on said plat; from
George G. Getz, Trustee under the Buckhorn Land Trust
Agreement dated October 1, 1991, (Deed Book 1357, page
1583) (Tax Map No. 88.13-4-18).
b) Donation of a parcel of land shown and designated as
"PROPOSED R/W" on a plat, dated March 14, 1991, prepared
by the Roanoke County Engineering Department, a copy of
which is attached hereto, from Gary L. Bannister and
Glenna J. Bannister, husband and wife, (Deed Book 1278,
page 42) (Tax Map No. 88.13-4-19).
The location and dimensions of these properties have been
reviewed and approved by the County's engineering staff.

CAVE SPRING MAGISTERIAL DISTRICT
WHEREAS, on October 22, 1991, the Board of Supervisors granted
a special exception permit for the location and operation of a
stump and construction debris landfill on a 74.86 acre tract of
land located on the east side of Merriman Road (Route 613) 800 feet
north of its intersection with Token Road (Route 684) in the Cave
Spring Magisterial District subject to certain conditions; and
WHEREAS, Joe Bandy & Son, Inc. has filed a petition to operate
a debris waste landfill at the same location with amended the
conditions; and
WHEREAS, the Planning Commission held a public hearing on this
matter on July 7, 1992; and
WHEREAS, the Board of Supervisors of Roanoke County, Virginia,
held a public hearing on this matter August 25, 1992.
NOW, THEREFORE BE IT RESOLVED by the Board of Supervisors of
Roanoke County, Virginia, as follows:
1. That the Board finds that the granting of a special
exception permit for the location and operation of a debris waste
landfill is substantially in accord with the adopted 1985 Compre-
hensive Plan pursuant to the provisions of § 15.1-456 (b) of the
1950 Code of Virginia, as amended.

2. That the Board hereby grants a Special Use Permit to Joe
Bandy & Son Inc. to operate a debris waste landfill on approximate-
ly 75 acres of land located on the east side of Merriman Road
(Route 613) 800 feet north of its intersection with Token Road
(Route 684), in the Cave Spring Magisterial District, subject to
the following amended conditions:
a. Active landfilling will not be conducted on more
than 25 acres.

WHEREAS, Robert and Sherry Wagstaff have requested the Board

feet of a 10 -foot drainage easement located on the southern

Board of Supervisors at their August 25, 1992 meeting. This
ordinance repeals the Zoning Ordinance revised 1985, and approves
the new Zoning Ordinance as Appendix A of the Code.

ORDINANCE 82592-12 AMENDING THE ZONING
ORDINANCE FOR ROANOKE COUNTY BY THE REPEAL OF
SAME AND BY ADOPTING AND REENACTING A NEW
ZONING ORDINANCE FOR ROANOKE COUNTY, AND
PROVIDING FOR CERTAIN TRANSITION PROVISIONS AND
AN EFFECTIVE DATE THEREOF
WHEREAS, the old zoning ordinance for Roanoke County was adopted over twenty
years ago. It was reorganized and updated in 1985 to improve its ease of use, to correct
possible legal problems, and to make standards and documents consistent with then -current
conditions. Its substantive provisions have been amended from time -to -time to address
evolving issues of growth and land use in Roanoke County; and
WHEREAS, the Roanoke County Planning Commission and County staff have been
laboring for the past three years to develop a new zoning ordinance for the County to
address the changing needs and land use patterns of the County and its citizens; and
WHEREAS, this ordinance is adopted in accordance with and pursuant to the
provisions of Article 8, Chapter 11, Title 15.1 of the 1950 Code of Virginia, as amended,
and Chapters 3 and 9 of the Roanoke County Charter; and
WHEREAS, the 1992 Roanoke County Zoning Ordinance is adopted in order to
implement the 1985 Roanoke County Comprehensive Plan (and reviewed by the Planning
Commission in 1990 in accordance with Section 15.1454 of the State Code) to address
future growth and development policies of the County; and
WHEREAS, the Board finds that the adoption and reenactment of this zoning
ordinance will improve the public health, safety, convenience and welfare of the citizens

of the County and will assist in planning for the future development of this community to
the end that transportation systems be carefully planned; that new community centers be
developed with adequate highway, utility, health, educational, and recreational facilities;
that the needs of agriculture, industry, and business be recognized in future growth; that
residential areas be provided with healthly surroundings for family life; that agricultural
and forestal land be preserved; and that the growth of the community be consonant with
the efficient and economical use of public funds; and
WHEREAS, the Roanoke County Planning Commission and planning staff have
conducted numberous neighborhood and civic league meetings, work sessions, community
open house sessions, and public hearings to advise and inform the citizens and the
development community of the provisions of the new zoning ordinance; and
WHEREAS, the Roanoke County Planning Commission held public hearings on this
matter on April 7, 1992, and June 2, 1992; and recommended approval of this ordinance
to the Board of Supervisors of Roanoke County, Virginia; and
WHEREAS, legal notice and advertisement has been provided as required by law;
and
WHEREAS, the first reading of this ordinance was held on June 23, 1992, and the
second reading and public hearing was held on August 25, 1992.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That the Roanoke County Zoning Ordinance, 1985 edition, as amended, is
amended by repealing it in its entirety, Sections 21-1 through 21-140, as amended.

2. That the following provisions of the Roanoke County Code are hereby
amended by repealing them in their entirety:
a. Sections 201.00 through 202.00 inclusive of all subsections of the
Public Street and Parking Design Standards and Specifications of the
Roanoke County "Design and Construction Standards Manual."
b. Article II, "Public Dance Halls, " of Chapter 4, "Amusements" of the
Roanoke County Code.
C. Article III, "Shooting Matches" of Chapter 4, "Amusements" of the
Roanoke County Code.
3. That there is hereby adopted and reenacted a Zoning Ordinance for Roanoke
County, being Appendix A of the Roanoke County Code, as follows:

4. That the following transition provisions shall apply for the application and
enforcement of the Zoning Ordinance for Roanoke County:
a. Until revised official zoning maps are approved by the Board of
Supervisors, the zoning district designations and regulations of the
adopted and reenacted Zoning Ordinance shall apply to the existing
official zoning map designations and districts as provided in the
following table:

b. Upon the filing with the County by any owner of real estate of a site
development plan, an application for a building permit, final
subdivision plat, or any other plan, plat, or permit required by or
under the provisions of the Roanoke County Zoning Ordinance, before
effective date of this ordinance, then the provisions of the repealed
Zoning Ordinance shall apply to such plan, plat, permit, or
application, provided that such plan, plat, permit, or application shall
receive final approval by the County on or before the effective date of
this ordinance.
5. That this ordinance shall be in full force and effect from and after December
31, 1992.
On motion of Supervisor Nickens to approve Option 2 for clarification of Article II,
Major Public Utilities, as contained in memorandum dated 8/25/92 from John Hartley, and
carried by the following recorded vote:

Ordinance, June 15th draft, with amendments of August 21st, and with changes as

ordinance to be December 31, 1992, and carried by the following recorded vote:
