RESOLUTION 91091-1 OF CONGRATULATIONS TO ROANOKE COLLEGE
AND HOLLINS COLLEGE ON THEIR SESQUICENTENNIAL ANNIVERSARIES
WHEREAS, Roanoke College and Hollins College were
founded in Roanoke County in 1842; and
WHEREAS, both colleges have contributed to the
educational and cultural environment of the Roanoke Valley for the
past 150 years, providing the opportunity for Valley students of
all ages to earn college degrees; and
WHEREAS, graduates of the two schools have distinguished
themselves in both the public and private sectors; and
WHEREAS, Roanoke College and Hollins College continue
to provide, through the broad liberal arts curriculum, preparation
for the challenges and problems of modern life.
NOW, THEREFORE, BE IT RESOLVED, that the Roanoke County
Board of Supervisors extends its sincere congratulations to ROANOKE
COLLEGE and HOLLINS COLLEGE on the occasion of their
Sesquicentennials; and
FURTHER, BE IT RESOLVED, that the Roanoke County Board
of Supervisors extends its appreciation and gratitude for the
opportunities which these schools have provided to the residents
of Roanoke County.

AGENDA ITEM: Authorization to Rename Gladetown Park, Vinton
Magisterial District, to M. A. Banks Park.
COUNTY ADMINISTRATOR'S COMMENTS:'
EXECUTIVE SUMMARY:
The Craig Avenue Advisory Committee has formally requested
that the Board of Supervisors rename Gladetown Park in honor
of the late Mr. Matthew A. Banks.
BACKGROUND:
Mr. Banks was a citizen of the Craig Avenue Community for over
seventy years and a notable civic leader who served Craig
Avenue residents faithfully. Among his many community
accomplishments, Mr. Banks formed the first Boy and Girl Scout
Programs for the community, organized the first Youth Baseball
League and was nominated for the Roanoke County Senior
Citizen's Hall of Fame in 1990. In addition, Mr. Banks served
on the Vinton Town Council, Chairman of the Craig Avenue
Advisory Committee, Vinton Historical Society, Vinton
Transportation Committee and as Past Grand Potentate of the
Sahara Grand Temple Shrine for the Commonwealth of Virginia.
SUMMARY OF INFORMATION:
Mr. Banks dedicated his adult life to serving the residents
of the Craig Avenue Community. The Craig Avenue Committee's
request to rename Gladetown Park to M. A. Banks Park is a
fitting tribute to a man who has done so much for his
community and who consistently showed a sincere interest in
the value of Parks and Recreation services.

EXECUTIVE SUMMARY: This proposed program is a volunteer leaf
program for the elderly or disabled who are financially
disadvantaged and need assistance in bagging their leaves and a
referral service to other citizens who may wish to contract this
service.
BACKGROUND:
The curbside leaf vacuum service has been discontinued in
Roanoke County due to costs of equipment repair and replacement,and
because of inequities in being able to service only urban areas and
not rural areas of the County. This may cause hardships on the
elderly or disabled who are financially disadvantaged who depended
on this service to help maintain the appearance of their property
after the leaves have fallen. The Board of Supervisors has
requested that the County Administrator design this program to help
fill the void of no longer having a leaf vacuum service in Roanoke
County.
SUMMARY OF INFORMATION:
This program would be staffed strictly by volunteers from the
community who would bag leaves at the homes of qualified citizens
for pick up by the Refuse Division. The County would provide a
coordinator to oversee the "matching" of volunteers and qualified
citizens. The coordinator would also inform other citizens of
available professional services that would help them with leaf
removal. The coordinator would be selected from existing staff and
would not cause an increase in payroll expenditures. Qualified
citizens would be identified through existing tax relief rolls, and
would have to demonstrate a "need" for this program. The County
would assume no liability for this program other than acting as a
medium to put volunteers and qualified citizens in touch with one
another. (See attachment for detail of plan.)
ALTERNATIVES AND IMPACT•
#1 To offer leaf bagging to the elderly or disabled
citizens who are financially disadvantaged and to provide a
referral service to other citizens who may wish to contract this
service through the private sector.
This alternative would help the citizens who are the most in
need of this type of service without committing the County to a
program bigger than it can manage. It would maintain the County's
commitment and consistency in handling the elderly or disabled
citizens who are financially disadvantaged and would also provide
a listing of available professional services that would assist the
remaining citizenry in leaf removal. Costs would be minimal as
only rakes, gloves, and trash bags would be required.
#2. To privatize all leaf collection operations.
This alternative does not address the needs of Roanoke
County's elderly or disabled who are financially disadvantaged
citizens who may not be able to perform this task without help.
Leaves left on lawns creates an eyesore and damages the grass
underneath causing a deterioration of appearance in the
neighborhoods.

VOLUNTARY LEAF BAGGING FOR ELDERLY,
DISABLED, OR FINANCIALLY DISADVANTAGED CITIZENS
SCOPE: On a voluntary basis to bag leaves for elderly,
disabled, or financially deprived citizens who reside in Roanoke
County and who are unable to remove leaves from their homesites
during the months of November through January. In addition, staff
would mail, upon request, a listing of available professional
services that would assist the remaining residents in removing
leaves from their property.
OVERVIEW: Leaf collection for citizens of Roanoke County
who are either elderly or disabled and who are financially
disadvantaged could be accomplished by using volunteer groups who
are directed by a bagged leaf coordinator.
Qualified citizens could be easily identified by using the
Commissioner of Revenue's "Tax Relief" programs roll. The citizens
who qualify for tax relief fit the profile of the citizen we would
be trying to identify for leaf collection in as much as they must
be 65 years old or older, or disabled as certified by the Social
Security Administration, be of low income, etc.
Equipment needs would be minimal because the volunteers would
bag the leaves and let the refuse department collect them on their
normal leaf pick up schedule. Only rakes, work gloves, and plastic
bags would be needed by the work force.
A leaf collection sign-up prior to the leaf collection should
be done so that scheduling areas of collection could be done which
would prevent the work force from crisscrossing the County and
wasting time and fuel. Advanced scheduling of qualified citizens
would also keep refuse trucks from doubling back to pick up bagged
leaves after they have already picked up in an area.
Two groups must be "reached" so that the leaf collection
program is widely known.
1. The Volunteers. - Contacts with volunteer groups could
be done through public service announcements, newspaper articles,
League of Older Americans, County publications, and personal
contacts, etc.
2. The Oualified Citizen - The qualified citizen could be
reached most easily by a direct mail insert in the utility bills
mailed out monthly. However, this would reach only citizens who
are connected to County water or sewer lines. An article in the
Roanoke County Today publication would probably reach the most
citizens at the lowest cost. An application for this service could
be included in the article.

Leaves should be raked to the curb or edge of yard nearest to
the street as was done during the past when leaf vacuums removed
leaves. This will prevent work crews from being expected to pick
up leaves from large tracts of land and wooded areas. The purpose
of the program should be to help the qualified citizens to keep
their homesite presentable, so that they do not become an eyesore
in their neighborhood. This would help neighborhoods maintain
their property value and civic pride and help the qualified citizen
to maintain their dignity as homeowners. It would also allow
rural areas to be serviced in a uniform manner with urban areas,
thus helping to dispel the notion of unequal services throughout
the County.
The following are local groups and organizations that may like
to participate as volunteer labor in.this program:
American Association for Retired Persons
Boy Scouts of America - Blue Ridge Mountains Council
Green Thumbs, Inc. (Federally Funded Program)
Virginia Skyline Girl Scout Council
4-H Clubs
Civic Leagues
Of the above-mentioned organizations only Green Thumb, Inc.,
pays their workers, but funding is strictly their responsibility.
In order to implement this project by the 1991-92 leaf
collection season, we must act quickly in order that the transition
year from vacuum leaf service to bagged leaf collection causes as
little trauma to the public as possible.

BACKGROUND
In recent years efforts have been made nationwide to develop and
promote a program to provide beginning teachers with structured,
planned, and supportive entry into the teaching profession which
would ease the transition from university students to
accomplished teachers. The Virginia Department of Education has
actively solicited the input from local school divisions and has
initiated a mentor teacher program for beginning teachers.
During the 1991-92 school year 31 school divisions will receive
small grants to develop a variety of approaches to assisting
beginning teachers. These approaches will be shared with other
school divisions so the best practices may be replicated.
Additionally, VPI & SU has become involved in a model
professional development program to specifically assist
beginning vocational teachers on an individual basis and in group
activities. Included among the components are a professional
development center located within the local school division and a
local professional development coordinator.
SUMMARY OF INFORMATION:
For the 1991-92 school year, Roanoke County Schools has been
awarded a $9,925.20 grant from the Virginia Department of
Education to fund substitutes for teacher mentors assigned to the
beginning teachers, and to cover the costs of stipends and travel
for outside training personnel.
A grant of $32,300.00 has been received through VPI & SU to cover
salary and fringe benefit costs for the local professional
development coordinator who will work with beginning vocational
education teachers for 1991-92.

Revenue would be recorded to reflect $42,255.20 in the School
Operating Fund. Related expenditures would also be recorded.

RESOLUTION REQUESTING APPROPRIATIONS TO THE

WHEREAS, the County School Board of Roanoke County has
been awarded total grant funding of $42,225.20 as a participant

BE IT RESOLVED that the County School Board of Roanoke
County on motion of Barbara B. Chewning and duly seconded,
requests an appropriation of $42,255.20 to the 1991-92 School
Operating Fund for the following grants:

AGENDA ITEM: Approval of agreement with the Roanoke County
Resource Authority to provide for reimbursement of
staff expenses
COUNTY ADMINISTRATOR'S COMMENTS: '
EXECUTIVE SUMMARY
This agreement reimburses the County for all personnel costs
and expenses arising out of the creation of the Authority and the
County's on-going operational support of the Authority.
At the organizational meeting of the Authority held on July
25, 1989, and thereafter on September 12, 1989, a chief executive
officer, a secretary, a treasurer, an attorney, a financial
advisor, and a bond counsel were appointed.
Over the past two years, the County has contributed
significant financial and staff support to the Authority so that
the Authority can exercise all of its powers with respect to
permitting, designing, and constructing new solid waste facilities
for the Roanoke Valley.
SUMMARY OF INFORMATION:
This agreement reimburses the County for all fees, expenses,
and charges paid by it in support of the Authority over the past
two years. It ratifies and confirms the allocation of County
personnel to the Authority and the reimbursement of the County by
the Authority of these personnel costs and expenses and overhead
charges.
This agreement provides for the County to supply operational
staff support and personnel to the Authority, including
administrative, clerical, financial, engineering, and legal
services as required by the Authority. It designates the County
purchasing agent as the purchasing official for the Authority and

it incorporates by reference the County's procurement code (small
purchases procedures are amended to $15,000).
FISCAL IMPACTS•
ALTERNATIVES•
1. Approve the execution of the agreement between the Board
of Supervisors of Roanoke County, Virginia, and the Roanoke County
Resource Authority.
2. Do not provide financial and operational staff support to
the Authority and require the Authority to hire its own personnel
or to enter into contracts for these services with other political
jurisdictions.
3. Continue to provide financial and operational staff
support to the Authority, but do not seek reimbursement for County
expenditures for these purposes.
STAFF RECOMMENDATION:
Staff recommends that the Board authorize the Chairman to
execute the attached agreement on behalf of the County.

RESOLUTION 91091-6 PURSUANT TO §25-232.01 OF THE CODE OF
VIRGINIA, 1950 (AS AMENDED), AUTHORIZING THE ACQUISITION
OF A .412 -ACRE PARCEL OF LAND FROM MARY VIOLA BUSH FOR
THE BUSHDALE ROAD RURAL ADDITION PROJECT BY EMINENT
DOMAIN PROCEEDINGS
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That the Bushdale Road Rural Addition Project has been
approved for the purpose of making improvements in accordance with
state standards in order to have Bushdale Road accepted into the
state secondary road system by the Virginia Department of
Transportation.
2. That such improvements are necessary for the general
health, safety and welfare of the public, and specifically will
permit access for school, public safety, and emergency (police,
fire, and rescue) vehicles to the county residents on Bushdale
Road.
3. That acquisition of a certain parcel of land, consisting
of .412 acre, is necessary to relocate the initial portion of
Bushdale Road due to the narrow width of the existing Bushdale
Road, bordered on both sides by residences, and the inadequate
sight distance at its intersection with Mayfield Drive.
4. That the parcel of land required for this project is
owned by Mary Viola Bush and is more particularly described as
follows:
All that certain parcel of land, together with any
improvements thereon, rights incident thereto, and
appurtenances thereunto belonging, situate in the Vinton
Magisterial District of Roanoke County, Virginia, shown
and designated as 110.412 AC. BOUNDED BY CORNERS 1 THRU
10 TO 1 TO BE CONVEYED TO THE COUNTY OF ROANOKE" upon the
plat, dated January 31, 1991, made by T. P. Parker & Son,
attached hereto as Exhibit A. This being a portion of
the same real estate conveyed unto L. L. Bush, by deed
dated February 26, 1930, from John H. Gearhart, of record
in the Clerk's Office of the Circuit Court of Roanoke
County, Virginia, in Deed Book 195, Page 535. L. L. Bush
departed life on the 25th day of May, 1971, and the
subject property was devised unto the Grantor in his last
will and testament, of record in the aforesaid Clerk's
Office in Will Book 26, page 108. The above-described
parcel is a portion of the property designated on the
Roanoke County Land Records as Tax Map No. 79.03-05-80.
TOGETHER WITH a temporary construction easement of an
additional ten feet (101) on the north and east sides of
the parcel of land hereinabove described for use as a
temporary work space and to allow for necessary grading
during any phase of construction of the road and related
improvements.
5. That the fair market value of the aforesaid interest to
be acquired is $5,510.00, such compensation having been, and hereby
is offered the property owners.
6. That pursuant to the provisions of §25-232.01 of the Code
of Virginia, 1950 (as amended), the Board does hereby invoke all
and singular the rights, privileges, and provisions of said§25-
232.01 as to the vesting of powers in the County under the Virginia
General Condemnation Act (§25-46.1, et seg., of the Code of
Virginia, 1950, as amended).
7. That the County Administrator and the County Attorney are
hereby authorized to execute such documents and take such actions
as may be necessary to accomplish this acquisition pursuant to the
Virginia General Condemnation Act.

ORDINANCE 91091-7 AMENDING THE ROANOKE COUNTY
CODE BY AMENDING AND RE-ENACTING ARTICLE II,
VIRGINIA STATEWIDE FIRE PREVENTION CODE OF
CHAPTER 9, FIRE PREVENTION AND PROTECTION TO
INCORPORATE THE STATEWIDE FIRE PREVENTION CODE,
8TH EDITION, TO GRANT FIRE MARSHALS FULL POLICE
POWERS, AND TO STRENGTHEN THE POWER OF THE FIRE
MARSHALL IS OFFICE TO INVESTIGATE FIRE AND FIRE
RELATED OFFENSES
WHEREAS, by Ordinance 52388-13, the Board of Supervisors of
Roanoke County, Virginia, repealed the then current Articles II and
III of Chapter 9 of the Roanoke County Code, and enacted a new
Article II "Virginia Statewide Fire Prevention Code" of Chapter 9
of the Roanoke County Code and further amended the said "Virginia
Statewide Fire Prevention Code"; and
WHEREAS the Virginia Board of Housing and Community
Developments has adopted the eighth edition of the BOCA National
Fire Prevention Code, with amendments as the Virginia Statewide
Fire Prevention Code, effective as of April 15, 1991; and
WHEREAS, the State Fire Marshall is authorized to enforce the
Virginia Statewide Fire Prevention Code in those jurisdiction in
which the local governing body does not enforce the current code;
and,
WHEREAS, the first reading on this ordinance was held on
August 27, 1991; and the second reading was held on September 10,
1991.
BE IT ORDAINED by the Board of Supervisors of the County of
Roanoke, Virginia, as follows:

1. That Article II, "Virginia Statewide Fire Prevention
Code," of Chapter 9 of the Roanoke County Code is hereby amended
and re-enacted as follows:
Sec. 9-16. Incorporation of statewide fire prevention code.
Pursuant to the provisions of Section 27-98 of the Code of
Virginia, 1950, as amended, Roanoke County shall enforce the
Virginia Statewide Fire Prevention Code as written with amendments.

certain regulations and procedures to'accomplish the adoption and
enforcement of this Code. The Virginia Statewide Fire Prevention
Code is incorporated herein by reference as fully as if set out at
length herein. The regulation set forth herein shall be known as
the Fire Prevention Code of the County of Roanoke and shall be
referred to as such or as this code.
Sec. 9-21. Amendments.
The Virginia Statewide Fire Prevention Code is hereby amended
and changed pursuant to section 27-97 of the Code of Virginia in
the following respects:
(1) F-102.1. Enforcement officers Add the following at the
end of the existing subsection F.102.1:
The provision of the Virginia Statewide Fire Prevention
Code and this code shall be enforced by the office of the fire
marshall, also herein referred to as the fire marshal's
office, the fire marshall, members of the fire marshal's

structure, or premises until such evidence has been properly
processed.
2. This ordinance shall be effective from and after
September 10, 1991.

ON TUESDAY, SEPTEMBER 10, 1991
ORDINANCE 91091-8 FOR AUTHORIZATION TO ACQUIRE
A SANITARY SEWER EASEMENT FROM H. M. AND
LEARLEEN D. OBENCHAIN
WHEREAS, a permanent sanitary sewer easement across a tract
of land owned by H. M. Obenchain and Learleen D. Obenchain is
required in connection with the Roanoke River Sewer Interceptor
Phase III Project; and,
WHEREAS, staff has negotiated with the property owners for the
acquisition of said easement and the owners have declined any offer
of consideration less than $2,000.00;`and,
WHEREAS, Section 18.04 of the Roanoke County Charter directs
that the acquisition of real estate be accomplished by ordinance;
the first reading of this ordinance was held on August 27, 1991,
and the second reading was held on September 10, 1991.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF
ROANOKE COUNTY, VIRGINIA, as follows:
1. That the acquisition and acceptance of a permanent
sanitary sewer easement from H. M. and Learleen D. Obenchain, for
a sum not to exceed $2,000.00, is hereby authorized and approved;
and
2. That the consideration of $2000.00 shall be paid from the
funds previously appropriated by the Board of Supervisors to the
Utility Department budget for the Roanoke River Sewer Interceptor
Phase III Project; and,
3. That the County Administrator is hereby authorized to
execute such documents and take such actions as may be necessary
to accomplish this acquisition, all of which shall be on form
approved by the County Attorney.
On motion of Supervisor Johnson to adopt the resolution, and

APPLICATION FOR PERMIT TO CONDUCT RAFFLES OR BINGO
Application is hereby made for a bingo game or raffle permit.
This application is made subject to all County and State laws,
ordinances, rules, and regulations now in force, or that may be
enacted hereafter and which are hereby agreed to by the under-
signed applicant and which shall be deemed a condition under
which this permit is issued.
All applicants should exercise extreme care to ensure the accura-
cy of their responses to the following questions. Bingo games
and raffles are strictly regulated by Title 18.2-340.1 et. sec.
of the criminal statutes of the Virginia Code, and by Section
4-86 et. sec. of the Roanoke.County Code. These laws authorize
the County Board of Supervisors to conduct a reasonable investiga-
tion prior to granting a bingo or raffle permit. The Board has
sixty days from the filing of an application to grant or deny the
permit. The Board may deny, suspend, or revoke the permit of any
organization found not to be in strict compliance with county and
state law.
Any person violating county or state regulations concerning these
permits shall be guilty of a Class 1 misdemeanor. Any person who
uses any part of the gross receipts from bingo or raffles for any
purpose other than the lawful religious, charitable, community,
or educational purposes for which the organization is specifi-
cally organized, except for reasonable operating expenses, shall
be guilty of a Class 6 felony.

ordinances, rules, and regulations now in force, or that may be
enacted hereafter and which are hereby agreed to by the under-
signed applicant and which shall be deemed a condition under
which this permit is issued.
All applicants should exercise extreme care to ensure the accura-
cy of their responses to the following questions. Bingo games
and raffles are strictly regulated by Title 18.2-340.1 et. sec.
of the criminal statutes of the Virginia Code, and by Section
4-86 et. seq. of the Roanoke County Code. These laws authorize
the County Board of Supervisors to conduct a reasonable investiga-
tion prior to granting a bingo or raffle permit. The Board has
sixty days from the filing of an application to grant or deny the
permit. The Board may deny, suspend, or revoke the permit of any
organization found not to be in strict compliance with county and
state law.
Any person violating county or state regulations concerning these
permits shall be guilty of a Class 1 misdemeanor. Any person who
uses any part of the gross receipts from bingo or raffles for any
purpose other than the lawful religious, charitable, community,
or educational purposes for which the organization is specifi-
cally organized, except for reasonable operating expenses, shall
be guilty of a Class 6 felony.

not be conducted more frequently than two calendar days in any
calendar week?

340.6 of the Code of Virginia and §4.98 of Roanoke County Code

bingo supplies purchased, as well as the name and address of

invoice or receipt is also required for each purchase of in-
