HomeMy WebLinkAbout2/28/1989 - Adopted Board Records0 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE RONAOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, FEBRUARY 28, 1989 RESOLUTION 22889-1 EXPRESSING THE APPRECIATION OF THE POARD OF SUPERVISORS OF ROANOKE COUNTY TO ART WHITTAKER FOR OUTSTANDING CONTRIBUTIONS TO HIS COMMUNITY BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: WHEREAS, the service of Piedmont Airlines to the Roanoke Valley has been important to the residents and businesses of the area; and WHEREAS, Art Whittaker has worked for Piedmont Airlines since August 1948, and spent the last 22 years as Station Manager at the Roanoke Regional Airport; and WHEREAS, Art Whittaker has been responsible for the operation of Piedmont's airplanes in and out of Roanoke and has contributed greatly to the impressive efficiency and safety record of the company in the Roanoke Valley; and WHEREAS, Art Whittaker has been an active member of the Cave Spring community in which he resides and has benefited the citizens of Roanoke County by his involvement. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia, on behalf -of the -- citizens of Roanoke County, and on its own part, expresses appreciation to Art Whittaker for over 40 years of dedicated service to the citizens of the Roanoke Valley. FURTHER, the Board of Supervisors extends its best wishes for a happy, restful and productive retirement. Allen, Deputy Clerk Roanoke County Board of Supervisors cc: File Resolutions of Appreciation File 2 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, FEBRUARY 28, 1989 RESOLUTION 22889-2 APPROVING THE FISCAL YEAR 1989/90 OPERATING BUDGET FOR THE ROANOKE REGIONAL AIRPORT COMMISSION WHEREAS, Section 17 of the contract between the City of Roanoke and Roanoke County, Virginia, requires the Roanoke Region- al Airport Commission to prepare and submit its operating budget for the forthcoming fiscal year to the Board of Supervisors of the County and the City Council of the City prior to February 15 of each year; and WHEREAS, the Roanoke Regional Airport Commission trans- mitted its 1989-90 budget to the City of Roanoke and Roanoke County by letter dated February 14, 1989; and WHEREAS, the Roanoke Regional Airport Commission adopted its fiscal year 1989-90 annual operating budget at its February 14, 1989, meeting; and WHEREAS, it appears that estimated revenues shall once again exceed estimated expenses. NOW, THEREFORE it is hereby resolved by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the annual operating budget for fiscal year 1989-90 of the Roanoke Regional Airport Commission is hereby approved. 2. That the Deputy Clerk to the Board of Supervisors is hereby directed to forward a certified copy of this resolution to the Chairman of the Roanoke Regional Airport Commission, and to Jack Spain Jr., Esquire, Hunton & Williams, Richmond, Virgin- ia. Parker, Clerk, Roanoke City Council E ITEM NUMBER D--3 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: February 28, 1989 AGENDA ITEM: Request from the Registrar for an Appropriation of Funds for Primary Elections COUNTY ADMINISTRATOR'S, -`COMMENTS: BACKGROUND: The State Republican Party has called for a primary election to be held on Tuesday, June 13, 1989. Since this action was not anticipated during,the preparation of the 1988-89 fiscal year budget, it is necessary that we come to you, the Board of Supervisors, at this time requesting that $23,855.00 be appropriated to the Registrar's Office from the Unappropriated Balance. This appropriation will cover the cost of salaries for the election officials at each of the election poll sites, the cost of moving and setting up the voting machines, the cost of printed materials, the cost of handling absentee ballots, and any other costs associated with this special election. These estimates have been derived from the actual costs incurred during the primary election in March 1988, and have been scaled accordingly, since only one party is participating in this primary. None of these monies -are reimbursable by the State. ALTERNATIVES AND IMPACT: FISCAL IMPACT: STAFF RECOMMENDATION: Staff recommends that the appropriation in the amount of $23,855.00 be made from the Unappropriated Balance. NOW, THEREFORE, be it resolved by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. Allen, Deputy Clerk Roanoke County Board of Supervisors cc: File Paul Mahoney, County Attorney 2 _ - - ACTION # A-22889-5 ITEM NUMBER--I>-,S AT A REGftAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: February 28, 1989 AGENDA ITEM: Authorization to initiate a sanitary sewer project for the Highfields/Lakeland Road Area COUNTY ADMINISTRATOR'S COMMENTS: BACKGROUND• Sixteen residents that live along Highfields and Lakeland Road have petitioned Roanoke County to supply public sanitary sewer service under provisions of the County Code. A copy of the petition and a map of the area is attached. SUMMARY OF INFORMATION: It is requested that the Board of Supervisors establish a. special sewer service area as indicated on the attached map so that a special sewer connection fee for the area can be made. It is further requested that the Board of Supervisors authorize Staff to complete a sufficient engineering study to establish the cost of a sewer project to serve the special service area. Upon completion of this study, staff would notify the affected property owners of the proposed project and provide them with a service agreement. The agreement would include the not to exceed special sewer connection fee and state that the project was contingent upon final approval by the Board _of_Supervis_ors._ -_ - Depending on the number of residents executing agreements, the special sewer connection fee for public sewer service will be between $4,000.00 and $5,000.00 per lot. This sanitary sewer project would only serve the petitioned area and no County cost participation is planned. After receipt of agreements from the affected property owners, Staff will present a detailed report of the project for final approval by the Board of Supervisors._ _ 1)-.5 STAFF RECOMMENDATION: It is recommended that the Board of Supervisors authorize Staff to initiate this project and establish a special sewer service ar4ea as delineated on the attached map along with the special connection fee for this area. It is further recommended that Staff be authorized to send notice of the project and agreements for service 'to all property owners within the special service area in order that a commitment to the project can be made by the residents. During a preliminary concept design conducted by County staff, it was determined -that such a water system could be constructed along with an upgrade of- the existing. water system serving Old Hollins Road and the Ardmore area. The Old Hollins Road area has low-wat:er.pressure-that requires industries such as Ingersol Rand and AMP to construct their own storage and pumping in order to provide adequate fire protection. The Ardmore area along Garman Road is served by a well that has a very low quality water and also can not provide water for fire protection. SUMMARY OF INFORMATION: By developing a water project that will provide -full water ----- service to both the existing Old Hollins-RdAd/Ardmore.area , as well as the Hunters Trail/Olde Tavern Road area, the overall cost of the eventual system will be reduced. The estimated cost of this project is $368,000.00. Staff requests that the Board of Supervisors authorize this project contingent upon at least forty-six residents in the affected new service area signing an agreement to participate in and provide part of the financing of this project. Staff further requests that the Boa _rd__�f a -r _v1%'Qrr - - - establish a special water service area as 1ndie_a_ fid._ on -- h e -_:-: attached map which includes the properties along Shadwell Drive and in the Belleview Gardens and Belleview Estates subdivisions. -- 1 The purpose of this special water service area is to designate an area that will have a specific water connection fee assigned for a period of six years following the completion of the above-mentioned water project. It is proposed that a special water connection fee of $4,000.00 per equivalent residential connection be established for this area. The normal off-site facility fee of $1,036.00 is included within the special $4,000.00 and is credited against the cost of off-site construction as provided for in the water ordinances for those residents that execute agreements with the County within 90 days of Board final approval of the project. They would be required to pay $500.00 of the $4,000.00 connection fee within 90 days of the Board's final approval of this project. The remaining $3,500.00 could be paid at the same time or the County would finance the $3,500.00 at 7 1/2% for a period not to exceed six years. Any other water connections made within this special service area during its six year period of existence would be required to pay the $4,000.00 special water connection fee plus the normal off-site facility and basic connection fee. No credit would be made nor would any of the fee be financed by the County. For example, a normal residential water connection made within this special service area at the current rate would be $5,536.00 for`` those connections not signing an agreement with the -County-within -- the 90 days of Board final approval for this project. -- - - - After receipt .of agreements from the affected property owners, Staff will present a detailed report of the project=for final approval by the Board of Supervisors, along withanordinance to effect this project. STAFF RECOMMENDATION: It is recommeded the Board of Supervisors authorize Staff to initiate this project and establish a special water service area as delineated on the attached map along with the special connection fee for this area. ' VICINITY MAP � � -- r. -Q- NORTH COMMUNITY SERVICES ROAD AREA AND DEVELOPMENT_. - 4 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, FEBRUARY 28, 1989 RESOLUTION 22889-7 AUTHORIZING THE ISSUANCE AND SALE OF THE COUNTY OF ROANOKE, VIRGINIA, REVENUE ANTICIPATION NOTES, SERIES 1989A IN THE AMOUNT $9,000,00x:•. r BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: WHEREAS, the Board of Supervisors ("Board") of the County of Roanoke, Virginia ("County") adopted a resolution on February 14, 1989, authorizing the County to borrow not to exceed $17,000,000 and issue its revenue anticipation notes therefor; WHEREAS, the Board has determined that it is necessary and expedient to borrow $9,000,000 and to issue its Revenue Anticipation Notes, Series 1989A therefor ("Notes") to meet casual cash flow deficits of the County; and WHEREAS, bids have been taken for the purchase of the Notes, and the County desires to specify the form and details of the Notes and to award the Notes to the bidder whose proposal results in the lowest interest cost to the County. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Roanoke, Virginia: 1. The Board of the County determines that it is advisable to contract a debt and issue and sell the Notes in an aggregate principal amount of $9,000,000. The issuance and sale of the Notes are authorized. The proceeds from the sale of the Notes shall be used to meet casual cash flow deficits of the County. 2. The Notes shall be issued in bearer form, without privilege of registration and without coupons, in substantially the form attached as Exhibit A. The Notes shall be dated as of the date of their issuance and delivery, shall be issued in denominations of $25�;-000 shall be numbered N-1 and upward, sequentially, shall bear interest at the annual rate of 6.98% payable at maturity, and shall mature on June 15, 1989. The Notes shall not be subject to payment or redemption before maturity. 3. The County Administrator and Treasurer of the County are hereby authorized and directed to execute the Notes, and the Treasurer is hereby authorized to affix or imprint the seal of the County on the Notes. The form of execution, imprinting of the seal and attestation may be by facsimile; provided, however, if the signatures of the County Administrator and Treasurer are both by facsimile, the Notes shall not be valid until authenticated by the manual signature of the Paying Agent. In case any officer whose signature or a facsimile of whose signature shall appear on any Note shall cease to be such officer before the delivery of the Notes, such signature or such facsimile shall nevertheless be valid and sufficient for all purposes the same as if he or she had remained in office until such delivery. Any Note may bear the facsimile signature of or may be signed by such persons as at the actual time of its execution are the proper officers to sign such Note al though at the date of delivery of such Note such persons may not have been such officers. Upon receipt of payment therefor, the Treasurer 2 of the County or such agent as may be designated, shall issue and deliver the Notes to the purchaser or purchasers thereof. The officers and agents of the County are further authorized and t directed to do all acts required by the Notes and by this Resolution for the fulY, punctual and complete performance of all things necessary for this borrowing. 4. Crestar Bank, Richmond, Virginia is appointed as Paying Agents for the Notes. The principal of and interest on the Notes shall be payable in lawful money of the United States upon surrender of the Notes on the maturity date at the principal corporate trust office of the Paying Agent in Richmond, Virginia. 5. The Board agrees on behalf of the County that the proceeds from the issuance and sale of the Notes will be invested and expended as set forth in the Non -Arbitrage Certificate of the County to be delivered at the time of the issuance and delivery of the Notes and -that the County will comply with the covenants and representations contained therein. Further, the County shall comply with the reporting requirements of Section 149(e) of the Internal Revenue Code of 1986, as amended. 6. The Board determines that it is in the best interest of the County to accept the bid of Central Fidelity Bank to purchase the Notes and such bid is accepted. 7. The officers and agents of the County are authorized and directed to take such further action as may be necessary or convenient in connection with the issuance, sale and delivery of the Notes and all actions previously taken by such 3 officers and agents in connection therewith are ratified and confirmed. 8. The Offering Circular with respect to the sale of k the Notes is hereby approved in substantially the form submitted at this meeting and :the County Administrator is authorized to execute and deliver the Offering Circular with such changes, additions and deletions as he deems appropriate. 9. The appropriate officers and agents of the County are authorized and directed to immediately cause a certified copy of this Resolution, setting forth the form and details of the Notes, to be filed with the Circuit Court of the County pursuant to Sections 15.1-199 and 15.1-212 of the Code of Virginia of 1950, as amended. 10. This Resolution shall take effect immediately. NIURY ACTION NUMBER A-22889-9 ITEM NUMBER IV— I AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER t MEETING DATE: February 28, 1989 SUBJECT: Receipt of Consultant's Report on Landfill Siting and Request to Proceed with Part A Application Process COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: The search for a new landfill site for the Roanoke Valley began more than a year ago. Since that time, staff and the landfill consultant, Olver, Incorporated, have evaluated more than fifty sites and have identified the six most feasible for your considera- tion. Attached is a report from Olver, Incorporated ranking the top six sites. Following a report to the Board by the consultant, staff will request permission to forward to the State two of these sites for Part A reviews. After careful review of the consultant's work, visits to each site, and work sessions with the Board, I recommend proceeding with the first two sites, Bradshaw and Boones Chapel. It should be understood that all six sites have potential if the _Board wishes to choose others. Each Part A application _will__cnst_ approximately $46,000, so it is not advisable to submit all six at one time. The two top sites are recommended because they have the best socio -technical characteristics. The Bradshaw site, with a matrix score of 291, is clearly the best location, as indicated by the consultant's report. It consistently scored the highest points with all of the evaluation methods. It has the proper soil conditions, impacts the fewest homes, and has a 60 -year expected life. At this time, we feel certain that an access road can be constructed from the Dixie Caverns exit of I-81, so that landfill vehicles will not use Bradshaw Road. The cost of constructing the access road will be less than upgrading existing roads to industrial standards and will reduce travel time for refuse vehicles. The second site recommended for the Part A review is Boones Chapel with a matrix score of 214. Although staff expects the Bradshaw site to be Permitted by the State, a second one should be submitted for concurrent review in the event that it is not. The Boones Chapel site was ranked second by the consultant - because it has an expected 25 -year life and meets the established criteria If chosen, electricity will have to be extended to the area and roads.. will have to be improved. Otherwise, this is -a convenient,------- - technically suitable alternative to the Bradshaw site. -2 - The Buck Mountain site, which has a matrix score of 224, would have been second in the ranking. However, due to a projected life of only 15 years, I have eliminated it from consideration. Of the remaining sites, Mount Pleasant, with a matrix score of 210, and Fort Lewis, 201, are so close that I cannot recommend one over the other as a third choice., to send for Part A review. Red Hill received the lowest score -of these six, which was 158. Based on the above,- staff prefers to withhold consideration of these sites, pending State review of Bradshaw and Boones Chapel. Because the top two sites are technically and socially acceptable, and because submitting Part A applications is expensive, it makes more sense to reserve the remaining four sites for future use if necessary. Having worked closely with the staff and the consultant, I believe we have achieved the balance required by the Board. Throughout the process, you have stressed the need to locate a new landfill that is technically sound, feasible to construct and operate, while at the same time minimizing the impact on the communities. The Bradshaw site in particular is an excellent site and will provide suitable landfill space for the County and our neighbors for many years. Vinton, Roanoke City, and Salem have expressed an interest in participating, so it is important that we find a site large enough to include them. While the State performs Part A reviews, the County should conclude the contractual arrange- ments with these localities. The Roanoke Valley should also continue pursuing the possibility of constructing an additional landfill with Bedford County as well as increase regional recycling efforts. This would benefit all the jurisdictions by extending landfill life and reducing transportation costs. In conclusion, I would like to commend the Citizens Landfill Advisory Committee, John Olver and his staff, and John Hubbard for the thorough and compassionate way they have approached this most difficult task. We regret any disruption to the neighborhoods of the County and commend the Board for the emphasis on compensating those affected.
