RESOLUTION 12187-1 REQUESTING
RECREATIONAL AREA ACCESS ROAD FUNDS FROM
THE VIRGINIA DEPARTMENT OF TRANSPORTATION
TO PROVIDE ACCESS TO THE EXPLORE PROJECT
(THE RIVER FOUNDATION) TO BE LOCATED IN
ROANOKE COUNTY
WHEREAS, the Explore Project is to be developed by The
River Foundation as a recreational facility serving the residents
of Roanoke County and adjoining counties; and
and
WHEREAS, the facility is in need of adequate access;
WHEREAS, the right-of-way of the proposed access is
provided by The River Foundation at no cost to the State; and
WHEREAS, the procedure governing the allocation of re-
creational access funds as set forth in Section 33.1-223, Code of
Virginia 1950, as amended, requires joint action by the Director
of Conservation and Historic Resources and the Highway and Trans-
portation Board; and
WHEREAS, a statement of policy agreed upon between the
said Director and the Board approves the use of such funds for
the construction of access roads to publicly owned recreational
areas and historical sites; and
WHEREAS, the Board of Supervisors of Roanoke County has
duly adopted a zoning ordinance pursuant to Article 8 (Section
15.1-486, et seq.), Chapter 11, Title 15.1; and
WHEREAS, it appears to the Board that all requirements
of the law have been met to permit the Director of Conservation
and Historic Resources to designate Explore Project as a recrea-

tional facility or historical site and further permit the Virgin -
is Transportation Board to provide funds for access to this pub-
lic recreational area in accordance with Section 33.1-223, Code
of Virginia 1950, as amended; and
WHEREAS, the Board acknowledges that pursuant to the
provisions of Section 33.1-62, as amended, this road shall be
designated a "Virginia Byway" and recommends the State Highway
and Transportation Board, in cooperation with the Director of
Conservation and Historic Resources, take the appropriate action
to implement this designation. Further, the Board agrees, that
in keeping with the intent of Section 33.1-63, to reasonably pro-
tect the aesthetic or cultural value of this road.
NOW, THEREFORE, BE IT RESOLVED that the Board of Super-
visors of Roanoke County hereby requests the Director of Conserva-
tion and Historic Resources to designate the Explore Project as a
public recreational area and to recommend to the State Highway
and Transportation Board that recreational access funds be allo-
cated for an access road to serve said park; and
BE IT FURTHER RESOLVED that the Virginia Transportation
Board is hereby requested to allocate the necessary recreational
access funds to provide a suitable access road as hereinbefore
described.

SUBJECT: Authorization to Proceed with South Park
Circle Willowlawn Road and Sun Valley/Palm Valley Drainage
Projects
COUNTY ADMINISTRATOR'S COMMENTS•
SUMMARY OF INFORMATION:
In July, the Roanoke County Board of Supervisors approved funding
for drainage improvements in Sun Valley and South Park. The
funding was with the understanding that the residents in the two
(2) areas would donate easements allowing the installation of
various facilities.
For your review and direction, we have described each phase of
both projects with bid prices and status.
A. Sun Valley/Palm Valley ($55,526):
1. Provides a 15 inch concrete storm sewer to drain the
sinkhole adjacent to Return Road (Bid Price: $14,526);
we have received commitments from all property owners
for necessary easements. This project has been
authorized by Staff.
2. Improve the outlet channel for the 60 inch storm sewer
originating from Roanoke City. (Bid Price: $41,000);
At the Board's direction, staff has contacted Roanoke
City about participating in the cost of improving the
concrete flume. Staff has and is continuing to
discuss with Roanoke City cost participation on the
project.
3. Use the Roanoke County Drainage Crew to clean debris
from the banks of Carvins' Creek (Bid Price: n/a); The
County Crew is working in this area.

B. South Park/Willowlawn ($39,579):
1. Replace the existing 15 inch culvert from South Park
Circle to Mudlick Creek with a 54 inch culvert and
enlarge the existing roadside ditch upstream from the
culvert. (Bid Price: $32,570); During our negotiations
with property owners along the roadside ditch, we found
out that we would have sanitary sewer lateral
conflicts if we were to enlarge the ditch. Based on
this information, we have modified the project to
consist of replacing the existing culvert with a 42
inch concrete culvert. All adjoining property owners
have committed to the necessary easements.
2. Provide a paved ditch from Willowlawn Road to the
existing drainageway adjacent to South Park Circle.
(Bid Price: $7,000); The county staff continues to
negotiate with adjacent property owners as to a final
location for the paved ditch.
3. Use the Roanoke County Drainage Crew to clean debris
from the Bank of Mudlick Creek (Bid Price: n/a); the
County Crew is scheduled to begin work at the
conclusion of their work on Carvins Creek.
FISCAL IMPACT:
Funding for these projects are included in the current drainage
budget.
RECOMMENDATION:
Staff recommends that the Board of Supervisors authorize
proceeding with these projects as outlined above.

MEETING DATE: December 1, 1987
SUBJECT: Status and Recommendations concerning FY 87-88 Drainage
Improvements
COUNTY ADMINISTRATOR'S COMMENTS•
SUMMARY OF INFORMATION:
On July 28, 1987, the Board of Supervisors approved a priority
list consisting of seven (7) projects for the Roanoke County
Drainage Crew. To date, the crew has completed five (5) of the
seven (7) projects (See Attachment A). The two (2) remaining
projects (cleaning streambanks in the vicinity of South Park
Circle and Palm Valley Road) have been started but could take one
(1) additional month to complete.
Since July, staff as directed by the County Administrator
contracted with Rockbridge Excavating Company to improve a
drainageway near the Fort Lewis Fire Station. In addition, staff
has included drainage improvements along Cove Road and Burnt
Quarter Circle in the preliminary Secondary Highway Six Year
Construction Plan. All of the drainage projects, including
these two, which will be completed using Secondary Highway
Funding are shown on Attachment B.
Staff is preparing an overall project listing based on the
Community Meetings and the Drainage Complaint Process. In
January, staff will make a presentation to identify these
projects, and will recommend funding alternatives.
Even though the drainage crew has two (2) activities scheduled
for the next month, approval of additional projects is needed
from the Board. Several weeks are generally required for
preliminary engineering and acquiring easements in advance of the
drainage crew. Therefore, we recommend that the Board approve
the projects shown on the attached priority list (See Attachment
C.

FISCAL IMPACT:
Funding for the maintenance projects is in the approved Drainage
Budget for F.Y. 87-88.
RECOMMENDATION:
Staff recommends that the Board approve the attached priority
list (Attachment C).

SUMMARY OF INFORMATION:
The Board previously authorized staff to negotiate an agreement
with Lingerfelt Development for the Valleypointe project with
County participation. A preliminary agreement was prepared at the
time of the rezoning of the Harris-Moomaw properties, which sets
forth the extent of County participation and is attached for your
information.
The project document was prepared for the development of Phase I
and II. Roanoke County's financial participation is as follows:

RESOLUTION 12187-5 REQUESTING INDUSTRIAL
ACCESS FUNDS FROM THE VIRGINIA DEPARTMENT
OF TRANSPORTATION TO PROVIDE ACCESS TO A
NEW PROJECT TO BE LOCATED IN ROANOKE
COUNTY
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That having duly considered the request and
assurances of Lingerfelt Development, Inc. concerning the
proposed development of Valleypointe, Phase I, the Board
respectfully urges and recommends to the Virginia Department of
Transportation that consideration be given, that immediate study
be made, and that a project be approved and initiated pursuant to
the provisions of Section 33.1-221 of the 1950 Code of Virginia,
as amended, to provide approximately 3,400 feet of needed
industrial access road improvements from State Route 117 (Peters
Creek Road) to Valleypointe, Phase I, to serve this 52 acre site
situated in Roanoke County; and
2. That Roanoke County guarantees any expense of
acquisition of all necessary right-of-way and the vesting thereof
in the public agency, and does further guarantee any adjustment
of utility expenses necessary for the project, and does hereby
assure the Virginia Department of Transportation that such
Department shall incur no expense for such items nor for any
preliminary engineering or plan development should the industry
fail to locate at the proposed site; and
3. That Roanoke County requests available industrial
access funds of $171,500 and matching funds from the Virginia
Department of Transportation of $150,000. The County shall
provide a local matching contribution of $150,000 to provide for
the maximum allocation of industrial access funds and shall
provide an additional $36,047 for additional road improvements.
The County shall bond the State's cost for this industrial access
road to guarantee compliance.
4. That the Clerk of this Board forthwith transmit
certified copies of this resolution together with any necessary
appropriate supporting data to the Virginia Department of
Transportation.

RESOLUTION 12187-6 REQUESTING THE
GENERAL ASSEMBLY FOR THE COMMONWEALTH
OF VIRGINIA TO AMEND THE CHARTER FOR
ROANOKE COUNTY
WHEREAS, Article VII, Section 2 of the Constitution of
Virginia, and Chapter 17 of Title 15.1 of the Code of Virginia
authorizes the General Assembly to grant a governmental charter
to a county or to amend an existing charter; and
WHEREAS, the 1986 General Assembly granted Roanoke
County a charter, as found in the 1986 Acts of Assembly, Chapter
617; and
WHEREAS, the Roanoke County Board of Supervisors finds
that certain amendments thereto are necessary for the public
health, safety, and welfare of the County, and for more efficient
and effective local government; and
WHEREAS, Roanoke County has complied with the provi-
sions of Section 15.1-835 of the Code of Virginia, and has held a
public hearing on these proposed charter amendments on November
17, 1987, after due legal notice, at which the citizens had the
opportunity to be heard concerning these proposed charter amend-
ments.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervi-
sors of Roanoke County, Virginia, that the General Assembly for
the Commonwealth of Virginia is hereby requested to amend the
charter for Roanoke County, Virginia. The requested charter
amendments are as follows:
1. Amend Section 2.02 to authorize a meals tax and a tobac-
co tax as limited by State law;
2. Amend Chapter 8 to create a new Section 8.03 to autho-
rize the creation of the office of license inspections, which
would authorize the enforcement of the County license ordinance
through the issuance of tickets or summons by officials in the
office of the Commissioner of the Revenue;
3. Amend Section 9.03 to authorize the appointment of mem-
bers of the Board of Zoning Appeals by the Board of Supervisors.
These charter amendments are attached hereto and incorporated
herein by reference for submission as a bill for consideration by
the General Assembly.

SUBJECT: 1988 Legislative Program
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
The Board of Supervisors considered its legislative programs
and suggestions for the 1988 session of the Virginia General
Assembly at its work session on November 17, 1987. It is sug-
gested that the Board consider addressing significant issues of
statewide impact through the Virginia Association of Counties and
Virginia Municipal League, specific issues of interest through
general law amendments, and specific, unique issues of interest
to Roanoke County through Charter amendments.
(1) The Board discussed responding to the significant state-
wide issues through VACo and VML:
(a) The recommendation of the Commission on Local Gov-
ernment Structures;
(b) COT -21 alternatives to enable local governments to
address transportation related problems (e.g. im-
pact fees on developers, off-site improvements,
transportation districts, airport funding);
(c) Funding needs of constitutional officers;
(d) JLARC recommendations concerning the formula for
distributing state funds to localities for educa-
tion.
(e) 1/2(� local option sales tax
(f) funding needs for parks and other recreational
purposes
(2) The Board discussed responding to specific issues of
interest through general law amendments or the appropriation leg-
islation:
(a) State funding for the EXPLORE Project, and expand
the Board of Directors for the River Foundation to
include elected local officials.
(b) Amend Section 46.1-267 to allow refuse collection
trucks to be equipped with flashing, blinking or
alternating combination emergency lights.
(c) Amend Section 42.1-70 to allow an increase in the
law library fee from $2.00 to $3.00.
(d) Support Roanoke City's request for State funding
for a convention center.
(3) The Board considered amending the Charter (the required
public hearing following a 10 day notice publication before the
County may submit a request to the General Assembly for a charter
amendment was held on November 17, 1987) to address specific,
unique issues of interest to Roanoke County:
(a) Amend Section 2.02 "Taxing Powers" to provide au-
thority for the Board to levy a tax on meals and
tobacco.
(b) Amend Chapter 8 to create a new Section 8.03 to
authorize the creation of the office of license
inspections, which would authorize the enforcement
of the County license ordinance through the issu-
ance of tickets or summons by officials in the
office of the Commissioner of the Revenue.
(c) Amend Section 9.03 to authorize the appointment of
members of the Board of Zoning Appeals by the
Board of Supervisors of Roanoke County.
RECOMMENDATION:
The Board should adopt and approve this legislative program
for the 1988 session of the General Assembly.

RESOLUTION 12187-8 APPROPRIATING ROANOKE
COUNTY'S SHARE OF CURB AND GUTTER
CONSTRUCTION COSTS FOR STARKEY ROAD
(ROUTE 904) PROJECT
WHEREAS, Starkey Road Project (Route 904) provides an
important urban highway link to commercial property in Roanoke
County; and the Roanoke County Board of Supervisors desires to
improve this commercial link; and
WHEREAS, Route 904 was placed on the Secondary Highway
Six -Year Construction Plan by the Roanoke County Board of Supervi-
sors and was assigned a project number of 0904-080-215-0501, by
the Virginia Department of Transportation; and
WHEREAS, Virginia Department of Transportation Policy
Memorandum DPM -8-6 requires participation by localities for por-
tions of storm sewer construction costs if curb and gutter "is
desired" and for sidewalk rights-of-way; and
WHEREAS, the Virginia Department of Transportation has
determined that the Roanoke County Board of Supervisors is respon-
sible for $72,300 for its portion of storm sewer construction,
and $89,500 for its portion of sidewalk rights-of-way on Project
0904-080-215-0501.
NOW, THEREFORE, BE IT RESOLVED that the Roanoke County
Board of Supervisors appropriate the sum of $72,300 for its share
of the construction costs; agree to the no -cost option for storm
sewer outfalls; and elect not to participate in acquisition of
rights-of-way for sidewalks for the Starkey Road Project
0904-080-215-0501.

SUBJECT: Authorization to Relocate the Registrar's Office and
Central Absentee Voting Precinct to the Administration

SUMMARY OF INFORMATION:
The County Registrar's office and Electoral Board are in need of
additional space and wishes to relocate from the present offices
nearer the Treasurer, Commissioner of Revenue and other offices
dealing directly with the public in the Administration Center.
The present location is somewhat remote and not easily accessible
to the handicapped. It will also be necessary to move the
Central Absentee Voting Precinct to this building. Staff has
determined that this request can be accomplished by the
relocation of several offices in this building. The most likely
approach will be to move the Engineering Department to the Public
Service Center on Kessler Mill Road, and relocate either the
Accounting Department or Assessor's Office to the area vacated by
Engineering.

ORDINANCE 12187-10 AUTHORIZING THE
ACCEPTANCE OF A DONATION OF A SMALL
PLOT OF REAL ESTATE ON ROUTE 311 FROM
THE COUNTY SCHOOL BOARD OF ROANOKE
COUNTY TO THE BOARD OF SUPERVISORS OF
ROANOKE COUNTY
WHEREAS, pursuant to Section 22.1-129 of the Code of
Virginia, the County School Board of Roanoke County has declared
the subject property to be surplus on October 8, 1987; and
WHEREAS, pursuant to the provisions of Section 18.04 of
the Charter of Roanoke County, a first reading concerning the
acceptance of the hereinafter -described real estate was held on
November 17, 1987. A second reading on this matter was held on
Decmeber 1, 1987. This real estate is located on Route 311 and
is more particularly described as Tax Map No. 7.00-1-73.1.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervi-
sors of Roanoke County, Virginia, as follows:
1. That the donation of a small plot of real estate
located on Route 311 in Catawba, Tax Map No. 7.00-1-73.1, from
the County School Board of Roanoke County to the Board of Supervi-
sors of Roanoke County be, and hereby is, accepted; and
2. That the County Administrator is authorized to exe-
cute such documents and take such actions on behalf of Roanoke
County as are necessary to accomplish the acceptance of this pro-
perty, all of which shall be upon form approved by the County
Attorney.
3. That all proceeds from any future sale of this real
estate are to be allocated to the capital reserves of the County.
On motion of Supervisor Johnson, seconded by Supervisor
Nickens, and upon the following recorded vote:
AYES: Supervisors Brittle, Garrett, Nickens, Johnson

Consent Agenda be, and hereby is, approved and concurred in as to
each item separately set forth in said section designated Items 1
through 2, inclusive, as follows:
1. Request for a Bingo Permit from the Vinton Moose
Lodge #1121, Inc.
2. Acceptance of water and sewer facilities serving in
Beacon Ridge, Section 1.

SUBJECT: Acceptance of water and sewer facilities serving in
Beacon Ridge, Section 1
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
The developer of Beacon Ridge, Section 1, Fralin & Waldron,
Inc., has requested that Roanoke County accept the deed conveying
the water and sewer lines serving the subdivision along with all
necessary easements.
The water and sewer lines are installed as shown on
engineering plans prepared by Buford Lumsden & Associates
entitled Plans for Section 1, Beacon Ridge dated July 20, 1983,
which are on file in the Public Facilities Department. The water
and sewer line construction meets the specifications and the
plans approved by the County.
�i/ FISCAL IMPACT:
The values of the water and sewer construction are $25,000
and $33,000 respectively.
RECOMMENDATION:
The staff recommends that the Board of Supervisors accept
the water and sewer facilities serving the subdivision along with
all necessary easements, and authorize the County Administrator
to execute a Deed for the transfer of these facilities.
