RESOLUTION 32288-1 OF APPRECIATION TO
JACK C. SMITH UPON HIS RETIREMENT AS
EXECUTIVE VICE PRESIDENT OF THE ROANOKE
VALLEY CHAMBER OF COMMERCE
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
WHEREAS, Jack C. Smith has served with distinction as
Executive Vice President of the Roanoke Valley Chamber of
Commerce since 1960, and
WHEREAS, during that time he has played a prominent
role in the economic development of the entire valley through his
activities in the Roanoke Valley Development Corporation, the
Greater Roanoke Valley Development Foundation, and serving as an
officer in the Airport Advisory Commission, the Virginia
Association of Chamber of Commerce Executives, and Chairman of
the Industrial Development Authority for the City of Roanoke, and
WHEREAS, he was also instrumental in providing
outstanding cultural and social enrichment for valley citizens
through his involvement with the founding of the Mill Mountain
Theatre, Valley Beautiful, the Miss Virginia and Miss America
Pageants, and the Virginia Independence Bicentennial Commission,
and
WHEREAS, Mr. Smith has promoted the Roanoke Valley in
every possible manner for almost thirty years and has served the
citizens of the valley in a unique and special way.
THEREFORE, BE IT RESOLVED that the Board of Supervisors
of Roanoke County, Virginia wishes to express its deepest
appreciation and the appreciation of the citizens to Jack C.
Smith for his many years of capable, loyal and dedicated services
to the citizens of the Roanoke Valley; and
FURTHER, the Board of Supervisors does express its best
wishes for a happy, restful and productive retirement.

RESOLUTION 32288-2 ENDORSING THE CONCEPT
OF FAIR HOUSING WITHIN THE COUNTY OF ROANOKE
WHEREAS, the Board of Supervisors of Roanoke County, Vir-
ginia wishes to ensure equal opportunity to all persons residing
in the County of Roanoke to live in decent housing facilities,
and
WHEREAS, discrimination on the basis of race, color, reli-
gion, ancestry, national origin, sex, place of birth, age or
handicap in connection with the sale, purchase, leasing, or
financing of housing facilities is unlawful in Virginia.
NOW, THEREFORE, BE IT RESOLVED that the Roanoke County Board
of Supervisors endorses the concept of fair housing within the
County of Roanoke.

FIRST VIRGINIA BANK FOR BANK SERVICES FOR
ROANOKE COUNTY FOR A THREE YEAR PERIOD BEGINNING
JULY 1, 1988
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That that certain proposal from First Virginia Bank
for bank services for Roanoke County, upon all and singular the
terms and conditions of the invitation to bid, the specifications
of the County of Roanoke, the bidder's proposals, and the
provisions of this resolution, be, and same hereby is, ACCEPTED;
and
2. That the County Administrator is hereby authorized
and directed to execute the necessary documents on behalf of
Roanoke County, all to be upon form approved by the County
Attorney; and
3. That all other proposals for this service are hereby
rejected and the Clerk is directed to so notify such bidders and
express the County's appreciation for the submission of their
proposals.

SUBJECT: Claim of J. Kay Parr
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
Edward A. Natt, Esq., attorney for J. Kay Parr, has filed a
claim on her behalf with the Board of Supervisors pursuant to
Section 15.1-547, et seq., 1950 Code of Virginia, as amended.
The claim is for annual and sick leave benefits in the form of
three weeks salary for the period she was on leave from her job
with the Roanoke County Sheriff's Department as the result of the
adoption of an infant child.
J. Kay Parr, a dispatcher with the Roanoke County Sheriff's
Department applied to use a portion of her accumulated sick or
annual leave in connection with the adoption of an infant child.
The Employee Handbook does not provide for the use of sick leave
for adoption and her request was denied.
Mrs. Parr has retained an attorney and legal action is con-
templated. A determination by the Board of Supervisors is a
necessary legal step in her efforts to be reimbursed for three
weeks salary.
FISCAL IMPACT:
$997.05
RECOMMENDATION:
Staff recommends that the claim be denied. The Employee
Handbook specifies the conditions or justifications for use of
sick leave; adoption is not included as one of those. Nor does
the section concerning Absences for Maternity provide for this
situation.

SUBJECT: Right -of -Way and Easement Acquisition for Utility
Projects
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
It is requested that the staff be authorized to acquire the
necessary right-of-ways and easements for the following utility
projects along with the estimated completion dates:
1. Valleypointe sewer Phase II (July 1990);
2. Valleypointe water Phase II (July 1990);
3. Glade Creek Interceptor Sub -Main Phase II (January 1989);
4. Roanoke River Interceptor Sub -Main to Route 460/11
(June 1989);
5. Sewer sub -Main from the existing sewer to I-81 at
Hanging Rock including I-81 crossing (January 1989);
6. Sewer line extension from Kingston Court to lands
adjoining Nichols Estates (February 1989);
7. Water line extension from Big Hill water line to
Broadview Subdivision (June 1988);
FISCAL IMPACT:
No funds will be required for donations or dedications;
however, in the event of an acquisition of a right-of-way or
easement, funds are available in the utility project funding.

RECOMMENDATION:
Staff recommends that the Board of Supervisors authorize
staff to negotiate for the acquisition of the necessary
right-of-ways or easements for the above projects.
Pursuant to Ordinance No. 102787-4 adopted on October 27,
1987, the Board authorized the County Administrator to accept
donations or dedications of any noncontroversial real estate
matters.
Any acquisitions of a right-of-way or an easement for a
substantial consideration shall be submitted to the Board for the
adoption of an ordinance upon a first and second reading pursuant
to Section 18.04 of the Roanoke County Charter.

SUBJECT: Acceptance of water and sewer facilities serving
Woodbridge, Section 9
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
The developer of Woodbridge, Section 9, Westclub Corporation
has requested that Roanoke County accept the deed conveying the
water and sewer lines serving the project along with all
necessary easements.
The water and sewer lines are installed as shown on as -built
plans prepared by T. P. Parker and Son entitled Woodbridge
Section 9 dated January 25, 1988, which are on file in the Public
Facilities Department. The water and sewer line construction
meets the specifications and the plans approved by the County.
FISCAL IMPACT:
The values of the water and sewer construction are
$25,236.00 and $40,213.00 respectively.
RECOMMENDATION:
The staff recommends that the Board of Supervisors accept
the water and sewer facilities serving the subdivision along with
all necessary easements, and authorize the County Administrator
to execute a Deed for the transfer of these facilities.

SUMMARY OF INFORMATION:
The Board of Supervisors recently adopted resolutions requesting
that the Department of Transportation accept the following roads
into the Secondary System.
a. Resolution dated January 12, 1988 requesting 0.12 miles
of Snowgoose Circle (Route 1779)
b. Resolution dated June 9, 1987 requesting 0.26 miles of
Hollyberry Road (Route 1765)
C. Resolution dated November 17, 1987 requesting 0.17 of

SUBJECT: Off -Site Facility Fee Credit for Peters Creek Office Complex
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
The developer of the Peters Creek Office Complex, Mr. Jyke Jones,
has requested that the Board of Supervisors authorize the credit of
the second half of the off-site facility fee.
Mr. Jones is extending an 8 inch water line along Peters Creek
Road to provide service for this commercial development. He will be
responsible for the full cost of the first 300 feet of the extension
with the remaining amount being eligible for credit against the
off-site facility fees. The Utility Director will credit one-half of
the fee, $2,362 toward the eligible costs. With the Board of
Supervisors approval, the remaining $2,362 will be credited against
the construction cost for this water line. The total cost for this
extension is estimated to be $9,000.
FISCAL IMPACT:
Approval of this request will reduce the funds received by the
Utility fund by $2,362.
RECOMMENDATION:
Staff recommends that the Board of Supervisors approve the credit
of the second half of the off-site facility fee toward the eligible
cost of this water line extension.

SUBJECT: Off -Site Facility Fee Credit for North Cross School
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
The North Cross School is building an Athletic Center adjacent to
the existing building. As part of this project, they will be
extending the County water line along Colonial Avenue from Route 419
to just beyond the entrance to their facilities.
The Utility Department is paying a part of the construction in
order to have the water line oversized from 8 inch to 12 inch.
North Cross School will pay the full cost of an 8 inch water line
for the first 300 feet as required by the Water Ordinance. The
Utility Director has agreed to credit one-half of their off-site
facility fee toward the cost of an 8 inch water line for the distance
beyond the first 300 feet. The school has requested that the Board
approve the second half of their off-site facility fee to be credited
toward the same construction cost.
The school has the option to request their service from the
existing water line at Route 419 and install a private water line on
their property to serve their needs. However, staff and the school
representative feel it would be in the best interest of both the
County and the school to extend the water main along Colonial Avenue.
In order to encourage this construction to be completed without
additional cost to the school, the entire off-site facility fee needs
to be credited toward the construction.
FISCAL IMPACT•
There will be no direct fiscal impact since the County will be
receiving water facilities which have at least the value of the
off-site facility fee which will be credited.
RECOMMENDATION:
Staff recommends that the Board of Supervisors approve the credit
of the additional one-half off-site facility fee.

RESOLUTION 32288-7 OF CONGRATULATIONS TO
FOURTEEN COUNTY EMPLOYEES UPON THEIR
SELECTION AS A DEPARTMENTAL EMPLOYEE OF
THE YEAR 1987
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
WHEREAS, The Board of Supervisors of Roanoke County,
Virginia approved an Employee of the Year Program in November
1986 to recognize outstanding employees and encourage excellence
in performance of job duties; and
WHEREAS, fourteen finalists were nominated by their
individual departments based on criteria which included
excellence in the performance of job duties, display of service
to the public and to fellow employees, and contribution of
money -saving or labor-saving ideas; and
WHEREAS, these fourteen employees are also the
finalists in the Employee of the Year Program; and
WHEREAS, they are deserving of special recognition by
the Board of Supervisors of Roanoke County, and the citizens of
Roanoke County for their outstanding contributions to the County
during 1987, and
WHEREAS, these employees will be present to receive
individual recognition for this honor.

NOW, THEREFORE BE IT RESOLVED that the Board of
Supervisors of Roanoke County expresses its deepest appreciation
to Dora Altice, Tim Beard, Katherine Claytor, Randall Hinchey,

BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
WHEREAS, The Board of Supervisors of Roanoke County,
Virginia approved an Employee of the Year Program in November
1986 to recognize outstanding employees and encourage excellence
in performance of job duties; and
WHEREAS, fourteen finalists were nominated by their
individual departments based on criteria which included
excellence in the performance of job duties, display of service
to the public and to fellow employees, and contribution of
money -saving or labor-saving ideas; and
WHEREAS, Hope Patsel was selected the 1987 Roanoke
County Employee of the Year (by a committee appointed by the
County Administrator), and
WHEREAS, Hope Patsel is deserving of special
recognition by the Board of Supervisors of Roanoke County, and
the citizens of Roanoke County for her outstanding contributions
made during the year 1987.
NOW, THEREFORE BE IT RESOLVED that the Board of
Supervisors of Roanoke County expresses its deepest appreciation
to Hope Patsel for her excellent performance, and capable, loyal,

RESOLUTION 32288-9 PURSUANT TO SECTION
15.1-238 (e) OF THE 1950 CODE OF
VIRGINIA, AS AMENDED, SETTING FORTH THE
INTENT OF ROANOKE COUNTY TO ENTER UPON
CERTAIN PROPERTY LOCATED IN THE WINDSOR
HILLS MAGISTERIAL DISTRICT OF ROANOKE
COUNTY AND TO TAKE A CERTAIN SANITARY
SEWER EASEMENT
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:.
1. That the acquisition of a sanitary sewer easement
is being undertaken by the County of Roanoke to allow for the
elimination of an improperly functioning drainfield by extending
public sewer to the property of George McQuarrie; and
2. That in order to complete this project one sanitary
sewer easement is needed and more particularly described as a
fifteen (15) foot wide strip of land across the property of Helen
V. Bryant and more particularly described on the attached apprai-
sal report as being located along the rear property line and con-
taining 3,086.55 square feet, together with a ten (10) foot wide
temporary construction easement. The fair market value of the
aforesaid permanent easement is $593.00 and the estimated dam-
ages, if any, to the residue property is $2,045.00; such compensa-
tion having been offered the property owner; and
3. That it is immediately necessary for the County to
enter upon and take such property on April 22, 1988, and commence
the construction of said sanitary sewer easement in order to ex-
tend public sewer service to said property owner in order to
replace the improperly functioning drainfield, to satisfy the
requirements and recommendations of the State Health Department,
and to provide long-term sewer capacity for the health, safety
and welfare of its citizens and to thereafter institute and con-
duct appropriate condemnation proceedings as to said sanitary
sewer easement.
4. That pursuant to the provisions of Section 15.1-238
(e) of the 1950 Code of Virginia, as amended, and pursuant to
notice and public hearing as made and provided therein, the Board
does hereby invoke all and singular the rights and privileges and
provisions of said Section 15.1-238 (e) as to the vesting of
powers in the County pursuant to Section 33.1-119 through Section
33.1-129 of the 1950 Code of Virginia, as amended, all as made
and provided by law.

ORDINANCE 32288-10 RESCINDING ORDINANCE
NO. 9887-6 AND ACCEPTING AN OFFER FOR
AND AUTHORIZING THE SALE OF REAL ESTATE
ADJACENT TO FORT LEWIS FIRE STATION ON
U.S. 11-460 AND AUTHORIZING THE LEASE
OF THE BALLFIELDS BY ROANOKE COUNTY ON
SAID TRACT
WHEREAS, pursuant to the provisions of Section 16.01 of
the Charter of Roanoke County, the subject property has been de-
clared to be surplus; and
WHEREAS, pursuant to the provisions of Section 18.04 of
the Charter of Roanoke County, a first reading concerning the
sale and disposition of the real estate was held on August 25,
1987. A second reading and public hearing was held on Septem-
ber 8, 1987, whereupon the Board of Supervisors adopted Ordinance
No. 9887-6; and
WHEREAS, the terms of the real estate transaction have
been amended whereby Lewis Gale Building Corporation would pur-
chase 7.057 acres adjacent to the Fort Lewis Fire Station on U.S.
Route 11-460; and
WHEREAS, in consideration for this real estate, Lewis
Gale Building Corporation would convey 5.1779 acres off of Route
221 and $60,000; and
WHEREAS, the acreage of real estate off of Route 11-460
at the Fort Lewis Fire Station was changed to reflect the addi-
tion of a 50 -foot wide strip to the west. This was done to accom-
modate the future expansion of the structure in 1992; and
WHEREAS, in addition, the County will be allowed to
lease the ballfields presently located on the 7.057 -acre tract
from Lewis Gale Building Corporation in the amount of $1.00 per
annum through December 31, 1989; and
WHEREAS, Section 18.04 of the County Charter requires
that any sale or disposition of public property be accomplished
by ordinance. The first reading of this proposed amended ordin-
ance was held on March 9, 1988; the second reading is scheduled
for March 22, 1988.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervi-
sors of Roanoke County, Virginia, as follows:
1. That the Board of Supervisors hereby rescinds Ordin-
ance No. 9887-6 adopted September 8, 1987; and
2. That the Board of Supervisors hereby approves the
conveyance of 7.057 acres of real estate adjacent to the Fort
Lewis Fire Station on U.S. Route 11-460 to Lewis Gale Building
Corporation in exchange $60,000 cash and the conveyance of 5.1799
acres of real estate off of Route 221 to Roanoke County.
3. That the County hereby leases the ballfields pre-
sently located on the 7.057 -acre tract from Lewis Gale Building
Corporation in the amount of $1.00 per annum through December 31,
1988; and
4. That the net proceeds from the sale of this proper-
ty be allocated to the Capital Improvements Fund; and
5. That the County Administrator is hereby authorized
to execute such documents and take such actions on behalf of Roa-
noke County as are necessary to accomplish the conveyance of said
property, all of which shallbe upon form approved by the County
Attorney.

TRANSPORTATION DEALLOCATE $128,145 OF
INDUSTRIAL ACCESS ELIGIBILITY AND
REALLOCATE $128,145 OF INDUSTRIAL ACCESS
ELIGIBILITY TO THE VALLEYPOINTE PHASE I
PROJECT IN ROANOKE COUNTY.
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
That having duly considered and previously authorized
an escrow agreement on August 25, 1987 for industrial access
funds in the amount of $128,145 for the development of Southwest
Industrial Park in Roanoke County; and that those funds were to
be secured by letter of credit to ensure that qualifying indus-
tries were to be located within the park; and,
That a County -State agreement was approved between
Roanoke County and the Virginia Department of Transportation on
October 6, 1987 setting forth the respective responsibilities of
both the County and State regarding the design and construction
of the road; and,
That the Virginia Department of Transportation by that
agreement will reimburse Roanoke County for eligible construction
and engineering items incurred subsequent to September 22, 1987
in the event that the County locates significant and qualifying
industries on the remaining tracts; and,
That the County has received a number of requests from
local non -qualifying companies and individuals desirous of improv-
ing the remaining tracts; and,
That the County has other projects in need of indus-
trial access improvements which have strong potential for attract-
ing significant qualifying industry; and,
That the Board of Supervisors of Roanoke County have
taken action on March 9, 1988 also recinding action taken on
August 25, 1987; and,
NOW, THEREFORE, Roanoke County requests that the County -
State Agreement of October 6, 1987 be voided and the County
deallocate the use of industrial access funds in the amount of
$128,145 for the Southwest Industrial Park in Roanoke County, and
reallocate industrial access funds in the amount of $128,145 for
industrial access improvements to the Valleypointe Phase I
project in Roanoke County making the total industrial access
allocation of State funding to Valleypointe to be $449,645
($128,145 reallocation, plus $171,500 requested remaining
industrial access funds and $150,000 matching State funds as
described in resolution 2988-4 dated February 9, 1988).
That the Clerk of this Board forthwith transmit certi-
fied copies of this resolution together with any necessary and
support data to the Virginia Department of Transportation.
