Regular meetings are held on the second and fourth Tuesday at 3:00 p.m. Public hearings are held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule will be announced. The meetings are broadcast live on RVTV, Channel 3, and will be rebroadcast on Thursday at 7:00 p.m. and on Saturday at 4:00 p.m. Our meetings are now closed- captioned, so it is important for everyone to speak directly into the microphones at the podium. Clayton Goodman III County Administrator W9- COLINTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMA ~PION: Fred Amrhein opened his First jewelry shop in downtown Roanoke on West Campbell Avenue on November 5, 1921, calling it F.C. Amrhein's Jewelers. It was a dream come true for a jeweler to create a family tradition spanning generations, while also growing a small shop into a multi - divisional company. As the years passed, Fred's sons, grandson and great - grandson followed in his footsteps to grow the company and its divisions. Throughout the name changes and the business evolution, jewelry has remained afather- and -son trade. AmRhein's opened a jewelry store in the Cave Spring Corner Shopping Center in 1979, then moved to Old Country Plaza, and then moved to their own building on Ogden Road where the corripany successfully introduced the retail offering of fine jewel ry with bridal and formal wear. AmRhein Wines began in mid -1990 and are one hundred percent (100 %) estate grown and processed. The wine cellars now consist of three (3) vineyards of over forty (40) acres and yielding twenty (20) varieties of grapes. AmRhein's has been in Roanoke County for 32 years. 2011 is the 90th anniversary of Amrhein's —the Roanoke Valley's oldest jeweler. Amrhein's Jewelers in Roanoke, Virginia. Under the leadership of Fred C. Amrhein in the 1950's to the management through the 1970's of his two sons, Russell and Oliver; Amrhein's has been known as a full service jeweler and has the distinction of being the oldest jewelry establishment In the Roanoke Malley; and WHEREAS, in 1979, the operation of Amrhein's & Sons was passed to Fred's grandson Russ, who with his wife, Paula, opened several Amrhein's Jewelry stores, introduced a bridal and formal wear salon in 1992 and changed the business name to Amrhein's Brides, Formals and Fine Jewelry. By the 2000's, Russ and Paula began the transition of the jeweler legacy to their son, Chad, insuring that the business remained a father and son trade for four (4) generations. Following the transfer, Russ returned to his agricultural roots and founded AmRhein's Wine with five hundred (500) vines on Bent Mountain in Roanoke County; and WHEREAS, AmRhein's received the Roanoke Regional chamber's 2011 Small Business Legacy award, and in 2002, won the Outstanding Microbusiness award. AmRhein's Wine cellars has also won numerous state, national and international awards and medals for superior wine. In addition, the popular "dancing couple" wine label won a national Addy Award by the American Advertising Federation; and WHEREAS, AmRhein's continues to exhibit a strong, philanthropic commitment to the Roanoke Valley by serving as a corporate sponsor, or in -kind donor for many area organizations and their annual fundraisers. CHECKLIST A concept plan of the proposed project must be submitted with the application. The concept plan shall graphically depict the land use change, development or variance that is to be considered. Further, the plan shall address any potential land use or design issues arising from the request. In such cases involving rezonings, the applicant may proffer conditions to limit the future use and development of the property and by so doing, correct any deficiencies that may not be manageable by County permitting regulations. The concept plan should not be confused with the site plan or plot plan that is required prior to the issuance of a building permit. Site plan and building permit procedures ensure compliance with State and County development regulations and may require changes to the initial concept plan. Unless limiting conditions are proffered and accepted in a rezoning or imposed on a special use permit or variance, the concept plan may be altered to the extent permitted by the zoning district and other regulations. A concept plan is required with all. rezoning, special use permit, waiver, community plan (15.2 -2232) review and variance applications. The plan should be prepared by a professional site planner. The level of detail may vary, depending on the nature of the request. The County Planning Division staff may exempt some of the items or suggest the addition of extra items, but the followin are considered minimum: ALL APPLICANTS a. Clayton Goodman III County Administrator R-5_j� COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: §58.1 -3651 of the code of Virginia, 1950, as amended, grants county governments the authority to exempt property owned by nonprofit organizations when such property is used for charitable, patriotic, historical, benevolent, cultural or public park and playground purposes. The Advancement Foundation is requesting that a 0.23 acre parcel of real estate (Tax Map No. 60.15 07 - 40) be exempt from property tax. The organization is exempt from taxation pursuant to §501 (c) of the Internal Revenue code and has provided all information required by state law to the commissioner of the Revenue. The Advancement Foundation will agree to execute an agreement with the County for payment of a twenty percent (20 %) service fee in lieu of taxation. Before adopting any such ordinance, the Board shall consider the following questions from §58.1 -3651 (B) of the Code of Virginia (1950), as amended: 1. Whether the organization is exempt from taxation pursuant to § 501(c) of the Internal Revenue Code of 1954. Page 1 of 2 2. Whether a current annual alcoholic beverage license for serving alcoholic beverages has been issued by the Virginia Alcoholic Beverage Control Board to such organization, for use on such property. 3. Whether any director, officer or employee of the organization is paid compensation in excess of a reasonable allowance for salaries or other compensation for personal services which such director, officer or employee actually renders. 4. Whether any part of the net earnings of such organization inures to the benefit of any individual, and whether any significant portion of the service provided by such organization is generated by funds received from donations, contributions, or local, state or federal grants. As used in this subsection, donations shall include the providing of personal services or the contribution of in -kind or other material services. 5. Whether the organization provides services for the common good of the public. 6. Whether a substantial part of the activities of the organization involves carrying on propaganda, or otherwise attempting to influence legislation and whether the organization participates in, or intervenes in, any political campaign on behalf of any candidate for public office. 7. The revenue impact to the locality and its taxpayers of exempting the property. 8. Any other criteria, facts and circumstances that the governing body deems pertinent to the adoption of such ordinance. FISCAL IMPACT: Tax exempt status will result in loss of taxable revenue of the value of the land and any structures in the amount of $2,463.40 for Roanoke County and $67.80 for the Town of Vinton. This will be offset in part by the twenty percent (20 %) service fee. ALTERNATIVES: After the public hearing, the Board may decide to grant this exemption by approval of the attached ordinance; or the Board may decide to refuse to grant the exemption. If it is the pleasure of - the Board to adopt this ordinance rescinding or repealing the general noise standards for these systems, then after first reading of this ordinance, it should be referred to the Roanoke County Planning Commission for its consideration and recommendation. Upon receipt of the Planning Commission's recommendation, then the Board could schedule a second reading and public hearing on this ordinance. Section 15.2 -2285 of the Code of Virginia requires that any amendment to the zoning ordinance be referred to the Planning Commission for its recommendations. Section 30- 14 -1 of the Roanoke County Code provides that the Planning Commission has ninety (90) days to it to make its report to the Board of Supervisors. Failure of the Commission to report to the Board within ninety (90) days shall be deemed a recommendation of approval. Clayton Goodman Ill County Administrator COUNTY ADMINISTRATOR'S COMMENTS: At the October 11, 2011, Board of Supervisors (BoS) meeting, Virginia Tech (VT) Catawba Sustainability Center (CSC) staff presented information regarding the upcoming events and activities which are supported by the establishment of the Memorandum of Understanding wou). - rhe consensus of the members present was that this should be placed on the next agenda for consideration and possible adoption. SUMMARY OF INFORMATION: For the past year, the Roanoke County Administrator and the Departments of community Development, Economic Development and Parks, Recreation and Tourism have been working with VT officials to develop a partnership to support the growth of what is now called the Catawba Sustainability Center. The CSC is a 377 -acre farm located in the Catawba Valley of Roanoke County that is owned by the Commonwealth of Virginia and managed by the Office of Outreach and International Affairs at VT. Historically, CSC was a dairy employing nearby residents to provide meat and dairy products to the staff and patients at the Catawba Sanitarium, now known as the Catawba Hospital. In 1988, the Catawba Hospital transferred 377 acres of its land holdings to VT. - rhe farm has served as a focal point of the Catawba community, and the county wishes to preserve its pastoral character. The primary goal for the CSC is to establish a productive, sustainable and self - supporting enterprise that serves as a model for future farms in Virginia and the mid - Atlantic region; and supports the rural economic development goals of the residents of Catawba. The CSC was envisioned as a working farm that produced an income stream from products, services, training and special events in collaboration with the community. - rhe focus has been on strengthening collaboration across disciplines, as well as engagement with public Page 1 of 3 and private sectors, to create synergies and new linkages for the university and the region. The three part focus of the CSC includes: 1) community engagement and outreach, 2) learning and discovery and 3) land -based business incubation. To assist in reaching these goals, VT officials have requested funding for operational support and in -kind services and a Memorandum of Agreement (MOA) has been mutually drafted between Roanoke County and Virginia Tech. The Catawba Community Center, owned by Roanoke County and located adjacent to the CSC, provides a cooperative opportunity to offer in -kind support services including office space, program and meeting space, storage of equipment, etc. The Catawba CommUnity Center would provide the staff at CSC with a base of operations and allow for additional programming at a currently underutilized facility in Roanoke County. Successful cooperative programs have already been introduced to the community through this partnership including the Farmers Market, the annual Celebrate Catawba event and several gardeninglfarmers workshops. It is important to note that this partnership has been enthusiastically embraced and supported by the residents in the Catawba community, who share a deep appreciation for agricultural and natural resources practices. One of the significant outcomes included within the MOA is the establishment of a blue blaze trail connection between the Appalachian Trail (AT), the CSC and the Catawba community. This connection will serve as portion of the Catawba Greenway, which is supported as a regional priority in the 2007 Roanoke Valley Conceptual Greenway Plan. Currently, thousands of AT hikers are traveling along Route 311 to reach amenities in the Catawba community, such as a local restaurant, post office and small dry goods and grocery store. The establishment of this spur trail will provide hikers with a safe and convenient access between the AT and the Catawba community. Additionally, VT has committed to constructing hostels at the CSC to provide overnight accommodations for hikers. VT has agreed to grant Roanoke County a twenty -five (25) year lease agreement for the purposes of maintaining, constructing and managing the blue blaze trail. Roanoke County intends to coordinate with the Roanoke Valley Greenway Commission to utilize volunteers for the construction and maintenance of the trail. The failure of either party to comply with the terms and conditions provided in the MOA may result in termination of the agreement within thirty (3 0) days afterwritten notice of non- compliance. If the County determines that the agreement cannot continue due to budgetary or operational issues, the County may terminate the agreement within ninety (90) days written notice. FISCAL IMPACT: Per the MOA, the County has corrin ,- fitted to funding in the amount of $50,000 cash and a maximum of $50,000 for in -kind services during fiscal year 2011-2012. Future funding appropriations from Roanoke County shall be evaluated annually upon achievement of expected outcomes and responsibilities outlined in the MOA. Roanoke County commits to annual funding appropriations for duration not to exceed five (5) years. Annual funding Page 2 of 3 allocations to VT will be subject to budget appropriations approved by the Board of Supervisors. The County's financial commitment to the Catawba Sustainability Center (CSC) is $50,000 over approximately the next three to five years. Economic Development has authorized funding of the project from existing funds in their Public Private Partnership account (PPP). Funds in the amount of $50,000 will be reallocated annually to fund the CSC project. The project will be evaluated annually and progress reports to be provided to the BoS. ALTERNATIVES: 1 . Approve the attached resolution supporting the Memorandum of Agreement with Virginia Tech for the Catawba Sustainability Center and Catawba Oreenway. 2. Virginia Tech is governed by Subchapter 3 (§ 23 -38.91 et seq.) of Chapter 4.10 and Chapter 11 (23 -114 et seq.) of Title 23 of the Code of Virginia, and its Management Agreement with the Commonwealth of Virginia, 2006 Va. Acts of Assembly, chs. 933 and 943, Chapter 1, and is authorized to enter into this Agreement pursuant to § §23- 38.99, 23- 38.100 and 23- 38.101 of the Code of Virginia. B. Roanoke County is a political subdivision of the Commonwealth of Virginia and a Charter County pursuant to Chapter 617, Acts of Assembly, 1986 and Chapter 2, Local Government Charters, of Title 15.2, Code of Virginia, 1950, as amended. C. The Catawba Sustainability Center (CSC) is a 377 acre farm located in beautiful Catawba Valley of Roanoke County that is owned by the Commonwealth of Virginia and managed by the Office of Outreach and International Affairs at Virginia Tech. The College of Natural Resources at Virginia Tech stated in 2008 that the primary goal for the farm was to establish a productive, sustainable, and self - supporting enterprise that serves as a model for future farms in Virginia and the mid - Atlantic region and DRAFT 1 September 22, 2011 supports the rural economic development goals of the residents of Catawba. The Center was envisioned as a working farm that produced an income stream from products, services, training, and special events in collaboration with the community. During the summer of 2009, the CSC was re- assigned to the Office of Outreach and International Affairs at the Virginia Tech Roanoke Center. The current focus has been on strengthening collaboration across disciplines, as well as engagement with public and private sectors, to create synergies and new linkages for the university and the region. The three part focus of the CSC includes community engagement and outreach, learning and discovery, and land -based business incubation. D. Roanoke County and VA Tech desire to work cooperatively together to achieve the goals for the farm and the residents of Catawba as a foundation for ongoing and increasing partnership through cooperative management of the CSC. The parties to this Agreement have developed a series of objectives and responsibilities as concrete examples for the use and development of the CSC. E. One way to accomplish these goals, assist in fund raising efforts, and increase awareness and appreciation for the CSC is to provide a connection between the Appalachian Trail ( "AT "), the CSC, and the Village of Catawba. Safe and convenient access between these points will economically assist the Village of Catawba, provide access to special events held at the CSC and show stakeholders that progress is being made on conserving the CSC property. It will also greatly increase the safety and security of AT users by providing an off -road trail to access facilities available in the Village of Catawba. DRAFT 2 September 22, 2011 F. The Parties wish to construct, maintain, and manage a Blue Blaze Trail from the Appalachian Trail ( "AT ") and across property owned by Virginia Tech. See attached concept plan attached hereto as Exhibit A. The purpose of this new trail is to provide safe and easy access to the thousands of AT hikers, particularly through hikers, who want to access the Village of Catawba and take advantage of a small dry goods and grocery store, post office, a local restaurant, and a proposed hostel to be constructed at the CSC. The 2007 Update to the Roanoke Valley Conceptual Greenway Plan, adopted by the Roanoke County Board of Supervisors in 2008, includes a Catawba Greenway connection between the Appalachian Trail, through the CSC, to the Village of Catawba. NOW, THEREFORE, for and in consideration of the mutual covenants and agreements contained herein, the receipt and adequacy of which is hereby acknowledged, the Parties agree as follows: 1. VIRGINIA TECH RESPONSIBILITIES: a. Virginia Tech shall allow Roanoke County access to the CSC for the purposes of constructing, maintaining and managing the Blue Blaze Trail. Virginia Tech shall provide public access to this trail as a part of the Appalachian Trail system by means of a twenty -five (25) year lease agreement; b. Coordinate the design of a hiker hostel on the CSC property by December 31, 2013 and undertake the construction and operation of such hiker hostel by December 31, 2016; c. Continue the management and expansion of the Catawba Farmers' Market during calendar years 2011 and 2012, to include setup and take down of DRAFT 3 September 22, 2011 the Market stalls /vendor facilities and trash/debris removal. Va Tech, operating thru VT Earthworks shall write annual market policies to be approved by Roanoke County and signed by all vendors participating in the market, in accordance with an executed Memorandum of Agreement dated June 23, 2011; d. Organize, expand and continue support to the annual "Celebrate Catawba" event in coordination with the Roanoke County Departments of Economic Development and Parks, Recreation and Tourism; e. Research the feasibility of a certified commercial kitchen to be located in Roanoke County's Catawba Community Center ( "the Center ") which shall include analysis of any potential demand for such kitchen, its hours of operation, potential design/layout of any proposed improvements, cost of construction of any kitchen improvements, funding resources available including government and foundation grants and private sector donations, appropriate rental fees, potential return on investment, and any other related items. Such research shall be completed within twenty -four (24) months of the execution of this Agreement; f. Utilize the Center for multiple VT Earthworks programs during 2011 and all subsequent years during the term of this Agreement to include programs encouraging the development of rural entrepreneurship and support of Roanoke County food producers. Prior to January 30 of each calendar year, and as- needed, the Director of the CSC shall meet with designated members of a Roanoke County liaison team to discuss the DRAFT 4 September 22, 2011 Center's building usage and event scheduling to insure coordination of yearly programming. All events and programming shall be pre- approved by a designated representative of the Roanoke County Parks, Recreation and Tourism prior to event publicity and commencement; g. Establish CSC Director office space in the Center during fiscal year 2011- 2012. The CSC Director shall act as a liaison to enhance the relationship between VA Tech and Roanoke County residents throughout the term of this Agreement; h. Actively cooperate with the Roanoke County Department of Economic Development in the development of at least two (2) revenue producing agricultural or natural resource based businesses that will serve Roanoke regional markets during fiscal year 2011 -2012; and i. Act as a liaison between VA Tech, Roanoke County and the Catawba Hospital through the identification of economic development activities or initiatives that will benefit Roanoke County throughout the term of this Agreement. 2. ROANOKE COUNTY RESPONSIBILITIES: a. Roanoke County agrees that construction of the Blue Blaze Trail across property owned by Virginia Tech, as shown on Exhibit A, will be performed by professionals and /or experienced volunteer trail builders, under the supervision of Roanoke County or its designated representatives. The County will use Appalachian Trail Conservancy (ATC) standards for marking, clearing, and treadway care as specified in such ATC DRAFT 5 September 22, 2011 publications as Trail Design, Construction, and Maintenance, 2000, a copy of which is attached hereto as Exhibit B. i. Specific Roanoke County authorities and responsibilities include, but are not limited to: 1) trail construction and maintenance (trail location, design and construction; footpath protection and hardening with water diversion structures, puncheon, and rockwork; pathway obstruction removal; route marking with blazes, signs, and cairns); vegetation clearing, trimming, and storm damage clean -up within the trail corridor; tread maintenance; trash removal; 2) facilities construction and maintenance (kiosk, bridge construction if necessary); 3) information and education (hiker education and provision of information about the trail to the public). The County reserves the right to utilize volunteers to perform these duties. Roanoke County will pursue grant funding opportunities as the major source of funding for construction of the greenway. ii. Roanoke County agrees to provide written notice to Virginia Tech, at least ninety (90) days in advance, of any trail location changes that are necessary. These changes shall not be implemented without prior, written approval by Virginia Tech. iii. Roanoke County, and its agent and employees, hereby agree to conduct activities on the CSC in such a manner as not to endanger or otherwise limit the enjoyment and use of the CSC and adjacent DRAFT 6 September 22, 2011 properties not included as part of the Blue Blaze Trail. Roanoke County shall pay for or repair any damage to the land, structures, roads, fences, sidewalks, curbs, existing utilities and other improvements caused by Roanoke County, its employees, agents, or contractors. Roanoke County shall notify Virginia Tech immediately of any such damage, and shall make payment or repair as soon as possible but not to exceed thirty (30) days after such damage occurs; b. Provide use of the Center and its grounds for operation of the Catawba Farmer's Market and the annual Celebrate Catawba event; c. Provide office and meeting space at the Center for the CSC Director. d. Designate a member of County staff to serve as a liaison with VA Tech on matters concerning the CSC; e. Waive its standard fees for general use of the Center; f. Provide technical services to include mapping and analysis of geographic and spatial data, as well as limited engineering and design assistance; g. Provide a mutually agreed upon signage for the Farmer's Market; and h. Provide funding during fiscal year 2011 -2012 of $50,000 in cash and a maximum of $50,000 of in -kind services, as set forth above. Future funding contributions shall be evaluated on an annual basis based upon achievement of responsibilities. Subject to future appropriations by future governing bodies, Roanoke County commits to annual funding for a duration not to exceed five (5) years. DRAFT 7 September 22, 2011 3. COOPERATIVE MANAGEMENT: Roanoke County proposes that a cooperative management system be implemented based on a commitment to cooperation, consultation, and collaboration by all partners. The Roanoke County Attorney's Office shall represent Roanoke County in resolving differences between Roanoke County and Virginia Tech. This Agreement does not constitute a partnership, and neither party shall have the authority to bind the other without express written consent. 4. ASSIGNMENT: Roanoke County shall not assign or transfer its rights set forth in this Agreement without the prior written consent of Virginia Tech, which may be withheld by Virginia Tech in its sole discretion. This Agreement does not create an interest in or transfer possession of real property except as may be set forth in any lease or other legal document between the parties hereto in order to carry into effect the terms of this Agreement. 5. LIABILITY: Neither the Commonwealth of Virginia nor Virginia Tech shall have any liability in the construction or maintenance of this Blue Blaze Trail. Prior to entry upon the CSC, all volunteers shall sign a Release of Liability, a copy of which is attached hereto as Exhibit C. The Commonwealth of Virginia, Virginia Tech, and its agents and employees, shall be accorded all the benefits and protections afforded to landowners by virtue of Section 29.1 -509 of the Code of Virginia, 1950 (as amended) or any successor provision of law. 6. TERMINATION: The parties may terminate this Agreement at the end of twenty-five (25) years of the effective date of the Agreement or immediately upon the occurrence of any of the following: DRAFT 8 September 22, 2011 a) The failure of Roanoke County to comply with any term, provision, promise or covenant of this Agreement and the failure to cure such non - compliance within thirty (30) days after written notice of non-compliance to Roanoke County. b) If Roanoke County determines this contract cannot continue due to budgetary or operational issues, the County may terminate the Agreement with 90 days written notice. 7. GENERAL: 7.1 If any part of this Agreement is held illegal or unenforceable by a court of competent jurisdiction, the remainder of this Agreement shall be given effect to the fullest extent possible. 7.2 The Parties agree not to discriminate on the basis of race, gender, disability, age, veteran status, national origin, religion, sexual orientation, or political affiliation. 7.3 Nothing herein shall be construed as affecting the authority or ability of Virginia Tech or Roanoke County to perform their obligations under other agreements. This Agreement shall not confer any additional rights on, or waive any rights given, by any party hereto under any other agreement to which they are a party. 7.4 This Agreement may be amended from time to time by written supplement hereto executed by all parties. 7.5 This Agreement shall be governed by the laws of the Commonwealth of Virginia without regard to Virginia law regarding choice of law or other conflict of laws, and venue and jurisdiction shall be in either Montgomery County or Roanoke County, Virginia, and each party waives any objections to venue. Roanoke County does have a mutual aid agreement with the County of Craig and frequently responds to their requests for assistance. By donating this ambulance it will not only serve to improve patient care in Craig County but Roanoke County will also benefit by having the paid unit in service during times the volunteer responders are not available. Ultimately, the unit will reduce the number of times Roanoke County units have to respond into Craig leaving those units in service to assist the citizens of Roanoke County. Roanoke County Fire and Rescue has several ambulances on order to replace current older units. Once the vehicles are delivered, the department will evaluate which of the units being replaced is in the best condition to donate. In the past, these surplus units have been sold on the County's Public Surplus site for an average of $8,500. Craig County fully understands that the vehicle is not in perfect condition and that the unit will have high mileage. They agree to take possession of the vehicle in "as is" condition. ADMINISTRATION CENTER ON TUESDAY, OCTOBER 25, 2011 ORDINANCE GRANTING A SPECIAL USE PERMIT FOR A BROADCASTING TOWER IN AN AG-3 DISTRICT ON 17.12 ACRES LOCATED AT 3557 JAE VALLEY ROAD (TAX MAP NOS. 89.00-02- 06.00 AND 89.00-02-7.00) VINTON MAGISTERIAL DISTRICT, UPON THE PETITION OF SKYWAY TOWERS WHEREAS, Skyway Towers has filed a petition for a special use permit for an approximately 199-foot broadcasting tower in an AG-3, Agricultural/Rural Preserve, District on 17.12 acres located at 3557 Jae Valley Road (Tax Map Nos. 89.00-02-06.00 and 89.00-02-7.00) in the Vinton Magisterial District; and WHEREAS, the Planning Commission held a public hearing on this matter on October 4, 2011; and WHEREAS, the Board of Supervisors of Roanoke County, Virginia, held a first reading on this matter on September 27, 2011; the second reading and public hearing on this matter was held on October 25, 2011. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the Board finds that the granting of a special use permit to Skyway Towers for an approximately 199-foot broadcasting tower in an AG-3, Agricultural/Rural Preserve, District on 17.12 acres located at 3557 Jae Valley Road (Tax Map Nos. 89.00-02-06.00 and 89.00-02-7.00) in the Vinton Magisterial District is substantially in accord with the adopted 2005 Community Plan, as amended, pursuant to the provisions of Section 15.2-2232 of the 1950 Code of Virginia, as amended, and that it shall have a  Page 1 of 2  minimum adverse impact on the surrounding neighborhood or community, and said special use permit is hereby approved with the following conditions: a) The site shall be developed in general conformance the site plan prepared by Morrison Hershfield, dated June 13, 2011 b) The broadcasting tower shall comply with the recommendations of the National Park Service/Blue Ridge Parkway as indicated in the formal correspondence from Philip A. Francis, Jr., Superintendent, dated October 5, 2011 2. That this ordinance shall be in full force and effect thirty (30) days after its final passage. All ordinances or parts of ordinances in conflict with the provisions of this ordinance be, and the same hereby are, repealed. The provisions of this special use permit are not severable. Invalidation of any word, phrase, clause, sentence or paragraph shall invalidate the remainder.
