Regular meetings are held on the second and fourth Tuesday at 3:00 p.m. Public hearings are held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule will be announced. Clayton Goodman III County Administrator tclgr COUNTY ADMINis'll COMMENTS: SUMMARY OF INFORMATION: The Beard has in the past, approved the use of the Columbus Day floating holiday for the purposes of adjusting the work week for what day Christmas occurs during the week. Case in point, in 2012, Christmas Day falls on a Tuesday, and the Board approved on August 24, 2010, using the floating holiday of Columbus to close County offices on Monday, December 24 in this year. We have in the 2413 and 2014 calendars on major holidays an opportunity with varying our floating holidays for that purpose. Since in 2413, Christmas falls on a Wednesday, we are asking the Beard to consider and approve using the 2413 Columbus Day (October 14, 2013) floating holiday to close County offices on Tuesday, December 24, 2413. Clayton Goodman III County Administrator eab COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: The Commonwealth Transportation Board has awarded the county of Roanoke federal Transportation Enhancement Program funds for fiscal year 201 1 -2012 and fiscal year 2012 -2013 for the Eastern Section of the Roanoke River Greenway in the amounts of $237,000 and $152,000, respectively. These grants will supplement TEA -21 funding received in fiscal year 2008 -2009 and fiscal year 2009 -2010 to fund engineering, surveying and right -of -way acquisition for the greenway. The Roanoke River Greenway is envisioned as the backbone of the Roanoke Valley greenway system and has been designated as the top greenway priority by the Roanoke Valley Greenway Commission in its 2007 Update to the Roanoke Valley Conceptual Greenway Plan, endorsed by the Roanoke County Board of Supervisors. once complete, the Roanoke River Greenway will be a regional thirty -one (31) -mile bicycle /pedestrian trail through the Roanoke Valley, linking Roanoke County, the Cities of Roanoke and Salem and the Town of Vinton. The greenway system has been strongly supported by citizens, Page 1 of 3 businesses, civic organizations, politicians and local governments. Greenways were also strongly supported by citizens during the development of the Comprehensive Parks Master Plan, completed in 2007. The residents of Roanoke County identified greenways as a "High Priority Need" for facilities and amenities desired in our community. Phase I of the eastern section of the Roanoke River Greenway project is approximately two point seven (2.7) miles long extending from the Roanoke City line near the Western Virginia Water Authority Pollution Control Plant to the Blue Ridge Parkway. In April 2012, the City of Roanoke opened the section of the Roanoke River Greenway connecting the Roanoke River and Tinker Creek Greenways with the crossing of the Roanoke River at the Pollution Control Plant. The total estimated project cost is approximately $4,970,475, which includes costs associated with engineering, land acquisition, permitting and construction. A Request for Proposal (RFP) was advertised in November 2011, and the County has entered a contract with Anderson & Associates in Blacksburg for the preliminary engineering and design of the greenway. Negotiations have commenced with the Blue Ridge Parkway, American Electric Power and the Western Virginia Water Authority to identify greenway alignments and connections to existing recreational amenities. Staff has met with the majority of private property owners within the project study area to discuss the project and determine possible support for the project. FISCAL IMPACT: In accordance with the Enhancement Program Policy, the federal share of the funding is eighty percent (80 %), requiring a match of twenty percent (20 %) from State funds. VDOT's Enhancement Program Policy requires that the matching share of state funds come from the sponsoring locality. This can be in the form of local cash, private contributions, donation of goods and services and/or land value. The fiscal year 2011 -2012 grant award amount of $237,000 requires a local match of $59,250. The fiscal year 2012 -2013 grant award of $152,000 requires a local match of $38,000. A summary of the VDOT Enhancement Grant Funding received for this project is provided below. In accordance with Roanoke County's Grant Policies and Procedures, a budget appropriation must be established through Board Action for expenditures to be processed against a grant. The Department of Parks, Recreation and Tourism requests that the Board of Supervisors appropriate the grant funds with corresponding match amounts. It is anticipated that the match amount will be partially fulfilled with the value of donated right of way; therefore, the fiscal impact to Roanoke County may be minimal. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, as follows: 1. That it requests the Commonwealth Transportation Board to establish a project for the construction and development of approximately two point seven (2.7) miles of the Roanoke River Greenway in eastern Roanoke County from the Roanoke City line to the Blue Ridge Parkway. 2. That the total estimated project cost is $4,970,475. The costs associated with the first phase of the project (which will address project design, engineering and permitting, and private land acquisition along the proposed greenway corridor) are estimated to be $904,275. The costs associated with the second phase of the project (construction) are anticipated to be $4,066,200. 3. Roanoke County has received fiscal year 2011 -2012 grant funding in the amount of $237,000. In accordance with VDOT's Enhancement Program Policy, Page 1 of 2 Roanoke County hereby agrees to provide matching funds in the amount of $59,250, which is twenty percent (20 %) of the total project costs. The form of matching funds may come from local cash, private contributions, donations of goods and services and /or land value. 4. That if Roanoke County subsequently elects to cancel this project the County hereby agrees to reimburse the Virginia Department of Transportation for the total amount of costs expended by the Department through the date the Department is notified of such cancellation. Roanoke County has received fiscal year 2012 -2013 grant funding in the amount of $152,000. In accordance with VDOT's Enhancement Program Policy, Page 1 of 2 Roanoke County hereby agrees to provide matching funds in the amount of $38,000, which is twenty percent (20 %) of the total project costs. The form of matching funds may come from local cash, private contributions, donations of goods and services and /or land value. 4. The Department employs over ninety (90) people that provide services to not only Roanoke County but the Town of Vinton and the City of Salem. On -site parking is currently limited to thirty -four (34) spaces for employees and clients combined. Stellar One Bank leases the first floor of the Salem Bank and Trust Building from the County and also owns nearby property to include a parking lot directly adjacent to the Social Services offices and their existing on -site parking area. Currently, the Bank privately leases spots in this lot to individual tenants. Staff has negotiated a lease with Stellar One Bank for thirty -two (32) of the spaces in this lot. The initial lease term is two (2) years. The Bank has signed the lease effective November 1, 2012 pending Board approval and a subsequent thirty (30) day notification to current renters. FISCAL IMPACT: The rent for the initial two (2) -year lease is Seven Hundred Twenty Dollars ($720) per month for all thirty -two (32) spaces ($22.50 per parking space). That the execution of an agreement with StellarOne Bank to lease thirty- two (32) parking spaces in a parking lot located at 200 East Calhoun Street, Salem, Virginia, for use by Social Services staff and clients is hereby authorized. 4. That the lease term shall commence on November 1, 2012, and continue for a period of two (2) years, with the option to renew for an additional successive one (1) -year periods, upon the same terms and conditions contained in the agreement, unless terminated as provided in the agreement. 5. Chapter 2 "Administration" is amended by the addition of a new Article VII "Closed Landfill, Institutional Controls" as follows: §2 -150. Background and Legislative Intent A. Roanoke County operated the Dixie Caverns County Landfill as a disposal site for municipal refuse, solvents and fly ash from 1965 to 1976. From 1967 to 1975 electric arc furnace air emission control dust (fly ash) from Roanoke Electric Steel Corporation was disposed at this site. When this landfill was closed in 1976 it was not capped. The site lies on a relatively steep ridge complex between two steep valleys, each of which contains an intermittent stream. The property consists of approximately 74.9 acres, 39 acres of which were used for the landfill, located at Dixie Caverns in Roanoke County, Virginia, together with undeveloped land, and is identified as Tax Parcel Number 063.00 -01- 14.00 -0000 (hereinafter referred to as "Dixie Caverns Landfill "). Four areas at this landfill required remediation: a drum disposal area, the solvent contaminated sludge pit, the fly ash disposal area and a stream area. In 1987 Roanoke County entered into a Consent Agreement and Order with the Environmental Protection Agency (EPA) to clean up this site. A removal action was performed in 1988 to dispose of the drums and the contaminated sludge from the sludge pit. Dixie Caverns Landfill became a Superfund Site when it was listed on the National Priorities List in October 1989. Page 1 of 3 The Site was the focus of two Removal Actions and two Records of Decision (RODs). The only waste remaining at the Site is contained in a landfill area of the Site specifically constructed for it, as "concrete -like" stabilized blocks, and in a small pocket of fly ash - contaminated sediments, securely entombed deep in an inaccessible stream bank. This site was delisted from the National Priorities List in September 2001. § 2 -151. Definitions. Unless the context clearly indicates otherwise, the meaning of the following terms and phases used in this Ordinance shall be as follows: A. "Property" shall mean the real property located within the property identified as the Dixie Caverns Landfill, as more specifically described as Tax Map Parcel Number 063.00-01-14.00-0000. B. "Owner" shall mean the Person, custodian, guardian, trustee, caretaker, executor administrator in whose name the deed for the Property, or any portion thereof, is titled. C. "Person" shall mean any individual, partnership, company, corporation, association, corporate political body, joint ownership or any other entity. § 2 -152. Prohibition. It shall be unlawful for any Owner, lessor, lessee or occupier of the Property, or any other Person to engage in any activities on the Property that would in any manner disturb or interfere with the environmental remedial systems at the Property, including, without limitation, the landfill cap, gas vents, monitoring wells, leachate collection and conveyance system, and security measures, such as fencing, that prevent access to the Property. The prohibited activities include, but are not limited to the following: A. Digging in or disturbance of the landfill cap, tampering with hardware or equipment associated with the gas vents, monitoring wells, leachate collection and conveyance systems or the security fencing. B. Any use of leachate generated at the Property including, without limitation, any activities that could cause exposure to contaminants in the leachate via ingestion, vapor inhalation or dermal contact. C. Digging in or disturbance of the landfill cap including, without limitation, any activities that could result in contact with contaminants in the soils at the Property through ingestion, inhalation or dermal contact. D. No digging and /or construction at the Monofill where the stabilized sediments and soils are located. Page 2of3 E. Ground water monitoring wells should not be disturbed, and no drinking water wells should be installed. F. The leachate collection system and leachate collection tanks should not be disturbed. § 2 -153. Permitted Uses. The Owner is permitted to use the Property for its firing range, driving range, other related training facilities and any other lawful uses, so long as these uses do not disturb or interfere with the environmental remedial systems at the Property or as otherwise prohibited by Section 2 -152. § 2 -154. Enforcement - Violations and Penalties. A. In addition to any other remedy available under law or in equity, any Person convicted of a violation of this Article shall be subject to a criminal fine in an amount not to exceed $1,000.00 per day per violation or suffer imprisonment for a period of not more than 30 days, or both, together with costs of prosecution. Each 24- hour period during which a violation continues shall constitute a separate offense. Enforcement of this Ordinance shall be brought by action filed in the General District Court or Circuit Court for the County of Roanoke. The County Attorney may assume the prosecution with the consent of the Commonwealth's Attorney All fines and penalties collected for violation of this Ordinance shall be paid over to the County General Fund. Nothing in this section shall prohibit the County from enforcing the provisions of this Ordinance by any other remedy available at law or in equity. The remedies provided herein shall be cumulative and concurrent and shall be in addition to any other remedies available to the township at law or in equity. Section 2 - Severability. In the event that any section, sentence, clause, phrase or word of this Ordinance shall be declared illegal, invalid or unconstitutional by any court of competent jurisdiction, such declaration shall not prevent, preclude or otherwise foreclose enforcement of any of the remaining portions of this Ordinance. Section 3 - Repealer. All Ordinances or parts of Ordinances inconsistent herewith or in conflict with any of the specific terms enacted hereby, to the extent of said inconsistencies or conflicts, are hereby specifically repealed. Roanoke County Schools estimated a budget appropriation of $17,224.48. The VDOE has notified RCPS that the appropriation for this year is $22,697.60. Staff recommends a local supplemental appropriation of $5,473.12. - rhe state recognizes credentialing reimbursements for CTE industry certification examinations, licensure tests, and occupational competency assessments for students enrolled in C classes and who are eligible for such examinations. Staff requests the appropriation of $14,875.84 from the VDOE for the CTE industry certification examinations. The Jobs for Virginia Graduates (JVG) Grant's mission is to assist youth who are disadvantaged and not achieving in school to complete high school as well as secure and retain quality jobs. Roanoke County Schools received a JVG grant in the amount of $21,000. Staff recommends an appropriation in the full amount of the grant award: $21,000. The school budget currently contains a $140,000 revenue line item for the Perkins Grant. The Virginia DOE notified RCPS that the actual grant amount will be $146,238.69. Staff recommends supplemental appropriation of $6,238.69. This reserve area is more clearly shown on an exhibit titled as "Map of Access and Storm Water Management Reserve Area, attached as Attachment A. As the County cannot legally convey an easement to itself, the recording of a deed restriction will serve the purpose of providing public notice of the dedication of this reserve area. The Virginia Department of Transportation (VDOT) landscaped the roundabout shortly thereafter. Much of the landscaping planted is now dead and what survived is overrun with weeds. T.J.S Enterprises, Inc., a County landscaping business, contacted County Staff in May about replanting and taking over maintenance responsibilities for the roundabout for five years. SignaNge recognizing T.J.S Enterprises will be installed as part of this project. These activities fall under the Virginia Department of Transportation (VDOT) Comprehensive Roadside Management Program. This program requires the local governing body to hold a public hearing and adopt a Resolution of Endorsement prior to project approval by VDOT. - this project implements the 2005 Roanoke County Community Plan.
