Good afternoon and welcome to our meeting for September 11, 2012. Regular
meetings are held on the second and fourth Tuesday at 3:00 p.m. Public hearings are
held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule
will be announced. The meetings are broadcast live on RVTV, Channel 3, and will be
rebroadcast on Thursday at 7:00 p.m. and on Saturday at 4:00 p.m. Board of
Supervisors meetings can also be viewed online through Roanoke County's website at
www.RoanokeCountyVA.gov. Our meetings are closed- captioned, so it is important for
everyone to speak directly into the microphones at the podium. Individuals who require
assistance or special arrangements to participate in or attend Board of Supervisors

DECLARING THE MONTH OF SEPTEMBER 2012 AS
THE NINTH (O ANNUAL NATIONAL PREPAREDNESS
MONTH IN THE COUNTY OF ROANOKE
WHEREAS, "National Preparedness Month" creates an important opportunity for
every resident of Roanoke County to prepare their homes,
businesses and communities for any type of emergency including
natural disasters and potential terrorist attacks; and
WHEREAS, investing in the preparedness of ourselves, our families, businesses
and communities can reduce fatalities and economic devastation in
our communities and in our nation; and
WHEREAS, the Federal Emergency Management Agency's Ready Campaign,
Citizen Corps and other federal, state, local, tribal, territorial, private
and volunteer agencies are working to increase public activities in
preparing for emergencies and to educate individuals on how to take
action; and
WHEREAS, emergency preparedness is the responsibility of every citizen of
Roanoke County and all citizens are urged to make preparedness a
priority and work together, as a team, to ensure that individuals,
families and communities are prepared for disasters and
emergencies of any type; and
WHEREAS, all citizens of Roanoke County are encouraged to participate in
citizen preparedness activities and asked to review the Ready
campaign's websites at Ready.gov and become more prepared.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke
County, Virginia do hereby proclaim September 2012 as National
Preparedness Month, and encourages all citizens and businesses to
develop their own emergency preparedness plan and work together
toward creating a more prepared society.

SUMMARY OF INFORMATION:
The Beard has in the past, approved the use of the Columbus Day floating holiday for the
purposes of adjusting the work week for what day Christmas occurs during the week. Case
in point, in 2012, Christmas Day falls on a Tuesday, and the Board approved on August 24,
2010, using the floating holiday of Columbus to close County offices on Monday,
December 24 in this year.
We have in the 2413 and 2014 calendars on major holidays an opportunity with varying our
floating holidays for that purpose. Since in 2413, Christmas falls on a Wednesday, we are
asking the Beard to consider and approve using the 2413 Columbus Day (October 14,
2013) floating holiday to close County offices on Tuesday, December 24, 2413. This will
give employees time off on what usually is a slew business day in the holiday week and the
Commonwealth of Virginia is also closing on December 24, 2013, per attached calendar,
which syncs up with our court systems being closed for that day.

SUMMARY OF INFORMATION:
The Commonwealth Transportation Board has awarded the county of Roanoke federal
Transportation Enhancement Program funds for fiscal year 201 1 -2012 and fiscal year
2012 -2013 for the Eastern Section of the Roanoke River Greenway in the amounts of
$237,000 and $152,000, respectively. These grants will supplement TEA -21 funding
received in fiscal year 2008 -2009 and fiscal year 2009 -2010 to fund engineering, surveying
and right -of -way acquisition for the greenway.
The Roanoke River Greenway is envisioned as the backbone of the Roanoke Valley
greenway system and has been designated as the top greenway priority by the Roanoke
Valley Greenway Commission in its 2007 Update to the Roanoke Valley Conceptual
Greenway Plan, endorsed by the Roanoke County Board of Supervisors. once complete,
the Roanoke River Greenway will be a regional thirty -one (31) -mile bicycle /pedestrian trail
through the Roanoke Valley, linking Roanoke County, the Cities of Roanoke and Salem
and the Town of Vinton. The greenway system has been strongly supported by citizens,

businesses, civic organizations, politicians and local governments. Greenways were also
strongly supported by citizens during the development of the Comprehensive Parks Master
Plan, completed in 2007. The residents of Roanoke County identified greenways as a
"High Priority Need" for facilities and amenities desired in our community.
Phase I of the eastern section of the Roanoke River Greenway project is approximately two
point seven (2.7) miles long extending from the Roanoke City line near the Western
Virginia Water Authority Pollution Control Plant to the Blue Ridge Parkway. In April 2012,
the City of Roanoke opened the section of the Roanoke River Greenway connecting the
Roanoke River and Tinker Creek Greenways with the crossing of the Roanoke River at the
Pollution Control Plant.
The total estimated project cost is approximately $4,970,475, which includes costs
associated with engineering, land acquisition, permitting and construction. A Request for
Proposal (RFP) was advertised in November 2011, and the County has entered a contract
with Anderson & Associates in Blacksburg for the preliminary engineering and design of
the greenway. Negotiations have commenced with the Blue Ridge Parkway, American
Electric Power and the Western Virginia Water Authority to identify greenway alignments
and connections to existing recreational amenities. Staff has met with the majority of
private property owners within the project study area to discuss the project and determine
possible support for the project.
FISCAL IMPACT:
In accordance with the Enhancement Program Policy, the federal share of the funding is
eighty percent (80 %), requiring a match of twenty percent (20 %) from State funds. VDOT's
Enhancement Program Policy requires that the matching share of state funds come from
the sponsoring locality. This can be in the form of local cash, private contributions,
donation of goods and services and/or land value. The fiscal year 2011 -2012 grant award
amount of $237,000 requires a local match of $59,250. The fiscal year 2012 -2013 grant
award of $152,000 requires a local match of $38,000. A summary of the VDOT
Enhancement Grant Funding received for this project is provided below.
In accordance with Roanoke County's Grant Policies and Procedures, a budget
appropriation must be established through Board Action for expenditures to be processed
against a grant. The Department of Parks, Recreation and Tourism requests that the Board
of Supervisors appropriate the grant funds with corresponding match amounts. It is
anticipated that the match amount will be partially fulfilled with the value of donated right of
way; therefore, the fiscal impact to Roanoke County may be minimal.

RESOLUTION TO ACCEPT AND APPROPRIATE GRANT FUNDING
FROM THE VIRGINIA DEPARTMENT OF TRANSPORTATION FOR
THE FISCAL YEAR 2011 — 2012 TRANSPORTATION ENHANCEMENT
PROGRAM TO HELP FINANCE THE DESIGN AND CONSTRUCTION
OF THE EASTERN SECTION OF THE ROANOKE RIVER GREENWAY
WHEREAS, in accordance with Commonwealth Transportation Board
construction allocation procedures, it is necessary that a request by resolution be
received from the Board of Supervisors of Roanoke County in order for the Virginia
Department of Transportation program to establish an enhancement project in Roanoke
County.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of
Roanoke County, as follows:
1. That it requests the Commonwealth Transportation Board to establish a
project for the construction and development of approximately two point seven (2.7)
miles of the Roanoke River Greenway in eastern Roanoke County from the Roanoke
City line to the Blue Ridge Parkway.
2. That the total estimated project cost is $4,970,475. The costs associated
with the first phase of the project (which will address project design, engineering and
permitting, and private land acquisition along the proposed greenway corridor) are
estimated to be $904,275. The costs associated with the second phase of the project
(construction) are anticipated to be $4,066,200.
3. Roanoke County has received fiscal year 2011 -2012 grant funding in the
amount of $237,000. In accordance with VDOT's Enhancement Program Policy,

Roanoke County hereby agrees to provide matching funds in the amount of $59,250,
which is twenty percent (20 %) of the total project costs. The form of matching funds
may come from local cash, private contributions, donations of goods and services
and /or land value.
4. That if Roanoke County subsequently elects to cancel this project the
County hereby agrees to reimburse the Virginia Department of Transportation for the
total amount of costs expended by the Department through the date the Department is
notified of such cancellation.

been scheduled.
Please do not expend an funds or initiate an phase of y our project, for which y ou wish to be
reimbursed, until y ou are authorized in writin b VDOT to do so. Since this is a federall funded
pro startin an project activities before securin proper authorization would jeopardize
federal participation in the entire project. These funds are for the federal fiscal y ear that be
October 1, 201 so no authorization of funds can occur before then. The current federal transportation
le (SAFETEA. -LU) expired on September 30, 2009 and we are currentl operatin under a
continuin resolution that will provide fundin throu September 30, 201 Another continuation of
SAFETEA-LU or passa of new le ma be needed before all of the Enhancement Pro
funds are available.

RESOLUTION TO ACCEPT AND APPROPRIATE GRANT FUNDING
FROM THE VIRGINIA DEPARTMENT OF TRANSPORTATION FOR
THE FISCAL YEAR 2012 — 2013 TRANSPORTATION ENHANCEMENT
PROGRAM TO HELP FINANCE THE DESIGN AND CONSTRUCTION
OF THE EASTERN SECTION OF THE ROANOKE RIVER GREENWAY
WHEREAS, in accordance with Commonwealth Transportation Board
construction allocation procedures, it is necessary that a request by resolution be
received from the Board of Supervisors of Roanoke County in order for the Virginia
Department of Transportation program to establish an enhancement project in Roanoke
County.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of
Roanoke County, as follows:
1. That it requests the Commonwealth Transportation Board to establish a
project for the construction and development of approximately two point seven (2.7)
miles of the Roanoke River Greenway in eastern Roanoke County from the Roanoke
City line to the Blue Ridge Parkway.
2. That total estimated project cost is $4,970,475. The costs associated with
the first phase of the project (which will address project design, engineering and
permitting and private land acquisition along the proposed greenway corridor) are
estimated to be $904,275. The costs associated with the second phase of the project
(construction) are anticipated to be $4,066,200.
3. Roanoke County has received fiscal year 2012 -2013 grant funding in the
amount of $152,000. In accordance with VDOT's Enhancement Program Policy,

Roanoke County hereby agrees to provide matching funds in the amount of $38,000,
which is twenty percent (20 %) of the total project costs. The form of matching funds
may come from local cash, private contributions, donations of goods and services
and /or land value.
4. That if Roanoke County subsequently elects to cancel this project the
County hereby agrees to reimburse the Virginia Department of Transportation for the
total amount of costs expended by the Department through the date the Department is
notified of such cancellation.

SUMMARY OF INFORMATION:
The petitioners, A. R. Development, L.C. & Palm Heritage Corp., are the current owners of
Lots 5, 8 and 7 and request that the fifteen foot (15') wide drainage easement be vacated
and relocated. The existing drainage easement was originally dedicated to the public by
the Hampshire Subdivision plat, recorded in Plat Book 30, Page 181. The petitioners
would like to relocate the drainage easement toward the rear of the lots to have more
usable area. County of Roanoke staff has reviewed and tentatively approved the
construction plans for the channel relocation. Final approval is pending upon the final
approval and recordation of the attached ordinance.
FISCAL IMPACT:
The costs and expenses associated herewith, including but not limited to publication,
survey and recordation costs, shall be the responsibility of the petitioners.

WHEREAS, the plat of Hampshire recorded in the Clerk's Office of the Circuit Court

public drainage easement across Lots 5, 6 and 7; and
WHEREAS, County staff has reviewed and tentatively approved the construction
plans for an alternate drainage easement, therefore the public drainage easement
described above established in Plat Book 30, page 181 will no longer be needed; and
WHEREAS, the public drainage easement is more clearly indicated as "Portion of
Existing 15' Drainage Easement Hereby Vacated" on a plat entitled "Easement Exhibit for
A. R. Development, L.C., Palm Heritage Corp. showing a portion of an existing fifteen foot
(15') public drainage easement to be vacated and a proposed new fifteen foot (15) public
drainage easement to be dedicated crossing Lots 5 through 7, Hampshire, PB 30, Page
181" dated 8/27/12 and prepared by Balzer and Associates, Inc., attached hereto as
Exhibit A; and
WHEREAS, A.R. Development, L.C. & Palm Heritage Corp. (the "Petitioners ") are
the current owners of Lots 5, 6 and 7 and have petitioned the County to vacate and
relocate this drainage easement

WHEREAS, no other property owner will be affected by the vacation and relocation
of this public utility easement; and
WHEREAS, this vacation and relocation will not involve any cost to the County and
the affected County departments and public utilities have raised no objection; and
WHEREAS, notice has been given as required by Section 15.2 -2204 of the Code of
Virginia (1950, as amended); and
THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That pursuant to the provisions of Section 18.04 of the Roanoke County
Charter, the acquisition and disposition of real estate can be authorized only by ordinance.
A first reading of this ordinance was held on September 11, 2012, and a second reading
and public hearing of this ordinance was held on September 25, 2012.
2. That pursuant to the provisions of Section 16.01 of the Roanoke County
Charter, the subject real estate (fifteen foot (15') wide public drainage easement, which was
dedicated by plat of Hampshire recorded in Plat Book 30, page 181 and shown on the
attached Exhibit A) is hereby declared to be surplus and the nature of the interests in real
estate renders it unavailable for other public use.
3. That the subject real estate (fifteen foot (15') wide public drainage easement,
which was dedicated by plat of Hampshire recorded in Plat Book 30, page 181 and shown
on the attached Exhibit A) be, and hereby is, vacated pursuant to Section 15.2 -2272 of the
Code of Virginia, 1950, as amended.

4. That the Petitioners have dedicated by deed of easement and the County
hereby accepts a new fifteen foot (15) public drainage easement crossing Lots 5 through 7,
all as shown on Exhibit A.
4. That all costs and expenses associated herewith, including but not limited to
publication, survey, deed of easement and recordation costs, shall be the responsibility of
the Petitioners.
5. That the County Administrator, or any Assistant County Administrator, is hereby
authorized to execute such documents and take such actions as may be necessary to
accomplish the provisions of this ordinance, all of which shall be on form approved by the
County Attorney.
6. That this ordinance shall be effective on and from the date of its adoption, and a
certified copy of this ordinance shall be recorded in the Clerk's Office of the Circuit Court of
Roanoke County, Virginia, in accordance with Section 15.2 -2272 of the Code of Virginia
(1950, as amended).

COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
The Roanoke County Department of Social Services is housed in the former Salem
Bank and Trust Building located at 220 East Main Street, Salem, Virginia. The
Department employs over ninety (90) people that provide services to not only Roanoke
County but the Town of Vinton and the City of Salem. On -site parking is currently
limited to thirty -four (34) spaces for employees and clients combined.
Stellar One Bank leases the first floor of the Salem Bank and Trust Building from the
County and also owns nearby property to include a parking lot directly adjacent to the
Social Services offices and their existing on -site parking area. Currently, the Bank
privately leases spots in this lot to individual tenants. Staff has negotiated a lease with
Stellar One Bank for thirty -two (32) of the spaces in this lot. The initial lease term is two
(2) years. The Bank has signed the lease effective November 1, 2012 pending Board
approval and a subsequent thirty (30) day notification to current renters.
FISCAL IMPACT:
The rent for the initial two (2) -year lease is Seven Hundred Twenty Dollars ($720) per
month for all thirty -two (32) spaces ($22.50 per parking space). The lease is renewable

for additional one (1) year periods upon mutual agreement of Stellar One Bank and the
County. The total monthly rent would increase by Twenty -Five Dollars ($25) for each
renewal year. Funds are available for this lease within the Salem Bank and Trust
Building Account. This account was established in order to self- maintain the operations
of this facility and is funded by rents from the Commonwealth of Virginia for Social
Services, other building tenants, and the leasing of rooftop communication antenna
locations to private companies.
STAFF RECOMMENDATION:
Staff recommends approval of an ordinance for execution of this lease by the Board.

ORDINANCE APPROVING A LEASE WITH STELLARONE BANK FOR
THIRTY -TWO (32) PARKING SPACES OF A LOT LOCATED AT 200
EAST CALHOUN STREET IN SALEM, VIRGINIA
WHEREAS, the Roanoke County Department of Social Services (employing over
ninety (90) people and providing services to Roanoke County, the Town of Vinton and
the City of Salem) is housed in the former Salem Bank and Trust Building located at 220
East Main Street, Salem, Virginia; and
WHEREAS, the first floor of the Salem Bank and Trust Building is leased by
Roanoke County to StellarOne Bank; the Bank owns nearby property, which includes a
parking lot located directly adjacent to the Department of Social Services offices and the
Department's existing on -site parking area consisting of thirty -four (34) spaces; and
WHEREAS, staff has negotiated a lease of thirty -two (32) additional parking
spaces from the Bank for use by the employees and clients of the Department of Social
Services; and
WHEREAS, no other suitable parcels or tracts of land are available for lease or
sale to use for parking facilities to serve Social Services staff and clients near the Salem
Bank and Trust Building.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That pursuant to the provisions of Sections 2.01 and 2.03 of the Charter of
Roanoke County, the County is authorized to acquire property, including the lease of
real estate; and,

2. That pursuant to the provisions of Section 18.04 of the Charter of
Roanoke County, the acquisition of any interest in real estate shall be accomplished by
ordinance, the first reading of this ordinance was held on August 28, 2012, and the
second reading of this ordinance was held on September 11, 2012.
3. That the execution of an agreement with StellarOne Bank to lease thirty-
two (32) parking spaces in a parking lot located at 200 East Calhoun Street, Salem,
Virginia, for use by Social Services staff and clients is hereby authorized.
4. That the lease term shall commence on November 1, 2012, and continue
for a period of two (2) years, with the option to renew for an additional successive one
(1) -year periods, upon the same terms and conditions contained in the agreement,
unless terminated as provided in the agreement.
5. That the base rent shall be the sum of $720.00 per month ($22.50 per
parking space), with a $25.00 per month annual increase upon renewal of the lease
after the initial two (2) -year term.
6. That payment of rent shall be made from the funds available in the Salem
Bank and Trust Account.
7. That the County Administrator, or an Assistant County Administrator, is
authorized to execute such documents and take such actions on behalf of the Board of
Supervisors in this matter as are necessary to accomplish the lease of this property, all
of which shall be approved as to form by the County Attorney.

This LEASE AGREEMENT, made and entered into this day of September, 2012, by
and between STELLARONE BANK, Grantor, hereinafter referred to as
"Landlord" and the BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, a political
subdivision of the Commonwealth of Virginia, its successors or assigns, Grantee, hereinafter
referred to as "Tenant ".
wITNESSETH
That for and in consideration of the premises and the mutual covenants contained
herein, the parties agree as follows:
1. Leased Premises - The Landlord hereby rents and leases to the Tenant and the
Tenant hereby rents and hires from the Landlord, in accordance with the terms and conditions
set forth in this agreement, the following real property, herein referred to as the "premises " , to-
wit:
A portion of that tract or parcel of real estate containing 32 parking spaces of a
parking lot located at Zoo E. Calhoun Street, Salem, Virginia, bounded by
Calhoun Street and Colorado Street, said parcel designated as City of Salem Tax
Map #106 -013 -009.
Z. Term of Lease - The term of this lease shall be for a period of two (2) years, said
term to commence on November 1, 2012, and continue until October 31, 2014. The Tenant shall
have the option to renew this Lease for additional successive one (1) year terms, upon the same
terms and conditions contained in this agreement; said lease will be renewed automatically
each year unless the Tenant provides written notice to the Landlord on or before the 30th day
of August of the current renewal term. Either party may terminate this lease by providing six
(G) months written notice as provided in Section 13. Notices
3. Rental -- The Tenant shall pay as rent the sum of Seven Hundred Twenty Dollars
($720) per month ($22.50 per parking space), for the initial two year term and shall be payable
each month in advance by Tenant to Landlord at Stellar one Accountin 590 Peter efferson
Parkway, Suite 250. CharlottesvilleVA 22911 without demand therefore. The rent shall
increase Twenty -five Dollars ($25.00) per month annually upon renewal beginning on
September 1st of each year. The Tenant's obligation to pay is subject to annual appropriations
being made for such purpose by the governing body of the County of Roanoke.
4. Taxes -- During the term of this Lease, Landlord shall remain responsible for the.

payment of all taxes and assessments imposed on the premises; provided, however, that Tenant
agrees to pay the amount of any real estate tax increase which is directly attributable to
improvements made to the premises by the Tenant (County).
S. Use and Possession - It is understood and agreed by the parties that the
premises are to be used, during the term of this lease, for the purpose of parking or storing
motor vehicles, and may include the construction of certain improvements by the Tenant for

any related purposes. Any structures or other improvements placed upon the property by the
Tenants shall remain the property of the Tenant and may be removed at any time prior to the
expiration of this Agreement, but such removal shall not deemed an abandonment or waiver of
Tenant's rights under this Agreement. Tenant agrees not to install underground storage
facilities for petroleum products on the property.
6. Condition - The Tenant has examined and knows the condition of the premises
and accepts same in its current condition. Tenant acknowledges that no representation as to
the condition or repair of the Premises thereof has been made by the landlord, except as
provided for herein. The premises shall be returned to the Landlord at the expiration of this
lease in its current condition and state of repair, with allowance for ordinary wear and tear.
7. Liabilities - During the term of this Lease, Tenant will provide and pay for all
utilities which may be necessary to Tenant for the reasonable and proper use and enjoyment of
the demised premises by the Tenant. Landlord agrees to grant such approvals to the utility
companies as may be necessary for the installation of utility services.
8. Insurance - Tenant convents that it shall, during the term of this lease, keep in
full force and effect a policy of public liability insurance or such comparable self-insurance as
may be authorized by the laws of the Commonwealth of Virginia with limits of at least
$1,000,000 for personal injury to or death of any one person and $2,000,000 for injury to or
death of more than one person in any one occurrence and $100,000 for property damage.
9. Land ord Covenants - Landlord covenants and represents that it has the full
and complete ownership of the lease premises; that it has the full power and right to execute
this lease and to perform the obligations hereunder; that no private restrictions exist with
respect to the said premises or the use thereof; that no one, exclusive of the Landlord and
Tenant and their respective successors in interest, has any interest in or claim against the leased
premises; and that the proposed use of the leased premises by the Tenant is lawful and
permissible under all laws and regulations.
10. Sale of Premises - In the event that the Landlord sells the lease premises to any
party other than the Tenant, the sale and conveyance thereof will result in the termination of
this lease. Notice to terminate due to sale of premises shall be given 180 days in advance.

12. Agent - Landlord acknowledges that no real estate agent was involved in this
transaction and agrees to indemnify and hold Tenant harmless from any claim for a commission
by reason of any action on Landlord's part.
13. Modification - This Agreement represents the entire understanding between
the parties and may not be modified or changed except by written instrument executed by the
parties.
14. Governing Law - This Agreement shall be construed under the laws of the
Commonwealth of Virginia and shall be binding upon the parties hereto, their heirs, personal
representatives, successors and assigns.
15. Authors - This Lease Agreement is executed by the County Administrator of
Roanoke County by authority and on behalf of the Board of Supervisors of Roanoke County,

SUMMARY OF INFORMATION:
This is the second reading and public hearing for an ordinance to protect the integrity of the
environmental remediation measures at the Dixie Caverns Landfill Superfund site. This
ordinance has been requested by the United States Environmental Protection Agency
(EPA).
The County Attorney has been negotiating the drafting of this ordinance with the attorneys
for the EPA. EPA is requiring this ordinance in order to complete its 'Five (5) year review of
this closed -out Superfund site. The County Attorney has coordinated the development of
this ordinance with the County Engineer.
The attached ordinance amends chapter 2 of the Roanoke County Code by incorporating
institutional controls over this property by adding definitions, prohibited uses, permitted
uses and penalties for Violations. These provisions limit the permissible uses, while
protecting the integrity of the environmental remedial measures undertaken by the County
15 -20 years ago.
The first reading of this ordinance was held August 28, 2012.

PROHIBITING CERTAIN ACTIVITIES FOR THE PURPOSE OF
PROTECTING THE INTEGRITY OF THE REMEDIAL MEASURES AT
THE DIXIE CAVERNS LANDFILL SUPERFUND SITE
WHEREAS, the first reading of this ordinance is scheduled for August 28, 2012
and the second reading and public hearing is scheduled for September 11, 2012.
BE IT ORDAINED AND ENACTED by the Board of Supervisors of
Roanoke County, Virginia as follows:
Section 1. Chapter 2 "Administration" is amended by the addition of a new Article VII
"Closed Landfill, Institutional Controls" as follows:
§2 -150. Background and Legislative Intent
A. Roanoke County operated the Dixie Caverns County Landfill as a disposal site
for municipal refuse, solvents and fly ash from 1965 to 1976. From 1967 to 1975
electric arc furnace air emission control dust (fly ash) from Roanoke Electric Steel
Corporation was disposed at this site. When this landfill was closed in 1976 it was not
capped. The site lies on a relatively steep ridge complex between two steep valleys,
each of which contains an intermittent stream. The property consists of approximately
74.9 acres, 39 acres of which were used for the landfill, located at Dixie Caverns in
Roanoke County, Virginia, together with undeveloped land, and is identified as Tax
Parcel Number 063.00 -01- 14.00 -0000 (hereinafter referred to as "Dixie Caverns
Landfill ").
Four areas at this landfill required remediation: a drum disposal area, the solvent
contaminated sludge pit, the fly ash disposal area and a stream area. In 1987 Roanoke
County entered into a Consent Agreement and Order with the Environmental Protection
Agency (EPA) to clean up this site. A removal action was performed in 1988 to dispose
of the drums and the contaminated sludge from the sludge pit.
Dixie Caverns Landfill became a Superfund Site when it was listed on the National
Priorities List in October 1989.

The Site was the focus of two Removal Actions and two Records of Decision (RODs).
The only waste remaining at the Site is contained in a landfill area of the Site specifically
constructed for it, as "concrete -like" stabilized blocks, and in a small pocket of fly ash -
contaminated sediments, securely entombed deep in an inaccessible stream bank.
This site was delisted from the National Priorities List in September 2001.
§ 2 -151. Definitions.
Unless the context clearly indicates otherwise, the meaning of the following terms and
phases used in this Ordinance shall be as follows:
A. "Property" shall mean the real property located within the property identified as
the Dixie Caverns Landfill, as more specifically described as Tax Map Parcel Number
063.00-01-14.00-0000.
B. "Owner" shall mean the Person, custodian, guardian, trustee, caretaker, executor
administrator in whose name the deed for the Property, or any portion thereof, is titled.
C. "Person" shall mean any individual, partnership, company, corporation,
association, corporate political body, joint ownership or any other entity.
§ 2 -152. Prohibition.
It shall be unlawful for any Owner, lessor, lessee or occupier of the Property, or any
other Person to engage in any activities on the Property that would in any manner
disturb or interfere with the environmental remedial systems at the Property, including,
without limitation, the landfill cap, gas vents, monitoring wells, leachate
collection and conveyance system, and security measures, such as fencing, that
prevent access to the Property. The prohibited activities include, but are not limited to
the following:
A. Digging in or disturbance of the landfill cap, tampering with hardware or
equipment associated with the gas vents, monitoring wells, leachate collection and
conveyance systems or the security fencing.
B. Any use of leachate generated at the Property including, without limitation, any
activities that could cause exposure to contaminants in the leachate via ingestion, vapor
inhalation or dermal contact.
C. Digging in or disturbance of the landfill cap including, without limitation, any
activities that could result in contact with contaminants in the soils at the Property
through ingestion, inhalation or dermal contact.
D. No digging and /or construction at the Monofill where the stabilized sediments and
soils are located.

E. Ground water monitoring wells should not be disturbed, and no drinking water
wells should be installed.
F. The leachate collection system and leachate collection tanks should not be
disturbed.
§ 2 -153. Permitted Uses.
The Owner is permitted to use the Property for its firing range, driving range,
other related training facilities and any other lawful uses, so long as these uses do not
disturb or interfere with the environmental remedial systems at the Property or as
otherwise prohibited by Section 2 -152.
§ 2 -154. Enforcement - Violations and Penalties.
A. In addition to any other remedy available under law or in equity, any
Person convicted of a violation of this Article shall be subject to a criminal fine in an
amount not to exceed $1,000.00 per day per violation or suffer imprisonment for a
period of not more than 30 days, or both, together with costs of prosecution. Each 24-
hour period during which a violation continues shall constitute a separate offense.
Enforcement of this Ordinance shall be brought by action filed in the General District
Court or Circuit Court for the County of Roanoke. The County Attorney may assume
the prosecution with the consent of the Commonwealth's Attorney All fines and
penalties collected for violation of this Ordinance shall be paid over to the County
General Fund. Nothing in this section shall prohibit the County from enforcing the
provisions of this Ordinance by any other remedy available at law or in equity. The
remedies provided herein shall be cumulative and concurrent and shall be in addition to
any other remedies available to the township at law or in equity.
Section 2 - Severability. In the event that any section, sentence, clause, phrase or word
of this Ordinance shall be declared illegal, invalid or unconstitutional by any court of
competent jurisdiction, such declaration shall not prevent, preclude or otherwise
foreclose enforcement of any of the remaining portions of this Ordinance.
Section 3 - Repealer. All Ordinances or parts of Ordinances inconsistent herewith or in
conflict with any of the specific terms enacted hereby, to the extent of said
inconsistencies or conflicts, are hereby specifically repealed.
Section 4 - Effective Date. This Ordinance shall become effective from and after the
date of its adoption.

Jesse Freedman, Hollins Magisterial District, was appointed to fill the unexpired term
of Bryan Pettenger. This term will expire August 31, 2012. Mr. Freedman has been

The two -year term of Thomas A. Rotenberry, who is the designee of Richard Flora,

WHEREAS, during his time serving Roanoke County, Mr. Bryant Served as a Parks
Maintenance Equipment Operator I for the care of our parks and county maintained
properties by operating large mowing equipment, loaders, graders, tractors, and specialty
equipment that offered the public the safe and attractive use of our ballfields, greenways,
playgrounds, shelters, and landscaping, and where as he last served as a Parks Crew
Leader to work with and supervise park staff for the continued care of park facilities to
improve the quality of life for the citizens of Roanoke County and our visitors; and
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke
County, Virginia expresses its deepest appreciation and the appreciation of the citizens of
Roanoke County to GARY L. BRYANT, for eighteen (18) years and four (4) months of

SUMMARY OF INFORMATION:
On an annual basis, the Virginia Department of Education (VDOE) allocates funds for
school divisions for secondary Career and Technical Education (CTE) equipment.
Roanoke County Schools estimated a budget appropriation of $17,224.48. The VDOE has
notified RCPS that the appropriation for this year is $22,697.60. Staff recommends a local
supplemental appropriation of $5,473.12.
- rhe state recognizes credentialing reimbursements for CTE industry certification
examinations, licensure tests, and occupational competency assessments for students
enrolled in C classes and who are eligible for such examinations. Staff requests the
appropriation of $14,875.84 from the VDOE for the CTE industry certification examinations.
The Jobs for Virginia Graduates (JVG) Grant's mission is to assist youth who are
disadvantaged and not achieving in school to complete high school as well as secure and
retain quality jobs. Roanoke County Schools received a JVG grant in the amount of
$21,000. Staff recommends an appropriation in the full amount of the grant award:
$21,000.
The school budget currently contains a $140,000 revenue line item for the Perkins Grant.
The Virginia DOE notified RCPS that the actual grant amount will be $146,238.69. Staff
recommends supplemental appropriation of $6,238.69.

SUMMARY OF INFORMATION:
This resolution authorizes the permanent dedication of a reserve area for purpose of
stormwater management at the Green Ridge Recreation Center. In the process of
construction of the Green Ridge Recreation Center, a reserve area and drainage reserve
areas for purposes of stormwater management, access and maintenance, was designated
and set apart on the County's property, Tax Map # 026.18 -01- 15.00. This reserve area is
more clearly shown on an exhibit titled as "Map of Access and Storm Water Management
Reserve Area, attached as Attachment A.
As the County cannot legally convey an easement to itself, the recording of a deed
restriction will serve the purpose of providing public notice of the dedication of this reserve
area. In the event of any subsequent disposition of this property by the County, any deed
or conveyance will be required to include this restriction upon any future ownership.
FISCAL IMPACT:
No fiscal impact to Roanoke County is anticipated.

CATAWBA MAGISTERIAL DISTRICT
WHEREAS, Roanoke County has constructed the Green Ridge Recreation Center
located on County owned property on Woodhaven Road, Catawba Magisterial District; and
WHEREAS, the County of Roanoke desires to permanently designate and restrict
the use of portions of its property for purposes of a reserved area for stormwater
management, access and maintenance, identified as comprising portions of Tax Map
#026.18 -01 -15.00 as necessary for the completion and occupation of the County's Green
Ridge Recreation Center, as shown on the plat entitled "Map of Access and Stormwater
Management Reserve Area" prepared by Roanoke County Community Development
Department dated August 2012 and attached as Attachment A; and
WHEREAS, the proposed designation of this certain reserve area for purposes of
stormwater management, access and maintenance, will serve the interests of the public
and is necessary for the public health, safety and welfare of the citizens of Roanoke
County.
THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That pursuant to the provisions of Section 10.1 -1701 of the Code of Virginia,
the County of Roanoke, as a public body defined in Section 10.1 -1700 of said Code, may
acquire and designate property to be retained for use as open -space and for the

preservation of such real estate. A reading of this resolution was held on September 11,
2012.
2. That pursuant to the provisions of Section 16.01 of the Roanoke County
Charter, the interest in real estate to be restricted and preserved for public uses shall be
permanently reserved and dedicated in connection with the construction of Roanoke
County's Green Ridge Recreation Center.
3. That the recordation of a permanent deed restriction for purposes of
designating and setting apart a stormwater management, access and maintenance area,
as the reserve area designated on the above - mentioned map, on the County's property
(Tax Map #026.18 -01- 15.00) on which is located the Green Ridge Recreation Center, is
hereby authorized and approved.
4. That the County Administrator is hereby authorized to execute such
documents and take such further actions as may be necessary to accomplish this deed
restriction, all of which shall be on form approved by the County Attorney.
5. That this resolution shall be effective on and from the date of its adoption.

the BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, a political subdivision of
the Commonwealth of Virginia, Grantor.

WHEREAS, the County of Roanoke, Virginia, is the owner of a certain parcel of real
estate comprising 11.650 acres, located adjoining Woodhaven Road, State Route 628 in the
Catawba Magisterial District of Roanoke County, and further designated as Tax Map
#026.18 -01- 15.00 -0000, upon which the said County has constructed the Green Ridge
Recreation Center; and
WHEREAS, current stormwater management laws and regulations of the
Commonwealth of Virginia require Roanoke County to develop and reserve in perpetuity a
new stormwater management facility area in connection with the construction of the Green
Ridge Recreation Center; and
. WHEREAS, the County of Roanoke intends to maintain, protect and preserve, in
perpetuity, certain portions of said real estate parcels designated as a "New Variable Width
Permanent Stormwater Management Reserve Area," containing 42,566 square feet as
shown on Attachment A.
WHEREAS, the County of Roanoke, as Grantor, intends to accomplish the
maintenance, protection and preservation of these designated areas for the expressed
purposes which are in furtherance of the goal of the Commonwealth of Virginia to enhance
the quality of our State's waters through appropriate stormwater and flood control

measures by restricting the use of these areas as hereinafter set forth; and
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, desires to create a
public record of the intended formal designation of these enumerated areas by placing a
deed restriction and attached plat of survey of this real estate in the official land records
maintained by the Clerk of the Roanoke County Circuit Court.
NOW THEREFORE, in recognition of the foregoing expressed purposes and in
consideration of the public benefit to the citizens of Roanoke County which shall result
from this public deed restriction, the Grantor does hereby grant and dedicate portions of
the real estate parcel described below which are designated as "New Variable Width
Permanent Stormwater Management Reserve Area," containing 42,566 square feet as
shown on Attachment A.
The Grantor retains the right to construct such structures and grading as shall be
necessary to create the designated stormwater access and maintenance areas, to perform
normal maintenance and repairs to maintain the said designated areas for their intended
uses.
The designations and restrictions contained in this deed restriction shall be binding
upon the Grantor and its successor in interest and any subsequent purchaser or grantee of
this Property and shall continue as a servitude running with the Property. The Grantor
shall include such designations and restrictions in any subsequent deed or conveyance of
its ownership of all or any part of said Property
The Board of Supervisors of Roanoke County reserves the right to amend the
designations and restrictions set forth in this deed restriction when such actions shall
further the objectives herein set forth. Such amendment shall be adopted after opportunity

for public comment by formal action of the Board of Supervisors consistent with
procedures then in place for vacation or substitution of easements or similar actions
involving public property.
Although it is the Grantor's intention that this deed restriction will benefit the public
as described above, nothing contained herein shall be construed to convey to the public, or
any member thereof, a right of access to or use of the Property without the express written
consent of the County of Roanoke. The Grantor retains the exclusive right to such access
and use, subject to the terms hereof.

SUMMARY OF INFORMATION:
The Colonial Avenue /Penn Forest Boulevard Roundabout was constructed as part of a
series of Six Year Plan improvements to Colonial Avenue in 2009. The Virginia
Department of Transportation (VDOT) landscaped the roundabout shortly thereafter. Much
of the landscaping planted is now dead and what survived is overrun with weeds.
T.J.S Enterprises, Inc., a County landscaping business, contacted County Staff in May
about replanting and taking over maintenance responsibilities for the roundabout for five
years. SignaNge recognizing T.J.S Enterprises will be installed as part of this project. These
activities fall under the Virginia Department of Transportation (VDOT) Comprehensive
Roadside Management Program. This program requires the local governing body to hold a
public hearing and adopt a Resolution of Endorsement prior to project approval by VDOT.
- this project implements the 2005 Roanoke County Community Plan.
Staff will brief the Board of Supervisors on the landscaping project at the work session and
a public hearing on the project is scheduled for September 25, 2012.
