Regular meetings are held on the second and fourth Tuesday at 3:00 p.m. Public hearings are held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule will be announced. The name of this agency shall be the County of Roanoke Community Policy and Management Team, 10 hereinafter referred to as the “CPMT.” 11 12 AII–P RTICLE URPOSE 13 14 The purpose of the CPMT shall be to create, maintain and manage a collaborative system of services and 15 funding that is child-centered, family-focused and community-based that addresses the strengths and 16 needs of troubled and at-risk youth and their families who reside within the County of Roanoke as 17 empowered by Sections 2.2-5200 through 2.2-5214 of the Code of Virginia, 1950, as amended. 18 19 AIII–M RTICLE EMBERSHIP 20 21 Section 1. Membership in the CPMT in accordance with the Comprehensive Services Act for At- 22 Risk Youth and Families, §§ 2.2-5204 & 2.2-5205 of the Code of Virginia, 1950, as amended, and 23 resolution of the Board of Supervisors of the County of Roanoke, Virginia, shall be as set forth in this 24 Section 1. All designees or alternate designees of agencies or departments shall be submitted to and 25 ratified by the Board of Supervisors prior to participating in any meeting of the CPMT. 26 27 A. The local agency heads or their designees who have the authority to approve funds from 28 the following community agencies: 29 30 1. Community Services Board 31 2. Department of Health 32 3. Department of Social Services 33 4. Juvenile Court Services Unit 34 5. Roanoke County School Board 35 36 These agency heads or their designees shall serve as permanent members of the CPMT. 37 38 B. Representatives of other departments or agencies of Roanoke County as designated by 39 the Board of Supervisors: 40 41 1. An Assistant County Administrator 42 2. The Director of Finance, or designee 43 3. The Chief of the Roanoke County Police Department, or designee 44 45 These representatives shall serve at the pleasure of the Board of Supervisors and may 46 serve unlimited terms. 47 48 49 50 C. Private representatives as follows: 15 Page of 1 2 1. A representative of a private organization or association of providers of children 3 or its designee or family services ; 4 2. At least one parent advocate who is not an employee of any public or private 5 program which services children and families; 6 7 8 These private representatives shall be appointed by the Board of Supervisors and shall 9 serve for a three year term. At the initial meeting of the CPMT, the term of office of the private 10 representatives shall be chosen by lot for an initial term of one, two or three years so that all such 11 members' terms do not terminate at the same time. These private representatives shall be eligible for 12 reappointment. Each of these representatives shall annually file a statement of economic interest in 13 accordance with the requirements of the "State and Local Government Conflict of Interest Act," § 2.2- 14 3117 and 2.2-3118, of the Code of Virginia, 1950, as amended. 15 16 Section 2. The CPMT may solicit advisory personnel to assist it in achieving its objectives in 17 accordance with its approved program and mandates. Such advisory personnel shall have no voting rights 18 and shall not be considered members of the CPMT. 19 20 Section 3. The County Attorney’s Office shall provide legal representation and advice to the CPMT. 21 22 AIV–PD RTICLE OWERS AND UTIES 23 24 The CPMT, as an agency of the County of Roanoke, Virginia, and as a creation of state law, having been 25 mandated by the General Assembly, shall be subject to state and local laws and regulations established to 26 regulate its functioning, and shall have the general powers, duties and responsibilities of a policy and 27 - management team as set forth in § 2.25206 of the Code of Virginia, 1950, as amended. 28 29 A. Develop interagency policies and procedures to govern the provision of services to 30 children and families in this community. 31 32 B. Develop interagency fiscal policies governing access to the state pool of funds by the 33 eligible populations including immediate access to funds for emergency services and shelter care. 34 35 C. Coordinate long-range, community-wide planning which insures the development of 36 resources and services needed by children and families in this community, including consultation on the 37 development of a community-based system of services established under § 16.1-309.3 of the Code of 38 Virginia, 1950, as amended. 39 40 D. Establish policies governing referrals and reviews of children and families to the Family 41 Assessment and Planning Teams (FAPT) and a process to review the team’s recommendations and 42 requests for funding. 43 44 E. Establish quality assurance and accountability procedures for program utilization and 45 funds management. 46 47 F. Establish procedures for obtaining bids on the development of new services. 48 49 G. Manage funds in the interagency budget allocated to this community from the state pool 50 of funds and any other source. 51 25 Page of 1 H. Authorize and monitor the expenditure of funds by each Family Assessment and Planning 2 Team. 3 4 I. Prepare and submit grant proposals which benefit this community to funding sources that 5 meet the objectives of the team and enter into contracts for the provision or operation of services upon the 6 approval of the participating governing bodies. 7 8 J. Serve as the community’s liaison to the Office of Comprehensive Services for At-Risk 9 Youth and Families, reporting on its programmatic and fiscal operations and on its recommendations for 10 improving the service system. 11 12 K. Appoint the members of each Family Assessment and Planning Team (FAPT). 13 14 L.Establish policies to assess the ability of parents or legal guardians to contribute 15 financially to the cost of services to be provided and, when not specifically prohibited by 16 federal or state law or regulation, provide for appropriate parental or legal guardian 17 , financial contributionutilizing a standard sliding fee scale based upon ability to pay. 18 19 M.Collect and provide uniform data to the Council as requested by the Office of 20 subdivision Comprehensive Services for At-Risk Youth and Families in accordance with 21 D 16 of § 2.2-2648 of the Code of Virginia, 1950, as amended. 22 23 N.Review and analyze data to help evaluate child and family outcomes and public and 24 private provider performance in the provision of services to children and families through 25 the Comprehensive Services Act and as otherwise directed by subsection 13 of §2.2-5206 26 Of the Code of Virginia, 1950, as amended. 27 28 O.Administer funds pursuant to §16.1-309.3 of the Code of Virginia, 1950, as amended. 29 30 P.Have authority, upon approval of the participating governing bodies, to enter into a 31 contract with another community policy and management team to purchase coordinating 32 services provided that funds described as state pool of funds under § 2.2-5211of the Code 33 of Virginia, 1950, as amended are not used. 34 35 Q.Submit to the Department of Behavioral Health and Developmental Services as set forth 36 in subsection 16 of § 2.2-5206 of the Code of Virginia, 1950, as amended . 37 38 R.Establish policies for providing intensive care coordination services for children who are 39 at risk of entering, or are placed in, residential care through the Comprehensive Services 40 Act program, consistent with guidelines developed pursuant to subdivision D 22 of §2.2- 41 2648 of the Code of Virginia, 1950, as amended. 42 43 AV–OCPMT RTICLE FFICERS OF THE 44 45 Section 1. The officers of the CPMT shall be a Chair, a Vice-Chair, a Secretary, and a Fiscal Officer. 46 e. The CPMT shall elect the Chair, Vice-Chair and Secretary at the first meeting after the start of each 47 fiscal year. 48 49 Section 2. The duties of the Chair shall be as follows: 50 51 A. To preside at all meetings of the CPMT. 35 Page of 1 B. To appoint committees necessary for the operation of the CPMT. 2 C. Function as liaison to each FAPT. 3 D. To schedule meetings of the CPMT as needed. 4 E. No less often than annually, to regularly inform the Board of Supervisors of the 5 County of Roanoke and the State Executive Council for Comprehensive Services of the 6 activities of the CPMT. 7 F. To perform any other duties as directed by the CPMT. 8 9 Section 3. The duties of the Vice-Chair shall be as follows: 10 11 A. Perform the duties of the Chair during his/her absence. 12 B. Perform such other duties as delegated by the Chair. 13 C. Perform any other duties as directed by the CPMT. 14 15 Section 4. The Secretary shall see to it that accurate records of all meetings of the CPMT and any 16 Executive Committee are prepared and maintained. The Secretary shall distribute notice of any meeting 17 of the CPMT and any Executive Committee and perform such other duties as may be assigned by the 18 CPMT. In the absence of the Chair and Vice-Chair, the Secretary shall preside at meetings of the CPMT. 19 20 Section 5. The Fiscal Officer shall be the Director of Finance of Roanoke County or his or her 21 designee. The Fiscal Officer shall act as the fiscal agent for the CPMT and shall annually audit the total 22 revenues of the team and its programs as provided by § 2.2-5204 of the Code of Virginia, 1950 as 23 amended. 24 25 26 Section6. The CPMT shall have the authority to fill any vacancy occurring among the Officers and 27 to remove and replace any of the elected officers when in its best judgment such a need exists in the same 28 manner as prescribed by Article XI. 29 30 31 32 AVI–M RTICLE EETINGS 33 34 Section 1. Regular meetings shall be held at a time to be determined by the CPMT. 35 36 Section 2. Special meetings of the CPMT may be called by the Chairperson or upon the request of 37 three members. 38 39 Section 3. A quorum for a CPMT meeting shall be fifty percent (50%) of its members including one 40 of the officers. 41 42 AVII–EC RTICLE XECUTIVE OMMITTEE 43 44 Section 1. The officers specified by Article V and any additional members selected by the CPMT 45 shall constitute the Executive Committee. The officers of the CPMT shall likewise serve in their 46 respective capacities, and with the same powers and duties, with the Executive Committee. 47 48 Section 2. A quorum of the Executive Committee shall consist of three members or a constitutional 49 majority if more than five members are elected pursuant to Article VII Section 1. The Executive 50 Committee shall have the authority to conduct all necessary business of the CPMT between its meetings. 45 Page of 1 All actions of the Executive Committee shall be subject to ratification at the next regular meeting of the 2 CPMT. Necessary business such as the authorization to expend monies may be conducted by attendance 3 at a called meeting, by telephone, by fax or by other expedient means. The vote of each member shall be 4 recorded and a constitutional majority of the membership of the Executive Committee shall be required to 5 obligate or expend monies. 6 7 AVII–RO RTICLE ULES OF RDER 8 9 Robert's Rules of Order, Newly Revised shall be used as the guide for conducting the meetings of the 10 CPMT. All issues of parliamentary procedure shall be referred to the representative of the County 11 Attorney's Office whose decision shall be formal and binding. 12 13 All information regarding specific children, families or other individuals obtained by the CPMT or any 14 FAPT in the discharge of their responsibilities shall be confidential under all applicable laws, mandated 15 and licensing requirements. Any agency referring a child or family to a FAPT shall be responsible for 16 obtaining the necessary consent to share information with that team. However, the refusal of any parent or 17 guardian to execute such a consent for any child shall not limit the authority of any agency to share 18 information regarding such child and its needs with the FAPT consistent with the terms of § 2.2-5210 of 19 the Code of Virginia, 1950, as amended. 20 21 AX–L RTICLE IABILITY 22 23 above Members of the CPMT as set forth in Article IIIshall be immune from any civil liability for 24 decisions made about the appropriate services for a family or the proper placement or treatment of a child 25 who comes before the CPMT unless it is proven that such person acted with malicious intent. 26 27 AXI–A RTICLE MENDMENTS 28 29 The terms and provisions of these By-Laws may be amended at any regular meeting of the CPMT by a 30 majority vote of those present and voting, provided that notice of any proposed amendment was mailed to 31 all members at their business address at least ten (10) days prior to such meeting.
