Mahoney County Attorney ÝÑËÒÌÇ ßÜÓ×Ò×ÍÌÎßÌÑÎùÍ ÝÑÓÓÛÒÌÍæ ÍËÓÓßÎÇ ÑÚ ×ÒÚÑÎÓßÌ×ÑÒæ Supervisor Altizer has requested this work session.On August 28, 2012, during Citizen Comments, a citizen reported on problems she was experiencing from mopeds in her neighborhood and inquired as to the power of the County to address these problems. Section 46.2-100 defines a moped as follows: "Moped" means every vehicle that travels on not more than three wheels in contact with the ground that has (i) a seat that is no less than 24 inches in height, measured from the middle of the seat perpendicular to the ground and (ii) a gasoline, electric, or hybrid motor that displaces less than 50 cubic centimeters. For purposes of this title, a moped shall be a motorcycle when operated at speeds in excess of 35 miles per hour. For purposes of Chapter 8 (§ 46.2-800 et seq.), a moped shall be a vehicle while operated on a highway. Section 15.2-1720 of the Code of Virginia (copy attached) authorizes localities to license bicycles, electric power assisted bicycles, mopeds and electric assisted mobility devices. Among the various listed powers, the county could require from every resident owner a license and a license plate, prescribe a license fee, license application forms, and finally prescribe penalties for operating these bicycles, mopeds or devices on public roads without a license plate or tag or decal. Several localities have adopted local ordinances based upon this enabling legislation. For example, Roanoke City has adopted a 13 section division in its city code implementing the powers authorized by this enabling legislation.Its registration fee is $15. Meanwhile other localities have adopted ordinances that penalize violations as a traffic infraction and impose a fine of not more than $50. Page 1 of 2 Mopeds are also subject to existing traffic regulations. For example, Section 46.2-914 of the Code of Virginia imposes limitations on the operation of mopeds (cannot be driven on any highway faster than 35 MPH, cannot be driven by any person under the age of 16, cannot be operated on interstate highways). Section 46.2-905 also imposes operating requirements for bicycles, mopeds, and other similar devices. Section 46.2-915.2 also provides authority to localities to adopt an ordinance to require certain safety equipment for mopeds. Ú×ÍÝßÔ ×ÓÐßÝÌæ The Treasurer has provided the Board with a proposed fiscal impact if the Board wishes to regulate and license mopeds. ÍÌßÚÚ ÎÛÝÑÓÓÛÒÜßÌ×ÑÒæ It is recommended that the Board coordinate the consideration of adopting a local ordinance with the Police Department and with the Treasurer. It would be necessary to develop license application forms as well as license tags, plates or decals for such bicycles, mopeds and devices. There are administrative burdens such an ordinance would place on both the police department and the treasurer. for areas of the county within the urban service area with existing low-middle density residential development, with an average density of from one (1) to three (3) units per acre, and land which appears appropriate for such development. These areas are generally consistent with the neighborhood conservation land use category as recommended in the comprehensive plan. In addition, where surrounding development and the level of public services warrant, these areas coincide with the development category recommended in the plan. This district is intended to provide the highest degree of protection from potentially incompatible uses and residential development of a significantly different density, size, or scale, in order to maintain the health, safety, appearance and overall quality of life of existing and future neighborhoods. In addition to single-family residences, only uses of a community nature which are generally deemed compatible are permitted in this district.
