Good afternoon and welcome to our meeting for January 8, 2013. Regular meetings are held on the second and fourth Tuesday at 3:00 p.m. Public hearings are held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule will be announced. Mahoney County Attorney COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: Each year at the annual organizational meeting of the Board of Supervisors, the Board elects a chairman and vice - chairman. Section 3.08 of the Roanoke County Charter provides as follows: Section 3.03. Chairman and vice - chairman. — The board shall, at its first meeting in January of each year, elect one of its number as chairman, who shall preside at such meeting and all other meetings during - the term for which so elected, if present. The board also may elect a vice - chairman who shall, if so elected, preside at meetings in the absence of the chairman and may discharge any other duty of the chairman during his absence or disability. The chairman and vice - chairman shall preside for a term of one year. - rhe chairman and vice - chairman may succeed themselves in office. In the case of the absence from any meeting of the chairman and vice - chairman, the members present shall choose one of their number as temporary chairman. In addition to the compensation provided members of the board of supervisors, the board may by ordinance fix an additional sum to be paid to the chairman and vice - chairman, not to exceed the limit established by general law, without regard to the maximum salary limits. Burch Jr. Chief of Fire and Recue B. Clayton Goodman III County Administrator TSCA— COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: Public Education Specialist Brian clingenpeel of the Fire and Rescue Department has received the 2012 Governor's Award for outstanding Contribution to EMS for Children. The annual Governor's EMS Awards Program began in 1986 and has been endorsed by each Governor to recognize the outstanding contributions of individuals, agencies and community organizations and businesses that provide or help support emergency medical care in Virginia. The Governor's Awards program is administered by the Office of EMS, in cooperation with Virginia's 11 Regional EMS councils. Each Regional EMS council conducts the awards program in their community, holds an awards ceremony and publicizes the winners, bringing much needed recognition to Virginia's EMS providers and agencies. In June, Brian received the Regional EMS Award for outstanding Contribution to EMS for children and then moved on to participate at the commonwealth level. The regional winners were submitted to the Governor's EMS Awards Selection committee who reviewed the nominations and forwarded its recommendations for the Awards winners to the Governor's office. Page 1 of 2 Brian was recognized for the following: Governor's Award for outstanding contribution to EMS for children: Roanoke County Fire and Rescue's Public Education Specialist, Brian Clingerlpeel received this award because he has been instrumental in his work to establish a safe community for children in Roanoke County by dedicating much of his time to educating our young people about fire and life safety through a number of educational and instructional programs. It is Brian's tremendous efforts to reach our young children, as well as to identify at risk children, that made him worthy of receiving the award. Brian Clingenpeel has gone above and beyond service standards to provide life safety education and injury prevention for children throughout the Roanoke Valley and beyond. As with all prevention programs, it is difficult to quantify the results, but it is felt that these ongoing programs do benefit our children of today and stay with them as they grow older. Many of Clingenpeel's programs have been used as models in other areas of the Commonwealth. D -2 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: January 8, 2013 AGENDA ITEM: Recognizing Virginia Department of Forestry and Roanoke County Fire and Rescue Staff for extinguishment of forest fire on November 25, 2012 SUBMITTED BY: Richard E. Clayton Goodman III County AdministratorWJ[3r COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: On November 25, 2012 the Roanoke County Emergency Communications center received notification of a forest fire located on Bent Mountain near Willet Lane. This Fire was fast moving do to high winds and large amounts of fuel (dry wood). A number of homes were in grave danger of being destroyed. Fire /Rescue personnel and equipment responded from the following stations; Bent Mountain #8, Back Creek #11, Cave Spring #3, Mount Pleasant#5, Clearbrook #7, Fort Lewis #9, Masons Cove #10, Hollins #5 and Command Staff. The Virginia Department of Forestry (VDOF) was contacted in the first hour of the fire to provide assistance in the form of a bull -dozer to assist in cutting a fire line around the fire. Additional personnel from VDOF responded and assisted along with maintaining a crew on the scene to "mop -up" any hot spots inside the burned area to prevent further fires From jumping established fire lines. The fire was contained and all Roanoke county personnel cleared from the scene approximately 18 hours after the fire was reported. The quick response from the Fire /Rescue Department and VDOF averted any loss of life or injuries and no structures were loss. Page 1 of 1 ACTION NO. ITEM NO. Clayton Goodman III County Administrator BP;;-' COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: On February 20, 2007, Blue Hills Village, LLC (Developer), a Virginia Corporation, submitted an Erosion and Sediment Control (ESC) plan; signed a ESC agreement with Roanoke County; and was granted approval to subdivide a certain parcel of land to be known as Blue Hills Village in the Hollins Magisterial District. On August 7, 2007, the developer signed Land Subdivider's (LS) Agreement for this project. An irrevocable standby letter of credit (surety) of $23,600 was granted for ESC and another irrevocable standby letter of credit (surety) of $134,731 far the LS, both by National Bank of Virginia for said development. The Developer agreed that measures for the control of siltation, erosion and all improvements to the land within the said subdivision would be properly and satisfactorily installed and completed as provided for on the approved plans. The Developer proceeded with the development as approved by the Department of Community Development. - rhe project has been substantially completed with the exception of minor improvements to the stormwater management facility and submitting the As -Built plans to close the project. The staff has attempted to work with the developer over several months, however the developer never responded to complete its obligations. Page 1 of 2 The Bonding Committee reviewed the development file on December 12, 2012, and voted to declare that the Developer is in default based on failure to close out the project and the fact of the anticipatory default shown in the National Bank of Virginia action against the Developer. The current Land Subd ivider's Agreement letter of credit balance covers the cost of the improvement necessary for the stormwater management facility and the As -built plans. FISCAL I M PACT: The cost of completing the necessary development and the As -built plans in order to satisfy the obligations of the developer can be covered by the letter of credit # 1756 with National Bank of Virginia for this project. ALTERNATIVES: I. The Bonding Committee recommends that the Board of Supervisors schedule a public hearing on February 12, 2013, to declare that the Developer is in default of the agreements with Roanoke County to cornplete the project. II. Reject the Bonding Committee Recommendation. STAFF RECOMMENDATION: Staff recommends that the Board approve alternative I and authorize the staff to schedule public hearing on February 12, 2013. Attachment Page 2 of 2 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, JANUARY 8, 2013 RESOLUTION APPROVING AND ADOPTING THE RECOMMENDATION OF THE ROANOKE COUNTY BONDING COMMITTEE TO SET FEBRUARY 12, 2013 AS PUBLIC HEARING IN ANTICIPATION OF DECLARING THE DEVELOPER BLUE HILLS VILLAGE, LLC OF BLUE HILLS VILLAGE (LOCATED IN THE HOLLINS MAGISTERIAL DISTRICT), TO BE IN DEFAULT AND TO AUTHORIZE OFFICIALS OF ROANOKE COUNTY TO EXERCISE ITS RIGHTS UNDER THE "DEVELOPER'S SITE DEVELOPMENT AGREEMENT" AND THE ACCOMPANYING SITE DEVELOPMENT LETTER OF CREDITS WHEREAS, Blue Hills Village, LLC, a Virginia limited liability corporation (hereafter "Developer "), as developers of Blue Hills Village in the Hollins Magisterial District of Roanoke County, on or about February 20, 2007, entered into an Erosion and Sediment Control Agreement (hereafter "ESC Agreement ") with the County of Roanoke and provided an irrevocable Letter of Credit issued by National Bank of Virginia in the amount of $23,600 to insure the construction and maintenance of certain erosion and sediment control facilities in connection with the development of Blue Hills Village; and WHEREAS, the Developer subsequently, on or about August 7, 2007, entered into a Land Subdivider's Agreement with the County of Roanoke and was granted approval to subdivide a portion of the Developer's property and to record a plat of subdivision for the development to be known as Blue Hills Village and provided an irrevocable Letter of Credit issued by National Bank of Virginia in the amount of $134,731 to insure the construction, completion and maintenance of improvements to the land; and WHEREAS, the Bonding Committee for Roanoke County meeting on December 12 2012, at the Roanoke County Administration Building considered the documentation Page 1 of 2 as to the status of this subdivision project and voted to recommend that the Board of Supervisors schedule a public hearing to consider declaring the Developer to be in default and that the County take all necessary actions to collect the outstanding surety proceeds in order to complete this development. NOW THEREFORE, be it RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That a public hearing be scheduled for February 12, 2013, at 3:00 p.m. at the Roanoke County Administration Center, 5204 Bernard Drive, Roanoke, Virginia, 24018 to hear testimony and proposals from Blue Hills Village, LLC and National Bank of Virginia concerning the recommendations of the Bonding Committee to declare the Developer in default and to collect the proceeds from the letters of credit in order to complete the development of Blue Hills Village, in accordance with the Land Subdivider's Agreement. 2. That the County Administrator, the Director of the Department of Community Development, his staff and agents and the Office of the County Attorney are hereby directed to provide appropriate notices to the Developer and the Surety of this public hearing, and are further authorized to take such action as may be necessary to fully assert and defend the rights and obligations of Roanoke County in this regard. 3. This Resolution shall be in full force and effect from the date of its adoption. Page of ITEM NO. Mahoney County Attorney COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY of INFORMATION: Verizon Virginia, Inc. is requesting that Roanoke County grant them a utility line easement from an existing overhead line for purposes of an underground utility service to the Glenvar Library. The attached Exhibit A drawing prepared by Verizon Virginia, Inc. shows a "1 g' Verizon, VA. Inc. Easement" indicating the proposed location of the utility line. Staff has met with officials of Verizon on site and has determined the location of the easement will have a minimal amount of impact on County -owned property. The first reading of this ordinance was held on December 11, 2012; and the Second reading and public hearing of this ordinance will be held on January S, 2013. FISCAL IMPACT: No funding from Roanoke County will be required for this request. The Virginia Department of Health, Office of EMS has allocated funding for the specific purpose of purchasing a training manikin for the EMT - Intermediate Center. Roanoke County is the fiscal agent for the EMT -I ntermediate Training Center which is located at the Regional Fire - EMS Training on Kessler Mill Rd. This training manikin commonly referred to as "SimJunior" is a highly technical device that interfaces with computer software to simulate an actual child. The manikin generates a life -life heartbeat, pulse, and is able to breathe. This device allows paramedic students to train in more lifelike situations while honing their skills. An unlimited amount of training scenarios can be developed and programmed for a multitude of emergency health settings for the student. All equipment is included with the grant and will add to the existing training aides currently at the Training Center. Clayton Goodman III County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: The Roanoke River Greenway will be a 31 -mile bicycle /pedestrian trail through the entire Roanoke Valley, linking Roanoke County, the Cities of Roanoke and Salem, and the Town of Vinton. The greenway system has been strongly supported by citizens, businesses, civic organizations, and local governments. As such, the Roanoke Valley Greenway Commission made the Roanoke River Greenway its number one priority in the 2007 Update to the Roanoke Valley Conceptual Greenway Plan. Greenways were also strongly supported by Roanoke County citizens during development of the Department of Parks, Recreation and Tourism Comprehensive Parks Master Plan, completed in 2007. The residents of Roanoke County identified greenways as a "High Priority Need" for facilities and amenities desired in our community. The City of Roanoke has completed their section of the Roanoke River Greenway to the wastewater treatment plant. A bridge associated with this project provides connectivity of the Roanoke River and Tinker Creek Greenways. Roanoke County entered into a contract with Anderson &Associates of Virginia, Inc. (A &A) in April 2012 to provide professional Page 1 of 4 engineering services for the preliminary engineering of the Eastern Section of the Roanoke River Greenway from the wastewater treatment plant to the Blue Ridge Parkway. The project area includes land located on the south side of the Roanoke River. The greenway is estimated to be 2.7 miles in length. A &A and County staff members have made considerable progress to date on the initial stages of the preliminary design process, including meeting with all affected property owners, field reconnaissance and surveying, and conceptual design of portions of the greenway corridor. There are eleven private property owners along the south side of the Roanoke River, as well as land owned by the Western Virginia Water Authority, Appalachian Power Company, the Virginia Recreational Facilities Authority, and the National Park Service /Department of the Interior. Property owners are generally supportive of the Roanoke River Greenway and provided Roanoke County with permission to conduct surveying, engineering, and geotechnical analysis on their parcels. Issues and concerns voiced by property owners included the following: hunting, fishing, access to the river, security, safety, lighting, and hours of operation. The project team continues working with the Virginia Department of Transportation (VDOT) and the National Park Service /Blue Ridge Parkway concerning the location of a possible eastern terminus (i.e., trailhead parking area). In August 2011, the draft Environmental Assessment for the Roanoke Valley /Blue Ridge Parkway Trail Plan was released by the National Park Service (NPS). The NPS preferred Alternative C includes a connection for the Roanoke River Greenway to the Blue Ridge Parkway. Roanoke County is currently involved in discussions with staff from the Blue Ridge Parkway to develop a Memorandum of Agreement/Partnership Agreement for the greenway to cross federal land. To date, the NPS has not been supportive of an at -grade greenway crossing of the Parkway motor road, nor the location of a trailhead on NPS property. A &A has submitted a proposal to VDOT for a greenway accommodation along Highland Road. The County received funding through the VDOT Transportation Enhancement Program in 2008 2009 2011 and 2012 for the Eastern Section of the Roanoke River Greenway. The County currently has $716,250 committed to this project (a combination of VDOT funds and County match); however, additional funds are needed to cover the costs associated with the project design, engineering, permitting, private land acquisition, and construction. A summary of the VDOT Enhancement funding allocated for this project is provided below. Under the recently enacted MAP -21 federal transportation bill, the Transportation Enhancement Program (EN) is now part of the Transportation Alternatives (TA) Program. This year, VDOT is accepting applications for existing projects that have received Enhancement Program allocations in past years. Staff would like to apply for additional funding to complete Phase I (design, engineering, permitting, and right -of -way acquisition) and Phase II A (construction from Roanoke City line to the Harner property). FISCAL IMPACT: In accordance with the Transportation Enhancement Program, the federal share of the funding is 80 percent, requiring a match of twenty percent (20 %) from state funds. VDOT's Enhancement Program Policy requires the matching share of state funds to come from the sponsoring locality. This can be in the form of local cash, private contributions, donation of goods and services, and /or land value. Staff recommends applying for approximately $868,518 in grant funding which will require a local match of $217,129. It is anticipated that the match amount will be partially fulfilled with the value of donated right of way; therefore, reducing the fiscal impact to Roanoke County. A tentative work session is planned on January 22, 2013, to review year -to -date (6 months) revenue collections and departmental expenditures and to update revenue projections for the current year (fiscal year 2013) and next year's budget development (fiscal year 2014).
