Clayton Goodman III County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION Staff is requesting authorization to amend and extend the A &E contract with Holzheimer, Bolek and Meehan for the Glenvar Library to ensure that all construction is accomplished successfully. The project is well within budget; however there is a two (2) month delay from the original project schedule necessitating the extension of these services. The substantial completion date for the project is now March 23, 2013, with final completion expected by the end of April. We are scheduling a May 6, 2013, opening for the new Glenvar Library. One (1) month of the delay was caused by extending the estimated construction period at the front end of the construction to allow the contractor sufficient time to complete the work. The second month was due to a delay in the delivery of storefront and window materials by the manufacturer. The contractor has agreed to compensate the County for this delay. Normally contract changes of this type are within the oversight of County Administration as all necessary funds have already been appropriated to the project budget. However, as we added construction management services to the contract after the A &E contract was approved, combined change orders to the contract total in excess of twenty -five (25 %) of the original amount. According to County procurement regulations and the Procurement Code of Virginia, change orders exceeding more than twenty -five percent (25 %) must be approved by the Board of Supervisors. Staff is requesting the authority to add $20,405.64 Page 1 of 2 for two (2) months of construction management services and one month of contract administration. In addition, we are also requesting the ability to extend the contract one additional month for another $12,405.64 should continued services be necessary after April 30 2013. Finally we are requesting to add $2,000 for reimbursable expenses, primarily travel costs. This would make the maximum change up to $34,811.24. Of this amount, $15,480.92 is being credited back to the County by the general contractor due to the need to extend their schedule. The remaining $19,330.36 is available in the project contingency accounts. This change will bring the total contract amount for A &E and construction management services to $556,609.08. FISCAL IMPACT There is no project budget impact as the $34,811.28 is available in the project budget. $15,480.92 will be recovered as a credit from the General Contractor for a schedule extension. Therefore up to $19,330.36 will come from previously appropriated and available project funds. RECOMMENDATION Staff recommends the approval of a contract modification not to exceed $34,811.28 for the contract with Holzheimer, Bolek and Meehan for an extension of construction management and project administration services to ensure the successful completion of the new Glenvar Library. Clayton Goodman III County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: HyperGen, Inc is a growing technology company that provides IT consulting services and software solutions to companies throughout the United States. They have been in business in the Roanoke area since 1992 and have grown substantially during this time. After extensive analysis of available sites in the region, HyperGen has decided to construct a 10,000 sq. ft. corporate office building on two point five (2.5) acres on Waldrond Drive off of Plantation Road in Roanoke County. HyperGen is planning a $1.5 million investment in personal property and a new modern facility, to accommodate their current and future growth needs. They currently employ twenty (20) people with high skill level requirements in Management Information Systems, Software Engineering and Computer Science fields, with projections to grow their business by up to thirty percent (30 %) within the next two (2) years. The company also pays wages in excess of the County's median wage rate by up to forty percent (40 %). To assist with their expansion, a four- party performance agreement has been negotiated between Roanoke County, Roanoke County Economic Development Authority, HyperGen, Inc. and 4D Investments, LLC. This agreement will promote and encourage the expansion Page 1 of 2 of this high tech company, and provide increased employment and corporate investment in Roanoke. The agreement allows for an economic development grant in an amount equal to two years of new local tax revenue to be reimbursed to the company after the new facility is built. New local tax revenue is defined as new real estate and business license and personal property taxes generated annually by the project, not to exceed to $75,000 in total. This is consistent with the County's Public Private Partnership Policy. If the company generates less than the estimated new local tax revenue, then the actual grant for that year shall be less. The two -year period will commence on January 1, 2014. FISCAL IMPACT: Per the performance agreement, the grant will be calculated as a reimbursement based on new tax revenues generated by the project; therefore, the fiscal impact will be in the form of foregone revenue. No new funding is needed for this project. STAFF RECOMMENDATION: Staff recommends authorizing the execution of a performance agreement between the County of Roanoke, the Roanoke County Economic Development Authority, HyperGen, Inc. and 4D Investments, LLC. Clayton Goodman III County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: Staff has tentatively renegotiated the lease with Valley Electric Supply, owner of the rented space currently being used to house the temporary Glenvar Library. The amendment will provide fora month to month renewal after March 31, 2013. The original lease provided for a six (6) -month automatic renewal, but the temporary space will only be needed until April 30 2013, as the construction project will be substantially complete. Therefore, the County will be saving $1,500 per month for five (5) months, or a total of $7,500 by amending the lease. The landlord is agreeable to this change as long as we provide a two month notice, which staff plans to do near the end of February. Alternatives Alternative One — Alternative one is to approve the amendment to the lease with Valley Electrical Supply to provide for month to month extensions after March 31, 2013, and save Roanoke County $1,500 per month. Alternative Two — Alternative two is to deny approval of the amendment and allow the lease to automatically renew for six months after March 31, 2013. Page 1 of 2 Staff Recommendation Staff recommends approval of Alternative One in order to decrease rental costs for temporary library space by $1,500 per month. That the Board hereby accepts and appropriates grant funds in the amount of $341,000 from the Virginia Department of Transportation for - Fiscal year 2612 -2613, and matches the grant award with $85,266; and 2. Ext (Route 690) to the end of it's cul -de -sac 0.23 50 28 13 ROANOKE COUNTY ACCEPTANCE OF WATERSTONE DRIVE INTO THE DEPARTMENT OF VIRGINIA DEPARTMENT OF TRANSPORTATION SECONDARY SYSTEM COMMUNITY DEVLOPMENT AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINSITRATION CENTER ON JANUARY 22, 2013 RESOLUTION 012213 -3.f REQUESTING THE VIRGINIA DEPARTMENT OF TRANSPORTATION (VDOT) TO DESIGNATE LANCASTER ROAD, ROUTE 708, AS A RURAL RUSTIC ROAD IN THE VDOT SECONDARY SYSTEM, WINDSOR HILLS MAGISTERIAL DISTRICT WHEREAS, Section 33.1 -70.1 of the Code of Virginia, permits the improvements and hard surfacing of certain unpaved roads deemed to qualify for designation as a Rural Rustic Road; and WHEREAS, any such road must be located in a low- density development area and have a minimum of fifty (50) vehicles per day (vpd), and have no more than one thousand (1,000) vpd; and WHEREAS, the Board of Supervisors of Roanoke County, Virginia ( "Board ") desires to consider whether Lancaster Road, Route 708 from: from the intersection with Fortune Ridge Road, Route 690 to: dead end of Lancaster Road, Route 608 should be designated a Rural Rustic Road; and WHEREAS, the Board is unaware of pending development that will significantly affect the existing traffic on this road; and WHEREAS, the citizens that utilize this road have been made aware that this road may be paved with minimal improvements; and WHEREAS, the Board believes that this road should be so designated due to its qualifying characteristics and will endeavor to retain these characteristics through its comprehensive planning process; and WHEREAS, this road is in the Board's Revenue Sharing Program for improvements to the secondary system of state highways; and Page 1 of 2 NOW lfHEREFORE, BE IT RESOLVED, that the Board herby designates this portion of Lancaster Road as a Rural Rustic Road, and requests that the Residency Administrator for the Virginia Department of Transportation concur in this designation; and BE IT FURTHER RESOLVED, that the Board requests that this road be hard surfaced and, to the fullest extent prudent, be improved within the existing right of way and ditch -lines to preserve as much as possible the adjacent trees, vegetation, side slopes, and rural rustic character along the road in their current state; and BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to the Residency Administrator for the Virginia Department of Transportation. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, as follows: Page 1 of 3 1. That the Commonwealth Transportation Board approve a project for the development and construction of approximately two point seven (2.7) miles of the Eastern Section of the Roanoke River Greenway between the City of Roanoke and the Blue Ridge Parkway. 2. That the total project costs associated with Phases I and IIA of the project (which will address project design, engineering and permitting, private land acquisition, and construction along the proposed greenway corridor) are estimated to be $1,085,647. Roanoke County requests grant funding in the amount of $868,518, which is eighty percent (80 %) of the total unfunded cost of Phases I and IIA of this project. Roanoke County agrees to pay matching funds of $217,129, which is twenty percent (20 %) of the total unfunded cost of Phases I and IIA of this project. 3. That if Roanoke County subsequently elects to cancel this project the County agrees to reimburse the Virginia Department of Transportation for the total amount of costs expended by the Department through the date the Department is notified of such cancellation. 4.
