Audio and video recordings of this meeting will be held on file for a minimum of five (5) years in the office of the Clerk to the Board of Supervisors. IN RE: OPENING CEREMONIES Before the meeting was called to order an invocation was given by Dr. Maurita Wiggins of Valley Community Church. The Pledge of Allegiance was recited by all present. IN RE: CALL TO ORDER Chairman Altizer called the meeting to order at 3:04 p.m. The roll call was taken. MEMBERS PRESENT: Chairman Michael W. Altizer; Supervisors Joseph B. Jacks, Clerk to the Board IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS AND AWARDS 1. Resolution expressing the appreciation of the Board of Supervisors of Roanoke County to Sue Smith, Communications Officer, upon her retirement after more than twenty -seven (27) years of service (Bill Hunter, Director of Communications and Information Technology) The Clerk read the resolution. In attendance for this recognition were: Bill 276 July 9, 2013 Hunter, Director of Communications and Information Technology; Sue Smith, Communications Officer and Joey Stump, Division Chief. All Supervisors offered their congratulations and thanks. RESOLUTION 070913 -1 EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO SUSAN M. SMITH, COMMUNICATIONS OFFICER II, UPON HER RETIREMENT AFTER TWENTY -SEVEN (27) YEARS OF SERVICE WHEREAS, Susan M. Smith was hired on May 31, 1986, and has worked as a Dispatcher, Communications Officer, Lead Communications Officer and Communications Officer II during her tenure with Roanoke County; and WHEREAS, Ms. Smith retired on June 1, 2013, after twenty -seven (27) years of devoted, faithful and expert service with the County; and WHEREAS, during her time serving Roanoke County, Ms. Smith, who began her career working for the Sheriff before there was a 911 system in Roanoke, has supported both citizens and first responders through fire, floods and earthquakes as the calm reassuring voice behind the radio and telephone. Ms. Smith has been a trainer and mentor to a whole new generation of Communications Officers, participating in their selection, background investigations, and both classroom and on- the -job training. Her knowledge and professionalism have been recognized by her peers, police, fire and the American Red Cross. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to SUSAN M. SMITH, for twenty -seven (27) years of capable, loyal and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. On motion of Supervisor Altizer to adopt the resolution, and carried by the following roll call and recorded vote: AYES: Supervisors Moore, Church, Elswick, Altizer NAYS: None ABSENT: Supervisor Flora IN RE: NEW BUSINESS 1. Resolution of the Board of Supervisors of the County of Roanoke, Virginia declaring its intention to reimburse itself from the proceeds of a financing for certain costs of the Glenvar High School Renovation Project (Rebecca Owens, Director of Finance) July 9, 2013 277 Ms. Owens outlined the resolution. The following representatives from the school were in attendance: David Wymer, School Board member from the Catawba Magisterial District; Dr. Lorraine Lange, School Superintendent; Penny Hodge, Assistant Superintendent of Finance; Martin Misicko, Director of Operations. Mr. Wymer spoke on the need for renovations to Glenvar High School. Supervisor Church reiterated Mr. Wymer's remarks regarding the Glenvar community. There was no discussion. RESOLUTION 070913 -2 OF THE BOARD OF SUPERVISORS OF THE COUNTY OF ROANOKE, VIRGINIA, DECLARING ITS INTENTION TO REIMBURSE ITSELF FROM THE PROCEEDS OF A FINANCING FOR CERTAIN COSTS OF THE GLENVAR HIGH SCHOOL RENOVATION PROJECT The Board of Supervisors of the County of Roanoke, Virginia (the "County ") have determined that it may be necessary or desirable to advance money to pay the costs associated with the Glenvar High School Renovation Project (the "Project "). NOW THEREFORE, BE IT RESOLVED, BY THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, as follows: 1. The Board of Supervisors adopts this declaration of official intent under Treasury Regulations Section 1.150 -2. 2. The Board of Supervisors reasonably expects to reimburse advances made or to be made to pay the costs of designing, acquiring, constructing and equipping the Project from the proceeds of its debt or other financing. 3. This resolution shall take effect immediately upon its adoption. On motion of Supervisor Church to adopt the resolution, and carried by the following roll call and recorded vote: AYES: Supervisors Moore, Church, Elswick, Altizer NAYS: None ABSENT: Supervisor Flora 2. Reappointment of Special Assistant for Legislative Relations; authorization to continue an agreement and transfer of previously appropriated funds in the amount of $32,400 (Katherine Jones, Senior Assistant County Attorney) A- 070913 -3 Ms. Jones outlined the request. Supervisor Church commented Eldon James and Associates have done a wonderful job. Fees are in line, benefited from his hours. 278 July 9, 2013 Chairman Altizer commented the way we do business with State government has changed a great deal over the years and requires the need for an agreement with a special assistant for legislative issues. On motion of Supervisor Church to approve the staff recommendation to reappoint Eldon James and Associates and appropriate the necessary funds from Board Contingency carried by the following roll call and recorded vote: AYES: Supervisors Moore, Church, Elswick, Altizer NAYS: None ABSENT: Supervisor Flora IN RE: FIRST READING OF ORDINANCES 1. Ordinance approving agreements between the County of Roanoke and Roanoke County Schools for use of space on tower sites for County Schools radio equipment and accepting and appropriating six hundred dollars ($600) to the County radio replacement fund (Bill Hunter, Director of Communications and Information Technology) Mr. Hunter outlined the request for the ordinance. Chairman Altizer requested Mr. Hunter to check on easements for having access and advise at the second reading. Upon motion of Supervisor Church to approve the first reading and set the second reading for June 25, 2013, motion was carried by the following roll call and recorded vote: AYES: Supervisors Moore, Church, Elswick, Altizer NAYS: None ABSENT: Supervisor Flora 2. Ordinance appropriating $4,256.70 to the Clerk of the Circuit Court from the Commonwealth of Virginia for fiscal year 2012/2013 (Rebecca Owens, Director of Finance) Ms. Owens outlined the request for the ordinance. There was no discussion. Upon motion of Chairman Altizer to approve the first reading and set the second reading for June 25, 2013, the motion was carried by the following roll call and recorded vote: July 9, 2013 279 AYES: Supervisors Moore, Church, Elswick, Altizer NAYS: None ABSENT: Supervisor Flora 3. Ordinance appropriating $380,000 to the Social Services budget for fiscal year 2012 -2013 (W. Brent Robertson, Director of Management and Budget) Jimmy Lyons, Budget Analyst outlined the ordinance for the appropriation for Social Services. There was no discussion. Upon motion of Supervisor Church to approve the first reading and set the second reading for June 25, 2013, motion was carried by the following roll call and recorded vote: AYES: Supervisors Moore, Church, Elswick, Altizer NAYS: None ABSENT: Supervisor Flora 4. Ordinance of the Board of Supervisors of the County of Roanoke, Virginia, authorizing the issuance and sale of its General Obligation Refunding Bond and appropriating anticipated upfront savings of approximately $508,000 to Solid Waste Department (Rebecca Owens, Director of Finance) Ms. Owens outlined the request for the ordinance authorizing the issuance and sale of its General Obligation Refunding Bond and applicable appropriation. She added this was a follow -up from prior work session. She advised that the bid was sent to ten (10) banks and after consideration it was determined that Wells Fargo had the most competitive bid with a fixed rate option of two point three eight percent (2.38 %), which would yield savings of approximately $58,000. Chairman Altizer commented the interest rates on the bonds to be refinanced were at four and one half to five percent (4 % to 5 %) and we would basically be cutting the rate in half for the next eight (8) years. Upon motion of Chairman Altizer to approve the first reading and set the second reading for June 25, 2013, the motion carried by the following roll call and recorded vote: AYES: Supervisors Moore, Church, Elswick, Altizer NAYS: None ABSENT: Supervisor Flora 280 July 9, 2013 5. Ordinance appropriating $65,000 to General Services capital maintenance account for repairs at the Roanoke County Courthouse Complex (Anne Marie Green, Director of General Services) Ms. Green outlined the request for the ordinance. Chairman Altizer asked the second reading be waived due to safety precautions. Chairman Church concurred. Supervisor Elswick asked if people were still walking under the affected area with Ms. Green advising the area had been cordoned off. There was no further discussion. ORDINANCE 070913 -4 APPROPRIATING $65,000 TO GENERAL SERVICES CAPITAL MAINTENANCE ACCOUNT FOR REPAIRS AT THE ROANOKE COUNTY COURTHOUSE COMPLEX WHEREAS, on July 9, 2013, the Board of Supervisors of Roanoke County heard a request to appropriate $65,000 from the Minor Capital Account to the General Services Capital Maintenance Account; and WHEREAS that request was made in order to repair the brick soffit at the Roanoke County Courthouse Complex; and WHEREAS, Section 18.04 of the Roanoke County Charter provides that funds be appropriated by ordinance; and WHEREAS, first reading of this ordinance was held on July 9, 2013, and the second reading of this ordinance has been dispensed with since an emergency exists, upon a 4 /5ths vote of the members of the Board. BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the sum of $65,000 is hereby appropriated from the Minor Capital Account to the General Services capital maintenance account for the repairs to the brick soffit at the Roanoke County Courthouse Complex; and 2. That this ordinance shall take effect from and after the date of adoption. Social Services Advisory Board (appointed by District) Vice Chairman Charlotte Moore recommended the reappointment of Ms. Beckner to represent the Cave Spring district. Ms. Becker has agreed to an additional four -year term to expire July 31, 2017. Confirmation of this appointment has been placed on the Consent Agenda for consideration by the Board. Supervisor Church has recommended the reappointment of Ms. Tawney to represent the Catawba district. Ms. Tawney has agreed to an additional four -year term to expire July 31, 2017. Confirmation of this appointment has been placed on the Consent Agenda for consideration by the Board. IN RE: CONSENT AGENDA RESOLUTION 070913 -5 APPROVING AND CONCURRING IN CERTAIN ITEMS SET FORTH ON THE BOARD OF SUPERVISORS AGENDA FOR THIS DATE DESIGNATED AS ITEM H- CONSENT AGENDA BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: That the certain section of the agenda of the Board of Supervisors for July 9, 2013, designated as Item H - Consent Agenda be, and hereby is, approved and concurred in as to each item separately set forth in said section designated Items 1 through 6 inclusive, as follows: 1. POWELL, LAND USE COMPLIANCE COORDINATOR, UPON HER RETIREMENT AFTER MORE THAN EIGHTEEN (18) YEARS OF SERVICE WHEREAS, Jane B. Powell was hired on September 20, 1994, and has worked as an Instructor with Parks and Recreation, Customer Services Representative , Land Use Compliance Coordinator in the Real Estate Valuation Office during her tenure with Roanoke County; and WHEREAS, Ms. Powell retired on July 1, 2013, after eighteen (18) years and nine (9) months of devoted, faithful and expert service with the County; and WHEREAS, during her time serving Roanoke County, Ms. Powell showed exemplary customer service skills as both a Customer Service Representative and Land Use Compliance Coordinator to both internal and external customers of the Real Estate Valuation Department. She made many visits to Land Use participant's property and brought a true professionalism to her position. Many of the participants were on a first name basis with her as she guided many elderly land use participants through the revalidation process. Jane made countless roll back estimates for real estate closings concerning land use with no complaints at closing that the numbers were incorrect. She was a member of the VAAO during her entire career with the Real Estate Valuation Office. Jane served as a member of the Use Value Committee with distinction for four years. Jane also served on the Executive Committee for the county United Way Campaign for four years, and an Office Captain from the Real Estate Valuation Office for twelve years. During her years as an aerobics instructor for Roanoke County Parks and Recreation, she has taught many county employees and gained quite a following for her classes. We will miss her weekly health tips for nutrition and exercise within our office; but mostly, we will miss Jane for who she is. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to JANE B. JACKSON, SENIOR LIBRARY ASSISTANT, UPON HER RETIREMENT AFTER MORE THAN TWENTY -FIVE (25) YEARS OF SERVICE WHEREAS, Joanne S. Jackson was hired as a Library Page on August 24, 1987; and WHEREAS, during her tenure with Roanoke County, Ms. Jackson went on to hold a series of responsible positions, earning promotions to Library Assistant, and later to Senior Library Assistant; and WHEREAS, Ms. Jackson retired on July 1, 2013, after twenty -five (25) years and ten (10) months of devoted, positive and expert service with the County; and WHEREAS, throughout her employment, Ms. Jackson consistently showed herself to be an intelligent and resourceful staff member, devoting her best efforts to providing excellent customer service in whatever capacity she served; and WHEREAS, Ms. Jackson's management skills were repeatedly demonstrated in her role as Senior Library Assistant at the Hollins Branch Library, during which time she worked seamlessly with several branch librarians, thereby guaranteeing the branch operated efficiently and maintained its reputation for having a proficient, friendly and knowledgeable staff; and WHEREAS, in 1993, Ms. Jackson provided stability and guidance throughout the long process of remodeling the library, ensuring that the branch never closed, despite extremely challenging circumstances; and WHEREAS, Ms. Jackson also willingly accepted additional duties within the library system, most notably acting as the resident expert on the Roanoke Valley Library's shared automation software, and even resolving functional or reporting issues for partner systems in the consortium; and WHEREAS, when it came time to prepare for the opening of the South County Library, Ms. Jackson again stepped forward and accepted a new set of responsibilities, helping to acquire and organize thousands of new materials for the collection prior to the library's opening day; and WHEREAS, throughout all her years of service, Ms. Jackson has been a valued colleague and trusted friend to those who worked with her. 284 July 9, 2013 NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to JOANNE S. CUNDIFF, DEPUTY CIRCUIT COURT CLERK III, UPON HER RETIREMENT AFTER MORE THAN EIGHT (8) YEARS OF SERVICE WHEREAS, Janet L. Cundiff was hired on March 3, 2005, and has worked as a Deputy Circuit Court Clerk I, Deputy Circuit Court Clerk II and Deputy Circuit Court Clerk III during her tenure with Roanoke County; and WHEREAS, Ms. Cundiff retired on July 1, 2013, after eight (8) years and four (4) months of devoted, faithful and expert service with the County; and WHEREAS, during her time serving Roanoke County, Ms. Cundiff handled many estate matters and law cases in a very compassionate, precise and professional manner, frequently earning the admiration and praise of the general public and her co- workers ; and NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to JANET L. CUNDIFF for more than eight (8) years of capable, loyal and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. On motion of Supervisor Altizer to adopt the resolution, and carried by the following roll call and recorded vote: AYES: Supervisors Moore, Church, Elswick, Altizer NAYS: None ABSENT: Supervisor Flora July 9, 2013 285 A- 070913 -5.d A- 070913 -5.e RESOLUTION 070913 -5.f ESTABLISHING AN ADVISORY CITIZEN COMMITTEE KNOWN AS THE "ROANOKE COUNTY STORMWATER ADVISORY COMMITTEE" (RCSAC) WHEREAS, Roanoke County is committed to involving its citizens in the development of projects and processes that impact their quality of life; and WHEREAS, the County is evaluating its stormwater management and related services to determine the best approaches to meet citizens' needs and to meet the upcoming unfunded state and federal mandated stormwater requirements; and WHEREAS, Section 18.02 of the County Charter provides that the Board of Supervisors may establish such advisory boards and commissions as it deems necessary for the purposes of advising the board and the county administrator; and WHEREAS, as a part of the ongoing evaluation of the best approaches to provide stormwater and related services, a Roanoke County Stormwater Advisory Committee (RCSAC) will be formed to provide a means for key community stakeholders from the County of Roanoke and the Town of Vinton to be involved in the decision - making process. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia as follows: 1. That there is hereby established an advisory citizen committee known as the "Roanoke County Stormwater Advisory Committee" (RCSAC). 2. The objective of the RCSAC is to make recommendations on the following: • Stormwater management priorities • Appropriate and affordable level of service • Level of interest in public participation in stormwater management program activities • Preliminary stormwater management needs assessments • Preliminary regulations and policies; Preliminary financial requirements and funding mechanisms. Members of the RCSAC will also represent the views of their constituencies, assist staff in its understanding of community goals and issues through open dialogue and discussion and assist staff in presenting RCSAC recommendations to the Board of Supervisors, when appropriate. The RCSAC is an advisory committee. Committee recommendations may be accepted, rejected, or accepted with modifications by the Board of Supervisors. 3. That Roanoke County staff will work with the RCSAC to reach the following objectives: 286 July 9, 2013 • Educate the RCSAC on the County's current and anticipated stormwater management program needs and expenses • Ensure that stakeholder concerns and views are identified, understood, and considered • Address key issues and concerns expressed by RCSAC members; • Encourage consensus on relevant issues, policies and recommendations, where possible. • Present RCSAC recommendations to the Board of Supervisors 4. That the RCSAC will be appointed by the Board of Supervisors and be composed of representatives of key stakeholders from across a broad spectrum of community interests including: • Residents, civic leagues, homeowner associations; • Institutional and tax - exempt entities, including colleges and churches • Business community, including residential, commercial and industrial property owners, malls, and business groups; • Special interest groups that represent economic development, environmental and outdoor recreation. Approximately twenty -five (25) RCSAC members are anticipated, as well as alternate members. The County desires that the same stakeholder representatives be actively involved throughout the project. Continuity will aid in the effectiveness of the process. In the event that a participant is unable to attend one or more meetings, a designated alternate may be assigned. In the event that neither is able to attend a meeting, their input should be submitted to the staff prior to the meeting. 5. That the roles and responsibilities of County staff are as follows: • Provide adequate background information to allow participation • Provide overviews /presentations on the key issues • Facilitate and act as a resource for the main discussion and breakout sessions • Identify ways in which stakeholder recommendations have influenced the study process 6. That the roles and responsibilities of the RCSAC members are as follows: • Review materials presented • Identify key concerns and issues • Provide and present input, advice and feedback on pertinent issues • Explore potential areas of agreement around key issues • Provide advice on the most effective method of involving the general public at key points in the project • Participate in all meetings July 9, 2013 287 7. That the regular meetings will be held monthly on the first (1 Thursday of the month, from 6 pm to 8 pm. Meeting locations are to be determined. Public hearing meetings will be held in election magisterial district. 8. That this Resolution shall be effective immediately. On motion of Supervisor Altizer to adopt the resolution, and carried by the following roll call and recorded vote: AYES: Supervisors Moore, Church, Elswick, Altizer NAYS: None ABSENT: Supervisor Flora IN RE: REQUESTS FOR PUBLIC HEARINGS 1. Request for public hearing to establish the Roanoke Valley Broadband Authority (B. Clayton Goodman III, County Administrator) Mr. Goodman explained the reason for the request. There were no objections. Public hearing was scheduled for August 27, 2013. IN RE: CITIZENS' COMMENTS AND COMMUNICATIONS The following citizens spoke. Noah Tickle of 1603 Frosty Lane in Salem, Virginia stated attacking carbon dioxide is hate speech against GOD'S nature and nature's GOD. The more you really examine the scientific truth about carbon dioxide rather than the politically charged "hate speech" against nature being spewed by people like Al Gore, the more you realize CO2 is a crucial nutrient for the Earth's environment and ecosystem. In fact, the vast majority of all the CO2 released into the atmosphere is produced by nature via animals in the ocean. Anyone who criticizes CO2 is attacking ocean life and condemning trillions of aquatic creatures who exhale carbon dioxide as part of their natural respiration. As a society interested in reforestation, expanding the diversity of plant life, nourishing trees and re- greening deserts, we should no longer tolerate anyone engaged in hate speech against Nature and CO2. Those who attempt to demonize this critical nutrient for the planet are engaged in a kind of hate - motivated foolishness against plants. Nobody spews more doom and gloom than Al Gore and the global warming crowd who paint the end of earth's future if we all don't start paying carbon taxes to the various bureaucrats. Bureaucrats buy into it because it is used by them as a method build on their tax and spend industrial complex. It is a political scam from the UN NGO socialist sustainabilists to control all of humanity. They need to practice more positivity and repeat to themselves affirmations like: "CO2 is a nutrient for forests. "CO2 is produced by ocean 288 July 9, 2013 life." Perhaps by staying positive, the global warming fear mongers and doom - and - gloomers can calm down, take a few breaths (with extra CO2) and recognize that what's good for plants is good for the planet. In fact, I'm going to hyperventilate after a little just to generate a little extra CO2 for the world. I love plants, especially my tomato plants. One of the fear mongers is here present among us: the International Council of Local Environmental Initiatives aka ICLEI. Let's de -fund ICLEI now. We do not need them or their carbon hate calculator. RoxAnne Christley of 7259 Willow Lane in Roanoke, Virginia stated since we've just celebrated our Country's Independence on the fourth of July, she would like to bring the Board's attention to our American Revolution against the Crown of England. Our Declaration of Independence was a bold statement, but it was also very well reasoned with grievances against tyranny that resonate timelessly. One of those grievances was taxation without representation and so we ended up with a Republic that provided us with that necessary representation. However, that Republic is failing on every level as the representation given over the years has fallen prey to every foible known to man. Greed, power, notoriety, and personal agendas are the antithesis of representing a constituency on any level of government, to include our own right here in Roanoke County. She would like to ask this Board: Where is the citizen's true representation when this Board determines it is in our best interests to spend millions of our hard earned dollars through a debt process without our consent? Where is our representation when a Capital Improvement Project is accelerated past the Planning Commission's recommendations without taxpayer consent? Where is the representation when you engage with NGO's that have in fact become policy makers in our County? Where is the taxpayer representation when political appointees are made to Committee's that recommend policy to this Board -that would include the School Board amongst others? Where is the citizen representation when you raise real estate assessments and so tax us again? Where is our representation when YOU decide to raise tax rates on anything? Our representation in Roanoke County is a failure by the same majority she mentioned at the last meeting. It isn't because you aren't working within the confines of the law, it is because you purposefully ignore your constituency and defy the spirit of our Constitution to do whatever YOU think best, according to your own personal agendas. Independence Day has significant meaning that cannot be forgotten. As a concerned citizen, I would end with a quote that we all should be familiar with: "Power corrupts, absolute power corrupts absolutely!" Treasurer's Statement of Accountability per Investment and Portfolio Policy as of May 31, 2013 IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Elswick stated he would like to give congratulations to Luke Hancock who was one of twelve (12) chosen to represent us in the World University Games. Luke is not only a good athlete and a great representative for the County, but is a really nice young man. He then advised he wanted to talk a little bit about mandates. He advised what is bothering him is that it seems like from a number of different directions, we are getting people telling us what we have to do. Sometimes you wonder, do they really have that authority and you wonder if we are really going to object to that. There are those that would say that we cannot object to the EPA doing actions that are going to cost us millions of dollars with the control of stormwater. He does not know why we shouldn't object, we have been working real hard, spending lots of money in recent years to clean the streams and the rivers and control the water to the best extent that our budgets would allow. Now they are saying you have to go further and if you don't have the money, well then pass it on to the taxpayers. That has to stop at some point in time because the tax payers cannot afford every whim that our federal and state governments think of. He has not seen any research that indicates there are major problems or if there are, where are they in Roanoke County that we would need to do an extensive allocation of funds to do more in terms of stormwater management. He stated he would like to recommend that we object to whomever initiated the stormwater requirements and say, where are we going to get the money our people don't have it, do you have it. Well, you say it is a law and you cannot do anything about; every day our government is ignoring the laws. If you look at what has happened recently with the healthcare, where the government says people don't have to be eligible to get health care under Obamacare, they are taking that out completely and saying all you have to do is apply, we are not going to check into whether or not you are eligible, that is against the law as it was written by Congress. I guarantee Congress is 290 July 9, 2013 not going to stand up and say, "Wait, Mr. President you cannot act against the law." Well, if he can do it, why cannot we. The latest requirement from the State is on the control of scrap. He hauls his scrap to Joe Whitlow a couple or three times a year and it is usually automobile parts and things that a person will generate. Now, he has to have a permit to do that. He is tired of having to get a permit to do everything; where will that lead? There is a better way to handle. Supposedly the law was written to control thievery of copper and aluminum from houses that are being built or stealing of air conditioners from locations and selling them to salvage yards for aluminum and copper. It would be a whole lot simpler to ask the salvage yards to keep a log of whose bringing in a lot of aluminum and copper and then once a month have a policeman go look at the log and see that "John Doe" has brought in five loads of copper this month rather than having every citizen of the County who wants to go to the scrap yard and take their stuff, which is good thing for the environment, it would be much easier to control it that way and the salvage yards know who these thieves are and they can help the police find out who is doing it. The average citizens should not have to go get a permit. Our hearts go out to the families of firefighters who lost their lives in Arizona. Our people face the same kind of thing on occasion and you have to really feel for those people who lost their lives in Arizona and appreciate what our firefighters do for us. Supervisor Moore invited everyone to a Stormwater Management Meeting, which will be held at the South County library on July 18 at 7:00 p.m. Mary Dell with DEQ and David Henderson and County staff will be available to answer your questions about stormwater and why it is so important to manage it. Supervisor Church stated he too wanted to congratulate Luke Hancock. He thinks we all have kind of adopted him here in Roanoke County. As many of you know, he was on his way to the tryout in Colorado when he father died. Upon news that he made the USA team, he sent him a text never expecting to hear anything back, when he received, "Thanks a lot Mr. Church; I am on my way to Russia." What a great young man. I sent him another text when he scored fifteen (15) points the day before yesterday when USA beat the Czech Republic. Here you go, you have a young man from Roanoke County that is the epitome of everything good in high school and college sports right from our own school district and did not expect to get a text back from the Soviet Union or Czech Republic, but thinks that he knows we are all pulling for him and are proud of what he has done, not only on the basketball court, but off the court. Additionally, he congratulated the Glenvar community. As we mentioned earlier in our meeting today, we had a great event on July 1 St in Glenvar, we danced around Diana Rosapepe, we danced around the weather, as you know it has been raining nine out of the last prior ten day so we were able to have a little bit of cooperation and had a wonderful crowd. There were estimates of 300 to 350 people. He thanked each of the Board members for being there; the community appreciates them being there. It is something the Glenvar community has been waiting for over a dozen years and they are so excited to see the kids faces and watch them go to the children's center and use the computers with the colorful keyboards and just have a computer and just have their July 9, 2013 291 own room. According to Diana Rosapepe, our Director of Library Services, we have had circulation of over 900, which is about triple the average in Glenvar, 530 people average per day, which is more than double and 95 new library cards just since July 1 st This tells him the people are excited and he fully expects it to continue to grow. We are even hearing overtones from the City of Salem, "what is going on." They are getting itchy feet for a new library in the City of Salem so now they are coming down. He really expects it to continue to grow and prosper and cannot say how proud he is of the staff and the entire crowd that showed up and the expectations in Glenvar. Supervisor Altizer commented the dedication of the Glenvar library was absolutely wonderful. Mr. Church made a comment that it looked like a Friday night football game, it did, because everybody was coming down the street and walking up the walkway. It was great and just goes to prove that with libraries anyway, if you build it they will come. They have done it in South County, now in Glenvar and feel sure they are going to do it in Vinton. It was a great occasion. IN RE: CLOSED MEETING At 4:00 p.m., Supervisor Altizer moved to go into closed meeting following the work sessions pursuant to the Code of Virginia Section 2.2 -3711 A 1, Personnel, namely discussion concerning appointments to the Stormwater Committee The motion carried by the following recorded vote: AYES: Supervisors Moore, Altizer, Church, ElswickNAYS: None ABSENT: Supervisor Flora The closed session was held from 4:47 p.m. until 5:20 p.m. At 4:01 pm. Chairman Altizer recessed to work session and closed meeting. IN RE: WORK SESSIONS 1. Work session to discuss recycling (Anne Marie Green, Director of General Services) In attendance for this work session were: Anne Marie Green, Director of General Services, Nancy Duvall, Solid Waste Manager and B. Clayton Goodman, County Administrator. The work session was held from 4:15 p.m. until 4:42 p.m. Ms. Green went through a PowerPoint presentation outlining the current recycling conditions. A copy of the presentation is on file in the office of the Clerk to the Board of Supervisors. Ms. Green updated the Board on curbside recycling with private 292 July 9, 2013 companies and then advised the problem with Cycle Systems, who will no longer take recycling. RIDS is now doing for free but will not continue much longer. She requested direction from the Board as this will have a budget impact. Supervisor Elswick inquired if these private companies are really recycling. Ms. Green confirmed that they recycling, and that metal was not an issue. Supervisor Church advised his only concern is how Stormwater Management is going to impact the budget. He would hate to venture out on an aggressive campaign not knowing where stormwater management is going to lead us money wise. He stated he feels that when the private companies are rolled out, some citizens will say that the County should be providing this for free. He is okay as long as we do not begin an aggressive campaign and then have to stop it. Ms. Green commented General Services could have a $30,000 to 55,000 budget hit depending on how much recyclables we take to RIDS and wanted to make sure the Board was comfortable with that. Chairman Altizer stated so we were getting $28,500 a year and saving $47.00 a ton with Ms. Green confirming. Chairman Altizer reiterated it will cost us $10,500 and increased fuel. Anne Marie confirmed and stated it may be a slower process because of taking and dropping off. Chairman Altizer then reiterated so in real money it could cost the County $40,000. Ms. Green agreed but stated a lot of people might start changing to the curbside, which they are paying for and are not bringing to our drop off point. Supervisor Church inquired if staff has projected the number they will need to have for that to happen. Ms. Green responded negatively because these companies are already doing it. There biggest concern is they may get flooded with too many requests. Chairman Altizer inquired what is the tonnage if we threw it all in the landfill; how many tons? Ms. Green stated if we took the 500 tons at $47.00 a ton, it was could the County $23,500 at the landfill. So, it is probably going to cost $10,000 to $15,000 with RIDS not including transportation costs. It will still be cheaper, but both of these figures are numbers we are not paying right now. Chairman Altizer stated the first thing is do we continue to do what we have been doing, what is the number of reconciliation. If we are going to continue to do it, it is going to cost us $15,000 to $18,000 and then we are going to have $23,000 to $28,000 go to the landfill. It is a no brainer to do this one versus taking it all to the landfill. He stated he is comfortable with that. He then asked what have the proposed private companies said about how they would handle the increase in customers. Ms. Green responded they may not pick up as often, may need to go to the bank and expand their business. Chairman Altizer stated he would like to have that in concrete. Mr. Elswick asked if citizens went to the private companies would they get any type of refund with Mr. Goodman advising no, it would be more of a convenience not having to haul to the recycling bins. Ms. Moore asked how much the trailers cost and did they do research on July 9, 2013 293 whether it is feasible to have businesses put their names on the trailers. Ms. Green responded they have not gotten that far, but the trailer costs about $8,000 and the only way we could agree is if they would agree to pull it. It was the consensus of the Board to continue as they have in the past and to discuss again at another work session sometime in September. Mr. Goodman reiterated that staff would move forward with the two vendors that are prequalified. IN RE: CERTIFICATION RESOLUTION At 5:20 p.m., Supervisor Altizer moved to return to open session and adopt the certification resolution. RESOLUTION 070913 -6 CERTIFYING THE CLOSED MEETING WAS HELD IN CONFORMITY WITH THE CODE OF VIRGINIA WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and WHEREAS, Section 2.2 -3712 of the Code of Virginia requires a certification by the Board of Supervisors of Roanoke County, Virginia, that such closed meeting was conducted in conformity with Virginia law.
