E-1 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: August 26, 2014 AGENDA ITEM: Request for authorization to execute a performance agreement between the County of Roanoke, the Roanoke County Economic Development Authority and Allstate Insurance Company and Affiliates, Catawba Magisterial District SUBMITTED BY: Jill Loope Director of Economic Development APPROVED BY: Daniel R. O'Donnell Interim County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: Allstate Insurance Company has been operating at the 1819 Electric Road location in Roanoke County for forty-three (43) years. This location supports Allstate's technology, claims and call center needs, which is an important component of their business operations. The iconic 147,000 sq. ft. building on Electric Road is larger than the company requires today, twice the size of the proposed new facility. For this reason, the company has chosen to construct a more modern facility that better meets their current needs. After extensive analysis of multiple sites throughout the Roanoke Valley, Allstate has decided to construct a 70,000 sq. ft. 3 -story facility on a 7.5 acre site at 1745 Loch Haven Road and Interstate 81 in Roanoke County. This highly visible location will promote Allstate's corporate image on the interstate, while providing convenient access for their employees. Allstate's employment is projected at 515 positions, some of which are home- based. To assist with the project, a three -party, performance agreement has been negotiated between Roanoke County, the Roanoke County Economic Development Authority and Allstate Insurance Company. This agreementwill assist Allstate with theirsite development and infrastructure related costs and provide new capital investment in Roanoke County, while also assisting with the retention of 515 high qualityjobs at an average annual salary Page 1 of 2 of $40,000+ per year. The agreement allows for an economic development grant in an amount equal to eighteen (18) months of new local tax revenue to be reimbursed to the company. New local tax revenue is defined as net new real estate and business personal property taxes generated by the project. The total amount of the grant shall not exceed $300,000. The agreement also allows for the extension of a water line to the property line of the site in an amount not to exceed $30,000. This is consistent with the County's Public Private Partnership Policy. If the company generates less than the estimated new local tax revenue, then the actual grant for that year shall be less. The eighteen (18) month period will commence on January 1, 2016. FISCAL IMPACT: Per the performance agreement, the grant will be calculated as a reimbursement based on new tax revenues generated by the project in an amount not to exceed $300,000; therefore, the fiscal impact will be in the form of foregone revenue. The water line extension shall be paid through the County's Public Private Partnership Fund, and is limited to $30,000. STAFF RECOMMENDATION: Staff recommends that the Board authorize the Interim County Administrator, or any Assistant County Administrator, to execute on behalf of the County a performance agreement between the County of Roanoke, the Roanoke County Economic Development Authority and Allstate Insurance Company. Cooper Construction, Incorporated" dated February 20, 2001, and recorded in the Clerk's Office of the Circuit Court of Roanoke County, Virginia, (Plat Book 24, Page 38) dedicated a fifteen foot (15') wide public utility easement across a parcel identified as Lot 75 (Tax Map #044.03-09-12.00-0000); and WHEREAS, the current owner of the property, David Kilbane, has requested that the fifteen foot (15') wide public utility easement located along the rear and side property lines be vacated in order to remove that encumbrance on his property for the purpose of building a garage in the north corner of the property; and WHEREAS, County staff has reviewed and approved the vacation this fifteen foot (15') public utility easement as shown on the exhibit (Exhibit "A") attached hereto and entitled "Easement plat for David Kilbane showing hereon an existing 15' public utility easement to be vacated (Tax Map #044.03-09-12.00-0000) prepared by Balzer and Associates, Inc.; and WHEREAS, no other property owner will be affected by the vacation of this public utility easements, and this vacation will not involve any cost to the County, and the affected County departments and public utilities have raised no objection; and Page 1 of 3 WHEREAS, notice has been given as required by Section 15.2-2204 of the Code of Virginia (1950, as amended); and THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That pursuant to the provisions of Section 18.04 of the Roanoke County Charter, the acquisition and disposition of real estate can be authorized only by ordinance. A first reading of this ordinance was held on August 12, 2014, and a second reading and public hearing of this ordinance was held on August 26, 2014. 2. That pursuant to the provisions of Section 16.01 of the Roanoke County Charter, the subject real estate, a fifteen foot (15') wide public utility easement, which was dedicated by plat of The Highlands (Plat Book 24, Page 38) is hereby declared to be surplus and the nature of the interests in real estate renders it unavailable for other public use. 3. That the subject real estate, a fifteen foot (15') wide public utility easement, located along the rear and side property line, which was dedicated by plat of The Highlands (Plat Book 24, Page 38) be, and hereby is, vacated pursuant to Section 15.2-2270 of the Code of Virginia 1950, as amended. 4. That all costs and expenses associated herewith, including but not limited to publication, survey and recordation costs, shall be the responsibility of the Petitioner. 5. That the County Administrator, or any Assistant County Administrator, is hereby authorized to execute such documents and take such actions as may be necessary to accomplish the provisions of this ordinance, all of which shall be on form approved by the County Attorney. That this ordinance shall be effective on and from the date of its adoption, subject to receipt of consent letter from Verizon Wireless and a certified copy of this ordinance shall be recorded in the Clerk's Office of the Circuit Court of Roanoke County, Virginia, in accordance with Section 15.2-2270 of the Code of Virginia (1950, as amended). O'Donnell Interim County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: The Board has in the past approved the use of the Columbus Day floating holiday for the purposes of adjusting the work week for what day Christmas occurs during the week and often times because of the impact on County court services lack of access to State computers and State systems when they are closed and we remain open. We have an opportunity with varying our floating holiday for that purpose in 2015. Since in 2015, Christmas falls on a Friday, we are asking the Board to consider and approve using the 2015 Columbus Day (October 12, 2015) floating holiday to close County offices on Thursday, December 24, 2015. The State offices will be officially closed on Thursday and Friday, Christmas Eve and Christmas Day. Carolyn Minix Director of the Court Service Unit of the Commonwealth of Virginia Department of Juvenile Justice has requested that Rosemary Walker be delegated as the primary representative on behalf of the Court Service Unit to the Roanoke County Community Policy and Management Team. There is no term limit on this appointment. Additionally, Ms. Minix has requested that Andrea Scott be removed as the secondary representative (alternate). TO OBTAIN A SPECIAL USE PERMIT FOR A RESTAURANT, DRIVE-IN, OR FAST FOOD IN A C-1, LOW INTENSITY COMMERCIAL DISTRICT ON APPROXIMATELY 1.3825 ACRES LOCATED AT 3814 CHALLENGER AVENUE (TAX MAP NO. 050.05-01-19.00-0000), HOLLINS MAGISTERIAL DISTRICT WHEREAS, Corporate Property Services, Inc. filed a petition for a special use permit for restaurant, drive-in, or fast food in a C-1 Low Intensity Commercial District to be located at 3814 Challenger Avenue (Tax Map No. 050.05-01-19.00-0000) in the Hollins Magisterial District; and WHEREAS, the Planning Commission held a public hearing on this matter on April 1, 2014, and acted on this matter on May 6, 2014; and WHEREAS, the Board of Supervisors of Roanoke County, Virginia, held a first reading on this matter on March 25, 2014; the second reading and public hearing on this matter was held on May 27, 2014. WHEREAS, this matter was continued until June 24, 2014; and WHEREAS, on June 24, 2014, the Board denied granting a special use permit to Corporate Property Services, Inc. for the operation of a restaurant, drive-in, or fast food establishment to be located at 3814 Challenger Avenue (Tax Map #050.05-01-19.00- 0000); and WHEREAS, at the Board's meeting held on July 8, 2014, Supervisor Jason Petersmade a motion to reconsider the petition of Corporate Property Services, which motion was approved; and Page 1 of 3 WHEREAS, the reconsideration of this matter was published in the Roanoke Times on August 12, 2014 and August 19, 2014; and WHEREAS, this ordinance granting a special use permit was reconsidered by the Board after a public hearing on August 26, 2014; and NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the Board finds that the granting of a special use permit to Corporate Property Services, Inc. for a restaurant, drive-in or fast food located at 3814 Challenger Avenue in the Hollins Magisterial District is substantially consistent with surrounding land uses along Challenger Avenue, but is not in conformance with the Transition area of the Future Land Use Map in the adopted 2005 Community Plan, as amended, pursuant to the provisions of Section 15.2-2232 of the 1950 Code of Virginia, as amended, and that it shall have a minimum adverse impact on the surrounding neighborhood or community, and said special use permit is hereby approved with the following conditions: 1) The site shall be developed in substantial conformance to the site plan prepared by GBC Design, Inc. dated August 25, 2014, subject to any revisions required during site plan review. 2) The site shall be developed in substantial conformance to the architectural renderings titled "Challenger Avenue FSU — Roanoke, VA Store #03375" subject to any revisions required during site plan review and building plan review. Page 2 of 3 3) The dumpster shall only be serviced during the hours of 7:00 a.m. and 7:00 p.m. 4) The attached letter from the Virginia Department of Transportation dated August 6, 2014, is herein incorporated as a matter of record. 2. That this ordinance shall be in full force and effect thirty (30) days after its final passage. All ordinances or parts of ordinances in conflict with the provisions of this ordinance be, and the same hereby are, repealed. The provisions of this special use permit are not severable. Invalidation of any word, phrase, clause, sentence or paragraph shall invalidate the remainder. The Zoning Administrator is directed to amend the zoning district map to reflect the change in zoning classification authorized by this ordinance. Box 29800 Roanoke, VA 24018 RE: Corporate Property Services, Inc (Chick-Fil-A) Roanoke County Proposed Land Use - Restaurant with drive-thru (C-1 ws' SUP) Route 610, West Ruritan Road Supervisor Peters: In response to our previous conversations with you and Delegate Chris Head in reference to the posted speed of Route 610 (West Ruritan Road), a revised posting would not appear to be warranted given the existing conditions along with documentation provided by the engineer for the proposed Special Use Permit request. However, VDOT agrees to initiate a full speed study along Route 610 three months from the opening date of the proposed development referenced above. Please be aware a speed study can require approximately six to eight weeks depending upon workload and complexity. We have also provided additional information in the attachments concerning crashes at the intersection of Route 460 (Challenger Avenue) and Route 610 which extends approximately 500 feet to the east, west, and north of the intersection along both routes as a follow-up to your question about crashes. The crash data includes all reported information available to VDOT from 2010 to 2013. In short, 51 crashes were reported in the four year period. Approximately 65% of all crashes were rear end incidents on Route 460 in the eastbound and westbound directions combined. There were two reported crashes related to Route 610 but both appeared to be associated with the intersection rather than along the tangent section adjacent to the proposed development entrance. As an additional mitigation for the proposed development entrance, we have researched alternative signage options opposed to the "Watch for Turning Vehicles" (WI I -V3) sign proposed by the engineer. VDOT will recommend the installation by the developer along Route 610 of an Intersection Warning Sign (W2-2) along with a supplemental advisory speed plaque (W134P, 25 MPH) during the plan development stage. From 2010-2013, only 2 of the 51 crashes (4.2%) were reported as specifically on Route 610. Neither crash resulted in injury; the first crash was a rear -end (2012) and the second was a same -direction sideswipe (2013). Both crashes occurred at the intersection with 460 and not along the length of West Ruritan Road. The most common crash type was rear ends, which accounted for approximately 659 of the total. A sideswipe in the same direction would occur in a situation where one driver tries to change lanes and "merges" into the other driver directly beside them, potentially damaging the sides of both vehicles. Fixed object— off road refers to a vehicle colliding with an object off of the road, such as a guardrail or tree; this crash may occur if the driver swerves to avoid another accident or loses control of his vehicle.
