GRAHAM, DEPUTY ASSISTANT GENERAL REGISTRAR, UPON HER RETIREMENT AFTER MORE THAN THIRTY-THREE (33) YEARS OF SERVICE WHEREAS,Betty B. Graham was hired on October 1, 1980, and during her tenure with Roanoke County has served in the Registrar’s Office as Officer of Election, Clerk- Typist, Assistant Registrar and as Deputy Assistant General Registrar for the last eighteen (18) years; and WHEREAS, Ms. Grahamretired on August1, 2014, after thirty-three (33) years and ten (10) months of devoted, faithful and expert service with the County; and WHEREAS,Ms. Graham,throughout heremployment with Roanoke County, has been instrumental in improving the quality of life and providing services tothe citizens of Roanoke County; and WHEREAS, during hertime serving Roanoke County, Ms. Graham was one of the foundations of Roanoke County Voter Registration and Elections. She served under three (3)GeneralRegistrarsand possessed an extraordinary friendly and helpful attitude to everyone she came in contact with during her service. Ms. Graham selflessly dedicated her professional life to voter registration and elections. Shehas been through many changes over the years with the voting processes, including redistricting, adding new voting precincts as Roanoke County grew, institution of a new statewide voter registration system in 2007, touch screen voting equipment in 2003, and electronicpollbooks in 2010; and WHEREAS, during her time serving Roanoke County, Ms. Grahamhas assisted many, many candidates running for publicoffice;andhas recruited and maintained Page 1 of 2 hundreds of Officers of Election to staff the polling places; and WHEREAS, during her time serving Roanoke County, Ms. Graham completed courses through The Election Center, Houston, Texas, and the Voter Registrars Association of Virginia, and attained the certification of Virginia Registered Election Official. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginiaexpresses its deepest appreciation and the appreciation of the citizens of BETTY B. GRAHAM, Roanoke County to for thirty-three (33) years and ten (10) months of capable, loyaland dedicated service to Roanoke County; and FURTHER,the Board of Supervisors does express its best wishes for a happy and productive retirement. Page 2 of 2 timber harvesting, and guiding the decision making of 374,000 non-industrial private landowners, whose natural resource contributes more than $17 billion each year to Virginia’s economy and another $6.5 billion in ecosystem services. The agency serves every county and several cities in Virginia with forestry professionals, such as foresters, forest technicians and formerly chief forest wardens. The agency reached its peak employment in the early 1990s with nearly 450 employees statewide. Today, the agency has less than 240 people working to protect and serve Virginia citizens, the forest industry and other natural resource cooperators. Smokey Bear has been an integral part of forest fire suppression since the mid-1940s, and his birthday is celebrated each year on August 9. Originally created as a forest fire prevention campaign character, he remains as guardian of our forests today, and is one of the most recognizable fictional characters in the world. The Virginia Department of Forestry (VDOF)still partners heavily with federal and local fire services towards preventing wildfires with Smokey Bear playing a large role in most all fire prevention efforts. This year, we recognize Smokey to be a healthy 70 years of age (born Aug. 9, 1944) who reminds us all to be ever vigilant. Page 2 of 2 PERFORMANCE AGREEMENT (the “Agreement”) is made as of this ___ THIS PERFORMANCE AGREEMENT day of August, 2014, by and between , a political ROANOKE COUNTY, VIRGINIA subdivision of the Commonwealth of Virginia, (hereafter, the “County”), the ECONOMIC DEVELOPMENT AUTHORITY OF ROANOKE COUNTY, VIRGINIA, a political subdivision of the Commonwealth of Virginia, (hereafter, the “Authority”), and a Virginia corporation, ALLSTATE INSRANCE COMPANY and AFFILIATES, (hereafter, the “Company”). W I T N E S S E T H , the Roanoke County Board of Supervisors and the Economic WHEREAS Development Authority of Roanoke County, Virginia, desire to promote and encourage the economic development and vitality of Roanoke County and the Roanoke Valley through the construction of new business and the retention and expansion of existing business in order to provide for retained and increased employment and corporate investment in Roanoke County; and , the Company desires to construct a new office and call center (the WHEREAS “Project”) located at 1745 Loch Haven Drive in Roanoke County (Tax Map #036.10-01- 14.00 and Tax Map #036.10-01-14.04) (the “Property”), and , the County and the Authority expect that Allstate will maintain its WHEREAS high quality employment opportunities for the citizens of the Roanoke Valley with the 1 completion of this Project which will promote economic development and generate new local tax revenues for Roanoke County; and , this increased employment and investment constitutes a valid WHEREAS public purpose for the expenditure of public funds. , in consideration of the premises and the mutual covenants NOW, THEREFORE contained herein, the parties agree to the following: 1. Site Development by the Company. A. The Company will cause this new Project in Roanoke County to be made and developed, subject to obtaining ordinary and necessary governmental approvals from the County, and any other governmental agency. B. The Company shall construct an approximate 70,000 square foot new officeand call centerbuildingwith an estimatedconstruction cost of $15 Millionon the Property, and install new equipment therein with an estimated value of $2.7 Million by January 1, 2016. After this new construction the Company will employ approximately 515 people (being defined as employees scheduled for full time employment by the Company and eligible for Company benefits) at the Property. C.The Company agrees to provide the Countyandthe Authority any and all documentation that may be required to verify the investment and employment figures for the duration of this Agreement. 2. Procedures for the reimbursement of Authority funds to the Company. A.Beginning in calendar year 2017, the County shall appropriate to the Authority in two annual installments sums sufficient, for an Economic Development Incentive Grant for the benefit of the Company. These sums sufficient amounts will 2 equal a total of eighteen months of “New Local Tax Revenues.” The term, “New Local Tax Revenues,” means the total of local real estate taxes and Business Personal Property taxesgenerated annually by the Project. The total amount of the Economic Development Incentive Grant shall not exceed $300,000. If the Project generates less than the estimated New Local Tax Revenues, then the Grant shall be less than the estimated total of $300,000 for all eighteen months. Such payments will be made over a two-year period in accordance with this Agreement. The two-year period will commence on January 1, 2016. B. Upon the approval of the site plan for the improvements described in paragraph 1 and upon the issuance of a building permit for the construction of the office and call center building, the County will then pay for the construction of a new water line to the property line to benefit this Project in anamount not to exceed thirty thousand dollars ($30,000). This payment shall be made from the County’s Public- Private Partnership Fund. C. Within sixty (60) days of the end of each calendar year beginning January 1, 2016, the Company shall provide such financial and tax revenue data relating to the Project as may be reasonably required by the Authority so that the Authority may calculate the actual grant amounts. The Company hereby authorizes the Commissioner of the Revenue for Roanoke County and the Commonwealth of Virginia to release to the Authority and the County the Company’sconfidential tax information and data so that the Authority may calculate the actual reimbursement amounts. The Authority shall pay the annual reimbursement amount to the Company at an address designated by the Company within thirty days after receipt by the Authority of the data. 3 D. If the Company terminates this Project or fails to complete the construction of this development by December 31, 2015, then the Authority shall be relieved of any obligation to the Company for any Economic Development Incentive Grant. 3. The Company shall have the right to assign this Agreement to a separate entity provided that any such assignment shall not relieve the Company of its obligations herein. 4. If any party is unable to perform its commitments under this Agreement by reason of force majeure, then that party shall not be deemed to be in default of its obligations under this Agreement, and any deadlines for the performance of its obligations and, if applicable, the deadlines for the performance of the other party’s obligations shall be extended for a time equal to the time period of the force majeure event, plus ten days. The term a “force majeure” as used herein, shall include without limitation acts of God: hurricanes, floods, fire, tornadoes, earthquakes, storms; strikes or other industrial disturbances; acts of public enemies; orders of governmental authorities; insurrections; riots; epidemics. 5. This Agreement shall be governed by and all disputes related hereto shall be determined in accordance with the laws of the Commonwealth of Virginia. 6. This Agreement and any payments of public funds are subject to future appropriations by the Board of Supervisors to the Authority. 4 , the undersigned have executed this Agreement the IN WITNESS WHEREOF day and year first above written. Public safety is a long established priority for the Roanoke County Board of Supervisors and Town Council. For this reason, statistics are monitored to look for response issues. In most cases, a decline in responses is associated with a trend that is occurring nationwide. Volunteerism is declining on a national level. Increased training requirements, more duties, squeezed family lives and less-flexible employers as well as the economy have all contributed to this. Volunteers leave because they have to work longer hours at their regular jobs as employers downsize; others have lost their jobs and are moving out of the cities/counties where they serve. This downward trend has been evident in our region as well. Roanoke County and Vinton are no exception. We have noticed a decline in responses from the Vinton station which is primarily the result of the lack of volunteers. To offset this decline we must sometimes entertain changes in our paid shift structure such as transitioning from 12-hour shifts to 24-hour shifts. The ambulance at the Vinton station began being staffed 24 hours a day, seven days a week in 2001to answer the increase in rescue calls and reduction in volunteers. Now fire responses (including vehicle accidents, extrications, hazmat, and advanced life support critical calls) are feeling the effects of a declining volunteer base. Recent fire incidents have raised concerns about the County and Town providing proper resources to the fire scene and its effect on our mutual aid relationship with Roanoke City. It is now crucial that we take a serious look at fire responses from the Vinton station. Roanoke County and the Town of Vinton have co-staffed the Vinton station since 2001 providing fire and ems services to citizens in the eastern portion of the County. The purpose of this report is to show the drastic increase in no responses, their effect on our system, and provide the County and Town with options to correct the existing problem. The three main considerations to address the issue are staffing, organizational structure, and station improvements. Background Over the recent years, the occurrence of no response to calls in the Vinton first due area has increased. In 2001, Vinton was identified in our quadrant system as one of our four core stations. This quadrant system is still in use today so this increase in no responses not only affects the Town but the eastern portion of Roanoke County as well. When Vinton is dispatched to a fire call, Read Mountain and Mt. Pleasant are simultaneously dispatched to assist. If there is no response from these stations, after 1 six minutes the call will roll to Roanoke City. If we look at fire calls only from January 1, 2013 to October 15, 2013 during volunteer hours the current no response statistics are: Read Mountain 58.8% Vinton 32.13% Mount Pleasant 30.97% These figures are in line with with the past couple of years so the trend definitely shows the effect of declining volunteer availability. This has not only impacted the Roanoke County system but our mutual aid partner, Roanoke City. In most cases, when the City arrives there are no County units on the scene or the County unit arrives late staffed with minimally trained personnel, often with little experience. This creates a non-functional fire attack and safety risks for citizens and responders on the scene. To temporarily address the risk, Roanoke City has increased their response to fire calls in the Town of Vinton: two engines, one ladder, and 1 Battalion Chief equating to 10 personnel. As you can see this consumes City resources that may be needed within their own jurisdiction. At the request of the City, the County, the Town, and Vinton volunteers looked into the problem and developed the solutions in Attachment A. Understandably, Roanoke City has notified us that they cannot continue to respond their units into the County/Town on a routine basis. They can only support this practice until July 2014 so it is critical that we correct our system inefficiencies before that date. In an effort to work with us, Roanoke -hour, 7 day a week fire truck with personnel that not only responded to County/Town calls but also stations that are fully staffed and closer in proximity than either the Read Mountain or Mt. Pleasant stations that are currently dispatched. For the above reasons, it crucial that we address this issue by the end of this calendar year. The decision to hire additional personnel needs to be made by December 31, 2013 in order to meet hiring deadlines. As indicated by Attachment A, if we miss this Procedures The Department reviews call statistics annually to ensure resources are assigned in the most efficient manner. The Operational Battalion Chiefs submit a daily report that includes the number of fire calls flagged as no response for the previous 24-hour period. Meetings on 24-hour, 7 day a week fire coverage started in June 2010 and have continued through the years. 2 On July 2, 2013 we met with Vinton to discuss applying for an Assistance to Firefighter SAFER Grant because of the increase in no responses. Town and County representatives decided to study and possibly apply for the 2014 SAFER grant feeling that there was not enough time to apply for the current year. On October 24, 2013 we had a meeting with Roanoke City and the Town of Vinton to discuss the lack of response issue. During this meeting Roanoke City advised of their intention to stop mutual aid responses into the Town in July 2014 if the situation remained unchanged. On November 13, 2013 the Town of Vinton and Roanoke County volunteer and career fire and ems representatives met and formed a transition team to develop a report and present recommendations for establishing a 24-hour, 7 day a week fire shift. November 20, 2013 the transition team agreed on two options to be presented as detailed in Attachment A. November 22, 2013 members of the transition team met to review a draft of the recommendations and approved to move forward. Also on November 22, 2013 members of the transition team met with a representative from Roanoke County General Services to define the scope of work and develop initial cost projections for station improvements. These alterations occur in primarily five locations in the building. The general layout of the renovations is shown in the attached sketches. I am attaching a letter that was received from VDOT regarding the speed limit on West Ruritan and the possibility of additional warning signs. In addition, several members of County staff and Ihave been contacted by representatives of the developer regarding the potential extension of the right turn lane from Challenger onto West Ruritan Road. The following is my understanding based on these discussions: 1) Theproposed extension will be presented by the developer at the Board Meeting on August 26. 2) The extension would be approximately 200 feet in length with a 100 foot taper for an overall length of approximately 300 feet. The existing turn lane has roughly 50-75 feet of full width storage with 75-100 feet of taper for an overall length of approximately 150 feet. I have not seen any details of this plan in writing or in plan form so the final proposal may be different. 3) This extension would beconstructed at developer expense. 4) No modification of this turn lane was required by the approved Traffic Impact Analysis so any work on this turn lane would be considered to be a voluntary improvement by VDOT. 5) A portion of the taper may slightly overlap the adjacent driveway entrance but no adverse impact to the property owner is anticipated. 6) The County's review of the turn lane is limited to sending the final plan to VDOT for its approval since the plan as previously submitted to the County meets our requirements. 7) While the turn lane will be required to conform to VDOT's standards for width, pavement thickness etc.,VDOT has verbally indicated that it is agreeable to the length of the proposed turn lane at 200' x 100'. Most of the public comments and discussion at the Planning Commission meetings have focused on traffic issues. The applicant has submitted four separate Traffic Impact Analyses (TIAs) to the Virginia Department of Transportation (VDOT) for review and comment. The latest TIA was submitted to VDOT on May 16 th (TIA supplement attached without appendices). This supplement addresses the public comments. Specifically, this supplement will analyze traffic operations with two proposed option modifications to the development access. Option 1: Relocating the proposed entrance location along West Ruritan Road an additional 15 from Route 460. Providing a right turn lane at the southbound approach to the signalized intersection of West Ruritan Road and Route 460; the right turn lane will have 130 of storage and a 50 taper. A half-porkchop will be provided at the exit from the proposed Chick-fil-A to prohibit left turns from the site. Option 2: Eliminate the site entrance from West Ruritan Road. Provide access to the site via Trail Drive and through the Cleaner World property. This supplement shall accompany the TIA. Trip distribution logic from the TIA will apply to this supplement. Please refer to the TIA to compare the proposed options to the original study scenarios. 2.0Option Analysis The following sections will analyze the options versus the scenarios provided in the TIA. 2.1Option 1 The intent of Option 1 is to reduce the hazard to motorists of less than standard sight distances for vehicles entering and exiting the proposed site location by prohibiting lefts from the site. Additionally, Option 1 creates more storage for the southbound approach to the signalized intersection of West Ruritan Road and Route 460 by moving it 15 away from Route 460. This Appendix B relocation does not result in any significant change to available sight distance. (See for plan and profile of West Ruritan Road and the available intersection and stopping sight distances from the Option 1 entrance location and the required intersection and stopping sight distances for 35 mph.) The southern edge of pavement of the proposed development entrance is located approximately 203 from the north edge of pavement on the eastbound right turn lane of Route 460. The VDOT Road Design Manual, Appendix F, Figure 4-4, requires 225 of corner clearance to the nearest entrance or street. An Access Management Exception Request (VDOT Form AM-E) accompanies this supplement. The proposal would route all trips to the site via Trail Drive and through the Cleaner World property. Trail Drive will remain a right-in/right-out access for eastbound Route 460. Site trips in Option 2 will utilize U-turns along Route 460 at Blue Hills Village Drive and West Ruritan Road to gain access to and from the site and on to their intended destination. Existing turning movement counts are not available at Trail Drive or Blue Hills Village Drive. Based upon citizen comments at the Planning Commission Public Hearing held on April 1, 2014, the possibility of utilizing Trail Drive as primary access to the site was evaluated. The following findings were determined: 20 M&C Comm. # 3413 Supplement to T.I.A. for Chick-fil-A For: GBC Design, Inc. 1.The property to be developed does not front on Trail Drive. 2.Chick-fil-A requires the primary access to the site be from West Ruritan Road for a viable development. 3.Chick-fil-A does not own property fronting on Trail Drive. The property is owned by A Cleaner World. Access from Trail Drive utilizing a cross-access easement on property not owned by Chick-fil-A is not a viable and satisfactory single access. 4.A Cleaner World was required to construct and maintain access to West Ruritan Road with the development permit. 5.The VDOT Access Management Design Standards require a minimum of 1,050 spacing between a signalized intersection and a full access unsignalized intersection. Trail Drive is approximately 350 from the West Ruritan Road signal. 6.With no crossover allowed, eastbound traffic bound to and from the site will be required to access the site via U-turns at the signal and at the existing crossover to the west, likely at Blue Hills Village Drive. Safety and efficiency of operation are major concerns for U- turn maneuvers, particularly at unsignalized crossovers. With Trail Drive being the primary access some 25 to 70 U-turn movements would be required at the crossover and at the signal during the three peak hours evaluated. Based on the site trips only, a right turn lane is warranted at the westbound approach to the Trail Drive intersection. 3.0Conclusions and Recommendations The follow conclusions and recommendations supersede those presented in the TIA. The conclusions combine the findings of the TIA and this Supplement. This study analyzes existing traffic operations of the street network in the study area and impacts to these operations that might be expected upon completion of a proposed Chick-fil-A. The study evaluates the impacts to vehicle level of services and delays, queue lengths at the signalized intersection, and the design criteria justification and feasibility of geometric improvements that may be warranted by the proposed development. Traffic impacts were evaluated at the anticipated opening of the proposed Chick-fil-A in December 2014 and in the design year 2020. The development generates the most trips during the Midday peak hour. Due to the existing volume of traffic on Route 460, the impacts on the existing signalized intersection at West Ruritan Road are insignificant. However, the critical peak hour on West Ruritan Road is the AM peak hour due to the volume of southbound traffic approaching the signal. This study explores four scenarios for improvements to the street network in the vicinity of the proposed Chick-fil-A site: 1.No changes to West Ruritan Road or any other area of the study network. 2.Add right turn lane on West Ruritan Road at southbound approach to signalized intersection of West Ruritan Road and Route 460. Storage length: 150; Taper length: 25. Chick-fil-A entrance is full-service. 3.Relocate the proposed Chick-fil-A entrance 15 further north on West Ruritan Road. 4. Add right turn lane on West Ruritan Road at southbound approach to signalized intersection of West Ruritan Road and Route 460. Storage length: 130; Taper length: 50. Prohibit left turns onto West Ruritan Road for vehicles exiting the Chick-fil-A site. (Option 1) 38 M&C Comm. # 3413 Supplement to T.I.A. for Chick-fil-A For: GBC Design, Inc. 5.Eliminate access to site from West Ruritan Road. Access to site will be via Trail Drive and through Cleaner World property. (Option 2) To better accommodate the traffic on West Ruritan Road with minimal design waivers and access management exceptions, a southbound right turn lane with 130 storage length and a 50 taper length is proposed at the signalized intersection, per discussions with VDOT. The right turn lane will provide additional storage capacity for the southbound approach, particularly for the major westbound right turn movement. Additionally, this proposal recommends prohibiting left turns from the site in order to reduce the impacts of the available intersection sight distance. Appendix A The proposed layout of the site is provided in . This proposal will require modification to the existing signal. A design waiver request form accompanies this report for taper length of the proposed right turn lane. Analysis indicates that the addition of a left turn lane is not warranted, based upon the volume of vehicles making a left into the site and the opposing traffic volume. With the addition of the separate right turn lane for westbound trips, the SimTraffic analysis indicates that vehicles making a left turn into the site do not develop queues long enough to back into the Route 460 intersection during any of the peak hours. This was confirmed through analysis performed with the development entrance blocked. It may be noted that the layout of the drive-thru lanes on the site will accommodate up to 30 vehicles. There is minimal chance that on-site vehicles will back up to West Ruritan Road and block the entrance. In summary, in our engineering judgment, a left turn lane on West Ruritan Road is not required, nor recommended. A more practical alternative is to utilize other means to ensure the entrance is not blocked such as installing "Do Not Block Intersection" sign and marking out the lane in front of the entrance. The analysis indicates that the existing right turn lane on the westbound Route 460 approach should be lengthened to prevent being blocked by through traffic. However, this is an existing condition. Although the proposed development may increase the total length of the queue on westbound Route 460 the development does not initiate the problem. Further existing entrances along this section of roadway prohibit the extension of the right turn lane with a development project beyond the site. The VDOT Access Management Design Standards (See VDOT Road Design Manual, Appendix F, Figure 4-4) require 225' of distance (corner clearance) from the edge of the major street to the edge of the nearest minor street or entrance. The proposed entrance is 203' from Route 460. An Access Management Exception is required for construction of the entrance as proposed. The size of the site limits the distance from Route 460 an entrance can be constructed. The proposed location provides less than desirable intersection sight distance to the north for cars entering and exiting the site. However, the stopping sight distance requirement is met for the site entrance. The sight distance requirements are based upon a 35 mph speed limit on West Ruritan 39 M&C Comm. # 3413 Supplement to T.I.A. for Chick-fil-A For: GBC Design, Inc. Road. The speed study provided no justification for lowering the speed limit. A design waiver request form accompanies this report for a sight distance waiver. It is recommended that a Watch for Turning Vehicles (W11-V3) sign be installed approximately 400 in advance of the proposed entrance location along the southbound lane of West Ruritan Road.
