Page 1 of 1 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, NOVEMBER 18, 2014 RESOLUTION EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO KURT KIPLEY SR., FIREFIGHTER/EMT UPON HIS RETIREMENT AFTER MORE THAN SIXTEEN (16) YEARS OF SERVICE WHEREAS, Kurt Kipley Sr. became a volunteer with the County's Cave Spring Volunteer Fire Department and served many years as a dedicated volunteer; and WHEREAS, Kurt Kipley Sr. was first employed as a part-time Firefighter/EMT on December 12, 1997, and then promoted to full time on November 1, 1998; and WHEREAS, Kurt Kipley Sr. retired on November 1, 2014, after more than sixteen (16) years of devoted, faithful and expert service with the County; and WHEREAS, Mr. Kipley being an experienced firefighter provided mentoring to new firefighters and competent service to the County; and WHEREAS, Mr. Kipley provided compassionate care to the sick and injured as an Emergency Medical Technician to all the patients he came in contact with; and WHEREAS, Mr. Kipley was a well-respected fire engine pump operator and provided knowledgeable training to countless career and volunteer personnel on the proper technique of pump operation especially in a rural water system of pumping from a creek/pond; and NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to Kurt Kipley Sr. for over sixteen (16) years of capable, loyal and dedicated service to Roanoke County; and Page 1 of 2 FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. O'Donnell Interim County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: At the work session held October 28, 2014 to discuss methods of removing the surplus classroom material at Old William Byrd High School, staff was instructed to come back to the Board to discuss progress made on preparing to remove the materials. Staff is working towards ensuring the materials are safe from any friable asbestos and the Sheriff has agreed to assist with inmate labor once the school and materials are certified as safe. We will report on the progress made and future plans to ensure the safety of the building before inmates enter and the materials are made available to the public. Page 1 of 1 ACTION NO. ITEM NO. Mahoney County Attorney SUMMARY OF INFORMATION: Attached is a resolution for consideration by the Board of Supervisors to appoint a new County Administrator. This resolution also requests the Board's approval of the employment agreement for the County Administrator, and would authorize the Chairman of the Board to execute this agreement on its behalf. STAFF RECOMMENDATION: It is recommended that the Board favorably consider the adoption of this resolution. Page 1 of 1 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, NOVEMBER 18, 2014 RESOLUTION APPOINTING THE COUNTY ADMINISTRATOR AND APPROVAL OF AN EMPLOYMENT AGREEMENT WHEREAS, Section 4 of the Roanoke County Charter provides for the appointment of a County Administrator, his or her powers and duties, compensation and tenure of office; and WHEREAS, Section 15.2-1540 of the Code of Virginia provides for the appointment of a chief administrative officer by the governing body of that locality; and WHEREAS, Section 15.2-1541 of the Code of Virginia establishes the various duties and responsibilities of the administrative head of the local government; and WHEREAS, an employment agreement between the County Administrator and the Board of Supervisors has been negotiated. NOW THEREFORE, BE IT RESOLVED, By the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That Candidate #6 is hereby appointed County Administrator for Roanoke County, and that his/her tenure shall commence on or before December 28, 2014. 2. That Candidate #6 shall exercise all of the powers and fulfill all of the duties and obligations of County Administrator as provided in the Roanoke County Charter, the Code of Virginia, the position description, the policies and regulations adopted by the Board, and the legal directives of the Board. That the employment agreement negotiated between the Board and Candidate #6 is hereby approved, and the Chairman of the Board is hereby authorized to execute this agreement of behalf the Board. Page 2 of 2 EMPLOYMENT AGREEMENT This Agreement is made and entered into this day of November, 2014, between the Board of Supervisors of Roanoke County, Virginia (the "Board") and Candidate #6 (the "County Administrator") and sets forth the terms and conditions of his employment by the Board as County Administrator for the County of Roanoke, Virginia ("Roanoke County"). WITNESSETH WHEREAS, the Board desires to employ the services of Candidate #6 as County Administrator of Roanoke County, Virginia ("Roanoke County"); and WHEREAS, it is the desire of the Board to (1) secure and retain the services of a County Administrator and to provide inducement for him to remain in such employment and (2) to provide a just means for termination of the County Administrator's services at such time as he may be unable fully to discharge his duties or when the Board may desire to otherwise terminate his employment; and WHEREAS, Candidate #6 desires to accept employment as the County Administrator for Roanoke County, Virginia; and 1%6AP I% WHEREAS, the parties wish to enter into an agreement setting forth the terms of such employment during such period; and NOW, THEREFORE, in consideration of the mutual covenants herein contained, the Board and the County Administrator agree to the following terms and conditions of employment: Section 1. Employment of and Duties of County Administrator. a. The Board hereby agrees to employ Candidate #6 as County Administrator of Roanoke County to serve as the chief administrative officer of Roanoke County. b. The County Administrator shall perform the functions and duties of County Administrator as prescribed by Chapter 4 of the Roanoke County Charter, Section 15.2-1541 of the Code of Virginia, and those set forth in the position description for the County Administrator approved by the Board and attached hereto as Appendix A and as amended from time to time, policies and regulations adopted by the Board, and the legal directives of the Board, and shall be identified as the County Administrator. The County Administrator shall devote all necessary time, skill, labor, and attention to such duties as the chief administrative officer of Roanoke County. C. The County Administrator shall have charge of the administration of the Roanoke County government under the direction of the Board. The County Administrator shall fully and completely inform the Board of Supervisors of any and all information that is relevant to the functioning of the Board. The County Administrator shall be the chief executive for the Board; shall select, organize and assign all personnel, as best serves Roanoke County government, subject to the policies of the Board and the laws of the Commonwealth; shall oversee the business affairs to Roanoke County; shall from time to time suggest regulations, rules and procedures deemed necessary for the well ordering of Roanoke County; and in general perform all duties incident to the office of the County Administrator as prescribed by law and Board policy. The County Administrator shall perform any other legally permissible duties or functions which the Board may see fit to assign at any time during the term of this Agreement consistent with the office of the County Administrator. Section 2. Commencement of Employment; Term; County Administrator Serves at the Pleasure of Board. a. The County Administrator shall commence his services in that position on or before December 28, 2014 and for a term of three (3) years. b. The Board and County Administrator acknowledge that the County Administrator serves only at the pleasure of the Board. Nothing in this Agreement shall prevent, limit or otherwise interfere with the right of the Board of Supervisors to terminate the services of the County Administrator at any time, with or without reason, provided that it may not do so for any reason which would contravene the laws of the Commonwealth or the Constitution or laws of these United States, and subject only to the Termination and Compensation provisions set forth in Section 3 of this Agreement. C. Nothing in this Agreement shall prevent, limit or otherwise interfere with the right of the County Administrator to resign at any time from his position with the County, subject only to the provisions of Section 4 of this Agreement. d. The Board shall provide the County Administrator with at least six (6) months' notice of its intent not to renew this Agreement. Section 3. Termination and Compensation Pad a. Termination by Board without cause; notice. The Board shall have the right to terminate this Agreement at any time by providing the County Administrator with written notice setting forth the effective date of termination and paying the County Administrator the remainder of the contract pay set forth in paragraph "c" of this Section. No compensation shall be paid in the event that employment is terminated for the reasons set forth in paragraphs "b" or "e" of this Section. b. Termination by Board for cause. The County Administrator may be terminated by the Board for sufficient cause which shall include material breach of this Agreement, willful non-compliance with laws and regulations or Board policies, conviction of any felony or any crime involving moral turpitude, or conviction of a crime involving his employment with Roanoke County or an act involving gross and willful negligence pertaining to the execution of responsibilities of the County Administrator. In the event of such termination for cause, all salary and benefits shall cease as of the effective date of such termination. The County Administrator shall be entitled to payment for accrued flexible leave, and holiday leave in accordance with Section 7 of this Agreement. C. Compensation Pay. In the event of termination as provided in paragraph "a" of this Section the County Administrator shall be entitled to the pay for the remainder of the term of this Agreement as well as twelve months of health and dental insurance for the County Administrator and his dependents, or through the remaining term of this Agreement, whichever is less (as provided in Section 10). This pay and payments for flexible leave and holiday leave in accordance with Section 7 of this Agreement shall be the total and complete amount due the County Administrator under this Agreement. Should the County Page 2 of 7 Administrator make application for and receive unemployment benefits following a termination of his employment by the Board, the sum due under this paragraph shall be reduced directly by the total sum of unemployment benefits paid to the County Administrator. d. Termination for Non -Compliance with Agreement or Resignation Requests. In the event the Board refuses, following written notice, to comply with any provisions of this Agreement benefiting the County Administrator, or if the County Administrator resigns (not for cause) following a request, either formal or informal, by a majority of the Board that the County Administrator resign, then in that event, the County Administrator may, at the County Administrator's option, be deemed to be terminated at the date of such refusal or suggestion, and the provisions of paragraph "c" above with regards to compensations shall apply. e. Termination for Disability. Sickness. If the County Administrator is disabled or is otherwise unable to perform his duties because of sickness, accident, injury, mental or physical incapacity or health, the Board shall have the option to terminate this Agreement effective on the date of written notice thereof without regard to any other notice provisions in this Agreement, and the County Administrator shall be entitled to leave and disability benefits applicable to full-time County employees. However, the Board shall have no obligation to provide the compensation pay pursuant to paragraph "c" of this Section. Section 4. Voluntary Resignation. lNe The County Administrator may terminate this Agreement by giving written notice at least three months prior to the effective date of said resignation. The County Administrator shall be entitled to receive all compensation payable under this Agreement up to and including the effective date of said resignation, and leave accruals, as listed in Section 7 of this Agreement. Upon voluntary resignation the County Administrator waives any claim to compensation for the remainder of the term of this Agreement. The Board may, in its sole discretion, waive any or this entire three months' notice requirement. Section S. Salary. The annual base salary of the County Administrator beginning December 28, 2014 shall be $177,007 to be paid in accordance with the standard policy of the Board governing payment of professional staff members in the Roanoke County government. The Board agrees to award the County Administrator in July of each fiscal year cost of living increases, or average compensation adjustment, if any, in the same amount as awarded to Roanoke County employees generally. The annual salary of the County Administrator may be adjusted or increased for any subsequent fiscal year during the term of this Agreement based on an annual performance review prior to the end of the fiscal year. In lieu of or in addition to a salary increase, the Board may provide a bonus to the County Administrator based on his annual performance review. Any adjustments for subsequent years during the term of this Agreement shall be in writing and shall be in the form of an amendment or addendum except for the above- mentioned cost of living increases. Section 6. Automobile Allowance. The County will furnish the County Administrator with an automobile allowance of $6,000 annually. Additionally, the County Administrator must present a valid Virginia driver's license prior to receiving such automobile allowance and he must consent to a check of his driving records with the State Division of Motor Vehicles. At all times that he operates his automobile for County purposes, he must Page 3 of 7 possess a valid Virginia driver's license and his driving privileges and/or license must not be suspended or revoked. The County will furnish the County Administrator with a PDA/cellular telephone and service for business use. Personal use of this PDA/cell phone shall be kept to a minimum. Section 7. Flexible Leave. The County Administrator shall receive flexible leave as provided to all other County employees, and he shall accumulate flexible leave hours based upon ten years of service (26 days annual accumulation, 8 hours bi-weekly accumulation). Section 8. Hours of Work. The County Administrator is expected to observe office hours similar to those of other administration employees. It is recognized that the County Administrator will frequently be required to work beyond normal office hours for night or weekend meetings and related duties. In recognition of the fact that the County Administrator is expected to devote a significant amount of time outside of normal office hours to the business of Roanoke County, the County Administrator may, to the extent that his duties permit, take reasonable discretion in varying observance of office hours; however, no accumulation of compensatory time or monetary compensation is granted. Section 9. Holidays and Other Miscellaneous Benefits. The County Administrator shall be entitled to the same holidays and funeral, military, court, workers' compensation, emergency condition, discretionary and volunteer leave as other fulltime Roanoke County employees. Section 10. Health Insurance. The County shall provide health, dental, and vision insurance coverage and short and long term disability insurance for the County Administrator and his dependents as it does for other full-time employees of the County. Section 11. Retirement and Life Insurance. The Board shall pay the employer share of the Virginia Retirement System (VRS) contribution and the total premium for VRS Group Term Life Insurance for the County Administrator. The County Administrator may also choose to enroll in the Deferred Compensation Plan available to other full-time employees of the County. If he chooses to enroll in the Deferred Compensation Plan then the County will pay on his behalf into such plan $653.31 per 26 pay periods for the term of this Agreement. The County shall also allow for the opportunity to participate in the Optional Life Insurance Program as provided by the Virginia Retirement System. The County does not contribute anything to the monthly premium of the Optional Life Insurance Program. Section 12. Dues, Subscriptions and Professional Development. a. Dues and Subscriptions. The Board agrees to pay a reasonable amount for the professional dues and subscriptions of the County Administrator necessary for his continuation and full participation in VLGMA and ICMA and other national, state, and local associations necessary and desirable for his Page 4 of 7 continued professional participation, growth, and advancement and for the good of Roanoke County following approval by the Board of Supervisors any estimated expenses the County Administrator proposes under this Section. b. Professional Development. The Board also agrees to pay the travel and related expenses of the County Administrator for his professional development, professional training and education, and to attend necessary official and other functions for the Board and meetings of such other national, regional, state, and local groups, or committees thereof, on which the County Administrator serves as a member, following approval by the Board of any estimate of expenses the County Administrator proposes under this Section, such expenses to include registration fees, travel and subsistence expenses in accordance with Roanoke County travel policies. Such meetings would include the VLGMA Winter and Summer Conferences, VACo annual conference, and the ICMA annual conference, provided that the expenses therefore are within the total amount budgeted as provided in paragraph "c" of this Section. C. The total available for the expenses set forth in this section shall be set annually by the Board in the operating budget based on and in consideration of the recommendation of the County Administrator and the expenses for dues and subscriptions and professional development in this Section are limited to such annual budgeted amount. Section 13. Residency. The County Administrator shall reside in and be a bona fide resident of Roanoke County during the term of this Agreement. The Board agrees that the County Administrator may take up to twelve months to relocate his residence to Roanoke County, which date will be December 28, 2015. Failure to relocate in the time provided in this Section shall be good and sufficient cause to terminate this Agreement and in that event, the Board shall have no obligation to pay the remainder of the compensation provided in paragraph "c" of Section 3 of this Agreement. Notwithstanding the foregoing, the Board may extend this period for good cause. Section 14. Outside Employment or Activities. The County Administrator may, with prior approval of the Board, undertake consultative work, speaking engagements, writing, lecturing, or other professional activities for compensation so long as such activities do not interfere with the duties required under this Agreement. Section 15. Evaluation. The Board shall review and evaluate the performance of the County Administrator at least once annually before July 1St. This review shall be in accordance with specific criteria developed by the Board and the County Administrator. This criteria can be amended from time to time based on changes to the expectations of the Board, after the County Administrator has been informed of the proposed changes. Further, the Board shall provide the County Administrator with a summary written statement of the evaluation and provide the opportunity for the County Administrator to discuss this evaluation with the Board. Page 5 of 7 Section 16. Relocation Allowance. The Board agrees to provide the County Administrator a one-time relocation allowance of $12,500. This allowance shall be paid to the County Administrator upon the execution of this agreement. If the County Administrator fails to commence his duties on December 28, 2014, or is terminated for cause under Section 3.b. or voluntarily resigns under Section 4. within the term of this Agreement, then he shall refund to the County this relocation allowance upon a pro -rata basis over the term of this Agreement. (For example, if he must refund this allowance after year one of the term of this Agreement, then he shall refund two-thirds of $12,500 to the County.) Section 17. General Provisions. a. The Board agrees to provide insurance or self-insurance coverage in matters relating to the County Administrator's official duties within the scope of employment, and legal counsel for the County Administrator as is provided to all Roanoke County employees generally in accordance with the Code of Virginia. b. This Agreement is expressly subject to the laws of the Commonwealth of Virginia and the regulations of Roanoke County. C. The obligations of the County under this Agreement shall be subject to and dependent upon appropriations being made from time to time by the Board of Supervisors of the County for such purpose. Any other provision to the contrary notwithstanding, this Agreement and the obligations herein shall not constitute a debt of the County within the meaning of any limitation on indebtedness of the County under any constitutional or statutory limitation and nothing in this Agreement shall constitute a pledge of the full faith and credit of the County under any provision of its Charter, as applicable, or the Constitution of Virginia. The failure of the governing body of the County to appropriate funds in any year for payment in full of the payments required by the Agreement during such year shall terminate this Agreement without any further liability on the part of the County off any kind, thirty (30) days after the Board of Supervisors of the County makes a final determination not to appropriate funds for this Agreement for the current fiscal year, unless the County provides appropriations for similar purposes or services. d. This Agreement constitutes the entire agreement between the Board and the County Administrator and may be amended only by written agreement executed by them. If any provision of this Agreement is held to be unconstitutional, invalid or unenforceable, the remainder of the Agreement shall be severable and shall remain in full force and effect. The Audit Committee met on November 13, 2014, to review the results of the year's operations. Both the County and Schools received a clean and unmodified opinion. The Comprehensive Annual Financial Report will be distributed to the Board of Supervisors as soon as it is received from the printer. Below is information for both the County and Schools regarding the results of operations for fiscal year ended June 30, 2014. Most of this information was reviewed with the Board during a work session on September 23, 2014, and the only change from what was originally presented is the carryover of the Board Contingency in the amount of $28,231 for Hidden Valley, which was appropriated on October 14, 2014. Results of Operations of the County of Roanoke for the Year Ended June 30, 2094: Revenues We are pleased to report that fiscal year 2013-2014 General Fund Revenues exceeded the final amended budget by a variance of 1.17% or $2,017,363. Historically, the Board had expressed a desire to target surplus revenues at no more than two percent (2%). It is important to note this additional projected surplus was factored into fiscal year 2014-2015 projections; therefore, this surplus is not expected to recur. Page 1 of 3 A summary of the General Fund Revenues is outlined in Attachment I and reasons for these variances are as follows: • Real estate tax collections were $816,044 above budget as a result of assessment values being slightly above the projected amount. • Personal property tax collections were $755,567 above budget as a result of improved sales and stabilized used car values. • Local sales tax was $270,303 below budget as the result of a sluggish economy. • Communication sales and use tax was $193,640 above budget, which is the result of the County receiving more from the State than originally projected. • Business License tax was $482,149 above budget primarily as a result of a one- time "back" collection of Business License taxes of $430,000 due to a ruling from the Department of Taxation. • Meals tax was $160,017 below budget as a result of the uncertain economic conditions. • Rescues Fees were $178,977 above budget and were not negatively impacted by the Affordable Care Act as originally expected. • Intergovernmental Revenues were $295,761 above budget primarily as a result of mid -year state appropriations for reimbursements for Social Services programs. The policies for use of general fund revenues and expenditures in excess of budget at year end designates portions of the year-end balance for major and minor capital projects as well as to the general fund unappropriated balance. Based upon these policies, staff recommends the following: • $532,638 to be added to the general fund unappropriated balance. This will increase the General Fund Unappropriated Balance to $21,799,195 at June 30, 2014, which is eleven percent (11 %) of the 2014-2015 General Fund Revenues. • $1,305,748 be allocated to the Major Capital reserve. • The additional rescue fees of $178,977, which are solely dedicated for Fire and Rescue will be allocated to the Fire and Rescue Capital Reserve. These appropriations are covered in the budget ordinance 052714-4 and no action is required by the Board. Expenditures: Departmental expenditure savings amounted to $3,001,241 as shown on Attachment I. • Personnel savings totaled $1,065,137 as a result of the County's process to review all vacancies and fill only critical positions. • Operational and capital savings were approximately $1,971,770 as a result of: o Public Transportation -$273,960 remaining as a result of grants received during the year not originally anticipated. Page 2 of 3 o Sheriff Department -$206,732 -The majority of the expenditure savings were related to less prisoners population at the Western Virginia Regional Jail Authority (WVRJA) than originally projected o Social Services -$297,169 remaining at the end of the year is the result of reimbursements for programs being higher than originally anticipated o Overall frugal, under -spending of departmental budgets $87,711 with departments spending less than budgeted for the year o Department encumbrances -$1,072,026 -Funds that were obligated prior to the end of the fiscal year, but not paid Based upon the policy for use of unspent expenditure appropriations at year end, departments are able to request up to fifty-five percent (55%) of the savings within their own department for special purchases and programs approved by the County Administrator, ten percent (10%) is allocated to the Technology Capital Reserve and the remaining reverts to the Minor County Capital Reserve for future projects. These appropriations are covered in the budget ordinance 052714-4 and no action is required by the Board for the following: • $517,890.66 to be appropriated to departments for rollovers (Attachment II) $1,072,026.64 to be appropriated to departments for encumbrances (Attachment I II) • $320,696.09 to be appropriated for expenditures that will occur in the 2014-2015 fiscal year (Attachment IV) • $605,096 to be appropriated to the Minor County Capital Reserve • $192,921 to be appropriated to the Technology Capital Reserve Additionally, $292,611 from Social Services expenditure budgetwill be appropriated to the Social Services Building Renovation project in a separate agenda item later at this meeting. Results of Operations of the Roanoke County Public Schools for the Year Ended June 30, 2094: Attachment V is the report for the School Operations year end for June 30, 2014. This budget represented the fifth consecutive fiscally constrained budget with funding lower than the 2007-08 budget year. The financial records for the year ended June 30, 2014 have been audited by Cherry Bekaert, LLP_ A summary of the major variances between budget and actual revenues and expenditures was presented to the School Board at the October 30, 2014 meeting and is summarized in this report. Revenues — The School Board operations for the year ended June 30, 2014 resulted in general fund revenues of $1,017,592 (0.73%) over budget. A summary of general fund revenues is outlined in Attachment A and reasons for these variances are as follows: a) The school share of the state-wide sales tax collections was $58,137 over budget. This revenue line was budgeted level with the prior yearwhich highlights that consumer confidence continues to show limited recovery in personal spending. b) State revenue collected (excluding sales taxes) for FY2013-14 was $434,225 over budget. Although this is the sixth time in the past ten years that enrollment has declined in the School System, this was the smallest reduction. The March 31, 2014 ADM of 13,929 was 29 students lower than the ADM for the prior year and 94 students higher than budgeted. The enrollment declines continue to be based primarily on significantly smaller kindergarten enrollment compared to the number of graduating seniors. The FY2014-15 budget was built on a small reduction in ADM (34 less than the 2013-14 budget year) expecting further decline would occur but not expecting it to go below 13,801 students. With over 50% of the budget dependent upon state aid, it is critical that the enrollment projections are attainable and flexible enough to address state shortfalls like sales tax fluctuations and/or potential mid -year state revenue adjustments recently proposed by the Governor for several state agencies. See Attachment B for a historical comparison of student enrollment. c) Federal revenue collections for Medicaid reimbursements were $251,259 over budget. These revenues are reimbursements for Medicaid services provided and billed to the federal government. This funding source has been subject to significant change in recent years resulting in an uncertain source of funding. This revenue stream is being closely monitored and is generally earmarked for Medicaid required expenditures associated with licensing and training. d) Investment income for the year was $20,051 below budget mirroring the low investment rates available. Rental income of $39,275 was collected this year as a result of the change in board policy on facility rentals. This revenue source is shared 50150 with the individual schools rented. Online tuition payments exceeded budget by $32,540 reflecting the increasingly popular online class options available to students in addition to the regular school day courses. Likewise, tuition collection from summer school, adult education, gifted programs, and regular day school also exceeded budget. e) The school division maintains a parts inventory for school vehicles that required an audit adjustment this year to record the beginning inventory. That entry resulted in a one-time revenue increase of $117,363, f) The budget included a transfer from the health reserve fund to cover the employer and employee C:\Users\rowens\AppData\Ur-al\Temp\XPgrpwise\ii-i3-i4 YE x.dor age 7of11 share of the health premium increase in order to keep the employee cost the same and continue to fund the salary increases provided in the previous year. The amount transferred to the general fund for the year was $1,865,116. The 2014-15 budget was built without this continued reliance on the health reserves going forward. Expenditures -- The School Board continued a hiring restraint practice for the 5th consecutive year in response to slow signs of economic recovery and limited budget growth. Expenditure savings for the year were $1,875,015, net of the emergency fund and encumbrances, or 1.35% of the budget (Attachment A). Under -expenditures included the following: 1. Savings in the personnel budget while under a hiring freeze after allocating funds for capital items ($1,144,000) 2. Unspent Superintendent search expenses prior to year end ($50,000) 3. Bus fuel savings ($122,000) 4. Utility savings ($120,000) 5. Lower athletic and academic supplements paid out ($105,000) 6. Overall under -spending of departmental budgets ($334,000) with all departments spending less than budgeted (or covered with tuition revenue as was the case for summer school) for the year. The budget ordinance adopted by the Board of Supervisors on May 27, 2014 stated "that all school fund appropriations remaining at the end of the 2013-14 fiscal year not lapse but shall be appropriated to the School Capital Fund in fiscal year 2014-15 as follows: a) Two-thirds of the year end balance in the school operating fund will be allocated to the Major School Capital Reserve, b) One-third of the year end balance in the school operating fund will be allocated to the Minor School Capital Reserve". SUMMARY OF INFORMATION: The ending fund balance in the school operating fund is $4,892,607, less the $2,000,000 emergency contingency fund and $34,719 in outstanding encumbrances, for a net surplus of $2,857,888 available to be allocated to the capital reserves. A historical comparison of the year-end balance over the past ten years is included in Attachment C. During 2005, the School Board and Board of Supervisors adopted a joint funding policy to provide for a sustainable funding stream for school and county capital improvements in future years. The Year End Balance and School Capital Reserve policies designate portions of the year-end balance for major and minor capital projects as noted in the county budget ordinance. Based on the adopted policies, staff is recommending the following appropriations (Attachment A): Minor Capital Funds • Up to $952,629 allocated to Minor Capital Reserve (exact amount to be determined by School Board) for projects to be approved by the School Board at a later date based on evaluation of existing capital needs and priorities. Major Capital Funds • $1,905,259 allocated to Major Capital Reserve in the approved School Capital Improvement Plan. School Operating Fund Unappropriated Balance (Emergency Reserve) • The School Board allocated funds in 2005 and 2007 to establish a reserve for financial emergencies due to unexpected revenue shortfalls or unplanned significant expenditure increases. This reserve is intended to protect the school system from the need for a mid -year reduction in staff or service levels as the result of an unanticipated financial draw on school resources. The Board of Supervisors approved the creation and operation of this reserve. The balance in the Emergency Reserve remains at $2,000,000 as allowed by policy. (1) Oppose the elimination of the authority of local governments to adopt business, professional and occupation license taxes (BPOL) and Machinery & Tools taxes (M&T). These local taxes comprise approximately six percent (6%) of Roanoke County's local tax revenues or $8,000,000 annually. (2) Support various public highway issues, including: a. Restoring Secondary Road Funding (VDOT) from the Commonwealth to localities/counties, so that local governments have a source of funds to address local road projects (as they did previously). b. Supporting Commonwealth Transportation Board funding for specific highway projects: widening 1-81, improvements to S.R. 419, and improvements to S.R. 220 and/or funding for 1-73. c. Supporting legislative direction to VDOT to maintain primary roads and urbanized entry corridors in Metropolitan Planning Organizations to the same standard required by local ordinances for the cutting of grass Page 1 of 3 and weeds. This initiative would promote urban development areas for economic development and growth (3) Support legislation placing the State Executive Council (SEC) for Comprehensive Services for At -Risk Youth (CSA) under the Administrative Process Act (Sec. 2.2-4000, et seq.) of the Code of Virginia. SEC is not currently subject to the procedural due process protections found in the Administrative Process Act like other state agencies. This would provide the County with an opportunity to address changes in rules and regulations developed by VDSS. (4) Eliminate the requirement for publishing legal notices in newspapers. Roanoke County spent over $18,000 in legal notice publication costs last year. Paid circulation of newspapers is dropping. More citizens are getting their information from the internet. (5) Amend Sec. 15.2-901.0 and D of the Code of Virginia to increase the authority of local governments to impose civil penalties for violations of local ordinances requiring the removal of trash or cutting of grass and weeds or prohibiting littering. Currently the civil penalty is limited to $50 for the first violation and $200 for subsequent violations within a twelve (12) month period. (6) Workforce Training. State funding — in the form of performance incentives for the completion of industry recognized credentials — should be invested to lower the cost of training and instruction for students and enable community colleges to expand their capacity to meet this vital need of business, industry, and Virginia's economy. Using a performance-based funding model, community colleges should receive state funds for each student who successfully completes training at a community college through noncredit workforce training and then obtains — through a third - party validation process — an industry recognized -credential identified regionally as high demand by business and industry. (7) Board Member Salaries. Repeal all of the provisions in Article 1.1 of Chapter 15 of Title15.2 relating to salaries of members of local governing bodies, and require that any salary increase be approved at referendum. Tucker, Petitioners, have requested the vacation of right-of-way shown as Nelms Lane on the Map of Airlee Court Annex that was dedicated by the plat of record in Plat Book 2, Page 103 to the Board of Supervisors of Roanoke County. The right-of-way is located off Woodbury Street (Rte. 898) adjacent to the parcel owned by the said petitioners. The portion of Nelms Lane that is proposed to be vacated is a "paper street" and it has not been improved. The petitioners desire to use their portion of the aforementioned right -of -away for improvements to their property. Once this right-of-way is vacated, the property will vest in the abutting landowner, Donna C. Wills, as provided in Section 15.2-2274 of the 1950 Code of Virginia. The petitioners have indicated that Ms. Wills intends to execute a deed conveying the vacated property to them. This transaction is a private legal matter between Ms. Wills and the petitioners. There are no adjoining landowners or other persons that will be affected by this action. County Departments and local utility companies were contacted concerning the vacation. A variable width public utility easement is being retained for utilities present in the existing right-of-way. Other utility companies contacted had no objection to the paper street being vacated. WINSTON, SHERIFF, UPON HIS RETIREMENT AFTER MORE THAN FORTY-FOUR (44) YEARS OF SERVICE WHEREAS, Sheriff Winston retired on October 31, 2014, after forty-four (44) years and one (1) month of exemplary service to the Roanoke County; and and and WHEREAS, Sheriff Winston was employed by Roanoke County on October 1, 1970; WHEREAS, Sheriff Winston was assigned to the jail and later transferred to patrol; WHEREAS, Sheriff Winston quickly moved through the ranks to corporal and then to sergeant; and WHEREAS, Sheriff Winston attended special training in firearms instruction and built the first official firing range for Roanoke County; and WHEREAS, Sheriff Winston attended FBI SWAT training and established the first SWAT team for the Sheriff's Office and managed the team for 10 years; and WHEREAS, Sheriff Winston was promoted to the rank of lieutenant in 1984 and was assigned to the criminal investigations division; and and WHEREAS, Sheriff Winston was transferred to the patrol division in 1987; and WHEREAS, Sheriff Winston was promoted to first lieutenant and assigned to patrol; WHEREAS, Sheriff Winston joined the newly created Roanoke County Police Department in 1990, as a first lieutenant; and Page 1 of 2 WHEREAS, Sheriff Winston returned to the Sheriff's Office as the chief deputy sheriff; and WHEREAS, Sheriff Winston served in this position until he was appointed to serve the remainder of Sheriff Gerald Holt's term in 2010. WHEREAS, Sheriff Winston was elected in a special election; and WHEREAS, Sheriff Winston was elected to a full term in 2011; and WHEREAS, Sheriff Winston has helped build the very foundation that has made the Sheriff's Office successful. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to MICHAEL G. O'Donnell Interim County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: During a work session on October 28, 2014, staff provided an update on the Social Services Building project, the need to expand the scope of the project to include renovations to the entire building and recommendations for funding the expanded project. Renovations to the Social Services Building in Salem are underway and the construction phase of the project has begun. The current scope of the construction contract with Martin Brothers is to replace the roof, reconfigure the cell providers on the roof and fifth (5th) floor, replace the HVAC system, provide increased fire protection via a sprinkler system, rebuild the parking lot and renovate the fifth (5th) floor office spaces. To complete building renovations to the entire building in one phase, Roanoke County will need to modify existing contracts with Thompson and Litton for design and Martin Brothers for construction since the added work will increase these contracts by more than twenty- five percent (25%) of the amount of the existing contracts, all as required by Section 2.2- 4309 of the Code of Virginia. Advantages of changing the scope of the project include cost savings by eliminating a second bidding process, less disruption in the workplace by shortening the timeframe to complete the total project and by providing a decent workplace for all of the staff and clientele in a shortened timeframe. Page 1 of 2 In an effort to avoid delays in the project, which could lead to higher costs and longer disruption of the workplace for the Department of Social Services, staff recommends approval of the first reading of the ordinance and waiving the second reading upon an affirmative vote of four-fifths (4/5ths) of the members of the Board of Supervisors. FISCAL IMPACT: Funding previously appropriated to the project to date is $3,126,929. Remaining funds needed for the project are $2,042,611 and are as follows: • $292,611 appropriation from the Social Services Department June 30, 2014, year- end rollover $250,000 appropriation from the Social Service Building Fund Operating Account • $1,500,000 as a loan from the Major Capital with funds to be repaid from existing rents and leases over four years beginning in 2015-2016 and ending in 2018-2019 as outlined on attachment A. After the deposit from the June 30, 2014, year-end revenues and the loan to the Social Services building renovation project, the balance in the Major Capital will be $1,090,463. STAFF RECOMMENDATON Staff recommends approving the ordinance appropriating $2,042,611 from various sources for the Department of Social Services building project, authorizing an internal loan from Major Capital, authorizing the County Administrator or designee to execute any documents or take such action as may be necessary to execute modifications of existing contracts associated with the project and dispensing with the second (2"d) reading of the ordinance. The bank was never constructed and the church would like to purchase the parcels back from what is now Union First Market Bank for the purpose of expanding its parking lot. The site is designated as Transition by the 2005 Roanoke County Community Plan. Transition policy encourages the orderly development of highway frontage parcels with a high degree of architectural and environmentally sensitive site design for office, institutional, higher density residential, park and small-scale coordinated retail uses while serving as a buffer between highways and adjacent lower intensity land uses. 1. APPLICABLE REGULATIONS Current zoning is regulated by C-1, Low Intensity Commercial District standards, the 2009 proffered conditions and masterplan (Ordinance #102709-6), as well as the Religious Assembly use and design standards. A Special Use Permit and masterplan from 2008 (Ordinance #102808-12) for Religious Assembly use was approved for a portion of this property. In 2013, the Zoning Ordinance was amended which makes the expansion of an existing Religious Assembly use a by -right use. Site development review and onsite stormwater management are required. Virginia Department of Transportation (VDOT) approval will be required for any changes to or impacts in the right-of-way of Cloverdale Road and Crumpacker Drive. No changes or impacts to the right-of-way are proposed at this time. 2. ANALYSIS OF EXISTING CONDITIONS Background — Union First Market Bank (formerly StellarOne Bank) purchased these four parcels from Bonsack Baptist Church in 2009 after a rezoning from R-1, Low Density Residential District to C-1, Low Intensity Office District with three proffered conditions. The bank was never constructed and Bonsack Baptist Church would like to use the parcels for a parking lot expansion, however the proffered conditions on the property would prevent this from happening. Topography/Vegetation — The property is generally flat and slopes gently upward from the road as well as from the north corner of the property. The property is generally at a similar elevation as other properties adjacent to Cloverdale Road. Surrounding Neighborhood — Surrounding properties are zoned R-1, Low Density Residential, to the north, east and south. Properties to the west across Route 220 and adjacent to Crumpacker Drive are zoned C-1, Low Intensity Commercial. Existing land uses include residential uses to the north and east, Bonsack Baptist Church as well as the intersection of Cloverdale Road and Route 460 is located to the south, and vacant properties across Route 220 on both sides of Crumpacker Drive are located to the west. 3. ANALYSIS OF PROPOSED DEVELOPMENT Site Layout — During a recent site plan review for the construction of an approximately 28,000 sq. ft. multipurpose building with gymnasium, the parking for the entire build -out of the church parcels was calculated to be 484 parking spaces. This determination was made based on the varied uses of the site, which made the standard Religious Assembly parking calculation far too low to meet the church's current needs. The proposed parking lot expansion will serve the 748 seat main worship building as well and the approximately 563 seat multi-purpose building, which is currently under construction. The concept plan included in this application is for illustrative purposes only of what the parking lot might look like on these parcels. The final configuration of the parking lot would be determined during the site plan review process. The proposed parking expansion does require a 30' landscaped buffer next to all adjacent residential properties. A 10 -foot street yard buffer is also required along Route 220. Access/Traffic Circulation — The parking area will be accessed through the existing entrance and parking lot off of Cloverdale Road. No additional entrance is proposed at this time. VDOT review of this request indicated that if an additional entrance is proposed in the future, a traffic impact analysis will be required. Fire & Rescue/Utilities — Fire and Rescue offered no comments on the petition. Economic Development — Economic Development offered no comments on the petition. 4. CONFORMANCE WITH ROANOKE COUNTY COMPREHENSIVE PLAN The site is designated as Transition by the 2005 Roanoke County Community Plan. The church is experiencing growth and is currently running multiple services and is under construction of a new 28,000 sf facility that includes a fellowship hall, family life center and gymnasium. Parking has become increasingly difficult and given the future multiple uses with the new facility additional parking is a necessity. The new parking lot will be used to serve the needs of the community and is appropriate along the Route 604 corridor. The church is an established entity setting precedent as a buffer between Route 604 and residential uses. Site development standards including zoning and stormwater management regulations will be followed to ensure eompatibily with adjoining properties. (A) The purpose of the C-1 low intensity commercial district is to provide for the development of attractive and efficient office and commercial uses in the urban service area which serve both community and county -wide needs. The C-1 district allows for varying intensities of office and commercial development as part of either a planned office complex or, to a limited degree, small scale office and commercial uses. The C-1 districts are most appropriately found along or near major arterial streets where existing commercial development has occurred and/or where commercial zoning has been established, or near existing residential development where it would serve as a logical buffer strip between conflicting land use types. El C-1 District Regulations Height limitations: a. Principal structures: When adjoining property zoned R-1 or R-2, forty-five (45) feet, including rooftop mechanical equipment. The maximum height may be increased, provided each required side and rear yard adjoining the R-1 or R-2 district is increased two (2) feet for each foot in height over forty-five (45) feet. In all other locations the height is unlimited unless otherwise restricted by this ordinance. b. Accessory structures: 15 feet. (D) Maximum coverage. (APPLICATION WITHDRAWN BY PETITIONER) B. CITIZEN COMMENTS Three citizen spoke in favor of the petition. Ten citizens spoke against the petition citing. Majority of issues raised were security and location of proposed use. C. SUMMARY OF COMMISSION DISCUSSION Rebecca James presented the staff report and the representative for the petitioner, Ben Crew, presented a summary of the proposal. In addition, the President of Intercept Youth Services, Mark Bogert, and an employee, Natalie Elliot, spoke at length about the program and plans for the site. Howard Hall, Chief of Police, and Jill Loope, Director of Economic Development, were also present to address questions. Chief Hall addressed the security issues and how IYS was expected to address those concerns. Mrs. Loope described the economic impact the request would have on the area if approved, specifically the loss of an industrial zoned parcel in Roanoke County. Wayne Bower asked several questions of Mr. Bogert and Ms. Elliot, including specifics about the operation IYS owns on Hazelridge Road. Mr. Bogert described the difference in the two facilities and programs. Mr. Bower also inquired about where the youth would go after released from the facility. Mr. Bogert indicated they would return back to their families. The Commissioners also asked about the open house that IYS hosted to provide more information and answer questions of the citizens. Ms. Elliot and Mr. Bogert indicated only 7 people attended, even though the dates and times were heavily advertised. Rick James clarified the Zoning Verification Letter issue and that there was an option to appeal the determination. Mr. Bogert indicated he should have appealed. Jim Woltz asked many questions of the operations of the facility, licensing requirements and levels of service. Ms. Elliott described Page 1 of 2 R-2 the ratio of youth to staff, additional staff required to operate the facility, hours of operation and specifics on the classification of the youth (or patient). Mr. Bower asked what types of security measures will be installed or implemented, mainly to address Chief Hall's earlier concerns. Ms. Elliot described in detail the training required by staff, use of security cameras and lighting and required procedures of trained staff. D. PROFFERED CONDITIONS 1. Permitted uses on-site shall be limited to C2 — General Commercial District with a special use permit for a Halfway House, but NONE of the following uses are permitted on-site: Substance Abuse Rehab, Drug Rehab, Alcohol Rehab, and/or Youth Detention. 2. Six feet tall chain link fencing shall be provided along the entire length of the eastern property line and along the entire southern property line to Airport Road. A minimum eight feet tall chain link security fencing shall be provided for all exterior recreational areas adjacent to the building for the residents. 3. A 15' buffer yard shall be provided along the eastern property line and shall consist of large evergreen trees planted 15' on center. The trees shall be a minimum height of 6' at time of planting. 4. All portions of the facility used for residential purposes shall be locked and secured. E. COMMISSION ACTION Mr. Bower made a motion to deny the petition. The motion carried 5-0. F.
