Gates County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: On December 19, 2014, the Board of Supervisors approved a Resolution directing the County Administrator to "review the administrative policies and practices related to human resources management and assess their effectiveness in ensuring the highest of organizational ethics." The County Administrator was also directed to "address disciplinary procedures as they relate to the performance of County Government employees and to assess the effectiveness of these policies in ensuring fair, equitable and consistent treatment of all employees." The Administrator was directed to produce a report highlighting specific findings, conclusions or recommendations, and to recommend "any policy action deemed advisable for strengthening the ethical standards of the County Government." Background The Roanoke County Employee Handbook is the primary source of reference for information related to the policies and procedures governing employees of the Roanoke County government. The numerous policies and procedures contained in the Employee Handbook serve a wide variety of purposes although they can generally be characterized as defining employment conditions, setting expectations for behavior in Page 1 of 5 the workplace, and/or establishing working conditions. Specific policies and procedures included in the Handbook reference compensation and benefits, use of employee leave, administrative policies (i.e. use of County vehicles), disciplinary procedures, and employee grievance procedures. While employee policies and practices are generally recorded in the Employee Handbook, the Handbook is not the sole source for those rules and actions which govern employment with the County. Most notably, public safety agencies have their own internal policies which are typically more detailed and restrictive than those administered County -wide. Public safety policies and procedures, often referred to as General Orders, are tailored to address the health and safety risks routinely encountered by employees in the public safety profession. The Employee Handbook has occasionally been formally adopted by the Board of Supervisors although there is no specific requirement for the Board to take such an action. The Commonwealth requires local governments to have a personnel "system" as part of the governing structure. Historically, the Employee Handbook has served as evidence of that system although there are numerous other examples of the County's establishment of a system including an adopted budget which contains a detailed pay classification plan. Over time, amendments or changes to the Employee Handbook have occasionally occurred although a comprehensive re -drafting of the document has not been accomplished in many years. The most recent action of the Board to adopt the Employee Handbook in its entirety was on July 10, 2010. Changes to the Handbook are most often brought forward as a result of a legal or administrative concern which warrants revision to a policy. Likewise, departmental policies and procedures are amended from time to time but in most cases revisions are reactive and prompted by a need to address a specific issue. The most recent example of a change to the Handbook occurred in February 2015, when the County's inclement weather policy was revised. Analysis General Observations • An Employee Handbook is routinely a document produced for employees as a reference guide for employment related issues. Conversely, detailed policies and procedures of the employer are typically contained in a "Manual of Administrative Regulations", a comprehensive document describing all matters related to working environment, practices and requirements. An Employee Handbook may cross reference Administrative Regulations (AR's) and utilize Page 2 of 5 AR's to document the source of authority for a policy or procedure but it is commonly not a substitute for the comprehensive document. Roanoke County's Employee Handbook is neither a Handbook nor a set of Administrative Regulations but instead blends characteristics of both. Detailed procedures related to the grievance procedures, for example, are included in the document. Procedures for interpreting, modifying or revising policies are excluded. • The County Attorney has opined that given the Board of Supervisors has previously taken action to adopt the Employee Handbook, any change to the policies and procedures of the Handbook must also be approved by the Board. As previously noted, there is no legal obligation of the Board to adopt specific policies and procedures related to employment. In fact, the Code of Virginia authorizes County Administrators "to prescribe such rules and regulations as he deems necessary or expedient for the conduct of administrative departments or agencies subject to his authority, and he shall have the power to revoke, suspend or amend any rule or regulation of any such department or agency, promulgated by any officer or employee subject to his control, so long as such rules or regulations are not promulgated by the board of supervisors." The current practice of Board authorization of administrative policy revisions creates a practical issue that results in irregular review, few changes, and an outdated set of administrative policies and procedures. Staff typically views modifications to minor policies (i.e. social media policy, credit union participation, employee safety practices, etc.), as of insufficient importance for Board consideration and therefore outdated or impractical polices remain in effect. More substantive administrative policy matters (i.e. inclement weather policy, grievance procedures) may be addressed by the Board but typically these reviews occur in reaction to some conflict or concern rather than as a result of comprehensive, routine review. • The absence of specific County Administrative Regulations (AR's) which provide organizational standards to be adhered to by departments, results in inconsistencies in departmental practices. For example, practices related to the payment of stand-by pay, use of personal vehicles in the performance of work duties, employee recruitment, etc., may vary in their application depending on departmental policy or practice. Inconsistent practices, particularly as they relate to employment practices, create unnecessary legal risks for the County government. Page 3 of 5 Ethics and Ethical Standards • The Employee Handbook makes no specific reference to employee ethics or organizational expectations for ethical behavior. Further, it provides no direction on how employees with ethical questions are to inquire about those issues nor does it direct how ethical concerns are to be resolved. In practice, when ethical concerns are raised, they are typically raised within departmental management structures and guidance provided is by Department Heads and/or other senior managers who do not have the benefit of clear ethical principles and expectations defined by the organization. Disciplinary and Grievance Procedures • Disciplinary procedures are clearly defined in the Employee Handbook with numerous examples of behavior which may result in a corrective response. Disciplinary actions are appropriately scaled so that there is a logical relationship between the offense and the consequence. Further, the Employee Handbook implies a progressive discipline process that involves the use of reprimands, suspensions, demotions and dismissals which again appropriately relates disciplinary action with offense. Procedures for addressing employee discipline issues are also well defined. • Grievance procedures are well stated with both the rights of the employee and the rights of management clearly outlined. There is a well stated process for employees who wish to file a grievance and definition of the actions which are subject to a grievance filing. FISCAL IMPACT: Estimated to be $5,000 depending on requirements for contracted legal review. The review of existing policies and procedures and the development of a County manual of Administrative Procedures will require significant staff time although no additional expense. There may be need for legal review of key provisions of both the Employee Handbook and the Administrative Procedures Manual to ensure compliance with existing local, State and Federal laws. Legal matters that require knowledge of specific knowledge of employment law may be contracted to outside counsel. STAFF RECOMMENDATION: As outlined above, the existing Employee Handbook neither functions fully as a source of information for employees regarding their employment nor a set of administrative policies that provide direction for Departmental practices. Instead, the Handbook represents a hybrid of what might appropriately be two distinct documents. Page 4 of 5 Further, the existing Employee Handbook is void of some key elements, particularly discussion and direction on what constitutes ethical conduct in the performance of responsibilities as a County employee. Employees with ethical concerns or who wish to address questions pertaining to ethical behavior are not provided sufficient resources. Most problematic is the manner in which changes to County policies and procedures related to employment conditions and work environment must be accomplished. County practice has been to request the Board consider and adopt any change to policies related to the administration of our human resources. However, there is no specific requirement for the Board to consider these administrative matters and, as noted, changes to administrative polices have not been routinely forwarded to the Board. The result is many of our existing policies and procedures are outdated, are not of sufficient detail to ensure consistency in application, and may not reflect our current work environment. As a result, I am recommending the following actions: • Specifically designate the County Administrator as the responsible party for the development and implementation of administrative policies and procedures related to employee work conditions and direct the regular routine upkeep of the Roanoke County Administrative Policies and Procedures Manual. • Direct the County Administrator to initiate a comprehensive review and rewrite of the Employee Handbook with focus on the Handbook as an informational tool for employees seeking general guidance on work policies, procedures, ethical conduct and employment conditions. • Direct the County Administrator to develop an Administrative Policies and Procedures manual that provides detailed information on matters that govern the work of employees and Departments. Direct the County Administrator to ensure consistency in the application of policies and procedures to the extent feasible and adherence to all County policies specifically directed by the Board of Supervisors. • Direct the County Administrator to develop and implement a comprehensive ethics training and education program for County employees including a process for addressing and resolving ethical concerns. (Note: this effort is currently underway and is expected to commence in the fall of 2015. All County employees will be provided with information regarding expectations for ethical conduct and guidelines for ethical behavior}. Page 5 of 5 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, AUGUST 25, 2015 RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF ROANOKE, VIRGINIA AFFIRMING THE ROANOKE COUNTY ADMINISTRATOR'S RESPONSIBILITY FOR THE DEVELOPMENT AND PROMULGATION OF PROCEDURES RELATED TO EFFECTIVE ADMINISTRATIVE MANAGEMENT, POLICIES AND PROCEDURES RELATED TO EMPLOYMENT CONDITIONS AND ETHICAL STANDARDS FOR EMPLOYEES OF ROANOKE COUNTY GOVERNMENT WHEREAS, the Board of Supervisors of Roanoke County has previously adopted, amended and revised a handbook for County employees which established the policies and procedures for employment with Roanoke County, and WHEREAS, Chapter 6 of the Roanoke County Charter provides that the Board shall establish a personnel system for county administrative officials and employees, and this personnel system shall include a classification plan for service, a staff development plan, a uniform pay plan and a procedure for resolving grievances for employees, and WHEREAS, Section 15.2-1541 of the Code of Virginia provides for the duties and responsibilities of the County Administrator, which includes various responsibilities for the supervision of County employees, and WHEREAS, by Resolution No. 120914-3 adopted on December 9, 2014 the Board directed the County Administrator to review the various policies, practices and procedures related to human resources management to assess their effectiveness in ensuring the highest of organizational ethics. BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows.. Page 1 of 2 1. That the County Administrator is directed to develop an Administrative Policies and Procedures Manual that provides detailed information on matters that govern the work of employees and departments. 2. That the Board of Supervisors hereby designates the County Administrator as the responsible party for the development and implementation of administrative policies and procedures related to employee work conditions and further directs the regular routine upkeep of the Roanoke County Administrative Policies and Procedures Manual. 3. That the County Administrator is directed to initiate a comprehensive review and rewrite of the Employee Handbook with focus on the Handbook as an informational tool for employees seeking general guidance on work policies, procedures, ethical conduct and employment conditions. 4. F-1 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: August 25, 2015 AGENDA ITEM: Ordinance amending Article II. — Regulation of Open Burning of Chapter 9 — Fire Prevention and Protection of the Roanoke County Code SUBMITTED BY: APPROVED BY: Stephen Simon Chief of Fire and Rescue Thomas C. Gates County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: In accordance with the Clean Air Act, the Commonwealth State Air Pollution Board has revised and enacted new regulations as it relates to open fire burning. The goal of the regulations is to reduce excessive volatile organic compound emissions in the Western Emissions Control Area which incorporates the County of Roanoke. The Fire and Rescue Department Fire Marshal's Office is the mandated agency to enforce the open burn law. Changes to the Commonwealth's open burning regulations that took effect July 15, 2015, reduce the areas of the County that are allowed to have open burns. In most instances, open burning is not permitted if the resident has brush pick-up by the County. The new regulations, while similar to the current County Open Burn Ordinance require our local ordinance to be amended to meet the Department of Environmental Quality (DEQ) State Air Pollution Control Board requirements. In an effort to inform the public of the regulatory change, Fire/Rescue staff have mailed letters to all individuals who had received a burn permit in the last five (5) years. The letter explains the changes and offers assistance to residents who may have questions. Page 1 of 2 FISCAL IMPACT: The fiscal impact is projected to be minimal initially, however a monitoring and review process will be implemented to determine if citizens who no longer have the ability to open burn utilize brush pick-up offered by General Services. ALTERNATIVES: The new regulations are a mandated requirement through the Commonwealth and no alternative is being proposed. STAFF RECOMMENDATION: Staff recommends an amendment to the current County Ordinance to comply with the new regulations. Page 2 of 2 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, AUGUST 25, 2015 ORDINANCE AMENDING ARTICLE II. — REGULATION OF OPEN BURNING OF CHAPTER 9 — FIRE PREVENTION AND PROTECTION OF THE ROANOKE COUNTY CODE WHEREAS, the Commonwealth of Virginia, State Air Pollution Control Board has adopted new regulations for open burning and said regulations are found at 9VAC5 Chapter 130; and WHEREAS, these regulations include a proposed model ordinance for local governments in this Commonwealth to adopt in order to assist local governments in a VOC (Volatile Organic Compound) control area with the development of their ordinances acceptable to the State Air Pollution Control Board; and WHEREAS, if the governing body of any locality wishes to adopt an ordinance governing open burning that ordinance must first be approved by the State Air Pollution Control Board unless that ordinance is identical to the language of the model ordinance; and WHEREAS, Roanoke County adopted its ordinance regulating open burning by Ordinance #092496-6 on September 24, 1996; and WHEREAS, Roanoke County's 1996 ordinance is hereby amended to incorporate the provisions of the model ordinance recommended by the State Air Pollution Control Board; and WHEREAS, the first reading of this ordinance is scheduled for August 25, 2015, and the second reading is scheduled for September 8, 2015; and Page 1 of 10 NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That Article II. — Regulation of Open Burning of Chapter 9 — Fire Prevention and Protection be amended to read and provide as follows: ARTICLE II. - REGULATION OF OPEN BURNING Sec. 9-5. - Title. This article shall be known as the Roanoke County ordinance for the regulation of open burning. Sec. 9-6. - Purpose. The purpose of this article is to protect public health, safety, and welfare by regulating open burning within the county to achieve and maintain, to the greatest extent practicable, a level of air quality that will provide comfort and convenience while promoting economic and social development. This article is intended to supplement the applicable regulations promulgated by the state air pollution control board and other applicable regulations and laws. Sec. 9-7. - Definitions. For the purpose of this article and subsequent amendments or any orders issued by the county, the words or phrases shall have the meaning given them in this section. Automobile graveyard means any lot or place which is exposed to the weather and upon which more than five (5) motor vehicles of any kind, incapable of being operated, and which it would not be economically practical to make operative, are placed, located or found. "Built-up area" means any area with a substantial portion covered by industrial, commercial or residential buildings. Construction waste consists of lumber, wire, sheetrock, broken brick, shingles, glass, pipes, concrete, and metal and plastics if the metal or plastics are a part of the materials of construction or empty containers for such materials. Paints, coatings, solvents, asbestos, any liquid, compressed gases or semi -liquids, and garbage are not construction wastes and the disposal of such materials must be in accordance with the regulations of the Virginia Waste Management Board. Debris waste means stumps, wood, brush, and leaves from land clearing operations. Debris wastes include but are not limited to stumps, wood, brush, leaves, soil and road spills. Demolition waste means that solid waste which is produced by the destruction of structures and their foundations, or both, and includes the same materials as construction waste. For purposes of this regulation, households include single and multiple residences, hotels and motels, bunkhouses, ranger stations, crew quarters, campgrounds, picnic grounds and day-use recreation areas. Household wastes do not include sanitary waste in septic tanks (septage) which is regulated by state agencies. "Industrial waste" means any solid waste generated by manufacturing or industrial process that is not a regulated hazardous waste. Such waste may include but is not limited to waste resulting from the following manufacturing processes: electric power generation; fertilizer/agricultural chemicals; food and related products/by products; inorganic chemicals; iron and steel manufacturing; leather and leather products; nonferrous metals manufacturing/foundries; organic chemicals; plastics and resins manufacturing; pulp and paper industry; rubber and miscellaneous plastic products; stone, glass, clay and concrete products; textile manufacturing; transportation equipment; and water treatment. Landfill means a sanitary landfill, an industrial waste landfill, or a construction/demolition/debris landfill. See Solid Waste Management Regulations 6'�99VAC20-81) for further definitions of these terms. Local landfill means any landfill located within the jurisdiction of a local government. burnina" means the combustion of solid waste without: 1. Control of combustion air to maintain adequate temperature for efficient combustion; 2. Containment of the combustion reaction in an enclosed device to provide sufficient residence time and mixina for comalete combustion: and 3. Control of the combustion products' emission. Open pit incinerator means a device used to burn waste for the primary purpose of reducing the volume by removing combustible matter. Such devices function by directing a curtain of air at an angle across the top of a trench or similarly enclosed space, thus reducing the amount of combustion by-products emitted into the Page 4 of 10 atmosphere. The term also includes trench burners, air curtain destructors and over draft incinerators. "Refuse" means all solid waste products having the characteristics of solids rather than liquids and which are composed wholly or partially of materials such as garbage, trash, rubbish, litter, residues from clean up of spills or contamination or other discarded materials. Sanitary landfill means an engineered land burial facility for the disposal of household waste which is so located, designed, constructed, and operated to contain and isolate the waste so that it does not pose a substantial present or potential hazard to human health or the environment. A sanitary landfill also may receive other types of solid wastes, such as commercial solid waste, nonhazardous sludge, hazardous waste from conditionally exempt small quantity generators, and nonhazardous industrial solid waste. See Solid Waste Management Regulations C872 2 for further definitions of these terms. Smoke means small gas -borne particulate matter consisting mostly, but not exclusively, of carbon, ash and other material in concentrations sufficient to form a visible plume. Special incineration device means a pit incinerator, conical or teepee burner, or any other device specifically designed to provide good combustion performance. "Wood waste" means untreated wood and untreated wood products, including tree stumps (whole or chipped), trees, tree limbs (whole or chipped), bark, sawdust, chips, scraps, slabs, millings, and shavings. Wood waste does not include: 1. Grass, grass clippings, bushes, shrubs, and clippings from bushes and shrubs from residential, commercial/retail, institutional, or industrial sources as part of maintaining yards or other private or public lands. 2. Construction, renovation, or demolition wastes. 3. Clean lumber. "Yard waste" means grass, grass clippings, bushes, shrubs, and clippings from bushes and shrubs that come from residential, commercial/retail, institutional, or industrial sources as part of maintaining yards or other private or public lands. Yard waste does not include (i) construction. renovation. and demolition wastes or (ii) clean wood Page 5 of 10 Sec. 9-8. - Prohibitions on open burning. (a) No owner or other person shall cause or permit open burning or the use of a special incineration device for disposal of refuse except as provided in this article. (b) No owner or other person shall cause or permit open burning or the use of a special incineration device for disposal of rubber tires, asphaltic materials, crankcase oil, impregnated wood or other rubber or petroleum based materials except when conducting bona fide fire fighting instruction at fire fighting training schools having permanent facilities. (c) No owner or other person shall cause or permit open burning or the use of a special incineration device for disposal of hazardous waste or containers for such materials. (d) No owner or other person shall cause or permit open burning or the use of a special incineration device for the purpose of a salvage operation or for the disposal of commercial/industrial waste. (e) Open burning or the use of special incineration devices permitted under the provisions of this article does not exempt or excuse any owner or other person from the consequences, liability, damages or injuries which may result from such conduct; nor does it excuse or exempt any owner or other person from complying with other applicable laws, ordinances, regulations and orders of the governmental entities having jurisdiction, even though the open burning is conducted in compliance with this article. In this regard special attention should be directed to section 10.1-1142 of the Forest Fire Law of Virginia, the regulations of the Virginia Waste Management Board, and the state air pollution control board's regulations for the control and abatement of air pollution. (f) Upon declaration of an alert, warning or emergency stage of an air pollution episode as described in 9VAC5-70 (Air Pollution Episode Prevention) Dart V41ef the reg it dens fer we nnntrnl aAd ahatomon+ .,f ,;r PGII61tiGR or when deemed advisable by the state air pollution control board to prevent a hazard to, or an unreasonable burden upon, public health or welfare, no owner or other person shall cause or permit open burning or use of a special incineration device; and any in process burning or use of special incineration devices shall be immediately terminated in the designated air quality control region. Sec. 9-9. - Exemptions The following activities are exempted to the extent covered by the state air pollution control board's regulations for the control and abatement of air pollution: (1) Open burning for training and instruction of government and public fire fighters under the supervision of the designated official and industrial in-house fire fighting personnel; (2) Open burning for camp fires or other fires that are used solely for recreational purposes, for ceremonial occasions, for outdoor noncommercial preparation of food, and for warming of outdoor workers; Page 6 of 10 (3) Open burning for the destruction of any combustible liquid or gaseous material by burning in a flare or flare stack; (4) Open burning for forest management and agriculture practices and highway construcalcri ana ma r-Iteriance prograrn approved by the State Air Pollution Control Board; and (5) Open burning for the destruction of classified military documents. Sec. 9-10. - Permissible open burning. (a) Open burning is permitted for the disposal of leaves and tree, yard and garden trimmings located on the premises of private property, provided that the conditions are met: (1) The burning takes place on the premises of the private property; and (2) The location of the burning is not less than three hundred (300) feet from any occupied building unless the occupants have given prior permission, other than a building located on the property on which the burning is conducted; and 3. (c) Open burning is permitted for the disposal of debris waste resulting from property maintenance, from the development or modification of roads and highways, parking areas, railroad tracks, pipelines, power and communication lines, buildings or building areas, sanitary landfills, or from any other clearing operations which may be approved by the Roanoke County fire marshal, provided the following conditions are met: Page 7 of 10 (1) All reasonable effort shall be made to minimize the amount of material burned, with the number and size of the debris piles approved by the Roanoke County fire marshal; (2) The material to be burned shall consist of brush, stumps and similar debris waste and shall not include demolition material; (3) The burning shall be at least 500 feet from any occupied building unless the occupants have given prior permission, other than a building located on the property on which the burning is conducted; (4) The burning shall be conducted at the greatest distance practicable from highways and air fields; (5) The burning shall be attended at all times and conducted to ensure the best possible combustion with a minimum of smoke being produced; (6) The burning shall not be allowed to smolder beyond the minimum period of time necessary for the destruction of the materials; and (7) The burning shall be conducted only when the prevailing winds are away from any city, town or built-up area. (d) Open burning is permitted for the disposal of debris on the site of local landfills provided that the burning does not take place on land that has been filled and covered so as to present an underground fire hazard due to the presence of methane gas provided the following conditions are met: (1) The burning shall take place on the premises of a local sanitary landfill which meets the provisions of the regulations of the Virginia Waste Management Board; (2) The burning shall be attended at all times; (3) The material to be burned shall consist only of brush, tree trimmings, yard and garden trimmings, clean burning construction waste, clean burning debris waste, or clean burning demolition waste; (4) All reasonable effort shall be made to minimize the amount of material that is burned; (5) No materials may be burned in violation of the regulations of the Virginia Waste Management Board or the state air pollution control board. The exact site of the burning on a local landfill shall be established in coordination with the regional director and the Roanoke County fire marshal; no other site shall be used without the approval of these officials. The Roanoke County fire marshal shall be notified of the days during which the burning will occur. (E. Sections 9-10.h. through D. notwithstanding, no owner or other person shall cause or permit open burning or the use of a special incineration device from May 1 through September 30. Sec. 9-11. - Permits. Page 8 of 10 (a) When open burning of debris waste (section 9-10(c)) or open burning of debris on the site of a local landfill (section 9-10(d)) is to occur within the county, the person responsible for the burning shall obtain a permit from the county fire marshal prior to the burning. Such a permit may be granted only after confirmation by the county fire marshal that the burning can and will comply with the provisions of this article and any other conditions which are deemed necessary to ensure that the burning will not endanger the public health and welfare and to ensure compliance with any applicable provisions of the state air pollution control board's regulations for the control and abatement of air pollution. The permit may be issued for each occasion of burning or for a specific period of time deemed appropriate by the county fire marshal. (b) Prior to the initial installation (or reinstallation, in cases of relocation) and operation of special incineration devices, the person responsible for the burning shall obtain a permit from the county fire marshal, such permits to be granted only after confirmation by the county fire marshal that the burning can and will comply with the applicable provisions in regulations for the control and abatement of air pollution and that any conditions are met which are deemed necessary by the county fire marshal to ensure that the operation of the devices will not endanger the public health and welfare. Permits granted for the use of special incineration devices shall, at a minimum, contain the following conditions: (1) All reasonable effort shall be made to minimize the amount of material that is burned. Such efforts shall include, but are not limited to, the removal of pulpwood, sawlogs and firewood. (2) The material to be burned shall consist of brush, stumps and similar debris waste and shall not include demolition material. (3) The burning shall be at least three hundred (300) feet from any occupied building unless the occupants have given prior permission, other than a building located on the property on which the burning is conducted; burning shall be conducted at the greatest distance practicable from highways and air fields. If the county fire marshal determines that it is necessary to protect public health and welfare, he may direct that any of the above cited distances be increased. (4) The burning shall be attended at all times and conducted to ensure the best possible combustion with a minimum of smoke being produced. Under no circumstances should the burning be allowed to smolder beyond the minimum period of time necessary for the destruction of the materials. (5) The burning shall be conducted only when the prevailing winds are away from any city, town or built-up area. (6) The use of special incineration devices shall be allowed only for the disposal of debris waste, clean burning construction waste, and clean burning demolition waste. (7) Permits issued under this subsection shall be limited to a specific period of time deemed appropriate by the county fire marshal. Page 9 of 10 Sec. 9-12. - Penalties for violation. Gates County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: The 2007 Roanoke Valley Conceptual Greenway Plan identifies the Catawba Greenway as a link between the Appalachian Trail (AT), the Catawba Village, and the National Forest. Greenways were identified as a high priority need in the Roanoke County Parks, Recreation and Tourism Comprehensive Parks Master Plan. The Catawba Sustainability Center (CSC) is proposing greenway connections and a trailhead that supports economic development and enhances the quality of outdoor recreational amenities, as it provides additional trail connections in the popular McAfee's Knob section of the AT. The proposed trails will provide AT hikers with safer, off-road alternatives for accessing amenities in the Catawba Village such as the Catawba Valley Farmers Market, Virginia Cooperative Extension Office, Homeplace Restaurant, Post Office, and convenience store. Once the trailhead is constructed, cyclists traveling along U.S. Bicycle Route 76 will have restroom accommodations and a wayside rest area. The proposed trails will also provide community residents and AT hikers with access to educational programs available at the CSC. The Virginia Tech Catawba Sustainability Center (CSC) is a research and education center that works to advance environmental stewardship, community engagement, economic growth, and innovative solutions to sustainability challenges. Roanoke County has been working with Virginia Tech since 2007 to support rural economic development for residents Page 1 of 3 in Catawba and conserve agricultural land. Virginia Tech is renovating this historic farm and creating an outdoor learning lab to address sustainability issues through research, teaching, and demonstration. In 2012, Roanoke County secured a partnership for development and maintenance of the Catawba Greenway with Virginia Tech's commitment to a twenty-five year license agreement. This cooperative agreement allows Roanoke County to construct off-road, pedestrian trails at the CSC that connect hikers on the AT with safer means of accessing the Catawba Village and the Catawba Center. Developing this outdoor recreational amenity will promote tourism and protect the view shed of McAfee's Knob, a popular day -hike that remains one of the most photographed sites along the AT. The project also proposes construction of a trailhead at the CSC to provide a secondary AT parking facility, an accessible trail, and a bridge across Catawba Creek. Through coordination with the National Park Service, the Appalachian Trail Conservancy, and Pathfinders for Greenways, a section of the trail located south of Route 311 has been constructed by volunteers. Additionally, a pedestrian bridge over Catawba Creek has been designed and environmental permitting is underway. Funding is needed to complete the trail system, construct a parking lot and restroom facility, and provide accommodations for individuals with mobility issues. FISCAL IMPACT: Staff recommends applying for $154,500 in federal funding to cover the project costs of constructing a parking lot, pedestrian bridge, and trails at the Virginia Tech Catawba Sustainability Center which will require a local match from Roanoke County is the amount of $20,000. The local match will be comprised of departmental funds that will be used to construct the pedestrian bridge. Virginia Tech is contributing cash and in-kind services in the amount of $16,950 for construction of the trail system and improvements for the restrooms. The Pathfinders for Greenways is contributing volunteer labor and cash for construction of the trail system. The Center's 377 -acre property is located in Roanoke County within a critical viewshed of the Appalachian Trail (AT). McAfee's Knob is the most photographed site along the AT and serves as a popular outdoor recreational amenity for residents in the Roanoke Valley and surrounding areas. Roanoke County and Virginia Tech have pledged to construct off-road, blue -blaze spur trails to connect hikers on the AT with safe and convenient means of accessing the CSC and the Catawba Village. Once completed, hikers will have an opportunity to pass by demonstration and research plots at the CSC such as an American Chestnut tree planting, examine a Catawba Creek Stream Lab, and observe a farm incubator program. Additionally, constructing a trailhead at the CSC will provide a secondary parking facility for the congested AT parking lot on Catawba Valley Drive (Route 311) and serve cyclists traveling along Bicycle Route 76. Through coordination with the National Park Service and the ATC, approximately a 3/4 -mile of the trail system has been constructed by volunteers providing a southern spur to the AT, a bridge crossing of Catawba Creek has been designed, environmental permitting is underway, and the Virginia Department of Transportation (VDOT) has approved a pedestrian crossing of Route 311. The ATC has worked with Roanoke County and Virginia Tech to ascertain a northern spur connection to the AT, and the ATC pledges to continue working with the NPS to secure appropriate environmental permits. We are renovating this historic farm and creating an outdoor learning lab to address sustainability issues through research, teaching, and demonstration. In 2012, representatives from Virginia Tech and Roanoke County signed a Memorandum of Understanding agreeing to develop the Blue Blaze Trail on the university property. The County agreed to establish and maintain the footpath with support from the university as needed. Once completed, the trail will connect the Appalachian Trail to the Catawba community by way of the CSC, allowing hikers the opportunity to pass by demonstration and research plots, examine the Catawba Creek Stream Lab, and observe the farm incubator program. A trailhead at the CSC will provide access to the Blue Blaze trail that intersects the Appalachian Trail near McAfee Knob and will allow hikers safe access to the village of Catawba. Members of the community will also reap benefits in that they can utilize the trail for recreation and walking. We have spent many years working with the County, Appalachian Trail supporters, and local residents to make this trail a reality. The Catawba Greenway was not in the original 1995 Greenway Plan. When updating the Plan in 2007, the Greenway Commission recognized that citizens had additional ideas for routes that should be in the plan. Thus, the Catawba Greenway was included in the 2007 Plan as a trail that would serve the Catawba community and the Appalachian Trail (AT) hikers. The Catawba Greenway will connect from the AT south of Rt. 311, drop down to the area near the Post Office, then skirt the fields of the farm toward the east, go up the old Rt. 311 road bed to a beautiful overlook, then wind between the fields and woods to connect back to the McAfee Knob Fire Road right at the "cutover" trail that connects the fire road to the AT. This will provide a five -mile loop trail, as an alternative to hiking to McAfee Knob, will give thru-hikers an off-road route to the attractions in Catawba, and will also provide shorter options for birding, hiking, and study at the Sustainability Center. This route has been developed after years of consultation with the Appalachian Trail Conservancy (ATC), the National Park Service, the Catawba Sustainability Center, and Roanoke County. We have tromped through these fields and woods many times, climbed fences, slipped and slid on scree fields, painted boundary lines, and looked for unusual plants, all in our efforts to find the best route to meet the needs of all the partners. We believe that we now have that route, and, most importantly, we have the commitment and support of Roanoke County, the Appalachian Trail community, and the Catawba Sustainability Center. The trailhead and restroom facility are features that were not needed 10-15 years ago, but are in high demand now. Only through our cooperative partnership with the Tech Farm are we able to provide these critical amenities and new access. As you know, I work with the Pathfinders for Greenways on many trail construction projects in our region. At their meeting on Tuesday, we discussed the budget for this project and their role in providing volunteer labor and equipment for this effort. They whole-heartedly support the project and look forward to completing the trail which they began many years ago. They will be using the Ditch Witch, Vermeer, and Canycom in building this trail, and we appreciate DCR's support in purchasing that equipment. WHEREAS, under the provisions of RTP, Federal funding assistance is requested to aid in financing the design and construction of trails and a trailhead within Roanoke County at the Catawba Sustainability Center owned by Virginia Tech; and WHEREAS, Virginia Tech and Roanoke County consider it in the best public interest to complete the project described in the RTP application to promote tourism and enhance outdoor recreation; and WHEREAS, Roanoke County has a twenty-five (25) year Memorandum of Agreement with Virginia Tech for development and maintenance of the Catawba Greenway at the Catawba Sustainability Center; and WHEREAS, in accordance with the RTP procedures, it is necessary that a request by resolution be received from the Board of Supervisors of Roanoke County authorizing the filing of the grant application to the Virginia Department of Conservation and Recreation (DCR). NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, as follows: Page 1 of 3 1. That it requests the Virginia Department of Conservation and Recreation (DCR) establish a project for the construction and development of approximately three miles of the Catawba Greenway and a trailhead in the Catawba Magisterial District of northern Roanoke County at the Catawba Sustainability Center; and 2. Any funding assistance received be used for implementation and completion of the Catawba Greenway and a trailhead at the Catawba Sustainability Center within the specified grant time frame; and 3. Roanoke County hereby certifies that project funding is currently available and is committed for the completion of this project while seeking periodic reimbursement through the RTP; and 4. Roanoke County is aware that the RTP funding, if approved, will be paid on a reimbursement basis. This means Roanoke County may only request payment after eligible and allowable costs have already been paid to our vendors and evidence of such has been provided to DCR; and 5. Roanoke County acknowledges that the assisted trail project will have an assigned life expectancy assigned to it and that the facility may be maintained to standards suitable for public use; and 6. Roanoke County acknowledges that responsibility for compliance with the National Environmental Policy Act, Endangered Species Act, Historic Preservation Act, Executive Orders 11988 and 11990 (Floodplain Management and Wetlands Protection) and all other applicable state and federal law; and Page 2 of 3 7. Roanoke County acknowledges that the appropriate opportunity for public comment has been provided and evidence of such is a required component for approval; and 8. This resolution becomes part of a formal RTP application to DCR; and 9. That total estimated project cost is $231,480; Roanoke County is requesting $154,500 in Federal funding, which is sixty-seven percent (67%) of the total project costs, to address design, engineering, permitting and construction of new pedestrian trails, a bridge, an accessible trail and a trailhead with restrooms. 10. In accordance with the Virginia Department of Conservation and Recreation's Recreational Trails Program policy, Roanoke County hereby agrees to provide local matching funds in the amount of $20,000, which is nine percent (9%) of the total project costs. Virginia Tech agrees to provide state matching funds in the amount of $16,950 which is seven percent (7%) of the total project costs in cash and in- kind services. The Pathfinders for Greenways, a nonprofit organization, agrees to provide matching funds in the amount of $ 40,030, which is seventeen percent (17%) of the project costs in the form of cash and in-kind services; and 11. If Roanoke County subsequently elects to cancel this project, the County hereby agrees to reimburse the Virginia Department of Conservation and Recreation for the total amount of costs expended by the Department through the date the Department is notified of such cancellation. Gates County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: The Bulletproof Vest Partnership (BVP) awarded the Roanoke County Police Department a fifty percent (50%) matching grant to assist in the purchase of protective vests for law enforcement and correctional officers. The U.S. Department of Justice will fund fifty percent (50%) of the cost of each vest up to a total of $4,944.08 of federal funds. FISCAL IMPACT: This grant requires a fifty percent (50%) match. Funds in the amount of $4,944.09 will come from the Police Department's budget for the required match. Ordinance #052714-4 appropriated grant funds for grants that are routine and usual in nature for the 2014-15 fiscal year. Funds in the amount of $9,888.17 will need to be allocated from the grant account to the Bulletproof Vest Grant for fiscal year 2015. ALTERNATIVES: 1. Accept and allocate funds in the amount of $9,888.17 from the U. S. Department of Justice's Bulletproof Vest Partnership to the Roanoke County Police Department for the 2014 award solicitation. 2. Gates County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: In order to stay in compliance with Virginia Department of Environmental Quality (VDEQ) requirements, Roanoke County must amend two ordinances: Chapter 8.1, Erosion and Sediment Control (ESC); and Chapter 23, Stormwater Management (SWM). Sub -section 23-1.8 of the SWM Ordinance also refers to the SWM Design Manual, which also requires a few amendments. These proposed amendments have been reviewed by VDEQ and the local Roanoke Regional Home Builder Association (RRHBA). Staff will present the proposed amendments to the Board during this work session and discuss the implications of the proposed changes. At a future date, these ordinances will be submitted to the Board of Supervisors for formal adoption following scheduled public hearings. In addition, the staff will present a proposal from the Town of Vinton to administer the town's SWM/VSMP process.
