Good afternoon and welcome to our meeting for December 8, 2015. Regular meetings
are held on the second and fourth Tuesday at 3-00 p.m. Public hearings are held at 7-00
p.m. on the fourth Tuesday of each month. Deviations from this schedule will be
announced. The meetings are broadcast live on RVTV, Channel 3, and will be
rebroadcast on Thursday at 7-00 p.m. and on Saturday at 4-00 p.m. Board of
Supervisors meetings can also be viewed online through Roanoke County's website at
www.RoanokeCountyVA.gov. Our meetings are closed -ca ptio ned, so it is important for
everyone to speak directly into the microphones at the podium. Individuals who require
assistance or special arrangements to participate in or attend Board of Supervisors
meetings should contact the Clerk to the Board at (540) 772-2005 at least 48 hours in

RESOLUTION EXPRESSING THE APPRECIATION OF THE BOARD
OF SUPERVISORS OF ROANOKE COUNTY TO PAUL M. MAHONEY,
COUNTY ATTORNEY UPON THIS RETIREMENT AFTER MORE THAN
THIRTY (31) YEARS OF SERVICE
WHEREAS, Paul M. Mahoney was named County Attorney on June 15, 1984,
and served knowledgably and capably in that capacity for thirty-one years and six
months, until his retirement on December 1, 2015; and,
WHEREAS, Mr. Mahoney also served as Acting County Administrator for a six-
month period during his tenure at Roanoke County-, and
WHEREAS, Mr. Mahoney played an integral role in the growth and development
of Roanoke County as it undertook numerous significant projects, including the
establishment of Roanoke County's Spring Hollow Reservoir, recodification of the
Roanoke County Code of Ordinances, guidance of legislation through the Virginia
General Assembly that granted the Roanoke County Charter in 1986, establishment of
the Roanoke County Police Department, and negotiation of the long-term lease of
Virginia's Explore Park-, and
WHEREAS, Mr. Mahoney also represented the best interests of Roanoke County
as various regional issues arose, such as annexation proceedings with the City of
Salem or discussions with the City of Roanoke concerning possible consolidation; and
WHEREAS, Mr. Mahoney was instrumental in negotiating many of the multi -
jurisdictional projects and agreements now in place, namely siting of the Smith Gap
Landfill and formation of the Roanoke Valley Resource Authority-, creation of the
Western Virginia Water Authority; merger of the Vinton and Roanoke County 9-1-1

Centers; and a partnership agreement with Franklin and Montgomery counties and the
City of Salem to construct and operate the Western Virginia Regional Jail-, and
WHEREAS, working closely with many County department directors and staff,
Mr. Mahoney crafted numerous inter -jurisdictional agreements with the Town of Vinton,
the cities of Salem and Roanoke, and the counties of Franklin and Montgomery-,
negotiated all public-private partnerships and corresponding performance agreements
as well as economic development performance agreements, and represented Roanoke
County in the establishment of the South Peak Community Development Authority; and
WHEREAS, Roanoke County was ably represented by Mr. Mahoney during
challenging times, as in the federally mandated remediation of the Dixie Caverns
Landfill, an Environmental Protection Agency Superfund site, and in the aftermath of the
Keeling Tire Fire, which was the largest tire fire in Virginia-, and
WHEREAS, Mr. Mahoney has adroitly guided the Board of Supervisors of
Roanoke County through many complex and charged issues, such as public prayer at
government meetings, eminent domain, and amendments to the Conflict of Interest Act
and the Freedom of Information Act and, in the process, has become recognized for his
expertise in interpreting and using Robert's Rules of Order for parliamentary procedure-,
and
WHEREAS, Mr. Mahoney has worked effectively and collegially with a wide
spectrum of Boards of Supervisors, comprising twenty-two different individuals with
often diverse philosophies, and is also well known and highly respected by the leaders
and employees of local jurisdictions, as well as numerous state and federal legislators-,
and

WHEREAS, Mr. Mahoney is held in the highest regard by Roanoke County staff,
who have valued his steady leadership, wise counsel, open door policy, and, most
importantly, his caring attitude about Roanoke County and his fellow employees.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of
Roanoke County, Virginia, expresses its deepest appreciation and the appreciation of
the employees of Roanoke County to Paul M. Mahoney for his selfless, loyal, and
dedicated commitment to public service as Roanoke County Attorney for thirty-one
years and six months-, and
FURTHER, the Board of Supervisors expresses its best wishes to Mr. Mahoney
and his family for a happy and fulfilling retirement.

RESOLUTION OF APPRECIATION TO JOSEPH B. "BUTCH" CHURCH
FOR HIS SERVICE AS A MEMBER OF THE BOARD OF SUPERVISORS
FROM 2000 THROUGH 2015
WHEREAS, Joseph B. "Butch" Church was first elected to represent the Catawba
Magisterial District on the Board of Supervisors of Roanoke County in 1999 and served
in that capacity through December 31, 2015; and
WHEREAS, during his sixteen (16) years as a member of the Board, Supervisor
Church served with professionalism and dedication, working on behalf of the people of
his district and all citizens of Roanoke County-, and
WHEREAS, during his tenure as a member of the Board, Supervisor Church
always put his citizens first and served with zeal and dedication, working on behalf of the
people of his district and all citizens of Roanoke County with his steadfast determination
to return every phone call and reply to every email that was sent to him-, and
WHEREAS, Supervisor Church participated on various committees on behalf of
Roanoke County, including the Social Services Advisory Board, Roanoke Valley
Television, School Construction Committee, Virginia's First Regional Industrial Facilities
Authority (alternate) and Western Virginia Regional Jail Authority (alternate).
WHEREAS, Supervisor Church's leadership skills were recognized by his fellow
Board members when he was chosen to serve as Chairman of the Board of Supervisors
in the years 2002, 2010 and 2011 -1 and
WHEREAS, in the course of Mr. Church's tenure with Roanoke County, he helped
bring to fruition the following- the formulation of a joint funding agreement with the School

Board that provided a funding stream for capital improvement projects, renovation of
Glenvar Middle School, Glenvar High School, Northside High School, new Masons Cove
Elementary School, New Public Safety Center in his district, new Glenvar Library,
Completion of Route 11/460 in West County, State Championship signs at Northside High
School and Glenvar High School for the first time in each school's history, new Regional
Fire and Rescue Training center in his district, responded to citizens' request for help and
prevented the closing of Fort Lewis Elementary School two different times in a 5 -year
period, fought for and was instrumental in keeping prayer in Board of Supervisor
meetings during the challenges that occurred in 2012, as an advocate for tax payers,
helped reduce the tax rate on three (3) different occasions with no tax rate increases in
his sixteen (16) -years of service, proposed and passed resolution for aid in freezing the
taxes for elderly and disabled citizens, as Chairman three (3) times, was a strong
advocate for citizens' involvement in Board meetings by allowing citizens the most
opportunities to speak and be recognized in meetings, was a strong believer that local
government truly belongs to the citizens and therefore strived for openness and
transparency in all county business, and truly believed that honesty and accountability is
most important in serving the citizens of Roanoke County.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke
County, Virginia, expresses its deepest appreciation and that of the citizens of Roanoke
County to JOSEPH B. "BUTCH" CHURCH for his commitment to public service,
dedication to the welfare of his fellow citizens, and thoughtful leadership while a member
of the Board of Supervisors-, and
FURTHER, the Board of Supervisors congratulates Supervisor Church at the

Q&A Emergency Snow Operations
What roads are VDOT responsible for clearing?
The agency is responsible for clearing state -maintained roads. All cities and the larger
towns clear their own streets.
VDOT is responsible for the interstates but has outsourced all interstate maintenance,
including snow removal, to private contractors since July 2009 as required by law
enacted by the General Assembly.
How does VDOT prepare for snow and ice season?
VDOT employees across the state stockpile thousands of tons of salt, sand and
chemicals at strategic locations.
VDOT contracts with individuals and companies who have heavy equipment, which is
placed on standby to be used as needed. Contractor supplied hired equipment is used
to complement state forces.
VDOT requires that the agency's personnel have an assignment that supports snow
removal efforts.
How does VDOT pre -treat roads before a snow event?
• Putting dry salt on roads before snow fall wastes time and money since salt can blow off
the pavement. Salt can be mixed with water to create a brine that can be used to pre-
treat roads up to 48 hours before a snow event.
• Brine is only applied to primary roads (those numbered 1-599) but not secondary roads
or neighborhood streets.
• During some smaller events, crews may only brine or apply de-icing abrasives to
selected cooler spots such as bridges or overpasses.
• VDOT cannot use brine to pre -treat roads when temperatures fall into the 20s because it
is too cold for it to be effective.
• VDOT will not apply brine ahead of a winter weather event that starts as rain as the brine
will wash off the roadway.
• Applying brine does not mean roads will be clear once snow starts to fall. Brine helps to
prevent a bond forming between road surface and the snow/ice so it is easier to plow
when the storm starts.
What Roads does VDOT Clear First?
• Roads carrying the most traffic get top priority. The primary roads (those numbered 1-
599) are VDOT's first priority in any winter weather event.
• When snow is falling, snow plows will make repeated passes on the primary roads.
Crews will not plow secondary roads (those numbered 600 and above) until the snow
stops and the primary roads have been plowed and treated.
• Operators focus on the secondary roads with the highest traffic volumes first before
proceeding to routes with lower traffic volumes such as subdivision roads and
neighborhood streets.
• Once working on the secondary roads, crews will return to the primary roads if
conditions change. For example, drifting snow or additional snow fall covers previously
plowed primary roads.
• Residents should not call VDOT to get their road on a list for snow removal. If it is a
state road, VDOT is responsible for clearing it.

How soon will all the roads be passable after a storm?
During a winter weather event, VDOT snow -removal crews work 12 -hour shifts.
VDOT's goal is to make all roads passable within 48 hours after a storm ends. Passable
does not mean bare pavement. It means that a plow has made at least one pass over
every road 48 hours after the snow stops.
How does VDOT treat roads during a storm?
During a storm, VDOT applies several materials to roads to help remove snow and
improve vehicle traction.
Sodium Chloride — For snow and ice control, sodium chloride — or salt — is the most
plentiful and inexpensive de-icing material. Applying salt is most effective after snow
has accumulated on the road surface about an inch and the temperature is above 27
degrees. Under these conditions, the salt and snow will mix, melting the snow into a
slush that can be plowed off the road. Salt is used on primary roads and interstates and
not extensively on secondary roads or neighborhood streets.
Calcium Chloride — An expensive de-icing chemical, liquid calcium chloride is most often
mixed with salt to provide some moisture so the chemical reaction causing melting can
take place. It is used when temperatures fall into the low 20s. At those temperatures,
moisture isn't present to help salt start the melting process. In liquid form, calcium
chloride provides quicker melting action.
Abrasives — VDOT uses small gravel or sand mixed with salt to provide additional
traction and reduce the cost of applying chemicals. Abrasives can be used on roads
generally not treated with chemicals such as secondary roads. De-icing chemicals, such
as salt and calcium chloride, are very detrimental to gravel -surfaced and surface -treated
roads (those pavements with a salt -and -pepper appearance). Chemicals are used very
sparingly on these types of roads and only when absolutely necessary.
Why does VIDOT not use salt on secondary roads?
Salt in any large quantity is not suitable for secondary roads, neighborhood streets and
subdivision routes due to the characteristics of the road. The stone base on secondary
roads cannot handle the large quantities of moisture that salt draws.
Potholes form when moisture seeps into roads and freezes and expands. Using large
amounts of salt on secondary roads will increase potholes and cause the road to break
up.
Why do plows block driveways with snow when they clear the road?
VDOT snowplow operators push the snow off the roadway in smooth continuous passes.
It ends up on road shoulders sometimes blocking driveways.
To avoid extra work, residents are encouraged to shovel snow to the right of driveways
as they face the road as less snow will plow back into the driveway when the plow
passes.

We reviewed all the contractors that signed on last year.
This established a base line for comparison.

SUMMARY OF INFORMATION:
Roanoke County has a Capital Improvement Program (CIP) Committee that has been in
place since August 2004. The CIP Committee is comprised of ten members, five of which
are appointed by the Board of Supervisors and five of which are appointed by various
County Boards and Commissions. Historically, the primary role of the committee has been
to review capital project proposals from County Departments and provide input to the
Board of Supervisors on project priorities. The CIP Committee has had no role in
reviewing and prioritizing the County's annual Operating Budget.
During the fiscal year 2015-2016 budget development process, the County's method for
developing a Capital Improvement Program (CIP) was significantly changed. Those
changes included capital project needs demonstrated over a ten-year period, the
identification of revenue sources to fund proposed projects, and the development of a
County Administrator recommended CIP. The fiscal year 2016-2025 Capital Improvement
Program adopted by the Board of Supervisors reflected these changes.
The changed CIP process has impacted the role of the CIP Committee. The creation of a
ten-year project plan, along with a description of the funding necessary to accomplish the
plan means the Committee's traditional role of providing project recommendations in a
tiered order of priorities is no longer applicable. Further, the development of a specific set
of recommendations from the County Administrator requires increased coordination of the
CIP Committee's input into capital project proposals forwarded to the Board of Supervisors.
Issues related to the role and functioning of the CIP Committee were discussed with the
CIP Committee in early 2015. At that time, staff committed to continue to work with the
CIP Committee to ensure their effective input. Staff also suggested the possibility for

expanded engagement of the CIP Committee on matters related to project funding and
fiscal policies related to capital programming.
On September 24, 2015, a meeting of the CIP Committee was convened to explore their
on-going role as an advisory body to the County. Discussions focused on the current role
of the Committee in reviewing the CIP process, a potential expansion of the Committee's
work scope to include a broader role in advising both the staff and the Board on budget
and fiscal policy matters, and review of the adopted fiscal year 2016-2025 CIP. The
discussion with the Committee was positive and the potential for a changed role of the
advisory group was well received among those who attended the meeting.
As a result of the County's changed approach to budgeting and a desire to maximize the
usefulness of citizen input into the process, staff recommends the Board of Supervisors
transition the CIP Committee to a Budget and Fiscal Affairs Committee (BFAC). The result
of this transition would be an expanded advisory role of the Committee in the fiscal affairs
of the County. Committee members would have an opportunity to expand their input
beyond the capital budget to include discussion of operating budget issues, fiscal policies
of the County and other fiscal matters. Staff would work with the BFAC to provide
information and education on public finance and the Committee's input would be sought
during the development of both the operating and capital budgets.
The establishment of an advisory Budget and Fiscal Affairs Committee will:
Encourage greater understanding of the financial conditions of the County which
determine resource availability for capital projects-,
Promote greater knowledge of the relationship between capital investments and
operating budget impacts-,
Provide citizen input on specific fiscal policies and benchmarks of the County
government including debt ratios and cash contributions to the capital program-,
Provide citizen input into effective development and public presentation of the
Operating Budget-,
Facilitate informed input from citizens regarding the County's operating and capital
budgets-, and
0 Create greater public transparency in the budgetary process.
Attachment A is a draft charter for the Roanoke County Budget and Fiscal Affairs
Committee which details responsibilities, organization and membership.

WHEREAS, Roanoke County has a responsibility to create a transparent budget
process with citizen involvement; and
WHEREAS, the current Capital Improvement Program Committee historically dealt
with only the Capital Budget and did not provide input on the Operating Budget or fiscal
policies-, and
WHEREAS, the Roanoke County Board of Supervisors recognizes the need to
replace the Capital Improvement Program Committee with an advisory group to provide
input on all County budget and fiscal affairs-,
NOW, THEREFORE, BE IT RESOLVED by the Roanoke County Board of
Supervisors of Roanoke Virginia, the creation of the Budget and Fiscal Affairs Committee
and the Budget and Fiscal Affairs Committee Charter is officially adopted-, and
FURTHER, thatthe County Administrator istasked with identifying Roanoke County
citizens for consideration and appointment by the Board of Supervisors to serve on the
Budget and Fiscal Affairs Committee.

Budget and Fiscal Affairs Committee Charter
Purpose
The Budget and Fiscal Affairs Committee (BFAC) is a citizen advisory group appointed by the
County Board of Supervisors to review, analyze and provide informed comment on Roanoke
County fiscal practices and procedures.
Business Function
The Budget and Fiscal Affairs Committee shall provide comment and guidance to the County
Administrator and the Board of Supervisors on the following:
• The use and prioritization of public resources necessary to fund the annual Operating
Budget and the ten-year Capital Improvement Program (CIP);
• Fiscal policies and fiscal benchmarks; and
• Enhancing public understanding and public transparency of fiscal practices.
Membership
Size of the Committee: The Budget and Fiscal Affairs Committee shall be comprised of eleven
(11) members with each Board Supervisor having an appointment, five members appointed jointly
by the Board of Supervisors, and one ex officio appointment representing County Administration.
Representation: The Budget and Fiscal Affairs Committee shall be comprised of a broad range
of citizens of various professional backgrounds with an interest and commitment to the fiscal well-
being of Roanoke County government.
Term of Committee Membership: With the exception of the ex officio member whose term shall
be indefinite, each Committee member shall serve a two-year term beginning September 1 and
expiring on August 31. Members of the Committee subject to a term appointment may be re-
appointed to four consecutive terms. It is the Board's intention to stagger terms to ensure
operational continuity. The Committee shall designate a Chair from its membership who shall
serve a term of one year. A Chair may be appointed to successive terms upon a majority vote of
the Committee members.
Meetings
The Committee will meet monthly at the Committee's discretion typically on the third Thursday of
the month and may meet as frequently as necessary to fulfill its advisory responsibilities.

SUMMARY OF INFORMATION:
In fiscal year 2013, the Board of Supervisors appropriated $84,421 in support of the
Virginia Western Community College Educational Foundation's efforts to provide tuition
assistance for Roanoke County public high school students who desire to enroll in Virginia
Western. The Community College Access Program (CCAP) provides financial assistance
to students who meet entrance requirements of the College but who may not have the
financial means to provide for tuition expense. Since 2014, the County has annually
appropriated $125,000 in support of the CCAP program. Funding provided by the County
is matched by the Virginia Western Educational Foundation, Inc.
While the County has provided funding for the CCAP program through the annual budget
process, a formal agreement between Roanoke County and Virginia Western Educational
Foundation has not been executed. The Virginia Wester Community College Educational
Foundation, Inc., is requesting all local jurisdictions participating in the CCAP program to
formalize their existing relationship through written agreement. The attached agreement
provides written acknowledgement of the County's participation in the CCAP program and
establishes the terms and conditions upon which that participation is based.
Terms and conditions contained in the written agreement are consistent with how the
CCAP program is currently administered with one notable exception. Currently, CCAP
funds provided by Roanoke County are made available only to those students who have
completed their junior or senior years at a Roanoke County public high school. Students
enrolled in private educational institutions or students educated through "home-school" are

not eligible for CCAP funds, regardless of their ability to meet other requirements of the
program. This agreement eliminates the requirement that a student be enrolled in a public
high school thereby granting access to the CCAP program to all local students. CCAP
eligibility criteria related to residency in the County, minimum grade point average,
semester hours, placement testing and completion of federal financial aid documents are
unchanged as a result of this agreement.
FISCAL IMPACT:
Approximately $125,000 per year subject to the annual appropriation of funds.

Authorize the County Administrator to execute an agreement with the Virginia Western
Community College Educational Foundation.

Establishment Agreement
for the
Community College Access Program for Roanoke County
Whereas, Roanoke County (the "Donor") desires to make a gift to the Virginia Western Community
College Educational Foundation, Inc. (the "Foundation"), in support of the continued education of
Roanoke County students through enrollment in the Virginia Western Community College
("Virginia Western"); and
Whereas it is the Donor's intent to award at least $125,000 per fiscal year subject to the annual
appropriation of funds by the Roanoke County Board of Supervisors; and
Whereas, it is necessary to document the intentions and understanding of the parties;
It is hereby agreed:
1. All proceeds from the above -referenced gift shall be held in a scholarship fund, specifically the
Community College Access Program for Roanoke County (the "Scholarship").
2. It is understood and agreed that the Scholarship shall qualify for such matching funds as may
be provided by the Commonwealth of Virginia under the Virginia Graduate and Undergraduate
Tuition Assistance Program, its successor program or any other applicable public or private
program.
3. This Scholarship shall be managed by the Foundation in accordance with the Foundation's
management and accounting policies, which are hereby incorporated by reference as is fully
set out herein.
4. It is understood that administrative fees are assessed on all restricted contributions to assist in
facilitating the scholarship process. Endowed donations are annually assessed a 1.5% fee.
Non -endowed donations are assessed a 5% fee upon the receipt of the gift.
5. Funds from the Scholarship shall provide assistance for academic tuition and related program
expenses, as mutually agreed upon by the Donor and the Foundation. To qualify for the
academic Scholarship, students mustenroll in a minimum of 12 credits per semester, maintain
a cumulative 2.5 GPA, have resided in Roanoke County for a minimum of the two past years,

and have met criteria as determined by the Foundation, which includes, but are not limited to
application for admission to the Virginia Western Community College, completion of the FAFSA
and financial aid process, and completion of the Virginia Western placement tests by the
deadline provided each year.
6. In the event there are any excess distributions available from this fund, the Foundation
may hold any distributions to award additional scholarships in subsequent periods.
7. In the eventthe Scholarship created herein cannot be used forthe purpose intended because
the purpose is no longer appropriate, necessary, practical or possible, or if for other substantial
and lawful reason, the purpose cannot be accomplished, the Foundation may in its sole
discretion use the distributions from the fund for a substantially similar purpose or for such
other purposes aswill fosterand promote the growth, progress and general welfare of Virginia
Western as the Foundation may specify.

CONCEPT PLAN CHECKLIST
A concept plan of the proposed project must be submitted with the application. The concept plan shall graphically depict
the land use change, development or variance that is to be considered. Further, the plan shall address arty potential land use
or design issues arising from the request. In such cases involving rezonings, the applicant may proffer conditions to limit
the future use and development of the property and by so doing, correct any deficiencies that may not be manageable by
County permitting regulations.
The concept plan should not be confused with the site plan or plot plan that is required prior to the issuance of a building
permit. Site plan and building permit procedures ensure compliance with State and County development regulations and

The following is a list of potentially high traffic -generating land uses and road network situations

Verizon Wireless (VZW) is proposing a 158 foot (to the top of the lightning rod) monopole tower on a 64
acre parcel located at 7014 Old Mountain Road in the northeastern portion of Roanoke County. There is
a demonstrable need for coverage in this area. Many citizens do not currently have adequate access to
high-speed, high-quality internet in their homes and businesses or while they travel on nearby roads and
highways. Therefore, the proposed tower will achieve the following:
Enhance the existing wireless network by supporting the latest wireless technologies and provide
coverage to the following:
• Those living in nearby residential neighborhoods;
• Those travelling on Hollins Road, Old Mountain Road and Shadwell Drive;
• Those working in the nearby PCA Roanoke packaging and shipping plant, which is less than 750
feet from the tower site;
• Future industries that may relocate on the large surrounding 1-1, Low Intensity Industrial District,
parcels.
Connect the propagation rings of the following nearby VZW towers and essentially fill the coverage
"hole" (see attached propagation maps):
• Tinker Mountain — Botetourt County - 1896 Tinker Top Road
• Bonsack — Botetourt County — 181 Blue Ridge Boulevard
• Plantation Road —City of Roanoke - 320 Hershberger Road NW

Compatibility with Comprehensive Plan
The Roanoke County Land Use Plan designates the subject property as Principle Industrial. The
Comprehensive Plan defines Principle Industrial as "areas where high technology industries and
research and developmentfirms are present or may develop ". The proposed tower will facilitate existing
industries and promote new industries by providing high quality wireless service in the area, which is a
necessity for "high technology industries".
Chapter 3: Land Use Issues, Design Guidelines, Principle Industrial, Guideline 911, encourages "the
siting of communication antennae and dishes on existing or new structures ". VZW always prefers to
collocate on existing structures; however, there are not any existing towers or structures that are a
sufficient height to meet the coverage objective within this search ring. Therefore, VZW is proposing a
new tower on a parcel designated as Principle Industrial, which is consistent with Guideline Al 1.
Chapter 3: Land Use Issues, Citizen Participation, Implementation Strategies #8, states that "Roanoke
County should provide its citizens the opportunity to interface with each other and the capability to
access all community services through the latest communications technologies". The proposed tower
will provide residents, businesses and travelers in the area access to the latest wireless technologies,
which is consistent with Implementation Strategy 48.
Zoning Ordinance requirements
The subject property is zoned 1-1, Low Intensity Industrial District. In accordance with Article 3, Section
30-61-2(B)(3), Miscellaneous Uses, of the Roanoke County Zoning Ordinance, broadcasting towers are
permitted subject to an approved special use permit. Article 4, Section 30-87-2 of the Zoning Ordinance
regulates broadcast towers. The applicable requirements listed in this section are as follows:
Sec. 30-87-2. - Broadcasting Tower.
(13) Applicability:
These standards shall apply to all new and replacement broadcasting towers within
Roanoke County with the exception that new and replacement broadcasting towers and
associated antenna not exceeding thirty (30) feet in height and located within any
commercial or industrial zoning district shall be permitted by right provided:
a. The proposed tower is a monopole type design;
Ae proposed tower is a monopole design.
b. The general area of the proposed tower is currently served by above ground utilities
including electric power and telephone poles; and
7 -he general area of the tower is served by above ground utilities.
c. All other use and design standards for the construction of the broadcasting tower and
associated facilities are met.
VZW will comply with all other use and design standards for the construction of the
tower andfacilities.
2. No modification to increase the height, size, type or location of any existing broadcasting
tower or associated facilities, excluding antennas, shall be made unless such
modification results in the full compliance of the broadcasting tower and facilities with
all of the requirements of this ordinance.
Not applicable; this is a new tower.
Antennas may be installed on any existing structure within the county, without the
necessity of obtaining a special use permit, provided said antenna does not meet the
definition of a broadcasting tower, does not increase the height of the existing structure
more than ten (10) feet, and does not result in the structure and antenna exceeding the
maximum structure height for that zoning district.
Not applicable; this is a new tower.
4. These provisions shall not apply to any temporary broadcasting tower erected for the
purpose of system design or testing provided the temporary broadcasting tower is erected
for a period not to exceed twenty-one (2 1) days. hi addition, in declared local emergency
situations, the county administrator shall be authorized to allow the temporary
installation of a broadcasting tower for the duration of the local emergency. A zoning
permit pursuant to section 30-9 of this ordinance shall be applied for and approved prior
to erecting any temporary or emergency tower.
Not applicable; this is a permanent tower.
(C) Application requirements:
All potential applicants for broadcasting towers shall consult with county planning staff
at least thirty (30) days prior to submitting an application for a proposed broadcasting
tower. During this consultation the applicant shall present information to the staff on
system objectives, proposed coverage areas, and alternative sites considered and
rejected. The staff shall provide the potential applicant information on Roanoke County
policies and standards for broadcasting towers, and shall discuss with the applicant
possible alternatives to broadcasting tower construction.
VZW had a pre -application meeting with Planning staff on 7113115.
2. In addition to the application requirements contained in section 30-19-2 of this ordinance,
all applicants for broadcasting towers shall provide the following at the time of
application:
1. The location of all other proposed broadcasting tower sites considered and rejected,
and the specific technical, legal or other reasons for the rejection.
In building out its network, VZW first looks to collocate on existing structures
(telecommunications towers, transmission power towers, rooftops, etc.) within a search
ring. VZWplaces a strong emphasis on collocationfor two reasons: 1) it is the desire
of most local governments and 2) it is typically much cheaper than building a new site.
Collocation was not an optionfor thefollowing reasons:
1here are no existing towers within the search ring that would meet the coverage
objective;
VZW is already collocated on all of the closest towers;
7 -he surrounding area is relatively rural and there are no existing structures tall
enough to meet the coverage objective.
2. The location of all other possible collocation sites considered and rejected, and the
specific technical, legal or other reasons for the rejection.
VZW is already collocated on all of the closest towers and there were no other
existing structures within the search ring that are tall enough to meet the coverage
objective.
3. Accurate, to scale, photographic simulations showing the relationship of the
proposed broadcasting tower and associated antenna to the surroundings.
Photographic simulations shall also be prepared showing the relationship of any new
or modified road, access or utility corridors constructed or modified to serve the
proposed broadcasting tower site. The number of simulations and the perspectives
from which they are prepared, shall be established with the staff at the consultation
required in section C. I. above.

4. A computerized terrain analysis showing the visibility of the proposed broadcasting
tower and antenna at the requested height and location. If new or modified road,
access or utility corridors are proposed, the terrain analysis shall also show the
visibility of these new or modified features.

Information on how the proposed site relates to the applicants existing
communication system, including number of other sites within the Roanoke Valley,
and the location of the antenna at each site.
See attached propagation maps showing the relationship of the proposed tower to
VZW's other tower sites within the area.
All broadcasting tower applicants shall be required, at their expense to conduct an
on-site "balloon" or comparable test prior to the planning commission and board of
supervisors hearings on the special use permit. The purpose of this test shall be to
demonstrate the potential visual impact of the proposed tower. The dates and periods
of these tests shall be established with the applicant at the pre -application
consultation.
A balloon test time was conducted on 9117115 (see attached photosimulations
demonstrating the visual impact of the proposed tower).
Written verification that all required submittals to the FAA as required by section
30-87-2(D)6 of this ordinance have been submitted.
VZW is required by Federal law to comply with all FAA requirements when
constructing a new tower. VZW will obtain all required approvals from the FAA
and all other State and Federal agencies.
3. The applicant shall be responsible for all fees associated with the filing of the application
including the reasonable cost of any independent analysis deemed necessary by the county to
verify the need for the new broadcasting tower. The board of supervisors shall establish these
fees, which shall be discussed with the applicant at the pre -application conference.
(D) General standards:
I . The maximum height of any proposed broadcasting tower and associated antenna shall
be made as a condition of the special use permit, but in no case shall any broadcasting
tower and antenna exceed one hundred ninety-nine (199) feet in height. Applicants shall
request the lowest broadcasting tower and antenna height necessary to accomplish their
specific communication objectives.
7 -he proposed tower is 158 feet (to the top of the lightning rod), which is the lowest
height necessary to achieve VZWs coverage objective. It should be noted that the
proposed height will also allow other wireless carriers sufficient height to meet their
coverage objectives.
The setback for any proposed broadcasting tower shall, at a minimum, conform to the
requirements for principal structures for the proposed zoning district. However, in no
case shall the minimum setback from the base of the broadcasting tower to any
residential structure on an adjoining lot be less than forty (40) percent of the height of
the tower, measured from the closest structural member of the broadcasting tower
(excluding guy lines). Guy lines shall be exempt from the minimum setback
requirements in side and rear yards for the respective zoning district, but shall comply
with the setback requirements for the front yard.
7 -he tower is setback 300 feet from the closest residence (7015 Old Mountain Road),
which is approximately 150% of the height of the tower.
3. The minimum setback from any property line abutting a road right-of-way for any other
building or structure associated with a broadcasting tower shall be fifty (50) feet. Such
buildings or structures shall be located a minimum of twenty-five (25) feet from any
other property line.
7 -he tower is setback 213feetfrom the closestproperty line (i. e. frontproperty line) and
over 600feetfrom all otherproperty lines.
4. More than one (1) broadcasting tower shall be permitted on a lot provided all applicable
requirements have been met including setback requirements.

Broadcasting towers shall not be illuminated with any type of lighting apparatus, unless
such lighting is a requirement of the FAA or FCC. When lighting is proposed to conform
to federal requirement, the county shall contact the federal agency to verify the necessity
of lighting, and to determine the minimal amount and type of lighting necessary to
comply with federal guidelines. Security lighting, or a "down lighting" design may be
installed on buildings and structures associated with a broadcasting tower. In no case
shall any lighting violate section 30-94 of this ordinance.
No lighting is proposed with this request.
6. Any proposed broadcasting tower within two (2) miles from any general or commercial
airport or located at a ground elevation at or above two thousand (2,000) feet, average
mean sea level, shall be referred to the appropriate regional office of the FAA for review
and comment prior to filing an application for a special use permit.
See attached TOWAIR, which requires FAA notification and FCC registration. When
constructing a new tower, VZW is required by law to comply with all FAA and FCC
requirements. VZW is currently in the process ofobtaining these approvals and will
provide the approval documents when complete.
7. All broadcasting towers shall comply with any additional requirements established in the
airport overlay district in section 30-72 of this ordinance, and the emergency
communications overlay district in section 30-73.
VZW agrees to comply with any additional requirements established in the airport
overlay district in section 30-72 of this ordinance, and the emergency communications
overlay district in section 30-73, if applicable.
Any broadcasting tower approved shall be structurally designed to carry sufficient
loading, and the site approved shall be sized to accommodate the additional equipment
necessary for at least three (3) other vendors/providers of communications services in
order to minimize the proliferation of new broadcasting towers in the vicinity of the
requested site. hi addition, by applying and being granted the special use permit, the
applicant and the owner of the land agree to make the broadcasting tower and tower site
available for additional leases within the structural capacity of the broadcasting tower
and at reasonable costs adequate to recover the capital, operating and maintenance costs
of the broadcasting tower location required for the additional capacity.
7 -he proposed tower will be structurally designed to carry sufficient loading, and the site
approved shall be sized to accommodate the additional equipment necessary for at least
three (3) other vendorslproviders of communications services. In addition, VZW agrees
to make the broadcasting tower and tower site availablefor additional leases within the
structural capacity of the broadcasting tower.
9. A monopole broadcasting tower design is recommended. The board may approve an
alternative broadcasting tower design if it finds that an alternative type of structure has
less of a visual impact on the surrounding community and Roanoke County, and/or
based upon accepted technical and engineering data a monopole design is not technically
feasible. Cost shall not be a criteria for determining broadcasting tower design.
A monopole tower design is proposed.
10. No broadcasting towers shall be permitted within the critical viewsheds of the Blue
Ridge Parkway or Appalachian Trail as shown on any official map designating these
viewsheds and pre -approved by the board of supervisors. In addition, no towers shall be
proposed within any other designated area of local scenic, historical, ecological and
cultural importance as designated and approved by the board of supervisors prior to the
filing of a tower application.
7 -he proposed tower is not within the critical viewshed of the Blue Ridge Parkway or
Appalachian Trail.
11. By applying and being granted the special use permit, the applicant and the owner of the
land agree to dismantle and remove the broadcasting tower and associated facilities from
the site within ninety days of the broadcasting tower no longer being use for wireless
communications. Dismantling and removal from the site shall only be required after
notice by the County. If antennas on any approved tower are relocated to a lower
elevation, the tower shall be shortened to the height of the highest antenna. A bond or
similar performance guarantee may be required as part of the special use permit
approval. Said guarantee will be in an amount sufficient to ensure removal of the tower
and all associated facilities and the reclamation of the property and road, access and
utility corridors to a condition that existed prior to tower construction.
VZW agrees to dismantle and remove the broadcasting tower and associatedfacilities
from the site within ninety days of the broadcasting tower no longer being usedfor
wireless communications.
12. All broadcasting tower structures and associated hardware, antennas, and facilities shall
be a flat matted finish so as to reduce visibility and light reflection unless otherwise
required by the FCC or FAA.

13. No business signs shall be allowed on the property identifying the name of, or services
offered by, any business associated with the broadcasting tower.

(E) General review policies:
All special use permit requests for new broadcasting towers, including the replacement or modification
of existing broadcasting towers shall be reviewed by the staff, planning commission and board of
supervisors on the basis of the following criteria:
1. The extent to which the broadcasting tower proposal conforms to the general special use permit
criteria in section 30-19 of this ordinance, and the intent, application requirements, and general
standards for broadcasting towers found in these provisions.
7 -he proposed tower will meet or exceed all special use permit criteria in section 30-19 of the
ordinance, and the intent, application requirements, and general standards for broadcasting
towersfound in these provisions.
2. The demonstrated willingness of the applicant to evaluate collocation opportunities within the
proposed communication service area, and the demonstrated history of the applicant choosing
collocation sites within the Roanoke Valley.
In building out its network, VZW first looks to collocate on existing structures
(telecommunications towers, transmission power towers, rooftops, etc.) within a search ring.
VZWplaces a strong emphasis on collocation for two reasons: 1) it is the desire of most local
governments and 2) it is typically much cheaper than building a new site. Collocation was not an

• VZW is already collocated on all of the closest towers;

3. The base and top elevation of the proposed broadcasting tower relative to surrounding natural
land forms. Notwithstanding any other provision of this section, broadcasting tower locations
below surrounding ridge lines are preferred.
]-he proposed tower will be located in a relatively flat area where it will be below surrounding
ridgelines.
4. Broadcasting tower locations already served by existing roads and utilities are preferred due to the
potential detrimental environmental and visual impacts resulting from the construction of new
road and utility corridors.
VZW will utilize an existing gravel road to access thefacility; therefore, a new entrance will not
berequired. VZW will attempt to use existing utilities if available.
Within the needed service area, the availability of other existing structures that are, based upon
independent analysis, of suitable height, design, and location for the needed antenna.
VZW always prefers to collocate on existing structures; however, there are not any structures
within the search ring that are tall enough to meet the coverage objective.
The visibility of the broadcasting tower from the surrounding community and neighborhood
compatibility of the tower as determined by the submitted computer simulations, terrain analysis
and balloon or comparable test.

test, which was conducted on 9117115. Ihese documents show that the proposed tower will have
limited visibilityfrom surrounding streets and residences.
7. The degree to which the proposed tower location, site design and facilities including fencing,

corridors are located, designed and constructed to be compatible with the neighborhood.
Ae wireless facility will have limited visibility. Specifically, the tower site has been located and
designed asfollows to reduce adverse visual effects:
• VZW has chosen a 64 acre property where existing mature trees will surround and screen the
compound on the north, east and west sides;
• VZW has chosen a location on the property where few, if any, trees will need to be removedfor
construction of the compound and access road;
0 VZW is proposing a wood board on boardJence around the entire compound to ensure that the
ground equipment will remain screenedfrom adjacent roads andproperties;
• VZW will utilize an existing gravel road to access the compound- therefore, the viewshedfrom
OldMountain Road will not change significantly with this request;
• Ae tower will be setback over 213 feetfrom Old Mountain Road -

COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
This ordinance accepts the conveyance of three (3) drainage easements, three (3)
parcels of real estate in fee simple, and six (6) quitclaims of interest in real estate to the
Board of Supervisors of Roanoke County, Virginia, for roadway improvements to
Harmony Lane, in the Windsor Hills Magisterial District under the Rural Road Addition
program.
Acceptance of the aforementioned interests in real estate is a necessary step in the
process to have Harmony Lane accepted by the Virginia Department of Transportation
(VDOT) into its secondary system of State highways as a rural addition roadway.
If this ordinance is approved by the Board, a second resolution will be presented to the
Board requesting Harmony Lane be accepted into the State secondary road system.
The first reading of this ordinance was held on November 10, 2015.

FISCAL IMPACT:
There is no fiscal impact. All right-of-ways and easements are being donated. Road
construction funding will be under the secondary, six-year improvement program, rural
addition program.
ALTERNATIVES:
1. Accept the donation of real estate and authorize the County Administrator, or
Assistant County Administrator, to execute such documents as may be necessary to
accomplish this acceptance.
2. Take no action at this time.

WHEREAS, the acceptance of Harmony Lane into the state secondary system of
highways under the Rural Addition Program is funded in partnership with the Virginia
Department of Transportation (VDOT)-1 and
WHEREAS, eight land owners have donated portions of their property to
Roanoke County for additional right-of-way and drainage easements to improve
Harmony Lane and to bring it up to VDOT standards-, and
WHEREAS, Charles F. and Anna Pauley Faggart-1 Mark A. and Marilyn J.
Edwards-, Mark W. and Beth Z. Tamaro-1 David B. Trail-, Steve D. and Michelle Lynn
Conner-, Carolyn W. and Stephen V. Robbins-, Ray C. and Susan B. Childress-, and Fred
R. Mowles have freely and voluntarily entered into deeds to the Board of Supervisors of
the County of Roanoke, Virginia, to allow the Board of Supervisors to obtain ownership
of each property for purposes of road construction upon approval of this ordinance and
recordation of a deed; and
WHEREAS, Section 18.04 of the Roanoke County Charter directs that the
acquisition and conveyance of real estate interests to the County of Roanoke be
accomplished by ordinance-, the first reading of this ordinance was held on November
10, 2015, and the second reading and public hearing was held on December 8, 2015.

NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1 . That the following donations from Charles F. and Anna Pauley Faggart be
and hereby are accepted:
Donation of 0.0047 acre of Roanoke County Tax Map No. 95.02-01-34.00 as
shown on the exhibit attached hereto as "Exhibit A"; being a portion of the
property conveyed to Charles F. & Anna Pauley Faggart by deed dated June
29, 1998, of record in the Clerk's Office, Circuit Court for the County of
Roanoke, Virginia, Deed Book 1599, page 804.
Quitclaim of 0.4840 acre portion of the 50 foot prescriptive easement adjacent

Roanoke County, Virginia, shown and designated as "Existing 50'
Prescriptive Easement (D.B. 1143 PG. 50) to be acquired" further
designated as "Harmony Lane" upon the exhibit dated September 22,
2015 made by the Roanoke County Department of Community
Development, attached hereto as Exhibit "A" and by reference
incorporated herein.
9. That the addition and improvement of Harmony Lane to the Secondary
System of State Highways of the Commonwealth of Virginia under the Rural Road
Addition program is hereby requested upon the conveyance and recordation of the
deeds from the above described land owners to the Board of Supervisors of Roanoke
County, Virginia.
10. That the County Administrator or Assistant County Administrator are
hereby authorized to execute such documents and take such actions on behalf of

SUMMARY OF INFORMATION:
This ordinance repeals an ordinance adopted on December 19, 1989, and adopts a new
ordinance requiring the filing of disclosure statements of economic interests as required
or authorized by the State and Local Government Conflict of Interests Act (the "Act",
Chapter 31 of Title 2.2 of the Code of Virginia.) This Act has been amended several
times since 1989 and a revision is necessary to bring local practice into compliance with
the State Code.
The Board reviewed many of the changes to this Act and their impacts on the Board
and the County in a work session held on October 27, 2015.
This ordinance designates those "persons occupying such positions of "trust" appointed
by the Board who must file the "long form" disclosure statement (Sec. 2.2-3117 of the
Code of Virginia). This proposed ordinance changes the 1989 ordinance by (i) adding
the Assistant County Administrators, Chief Financial Officer, Internal Auditor and
persons serving on the Community Policy and Management Team who do not represent
a public agency to section 1 to the list of individuals-, (ii) deleting the Library Board from
section 2 (since it is only advisory) and the Roanoke County Resource Authority (no
longer in existence, replaced by the Roanoke Valley Resource Authority), and (iii)
adding Western Virginia Water Authority, Roanoke Valley Resource Authority, Western
Virginia Regional Jail, Western Virginia Regional Industrial Facility Authority, Roanoke
Valley Broadband Authority, Roanoke County Economic Development Authority and the
South Peak Community Development Authority to section 2 for filing the "short form"

(Sec. 2.2-3118 of the Code). These authorities were created after the adoption of the
1989 ordinance.
Although this ordinance adds several individuals to the list of persons who must file the
"long form", many of these individuals have been appointed by the Board to various
authorities. Accordingly they must file disclosure forms as a result of such
appointments.
Finally it modifies the filing dates for the disclosure forms to bring them into compliance
with the Act.
The first reading of this ordinance was held on November 10, 2015. The only change
from first reading was the addition of Virginia's First Regional Industrial Facility Authority
to the list to file the short form, as it was inadvertently left off the first reading.

ADOPTING A NEW ORDINANCE REQUIRING THE FILING OF A
DISCLOSURE STATEMENT OF ECONOMIC INTERESTS AND OTHER
SPECIFIED INFORMATION PURSUANT TO SECTION 2.2-3115.A OF
THE CODE OF VIRGINIA
WHEREAS, on December 19, 1989, the Board of Supervisors of Roanoke
County, Virginia, adopted Ordinance No. 121989-13 requiring disclosure of personal
and financial interests of certain County officers, officials, and employees pursuant to
the provisions of the State and Local Government Conflict of Interests Act-, and
WHEREAS, said Act has been amended by the 2014 and 2015 Virginia General
Assembly which enacted the State and Local Government Conflict of Interests Act-, and
WHEREAS, this ordinance repeals and reenacts Ordinance No. 121989-13 and
adopts a new ordinance to conform with the revised State Code-, and
WHEREAS, the first reading of this ordinance was held on November 10, 2015,
and the second reading of this ordinance was held on December 8, 2015
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, that
Ordinance 121989-13 is hereby repealed. Further, a new ordinance requiring the filing
of a disclosure statement of economic interests and other specified information pursuant
to Section 2.2-3115.A of the Code of Virginia be adopted as follows:
1 . That in addition to the members of the Board of Supervisors and the
Constitutional Officers of Roanoke County, Virginia, the following persons occupying
certain positions of trust appointed by the Board of Supervisors and such other persons
employed by the County be, and they hereby are, designated and directed to file as a

business in which such persons own an interest, or from which income is received, if the
primary purpose of the business is to own, develop or derive compensation through the
sale, exchange or development of real estate in the county. Such disclosure shall be
filed as a condition to assuming office or employment, and thereafter shall be filed
annually on or before December 15.
4. That the Clerk of the Board of Supervisors shall cause the forms
hereinabove mentioned to be distributed to the designated individuals at least twenty
(20) days prior to the filing deadline. Such disclosure forms shall be filed and
maintained as public records for five years in the office of the Clerk of the Board of
Supervisors of Roanoke County. Such forms shall be made public no later than six (6)
weeks after filing.
5. The effective date of this ordinance shall be January 1, 2016.

WHEREAS, the street described below currently serves at least three (3) families
and was established prior to July 1, 1992, at which time it was used by motor vehicles
as a public access; and
WHEREAS, the County has determined its subdivision ordinance satisfies
subsection B of §33.1-72.1, Code of Virginia, and is therefore eligible to make qualifying
additions to the secondary system of state highways maintained by the Virginia
Department of Transportation and fund necessary improvements as set out therein,
except as otherwise prohibited by subsection B of §33.1-72.2, Code of Virginia-, and
WHEREAS, after examining the ownership of all property abutting this street,
including the deeds and related plats, this Board finds no restriction on the use of public
funds for improving of the road-, and
WHEREAS, after examining the ownership of all property abutting this street, this
Board finds that speculative interest does not exist" and
WHEREAS, this Board has identified immediately available funding to make
improvements required to qualify the street for addition to the aforesaid secondary
system of state highways, based on the Department's cost estimate of $ 219,531.40.
