Audio and video recordings of this meeting will be held on file for a minimum of five (5) years in the office of the Clerk to the Board of Supervisors. IN RE: OPENING CEREMONIES Before the meeting was called to order a moment of silence was observed. The Pledge of Allegiance was recited by all present. IN RE: CALL TO ORDER Chairman Peters called the meeting to order at 3:01 p.m. The roll call was taken. MEMBERS PRESENT: Chairman P. Jason Peters,Supervisors George G. Assaid, Al Bedrosian, Martha B. Hooker and Joseph P. McNamara MEMBERS ABSENT: None STAFF PRESENT: Thomas C. Gates, County Administrator; Daniel R. O’Donnell, Assistant County Administrator; Richard Caywood, Assistant County Administrator; Ruth Ellen Kuhnel, County Attorney; Amy Whittaker, Public Information Officer and Deborah C. Jacks, Chief Deputy Clerk to the Board IN RE: BRIEFINGS 1. Briefing to discuss with the Board of Supervisors the 2017 Real Estate Reassessment and regional economic conditions (William E. "Billy" Driver, Director of Real Estate; Christopher Bever, Director of Management and Budget; Rebecca Owens, Director of Finance; Jill Loope, Director of Economic Development) Briefing was given. Chairman Peters commented he attended the State of the Commonwealth and was encouraged by the growth of the Roanoke Valley. December 6, 2016 478 IN RE: NEW BUSINESS 1. Request to amend Roanoke County's contract with Whitman, Requardt and Associates (WRA) for engineering services for the Plantation Road project (Richard Caywood, Assistant County Administrator) A-120616-1 Mr. Caywood introduced David Holladay, David Henderson, and Megan Cronise who were in attendance to answer any questions. Mr. Caywod then provided an explanation of the request. Mr. Peters asked for confirmation of no additional funds, with Mr. Caywood responding in the affirmative. Supervisor Bedrosian moved to approve the staff recommendation to amend the contract, which was seconded by Supervisor Peters andcarried by the following recorded vote: AYES: Supervisors Assaid, Bedrosian, Hooker, McNamara, Peters NAYS: None 2. Resolution approving a Cooperative Fire Protection Agreement between the County of Roanoke and the United States Department of Agriculture Forest Service(Stephen G. Simon, Chief of Fire and Rescue) Mr. Simon outlined the request for the resolution. Mr. Simon introduced Peter Lubeck for any legal questions. There was no discussion. RESOLUTION 120616-2 APPROVING A COOPERATIVE FIRE PROTECTION AGREEMENT BETWEEN THE COUNTY OF ROANOKE AND THE UNITED STATES DEPARTMENT OF AGRICULTURE FOREST SERVICE WHEREAS, the Fire and Rescue Department of Roanoke County (the “County”) has the responsibility for the prevention, detection and suppression of structure and other non-wildland fires within the County of Roanoke; and WHEREAS, the United States Department of Agriculture Forest Service (“USFS”) has the responsibility for the prevention, detection and suppression of wildland fires on National Forest administered lands and on adjacent or intermingled State and private forested lands as identified through written agreement; and WHEREAS, portions of the George Washington and Jefferson National Forests are within the jurisdictional borders of the County; and December 6, 2016 479 WHEREAS, it is beneficial for the County and USFS to coordinate their efforts in the prevention, detection, and suppression of wildland fires in and adjacent to their areas of responsibility; and WHEREAS, the County and USFS, pursuant to Section 27-2.1 of the Code of Virginia, desire to enter into a Cooperative Fire Protection Agreement (the “Agreement”) for wildland fire management activities; and WHEREAS, in addition to the Agreement, the County and USFS have further negotiated a Supplement to the Agreement, which includes an annual operating plan, which may foreseeably be changed from year to year; and NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, that: 1. The negotiated Cooperative Fire Protection Agreement between the County of Roanoke and the United States Department of Agriculture Forest Service, is hereby approved; and 2. The County Administrator is authorized to execute such Agreement, upon such form as shall be approved by the County Attorney; and 3. The County’s Chief of Fire and Rescue Department is authorized to execute any supplements to the Agreement, as may be needed, upon such forms as shall be approved by the County Attorney; and 4. This Resolution shall be effective on and rom the date of its adoption. On motion of Supervisor Peters to adopt the resolution, seconded by Supervisor Hooker and carried by the following recorded vote: AYES: Supervisors Assaid, Bedrosian, Hooker, McNamara, Peters NAYS: None IN RE: FIRST READING OF ORDINANCES 1. Ordinance amending Chapter 21, Article III, Section 21-39 of the Roanoke County Code, requiring tax exempt entities to reestablish eligibility for tax exempt status of real property on a triennial basis; and enacting a new Chapter 21, Article II, Section 21-23, requiring tax exempt entities to reestablish eligibility for tax exempt status of personal property on a triennial basis (Peter Lubeck, Senior Assistant County Attorney) Mr. Lubeck outlined the request for the ordinance. There was no discussion. December 6, 2016 480 Supervisor Peters’ motion to approve first reading and set the second reading and public hearing for December 20, 2016, was seconded by Supervisor McNamara and approved by the following vote: AYES: Supervisor Assaid, Bedrosian, Hooker, McNamara, Peters NAYS: None 2. Ordinance accepting the conveyance of sixteen (16) parcels of unimproved real estate to the Board of Supervisors, for the extension of Ivyland Road, Vinton Magisterial District (David Holladay, Planning Administrator David Holladay outlined the request for the ordinance and acknowledged the neighbors who worked on obtaining all the necessary information: Mr. Burwell and Mr. Casey. Supervisor Peters’ motion to approve first reading and set the second reading and public hearing for December 20, 2016, was seconded by Supervisor McNamara and approved by the following vote: AYES: Supervisor Assaid, Bedrosian, Hooker, McNamara, Peters NAYS: None IN RE: CONSENT AGENDA RESOLUTION 120616-3 APPROVING AND CONCURRING IN CERTAIN ITEMS SET FORTH ON THE BOARD OF SUPERVISORS AGENDA FOR THIS DATE DESIGNATED AS ITEM H- CONSENT AGENDA BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: That the certain section of the agenda of the Board of Supervisors for December 6, 2016, designated as Item H - Consent Agenda be, and hereby is, approved and concurred in as to each item separately set forth in said section designated Items 1 through 4 inclusive, as follows: 1. Approval of minutes – November 8, 2016 2. Resolution requesting acceptance of Dawn Marie Court into the Virginia Department of Transportation System 3. Resolution establishing a meeting schedule for the Board of Supervisors of Roanoke County for calendar year 2017 December 6, 2016 481 4. Request to accept and allocate grant funds in the amount of $10,000 from Appalachian Electric Power Economic Development Growth Enhancement Program On motion of Supervisor Peters to adopt the resolution, seconded by Supervisor Hooker and carried by the following recorded vote: AYES: Supervisors Assaid, Bedrosian, Hooker, McNamara, Peters NAYS: None RESOLUTION 120616-3.a REQUESTING ACCEPTANCE OF DAWN MARIE COURT INTO THE VIRGINIA DEPARTMENT OF TRANSPORTATION SECONDARY SYSTEM WHEREAS, the streets described on the attached Addition Form AM-4.3, fully incorporated herein by reference, are shown on plats recorded in the Clerk's Office of the Circuit Court of Roanoke County, and WHEREAS, the representative for the Virginia Department of Transportation has advised this Board that the street(s) meet the requirements established by the Virginia Department of Transportation’s Subdivision Street Requirements, and WHEREAS, the County and the Virginia Department of Transportation have entered into an agreement on March 9, 1999 for comprehensive stormwater detention which applies to this request for addition, NOW, THEREFORE, BE IT RESOLVED, this Board requests the Virginia Department of Transportation to add the street(s) described on the attached Additions Form AM-4.3 to the secondary system of state highways, pursuant to §33.2-705, Code of Virginia, and the Department's Subdivision Street Requirements, after receiving a copy of this resolution and all outstanding fees and documents required of the developer, whichever occurs last in time. BE IT FURTHER RESOLVED, this Board guarantees a clear and unrestricted right-of-way, as described, and any necessary easements for cuts, fills and drainage, and BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to the Residency Administrator for the Virginia Department of Transportation. BE IT FURTHER RESOLVED, this Board hereby guarantees the performance of the street(s) requested herein to become a part of the State maintained secondary system of state highways for a period of one year from the date of the acceptance of the referenced streets by VDOT into the secondary system of state highways. This Board will reimburse all costs incurred by VDOT to repair faults in the referenced streets and related drainage facilities associated with workmanship or materials as determined exclusively by VDOT. Statement of the Treasurer’s Accountability per Investment and Portfolio Policy, as of August 31, 2016 Supervisor Bedrosian commented on the debt and asked the citizens to pay attention to our debt. IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Bedrosian stated that he had a couple of things. Over the last couple of weeks, there have been some issues with towing; the Collision Center and thinks a couple members of the Board maybe got contacted and he would like to ask and was thinking we could put on the agenda an update on how we are doing with the Collision Center and to invite some members of the towing community; members of the insurance community to just discuss it. He thinks it will be good for the public to hear some of the things going on and he loves getting things out into the open and discussing things and the impact that they have in our community. As many people know, we have a new process for dealing with accidents that happen in Roanoke County. The next thing, as always, as we get towards the end of the year, people like donating money and he always tells people to give money to good causes. He continues to get on the United Way a little bit; he likes some of what they do, but strongly urges, since we do help them, that they would stop funding Planned Parenthood and he thinks that is very important. He thinks other work that they do is good and he would urge everybody as we get towards the end of the year that there are a lot of people in need and to really think about how you could help others as we get towards the end of the year. Last thing he wants to talk about is the church that he goes to, Shenandoah Baptist Church, is putting on a nativity presentation; very different than what he has seen in the past. He was a little skeptical in the beginning, but they have a facility called Camp Eagle out in Fincastle and they use many acres to present a nativity and you actually take a tour through it with different set ups from the birth of December 6, 2016 484 Jesus all the way up to an older person and it is very well done and very interesting. Although it has been cold weather Saturday night and raining Sunday, still several hundred people came out each evening; he was very impressed. Also, his daughter is in it and that is another reason to come. Actually, it is a very good presentation and so he invites everybody next Saturday and Sunday starting at about 5:00 pm out there at Camp Eagle. Supervisor Hooker stated she just had a couple of points. First, she would like to applaud our local law enforcement officers when a fallen US Marshall was passing through our area and the body was being laid to rest and the family and the body was coming through in a parade of cars, and many of our local law enforcement officers came by on the overpass and saluted as the body passed by and it was really quite touching, very respectful and she was proud of our people. The second thing is that she was able to attend the Christmas Tree lighting last night and it was just a really great family-friendly event and she was very pleased with the way it was put together. It was outgoing; we have more enthusiasm and growth and that is a good problem to have; not much parking. It was a great event. Supervisor Peters stated he wanted to touch on a couple of things. If you have seen the Roanoke Times today the article talking about our Burton students was a pretty neat article. He does want to reiterate what Ms. Hooker said about the tree lighting last night. He was shocked by the number of people that showed up; they actually delayed the beginning of the presentation last night because there was so many people pouring into the library. He commended the library on opening that facility to us and to Parks and Recreation. The Parks and Recreation employees were helping to navigate all that last night, but it was a great time for all of our families that showed up. He also encouraged everyone to come out to the first ever Roanoke County Christmas Parade that will be this Saturday, December 10, 2016, at 10:00 am. He encouraged his collegues to attend as he has received an invitation to attend and would encourage all of his collegues to be there. It will be on Brambleton Avenue. Chairman Peters recessed to work session on the fourth floor at 4:10 p.m. Chairman Peters called the meeting into session at 4:25 p.m. IN RE: WORK SESSIONS 1. Work session to review with the Board of Supervisors tax-exempt properties and policies (Thomas Gates, County Administrator; Christopher Bever, Director of Management and Budget) In attendance were: Billy Driver, Director of Real Estate Valuation; Ruth Ellen Kuhnel, County Attorney; Peter Lubeck, Senior Assistant County Attorney, Chris Bever, Director of Management and Budget and Rebecca Owens, Director of Finance. December 6, 2016 485 Mr. Gates provided an overview and then turned the meeting over to Chris Bever, who reviewed a PowerPoint presentation. Supervisor Bedrosian asked about tax exempt properties in the land-use program and asked for confirmation that if the land is no longer considered land-use, the County can go and collect the back taxes. Mr. Bever confirmed adding it would probably be covered in a contract for sale. Mr. Gates then outlined the potential next steps adding staff is expecting two requests that will be coming before the Board in January.
